THE MOMBASA COUNTY FINANCES BILL, 2013

AN ACT of the County Government of Mombasa to provide for various taxation, imposition of taxes, charges for services and other revenue raising measures by the county government; and for matters incidental thereto.

PART 1-PRELIMINARY

1. This Act may be cited as the Finance Act, 2013 and shall come into operation on such a date as the County Executive Committee member for Finance with the concurrence of the Governor may appoint and different dates may be appointed for different provisions.

Short title and commencement

PART II – FEES AND TAXES PAYABLE AND RATES APPLICABLE

2. 1) The taxes, fees and charges set out in the ‘ Proposed Charges’ Schedule shall apply for the respective services listed in the ‘items description’ column and at the rates set out therein.

Imposition, revision of taxes, fees etc of the County

3) For greater certainty, the taxes, fees and charges applicable at the commencement of this Act shall continue to apply under the existing by – laws of the defunct City Council of Mombasa. Until such by-laws are repealed and replaced by the county legislation.

3.(1)All by laws, directions, resolutions, orders and authorizations on financial management, including the collection and administration of taxes, fees and charges given or issued by the defunct City Council of Mombasa and subsisting or valid immediately before the cessation of the application of the Local Government Act(now repealed) shall be deemed to have been given, issued or madeby or under the authority of the County Assembly pursuant to this Act, until the expiry, amendment or repeal of those directions, resolutions, orders and authorizations on financial management and shall continue, with the necessary modifications, apply to the payment and the administration of

the taxes, fees and other levies under this Act.

(2) Subsection(1) does not apply to the specific respective amounts payable in respect of the taxes, fees, charges or other levies and in that regard, the amount applicable shall be as provided for in the charges column in the schedule.
