Background Parcel Map 31884 approved by City and recorded

on November 14, 2006. (subsequently revised by Lot Line Adjustment LLA 07-5222).

Original developer entered into Subdivision Improvement Agreements and provided surety bonds for completion of improvements.

Improvements not completed and original developer lost property in foreclosure.

Subdivision Improvement Agreement and Surety Bonds still obligate original developer even though no further interest in property.

Background New property owner sent letters regarding proposed

reversion map in August 2011 and December 2011. City Council adopted Resolution approving intent to

Revert to Acreage on December 20, 2011. New property owner sent notice of public hearing in

January 2012 and contacted by telephone on January 12, 2012.

City Council continued public hearing on January 17, 2012.

Staff met with new property owner on January 31, 2012 to explain requirements for improvement agreements and securities associated with parcel map improvements.

Reversion to Acreage

City Council is permitted to revert to acreage property what was required to make improvements but improvements have not been made within 2 years of final map (Subdivision Map Act Section 66499.11).

Reversion to Acreage map prepared as Parcel Map 36425-R.

Following recordation of Reversion to Acreage Map, agreements and surety bonds from original developer will be released.

Recommendation

Adopt an Ordinance to Revert to Acreage the property known as PM 31884, LLA 07-5222, reserving existing utility and access easements and road right-of-way.
