DIVISION 1 – GENERAL CONDITIONS

1.1 SCOPE OF WORK

A. Title of the Project Reroofing of Building B2, Cafeteria at Blanton Elementary School.

B. The Scope of Work to be performed under this project consists of furnishing of all labor/

materials and performing all work necessary to the completion of: Work includes removal of the existing roof system and installation of new modified bitumen roof system and insulation. The extent of the work is outlined in Section 01010 – Scope of Work.

C. All work described in this bid document and drawings prepared by Roof Engineering Associates, Inc.

Drawings can be obtained at the Walter Pownall Service Center in Largo, Florida. D. Dimensions on drawings shall be checked for accuracy by the Contractor. The Contractor shall

determine exact dimensions for proper fit. Drawings shall not be scaled. E. Bidders and all Sub-Contractors shall have the following qualifications:

1. It is mandatory that contractors bidding as prime contractors on projects for the Pinellas County School Board be currently qualified on the date of opening of bids as a Florida Licensed Roofing Contractor by providing a copy of their contractor’s license, a business license for this type of work, and the ability to meet the qualifications as specified in Section 1.2, “Qualifications of the Bidders”.

2. Sub-Contractors shall be licensed within their respective trade and meet the qualifications as specified in Section 1.2, “Qualifications of the Bidders”.

3. Upon the request of the Owner’s representative, furnish documentation of the following:

a. that this firm has available, or can obtain, adequate personnel, equipment and financial

resources to undertake and execute the contract properly and expeditiously, in accordance with the plans and specifications, and in strict accord with recognized standard of quality workmanship;

b. that this firm has a workable construction schedule with reference to number of

manpower to be supplied, expected materials delivery dates, and construction techniques if necessary;

c. that this firm has a list of intended materials suppliers, including alternates which shall be

subject for review and approval by the Owner.

F. The length of the contract shall be for forty five (45) calendar days from the date of the Notice to Proceed. This includes the installation and the ordering of the materials and products specified herein. This time stipulation is very explicit and is essential to the completion of the work specified.

G. The parties agree that it is impossible to determine actual damages resulting from failure to finish the

work on time and therefore the Contractor agrees to pay the Owner, as liquidated damages, and not as penalty, a rate of $250 dollars per day for each and every calendar day elapsing between the time set forth in this section as modified by change order, construction change directive, or Contractor’s Agreement, and the actual date of substantial completion. All "punch list" items shall be completed to owner's satisfaction within thirty (30) calendar days after which the liquidated damages shall be reinstated until final completion.

H. The Special Conditions for this project are as follows:

1.  There  may  be  activities  at  the  facility  during  the  construction  period.    Additional information will be made available during the pre‐bid conference.  It will be the responsibility of the roofing  contractor  to  coordinate  his  work  with  the  Head  Plant  Operator  to  assure  minium  of disruption to the facility’s activities.   The roofing contractor shall perform his operations  in such a manner as to minimize any risk to staff or visitors through the use of construction fencing, signage and other means.    2.  The  jobsite  shall be policed daily with  special attention  to  removing any  loose  fasteners (nails or screws).  Tools, ladders and other items shall not be left on the roof or other areas where they may present a hazard or attractive nuisance.  3.  Demolition work shall be done after normal work hours or weekends.    4.  Since all school facilities are located in Pinellas County, Florida, the asbestos regulations of Pinellas County require removal of all roofing materials by a Florida Licensed Asbestos Abatement Contractor  and/or  roofing  contractor  that meets  the  requirements  of  Florida  Statute  469 which reads as follows:  

a.  Licensure as an asbestos contractor  is not  required  for  the moving,  removal, or disposal of asbestos‐containing roofing material by a roofing contractor certified or registered under part I of chapter 489, if all such activities are performed under the direction of an onsite roofing supervisor trained as provided in s. 469.012. 

b.  If any  silver  flashing  is  found positive or a  rotary blade  is used,  then a  ten day notification  to  the  Pinellas  County  Building  Department  (formally  Environment Department)   is required.  

c.  The  abatement  /  roofing  contractor must provide Pinellas County  Schools with asbestos  disposal manifest  indicating which  landfill  has  received  the  asbestos.  Payment may be delayed if this is not provided.  Please note that roofing material may be friable or non‐friable. Friable material must go to a class one landfill. Non‐friable material may be accepted by a C&D landfill if they choose to accept it.  

  d.  Asbestos survey must be onsite at all times.  

1.2 QUALIFICATIONS OF THE BIDDERS

A. Bidding Entity: Any sole proprietor, firm, partnership, or corporation submitting a proposal for the specified work.

B. The Bidding Entity shall hold all active licenses specified in Section 1.1, Scope of Work, prior to bid

due date. C. The Bidding Entity shall provide documented evidence of experience doing roofing (type of project

defined), including five of projects within five years. Projects provided as evidence with the Bidding Entity’s proposal shall be of comparable size and scope of work.

D. The Bidding Entity shall provide documented evidence of maintaining a business license under the

same legal entity for a period of at least five (5) continuous years, unless otherwise specified in Section 1.1, Scope of Work, prior to the bid due date. “Legal entity” is defined as the same company, corporation, partnership, or sole proprietorship that is a successor-in-interest to the previous entity. In the case of a separate, successor-in-interest entity, that entity must have maintained a business license for a period of five (5) continuous years prior to this bid.

E. The Bidding Entity shall have a place of business for contact by the Owner during normal working

hours on normal working days. Home operated businesses are permitted provided contact can be made as specified.

F. Sub-Contractors used by the Bidding Entity are subject to review by the Owner. Sub-contractors shall provide evidence of work experience doing the (specified work from paragraph C), for a period of at least five (5) continuous years, and shall provide documented evidence of maintaining a business license under the same legal entity for a period of at least five (5) continuous years, unless otherwise specified in Section 1.1, Scope of Work, prior to the bid due date.

A proposed Subcontractor’s list shall be submitted with the Bidding Entity’s bid proposal. If the

Owner has a good and sufficient reason, the Sub-Contractor may be rejected, requiring an alternate Sub-Contractor, acceptable to the Owner, be used without additional cost to the Owner.

1.3 CONTRACT PERIOD

A. The length of the contract is specified in General Conditions, Section 1.1, Scope of Work. B. If necessary, work may be performed after School or on weekends, as long as such activities are

coordinated with the School Principal and approved by the Project Leader. If the overtime is for the convenience of the Contractor, it shall be charged to the Contractor at a rate equal to the School employee’s current hourly rate and a Change Order from the Contractor’s Purchase Order shall deduct the amount. When overtime is requested of School employees, the request shall be made to the Project Leader at least two (2) working days in advance.

C. All Special Conditions such as the availability of the specified work site, and completion of work are

specified in General Conditions, Section 1.1 Scope of Work.

1.4 LIQUIDATED DAMAGES

Inasmuch as time is of the essence in the performance of this contract, failure to complete the project within the time agreed upon shall result in substantial injury to the Owner. It is hereby agreed to by all parties that if the project is not substantially complete on time the Contractor shall pay the Owner, as reasonable compensation for such delay, and not as penalty, a rate of as specified in General Conditions, Section 1.1, Scope of Work for each and every calendar day elapsing between the length of the contract specified therein, as modified by change order, construction change directive, or Contractor’s Agreement, and the actual date of substantial completion. It is further agreed that the Owner may deduct from the balance retained by the Owner, the amount of such liquidated damages incurred of such portion as the retained balance shall cover.

1.5 PROTECTION OF PERSONS AND PROPERTY

A. The Contractor and PA/E shall be responsible for reviewing the Asbestos Management Plan with the Owner prior to initiation of work.

B. The Contractor shall be responsible for initiating, maintaining and supervising all safety precautions

and programs in connection with the performance of the contract. C. All property of the Owner including but not limited to curbs, driveways, sidewalks, planters, play

courts, drainage structures, manholes, and underground piping, shall be assumed to be in sound undamaged condition at the beginning of this construction contract. All such items shall therefore be left in a corrected or reconstructed to a sound undamaged condition by the Contractor at his own expense unless, before work commences, he/she identifies to the Owner's Representative and the PA/E that such items were damaged prior to commencing construction. Such previously identified items shall be recorded in writing to both parties, together with copies of photographs made by the Contractor (as may be practical), prior to beginning of construction.

D. When use or storage of hazardous materials or equipment or unusual methods is necessary for execution of the work, the Contractor shall exercise utmost care and shall carry on such activities under supervision of properly qualified personnel. No explosives shall be used or stored on the site.

E. The Contractor shall be fully and solely responsible (accepting the liabilities and responsibilities of

his/her Sub-Contractors are not hereby eliminated) for all matters of safety of person and property arising from this contract.

Neither the PA/E nor the Owner or any of their representatives or employees are to be assumed to have any role of responsibility of matters of safety except they (including the PA/E, School Principal or Facility Director) shall have the authority to order stopping of a portion of the work which they notice may endanger students, faculty, School District employees or the public, or employees of the Contractor or Sub-Contractors. However, safety shall not be their responsibility but shall be solely the responsibility of the Contractor.

F. The Contractor shall take reasonable precautions for safety of, and shall provide reasonable

protection to prevent damage, injury or loss to:

1. Employees on the work site and other persons who may be affected thereby;

2. The work and materials and equipment to be incorporated therein, whether in storage on or off the site, under care, custody or control of the Contractor or the Contractor’s Sub-Contractors or Sub-Sub-Contractors; and

3. Other property at the site or adjacent hereto, such as trees, shrubs, lawns, walks, pavements,

roadways, structures and utilities not designated for removal, relocation or replacement in the course of construction.

G. The Contractor shall give notices and comply with applicable laws, ordinances, rules, regulations and

lawful orders of public authorities bearing on safety of persons or property or their protection from damage, injury or loss.

H. The Contractor shall erect and maintain, as required by existing conditions and performance of the

contract, or as identified by the PA/E reasonable safeguards for safety and protection, including but not limited to posting danger signs and other warnings against hazards, promulgating safety regulations and notifying the owners and users of adjacent sites and utilities.

I. The Contractor shall promptly remedy damage and loss (other than damage or loss insured under

property insurance required by the contract documents) to property caused in whole or in part by the Contractor, a Sub-Contractor, a Sub-Sub-Contractor, or anyone directly or indirectly employed by any of them, or by anyone for whose acts either of them may be liable, even though not directly attributable to the fault or negligence of the Contractor. The foregoing obligations of the Contractor are in addition to the Contractor’s obligations under the Indemnification paragraph.

J. The Contractor shall designate a responsible member of the Contractor’s organization at the site

whose duty shall be the prevention of accidents. This person shall be the Contractor’s superintendent unless otherwise designated by the Contractor in writing to the Owner and PA/E.

K. The Contractor shall not load or permit any part of the construction or site to be loaded so as to

endanger its safety or to damage such.

L. The Contractor shall take all steps necessary to protect the students, faculty and general public from injury due to construction. Unsafe conditions, equipment, or work practices shall not exist at any time. Fences, signs and barricades shall be provided at Contractor’s expense to keep public and students away from the construction site. The Contractor shall not perform work when students are in the area, such as class period changes, activities, etc. Work causing interference with School classes or activities is to be halted until acceptable conditions exist. The Contractor shall coordinate with the School Principal, and shall make every attempt to move School activities away from the construction site. However, if this cannot be arranged, the class activity takes priority and the Contractor shall reschedule his work.

M. The Contractor is to provide OSHA-approved construction equipment, hand tools, power tools,

ladders and scaffolding at all times. Equipment with safety defects is to be removed immediately from the construction site and work is not to be resumed until a safe condition exists.

N. Workers are to be properly trained and licensed for the job they are doing. The Contractor or his

supervisor/foreman shall be on the construction site at all times work is underway. Working foremen on jobs over $50,000 shall not be considered proper supervision, unless approved in writing by the Project Leader.

School Board Uniform Building Code Inspectors and Project Leaders have the authority to stop construction whenever, in their opinion, safe conditions do not exist.

1.6 ADMINISTRATION OF CONTRACT

A. The contract shall be administered by the School Board of Pinellas County, Walter Pownall Service Center, 11111 South Belcher Road, Largo, Florida 33773.

B. The School Board of Pinellas County shall designate the Project Leader/Liaison and Inspector(s) as

may be applicable. C. The Project Leader shall have complete responsibility for the administration of the contract.

All clarifications, changes, questions and conflicts concerning the project shall be brought to the attention of the Project Leader for resolution and/or approval. The PA/E, if assigned, is the interpreter of all contract documents which he/she prepared.

1.7 DEFINITIONS

A. THE OWNER

The School Board of Pinellas County, Florida. The words OWNER, BOARD or SCHOOL BOARD may be used interchangeably.

1. THE OWNER'S ROLE:

a. The Owner shall furnish information, services and decisions under the Owner's control with reasonable promptness.

b. The Owner shall make payments to the Contractor in accordance with the terms of this

contract. c. The Owner shall issue a “Notice To Proceed” form to the Contractor before moving onto

the site of work.

d. The Owner may order the Contractor to stop the work, or any portion thereof, until the cause for such order has been eliminated, or if the Contractor fails to correct the work or persistently fails to carry out the work in accordance with the requirements of the contract documents.

e. However, the right of the Owner to stop the work shall not give rise to a duty on the part of

the Owner to exercise this right for the benefit of the Contractor or to any other person or entity.

f. The Owner shall have the sole authority to determine whether to modify the contract time

completion date.

g. For projects for which there is no PA/E, the Owner shall perform the function of the PA/E.

B. THE PROJECT ARCHITECT/ENGINEER (PA/E)

The properly licensed individual or firm or entity practicing as a Registered Architect and/or a Registered Professional Engineer in Florida whose name, address, telephone and fax numbers are found on the cover page of this document.

1. ROLE OF THE PROJECT ARCHITECT/ENGINEER (PA/E):

The role of the Project Architect/Engineer (PA/E) including services provided, duties, and responsibilities are defined in the agreement for Professional Architectural/Engineering services for this project and include but are not limited to:

a. The PA/E shall provide estimates of construction costs.

b. The PA/E shall review bid submittals for compliance with plans and

specifications.

c. The PA/E will make periodic visits to the work site at intervals appropriate to the progress of the construction (or otherwise agreed to by the PA/E in writing). Activities shall include but not be limited to the following: 1. Attend the pre-construction conference, 2. Prepare and print minutes of all meetings and distribute to the appropriate parties, 3. Provide special inspections required by the Maintenance Department in accordance

with the Contract documents, 4. Review shop drawings for compliance with Contract documents, 5. Attend job site meetings as dictated by the scope and size of the construction

Project, 6. Review applications for payment by the Contractor, 7. Prepare change orders and/or field orders, 8. Prepare punch lists, inspect completed work and edit punch lists as conditions

warrant, 9. Issue and sign Certificates of Substantial Completion,

10. Issue and sign Certificates of Final Inspection, 11. Review and approve project close-out documents.

d. The PA/E shall be the representative of the Board during the construction phase and shall advise and consult with the Board as to all phases of construction. Instructions from the Maintenance Department or Board to the Contractor shall be forwarded through the PA/E.

e. The PA/E shall have authority to act on behalf of the Board only to the extent provided for in the Contract documents, unless otherwise modified by written mutual agreement.

f. The PA/E shall visit the site at intervals appropriate to various stages of construction and become generally familiar with the progress and quality of the work performed by the Contractor and to determine and advise the Board whether the work is proceeding in accordance with the Contract documents.

g. The PA/E shall review, approve, or take other appropriate action upon the Contractor’s

submittal of documents, including, but not limited to, shop drawings, project data and samples, but only for compliance with the design concept of the work and with the information given in the Contract documents. Such action by the PA/E shall be taken with reasonable promptness so as to cause no delay to the Project. The PA/E's approval of specific items shall not indicate approval of any assembly of which the item is a component.

h. The PA/E shall review and approve all payment requests from the Contractor. This review will include an evaluation of the current work progress against the project schedule to ensure that all work is being completed as required. The PA/E shall certify the Contractor’s applications for payment based upon the percentage of the construction completed at the Project in accordance with the plans and specifications.

i. The PA/E shall determine the amounts owed to the Contractor based on observations at the site. After evaluating the Contractor’s application for payment, if the PA/E approves, the PA/E shall sign the certificate and forward it to the Project Leader. The failure of the PA/E to forward to the Board the completed submittal and all required backup data, or if the certificate (or request for payment) is incorrectly prepared or contains arithmetic errors, the Board may reject the Contractor’s pay application and return it to the PA/E without penalty to the Board because of delay or error.

j. The PA/E shall invite and include the Project Leader to review meetings and to review inspections during the time when the Contractor’s applications for payment are evaluated by the PA/E.

k. The PA/E shall provide for special inspection and testing of materials and systems at Board expense that are included in the Construction Contract.

l. The PA/E shall keep the Board (Project Leader) informed as to the progress and quality of the work and endeavor to guard the Board against defects and deficiencies in the work by the Contractor or his Sub-Contractors and material suppliers.

m. The PA/E shall conduct appropriate observations to determine the dates of Substantial and Final Completion, receive and forward to the Board written warranties and documents required by the construction Contract and certify the final certificate of payment in affidavit form, certifying that to the best of his knowledge the Project has been constructed according to the final plans and specifications and SREF of the DOE's rules and regulations and that all mandatory requirements of DOE have been satisfied.

n. The PA/E shall have the authority and duty to reject work by the Contractor that does not conform to the Contract Documents. If the PA/E observes faulty materials or workmanship at the Project, or if the PA/E observes use of improper material or any work not being accomplished in a satisfactory manner by the Contractor or Sub-Contractors, the PA/E shall immediately notify the Contractor and the Maintenance Department.

o. The PA/E shall exercise due diligence to protect the Board against defects and deficiencies in the work and use of improper materials by the Contractor and Sub-Contractors.

p. After Substantial Completion of the work, the PA/E shall furnish the Board with a certified statement, in affidavit form, that in his professional opinion, the Project has been performed and finally completed according to the Contract documents and SREF of the DOE's rules and regulations and that all mandatory requirements of the DOE have been satisfied.

q. The PA/E shall interpret the requirements of the construction Contract documents. The

PA/E shall render such interpretations as are necessary with reasonable promptness when written request is made by the Board or the Contractor. The PA/E shall render written decisions, within seventy-two (72) hours, on all claims, disputes and other matters questioned by the Contractor or the Project Leader relating to the execution or progress of the work or the interpretation of the Contract documents.

r. The PA/E shall ensure that the Board is provided correct, as-built or record drawings

from the Contractor.

s. The PA/E shall provide one (1) set of specifications (unbound with no signature or seal) for duplication, one (1) set of original drawings in MYLAR also for duplication, and three (3) signed, sealed and dated copies of Project Specifications and Drawings. (Specifications will be in booklet form.) Also, one set of drawings on disk using AUTOCAD and one copy of specifications on disk in Word shall be provided.

t. The PA/E shall be the interpreter of the intent of the contract documents and shall be the authority to determine whether the work of the Contractor is in accordance with this intent.

u. The PA/E shall have authority to determine the quantity of work performed and whether such work complies with the intent of the contract documents; shall observe the Contractor’s work and shall endeavor to guard the Owner's interest and safeguard the Owner from risk of liability, lawsuit or fine.

v. The PA/E shall attend and coordinate all weekly/bi-weekly construction progress meetings.

w. The PA/E shall prepare and submit to the Owner construction progress reports, including as a minimum, weekly/bi-weekly construction progress meeting minutes, schedule changes, and a Project Work summary based upon the Contractor’s Daily Construction Reports.

x. The PA/E shall have the authority to stop portions of the work of the Contractor in the event, in the opinion of the PA/E, work is being done in a manner which is unlawful (according to either Federal or Florida Law or Statutes or Rules) or which puts the Owner at risk in regards to liability, or which may be injurious to life and health, or in a manner contrary to the intent of the Contract Documents.

y. The PA/E may initiate changes to the scope of the work under this contract by a Change Order (subject to Owner's approval and a Contractor’s Agreement) when the Contractor and the Owner are in agreement. If the Contractor does not agree, the Owner and the PA/E may sign and issue a Construction Change Directive (subject to Owner's approval and a new Contractor’s Agreement) to effect a change or an increase in scope in which a change in contract sum and time judged fair by the Owner and the PA/E shall become a part of the contract and shall be made a part of a Contractor’s Agreement.

z. In the event a Construction Change Directive is issued for which the Contractor does not agree to the cost change or time change or to other terms, the Contractor shall retain his right to further negotiate or litigate for additional compensation, BUT THE CONTRACTOR SHALL IMMEDIATELY PROCEED TO COMPLY FULLY WITH THE TERMS OF THE CONSTRUCTION CHANGE DIRECTIVE and, until otherwise resolved, the Owner shall make payments in accordance with the terms of the Construction Change Directive.

aa. The PA/E shall observe and monitor the work of the Contractor. The PA/E shall have authority to reject work which does not conform to the contract documents.

bb. The PA/E shall have authority to stop the work if a responsible Superintendent of the

Contractor is not on the site. Should the PA/E stop the work for reasons in paragraph "x" or "aa" above, the Contractor shall have no right of claim against the Owner or PA/E.

cc. The PA/E shall have authority in the event the Contractor fails to complete the work within the contract time, to recommend to the Owner's Representative to declare the Contractor in default.

dd. The PA/E shall have the authority to order the removal of any person or workman he deems to be detrimental to the work or who fails to adhere to suitable rules of behavior.

ee. The PA/E shall submit an AHERA Certification for the Absence of Asbestos Containing Building Materials upon project completion.

C. THE CONTRACTOR

The properly licensed person or firm or entity who is identified in the Contractor’s Agreement and who is referred to throughout the contract documents as if singular in number and masculine in gender. The term Contractor (or this Contractor) shall mean the Contractor or his authorized representative.

1. THE CONTRACTOR’S ROLE:

a. The Contractor shall do all work set forth in the drawings and specifications together with work described in any addendum issued during bidding, or change in the contract requirements made by Field Order, Change Order or Construction Change Directive.

b. The Contractor shall do all work in strict accordance with the requirements of the contract documents. The Contractor shall supervise and direct the work, providing full time on-site supervision of all employees including Sub-Contractors.

c. The Contractor shall be responsible to the Owner for acts and omissions of the Contractor’s employees, Sub-Contractors and their agents and employees and other persons performing portions of work under a contract with the Contractor.

d. The Contractor shall directly, or by subcontract, provide for labor, materials, equipment, tools, construction equipment and machinery, transportation and other facilities and services necessary for proper execution and completion of the work.

e. The Contractor shall enforce strict discipline and good order on the site among the Contractor’s employees and other persons carrying out the contract. The Contractor shall not permit employment of unfit or untrained persons or persons not skilled in tasks assigned to them in his plant or on the site for work on this project.

f. The Contractor shall be responsible for the quality control of the construction provided under this contract. It is his responsibility to assure that appropriate systems and processes are in place to assess and measure the quality of construction called for in these plans and specifications. He shall have these processes in place prior to the start of construction and be prepared to discuss them at the pre-construction conference if appropriate. He shall provide results to the project leader upon request.

g. The Contractor shall be responsible to ensure that all work is installed in a neat and workmanlike manner. Any work deemed unacceptable by the Owner or PA/E shall be corrected at the Contractor’s expense in a timely manner.

D. DEPARTMENT OF EDUCATION (DOE)

The Florida State Department of Education (DOE) establishes and interprets (in accordance with Florida Statutes), rules, regulations, codes and procedures to be adhered to in planning for and in construction contracts for the School Districts of Florida.

E. RULE - SREF

(STATE REQUIREMENTS FOR EDUCATIONAL FACILITIES)

The Rule promulgated by DOE--Administrative Rule Chapter SREF which, together with Federal Laws and Florida Statutes govern matters under this contract.

F. SUBSTANTIAL COMPLETION

The Date of substantial completion of the work or designated portion thereof (under this contract) is the date certified by the Project Architect/Engineer that the work is sufficiently complete, in accordance with the contract documents, so the Owner can occupy or utilize the work thereof for the use for which it was intended.

G. CLOSE-OUT DOCUMENTS

"Close-Out Documents" are those items that must be properly executed and delivered to the Owner's Representative via the PA/E in "one package" before final payment is made.

H. PUNCH LIST

A list prepared at the inspection scheduled to establish substantial completion which shall have each page signed by a designee of the Contractor, of the PA/E, of the Representative of the Owner, and the School Principal (or Facility Director) listing items of work identified as being still incomplete or requiring correction. The PA/E shall have the authority to determine whether an item shall be included on the punch list. Copies of the signed punch list shall be distributed immediately after signatures to all those signing with the original and one copy transmitted to the designee of the Owner's Representative. The original shall be filed by the Owner's Representative as an official public document. For this project, filing with the Secretary to the School Board shall be considered as being filed as a public document.

I. CHANGE ORDER

A change to the terms of the contract requirements agreed to and signed by the Contractor, the Owner and the PA/E. Such instrument, used in conjunction with an additional Contractor’s Agreement, shall be used when the parties agree to the change in the contract sum, contract time, quality or in quantity of work.

J. CONSTRUCTION CHANGE DIRECTIVE

A change to the terms of the contract requirements to which the Contractor does not agree, signed by the Owner and the PA/E, and used in conjunction with an additional Contractor’s Agreement. The Contractor must proceed with all due haste to do such work but retains his rights for later negotiation or litigation as to charges for such work or for time extensions.

K. CONTRACTOR’S AGREEMENT

The written authority between the School Board and the Contractor that defines the responsibilities of each party in relation to the scope of work involved in the project which includes but is not limited to, specifications, purchase order, bid documents, and plans and the contract.

L. SUB-CONTRACTOR

A person, firm or entity that has a direct contract with the Contractor to perform a portion of the work at the site or to fabricate work elsewhere for this project.

M. PROJECT LEADER

The person responsible for the administration of the contract on the School Board's behalf. He will assume the responsibility of the PA/E when a PA/E is not utilized on a project.

1.8 TERMINATION OR SUSPENSION OF CONTRACT

A. In addition, the Board may terminate the contract if the Contractor:

1. Refuses or fails to supply enough properly skilled workmen and supervisors;

2. Fails to make payment to Sub-Contractors for materials or labor in accordance with the respective agreements between the Contractor and the Sub-Contractor;

3. Disregards laws, ordinances, or rules, regulations or orders of a public authority having

jurisdiction;

4. Otherwise is guilty of breach of a provision of the contract documents.

5. Fails to provide supervision of Employees and Sub-Contractors. B. When any of the above reasons exist, the Owner, upon certification by the PA/E that said reasons

exist without prejudice to any other rights or remedies of the Owner and after giving the Contractor and the Contractor’s Surety written notice that such reasons exist, terminate employment of the Contractor if the Contractor fails within seventy two (72) hours of the receipt of the written notice to initiate timely corrective actions acceptable to the Owner to ensure that deficiencies are corrected, the Owner may, subject to any prior rights of the Surety (if any): 1. Take possession of the site and of all materials, equipment, tools and construction equipment

and machinery thereon owned by the Contractor;

2. Accept assignment of subcontracts; and

3. Finish the work by whatever reasonable method the Owner may deem expedient. C. When the Owner terminates the Contractor for one of the reasons stated in subparagraphs above, the

Contractor shall not be entitled to receive further payment until the work is finished.

D. If the unpaid balance of the contract sum exceeds costs of finishing the work, including

compensation for the PA/E's services and expenses made necessary thereby, such excess shall be paid to the Contractor. If such costs exceed the unpaid balance, the Contractor shall pay the difference to the Owner. The amount to be paid to the Contractor or Owner as the case may be, shall be as certified by the PA/E, upon application, and this obligation for payment shall survive termination of the contract.

E. SUSPENSION BY THE OWNER FOR CONVENIENCE: The Owner may, without cause, order

the Contractor in writing to suspend, delay or interrupt the work in whole or in part for such period of time as the Owner may determine.

F. NO DAMAGE FOR DELAY

If the Contractor is delayed at any time in the progress of the Work by any act, or neglect of Owner or by any Contractor employed by Owner, or by changes ordered in the scope of the work, or by fire, adverse weather conditions not reasonably anticipated, or any other causes beyond the control of the Contractor, then the required completion date or duration set forth in the progress schedule shall be extended by the amount of time that the Contractor shall have been delayed thereby.

However, to the fullest extent permitted by law, the Owner, Owner’s Agents and employees shall

not be held responsible for any loss or damage sustained by Contractor, or additional costs incurred by Contractor through delay caused by Owner, Owner’s Agents, or employees, or any other Contractor or Subcontractor, or by abnormal weather conditions or by any other cause, and Contractor agrees that the sole right and remedy therefore shall be an extension of time.

The Contractor shall make any claim for extension of time in writing to the Owner, for approval by the Owner, within seven (7) days after commencement of the delay. Contractor's failure to give such written notice to Owner shall deprive the Contractor of his right to claim an extension of time and any damages or additional costs incurred by Contractor resulting from such delay. In the case of a continuing cause of delay, only one claim shall be necessary. The giving of such notice shall not of itself establish the validity of the cause of delay or of the extension of time for completion.

G. If the Contractor has furnished Bonds, and if the Contractor’s Surety is directed to complete the

work, then all payments made after termination of the Contractor shall be made to the Surety until (or jointly to the Surety and Contractors if the Surety so directs) the work is finished and the contract sum has been expended. The Surety shall then be responsible for all of the obligations and duties of the Contractor under the contract and shall be bound by the conditions of the contract to fulfill all obligations of the contract in exchange of the balance of the contract sum yet unpaid by the Owner. The Surety may not assign those obligations without the written consent of the Owner. The Surety shall be responsible for the payment of all costs relating to the termination of the employment of the Contractor, including compensation for the PA/E's additional services and expenses made necessary by these matters. The amount to be paid to the Surety or Owner, as the case may be shall be certified by the PA/E, upon application, and this obligation for payment shall survive termination of the employment of the Contractor.

H. Before the Owner shall be obligated to make any payments to the Surety, all such Sub-Contractors

and suppliers shall be paid currently in proportion to the sum previously paid by the Owner to the Contractor.

I. If the Surety has failed to pay a Sub-Contractor or supplier, the Owner may withhold a sum equal to twice the amount claimed by the Sub-Contractor or supplier and shall not be obligated to pay the Surety such sum in order to properly protect the Sub-Contractor or supplier until the Surety has presented evidence satisfactory to the Owner that (a) the Surety has contracted with another party to complete or correct or replace the work by such Sub-Contractor or supplier, or (b) taken definitive steps to bring the matter to a fair resolution. Definitive steps may be interpreted to mean either a lawsuit has been filed or binding arbitration proceedings between the Contractor (or Surety if applicable) and the Sub-Contractor have been initiated and a hearing scheduled. The Owner shall have no obligation to fund the Surety's responsibilities to pay Sub-Contractors or suppliers fair and proportionate shares of sums previously paid by the Owner to the Contractor.

J. If the Surety fails within ten (10) days to initiate and to continue to proceed with a diligent and full

faith effort assuring and manning of the job, the payment of obligations, the resolution of disputes, the providing of substitute Sub-Contractors where necessary, as approved by the PA/E and the Owner's Representative, and the general overall effective pursuit of the work toward a satisfactory completion, the Owner may, at his option, stop the Surety from proceeding, declare the Surety in default and in breech of contract and undertake the completion of the work by other means. In such event, the Surety shall be liable for all costs in excess of the current contract sum including, but not limited to additional services of the PA/E, legal services, court costs and interest upon such additional costs from the time demanded until the time paid, and any penalty a Court assesses.

1.9 INDEMNIFICATION

A. To the fullest extent permitted by law the Contractor shall indemnify and hold harmless the Owner, the PA/E, and agents and employees of any of them from and against claims, damages, losses and expenses, including but not limited to attorneys' fees, arising out of or resulting from performance of the work, provided that such claim, damage, loss of expense is attributable to bodily injury, sickness, disease or death, or to injury to or destruction of tangible property (other than the work itself) including loss of use resulting there from, but only to the extent caused in whole or in part by negligent acts or omissions of the Contractor, by a Sub-Contractor, or by anyone directly or indirectly employed by them or anyone for whose acts they may be liable, regardless of whether or not such claim, damage, loss or expense is caused in part by a party indemnified hereunder.

B. Such obligation shall not be construed to negate, abridge, or reduce other rights or obligations of

indemnity which would otherwise exist as to a party or person described in this paragraph. C. The Contractor agrees that one (1) percent of the bid amount shall be the specific consideration for

paragraph A above. D. In claims against any person or entity indemnified under this paragraph an employee of the

Contractor, a Sub-Contractor, anyone directly or indirectly employed by them or anyone for whose acts they may be liable, the Indemnification obligation under this paragraph shall not be limited by a limitation on amount or type of damages, compensation or benefits payable by or/for the Contractor or a Sub-Contractor under workers' or workmen’s' compensation acts, disability benefit acts or other employee benefit acts.

E. The obligations of the Contractor under this paragraph shall not extend to the liability of the PA/E,

the PA/E's consultants, and agents and employees of any of them arising out of:

1. The preparation or approval by the PA/E of maps, drawings, opinions, reports, surveys, Change Orders, Construction Change Directives, Field Orders, design or specifications, or

2. The giving of or the failure to give directions of instructions by the PA/E, the PA/E's

consultants, and agents and employees of any of them provided such giving or failure to give is the primary cause of the injury or damage.

F. In consideration of the term of this contract and the terms set forth herein, exchanged each with the other and acknowledged by execution of this contract via the proposal and acceptance by insurance of the Contractor’s Agreement, both the Owner and the Contractor have agreed to the terms of Indemnification set forth herein this paragraph. The Contractor’s Surety (if any) is similarly bound to the terms of this paragraph.

1.10 INSTRUCTION TO BIDDERS

To receive full consideration, all bids must be executed and submitted in strict accordance with these "Instructions to Bidders."

A. CONTRACT DOCUMENTS

1. CONTRACT DOCUMENTS, (including bidding documents) may be examined as indicated in the public announcement at the specified location. Bidders are encouraged to pick up one (1) complete set of contract documents as soon as possible and prior to pre-bid conference.

2. All CONTRACT DOCUMENTS must be returned to the source from which they were obtained

and shall remain the property of the School Board.

3. Refund of any deposit, if required, less the cost of replacement of any damaged or missing items, may be obtained upon return of the documents, in a usable and legible condition, to the School Board. Deposits will be returned in a timely manner after bid opening.

4. Those Bidders not returning documents in the manner described above shall forfeit their deposit,

if any. 5. Additional copies of the CONTRACT DOCUMENTS (including the bidding documents) may

be purchased from the School Board, at the cost of reproduction and handling. A refund shall not be made for return of purchased CONTRACT DOCUMENTS.

B. BIDDER'S PRESENTATION

1. Each Bidder, by submitting his bid, represents all of the following:

a. That the Bidder has thoroughly examined all of the contract documents and is aware that his work may be shown on any one or more of the sheets comprising the set of Drawings or as called for in the Specifications, and that the bid proposal shall include all work shown, or specifically called for, or, as may be reasonably implied as necessary to execute and complete this contract;

b. The Bidder has made a complete examination of the site of the project, and familiarized himself with all of the conditions under which he is obliged to operate in the performance of the contract; the Bidder shall completely familiarize himself with the site of work and local conditions that may, in any manner, affect the work to be done;

c. The bid is based upon all materials, equipment described in the Drawings and Specifications or as may be reasonably implied, and;

d. The Bidder is familiar with all Federal, State and Local regulations having jurisdiction over the construction of the project, and these rules and regulations shall apply to the contract throughout and shall form a part of these Specifications the same as if rewritten in full here. Upon request, Contractor shall provide Owner such documentation as may be required to verify compliance with State and Federal laws, rules and regulations as may be applicable to the service to be performed by the Contractor.

C. INTERPRETATION OF CONTRACT DOCUMENTS

1. The PA/E shall be the interpreter of the intent of the contract documents (i.e., plans and specifications that have been prepared).

2. Any interpretation or correction shall be issued to all Bidders in addendum form by the PA/E

and distributed through the Purchasing Department, and only such written interpretation shall be binding. No Bidder shall rely upon nor shall the Owner be obligated by any interpretation or correction given by any other method. Such addendum shall become part of the contract documents when the contract is executed.

3. All Bidders requiring further information or requesting interpretation of the contract documents

regarding any ambiguity, inconsistency or error therein shall make a request to the PA/E.

D. SUBSTITUTIONS

1. Throughout the contract documents certain items of material, equipment, processes or systems have been specified by trade names and/or model numbers in order to establish a quantity and performance level as a uniform basis for bidding. If a Bidder proposed to substitute materials or manufacturer's equipment in lieu of those specified, they shall submit a written request including all necessary documentation for evaluation of the proposed substitutions to the PA/E for approval no later than ten (10) days prior to the date for receipt of bids.

2. Acceptance of such proposed substitution shall be at the discretion of the PA/E, with the

approval of the School Board designee, and any and all decisions shall be final. Should the proposed substitution be accepted, it shall be incorporated into contract documents by form of addendum issued to all holders (of the documents) of record.

3. The PA/E shall have no authority to allow later substitutions during the construction phase

without written approval of the School Board designee on the specific item.

E. MATERIALS

All materials supplied by the Contractor shall be new and in current production.

F. PERMITS, PERMIT FEES, LAWS, ORDINANCES

1. This project is not subject to any building permits or fees related thereto, for construction on the site except in the case of demolition projects. See sub-paragraph "H" below relating to demolition.

2. Charges made by local municipalities or the county for connections to water and sewer system

shall be borne by the Contractor (through his appropriate Sub-Contractors). 3. Sewer or water service impact fees, if applicable, shall be paid directly by the Owner. 4. The Contractor is required to be familiar with and comply with all Federal, State and Local laws,

ordinances, rules and regulations that in any manner affect the work, especially those involving waste disposal.

5. The Contractor’s attention is called to Section 255.04 Florida Statutes, which requires that on

public building contracts, Florida products and labor shall be used wherever price and quality are equal.

G. COORDINATION WITH BEGINNING OR CONTINUING SCHOOL OPERATIONS

1. Each Bidder shall be assumed to understand the necessity to minimize interruption and disruption to School operations and the educational process. The Contractor shall consider such requirements in preparing his proposal.

2. Each Bidder shall be assumed to have read and understood the requirements of phasing and

scheduling which may be set forth in the specifications and drawings.

H. DEMOLITION

1. "Demolition" means the wrecking or taking out of any load-supporting structural member of a building together with any related handling operations or the intentional burning of any building.

2. Contractor shall be responsible for filing a "Notice of Asbestos Removal Project” form for all

demolition projects regardless of whether asbestos is present. This form shall be turned into the Pinellas County Office of Air Quality in Clearwater and to the Department of Environment Protection in Tallahassee at least ten (10) days prior to the commencement of demolition activities. A copy must also be provided to the School Board Project Leader.

3. The Pinellas County School Board shall be responsible for surveying any structure scheduled for

demolition for asbestos. A written copy of the asbestos survey shall be provided to the demolition Contractor for submission with the notification form.

4. A copy of the asbestos survey must be kept on site and made available for inspection during all

demolition activities. 5. Any noted Regulated Asbestos Containing Material shall be removed by a School Board

appointed asbestos abatement Contractor prior to demolition. If any non-regulated asbestos containing materials (i.e. floor tile) remain within or on a structure, at the discretion of the School Board Project Leader and the School Board Asbestos Program Manager, it shall become the Demolition Contractors responsibility to use proper wet methods during the demolition process and to haul and dispose of the waste in a manner in accordance with all Local, State and Federal regulation.

1.11 ASBESTOS ABATEMENT

A. The Contractor and PA/E shall be responsible for reviewing the facility Asbestos Management Plan prior to initiation of work.

B. The Contractor shall be aware of and follow all federal and State regulations with regard to any

asbestos-containing material. C. The Pinellas County School Board shall be responsible for surveying all equipment and structures

for asbestos. A written copy of the asbestos survey shall be provided to the Contractor. D. It is the responsibility of the Contractor and the PA/E to identify asbestos requiring abatement prior

to beginning the project. In addition, the Contractor shall verify that all asbestos has been abated prior to starting any work.

E. All asbestos abatement shall be the responsibility of the Owner. F. For all projects involving demolition as defined in Section 1.10.R, “DEMOLITION”, the Contractor

shall meet all requirements specified therein.

G. If at any time the Contractor should discover or become aware of any material or substance suspected to be or contain asbestos materials, he/she shall:

1. STOP ALL work in affected areas. 2. Notify the Owner and P/AE verbally and in writing. These notifications shall clearly identify

the area(s) (e.g., Building Name, Building No., Room No., space, etc.) including the time, date, and the nature of the discovery.

3. Barricade all access to affected areas. 4. DO NOT re-enter affected areas until written notification is received from the School Board.

1.12 PRE-BID CONFERENCE

A. A mandatory pre-bid conference shall be held on the site as identified in the advertisement or "Invitation to Bid" form.

B. Contractors intending to bid as prime Contractors shall attend for the purpose of seeing the site of

work, submitting questions and requesting interpretations of the contract documents, which they have obtained beforehand.

C. All interpretations and clarifications given verbally shall be issued as an addendum to the Project

Specification to all attending the pre-bid conference. D. Failure to attend the pre-bid conference and to sign the sign-in sheet shall result in non acceptance

and disqualification of the bid. E. Contractors shall sign in at the main office, where they shall be directed to the designated meeting

area. No one shall be admitted to the meeting area after the designated start time indicated in the "Invitation to Bid." The official time source shall be the Project Leader.

1.13 PRE-CONSTRUCTION CONFERENCE

A. A Pre-construction conference at the construction site is mandatory and shall be attended by the Principal and/or Head Plant Operator, Project Leader, General Contractor and/or Superintendent.

B. The object of this conference is to ensure all parties are fully knowledgeable of the scope of work

and schedule of buildings to be repaired and/or replaced Work areas shall be designated and safety problems, including ingress, egress, and general coordination required shall be outlined.

C. A site walk shall be made and plans and specifications fully discussed. Project date shall be

confirmed and material storage and handling established. Starting date of construction shall not be allowed unless all parties attend this conference.

D. School coordination shall include location of sanitary facilities for Contractor’s people, parking

areas, areas for material storage, construction trailers, construction offices, traffic patterns and controls, construction fencing, barricading and creation of dust free areas.

E. Contractor for the work, per CONTRACTOR’S CONSTRUCTION SCHEDULES, Specification

Section 1.16, will prepare a construction.

1.14 NOTICE TO PROCEED, EFFECTIVE DATE OF INSURANCE AND BOND COVERAGE

A. The effective date of the contract shall be considered as the date of the Purchase Order or Notice To Proceed to the Contractor. The Contractor shall not actually move onto the site of work until he has acquired all insurance (and any Bonds) required by the terms set forth herein, the coverage set forth in the Certificate of Insurance (and Bonds, if any) has been approved by the Owner and a pre-construction conference has been conducted. In addition, the Contractor must obtain a written Notice To Proceed from the Owner.

B. Certificates of required insurance (and any Bonds required) shall be acquired by the Contractor

immediately upon notification of the Owner's award of the contract.

1.15 STANDARD REQUIREMENTS

A. The Contractor shall maintain a copy of the project plans and specifications including all changes on the job site at all times. Copies of the plans and specifications shall be made available to all Sub-Contractors.

B. The frequency of the Construction Progress Meetings shall be at the discretion of the Owner. Meeting

frequency will be based on the complexity of the project and work schedule progress. Weekly/Bi-weekly Construction progress meetings shall be attended by the Contractor and the Foreman for all Sub-Contractors.

C. The Contractor shall complete a Daily Construction Report. The report shall be left with the facility

Head Plant Operator (HPO). D. The Contractor shall provide and maintain in a neat and sanitary condition such portable

accommodations for the use of his employees as may be necessary to comply with regulations of the State Board of Health. No nuisance shall be permitted.

E. Temporary wiring for the work under this contract shall be provided by the Contractor and shall meet

all safety requirements of the National Electric Code, Florida Department of Commerce, Bureau of Workers' Compensation, OSHA and local requirements. In addition, all such wire shall be so sized that such is not overloaded according to the National Electric Code, and any wire used shall be protected by fuse or circuit breaker and, if used to provide electric power to tools, shall be protected by ground-fault protective device to adequately protect the wire, tools, equipment, and workers according to Code.

F. The Contractor shall provide an adequate number of outlets and each outlet shall be properly and

clearly labeled with the maximum voltage and over-current protection. G. Where temporary exterior lighting or outlets are used, the outlet shall consist of weatherproof socket

properly insulated and provided with a locking type wire guard. H. All devices and outlets shall be properly grounded. I. Storage and work areas: At the start of the operations the Contractor shall make arrangements with

the PA/E and the Owner's Representative for the assignment of storage and work areas. During construction the Contractor shall maintain the areas in a neat condition.

J. Contractor’s field offices: Trailers may be used for field offices. Trailer space, if provided, shall be

adequate for the PA/E and Owner's Representative as well as for the Contractor. K. Additional instructions regarding Construction Facilities are set forth in the Drawings and

Specifications.

L. There shall be no interruption of alarm systems, intercoms, emergency or exit lighting, or automatic

operation of fire doors or smoke compartmentalization doors, or the blocking of or inhibiting access to any exit way except with prior approval by the Owner's Representative.

M. The Contractors performance will be evaluated at the completion of the project. This evaluation will

be used in selection of Contractors for future projects.

1.16 CONTRACTOR’S CONSTRUCTION SCHEDULES

A. The Contractor, promptly after being awarded the contract, shall prepare and submit for the PA/E's and the Owner's Representative's information and approval, a construction schedule, and an all inclusive list of Sub-Contractors to be hired. The schedule shall not exceed the time limits under the terms of Division 1 - General Conditions, Section 1.1 Scope of Work.

B. The schedule shall identify all activities necessary to complete work including the sequence of

operation and the duration (e.g., estimated and actual start and completion times) for each activity/task. The schedule completion must be the same as the contracted completion date or before.

C. The work schedule shall be promptly revised by the Contractor and submitted to the PA/E at

appropriate intervals as required by the conditions of the work and Project including all delays and changes in scope. As a minimum, the schedule shall be updated prior to each weekly/bi-weekly construction progress meeting.

D. Failure of the Contractor to submit the original work schedule or to update, revise and submit the

subsequent schedules, shall be sufficient grounds for the PA/E, at his option, to find the Contractor in substantial default of the contract and to certify to the Owner that sufficient cause exists to terminate the contract, or to withhold payment to the Contractor until a schedule or schedule update acceptable to the PA/E is submitted to the PA/E and to the Owner's Representative by the Contractor.

E. The Contractor shall conform to the most recent schedule. F. The Owner and PA/E shall develop an inspection schedule based upon the work schedule. The

Contractor shall notify the Owner at least forty-eight (48) hours in advance of all required inspections.

G. Any and all equipment and enclosures shall be assessable and open for inspection at the specified

inspection times. The Contractor shall be responsible for opening and closing any such equipment after any necessary corrections or rework for re-inspections.

1.17 SUBMITTALS & DOCUMENTION

A. REQUIRED SUBMITTALS & DOCUMENTION

1. All required submittals and documentation SHALL be submitted by the Bidding Entity at the time the bid proposal is submitted or the bid will be declared non-responsive.

B. REQUESTED SUBMITTALS & DOCUMENTATION

1. All requested submittals and documentation as listed on the “Submittals Checklist” SHALL be furnished upon the request of the Owner’s representative, not later than five (5) work days after the request.

C. The apparent successful Bidder for projects will, upon the request of the PA/E or the Owner, furnish documentation of the following:

1. The firm is currently certified by holding an unexpired certificate issued by the Contractor

Industry Licensing Board in accordance with Chapter 489, Part I, Florida Statutes 1993, as evidenced by a copy of his current applicable license;

2. If a Corporation, a Certificate of Status from the Florida Department of State must be provided

showing the Corporation to be active and authorized to do business in Florida;

3. The firm presently maintains a permanent bona fide place of business in Florida, practicing this type of work and has the appropriate experience, and;

4. The firm has available, or can obtain, adequate equipment and financial resources to undertake

and execute the contract properly and expeditiously, in accordance with present day practices.

D. The apparent low Bidder may be required to furnish written documentation of past successful performance in this type of work. Documentation shall consist of the Owner's name, address, project type and scope, date of project and telephone number of person to contact for verification. Failure to do so, when requested, shall result in rejection of the bid.

E. A statement identifying the major manufacturer of materials selected.

F. A manufacturer's certification that Bidder is an approved applicator or installer. G. The apparent low Bidder may be required to submit an hourly dollar rate for labor cost and the

overhead rate used for costing of materials if additional work should be required.

1.18 PAYMENT

A. Submit payment requests on a Board approved Contractor Payment Request Form to the project PA/E or to the Project Leader if a PA/E has not been assigned to the project, for review and approval. Once approved, pay requests are to be sent to the Accounts Payable Department, Pinellas County School Board P.O. Box 2942, Largo, Florida 33779-2942.

B. Submission of a payment request prior to delivering goods or rendering services shall be deemed

fraudulent and subject to all civil and criminal penalties as provided in Florida Statutes. C. A Pinellas County W-9 form must be on file with Accounts Payable Department before Contractor

payment requests will be processed. D. The payment request for items of work that are deficient in Quality or Quantity shall be returned

for correction. E. Only an approved Contractor Payment Request form is to be used. Any written or math errors on

payment form will be returned to Contractor for correction. F. Payment shall be processed within thirty (30) calendar days, excluding holidays, after receipt of a

correctly executed Contractor payment request form along with attached required documentation. (i.e. ‘As-builts’, warranty documents, updated project schedule).

G. Contractor Payment Requests shall be paid per following schedule unless otherwise stated in

writing:

1. Contracts under $6,000.00: One lump sum payment upon 100% completion.

2. Contracts over $6,000.00 and under $50,000.00: 50% of contract price at 50% completion, balance at 100% completion. Completion is defined as all punch list items are satisfactorily completed, along with as builts, warranties, service manuals, and all other closure documentation.

3. Contracts over $50,000.00: Payment shall be made at 25% of contract price at 25%

completion, 50% of contract price at 50% completion, 75% of contract price at 75% completion, and balance at 100% completion.

A monthly draw (payment) may be considered and paid upon approval of the Project Leader. A retainage of 10% shall be paid upon Punch List completion and receipt of required Closeout documents. Monthly payment requests shall be made using AIA forms G702 and G703.

H. For contracts that have more than two (2) draws (payments), the Owner at the Owner’s discretion

may require that:

1. The Contractor shall provide an affidavit stating that all Sub-Contractors and Material Suppliers covered by the immediately preceding (previous) pay request (pay draw) have been paid in full;

OR 2. Affidavits are provided from each Sub-Contractor and Material Supplier covered by the

immediately preceding (previous) pay request (pay draw) stating that they have been paid in full.

1.19 CONTRACTORS’ EMPLOYEE CONDUCT

A. The Prime Contractor (and sub-contractors if approved by PCSB to work) and all employees are required to sign in and out at the main office or other place designated by the Project Leader on arrival and when leaving the job site. All Sub-Contractors used by Contractor are also required to follow this procedure with the Prime Contractor being responsible for assuring compliance. The Prime Contractor will be held ultimately responsible for compliance.

B. All employees must carry proper identification such as: company shirt with logo or ID badge. All

workers must prominently display a district issued Level 2 clearance security screening badge at all times when on the job site. Any Contractor or Sub-Contractor found on any district property without proper Level 2 clearance shall be removed by law enforcement officials and the district shall not be held liable for such action. This action could result in the Prime Contactor being declared in breach of contract and constitute cause for termination of this agreement.

C. Workmen using foul or abusive language or presenting an offensive appearance (as determined by

Principal or Project Leader) shall be asked to leave the job site.

D. Radios or other audio items are not to be used on School property. E. Worker's personal autos are to be kept in an area designated by School Principal.

F. Smoking on School Board property is prohibited.

G. The Contractor shall comply with all Civil Rights Legislation.

1.20 VENUE AND GOVERNING LAW

A. Venue.

Venue for purposes of any action brought to enforce or construe this Agreement shall lie in the Circuit Court for Pinellas County, Florida, or in the U.S. District Court for the Middle District of Florida, Tampa Division.

B. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.

1.21 EMERGENCIES

In an emergency affecting safety of person or property the Contractor shall act, at the Contractor’s discretion, to prevent threatened damage or injury or loss.

1.22 TAGGED OR SALVAGEABLE PROPERTY AND DEMOLITION PRODUCTS

A. TAGGED PROPERTY

For all tagged Property (e.g., equipment or material with a Property Tag which contains a Property Record Number) it is the Contractor’s responsibility to remove and deliver this property to the Pinellas County School Board (PCSB) and to maintain documentation of such property removal and transfer as follows:

1. Chapter 274 Florida Statutes obligates the School District to retain Ownership of material and

equipment; to trace and control it location; and to dispose of it in accordance with law. The School Board has adopted and published a policy as to this subject. The School District has an established procedure to comply with these requirements.

2. Materials and equipment identified herein remain the property of the School District. This

Contractor is responsible to exercise care in the removal of such and its delivery to a PCSB site or facility as directed by the Project Leader.

a. Delivery of air conditioning and all other designated materials and equipment will be to the

Walter Pownall Service Center Annex, (WPSCA) 12000 South Belcher Road, Largo, Florida 33773, or the Walter Pownall Service Center, (WPSC) 11111 South Belcher Road, Largo, Florida 33773 as directed by the Project Leader.

b. Prior to delivery of such materials and equipment, the Contractor shall notify the designated Project Leader, forty-eight (48) hours in advance of their intent to deliver such materials or equipment. The Project Leader will notify the Contractor of the acceptable date, time, and facility for delivery.

c. The hours established for delivery of material and equipment to the Walter Pownall Service Center Annex (WPSCA) or the Walter Pownall Service Center (WPSC) will be from 8:00 a.m. until 2:00 p.m., M-F, excluding holidays.

3. The Principal/Director of the school or facility shall prepare an Asset Transfer Form, PCS 818,

listing all tagged equipment which is to be transferred off the facility site. An attachment to this form shall indicate the basic condition of the item and any apparent damage or missing parts. The Principal shall sign the form and retain the pink or gold copies for his distribution. The original form shall be given to the Contractor for delivery to WPSC along with the equipment.

4. The Contractor shall deliver the property to the PCSB’s designated site or facility. Upon delivery, the Contractor shall obtain the recipient’s signature on the Asset Transfer Form PCS 818. The original Asset Transfer Form will remain with the recipient who will prepare a photocopy for the Contractor’s records.

5. The Contractor shall schedule delivery of such property to the designated site or facility at the

date and time at a time designated by Project Leader. 6. Failure to handle this property as described above shall place the sole responsibility for loss of

this property upon this Contractor and such loss shall be charged by the School District to this Contractor for any missing material or equipment at a replacement value. Such charges shall be deducted by change order from the Contractor’s purchase order.

7. All material or equipment bearing a Property Record Number but not listed here below as

scheduled for removal and delivery to a PCSB site or facility shall either (a) remain in place, or (b) be removed from its location by this Contractor and suitably stored on site where directed by the Principal or Director of the school or facility. The Contractor may, at his option, require an acknowledgment signed by the Principal/Director of such relocation at the school or center.

8. The Principal shall attach to the Asset Transfer Form an itemization of any apparent damage

or missing parts. 9. All property items identified and tagged as salvageable material shall be removed by the

Contractor and delivered to Walter Pownall Service Center Annex (WPSCA) or the Walter Pownall Service Center (WPSC).

B. SALVAGEABLE PROPERTY

Salvageable property shall be processed in accordance with the School Board Procedure “DISPOSITION OF SALVAGEABLE PROPERTY”.

C. DEMOLITION PRODUCTS

Demolition products which are not to be reused or salvaged by the Owner shall become the property of the Contractor. The salvage value of such products shall be considered in the Contractor’s bid.

1.23 CLEANING UP

A. The Contractor shall keep the premises and surrounding area free of accumulation of waste materials or rubbish caused by this work. The work site shall be inspected and cleaned as necessary on a daily basis.

B. The Contractor shall completely remove the waste material and rubbish in a legal manner no less

frequently than once a week, and if indicated in the contract documents or instructed by the PA/E, more frequently.

C. Upon completion of the work under the contract and prior to substantial completion, the Contractor

shall thoroughly clean all windows, glass, aluminum/steel/or-other-metal, floors, walls, ceilings, furniture, equipment, furnishings, fixtures and all other surfaces and make such surfaces (and interiors) clean and free of stain, discoloration, dirt or dust.

D. The cost of additional cleaning required by the Owner for which the Contractor fails to do, shall be

back-charged by the Owner to the Contractor whether done by the Owner's own forces or by separate contract with others.

1.24 CLOSE-OUT DOCUMENTS REQUIRED UPON COMPLETION (AND BEFORE FINAL PAYMENT IS MADE)

At least three (3) copies of all documents/manuals will be provided. A. Operating Instructions - Provide detailed step by step instructions for each piece of major installed

equipment. Instruction shall address procedures, sequences and options, start up, shut down and adjustments.

B. Maintenance Instructions - Describe routine preventive maintenance to be performed and the

maintenance interval (daily, weekly, 1,000 hrs., etc.) for each piece of installed equipment. In a separate subsection provide overhaul instructions if applicable. Provide manufacturers detailed instructions if available.

C. Spare Parts - For major pieces of installed equipment, provide a list of manufacturer's recommended

spare parts as well as special tools or instruments needed to perform routine maintenance; include part numbers, prices and sources of supply if available. Provide exploded view drawings and information on factory exchange components if available.

D. As Built Drawings which accurately reflect the finalized product as provided by the Contractor. As

Built drawings shall be correct and complete and a set of reproducible drawings shall be provided. E. Warranties/Guarantees - Contractor to supply terms and conditions of warranty to include labor and

materials for all installed equipment. Also included will be location of equipment and associated serial, FISH and model numbers. All test and certification reports shall also be included.

F. Materials - All additional materials supplied by manufacturer for the Owner's use in rating or

maintaining equipment. G. Punch List - A written certification by the PA/E (with the Punch List attached) that all items on the

punch list have been satisfactorily completed or corrected. H. Sub-Contractor List - An all inclusive list of Sub-Contractors and major wholesale suppliers on a

form provided by the Owner, signed and sworn to by the Contractor as being accurate and complete. I. Consent of Surety to Final Payment (AIA G707) if bonds are required.

1.25 WARRANTY

A. All work performed by the Contractor shall be warranted to be free from defects in materials and workmanship for a period of not less than two (2) years from the date of final completion of the project including correction of all punch list items.

B. All manufacturers’ warranties for equipment and material shall be extended in full to the Owner. C. Contractor shall respond to all warranty claims within twenty-four (24) hours after notification by

Owner. Failure to do so shall allow the Owner to perform the work in-house or by contract and back-charge the Contractor for the cost of the work.

D. The Contractor shall supply items and conditions of warranty to include labor and materials. E. All warranties, implied by law shall apply, and are not waived or limited in any way by any

provision contained herein.

1.3 CONTRACT METHOD

1.7 COORDINATION

A. Coordinate work of the various sections of Specifications to assure efficient and orderly sequence of installation of construction elements.

1.8 REFERENCE STANDARDS

A. For products specified by association or trade standards, comply with requirements of the standard, except when more rigid requirements are specified or are required by applicable codes.

B. The date of the standard is that in effect at the solicitation date, except when a specific

date is otherwise given or stated. C. Obtain copies of standards when required by Contract Documents. Maintain copy at job

site during progress of the specific work. 1.9 PROJECT MEETINGS

A. The Engineer will schedule and administer project meetings throughout progress of the work, including an initial construction meeting, progress meetings, and called meetings.

B. The Engineer will preside at meetings, record minutes, and distribute copies to

participants and those affected by decisions made at the meetings. C. Attendance shall include the Contractor's Job superintendent, major subcontractors and

suppliers, Engineer, and Owner’s Representative, as appropriate to agenda topics for each meeting.

D. Agenda items may include a review of work progress, status of progress schedule and

adjustments thereto, delivery schedules, submittals, maintenance of quality standards, pending changes and substitutions, and other items affecting progress of the Work.

SECTION 01010

SUMMARY OF WORK PART 1 - GENERAL 1.1 DESCRIPTION

A. This Summary of Work is provided as a general outline and is not intended to be all-inclusive. Refer to the Plans and other sections in these Specifications.

1.2 WORK INCLUDED

A. On the upper roof area, the six existing roof drains shall be removed, the pipes capped, and the roof deck repaired. On the lower roof areas, the existing roof drains shall be cleaned, primed, and painted. Replace existing bolts with stainless steel bolts and washers. On the southwest quadrant of the west lower roof, install a new roof drain and piping to drain to the grass area located on the southwest corner of the building. All roof drains are to have a four foot sump.

B. Where the existing capped roof drain pipes penetrate through the exterior walls and roof areas, remove the existing piping from the exterior, cap pipes, repair wall with lath and stucco. The stucco shall be feathered into the surrounding walls (like and kind) and painted to match the existing color of the surrounding wall.

C. At all areas to be reroofed, the existing modified bitumen roof system and insulation shall be

removed to the existing steel roof deck on the lower roofs and to the gypsum concrete deck on the upper roof area. Areas that have been determined to have asbestos-containing materials shall be removed in accordance with State and Federal requirements.

D. Abandoned penetrations shall be removed and the deck penetrations patched. The abandoned penetration curb located on the northeast corner of the upper roof shall have a cementious wood fiber panel placed back to the bulb tee’s and the wood fiber panel shall be secured to the existing steel bulb tee’s with screw fasteners and plates.

E. Existing wood nailers shall be refastened and new nailers installed to meet the thickness of the new roof insulation.

F. The first layer of roof insulation shall be installed with mechanical fasteners on the lower roofs. On the upper roof area the first layer of roof insulation shall be installed with adhesive. The tapered insulation and filler boards shall be installed in adhesive over the base layer of insulation.

G. Gypsum coverboard shall be applied over the tapered insulation boards with adhesive.

H. A new two-ply, torch-applied modified bituminous roof system shall be installed over the cover

board. New aluminum foil-surfaced flashings shall be installed at penetrations and walls as detailed.

I. Install all new aluminum edge metal, counter flashings, through-edge scuppers, gutters, gutter

spacers, gutter screens, hangers, two piece flashings at lower windows, goosenecks, and miscellaneous sheet metal items.

J. Extend plumbing vent pipes and roof curbs as necessary to provide a minimum 8 inches of flashing height.

K. Fabricate and install new wood area dividers on the lower roof areas.

L. At all curb mounted mechanical equipment, install new metal skirt flashing along the top of the curb.

M. Install walk-pads at the base of the wall mounted ladder, at the ladder on the upper roof area

and around the roof hatch over to the wall mounted ladder.

N. Install new latch, handle and locking components to the existing roof hatch. Clean, prime and paint the existing roof hatch.

SECTION 01100

PROJECT PROCEDURES PART 1 - GENERAL 1.1 REQUIREMENTS INCLUDE

E. Cleaning. 1.2 EXISTING CONDITIONS

A. Condition of Structure:

1. The Owner assumes no responsibility for actual conditions of the structure.

2. Conditions existing at the time of inspection for advertising purposes will be maintained by Owner in so far as practicable. Owner and Engineer shall not be responsible for variations which may occur as a result of normal operations.

3. Existing conditions of Project, including elements subject to damage or to movement during reroofing may be observed by inspecting the building.

a. Conflicts or problems shall be reported to the Engineer prior to submitting

proposals for resolution. Failure to report these conflicts places the responsibility on the Contractor to complete the work in accordance with the Documents at no additional cost to the Owner.

4. Report unsatisfactory or questionable conditions to the Engineer in writing. Do not

proceed with work until Engineer has provided further instructions. 5. Contractor shall provide a pre-construction inspection of the building to note the

existing conditions. Contractor shall notify Engineer of intent to survey the building and shall document the survey with videotape and provide one copy of the videotape to Owner.

B. Traffic

1. Coordinate construction operations to ensure minimum interference with roads, streets,

walks and other adjacent occupied or used facilities.

2. Do not close or obstruct streets, walks or other occupied or used facilities without permission from authorities having jurisdiction. Provide alternate and protected routes around closed or obstructed traffic ways if required by governing regulations.

C. Protection

1. Ensure safe passage of persons around area of operations. Conduct operations to

prevent injury to adjacent buildings, structures, other facilities and persons. 2. Erect temporary covered passages as required by authorities having jurisdiction. 3. Erect fencing, barriers or other approved means of directing pedestrians away from

work area(s).

D. Utility Services 1. Maintain existing utilities and keep in service and protect against damage during work

operations. 2. Do not interrupt existing utilities serving occupied or used facilities, except when

authorized by authorities having jurisdiction. 3. Provide temporary services during interruptions to existing utilities as acceptable to

governing authorities. 1.3 ALTERATIONS, CUTTING AND PROTECTION

A. Assign the work of moving, removal, cutting and patching to trades qualified to perform the work in a manner to cause least damage to each type of work.

B. Perform cutting and removal work to remove minimum necessary, and in a manner to

avoid damage to adjacent work. C. Execute cutting and demolition by methods which will prevent damage to their work, and

will provide proper surfaces to receive installation of repairs or replacement materials. D. Execute fitting and adjustment of products to provide a finished installation to comply

with specified products, functions, tolerances and finishes. E. Install and protect new products to provide completed work in accordance with

requirements of Contract Documents. F. Coordinate alterations and cutting with installation of roofing as a continuous operation of

work effort. 1.4 WATERTIGHTNESS IMPERATIVE

A. The work specified herein will not preclude the use of procedures that will maintain the building in a watertight condition. Therefore, the Contractor, while conforming to these contract documents, shall maintain building in a watertight condition at all times. A roll of heavy-duty visqueen shall remain on the site for covering internal furnishings in the

event of leakage. The Contractor shall also make provisions for temporary roofing in the event of sudden rains.

B. When rain is imminent, and when the work is done for the day, the new section of roofing

shall be temporarily sealed with cut-offs to the surrounding intersections so that no moisture may enter roofing, its substrate, or into the structure before work resumes.

C. Remove cut-offs before work resumes.

1.5 SITE REQUIREMENTS

A. Building and site components damaged during the handling and installation of roofing shall be restored to original condition or shall be replaced with new materials at the discretion of the Engineer.

B. The Contractor shall provide their own sanitary facilities. Workmen shall not use

Owner’s sanitary facilities. C. The Contractor's workers shall have a specific access route to the roofs. Access to the

roofs shall be coordinated prior to the start of work. D. Telephones at the site will not be accessible to the Contractor. Contractor’s

Superintendent shall be equipped with a cellular telephone. E. The Contractor shall not use any of the Owner’s debris dumpsters at the site. F. The Contractor shall fence off set-up, storage and kettle areas.

1.6 CLEANING

A. Remove from the site all debris, rubbish and other materials resulting from roofing operations.

B. Perform periodic and final cleaning as specified in section 01700. C. Clean spillage in occupied areas immediately. D. At completion of work of each trade, clean area and make surfaces ready for work of

successive trades. E. Dispose of debris, rubbish and other materials removed from the building off-site and in a

Identify pertinent Drawing sheet, detail number, or Specification section number, as appropriate and identify deviations from Contract Documents. Provide space for Contractor and Engineer review stamps.

C. Submit initial progress schedules and schedule of values in duplicate within five days

after award of Contract. After review by Engineer, revise and resubmit as required. Submit revised schedules with each Application for Payment, reflecting changes since previous submittals.

D. Comply with progress schedule for submittals related to Work progress. Coordinate

submittal of related items.

E. After Engineer's review of the submittals, revise and resubmit as required, identifying changes made since previous submittal.

F. Engineer will conduct only two reviews of the submittal package at the Owner’s

expense. Any additional reviews of submittal materials will be charged directly to the Contractor, based on the Engineer's standard hourly rates, and subtracted from the Contractor’s first Application for Payment.

1.3 CONSTRUCTION PROGRESS SCHEDULES

A. Show complete sequence of construction by activity, identifying work of separate stages and other logically grouped activities. Show projected percentage of completion for each item of Work as of time of each progress Application for Payment.

1.4 SCHEDULE OF VALUES

A. Submit typed schedule of values on AIA Form G703.

B. Identify each line item with number and title of the major Specification sections.

D. Revise schedule of values to list change orders, for each application for payment.

E. Contractor shall submit copies of Contractor Daily Construction Reports (CDCRs) for

each day worked with each Application for Payment. If the CDCRs are not submitted with the Application for Payment, the Application will be returned, unapproved, to the Contractor.

1.5 SHOP DRAWINGS

A. Submit three reproductions of all shop drawings and submittals, submitted in 3-ring binders.

A. Mark each submittal to identify applicable products, models, options, and other data; supplement manufacturer’s standard data to provide information unique to the Work. Include manufacturers installation instructions where required by the Specifications.

QUALITY CONTROL PART 1 - GENERAL 1.1 REQUIREMENTS INCLUDED

A. Quality control of the work is the sole responsibility of the Contractor. Owner’s Representative may elect to provide a representative for the purpose of quality verification or observation on a full or part-time basis. The presence of the Owner’s representative or the Engineer shall not relieve the Contractor's responsibility for quality control.

B. Maintain, for the duration of the project, an on-site, non-working supervisor whose responsibility

will be to coordinate work between all trades and assure quality control of all workmanship and operations. The supervisor will act as the sole Contractor’s representative for the purposes of communication and coordination with the Engineer and the Owner. After the supervisor has been agreed upon, the supervisor shall not be substituted or changed without approval for the duration of the project.

C. Maintain quality control over suppliers, manufacturers, products, services, site conditions, and

workmanship to produce work of specified quality. 1.3 MANUFACTURERS’ FIELD SERVICES

A. When specified in respective Specification sections or as required by manufacturer, manufacturer shall provide qualified personnel to observe field conditions, conditions of surfaces and installation, quality of workmanship, as applicable, and to make appropriate recommendations.

B. Manufacturer’s representative shall submit written report to Engineer listing observations and

1.2 PRODUCTS

A. Products include materials, equipment, and systems. B. Comply with Specifications and referenced standards as minimum requirements. C. Components required to be supplied in quantity within a Specification section shall be the

same, and shall be interchangeable. D. Do not use materials or equipment removed from existing structure unless specified.

1.3 WORKMANSHIP

A. Comply with industry standards except when more restrictive tolerances or specified requirements indicate more rigid standards or more precise workmanship.

B. Perform work by persons qualified to produce workmanship of specified quality. C. Secure products in place with positive compatible material anchoring devices with non-

corroding finish designed and sized to withstand stress, vibration, and racking in the direction or orientation expected for roofing applications.

1.4 MANUFACTURER’S INSTRUCTIONS

A. When work is specified to comply with manufacturer's factory written instructions, submit copies as specified in Section 01300, Submittals. Distribute copies to persons involved, and maintain one set at the project site.

B. Perform work in accordance with details of instructions and specified requirements.

Should a conflict exist between Specifications and manufacturer's instructions, consult

with Engineer. Field Representative's recommendations to change the Work shall be submitted in writing to the Engineer.

1.5 TRANSPORTATION AND HANDLING

A. Transport products by methods to avoid product damage. Deliver in undamaged, dry condition in manufacturer's labeled and unopened containers or packaging.

B. Provide equipment and personnel to handle products by methods to prevent soiling or

damage. C. Promptly inspect shipments to assure that products comply with requirements, quantities

are correct, and products are undamaged. 1.6 STORAGE AND PROTECTION

A. Store products in accordance with manufacturer's instructions, with seals and labels intact and legible. Store sensitive products in weather-tight enclosures; maintain within temperature and humidity ranges required by manufacturer's instructions.

B. For exterior storage of fabricated products, place on sloped supports above ground. Cover

products subject to deterioration with impervious sheet covering; provide ventilation to avoid condensation.

C. Arrange storage to provide access for inspection. Periodically inspect to assure products

are undamaged, and are maintained under required conditions. D. After installation, provide coverings to protect products from damage from traffic and

construction operation. Remove protection when no longer needed. 1.7 PRODUCT OPTIONS

A. Within five days after award of the contract, submit complete list of major products proposed, with name of manufacturer, trade name, and identifying product number.

B. Options:

1. Products specified only by reference standard: Any product meeting that standard.

2. Products specified by naming several manufacturers: Products of any named

manufacturer meeting Specifications, provided the material or product is approved as a "system" product by the primary supplier of the membrane.

3. Products specified by naming one or more manufacturers and "or equivalent": Submit a request for substitution for any manufacturer not specifically named.

1.8 SUBSTITUTIONS

A. Substitutions will be considered only when a product becomes unavailable due to no fault of the Contractor.

1. Has investigated proposed product and determined that it meets or exceeds, in all respects, specified product.

2. Will provide the same warranty for substitution as for specified product.

3. Will coordinate installation and make other changes which may be required for work to be complete in all respects.

4. Waives claims for additional costs which may subsequently become apparent. D. Substitutions will not be considered when they are indicated or implied on Shop Drawings

or product Data submittals without separate written request, or when acceptance will require substantial revision of Contract Documents.

E. Engineer will determine acceptability of proposed substitution, and will notify Contractor

B. When Contractor considers Work has reached final completion, submit written

certification that Contract Documents have been reviewed, Work has been inspected, and that Work is complete in accordance with Contract Documents and ready for Engineer's review.

C. In addition to submittals required by the conditions of the Contract, submit a final

statement of accounting giving total adjusted Contract Sum, previous payments, and sum remaining due.

1.3 FINAL CLEANING

A. Execute prior to final inspection. B. Clean surfaces as part of this Contract Work, exposed to view; remove temporary labels,

stains and foreign substances, polish transparent and glossy surfaces, vacuum carpeted and soft surfaces.

C. Clean site; sweep paved areas and rake grass areas and clean other surfaces used during

construction operation. Plant sod of same species of surrounding grass in all areas damaged by construction operations.

D. Remove waste and surplus materials, rubbish, and construction debris from the Project

and from the Site to a legal dumping area.

Provide table of contents and assemble in three hard cover, “D” ring, three-ring binders with tabs for each item.

B. Submit documents prior to final application for payment. For items of Work delayed

materially beyond Date of Substantial Completion, provide updated submittal within ten days after acceptance, listing date of acceptance as start of warranty period.

EXISTING CONDITIONS – ASBESTOS SURVEY PART 1 - GENERAL 1.1 ASBESTOS

A. The survey report is included for the Contractor’s information.

PART 2 - PRODUCTS

(Not Applicable) PART 3 - EXECUTION 3.1 Survey report attached, 15 pages, dated December 3, 2015, prepared by Air Quality Environmental, Inc. 3.2 Contractor shall be responsible for removal, handling and disposal of all asbestos in

accordance with all laws and requirements. 3.3 At the end of the project, the Contractor shall be responsible for submittal of disposal receipts

of the asbestos containing material. 3.4 Since the project is located in Pinellas County, Florida, the asbestos regulations of Pinellas

County require removal of all roofing materials by a Florida Licensed Asbestos Abatement Contractor and/or roofing contractor that meets the requirements of Florida Statute 469 which reads as follows:

A. Licensure as an asbestos contractor is not required for the moving, removal, or disposal of asbestos-containing roofing material by a roofing contractor certified or registered under part I of chapter 489, if all such activities are performed under the direction of an onsite roofing supervisor trained as provided in s. 469.012.

B. If any silver flashing is found positive or a rotary blade is used then a ten day notification to the Pinellas County Building Department (formally Environment Department) is required.

C. The abatement / roofing contractor must provide Pinellas County Schools with asbestos disposal manifest indicating which landfill has received the asbestos. Payment may be delayed if this is not provided. Please note that roofing material may be friable or non-friable. Friable material must go to a class one landfill. Non-friable material may be accepted by a C&D landfill if they choose to accept it.

D. Asbestos survey must be onsite at all times.

SEC 2 - EXECUTIVE SUMMARY

The purpose of this AHERA/ASHARA survey was to identify ACMs, their locations of ACM and its extent within the school structure scheduled for renovation. The asbestos survey was conducted pursuant to NESHAP requirements associated with the scheduled renovation plans. Mr. Erich Paltian, accredited building inspector, performed the survey on December 2, 2015. In accordance with the planned renovation activities, the survey was limited to the upper and lower roof of building 2 slated for renovation activities as described by Mr. Bill Robinson. The facility inspector performed a thorough visual inspection of all accessible areas, and identified four (4) homogeneous areas of suspect asbestos-containing building materials. The facility inspector collected a total of twelve (12) bulk material samples of non-friable suspect ACMs, in general compliance with the Environmental Protection Agency’s (EPA’s) Asbestos Hazard Emergency Response Act (AHERA, 40 CFR 763.86) protocol. Based upon the attached laboratory results, the white caulk / mastic around the entire roof perimeter (at flashing) on building 2 (upper & lower roof) showed to contained 3% Chrysotile Asbestos.

SEC 3 - FACILITY DESCRIPTION

The subject facility is a single story, stand-alone building with both an upper and lower roof. The roof consists of a foam insulation over a metal roof deck and covered with a rolled roofing material as well as some areas of torched down Veral Foil. Only the roofing materials on building 2 were surveyed and sampled.

SEC 4 - ASBESTOS SURVEY PROCEDURES

The pre-renovation asbestos survey was performed by visually observing accessible areas of the survey area for materials likely to contain asbestos mineral fibers. An EPA accredited building inspector performed the visual observations. Only non-friable materials were sampled (a friable material is one that can be crushed to a powder when dry by normal hand pressure). After the overall visual survey was completed, representative sampling areas were determined. The surveyor delineated four (4) homogeneous areas of suspect materials and samples of each material were obtained to generally comply with NESHAP regulations. The inspector determined sample locations based on previous experience. After completion of the fieldwork, the samples were delivered to Air Quality Environmental Inc., in Seminole, Florida for analysis. The samples were analyzed by Polarized Light Microscopy (PLM) coupled with dispersion staining in general accordance with EPA 600/M-4-82-020. Utilizing this procedure, the various asbestos minerals (chrysotile, amosite, crocidolite, actinolite, tremolite, and anthophylite) can be determined. The percentages of asbestos minerals in the samples were visually determined by the microscopist. Please note that the EPA designates all materials containing greater than 1% asbestos as asbestos containing.

SEC 5 – SUSPECT ASBESTOS-CONTAINING MATERIALS

A total of twelve (12) samples of suspect asbestos building materials were collected during the survey representing four (4) different homogeneous areas. Building materials sampled include roofing materials (rolled roofing / foam insulation, black patch mastic, Veral Foil / mastic and white caulk / mastic). The white caulk / mastic around the perimeter of both the upper and lower roof was identified to contain 3% Chrysotile Asbestos. ACM is defined in the NESHAP regulation as a material containing greater than on percent (1%) asbestos by PLM. A summary of the analytical results is presented in the laboratory analysis. Analysis using the point counting method was not performed, but is available at the request of the client.

SEC 6 - RECOMMENDATIONS AND CONCLUSIONS

General The Environmental Protection Agency (EPA), Occupational Safety and Health Administration (OSHA) and the State of Florida have promulgated regulations dealing with asbestos. For commercial building owners, the EPA NESHAP regulations require removal of asbestos prior to conducting activities, which might disturb the material. They also deal with notification, handling and disposal of asbestos. The OSHA regulations deal with employee exposure to airborne asbestos fibers. The regulations restrict employee exposure, and require special monitoring, training and handling procedures when dealing with asbestos. Category I non-friable materials, as defined by the EPA, may remain within a facility during demolition with no potential cessation of work provided they remain non-friable and the appropriate engineering controls (i.e.: wet methods) are utilized. However, there is no guarantee that these materials will remain non-friable. Additionally, OSHA has additional requirements that may supersede the EPA rules. In order to protect the worker, OSHA has established a permissible exposure level, which limits airborne fiber concentrations. OSHA requires objective evidence that the permissible exposure level will not be exceeded, as justification that personal air monitoring and engineering controls will not be required. OSHA has also established rules requiring the containerization and labeling of asbestos waste. Florida regulations require that anyone involved in asbestos consulting activities be a licensed asbestos consultant and that anyone involved in asbestos abatement, with the exception of roofing materials, be a licensed asbestos abatement contractor. Specific The results of our observation and laboratory analysis indicate that non-friable asbestos containing white caulk was identified around the roof perimeter (at flashing) on building 2 located at the Blanton Elementary School, 6400 54TH Avenue N, St Petersburg, Florida 33709. Non-friable ACM are those in which the asbestos fibers are bound with other materials in such a way that the release of those fibers into the air from casual contact or normal wear is unlikely. Non-friable materials should not be saw-cut or abraded in any way as these activities may result in a significant fiber release episode. All asbestos containing roofing mastic should be kept wet during roofing material removal and disposal activities. The non-friable asbestos containing mastic / caulk must be disposed of in an appropriate landfill capable of accepting asbestos containing mastics. Workers performing asbestos roofing tasks should be trained and certified to perform such tasks in accordance with OSHA and State of Florida regulations.

PART 1 - GENERAL

1.1 SUMMARY

A. This Section includes procedural requirements for demolition and removal of abandoned penetrations and selected portions of buildings.

1.2 DEFINITIONS

A. Remove: Detach items from existing construction and legally dispose of them off-site, unless indicated to be removed and salvaged or removed and reinstalled.

B. Existing to Remain: Existing items of construction that are not to be removed and that are not otherwise indicated to be removed, removed and salvaged, or removed and reinstalled.

1.3 QUALITY ASSURANCE

A. Regulatory Requirements: Comply with governing EPA notification requirements before beginning selective demolition. Comply with hauling and disposal regulations of authorities having jurisdiction.

B. Operational Elements: Do not remove operating elements and related components in a manner that results in reducing their capacity to perform as intended.

C. Miscellaneous Elements: Do not remove miscellaneous elements or related components in a manner that could change their load-carrying capacity that results in reducing their capacity to perform as intended.

1.4 PROJECT CONDITIONS

A. Owner will occupy the building during the portion of the construction period. Coordinate selective demolition work with other contractors and conduct selective demolition so Owner’s operations will not be disrupted.

B. Notify Engineer of discrepancies between existing conditions and Drawings before proceeding with selective demolition.

2.1 DECK REPAIR MATERIALS

A. Structural Wood Fiber (Tectum – 2 inches in thicknes) shall be used to patch abandoned deck openings. Fasteners shall be Trinity SIPHD (0.212 nominal shank diameter) with 3 inch diameter plates.

PART 3 - EXECUTION

3.1 EXAMINATION

A. Survey existing conditions and correlate with requirements indicated to determine extent of selective demolition required. Existing rooftop equipment is operational and must be returned to the Owner in operational condition at the completion of the project.

B. Perform surveys as the Work progresses to detect hazards resulting from selective demolition activities.

3.2 PREPARATION

A. Temporary Facilities: Provide temporary barricades and other protection required to prevent injury to people and damage to adjacent properties.

3.3 SELECTIVE DEMOLITION

A. General: Demolish and remove existing construction only to the extent required by new construction and as indicated. Use methods to complete the Work within limitations of governing regulations.

B. Existing Items to Remain: Protect construction to remain against damage during selective demolition.

3.4 DISPOSAL OF DEMOLISHED MATERIALS

A. General: Remove demolished materials from Project site and legally dispose of them is an EPA-approved landfill.

B. Disposal: Transport demolished materials off Owner’s property and legally dispose of them.

B. Resecure existing wood nailers with specified stainless steel screws installed at 16 inches on center. Hex heads shall be countersunk. Replace any deteriorated wood nailers.

C. New nailers (2x6 and 1x6 as required to match new insulation thickness) fastened to existing nailers shall be secured at each layer at 6 inches on center and 4 inches on center in corner areas with specified stainless steel screw fasteners.

D. Install members true, plumb and level. Secure in place.

E. Construct members of continuous pieces of longest possible lengths.

F. Countersink all fasteners. Countersink wood only to depth for fastener heads to be flush.

ROOF INSULATION PART 1 - GENERAL 1.1 DESCRIPTION OF WORK

A. Installation of a new roof insulation system, including tapered insulation. Install crickets at the high side of all curbs, as required to provide positive drainage.

1.2 REFERENCES

A. F.S.-HH-I1972/2, Class 1 Insulation Board, Thermal, Polyurethane or Polyisocyanurate, faced with felt on both sides of the foam.

B. General requirements and specific recommendations of the material's manufacturers are

included as part of these specifications. 1.3 SUBMITTALS

A. Submit product data under provisions of Section 01300.

B. Submit shop drawing of crickets, field verified, indicating dimensions and board layout. 1.4 DELIVERY, STORAGE, AND HANDLING

A. Deliver and store materials under provisions of manufacturer.

B. Label on insulation packages shall include material name, thermal conductance, production date and/or product code.

C. When stored outdoors, stack insulation on pallets at least 4-inches above ground or roof

level and cover with tarpaulins or other suitable covering. Factory installed plastic sheathing shall not be considered sufficient and shall require an additional covering.

D. Roof insulation that has been wet prior to installation shall not be used and shall be

removed from the site immediately.

PART 2 - PRODUCTS 2.1 ACCEPTABLE PRODUCTS

A. Products shall be approved in writing by roofing membrane materials manufacturer prior to reroofing operations. All products shall have Florida Product Approval.

2.2 INSULATION MATERIALS

A. Crickets shall be sloped ½-inch per foot.

B. Polyisocyanurate insulation shall be approved by the roofing membrane manufacturer. Maximum size of boards shall be four feet by four feet. Base layer of insulation for all roof areas shall be 1-1/2 inch thick polyisocyanurate insulation.

C. Fasteners (No. 14) for securing the insulation boards to the steel deck shall be provided

by the roof membrane manufacturer with 3-inch-diameter Galvalume stress plates.

D. Cover board shall be minimum 1/2-inch fiberglass-mat faced gypsum roof board for steel deck roof areas and ¼-inch thick for gypsum deck areas, meeting Factory Mutual Class 1 and Underwriters Laboratories Class A fire rating. Cover board shall be USG Securock, as approved as the roofing system manufacturer.

E. Tapered insulation system (1/8-inch per foot for steel deck areas, ¼-inch for gypsum deck areas) shall be polyisocyanurate. Maximum size of boards shall be four feet by four feet. Starting thickness of tapered insulation shall be ½-inch.

F. Spray adhesive used to secure the insulation and cover boards shall be provided by the roof system manufacturer.

PART 3 - EXECUTION 3.1 PREPARATION

A. Remove trash, debris, grease, oil, moisture and contaminants which may affect the insulation installation.

B. Make all depressions, holes, deformation, etc., in the roof insulation smooth prior to

the installation of the roof system. C. Areas where abandoned penetrations are removed cover with 16 gauge sheet metal plates

or replace larger areas with new steel roof decking.

3.2 INSTALLATION OF INSULATION BOARD

A. The insulation fasteners shall be a length such that they penetrate the top flange of the existing steel deck and are not long enough to fasten through the steel deck flutes.

B. The polyisocyanurate insulation shall be installed into ribbons of adhesive where installed over gypsum deck or base insulation, as required by the roof system manufacturer. Increased ribbons of adhesive shall be installed at the perimeter and corner areas. Tapered insulation boards shall also be installed into ribbons of adhesive

C. The cover board shall be installed into ribbons of adhesive. Increased ribbons of

adhesive shall be installed at the perimeter and corners.

3.3 INSTALLATION OF CRICKETS

A. At the high side of all curbed penetrations, insulation crickets shall be installed to divert water past the curb. Insulation pieces shall be set into ribbons of adhesive.

the drain bowl.

SBS MODIFIED BITUMEN ROOF SYSTEM PART 1 - GENERAL

A. RELATED DOCUMENTS

1. Drawings and general provisions of the Contract, including General and Supplementary Conditions and Division 1 Specification Sections, apply to this Section.

B. SUMMARY

1. This Section includes the following:

a. SBS-modified bituminous membrane roofing for torch-applied application.

C. DEFINITIONS

1. DESIGN UPLIFT PRESSURE – The uplift pressure, calculated according to procedures in ASCE 7-10.

2. OTHER ROOFING TERMINOLOGY: Refer to ASTM D 1079 and glossary of NRCA's "The NRCA Roofing and Waterproofing Manual" for definition of terms related to roofing work in this Section.

D. PERFORMANCE REQUIREMENTS

1. General: Provide installed roofing membrane and base flashings that remain watertight, do not permit the passage of water, and resist specified uplift pressures, thermally induced movement, and exposure to weather without failure.

2. Uniform Wind Uplift Load Capacity

Installed roof system shall withstand negative (uplift) design wind loading pressures complying with the following criteria:

a. Design Code: ASCE 7-10.

b. Building Category: III

c. Wind Speed: 154 mph.

d. Exposure Category: C

e. Topographic Factor: 1.0.

E. SUBMITTALS

1. Procedures: In accord with Division 1 requirements. CONTRACTOR shall provide all shop drawing submittal information at one time in one submittal in 3 ring binders tabbed by Specifica-tion Section number. Submittal shall be submitted in printed form and on a CD properly labeled with project information. MSDS shall be included behind the specific product submittals. Shop Drawings submitted at multiple times will be reviewed for convenience but at the ENGINEER’S normal hourly billing rate. The amount will be deducted from the contractor’s total project amount due as additional services for the ENGINEER.

2. Florida Product Approval a. Provide documentation that all products submitted are approved for use in Florida.

3. Samples:

a. Three samples of each fastener type.

b. Three strips of samples of each sheet material.

c. Three 6“strip by full roll width samples of rigid and/or flexible flashing, including side/end-lap seam.

d. Three 6“X 6“or larger samples of each type of insulation board.

4. Shop drawings: Drawings of fastening patterns, adhesive patterns and sheet metal flashing de-tails.

a. Shop drawings shall diagram required insulation fastening pattern to include field of roof, corners, and perimeter.

5. Product data: Manufacturer's latest edition of technical product data, installation instructions, and recommendations for each type of insulation and roofing product specified and required to in-clude, but not limited to insulation, membrane, flashing, asphaltic cements and mastics, primer, and fasteners. Include data substantiating that materials comply with requirements, including cer-tification of modified bitumen sheet minimum polymer content. Mark proposed products clearly by circling, underlining or highlighting with a highlighter color that will reproduce when copied. Yellow will not copy.

6. Manufacturer’s Instructions:

a. Detailed application instructions for the roof system being installed, to include general and specific recommendations, product storage and handling, weather restrictions and pa-rameters, and application requirements.

7. Certificates:

a. A Manufacturer's Notice of Intent to Issue Roof Warranty, in accordance with Attach-ment A, prior to the use of any of the manufacturer's materials on the project.

F. QUALITY ASSURANCE

1. Coordinated installation: Except as otherwise indicated, perform roofing and flashing work as a single integrated unit of work, without division of responsibility between separate installers. Single installer responsibility required.

2. Manufacturer qualifications: Provide primary products, including insulation (where indicated), each type of roofing sheet (felt), bitumen, and composition flashings produced by a single manufacturer, which has produced that type product successfully for not less than 5 years.

Provide secondary products only as recommended by manufacturer of primary products for use with roofing system specified.

G. Installer qualifications:

1. A single installer (“roofer”) must perform the work of this Section and have not less than five years of successful experience in installation of roofing systems similar to those specified for this project, and which is acceptable to, and approved and/or licensed by manufacturer of primary roofing materials.

a. Obtain written certification from manufacturer of roofing system certifying that installer is approved by manufacturer for installation of specified roofing system and approved at a level capable of providing the specified warranty.

b. Installer must maintain full-time supervisor/foreman on job site during times that roofing is in progress. Supervisor must have minimum of five years of experience in roofing work of similar nature and scope in specified roofing system.

H. Manufacturer's inspections: Provide manufacturer's inspection services of roofing application. Manufacturer's inspection services shall include inspection of installation at these times: within two days of start of system installation and during system installation at that time; immediately after completion, for deficiencies in workmanship and application of materials; and after work of other trades, requiring access/traffic on finished roofing, has been completed, for damage resulting from the work of other trades subsequent to the "completion of installation" inspection.

I. Requirements of regulatory agencies: In addition to pertinent regulations of governmental agencies having jurisdiction, comply with:

a. UL: Class A fire rating.

b. ASCE 7-10 Minimum Design Loads For Buildings and Other Structures.

c. Florida Building Code 2014 Edition.

J. Pre-application roofing conference.

1. Approximately two weeks prior to scheduled commencement of roofing installation and associated work, arrange a meeting at project site with ENGINEER, OWNER, installers of each component of associated work, installers of new roof drains, installers of roof-top units and other work in and around roofing which must precede or follow roofing work (including mechanical and electrical work), roofing system manufacturer's representative, and other representatives directly concerned with performance of the work. Record discussions of conference and decisions and agreements (or disagreements) reached, and furnish copy of record to each party attending.

2. Review methods and procedures related to roofing work, including, but not necessarily limited to, the following:

3. Tour representative areas of roofing substrates (decks) inspect and discuss condition of substrate, roof drains, curbs, penetrations, and other preparatory work performed by other trades.

K. DELIVERY, STORAGE, AND HANDLING

1. Deliver roofing materials to Project site in original containers with seals unbroken and labeled with manufacturer's name, product brand name and type, date of manufacture, and directions for storage.

1. Store liquid materials in their original undamaged containers in a clean, dry, protected location and within the temperature range required by roofing system manufacturer. Protect stored liquid material from direct sunlight.

a. Discard and legally dispose of liquid material that cannot be applied within its stated shelf life.

2. Protect roof insulation materials from physical damage and from deterioration by sunlight, moisture, soiling, and other sources. Store in a dry location. Comply with insulation manufacturer's written instructions for handling, storing, and protecting during installation.

3. Handle and store roofing materials and place equipment in a manner to avoid permanent deflection of deck.

L. PROJECT CONDITIONS

1. Existing conditions:

1. Along with the roofing applicator and sheet metal installer, verify existing conditions, in-cluding:

a. Roof deck conditions.

b. Varying deck and wall thickness for length of anchoring devices required.

c. Replace or restore to original condition all materials or work damaged during construction of work of this Section.

2. Protect paving and building walls.

a. Lap protective materials at least 6 in.

b. Vent plastic sheets, if used, to keep moisture from condensing and collecting on covered surfaces.

c. Secure protective coverings against wind.

d. Leave protective coverings in place until roofing work has been completed.

2. Environmental requirements:

1. Do not install roofing during rain or start roofing if rain is probable during installation.

2. Do not install roofing when there is frost, surface moisture, or dampness visible on the surface to which roofing is to be applied.

3. Protection:

1. Protect surfaces not intended to receive roofing materials from spillage, dripping, spot-ting and damage during application of the roofing. Should protection not be effective, or not be provided, restore the respective surfaces to their proper conditions by cleaning, re-pairing, or replacing, as applicable for the circumstances and as directed by ENGINEER.

2. Immediately protect completed portions of roofing from damage of subsequent construc-tion activities in accord with contract requirements. Repair, replace, or as otherwise re-quired to remedy any damage to roofing resulting from construction activities, for the en-tire duration of construction.

M. WARRANTIES

1. MANUFACTURER’S WARRANTY: A single source 20-year No Dollar Limit warranty covering all roofing materials and products comprising the roofing assembly which includes roofing felt, base sheets, fasteners, insulation, overlay board, cap sheets and base flashings.

2. CONTRACTOR’S WARRANTY: A single source Five-Year warranty covering all roofing materials and installation which is part of the project unless specifically excluded with approval of the OWNER. The warranty coverage includes all roofing materials, metal work, and flashings.

3. All Warranties shall list the Building numbers and shall list the date of substantial completion as the commencement date of the warranty.

2.0 PRODUCTS

2.1 GENERAL

A. The following materials are considered the “Basis of Design” for all roofing materials used for this roofing project. Alternate materials or substitutions will not be acceptable.

B. Materials must be supplied by acceptable roofing materials manufacturers and covered by the

Roofing Material Manufacturer’s twenty (20) year warranty.

C. Roof Assembly

a. Deck Type: Steel deck.

b. Insulation – Base Layer polyisocyanurate, tapered polyisocyanurate and 1/2-inch gypsum-fiber cover board, installed in roof system manufacturer’s adhesive.

c. Modified Bitumen Smooth Ply and Modified Bitumen FR Cap Ply – Torch-applied.

D. Anchoring and Attachment a. Roof Deck Testing: Fastener pullout resistance testing is required prior to the installation

of any mechanical fasteners. b. Sheet Metal Flashing and Trim: All metal work, including new or existing wood

blocking, shall be fastened to meet RAS111 criteria for uplift load. E. Materials – Roofing Ply Felt and Modified Asphalt Ply

a. SBS Modified Bitumen Smooth Interply – Polyester or fiberglass reinforced, smooth SBS interply membrane minimum thickness 120 mils complying with ASTM D6164 Type 1 Grade S for torch applications.

b. SBS Modified Asphalt Cap Sheet – Polyester reinforced SBS modified asphalt cap sheet with white granules, minimum thickness 160 mils and comply with ASTM 6164 Type II Grade G with minimum 250 g/m2 mat for torch applications.

c. SBS Modified Asphalt Base Ply for Base Flashing – Fiberglass or polyester reinforced modified asphalt sheet for torch application minimum thickness 120 mils. Two ply base flashing systems are required.

d. SBS Modified Asphalt Base Flashing Cap Ply – Fiberglass or polyester reinforced modi-fied asphalt sheet with a aluminum foil surface for torch application, minimum thickness 150 mils. Two ply base flashing systems are required.

e. Reinforcing fabric – Asphalt saturated woven fiberglass mat produced for use with roof-ing mastics in low slope roofing systems.

F. Bituminous Materials –

a. Asphalt based Roof Cement – Asphalt cut-back mastic reinforced with non-asbestos fi-bers and special mineral stabilizers. Product must be produced or sold by primary roof-ing materials manufacturer and approved for use for manufacturer warranted roofing sys-tems.

b. Asphalt Primer – Thin cut-back asphalt used to prepare surfaces for hot asphalt.

3. Roof Membrane Edge Sealant – one-part polyether meeting ASTM C920, Type S as manufactured by ChemLink, ProSeal or approved equal.

3.0 EXECUTION

3.1 INSPECTION AND PREPARATION

A. CONTRACTOR Inspections:

1. Installer shall examine substrates and conditions under which roofing work is to be per-formed and shall notify ENGINEER in writing of unsatisfactory conditions.

2. Do not proceed with roofing work until unsatisfactory conditions have been corrected in a manner acceptable to ENGINEER.

3. Inspect surfaces over which roofing and flashing is to be applied. Do not install roofing over any surfaces until they are clean, dry, and free of all dirt and debris and in acceptable condi-tion to receive new roofing materials. Voids greater than 1/4 in. are not permitted in surface to receive roofing membrane and flashing.

3.2 PREPARATION

A. Watertight imperative:

1. The work specified herein shall not preclude the use of procedures that will maintain the building watertight. Therefore, Contractor, while conforming to Contract Documents, shall utilize skill and all necessary procedures to keep unwanted water out of the building while construction is in progress. If existing roof system cannot be removed and replaced in a single day’s operation, a temporary roof shall be installed.

2. At the end of each day's roofing installation and/or prior to the onset of inclement weath-er, the new section of roofing shall be temporarily sealed with cut-offs to unfinished sub-strates, projections through the roof, and to surrounding intersections so that no moisture may enter roofing or into structure before work resumes. Remove cut-offs before work resumes.

B. Protrusions:

1. Install and secure items which pass through roof prior to application of roofing. Extend all protrusions and penetrations as required to accommodate thickness of insulation. En-sure that curbs and pipes are a minimum of 8 inches higher than the finished surface of the roof. Curbs shall be designed to anchor equipment to the roof and curb extensions structurally per FBC 1504.1.

3.3 ROOFING MEMBRANE INSTALLATION

A. TORCH APPLIED TWO-PLY MODIFIED BITUMEN MEMBRANE INSTALLATION OVER ADHERED INSULATION

1. Apply in accordance with detailed application instructions of the roof membrane manufacturer and the requirements specified herein.

2. Apply base layer of polyisocyanurate with mechanical fasteners, tapered polyisocyanurate and cover board in roof membrane manufacturer’s adhesive, applied with beads at maximum 12 inches on center (six inches on center in perimeters and corners or closer as required by the roof system manufacturer).

3. Unroll modified bitumen membrane sheets and allow to relax a minimum of 30 minutes prior to installing sheets. Ensure sheet is dry prior to installation.

4. Fully adhere the modified asphalt membrane sheets by torch application such that fluid bituminous material flows full width of roll as material is being rolled or set in place.

5. Provide minimum 4 inch side laps and minimum 6 inch end laps and as otherwise required by membrane manufacturer.

a. Stagger end laps minimum 36 inches.

b. Offset laps between base and cap sheets a minimum of 12 inches.

6. Fully adhere the cap sheet to the interply modified asphalt sheet by torching.

7. Delay in cap sheet installation of greater than one week shall result in thorough cleaning of the applied base sheet surface and priming of the base sheet with asphalt primer prior to cap sheet installation. Roof membrane manufacturer’s technical representative shall review the smooth ply application prior to the installation of the cap sheet.

8. Provide tight smooth laminations of each membrane layer without wrinkles, ridges, buckles, kinks, fishmouths, or voids.

9. Provide for slight, uniform flow of bitumen in front of roll and full width of roll as the material is being rolled or set into place. Apply uniform positive pressure to ensure membrane is fully adhered and all laps are sealed. Prior to forming lap over granulated surfaces, embed granules of the receiving sheet by heating and troweling-in the granules to form a uniform black compound surface. Inspect and ensure all lap areas are fully sealed.

10. Extend base plies over cant (where used) and 2 inches above the cant to the wall and fully adhere in place.

3.5 MEMBRANE FLASHING

A. Apply in accordance with detailed application instructions of the roof membrane manufacturer and the minimum reference detail indications and requirements specified herein.

1. A minimum of a 2 ply base flashing system is required.

2. Use a chalk line to maintain a straight bottom edge of the base flashing.

3. The base ply shall extend to the base of the cant and the top 4 inches beyond the top of the cant.

4. After the cap sheet is installed, install the base flashing to a minimum height of 8 inches above the finished height of the roofing system. Where the flashing is applied on a perimeter wood nailer wall, the flashing shall extend up and over the top of the wall and down the face so that all wood blocking is covered by the base flashing.

5. Mechanically fasten top edge of modified bituminous flashing maximum 6 inches on center through 1 in. diameter minimum tin caps with fasteners of sufficient length to embed 1 in. minimum into the substrate.

3.6 APPLYING ACCESSORY MATERIALS

A. General: Coordinate installation of accessory materials integral with the roofing assembly.

B. Conform to NRCA Roofing and Waterproofing Manual unless otherwise specified or recommended by the roofing material manufacturer.

C. Review details for special installation requirements.

D. Do not use any type cutback asphalt mastics under any modified bitumen products.

E. Set-on accessories: Where pipe or conduit blocking and similar roof accessories are set on the membrane, adhere additional layer of cap sheet material or traffic pad material to bottom of premanufactured pipe/conduit stand and the underside of other set-on accessories prior to setting on roofing membrane. Specific method of installing set-on accessories must permit normal movement due to expansion, contraction, vibration, and similar occurrences without damaging roofing mem-brane. Do not mechanically secure set-on accessories through roofing membrane into roof deck substrate.

F. Penetration flashing: 1. For small, single element penetrations, install metal flashings and metal counterflashings,

as applicable.

a. Clean and prime both sides of metal to be embedded in roof membrane system.

2. Set metal base flashings in a full, thick, uniform and continuous bed of flashing cement and secure to roof deck or wood nailers as applicable.

3. At lead vent pipe flashings, fold/roll lead flashing down into pipe a minimum of 1 in.

4. Strip-in multiple plies of flexible base flashing sheets as recommended by roofing mate-rials manufacturer, consistent with warranty requirements.

5. At juncture of metal base flashings and flexible base flashing sheets, apply a continuous bead of flashing cement.

6. Secure metal counterflashing to penetrating element and seal with non-bituminous sealant.

7. Use of pitch pans or pitch pockets is not permitted. Roof manufacturer’s liquid flashing and fabric matrix system shall be used at penetrations.

3.7 INSTALLATION OF FLASHING AT SHEET METAL

A. Metal flashing shall be coordinated by the Contractor, and installed by the sheet metal trade. Re-view the flashing details for additional roofing installation.

B. Metal flashings: Set primed metal flashings in a full bed of compatible modified bitumen roofing cement and securely fasten to roof deck or wood nailers. Prime flanges of metal flashing on the roof surface and strip-in with trowelings of cement and flexible flashing strips so that strip ex-tends not less than 8 in. beyond outer edge of flange.

C. Primer for all metalwork to be stripped into the roofing system shall be applied by brush and not roller or spray unless followed by brushing. Primer shall be applied to both sides of the horizon-tal metal flange.

D. Install metal flashings in accordance with Section 7F.

3.8 PROTECTION OF APPLIED ROOFING AGAINST MOISTURE ABSORPTION:

A. At the end of the day’s work and whenever inclement weather is imminent, use all means re-quired to protect applied roofing system from water intrusion or moisture exposure by providing:

B. Water Cut-offs:

1. The insulation line shall be straightened using loose-laid cut insulation sheets and the terminated edge of the roofing system shall be sealed watertight.

2. Temporary seals shall be removed prior to commencing work. C. Temporary Flashing for Permanent Roofing:

1. Provide temporary flashing at walls and other penetrations and terminations of roofing membrane until the roofing system installation is complete and the permanent flashings are applied.

2. Remove temporary flashing before applying permanent flashing.

D. Temporary Walkways, Runways and Platforms:

1. Do not permit storing; walking, wheeling and trucking directly on applied roofing materials.

2. Provide temporary walkways, runways and platforms of smooth clean insulation boards or planks as necessary to avoid damage to applied roofing materials and to distribute weight to avoid overloading the roof structure.

3. Use clean rubber-tired equipment for roofing work.

E. Wet or damaged materials shall be removed and replaced at no additional cost.

3.9 FIELD QUALITY CONTROL

A. During progress of the work of this Section, make visual inspections as necessary, and verify that:

1. All materials of this Section comply with the specified requirements.

2. All materials are properly stored and handled.

3. The proper number and types of plies are installed, with the specified overlaps.

4. The proper number, type, and spacing of fasteners are installed.

5. Associated flashings and sheet metal are installed in a timely manner in accord with the specified requirements.

6. Membrane is fully adhered without ridges, wrinkles, kinks, fishmouths, or other voids or delaminations.

7. Insulation is properly secured to the substrate and nailers are provided where and as needed.

8. Nightly tie-offs are properly made and effective.

SECTION 7F

FLASHING AND SHEETMETAL

PART ONE - GENERAL

1. RELATED DOCUMENTS

A. The requirements of the Bidding Requirements and the Contractual Conditions of Division One shall apply to this Section.

2. WORK INCLUDED

A. Work required under this Section consists of providing all necessary services, tools, equipment, material and labor needed to provide and install all flashing and sheet metal work pertaining to roofing work and to the prevention of water and moisture entering the envelope of the building.

B. Without restricting the volume, quantity or generality of the preceding paragraph, work included under this Section shall consist of but not be limited to:

(1) Flashing and sheet metal work pertaining to roofing. (2) Lead flashing around plumbing vents and roof drains. (3) Counter flashing (when not an integral part of equipment). (4) Roof (attic/soffit) ventilators. (5) Overflow scuppers, gutters, downspouts, gravel stops, and expansion

joint covers (when of sheet metal). (6) Parapet wall flashing system.

3. SUBMITTALS

A. Manufacturer's data:

(1) Submit eight (5) copies of manufacturer's specifications, installation instructions and general recommendations. Include published or certified test data for each material complying with the Specifications.

B. Shop drawings:

(1) Submit eight (5) copies of shop drawings for each fabricated item.

C. Samples shall be submitted, as described herein.

4. QUALITY ASSURANCE

A. The Architectural Sheet Metal Manual as published by the Sheet Metal and Air Conditioning Contractors National Association, Inc., latest edition, and hereinafter referred to as "The SMACNA Manual" shall be used as the standard reference of quality.

5. JOB CONDITIONS

A. The installation of flashing and sheet metal shall not proceed until substrate, curb, cant strips, blocking, expansion joint construction, reglets, and other construction to receive this work is completed.

6. FLASHING WARRANTY ENDORSEMENT

A. Furnish a written warranty which shall extend from the Date of Substantial Completion of the Project (as defined in Division One of this bound Specification Book) for a period set forth below, and which shall cover any and all necessary repair or replacement work required to keep and maintain fabric flashing materials in a watertight and first class condition, at no additional cost to the Owner. This warranty shall be limited to cover ordinary wear and tear caused by the elements (including storm weather) and to defects due to faulty materials or workmanship. The warranty shall also be furnished independently by each of the following:

(1) For a period of ten (10) years after the Date of Substantial Completion by:

a. The manufacturer of the fabric flashing material

(2) For a period of five (5) years after the Date of Substantial Completion by:

a. The Roofing Contractor

B. Furnish a written warranty from the Date of Substantial Completion of the Project (as defined in Division One of this bound Specification book) for a period of time set forth and which shall cover any and all necessary repair or replacement work required to keep and maintain metal flashing materials in a watertight and first class condition, at no additional cost to the Owner. Such warranty shall be limited to cover ordinary wear and tear caused by the elements (including storm weather) and/or inefficient or faulty materials or workmanship. This warranty shall be furnished independently by each of the following:

(1) For a period of five (5) years after the Date of Substantial Completion, of the Project, by:

a. The fabricator of the sheet metal work. b. This Roofing Contractor.

C. Damages to the building or to its contents, during construction and prior to the Date of Substantial Completion, shall be severally borne by the responsible individuals or firms listed above (except the manufacturer), if caused by defects in workmanship.

D. Damages to the building or to its contents due to defects in workmanship for a period of two (2) years after the Date of Substantial Completion shall be severally borne by the responsible firms listed above (except the manufacturer).

E. The obligations and liabilities under the terms of these warranties shall be extended to the obligations of the Roofing Contractor's Performance Bond for a period of time not less than the terms of the Performance Bond nor in any event for a time period of two (2) years following the Date of Substantial Completion, whichever is longer.

F. The above described warranty shall be delivered to the Owner (via the Project Engineer) by the Contractor prior to any obligation of the Owner to reduce the retainage of payment due the Contractor.

G. The requirements of notification and the Owner's right to effect corrective work set forth in the terms of warranty for the flashing and sheet metal work set shall include the designation of the Pinellas County School Board Maintenance Department in-house roof repair crew to make emergency repairs without relieving any party of his warranty obligations. Those guaranteeing the work shall reimburse the school district for such costs.

H. No other warranty, expressed or implied, is given. No terms of the "standard" warranties or guarantees by the manufacturer shall apply to this Contract if less stringent than these Specifications.

PART TWO - PRODUCTS

7. MATERIALS

A. Metal material used in flashing and sheet metal work shall be 0.050" mill-finished aluminum unless specifically designated otherwise on the Drawings.

B. Gauges of metal used in flashing and sheet metal work shall be as specifically designated on the Drawings. When the Drawings omit specifying a particular

gauge, such shall be of the gauges set forth in the following descriptions of particular metals.

C. Galvanized steel sheet metal: 24 gauge, zinc coated sheet steel, hot dipped galvanized carbon steel with 0.2% copper, complying with ASTM A525 and ASTM A526 G90 hot dip galvanized, of American manufacturer. Back prime in accordance with the painting Section of these Specifications.

D. Stainless steel: AISI Type 302/304 sheet or strip conforming to ASTM A167; dead soft, No. 2D finish, 0.024 gauge unless otherwise indicated. (Protect from dissimilar materials).

E. Copper: Standard sheet copper, 20 oz., 1/8 hard, C.R. Copper (.0270) complying with ASTM B370-Latest Edition

F. Aluminum: Sheets or strips of 3003 or 3004 alloy, temper H14 of the producer's standard finish, 0.050" gauge:

(1) Aluminum in contact with concrete or masonry shall receive two (2) coats of water-white meth acryl lacquer.

(2) Isolate aluminum from other materials, including wood, asphalt and roofing membrane, by a protective bituminous coating not less than 15 mils dry mil thickness; or, by SBS modified bituminous sheet felts, rubber or other techniques approved by the Project Architect.

G. Sheet flashing: Synthetic heavy duty, corrosion resistant, impermeable, flexible and homogenous virgin 20 mil sheeting weighing 22 oz. per square yard. Following approved manufacturers, subject to compliance with these Specifications:

(1) Rubber & Plastics Compound Co. (2) Sandell Manufacturing Co. (3) Wasco Products, Inc. (4) Manville (5) Siplast (6) Soprema

H. Fasteners for sheet flashing: Hot dipped galvanized conforming to ASTM - 153 Latest edition, or cadmium plated, (or stainless steel used in stainless steel construction). Fastenings shall match particular sheet metal materials to which applied. Nails and screws shall have sufficient length to penetrate all metal and fabric materials and into wood support by 3/4" minimum and shall be capable of 40 lb. each minimum initial withdrawal.

(1) Flashing nails shall be a minimum of 11 gauge, with barbed shank, and 5/8" diameter heads, by 2" with tin caps.

(2) Galvanized tin caps shall be 1" or 2" diameter and 28-30 gauge flat sheet metal.

(3) Integral capped flashing nail (simplex type) with round head, galvanized, 7/8" minimum.

I. Fasteners for sheet metal:

(1) Roofing nails for sheet metal to wood for concealed applications shall be Type 304 stainless steel .a minimum 11 gauge by 1 ¼” barbed shank nail with a 5/16” head.

(2) Screws for sheet metal to wood for exposed applications shall be Type 304 Stainless Steel self drilling, #10 x ½” with a “Flow-Seal” washer.

(3) Screws for sheet metal to sheet metal shall be a self tapping Type 516 Stainless steel #12 x 5/8”x 14 with a self sealing bonded EPDM Washer with A-B thread.

(4) Screws for sheet metal to masonry shall be Type 304 Stainless Steel, ¼”-14x 1 ¼” hex head with EPDM washer or a type 304 Stainless Steel pin-drive “one-step-anchor” ¼ x 1 ½ with mushroom head.

J. Sealing compound shall be a Type S-single component, Grade NS – Non sag gun grade silyl – terminated polyether sealant complying with ASTM C920. Color shall be selected by Project Architect/Engineer. Following products and schedule approved.

1. Exposed sealing applications on low slope roofing to permanently bond structural assemblies such as coping, metal edge, skylights and pitch pans: M-1 Structural sealant by Chem Link, Inc.

2. Metal to metal sheet metal lap joints: Sonolastic 150 by Sonneborn Building Products DIV, ChemRey, Inc.

3. All inside corner metal to masonry or metal to stucco joints at counter flashing “sealant trays: ”Sonolastic 150 by Sonneborn Building Products DIV., ChemRey Inc.

4. Perimeter of exterior vertical penetrations and attachments through concrete, stucco and masonry surfaces, such as but limited to, pipes, counter flashing and conduits: Sonolastic 150 by Sonneborn Building Products DIV., ChemRey, Inc.

K. Solder: ASTM B32, 50% pig lead, 50% black tin.

L. Flux: Muriatic acid 'killed' with zinc or suitable brand of prepared soldering flux.

M. Fixed situation curb base flashing:

(1) Fixed situation curb base flashing shall be as specified in Section 7A and shown in School Board Standard Detail.

(2) Install fixed situation curb base flashing in strict accord with manufacturer's recommendations except that greater or more stringent requirements of these Specifications shall govern.

(3) Comply with detail(s) shown with this Specification Section or on the Contract Drawings. Such shall govern over the standard details of the manufacturer.

(4) Locations: Install fixed-situation base flashing in all situations (except parapet walls) where roof plane intercepts vertical surfaces other than roof curbs, expansion joints, hatches, or equipment supports.

N. Metal work for gravel stops, roof membrane stops (without gravel), gutters, downspouts, scuppers, counter flashing, expansion joint covers, coping caps/covers, and other work, shall be fabricated and installed as shown in the PCSB Standard Details and/or on the Contract Drawings. Otherwise, all metal work shall be in accordance with best trade practices and as set forth in The SMACNA Manual.

(1) Perimeter edge metal gravel stops shall be 0.050 pre-finished aluminum. Flange shall be four (4”) inch (minimum), with hemmed edge kick out and at the joints, a cover plate and bottom plate shall be installed as shown in the PCSB Standard Gravel Stop Detail. Prime tops and bottoms of all flanges and any surface that will come in contact with asphalt. Fasten with stainless steel nails. Miter and heliarc all inside and outside corners with a minimum twenty-four (24”) inch let.

O. Gutters shall be fabricated as detailed, in such a manner that: the outer lip (top edge) is lower than the interior lip; so the interior bottom of the gutter sloping positively at no less than 1/16" per lineal foot towards its discharge drain. When the Project Architect specifies absolute level gutters, it shall be accomplished by a separate interior lining in a manner whereby the visible appearance of the gutter appears true and level horizontally and shall be supported frequently and adequately with hanger brackets between interior liner and exterior cover. Gutter shall be separately fabricated from any metal work built into the roofing system (such as a gravel stop) and shall be of special detailed configuration to match the Drawings and details (i.e. -- shall not be of standard "Ogee" or molded configuration, but of box design; and shall be fabricated of sufficient lengths to avoid problems with expansion and contraction. Heliarc all joints, end dams, mitered corners and outlets in the interior lining. See the PCSB Standard Gutter and Downspout Specification and Detail.

(1) New gutters shall be formed of 0.050 mill finish aluminum, in accordance with SMACNA, Plate 14-A. Gutter brackets shall be formed of 1/4” x 1” aluminum. Gutter spacers shall be formed of 0.062” by 1 inch aluminum. Note: If gutters are specified by Project Architect to be a color other than mill finish than an interior liner is required for welding purposes.

P. Downspouts shall be fabricated as detailed and shall not be of "standard-off-the-shelf" configuration with corrugated indentions or ribs, and shall be supported adequately at uniform and frequent vertical spacing.

(1) Downspouts, elbows and downspout hangers shall be formed of 0.050 mill finish aluminum. Downspouts shall be 4 inch by 4 inch minimum square or rectangular and formed in accordance with SMACNA, Plate 32-B. Hangers shall be formed in accordance with SMACNA, Plate 34-G. Fasteners for gutter hangers shall be a stainless steel pan head fastener compatible with aluminum.

Q. Coping metal: Fabricate and install according to the PCSB Standard Detail for Typical Parapet Wall Coping.

R. Counter flashing: Surface mounted .050” aluminum, shop fabricated, hem all edges, flare top and bottom edges, flares and bends shall be mitered to 24” outside of corners and Heliarc welded. Do not splice at any 90 degree corner. Provide 3” end plate at all end conditions. Use 3/16” x 1 ½” closed foam backer tape. Use 1”x 1”x 1 1/8” pressure bar with predrilled holes at 9” o.c. use specified sealant and fasteners fastened at nine (9) inches o.c.

S. Lead flashing for plumbing boots, pitch pans and roof drains shall be 4 lbs. desilverized sheet lead.

T. Roof vents: All gravity, turbine and power roof ventilators shall be aluminum.

U. Expansion joints: All roof expansion joint covers, all roof to wall expansion joint covers, all construction joint covers and all roof dividers shall be .050” aluminum with flashed wood nailers unless otherwise specified. No rubber bellows type expansion joints allowed. Membrane control joints will be specified as needed.

PART THREE - EXECUTION

8. INSPECTION

A. The installer shall examine the areas and conditions under which the flashing and sheet metal is to be installed, and notify the Contractor in writing of conditions detrimental to the proper and timely completion of this phase of the Work. Do not proceed with this phase until the unsatisfactory conditions have been corrected. Commencement of work shall be construed as acceptance of the conditions by this Contractor.

9. FABRICATION

A. Workmanship shall conform to the best trade standards. Materials shall be the same and like materials. Do soldering slowly with heavy well heated soldering coppers of blunt design, properly tinned before use. Tin edges of each item to be soldered with best grade pure metal, 1-1/2 inch on both sides, with rosin as flux.

B. Sheet metal counter-flashing normally an integral part of fan housings (air conditioning housing and like items) will be furnished as part of such work by other Sections of these Specifications. Other counter-flashing items shall be as detailed and specified in this Section. Transitions from roof curbs to gravity vents, fans or other work shall be of specified metal, of low profile design with transitions sloped 45 degrees maximum. Extend counter flashing four (4) inches over base flashing.

C. Penetration of the roof membrane shall be with techniques other than pitch pocket pans, where possible. However, where such must be used, form "pitch pocket pans" of size to clear items protruding through roofing membrane by three (3) inches on all sides, of 0.050 aluminum or sheet copper, with four (4) inch horizontal (approximate) deck flange and with a six (6) inch height. Heliarc or solder all laps. Cover all “pitch pocket pans” with an aluminum or lead “umbrella” secured with a stainless steel plumber’s strap.

D. Strainer units shall be fabricated from minimum 0.062" diameter, non-corrosive, compatible wire or wire mesh, with 1/2" maximum spacing of wires of a removable beehive design.

E. Welding: Comply with requirements for welding as set forth elsewhere in theses Specifications.

F. Dissimilar metals shall be protected galvanitic corrosion where they touch.

9. INSTALLATION

A. General:

(1) Installation shall comply with "The SMACNA Manual" recommendations for installation.

(2) It shall be required that the flashing and sheet metal work be permanently watertight and shall not deteriorate in excess of published limitations of the manufacturer.

B. Thermal expansion shall be provided for in all exposed sheet metal work exceeding 10'-0" in running length, except where otherwise indicated:

(1) On flashing, gravel stops, coping caps and trim, expansion capability shall be on 10"-0" maximum spacing, and located 2'-0" from corners and intersections.

(2) Gutters shall be provided with expansion capability at intervals no greater than 50'0".

C. Fasteners and expansion provisions shall be concealed wherever possible.

D. Flanges to be stripped-in shall be set into continuous trowelings of modified bitumen compatible plastic roof cement.

SECTION 15400 PLUMBING PART 1.0 - GENERAL 1.01 DESCRIPTION OF WORK

A. On the upper roof area, the six existing roof drains shall be removed, the pipes capped, and the roof deck repaired. On the lower roof areas, the existing roof drains shall be cleaned, primed, and painted. Replace existing bolts with stainless steel bolts and washers. On the southwest quadrant of the west lower roof, install a new roof drain and piping to drain to the grass area located on the southwest corner of the building. All roof drains are to have a four foot sump.

1.02 CODES AND STANDARDS A. Perform work in accordance with Florida Building Code Fifth Edition (2014) and latest

revisions. 1.03 QUALITY ASSURANCE A. All plumbing work shall be performed by a licensed plumbing contractor. PART 2 - PRODUCTS 2.01 PLUMBING MATERIALS

A. No-Hub Couplings shall be Anaco, Inc., Husky SD-4000 Super Duty Couplings with stainless steel drawbands.

B. New no-hub roof drains shall be Zurn Z100, Josam 21500 or Smith 1010, with aluminum

dome, drain receiver, and under deck clamp assembly. Sizes shall match existing drains. All clamping ring bolts shall be stainless steel. Replacement drain (one) for Roof Area J installed into concrete roof deck shall match existing roof drain.

C. New piping where necessary shall be Schedule 80 PVC meeting ASTM D2665.

D. Pipe insulation where necessary shall be Owens Corning Fiberglas SSL II, one inch in thickness.

E. Piping supports where necessary shall be Anvil 260 Clevis Hanger with insulation saddle system – galvanized. Threaded rod shall be Anvil 140 Threaded Rod – galvanized. Clamps shall be Anvil.

PART 3 - EXECUTION 3.01 INSTALLATION

A. Existing roof drains shall be removed. Blockages remaining in adjoining piping shall removed by the Contractor.

B. New roof drain shall be installed with drain manufacturer-supplied drain receiver and under

deck clamp. C. New vertical and horizontal piping shall be supported at the first elbow and four feet on

center. D. New piping shall be insulated to prevent condensation.

3.02 TESTING OF SYSTEM A. At the completion of the new drain installation, a test plug shall be placed in the drain

bowls. The bowls shall be filled with water and allowed to set for one hour. No leakage shall occur at the joints or connections. Correct deficiencies found and retest.

1. The above named Contractor hereby Guarantees to Owner, subject to the limits statedherein, that the labor, materials and workmanship are in accordance with the ContractDocuments, best standards of the Industry, and the Manufacturer’s requirements and suchare free from defect in material or workmanship.

2. The above named Contractor Warrants the work to be and to remain watertight, free ofevidence of major deterioration and failure (or pending failure). Normal aging of the roofingmaterials and normal wear and tear will not be considered major deterioration. Excessivepatches, ply separations, decomposing of membrane, repeated leaks and other obviousfailures or defects shall be evidence of major deterioration.

3. This Warranty shall require the above named Contractor to pay for materials and laborrequired to repair the Roofing System to return it to a watertight condition if leaks occur dueto: (1) ordinary wear and tear of any or all of the component materials of the RoofingSystem; or (2) workmanship deficiencies at the time of application of the Roofing System,all without additional cost to the Pinellas County School District. Such replacement or repairwork shall be equal to the existing system furnished under this Contract, and shall conformwith the recognized standards of the National Roofing Contractors’ Association, or asotherwise mutually agreed.

4. This Warranty does not obligate the Contractor to repair the Roofing System, or any partof the Roofing System, for leaks resulting from (a) natural disasters or acts of God; (b)misuse, abuse or negligence; (c) exposure of the Roofing System components to damagingsubstances such as oil or solvents or to damaging conditions such as vermin; (d) changesto the Roofing system not pre-approved in writing by the manufacturer; (e) failure of theBuilding substrate (mechanical, structural or otherwise and whether resulting from Buildingmovement, design defects or other causes), or improper drainage (ponding water greaterthan 48 hours); or (f) damages caused by vandalism, act of the Owner or others.

5. The Contractor shall not be responsible for leaks and damage resulting from water entryfrom any portion of the building structure not a part of the Roofing System.

6. The above named Contractor Guarantees to fairly reimburse the School Board the cost orvalue of the damages to the building(s) or contents caused by defects in materials orworkmanship.

7. The time period covered by the requirements of the Guarantee paragraph number 1 through6 above, shall be as follows:

a. During Construction; and

b. From time of the materials manufacturer extending for a period of two (2) years afterthe Date of Substantial Completion of the roofing system set forth above.

8. The above named Contractor agrees to effect emergency temporary repairs or permanentcorrective work as quickly as is necessary to fully protect the School Board’s best interestsor, to otherwise allow the School District to effect such corrective work with its own crewswithout adversely affecting the terms of this Guarantee and Warranty, or without affectingany obligations of this above named Contractor. The Contractor agrees to reimburse theOwner for any documented fair and reasonable cost expended by the Owner to make suchrepairs. The Contractor agrees to effect permanent repairs within a reasonable period oftime.

9. This Guarantee and Warranty shall also serve as a FLASHING WARRANTYENDORSEMENT for all membrane flashing material provided by this Contractor for thesame time periods set forth in paragraphs number 7 above.

10. The terms of the Contract Documents (drawings and specifications), which were bid uponand contracted for, are reflected in the terms of this Guarantee and Warranty, therefor noexculpatory words nor other terms lessening these shall apply. No lesser Warranty orGuarantee, expressed or implied, shall apply. No less stringent or exculpatory words of theManufacturer’s “standard” or printed Guarantee and/or Warranty shall apply.

1. The above named Contractor Guarantees to the Owner, subject to the limits statedherein, that the labor, materials and workmanship provided in the above referencedproject are in accordance with the Contract Documents, the standards of the industry (asreferenced in the Contract Documents), are of the highest workmanlike quality, and suchare free from defects in material or workmanship.

2. The above named Contractor Guarantees that the Work is effectively installed, willprovide the required performance and appearance, and will remain watertight, undernormal conditions, free of evidence of major deterioration and failure (or pending failure)despite normal wear and tear by the elements, as well as guaranteeing it against defectsin workmanship; Decomposing materials, repeated leaks and other obvious failures ordefects shall be evidence of major deterioration. Normal aging of the specified materialsand normal wear and tear, as determined by the Architect, shall not be considered majordeterioration.

3. The above named Contractor Guarantees to the Owner that he will, at his own expense,make or cause to be made, any repairs that may be necessary as a result of defects inmaterial or workmanship supplied by the Contractor, including Subcontractors in hisemploy, and will maintain said Work in a sound watertight condition free from any and allleaks and water intrusion due to, but not limited to: (a) ordinary wear and tear of any orall of the component materials of the roofing, sheet metal, or flashing assemblies; (b)back water laps in the sheet metal assemblies; (c) pop riveted and soldered joint failure;(d) premature deterioration of materials; and (e) workmanship deficiencies at the time ofapplication.

4. Upon notice by Owner to Contractor of need for repair of Work, the Contractor shall; (a)Inspect and make immediate temporary repairs as required to stop leaks or correct otherdefects in the Work and any associated work of this Project named herein, within twenty-four (24) hours of notice received from the Owner by telephone, facsimile, telegram orletter; and further agrees to make permanent repairs to restore or replace the Work tothe quality standards originally specified within reasonable time and as weatherconditions permit; and further agrees to make such temporary and permanent repairswithout reference to or consideration of the cause or nature of the leaks or defects insealants provided with the associated work; (b) Contractor, at its own expense andregardless of the cost, shall make such repairs as are required by the Guarantee.

5. The time period covered by the requirements of this Guarantee above shall be asfollows:

(a) During construction, and

(b) From Date of Substantial Completion as set forth above extending for a time periodof five (5) years.

6. This Guarantee does not obligate the Contractor to repair the specified Work, or any partof the specified Work, for leaks, water infiltration, or damage resulting from: (a) Damageto the Work due to mechanical abrasion or abuse not caused by the Contractor or hisSubcontractors’; (b) Any damage to the Work caused by structural defects in, or failureof the building or defects in or failure of, any roof deck, or any other material used as thesubstrate over which the Work is applied, except where the substrate material wasinstalled or applied by the Contractor, or failure of the building substrate (mechanical,structural or otherwise resulting from building movement and/or design defects; (c)Installation of equipment on or through the roof by others; (d) Vandalism; (e) Naturaldisasters, lightning, or tornadoes; or (f) Misuse, abuse or negligence;

7. Repair work required because of the above listed exclusions, will be paid for by theOwner promptly after completion of the required repair work in each instance.

8. In case Owner or his agent has notified the Contractor and confirmed in writing thatrepairs are required, and such repairs are NOT covered by this Guarantee (includingrepairs required by Owner’s alteration, extension or addition to the roof), Contractor,after having obtained Owner’s consent thereto, in writing, shall make or cause to bemade such repairs at Owner’s expense in accordance with the Specifications andprocedures as established by Contractor, and this Guarantee shall thereupon remain ineffect for the unexpired portion of its original term. If Owner fails to so consent or ifrepairs are made by one other than the Contractor or Contractor’s designee, thisGuarantee with respect to only such area, shall be automatically terminated.

9. In the event that (1) Owner or his agent notifies Contractor and has confirmed in writingthe need for repair of Work, and (2) Contractor is unable to promptly inspect and repairsame, and (3) an emergency condition exists which requires prompt repair in order toavoid any substantial damage to Owner, the Owner may make such temporary repairsas may be essential and any such action shall not be a breach of the provisions of thisGuarantee. In such case, the above named Contractor agrees to reimburse the Ownerfor any documented fair and reasonable costs expended by the Owner to make suchtemporary repairs and agrees to effect permanent repairs within a reasonable period oftime.

10. Repair work at the Owner’s cost shall be paid for by the Owner at prevailing labor rates,upon receipt by Owner of Contractor’s itemized invoice of quantities and “Out-of-Pocket”costs for labor burden, and material, including not more than 25% percent markup foroffice and shop overhead and profit (Fee).

11. The above named Contractor agrees to provide immediate (4 hour) response to all callsplaced by the Owner in regards to leaks or damage during the warranty period and toeffect corrective work as is necessary to fully protect the Owner’s best interests or, tootherwise allow the Owner to effect such corrective work with its own crews withoutadversely affecting the terms of this Guarantee and Warranty, or without affecting anyobligations of this above named Contractor. The Contractor agrees to reimburse theOwner for any costs expended by the Owner to make such repairs.

12. The terms of the Contract Documents, which were bid upon and contracted for, arereflected in the terms of this Guarantee, therefore no exculpatory words nor other termslessening the requirements of this Guarantee shall apply. No lesser Guarantee,expressed or implied, shall apply. Conversely, liability shall be as exclusively set forth inthis document.

13. Inspection Service: Contractor agrees to reinspect the completed work during theGuarantee Period every eleven (11) months after completion of the Work and, if it isdetermined that there are defects in the Work, then Contractor shall make, or cause tobe made at its own expense, such repairs as are necessary to remedy said defectswithin the scope of its responsibility under the terms of this Guarantee.
