INTRODUCTION

The night sky of our Autonomous Region hashistorically enjoyed an exemplary quality, being aworldwide benchmark for astronomical observations.Proof of this, is the situation of two importantastronomical observatories within our boundaries;Observatorio Astronómico Hispano-Alemón de CalarAltoandObservatoriodeSierraNevada.However, thedarknessofourskyisthreatenedbytheindiscriminategrowth of outdoor lighting fixtures. This growth isdirectly relatedtotheeconomicdevelopmentandtheresultingexpansionoftownsandcitiesduringthelastdecades.

The human being usually realizes the valueof the surrounding environment when it is alreadythreatened,andthisisalsothecaseregardingoursky.Thealarmroseonlywhenadeepchangewasperceived.

Nowadays,bylookinguptotheskyatnightwecanonlyseeabrightlightveil.

Light pollution is a problem that not only affects astronomical observations, butalso the natural development of ecosystems and even peopleós health. Moreover, weare depriving future generations of a common good. If we do not take action, futuregenerationswillgrowupwithoutbeingabletoobservethemarvelousstarrysky.Therefore,achangetowardsasustainablemodelofoutdoorlightingistotallynecessarytoavoidtheaforementionednegativeconsequences.Asustainablemodelofoutdoorlightingwillalsopreventenergywastage,whichisdirectlyrelatedtotheemissionofgreenhousegasesandanunnecessaryeconomicexpenditure.

TheGovernmentofAndalusiaiscommittedtomeetthenecessitiesoftheAndalusiansocietywhilenotcausinganecologicaloreconomicimbalance.Inviewoftheabove,since2004,theMinistryoftheEnvironmentisworkingtosolvethisproblem.TheresultofthiseffortwasreflectedbytheadditionoftheregulationoflightpollutiontotheAndalusiaósrules through the Section 7/2007 of the IntegratedManagement of the EnvironmentalQuality Law of July 9th. Posteriorly, the Decree 357/2010, August 3rd, approved theRegulations for the protection of the night sky quality against light pollution and theestablishmentofmeasurementsforenergysavingandefficiency.

Changingthehabitsofasocietythatassociateslightingwitheconomicprosperityisadifficultandslowprocess.Although,theperseverance,politicalwillandsocialparticipationwillundoubtedlyhelptoreachtheobjectives.Regardingthischallenge,LocalCorporationshaveakeyroleandtheRegionalAdministrationwillthereforeprovidethemwithallthepossiblesupport.ItismywishthatthepublicationoftheRegulationsfortheprotectionofthenightskyagainstlightpollutionwillbeausefuldocumenttoalltheagentsinvolvedintheapplicationoftherules,aswellasaconsultationdocumentforallthecitizens.Letuscontinuetoworktogetherontheprotectionofourenvironment;letuspreservethenaturaldarknessofournightsky.

Inadequate artificial lighting has negative consequences on the environment. Themaineffectistheincreaseofthenightskybright,makingastronomicalobservationsverydifficult.Itcanalsobeharmfultoecosystems,alteringvitalcyclesandbehaviorsof nocturnal animals and plants. Moreover, energy consumption is unnecessarilyincreasedthereforeoriginatingagrowthoftheeconomicexpenditureandproductionofatmosphericpollutants.Othernegativeimpactsalsoaffecttheenvironmentalqualityoftheinhabitedareas.Theluminousintrusionisraisedinthepeopleósprivateenvirongenerating problems such as visual fatigue, anxiety and sleep disturbances. It alsomakesitdifficultforthepopulationtoobservethenightsky. Andalusiahastwoopticalastronomicalobservatoriesofhighscientificquality:theobservatory of SierraNevada (Granada) and the observatory of CalarAlto (Almeria).In addition, there are other professional observatories which also perform relevantscientificresearchaswellassomeobservatorieswithinformativeandamateurpurposes.Allthepreviousobservatoriesaremoreorlessaffectedbytheoutdoorlightingemissionstothenightsky,thusdiminishingitsobservationcapacities.

The growing concern about light pollution of astronomical observatories, society ingeneral andRegionalGovernmentofAndalusia resulted in two LegislativeProposalsapprovedbytheAndalusianParliamenturgingtheAutonomousRegionGovernmentto:- To approve regulations regarding the following: outdoor lighting levels, gradualremovalofsphericalluminaires,recommendationsforenergyefficientdesign,outdoorlightinghours,etc.- ToensureanoptimalofenergyefficiencyineveryprojectimplementedorsubsidizedbytheRegionalGovernmentofAndalusia.Touselowpollutinglightsandtoavoidlightemissionabovethehorizontalplane.- To promote the approval of municipal regulations ensuring energy saving andcontrollingtheoutdoorlightingpollution.

- Toconductastudyassessingthemagnitudeoftheprobleminthetwoaforementionedobservatories.- Toapprovearegulationofprotectioninthismatter.

Similarly,theAndalusianOmbudsmanhasrecommendedtheRegionalMinistryoftheEnvironmenttoestablisharegulationfortheprotectionofthenightsky,takingintoaccountthezoningoftheregionaccordingtotheluminousintensitypermitted.

Withoutprejudicetoarticle149.1.23óoftheSpanishConstitution,thearticle57.3oftheStatuteofAutonomyforAndalusia,givestheAutonomousRegionthecompetencetoregulatetheatmosphericenvironmentandthedifferenttypesofcontamination.

Withinthisframeworkofpowers,theLaw7/2007,July9th,ofIntegratedManagementofEnvironmentalQualityisapproved.ThelawregulateslightpollutionforthefirsttimeinAndalusia.Therefore,inSection3ofChapterIIofTitleIV,theLawcoordinatesthematterfromthepointofviewofprevention,minimizationandcorrectionoftheadverseeffectsoftheartificiallightscatteringtowardsthenightsky.Amongotheraspects,theLawestablishesthefoundationsforthezoningoftheterritoryandthelightinglevelspermittedineachzone.TheLawtakesintoaccountthecompatibilityofmunicipalandbusinessinterestswiththescientific,ecologicalandenergysavingones.Furthermore,thestateLaw34/2007,November15th,ofAirqualityandprotectionoftheatmosphere,AdditionalProvisionFour,urgespublicAdministrations,totheextentoftheircompetence,topromotethepreventionandreductionoflightpollution.

TheDecree1890/2008,November14th,whichapprovestheRegulationsforenergyefficiency in outdoor lighting fixtures and its Complementary technical instructionsEA-01 to EA-07, lay down the technical conditions of design, implementation andmaintenancerequiredforoutdoorlightinginstallations.Theobjectivesaretoimprovetheenergysavingandefficiency,toreducetheemissionsofgreenhousegases,tolimitthenocturnalglareor luminouspollutionandtodecreasetheintrusiveordisturbinglight.

TheDecreedefinesSection3ofChapter IIofTitle IVof theLaw7/2007, July9th,withinthebasicregulatoryframeworkoftheLaw34/2007,November15th,regarding

light pollution and the Decree 1890/2008, November 14th. The Decree declares theopticalastronomicalobservatoriesofSierraNevadaandCalarAltoasreferencepointsandapprovestheRegulationsfortheprotectionofthenightskyqualityagainstlightpollutionandtheestablishmentofmeasuresforenergysavingandefficiency.ByvirtueofandinaccordancewithArticle27.9oftheLaw6/2006,October24th,oftheAutonomousRegionGovernment,andinagreementwiththeauthorizationconferredbythesecondfinalprovisionoftheLaw7/2007,July9th,ofIntegratedManagementof the Environmental Quality, as proposed by the head of the RegionalMinistry oftheEnvironment, inaccordancewiththeAdvisoryCouncilofAndalusiaandwiththepreviousdeliberationoftheGoverningCouncilontheAugust3rd2010session,

I HEREBY ORDER THAT

Sole Article. Approval of the Regulations.

BymeansofthisDecreetheRegulationsfortheprotectionofthenightskyqualityagainstlightpollutionandtheestablishmentofmeasurementsforenergysavingandefficiencyisapproved,developingSection3ofChapterIIofTitleIVoftheLaw7/207,July9th,of IntegratedManagementofEnvironmentQualityand incompliancewiththefourthadditionalprovisionoftheLaw34/2007,November15th,ofAirqualityandprotectionoftheatmosphere.

First additional provision. Designation of the astronomical observatories of Sierra Nevada and Calar Alto as reference points.

1.TheopticalastronomicalobservatoriesofSierraNevada(Granada)andCalarAlto(Almeria)aredesignatedasreferencepoints.

2. The Regional Ministry responsible for environmental issues shall approve theinfluence and adjoining influence zones. For that purpose, the observatories arerequestedtosubmittotheRegionalMinistrythedocumentsrequiredinthearticle24oftheRegulationsapprovedbythisDecree.Thedeadlineforthesubmissionofthedocumentsisestablishedinthefirsttransitoryprovision.

Second additional provision. Modification or expansion of existing outdoor lighting installations.

Themodificationorexpansionofexistingoutdoorlightinginstallationsimplyinganincrease over 50% of the power, or a growth over 50% in the number of installedluminariesshallbeconsideredasanewinstallationforthepurposesoftheRegulations.

Third additional provision. Map of illuminated areas of Andalusia.

TheRegionalMinistryresponsibleforenvironmentalissuesshallprepareandpublishthemapoftheilluminatedareasofAndalusia,inamaximumperiodoffouryearsfromthedateofentryintoforceofthisDecree.

First transitory provision. Deadline to request the declaration of E1 zones and reference points.

TherequestsforthedesignationofE1zonesandreferencepointsshallbesubmittedinaperiodofsixmonths fromthedateofentry intoforceof thisDecree.After thedeadline,theRegionalMinistryresponsibleforenvironmentalissuesshallhaveaperiodofsixmonthstodeterminetheE1zonesandreferencepointswithintheboundariesoftheAutonomousRegionofAndalusia.

Second transitory provision. Existing outdoor lighting.

Theoutdoor lighting installationsauthorizedand functioningon thedateofentryinto force of this Regulation shall be considered as existent, as well as those thatalready requested the relevantauthorizations requiredby theapplicable regulations,providedtheyareauthorizedandfunctioning,at the latest, twelvemonthsafter theaforementioneddate.

1.TheoutdoorlightinginstallationsexistingonthedateofentryintoforceofthisDecreeareallowedtomaintaintheirtechnicalcharacteristics,unlesstheyincurinanyoftheprohibitionsestablishedinthearticle11.Inthatcase,therestrictionsincludedintheaforementionedarticleshallbeimmediatelyapplicable,exceptwithregardtothearticle11.c,forwhichamaximumperiodoftwoyears,fromtheapprovaloftheinfluencezonesandadjoininginfluencezonestothedeclaredreferencepoints,isset.

2.InamaximumperiodofthreeyearsfromtheentryintoforceofthisDecree,thelicenseesofeveryoutdoorlightinginstallationshallremovetheluminairesemittinghemispherefluxabove25%ofthetotalfluxemittedbytheluminaire.

Third transitory provision. System of application of the obligations and limitations related to zoning.

Regardlessthesecondtransitoryprovision,theprovisionsoftheRegulationapprovedby this Decree regarding the obligations and limitations related to zoning, shall bemandatoryfromthedateofapprovalofthezoning,tothefollowing:

a)Outdoor lighting installations not authorized and functioning after the date ofapprovalofthecorrespondingzoning,orinstallationsthatpreviouslyrequestedtherelevantauthorizationsrequiredbytheapplicableregulations,butarenotfunctioningtwelvemonthsaftertheapprovalofthezoning.

b) The modification or expansion of outdoor lighting installations affecting orincreasing the power over 50% or luminaires installed after the approval of thecorrespondingzoning.

Fourth transitory provision. Municipal Regulations.

1. Municipalities shall approve or adapt the Municipal Regulations of protectionagainstlightpollutioninagreementwiththeprovisionsoftheRegulationapprovedbythisDecreeinaperiodofoneyearfromtheauthorizationofthecorrespondingzoning,accordingtoarticles29and30oftheRegulation.

2.WithoutprejudicetothecompetencesofotherPublicAdministrations,theRegionalMinistryresponsibleforenvironmental issuesshallprovidethenecessarytechnical,legal and administrative support for the drafting or amendment of theMunicipalRegulationsuponrequestofCityCouncils.

Furthermore,theRegionalMinistryshallprepare inamaximumperiodofoneyearfromtheentryintoforceofthisDecree,amodelofMunicipalRegulations.

Fifth transitory provision. Establishment of the Advisory Committee for the protection of the night sky against light pollution.

TheAdvisoryCommittee for theprotectionof thenight skyagainst lightpollutioncreatedinthearticle33oftheRegulationsshallbeestablishedinamaximumperiodof

oneyearfromtheentryintoforceofthisDecree.

Sole repeal provision. Repeal of legislation.

AnyprovisionsofequalorinferiorlevelthatopposetothetermsestablishedinthisDecreeareherebyrepealed.

First final provision. Establishment of formats and technical instructions.

The licensee of the General Directorate responsible of light pollution issues isallowed to establish the formats of the documents listed in the articles 24 and 29of the Regulations, as well as to approve the technical instructions required to itsimplementation.

Second final provision. Development and implementation.

TheheadoftheRegionalMinistryoftheEnvironmentisallowedtoissueanyprovisionsnecessaryforthedevelopmentofthisDecree.

Third final provision. Entry into force.

This Decree shall entry into force the day following its publication in the OfficialGazetteoftheRegionalGovernmentofAndalusia.

2.REGULATIONSFORTHEPROTECTIONOFTHENIGHTSKYQUALITYAGAINSTLIGHTPOLLUTIONANDESTABLISHMENTOFMEASUREMENTSFORENERGYSAVINGANDEFFICIENCY.

CHAPTERI

GENERALPROVISIONS

Article 1. Objective.

The objective of this Regulation is to regulate the requirements that outdoorlighting installations and technical lighting devices of public and private outdoorlighting shallmeet, and in general, the development of the Section 3 of Chapter IIofTitle IVof theLaw7/2007,July9th,of IntegratedManagementofEnvironmentalQuality.

Article 2. Purpose.

Inagreementwiththearticle62oftheLaw7/2007,July9th,thepurposeofthisRegulationisthedevelopmentofmeasuresfortheprotectionofthenightskyqualityagainstlightpollution,inorderto:

a) To prevent, minimize and correct the effects of the artificial light scatteringtowardsthenightsky.

b) To preserve the natural darkness conditions for the benefit of nocturnalecosystemsingeneral.

c)Topromotetheefficientuseoflightingwithoutprejudicetothesafetyofusers.

d) To reduce the luminous intrusion in areas other than those intended to beilluminated,mainlyinnaturalenvironmentsandinsideresidentialbuildings.

e)Tosafeguardthequalityofthenightskyandtomakeitsobservationeasieringeneral,andespeciallyinthesurroundingsoftheastronomicalobservatories.

Article 3. Scope.

1.Inaccordancewiththearticle60oftheLaw7/2007,July9th,theprovisionsofthisRegulationshallapplytothepublicandprivateoutdoorlightinginstallations,technicallightingdevicesandlightingauxiliaryequipment,intheterritorialscopeoftheAutonomousRegionofAndalusia.

2. Lighting of port, airport and rail activities that occur in those installations,lighting of cableway installations, military installations, vehicles, lighting ofcoastsandmaritime signaling, and ingeneral, the lightingof installationsandinfrastructuresunderspecific regulationsthat requirespecial lightingmeasuresforsafetyreasons,areexcludedfromthescopeofthisRegulation.

3. Light produced by combustion in the framework of an activity subject toadministrative authorization or to other forms of administrative control,whennotintendedforillumination,isalsoexcludedfromthescopeofthisRegulation.

Article 4. Definitions.

The concepts listed in the International Electrotechnical Vocabulary of theInternationalElectrotechnicalCommission,inthesectionregardingLightingTechnology,shall apply for the purposes of this Regulation, without prejudice to the followingdefinitions:

1. Light, light pollution and energy efficacy:

a) Light pollution: emission of luminous flux due to artificial night lightinginstallations with inadequate intensities, directions or spectral ranges for thedevelopmentoftheactivitiesforeseenfortheilluminatedarea.

b)Lightingefficacy:quotientofthetotalluminousfluxemitted(productoftheilluminatedsurfaceandtheaverageilluminance)dividedbythetotallamppowerinput.

ε=Energyefficacyoftheoutdoorlighting(m2lux/W). P=totallamppowerinput(lampsandauxiliaryequipment)(W). S=illuminatedarea(m2)

Em=averageilluminanceoftheinstallationconsideringtheforeseenmaintenance(lux).

c) Artificial light scattering: phenomenon caused by direct emissions andreflections,refractionsandtransmissionsofartificial light intomaterialsoftheEarthóssurfaceoratmosphericelements.

d)Visiblespectrum:rangeoftheelectromagneticradiationspectrumtowhichthehumaneyeissensible.

h) Refraction of light: physical phenomenon produced when light changes itsdirectionwhenitcrossesaninterfacebetweentwomediawithdifferentnatureandaggregationstateandasaconsequence,itnolongerpropagatesinthemediumfromwhichitoriginatedandcontinuespropagatingintothenewmedium.

i)Transmissionoflight:physicalphenomenonproducedwhenlightsuffersafirstrefractionwhencrossingan interface, itcontinuespropagatinganditsuffersasecondrefractionwhencrossingagaintotheoriginalmedium.

c)Installedupperhemispherefluxorupwardlightoutputratioinstalled(ULORinst):proportionofthetotalluminousflux,expressedasapercentage,emittedabovethehorizontalplanebyanoutdoorlightingfixture,installedinitsnormalpositionofdesign(dimensionlessmagnitude).

d)Illuminance(E):relationbetweentheluminousfluxemittedbyasourceandthesurfacewhereitfalls(theluxisitsunitofmeasurement).

e)Averagehorizontalilluminance(Em):valueoftheaveragehorizontalilluminanceofthespecifiedsurface(theluxisitsunitofmeasurement).

f)Luminousfluxintensity(I):luminousfluxemittedperunitofsolidangle(itsunitofmeasurementisthecandela).

g)Luminance(L):luminousintensityperunitarea(viewedbythehumaneye)oflighttravellinginagivendirection(itsunitofmeasurementisthecandela/m2).

h)Averageluminance(Lm):valueoftheaverageluminanceofthespecifiedsurface(itsunitofmeasurementisthecandela/m2).

3. Lighting equipment:

a)Outdoorlightingfixture:devicethatproduces,distributes,filtersortransformsartificiallightintendedtooutdoorlighting.

b)Auxiliaryequipment:elementsthatmakepossibletheswitchingon,correctionand regulationof the luminous level of the light sources (ballasts, condensers,starters,astronomicalclocks,regulators,etc.).

g)Louvre:reflectororsurfacelocatedintheinteriorofaluminairethatmodelstheshapeanddirectionofthelampluminousflux.

h)Projector:lightingdevicethatconcentratesthelightfromalampinalimitedsolidanglethroughanopticalsystem(mirrorsorlenses)toproducehighluminousintensitytowardsagivendirection.

i)Automaticsystemsofswitchingonandoff,regulationandcontrol:devicesthatpermitthefunctioningofthelightinginstallationinavariableregimen.

Article 5. Collaboration agreements

AgreementsbetweentheAdministrationoftheRegionalGovernmentofAndalusiaandtheLocalAuthorities,aswellasbetweenthelatterandtheinternationalprofessionalastronomicalobservatories,shallbepromotedaccordingtothecriteriaestablishedinthearticle8.1,withtheobjectiveofreducingandcontrollinglightpollution.

Article 6. Zoning.

a)E1.Darkareas.Comprisesthefollowingzones:

1st Zones located in land classified as non-developable by the urbanplanning, included in natural sites of the Autonomous Region, with a specialprotectionregimenundertheregional,stateorcommunityregulations,orunderinternationalconventionsandstandards,wherecertainhabitatsandspeciesarefound,whichduetoitsgreatecologicalvalueorsingularityneedtobeprotectedfromthedisturbingeffectofartificiallight.

2ndZonesofspecialinterestforscientificresearchthroughtheastronomicalobservationwithintherangeofthevisiblespectrum.

b)E2.Areasthattoleratereduced luminousflux: landclassifiedasdevelopableandnon-developableandnotincludedinzoneE1.

c)E3.Areasthattoleratemediumluminousflux.Comprisesthefollowingzones:

1st Residential zones inside the urban area and the periphery, withmedium-lowbuildingdensity.

c)Low:lessthan75housings/hectareorlessthan1m2roof/m2floor.

Article 7. E1 Zones.

1. In accordancewith theprovisionsof the article64of the Law7/2007, July9th, the RegionalMinistry responsible for environmental issues, acknowledgedthe affected city councils, shall establish the areas corresponding to E1 Zone,followingtheproceduredescribedinSection1ofChapterIII.

2.Inordertoprotectdarkareas,thezoningoftheterritoriesadjoiningtoanE1zonemusthaveE2classification.

Article 8. Reference points.

1.Thefollowingcanbeconsideredasreferencepoints: a)Theprofessionalobservatorieswithinternationalcategory.

b)Otherobservatoriesfocusedonscientific,academicorpostgraduatestudiesaswellasthoseconsideredasrelevantobservatoriesofamateurassociations.

The following criteria shall be taken into account for the establishment ofreferencepoints:

1stGenerationofrelevantscientificdata. 2ndDevelopmentofinformationandtrainingactivities.

2.Foreachreferencepoint,itsinfluencezone(Z1)isdefinedasthesurfacebetween the perimeter of the reference point and an equidistant line, onekilometerawayfromit.Theextensionofthissurfacecanbemodifiedaccordingtotheparticularconditionsofthereferencepointoritssurroundings.

3.Toavoidhighprotectionareasfrombeingadjacenttoareasthattoleratehighluminousflux,aninfluencezone(Z1)andanadjoininginfluencezone(Z2)shallbedefinedaroundthereferencepoint.

ThedefinitionofZ2zones,shalltakeintoaccountthespecificcharacteristicsoftheastronomical localityand itssurroundingsregardingorographyandorientation.Inthatsense, thenecessityofhigherprotection intheareaswithdirectvisionfromthereferencepointshallbeconsidered,aswellasinareasfromwhichlightemissionsareemittedtotheatmospherewithoutorographyactingasanaturalbarrier.

4.Influencezones(Z1)shallreceivethefollowingminimumclassificationregardingthetypeofreferencepointtowhichtheycorrespond:

a)E1classification:influencezonesofobservatoriesconsideredofinternationalcategoryaccordingtothecriteriaestablishedinsection1ofarticle8.

b)E2classification:influencezonesofotherobservatoriesfocusedonscientific,academicor postgraduate studies aswell as relevant observatories of amateurassociations,whichhavethisconsiderationaccordingtothecriteriaestablishedinsection1ofarticle8.

5.Theclassificationoftheadjoininginfluencezone(Z2)shallbethesameoronedegreelowerthanthatoftheinfluencezone(Z1).

Article 9. Outdoor lighting classification.

In accordancewith the provisions of the Complementary Technical InstructionEA-02oftheDecree1890/2008,November14th,whichapprovestheRegulationsofenergy efficiency in outdoor lighting installations and theComplementary TechnicalInstructionsEA-01toEA-07,thefollowingoutdoorlightingtypesareconsidered:

SECTION 2.Restrictions and Lighting features

Article 10. Restrictions to lighting parameters.

1. Thedesign, implementation andplacing into service of the outdoor lightinginstallationsmustfollowtheindicationsestablishedinthisRegulationandotherapplicableregulations.

2.TherequirementsandilluminationlevelsforthedifferenttypesoflightingarespecifiedintheComplementaryTechnical Instructions02and03oftheDecree1890/2008,November14th,andinthefollowingarticles.

3.TheCityCouncilsareabletomodifythelightingparametersestablishedinthisRegulationaccordingtotheconcretenecessitiesofitsterritory,providedthatthemodificationsimplyahigherprotectionofthenaturaldarknessofthenightsky.Similarly,CityCouncilsareabletoestablishalowerprotectionlevelduetodulyjustified security reasons, having to report the Administration of the RegionalGovernmentofAndalusiaineachcase,fortheinformationoftheRegionalMinistryresponsibleforenvironmentalissues.Thereportshallberegulatedbythearticle56oftheLaw7/1985,April2nd,RegulatoroftheLocalRegimenBasesandbytheDecree41/2008,February12th,whichregulatesthereferralofimplementationsandagreementsof the LocalAuthorities to theAdministrationof theRegionalMinistryofAndalusia.

4. Therefore, according to the characteristics of each reference point and itsinfluence zone and adjacent influence zone, the RegionalMinistry responsibleforenvironmental issues isabletoestablishmorerestrictive illumination levelsandoutdoorlightingrequirements,afterconsultationwiththeinterestedparties.

Article 11. Restrictions of use.

Inaccordancewiththeprovisionsofthearticle66oftheLaw7/2007,July9th,intheframeworkofthisRegulationandwithgeneralcharacter,itisprohibited:

a)Theuseofconventionalleds,lasersandprojectorsemittingabovethehorizontalplane,withadvertising,recreationalorculturalpurposes.

b)Lightingofbeachesandcosts,exceptthoseincludedphysicallyandfunctionallyinpopulationcenters.

c)Useofnon-monochromaticlampsintheinfluencezoneandadjacentinfluencezoneofareferencepoint.

d)Useofilluminatedaerostatsforadvertising,recreationalorculturalpurposesduringthenighttime.

e)UseorinstallationofluminoussignsinE1zones.

Article 12. Exceptions to the restrictions of use.

1.Accordingtotheprovisionsofthearticle66.2oftheLaw7/2007,July9th,therestrictionsestablished in theanteriorarticle shallbeomitted in the followingcases:

a)Dulyjustifiedcasesofcitizenshipsecurity.

b)Rescueoperationsandotheremergencysituations.Thisexceptionwillonlybeapplicableduringtheextentoftherescueoperationortheemergencysituation.

c)Temporaryeventsofspecialsocialinterest,amongwhicheventsoftouristicandeconomicaswellasculturalorsportinginterestareincluded.Thisexceptionwillonlybeapplicableduringtheextentoftheevent.

d)Lightingofmonumentsorareasofspecialheritageandculturalinterest.

e)Forotherdulyjustifiedlightingusesofspecialinterest.

2.TheagreementoftheCityCouncilauthorizingtheexceptiontotherestrictionsintheforeseencasesinparagraphsc),d)ande)oftheanteriorsection,isrequired.

Article 13. Lamps and luminaires features. WithoutprejudiceoftheprovisionsoftheDecree1890/2008,November14th,thelampsandluminairesmusthavethefollowingcharacteristics:

a)Regardingthetypeoflamp,thosewithhigherenergyefficiencyandcompatiblewiththerequirementsofthisRegulationshallbeused.

InE1andE2zonesadjacenttoE1zones,theemissionintheshortwavelengthbandofthevisiblespectrumshouldbeavoided,concentratingthelightmostlyinwavelengthsabove525nm.Lampsorfilterstoensurethatlightunderwavelengthsof440nmisnotbeingemittedshallbeinstalled.Whenthereisnotaneedofhighcolorrenditionintheilluminatedzoneandwhenthetechnicalcharacteristicsoftheinstallationallowit,monochromaticoralmostmonochromaticlampsshallbeused.

b)Luminaireswithadesignthatprojectslightbelowthehorizontalplaneshallbeused,withoutprejudiceoftheprovisionsofarticle14.

c)Withgeneralcharacter,luminairesthatdonotprojectlightoutsidetheobjector area tobe illuminatedand that prevent light from introducingdirectly intoadjoiningpropertiesor fromdirecting towards thenightsky, shallbeused.Forthispurpose,parameters,slats,louversoranyotheradequateelementsshallbeinterposed.

Article 14. Ornamental lighting.

1.Intheparticularcaseofornamentallighting,theaimistodisposetheluminairesinawaythatallowsthemtoemittheluminousfluxdownwards.Incaseitisnotpossible,louversshallbeused,provideditistechnicallyviable.

2.Thislightingmustbeturnedoffinthenighttimeperiodspecifiedbythearticle18.1.

3.CityCouncilsareallowedtoestablishexceptionstothelightingofbuildingsorsitesofspecialhistoricandculturalinterest,accordingtotheirsingularheritageandculturalvalues,duringthenighttime.

ForthosemunicipalitieshavingpropertieslistedintheGeneralCatalogueoftheAndalusianHistoricalHeritage,theprovisionsofthisarticleareapplicablewithoutprejudiceofthemeasurementsestablishedbythehistoricalheritagelegislationtopreventitsvisualorperceptivepollution.

4. The ornamental lighting shall not exceed the limit values established in theComplementaryTechnicalInstructionEA-02oftheDecree1890/2008,November14th.

Article 15. Electrical signs and advertisements lighting.

1.During thenight time established in the article 18.1, only those advertisingposters,billboardsandsignsthatinformaboutthelocalizationandexistenceofplaceswhereservicesareprovidedwhiletheseareoperational,willremainlit.

2. Without prejudice to the provisions of the anterior section, the signs andadvertisements lighting shall be implemented through luminaires emitting theluminousfluxdownwards.

3. The lighting of signs and advertisements shall not exceed the limit valuesestablished in the Complementary Technical Instruction EA-02 of the Decree1890/2008,November14th.

Article 16. Festival and Christmas lighting.

1.FestivalandChristmaslightingshallberegulatedbytheCityCouncilsthroughitsownlightingsystemwhichshallminimizelightpollutionandoptimizeenergyconsumption.

2. In any event, the maximum values of installed power established in theComplementaryTechnicalInstructionEA-02oftheDecree1890/2008,November14th,shallbesatisfied.

Article 17. Luminous intrusion.

Newoutdoorlightinginstallations,understoodasthosethatarenotconsideredexistentunderthecriterialistedinthesecondtransitoryprovision,exceptfestivalandChristmaslighting,shallmeetthemaximumvaluesestablishedintheComplementaryTechnicalInstructionEA-03oftheDecree1890/2008,November14th,withtheaimofminimizingtheeffectsofintrusiveordisturbinglightonresidentpersonsandcitizenshipingeneral.

Article 18. Lighting regimen and hours of use.

1.Withgeneralcharacter,thenighttimeisestablishedasthatwithinthefollowingtimeslot:

a)From0:00hoursto6:00hours,duringwintertime. b)From1:00hoursto6:00hours,duringsummertime.

2.CityCouncilsareallowedtoestablishintheirmunicipalregulationsjustifiablyextensionsofthenighttime.

3.Alloutdoorlightinginstallations,neworexistent,shallhaveautomaticsystemsof regulationorswitchingonandoff,necessaryto fulfill theprovisionsof thisRegulationandthoseoftheDecree1890/2008,November14th.

4. In E1 and E2 zones, the outdoor lighting that is not necessary for securityreasonsshallremainswitchedoffduringthenighttime.

5.TheoutdoorlightinginstallationsinzonesE3andE4shallreduceasmuchaspossible the luminous fluxduring thenight timewith regard to theapplicablelimitswhilemaintainingtheuniformityofthelighting.

6.CityCouncilsareallowedtomakeexceptionstotheprovisionsofsections4and5fordulyjustifiedcases,forthedevelopmentofrecreationalnatureactivitiesaswellascultural,sporting,touristic,commercial,industrialoragriculturalactivitiesduringnighttime,providedtheyareauthorizedbythecompetentAdministration.

Article 19. Maintenance operations.

Duringmaintenanceoperationsofalloutdoor lightinginstallations,publicaswellas

private, theprovisionsof thisRegulationaswell as thoseof theDecree1890/2008,November14th,shallbetakenintoaccount.

Article 20. Outdoor lighting installations subject to authorization or licensing.

1.Thelicenseesoftheoutdoorlightinginstallationsrelatedtoactivitiessubjectto integratedenvironmentalauthorization,unifiedenvironmentalauthorization,environmental qualification, building permit or other municipal interventionactions through the relevant authorizations or administrative licenses, shallincludeintheprojectpresentedwiththecorrespondingauthorizationorlicenserequest, according to the provisions of this Regulation, at least, the followinginformation:

a) The justification of the lighting parameters levels in the foreseen outdoorlightinginstallations.

b)Theinstalledupperhemisphereflux(ULORinst). c)Thetechnicalfeaturesoftheluminaires,lampsandauxiliaryequipment. d)Theforeseencontrolsystems. e)Theenergyefficiencyandsavingcriteria. f)Theinstallationplans.

2.IntheseprojectstheULORinstshallbeinferiororequalto1%.Whenthisisnotpossible,itmustbejustifiedintheprojectandundernocircumstancesthevaluesestablishedinAnnexIshallbeexceeded.

3. The projects of public installations shall necessarily comply with the lightpollutionpreventionandcorrectioncriteriadefinedinthisRegulation.

CHAPTERIIIPROCEDUREFORTHEDECLARATIONOFLIGHTINGAREASANDREFERENCEPOINTS

SECTION 1. Procedure for the Declaration of E1 Zones and Reference Points

1.ThelicenseeofthecorrespondingProvincialDelegationoftheRegionalMinistryresponsible forenvironmental issueshas thecompetence to initiate,dealwith,resolveandrevisethedeclarationofE1zonesandreferencepoints.

2.IftheE1zoneinvolvesmorethanoneprovince,theprocedureshallbeprocessedandresolvedbytheGeneralDirectorateresponsibleforlightpollutionissues.

Article 22. Initiation.

The declaration of E1 zones and reference points shall be initiated, throughresolutionofthecompetentbodyoruponrequestoftheinterestedpersons.

Article 23. Application.

1.TheapplicationshallconformtothemodelinAnnexIIandshallbeaddressedtothecompetentbody.

Theapplicationsmade by non-electronicmeans shall be submitted alongwiththe required documentation in any of the offices or registers stated in thearticle38.4oftheLaw30/1992,November26th,oftheLegalRegimenofPublicAdministrations and the Common Administrative Procedure, as well as in thearticle82oftheLaw9/2007,October22nd,oftheAdministrationoftheRegionalMinistryofAndalusia.

2.Thesubmissionofapplicationscanalsobemadebytelematicmeansthroughthe Internet,underthetermsofthearticles6and13oftheDecree183/2003,June24th,whichregulatesthecitizenósadviceandinformationserviceandtheprocessingofadministrativeproceduresbyelectronicmeans(Internet)andotherapplicable regulations, as well as the articles 83 and 113 of the Law 9/2007,October 22nd. The applications, which shall comply with the requirementsestablishedinthearticle12.3oftheDecree183/2003,June24th,intheframeworkof the requirements established in thearticle7.4of the Law9/2007,October22nd,shallbesubmittedtotheTelematicRegisteroftheAdministrationoftheRegionalGovernmentofAndalusia.Theapplicationcanbefoundinthecitizensówebsite“andaluciajunta.es”,aswellasinthewebsitewww.juntadeandalucia.es/medioambiente.

3.Theprovisionsofthearticles9and16oftheDecree183/2003,June24th,areapplicabletothesubmissionofelectronicdocuments.Underthesecircumstances,theinterestedpersonsshallhavearecognizedelectronicsignature,regulatedbythearticle3oftheLaw59/2003,December19th,ofelectronicsignature,orbytheelectronicsignaturesystemincludedtotheNationalIdentityDocumentaccordingtothearticles14and15oftheLaw11/2007,June22nd,ofelectronicaccessofthecitizenstothePublicServices.Inthecaseoflackingtheaforementionedtools,theprovisionsofthearticle22ofthisDecreeshallapply.

4.Theapplications that includea recognizedelectronic signatureand thataresubmittedaccordingtotheprovisionsoftheDecree183/2003,June24th,shallhave,withregardtotheelectronicdataanddocuments,thesamelegaleffectsthantheapplicationssubmittedinaccordancewiththearticle70.1oftheLaw30/1992,November26th.

5.Theinterestedpersonshallopt,atanypointoftheprocedure,foratelematicprocessingmethodoranon-siteone.

Article 24. Documentation.

1.Theapplications,withoutregardtothesubmissionform,shallbeaccompaniedbythefollowingdocuments,whichcanbesubmittedtotheTelematicRegisterof the Administration of the Regional Government of Andalusia, provided itsauthenticity,integrity,conservationandotherguaranteesandrequirementslistedinthearticle12oftheDecree183/2003,June24th,areguaranteed:

a)Limitsof thezoneor localizationof thearea forwhich theclassificationofE1 zone or reference point is requested. The geographic information shall bedigitallysubmittedinshapefile(shp)formatorcompatibleformatanddefinedintheEuropeanDatum150(ED50)referencesystemorintheEuropeanTerrestrialReferenceSystem89(ETRS89),inUTMZone30projection.

b)Mappingoftheareaintheformatspecifiedinthepreviousparagraph.

c) Sworn declaration stating that the area is affected by some environmentalprotectionlevel.

d)Descriptionofthezoneandhabitatsorspeciestobeprotectedwithinit,aswellasothervaluesthatjustifytheapplication.

e)Classificationandqualificationofthelandaccordingtotheurbanplanning.

f)Sworndeclarationstatingtheownershipofthelandproperty.

g)SworndeclarationstatingthelandusesandexploitationsintheareaproposedasE1zoneorreferencepointandinthesuggestedinfluencezones.

h)Explanatoryreportoftheproblemscausedbylightpollutioninthemomentofthesubmissionoftheapplication,aswellasthepotentialrisks.

In the case of reference points, the report shall include representativemeasurements of the night sky glow reported from the observatory.Moreover,supporting documents stating that relevant scientific data is produced in theobservatory,suchascompletereferencestopapersandpublicationswheredataobtainedintheobservatoryhavebeenused,shallbeincluded.Whereappropriate,alistoftheeducationalandtrainingactivitiescarriedoutintheobservatoryinthepastfiveyearsshallbeincluded.

i)Inthecaseofreferencepoints,thelimitsoftheinfluencezoneandadjacentinfluencezoneproposedbytheapplicantshallbesubmitted,accompaniedbythecartographyofthearea.

j)Description,asdetailedaspossible,oftheoutdoorlightinginstallationsexistentintheE1zoneorreferencepoint,aswellasthoselocatedintheproposedinfluenceandadjacentinfluencezones.

k)Otherrelevantdata.

2.Notwithstandingtheprovisionsofthepreviousparagraph,inaccordancewiththearticle84.3oftheLaw9/2007,October22nd,theinterestedpersonsshallnotpresentthedocumentsthatarealreadyinthepossessionoftheAdministrationof theRegionalGovernmentofAndalusia,providing thedateandprocedureofsubmissionareindicated.

3. The Public Administration may request the collation of the content of theprovided documentation. In the case that the collation is impossible andwithexceptionalcharacter,thePublicAdministrationmayrequestthedisplayofthedocumentortheoriginal information.Thesubmissionofthesedocumentsshallimply the applicantós consent to theuse of the personal information includedin the documents by the Public Administration, according to the provisions ofthe article 6.2 of the Organic Law 15/1999, December 13th, of Personal DataProtection.

4.Accordingtotheprovisionsofarticle111.4oftheLaw9/2007,October22nd,theinterestedpersonsshallsubmitthedocumentsfromthirdpartiesbytelematicmeans,providedtheguaranteesandrequirementsestablishedinthearticle12oftheDecree183/2003,June24tharemet.

Article 25. Procedure.

1.AfterthedeadlineforsubmissionofapplicationsestablishedintheFirsttransitoryprovision of theDecree bywhich this Regulation is approved, the applicationsshall be examinedby the competentbody thatwill assess their suitability andadequacy to theE1zoneor referencepointclassification. Thecompetentbodywillinformtheinterestedpersonsaboutthemaximumperiodoftimeforissuingandnotifying the resolution terminating theprocedureandwhereappropriate,abouttheadministrativesilenceimplicationsaccordingtoarticle42.4oftheLaw30/1992,November26th.

InthecaseswhereanapplicationisnotneededtoinitiatetheprocedureforthedeclarationofE1zonesand referencepoints, in thenotificationorpublicationof the agreement of initiation, the following shall be included: the maximumperiodoftimeforissuingandnotifyingtheresolutionterminatingtheprocedure,theadministrative silence implications,whereappropriate, and thedateof thesubmissionoftheapplicationtotheregisterofthecompetentbody.

2.Iftheapplicationrequirementsarenotmetortherequireddocumentsarenotincluded, the interestedpersonsshallbe requestedtocompletetheapplicationwithinaperiodoftendaysandshallbewarnedthatiftheyfailtodoso,theyshallbe deemed to havewithdrawn the application, following the resolutionwhichshallbeissuedaccordingtotheprovisionsofthearticle42oftheLaw30/1992,

November 26th. In accordance with article 15 of the Decree 183/2003, June24th,thisrequirementmaybemadebytelematicmeans,providedtheinterestedpersonshaveexpressedtheirconsenttoitintheapplication.

3.Followingtheinitiationofthedeclarationprocedure,thecompetentbodyshallrequest to theaffectedCityCouncils a reporton theexistentoutdoor lightinginstallationsintheE1zoneorreferencepointandproposedinfluencezones(Z1andZ2)thatincludes,atleast:poweroftheoutdoorlightinginstallations,numberandtypeoflampsanditspower,typesofluminaires,typesofswitchingonandoffsystems,operatinghours,typesofsystemsofluminousfluxregulationwheretheyexist,andageoftheoutdoorlightinginstallations.ThisreportshallbeissuedbytheCityCouncilinthemaximumperiodofonemonth.

4.Thecompetentbodyshallestablishaperiodofpublicinformation,publishingin theOfficialGazetteof theRegionalGovernmentofAndalusia, in thenoticeboardsoftheaffectedCityCouncilsandinthewebsiteoftheRegionalMinistryresponsible for environmental issues, that thedossier is availableduringaonemonthperiod from the announcement to be examinedby anynatural or legalpersonandtomaketherepresentationstheydeemappropriate.Theregulationsestablishedinthearticle86oftheLaw30/1992,November26thareapplicabletothisprocedure.

5. In view of the above, the competent body shall inform the natural personsor entities thatmay be affected by the declaration of zones and, in any case,thoseCityCouncils inwhosemunicipal area are the zones includedabout theprocedure, tomake the representations they deem appropriate in amaximumperiodoffifteendays.

Article 26. Resolution.

1.Followingthehearingprocess,thecompetentbodyshall issuetheresolutionabout thedeclarationof thecorrespondingE1zonesand referencepoints. TheresolutionshallbepublishedintheOfficialGazetteoftheRegionalGovernmentofAndalusiaandinthewebsiteoftheRegionalMinistryresponsibleforenvironmentalissues.

2.Inthecasesofex-officioinitiationoftheprocedure,themaximumperiodto

notify and publish the resolution shall be of sixmonths from the date of theinitiationagreementtowhicharticle25.1refers.Thefailuretonotifyorpublishthecorrespondingresolutionwithintheestablishedperiodshallhavetheeffectsforeseeninthearticle44oftheLaw30/1992,November26th.

3. In the cases of initiation of the procedure upon request of the interestedpersons,themaximumperiodtonotifyandpublishtheresolutionshallbeofsixmonthsfromthedateofentryoftheapplicationintheregisterofthecompetentbody. The failure to notify or publish the corresponding resolution within theestablished period shall have the effects foreseen in the article 43 of the Law30/1992,November26th.

Article 27. Catalogue of E1 zones and reference points.

1. The Catalogue of the E1 zones and reference points is created,which shallbe attached to theRegionalMinistry of theEnvironmentandmanagedby theGeneralDirectorateresponsibleforlightpollutionissues.

2.ThecatalogueshallincludetheE1zonesandreferencepointsdeclaredbythecompetentbody.

3. The RegionalMinistry responsible for environmental issues shall review andupdatetheCatalogueofE1zonesandreferencepointsatleasteveryfiveyears.

SECTION 2.Procedure for the Determination of E2, E3 and E4 Zones.

Article 28. Determination of E2, E3 and E4 zones.

1.Inaccordancewiththearticle64.2oftheLaw7/2007,July9th,theCityCouncilsshalldeterminethelightzonesE2,E3andE4withintheirmunicipalboundaries,attendingtothemainlanduse,withoutexcludingthepossiblepresenceoflandusesdifferentfromthoseindicatedasmajoritarianineachcase.

2.Inaddition,CityCouncilsshalldefinetheirownterritoryclassification,providedthatthecharacteristicsandrestrictionsestablishedbythisregulationforthelightareasarerespected

Article 29. Proposal of zoning.

TheCityCouncilsshallinformtherelevantProvincialDelegationoftheRegionalMinistryresponsibleforenvironmentalissuesabouttheirproposalofzoning,inaperiodofoneyearfromtheapprovaloftheE1zoningoritsrevision.Tothateffect,theyshallsubmitareporttotheProvincialDelegation,withthefollowingminimuminformation:

a)Classificationandqualificationofthelandofeachzone.

b)Developmentpotentialofthedifferentzones.

c)Limitsofeachzoneinshapefile(shp)formatorcompatibleformatanddefinedintheEuropeanDatum150(ED50)referencesystemorintheEuropeanTerrestrialReferenceSystem89(ETRS89),inUTMZone30projection.

d)Mappingoftheareaintheformatspecifiedinthepreviousparagraph.

e)Descriptivereportincludingthejustificationofthezoning.

f)ProgramfortheadaptationoftheexistentoutdoorlightinginstallationstotherequirementsofthisRegulation.Theprogramshall include,at least:analysisoftheadequacyoftheexistentoutdoorlightinginstallationstothelightzonewheretheyare located,descriptionofthenecessarymeasurestoadapttheseoutdoorlightinginstallations,implementationscheduleandassessmentoftheircost.

Article 30. Report of the Provincial Delegation.

1.Theheadof theProvincialDelegation responsible forenvironmentalmattersshallissueinaperiodoftwomonthsfromthereceptionofthezoningproposalforeseeninthearticle29,aperceptiveandbindingreport.

2. Following expiry of the given period without issuing the report, it shall bedeemed favorable according to the provisions of the article 83.4 of the Law30/1992,November26th,andtheCityCouncilshallproceedtotheapprovalofthezoning.

3.Inthecasethatthereportwasunfavorable,theCityCouncilshallhaveaperiodoftwomonthstosubmittherelevantinformationortomodifyitszoning,whenappropriate.Under these circumstances, the ProvincialDelegation shall issue anewreportunderthetermslaiddowninsection1.

4.Fortheissuingofthereportaccountshallbetakenof:

a)Compliancewiththecriteriaforluminouszoningestablishedinthearticle6.

b)Adjustmentofthezoningproposaltotherequirementsofarticle29.

c) Compatibility of the zoning proposal with the determination of E1 zones,referencepointsandtheir influencezonesestablishedbytheRegionalMinistryresponsibleforenvironmentalissues.

d)Compliancewiththelightpollutionregulations.

5.FollowingtheapprovalofthezoningbytheCityCouncil,itshallbereportedtotheAdministrationoftheRegionalGovernmentofAndalusiaaccordingtothereferralregimenofactsandagreementsoftheLocalAuthoritiesregulatedbythearticle56oftheLaw7/1985,April2nd,andbytheDecree41/2008,February12th.Thereportshallbemadeinamaximumperiodoftwomonthsfromtheapprovalofthecorrespondingzoning.

SECTION 3.Revision and Discontinuation of Zoning

Article 31. Revision of the zoning of the territory.

1.TheprocedurefortherevisionofthezoningshallinitiateaftertheagreementoftheheadoftheGeneralDirectorateresponsibleoflightpollutionissuesandshallbepublishedintheOfficialGazetteoftheRegionalGovernmentofAndalusia.

2. The applications for the declaration of E1 zones and reference points shall besubmitted by the interested persons in amaximumperiod of sixmonths from thepublicationoftheagreementfortheinitiationoftherevisionofthecatalogueofE1zonesandreferencepoints.Therevisionshallbedealtwithfollowingtheprocedure

establishedinSection1ofthisChapter.ThenewdeclarationshallbepublishedintheOfficialGazetteoftheRegionalGovernmentofAndalusiaandshalltakeeffectfromthedateofitspublication.

3.FollowingtheapprovalofE2,E3andE4zonesinitsterritory,CityCouncilsshallupdatethiszoninginthefollowingperiodsandunderthefollowingcircumstances:

a)WhentheRegionalMinistry responsible forenvironmental issuesestablishesa newE1 zone or reference point, the affectedCity Councils shall adapt theirzoninginamaximumperiodofoneyearfromthepublicationofthecorrespondingdeclarationintheOfficialGazetteoftheRegionalGovernmentofAndalusia.

b)Withinsixmonthsfollowingthefinalapprovalofthegeneralurbanplanningoritsrevision.

c)Withinthreemonthsafterthefinalapprovalofanymodificationofthegeneralurbanplanningthatimpliesthealterationoftheplanningconditionsofthelanduses.

4.CityCouncilsshallrequestthereportregulatedbythearticle30fortheapprovalof the revisionof thezoning.Followingtheapprovalof thezoningbytheCityCouncils,theyshallinformtherelevantProvincialDelegationinaperiodoftwomonthsfromthedateofapproval.

Article 32. Discontinuation of the zoning.

1. The discontinuation of E1 zones and reference points shall apply if thecircumstancesthatledtotheirpreviousdeclarationhavedisappeared.

2.Thediscontinuationprocedureshallbeinitiateduponrequestorbyagreementofthecompetentbody,whichshallissueareasonedproposal.Thisproposalshallbebroughttotheknowledgeoftheinterestedpersonstomaketherepresentationstheydeemappropriateinaccordancewiththeprovisionsofthearticle84oftheLaw30/1992,November26th.

3. Following the hearing process, the corresponding resolution shall be issued andpublishedinamaximumperiodofthreemonthsfromthedateofentryoftheapplicationinthecompetentbodyorfromthedateoftheinitiationagreement.Followingexpiry

4.ThediscontinuedzonesshallbeconsideredasE2zonesuntiltheCityCouncilsestablishanewclassificationforthemaccordingtotheprocedurelaiddowninthearticle31.

CHAPTER IVTECHNICAL ADVISING FOR THE PROTECTION OF THE NIGHT SKY AGAINST LIGHT

POLLUTION Article 33. Advisory Committee for the protection of the night sky against light pollution.

1. Attached to the Regional Ministry responsible of environmental issues,the Advisory Committee for the protection of the night sky against lightpollutioniscreated,tobereferredtohenceforthastheAdvisoryCommittee,ofinterdepartmentalnature,whichshallhaveadvisingandproposalfunctions.

2.ThefunctioningoftheAdvisoryCommitteeshallfollowtheregulationslaiddownintheChapterIIofTitleIIoftheLaw30/1992,November26th,aswellastheprovisionsoftheTitleIV,ChapterII,Section1oftheLaw9/2007,October22nd.

3.TheAdvisoryCommitteeshallbeintegratedbythefollowingmembers:

a)TheheadoftheGeneralDirectorateresponsibleforlightpollutionissues,whoshallholdThePresidency.

b) The head of theGeneralDirectorate responsible for nature protection areasissuesoftheRegionalMinistryresponsibleforenvironmentalmatters.

c) The head of the General Directorate responsible for issues regarding themanagement of the environment of the Regional Ministry responsible forenvironmentalmatters.

g)TworepresentativesofthemunicipalitiesofAndalusia,designatedbythemostwidelyestablishedassociationofmunicipalitiesandautonomousprovinces.

h)OnerepresentativeoftheSpanishLightingCommittee.

i)OnerepresentativeofthepublicAndalusianUniversities,thatshallbedesignatedbytheheadoftheGeneralDirectorateresponsibleforuniversitymattersoftheRegionalMinistryresponsibleforuniversityissues.

j) Two representatives of business organizations within the regional scope ofAndalusia.

k) Two representatives of themost characteristic trade union organizations ofAndalusia.

l)OnerepresentativeoftheNationalAstronomyCommittee. m)OnerepresentativeoftheAstrophysicsInstituteofAndalusia. n)OnerepresentativeoftheGerman-SpanishAstronomicalCenter.

TheCommitteeshallbeassistedbypersonsofrecognizedtechnicalandscientificcompetenceregardinglightingandenergysavingandefficiencyissues,designateduponrequestofthecorrespondingbody.TheyshalltakepartinthemeetingsoftheCommitteeinanadvisorycapacity,withoutvotingrights.

4.TheCommitteemembersaddressedinlettersg),h),j),k),l),m),andn)oftheprevioussectionshallbedesignatedaccordingtotheprovisionsoftheirownregulations.

5.ThefollowingshallbefunctionsoftheAdvisoryCommittee:

a)ToadvisetheRegionalMinistryresponsibleforenvironmentalissuesabouttheregulationproposalsregardinglightpollutionmattersinAndalusia.

b)ToadvisetheRegionalMinistryresponsibleforenvironmentalissuesaboutthezoningproposals,themeasurementsandtheprogramsimplementedincompliancewiththisRegulation.

c) To propose to the Regional Ministry responsible for environmental issuesthose implementations deemed appropriate and that contribute to the betterdevelopmentoftheobjectivesforeseeninthisRegulation,issuingreportswhenitshallberequired.

d)ToproposetotheRegionalMinistryresponsibleforenvironmental issuestheoutreach,promotionandadvisorytasksderivedfromtheimplementationofthisRegulation.

e)ToadvisetheRegionalMinistry responsible forenvironmentalmattersaboutResearchandDevelopmentissuesregardinglightpollution.

f) To advise the City Councils and other local authorities of the AutonomousRegionofAndalusiaaboutlightpollutionissues.

g)TobeinformedabouttheevaluationandmonitoringreportsissuedwithregardtothezoningagreementsreferredbytheCityCouncils.

CHAPTER VCOMPETENCES

Article 34. Competences of the Regional Ministry responsible for environmental issues.

The Regional Ministry responsible for environmental issues has the followingcompetencestopreventandtocombatlightpollution:

a)Thesurveillance, inspectionandcontrolof lightpollution issueswith regardtopublicandprivateactionssubjectto integratedenvironmentalauthorizationorunifiedenvironmentalauthorization,withoutprejudiceofthecompetencesofotherbodiesoftheRegionalGovernmentofAndalusiaandotherAdministrationsintheirrespectivescopesofcompetences.

b)Thesanctioningpowerwithregardtolightpollutionissues,withoutprejudiceofthecompetencesofotherbodiesoftheRegionalGovernmentofAndalusiaandotherAdministrationsintheirrespectivescopesofcompetences.

c)ThedefinitionofE1zonesandthedeterminationofreferencespointsaccordingtotheprovisionsofarticles6,7and8.

d)Thepromotionofoutreachandcitizenawarenesscampaignsaboutthebenefitsofanadequatenightlighting.

e) According to the principle of collaboration, the promotion of collaborationagreementsbetweentheAdministrationoftheRegionalGovernmentofAndalusiaandthemunicipalitiesandotherlocalauthoritiesoftheAutonomousRegion,tofostertheapplicationofthemeasurementsforeseeninthisRegulation.

f) The promotion of collaboration agreementswith institutions responsible foroutdoorlightinginstallationsthatareexcludedfromthescopeofapplicationofthisRegulationaccordingtothearticles3.2and3.

g)TheestablishmentofmeasurestopromotecompliancewiththeprovisionsofthisRegulation.

h)ThedevelopmentofanyotherfunctionsattributedinthisRegulation.

Article 35. Duty of cooperation.

The Regional Ministry responsible for environmental issues and the LocalAuthoritiesshallcooperate,withintheir respectivescopesofcompetences,toensurecompliancewiththeprovisionsofthisRegulation.

1.TheRegionalMinistry responsible forenvironmental issuesshallperformthedutiesofsurveillance,inspectionandcontroloftheactionsrelatedtopreventionandcontroloflightpollution,accordingtotheprovisionsofthearticle34.ThesedutiesshallbecarriedoutbystaffoftherelevantAdministrationandshallcounton the support of technical staff specialized in the field. The development offunctionsthatimply,directlyorindirectly,theexerciseofpublicpowers,shallbecarriedoutbygovernmentofficials.Inaddition,themunicipalitiesshallperformthesedutieswithinthescopeoftheircompetences.

2.Thefactsuncoveredbytheinspectionreportissuedbythestaffrecognizedasauthorityaccordingtotheprovisionsofthearticles137.3oftheLaw30/1992,November26th,and130.1oftheLaw7/2007,July9th,shallbepresumedtobetruthful, without prejudice of the evidence to the contrary that the inspectedpersonsorinstitutionsshallpresent.

3.Accordingtotheprovisionsofthearticle130oftheLaw7/2007,July9th,thepersonsresponsiblefortheactivities,actionsandinstallationsshallprovidethenecessaryassistanceandcollaboration,andallowtheentry tothe installationstothosepersonsthatcarryoutthedutiesofsurveillance,inspectionandcontrol.

Article 37. Infringements and sanctions.

1.Accordingtotheprovisionsofthearticle138.1.g)oftheLaw7/2007,July9th,thefollowingshallbeconsideredasseriousinfringementsandshallbesanctionedwithfinesfrom30,001to60,000euros:

a)Toexceedthelimitsestablishedinthearticles10,14,15,16and17.

b)Tomaintaintheornamentallightingswitchedonduringthenighttime,withoutprejudicetotheprovisionsofarticle14.3.

c)Tomaintainthesignsandadvertisementslightingswitchedonduringthenighttime,withoutprejudicetotheprovisionsofthearticle15.1.

d) To fail to comply with the obligation of illuminating billboards, signs andadvertisementswith luminaires that emit luminous flux downwards under theprovisionsofarticle15.2.

e)TomaintaintheoutdoorlightingofE1andE2zonesswitchedonwhenitisnotnecessaryduetosecurityreasonsaccordingtotheprovisionsofthearticle18.4.

f)Touseconventional leds, lasersandprojectorsemittingabovethehorizontalplane, with advertising, recreational or cultural purposes according to theprovisionsofthearticle11.a).

2.Thefollowingshallbeconsideredasminorinfringementsandshallbesanctionedwithfinesupto30,000euros:

a)Tofailtocomplywiththerestrictionsestablishedinthearticle10,whicharenotlistedinsection1ofthisarticle.

b)Tofailtocomplywiththerestrictionsofuseestablishedinsectionsb),c),d)ande)ofthearticle11,exceptinthecaseslistedinthearticle12.

c) To use lamps and luminaires that fail to comply with the characteristicsestablishedinthearticle13.

d)Tofailtocomplywiththelightingregimenandhoursofuseestablishedinthearticle18,whicharenotlistedinsection1ofthisarticle.

e)Tofailtocomplywiththemaintenanceoperationsestablishedinthearticle19.

3.TheimpositionofthesanctionsestablishedinthisarticleshallbecompetenceoftheheadoftheProvincialDelegationoftheRegionalMinistryresponsibleforenvironmentalissues.

3. AMENDMENTS TO THE DECREE 357/2010, AUGUST 3rd

First final provision. Amendments to the Decree 357/2010, August 3rd, which approves the Regulations for the protection of the night sky quality against light pollution and the establishment of measures for energy saving and efficiency.

The Decree 357/2010, August 3rd, which approves the Regulations for theprotectionofthenightskyqualityagainstlightpollutionandtheestablishmentofmeasuresforenergysavingandefficiency,isamendedasfollows:

One.Thearticle11.c)shouldreadasfollows:

c) The use of non-monochromatic lamps in the influence zone (Z1) of theobservatory.

Two.Thearticle13.a)wouldnowread:

a)Regardingthetypeoflamp,thosewithhigherenergyefficiencyandcompatiblewiththerequirementsofthisRegulationshallbeused.

InE1andE2zonesadjacenttoE1zones,theemissionintheshortwavelengthbandofthevisiblespectrumshouldbeavoided,concentratingthelightmostlyinwavelengthsabove525nm.Thespectraldistributionofthelightemittedbythelampsshallbesuchasthesumofthespectralradiancesofallthewavelengthsinferiorto440nmislessthan15%ofitstotalradiance.Inthecasethatledsareused,thesumofthespectralradiancesofallthewavelengthsinferiorto500nmshallbelessthan15%ofitstotalradiance.Lampsorfilterstoensurethecompliancewiththepreviouslimitsshallbeinstalled.Whenthereisnotaneedofhighcolorrenditionintheilluminatedzoneandwhenthetechnicalcharacteristicsoftheinstallationallowit,monochromaticoralmostmonochromaticlampsshallbeused.

Three.Thearticle18.3shouldreadasfollows:

Theoutdoorlightinginstallationsshallreduceasmuchaspossibletheluminousfluxduringthenighttimewithregardtotheapplicablelimitswhilemaintainingtheuniformityofthelighting.

Five.Thearticle20.1shouldreadasfollows:

The licenseesof theoutdoor lighting installations related toactivities subject tointegrated environmental authorization, unified environmental authorization,environmental qualification, building permit or other municipal interventionactionsthroughtherelevantauthorizationsoradministrativelicenses,shallincludewiththecorrespondingauthorizationorlicenserequestinimplementationofthecorrespondingsectoriallegislation,accordingtotheprovisionsofthisRegulation,atleast,thefollowinginformation:

a) The justification of the lighting parameters levels in the foreseen outdoorlightinginstallations.

b)Theinstalledupperhemisphereflux(ULORinst).

c)Thetechnicalfeaturesoftheluminaires,lampsandauxiliaryequipment.

d)Theforeseencontrolsystems.

e)Theenergyefficiencyandsavingcriteria.

f)Theinstallationplans.

Six.Thearticle20.2isamendedasfollows:

IntheseinstallationstheULORinstshallbeinferiororequalto1%.Whenthisisnotpossible,itmustbejustifiedintheinformationaccompanyingtheapplicationandundernocircumstancesthevaluesestablishedinAnnexIshallbeexceeded.

Second final provision. Development and implementation.

The head of the RegionalMinistry of the Environment is allowed to issue anyprovisionsnecessaryforthedevelopmentandimplementationofthisDecreeand,specificallytoamendtheTechnicalInstructionslistedintheRegulationapprovedbythisDecree.

Third final provision. Entry into force.

ThisDecreeshallentryintoforceinaperiodofonemonthfromitspublicationintheOfficialGazetteoftheRegionalGovernmentofAndalusia.
