Dear Ms. McCann-HartJey:
This notice is being provided to you pursuant to RSA 80:89 as notification that the City of Claremont (the "City") intends to sell the real estate (hereafter "the property") located at Tax Map 108, Lot 102. On May 10, 2017, the Claremont City Council authorized the sale of property acquired by Tax Collector's Deed. This property was subsequently acquired by the City pursuant to a Tax Collector's Deed dated August 26, 2019, which was recorded in the Sullivan County Registry of Deeds at Book 2080, Page 609 on August 26, 2019. A copy of this deed is enclosed for your convenience.
You are listed as the former owner of the property.
In accordance with RSA 80:89(1), you, as the former owner of the property, have the right to repurchase the property prior to the City disposing of the property by sealed bid or public auction. You may repurchase the property from the City for the total sum of$ 29,241.43 .** This amount is in accordance with RSA 80:90(1) and includes all unpaid taxes, interest, costs and fees.
• $ 27,468.52 representing all taxes assessed but unpaid as of the date of the tax deed. See RSA 80:90, I(a);
• $ 0.00 as the amount of taxes which would otherwise have been assessed on the property based on its valuation after the date of the tax deed, but for its ownership by the City. See RSA 80:90, I(a);
• $ 662.91 as the amount of all statutory interest accrued on all back truces as of the date of the tax deed and all s~atutory interest which would have otherwise accrued but for the ownership of the property by the City. (This amount of interest is calculated as of the date the former owner must notify the City of his/her intent to repurchase. **The amount listed in this paragraph is subject to change based on the actual date the payment to repurchase is made to the City.) See RSA 80:90, I(b);
• $ 110.00 for all statutory fees charged for notice and recording in connection with the tax collection process. See RSA 80:90, I(c);
• $ 1,000.00 for all legal costs incurred by the City in connection with the property, including those connected with the City's sale or the former owner's repurchase. See RSA 80:90, I(d);
• $ 0.00 representing all incidental and consequential costs reasonably incurred (or estimated to be incurred) by the City in connection with its ownership and disposition of the property (including but not limited to. insurance, maintenance, repairs or improvements, and marketing expenses). ** The amount listed in this paragraph is as of the date of this letter and is subject to change. See RSA 80:90, I(e); and
• $ representing an additional penalty of 10% of the assessed value of the property as of the date of the tax deed, adjusted by the equalization ratio for the year of the assessment. See RSA 80:90, I(f).
If you intend to exercise your right to repurchase the property for the amount specified above, you must inform the City of your intention within thirty (30) days ofreceipt of this notice. See RSA 80:89, II. Notification to the City of your intention to repurchase must be by certified mail, and shall indicate that you are ready, willing, and able to pay all back taxes, interest, costs and penalties. See RSA 80:89, II. The penalty portion of the amount due does not apply if the property is the former owner's principal residence when the tax collector issued the tax deed. See RSA 80:89, II. Within 30 days after notifying the City of your intention to repurchase the property, you must tender the entire repurchase price by certified check or money order to the City. See RSA 80:89, II.
If you exercise the right to repurchase the property under the above-stated conditions, the title to the property upon repurchase will be subject to all liens or other encumbrances of record against the property that existed as of the date of the tax deed (with the exception of true liens), as well as subject to any leases, easements, or other encumbrances as may have been granted or placed on the property by the City.
If you fail to notify the City of your intention to repurchase the property within the time prescribed above, or if you fail to tender the required payment within thirty (30) days after notifying the City of your intention to repurchase, the City will proceed with its plan to offer the property for sale and you will lose all interest in the property upon conveyance. See RSA 80:89, II.
At this time, you are no longer allowed access to the property without prior approval from the City of Claremont. You have 30 days from the date of this letter to contact the City of Claremont to make arrangements to remove any personal belongings from the property. Any personal prope1iy left on the property after that date will be assumed abandoned and the City will dispose of all such property without any obligation to you.
