STATE OF ) OFFICE OF THE WYOMING ) BOARD OF ) COUNTY ) COMMISSIONERS COUNTY OF ) THERMOPOLIS HOT SPRINGS ) WYOMING December 19, 2017 The Hot Springs Board of County Commission- ers met in regular session on Tuesday, December 19, 2017, at 4:00 p.m. in the Public Meeting Room at the Government Annex. Present were Commis- sioners John Lumley, Tom Ryan and Phillip Scheel. Also present was County Clerk Nina Webber and Ad- ministrative Assistant to the Commissioners Penny Herdt. Chairman Lumley led those present in the Pledge of Allegiance. Approval of Agenda The agenda was approved with the following ad- ditions: ADD: Commissioners 4. Owl Creek Water District Discussion; Other Business 4. Fairgrounds Multi-Purpose Building Roof Update THP Reuse Study Contract Amendment The Commissioners approved the contract amend- ment to the THP Reuse Study contract with GDA Engineers in the amount of $4,700.00. The Commis- sioners reviewed an action plan for implementation of the Re-Use Plan presented by GDA. A work ses- sion will be set to work on moving forward with the action plan at the February 6th meeting. Airport Terminal Drainage Plan The Commissioners authorized GDA to pursue the Alternative #1 solution to the terminal area drain- age issues at the new airport. The drainage project is scheduled for 2018 as part of WYDOT’s WACIP plan for FY 2019. HSA Deductible Federal Mandate The Commissioners agreed to raise the HSA plan annual deductible from $2,600.00 to $2,750.00 for in- dividuals and $5,200.00 to $5,500.00 per family ef- fective January 1, 2018 in accordance with the fed- eral mandate to increase HSA plan deductibles on an annual basis as indexed by the IRS. Voluntary Remediation Program – THP Brownfields Study The Commissioners authorized the County Plan- ner to work with Cindi Martinez of the DEQ to in- vestigate enrollment of Hot Springs County in the VRP for soils at the old airport site. Owl Creek Water District Discussion The Commissioners agreed to support the OCWDin their quest to obtain acceptable water in whatever ways possible, up to and including an application for emergency funding to the State legislature during the upcoming session. Other Business Red Lane Water District Dissolution Discussion – The Clerk was authorized to put the statutorily required notice of potential dissolution due to fail- ure to file an annual report in the local paper before the end of the year. No further action will be taken at this time. QT POD Fuel System Annual Service Plan – The Commissioners approved the purchase of the Gold Level Service Plan for the POD Fuel system at HSG in the amount of $995.00. WBI Letter of Agreement – Wyoming Behavioral Institute submitted a letter of agreement for the daily rate charged by WBI for county resident involuntary hospitalization under W.S. 25-10-110. The Commis- sioners approved the Letter of Agreement between Hot Springs County and the Wyoming Behavioral Institute acknowledging the 2018 daily hospitaliza- tion rate of $754.00 for the period of January 1 – De- cember 31, 2018. Fairgrounds Multi-Purpose Building Roof Update – The Commissioners approved a letter to the Fair- board updating the board about ongoing action on the Multi-Purpose Building Roof. Senior Center Roof Update – Commissioner Ryan expressed his appreciation of Commissioner Scheel’s efforts in Cheyenne earlier this month which resulted in the awarding of an Emergency Mineral Royalty grant for the Senior Center Roof project. Correspondence Library Board Minutes November, 2017 Chamber of Commerce Newsletter December, 2017 Fairboard Minutes November, 2017 Steve Torrey Yellowstone Vehicle Registration The Commissioners reviewed the foregoing corre- spondence items. Present were Commissioners John Lumley and Phillip Scheel. Also present were County Attorney Jerry Williams, County Clerk Nina Webber and Administrative Assistant to the Commissioners Penny Herdt. Chairman Lumley led those present in the Pledge of Allegiance. Chairman Lumley suspend- ed Roberts Rules of Order so that business might be conducted in the absence of Commissioner Tom Ryan. Approval of Agenda The agenda was approved with the addition of an Executive Session at 1:00 p.m. for Personnel reasons. Approval of Minutes The minutes of December 5 and 19, 2017 were ap- proved as presented. Reorganization 2018 1. Select Chairman and Vice Chairman – Tom Ryan was appointed Chairman and Phillip Scheel was appointed Vice-Chairman.. 2. Set Meeting Dates – Regular meeting dates for 2018 will be the first Tuesday of the month beginning at 9:00 a.m. and the third Tuesday beginning at 4:00 p.m. 3. Appoint County’s Official Paper –The Independent Record was designated as the County’s official newspaper. 4. Set Commissioners’ Special Ar- eas of Responsibility – The follow- ing areas of special responsibility were designated for each Commissioner: Phillip Scheel: Town Properties, Town of Thermopolis, Search & Rescue, Ther- mopolis Hot Springs Economic Develop- ment Company, Basin Authority Child Support Enforcement, Land Use/Planning Board, Hot Springs County Museum, Hot Springs County Fairboard, Human Re- source Council, Chamber of Commerce, Big Horn Basin Nature & Discovery Center, and Natural Resource Planning Committee. John Lumley: Town Properties, Town of Thermopolis, Senior Citizens Center, BLM Bighorn Basin Resource Management Plan Implementation, Tribal Liaison with the Wind River Indian Reservation, Human Resource Council, Shoshone Forest Trav- el Management Planning Committee and Natural Resource Planning Committee. Public Office Disclosure Statements - The Commissioners filled out public office disclo- sure statements to be filed in the Clerk’s office. Hot Springs County Boards & Committee Appointments The Commissioners appointed the following Coun- ty Board positions: Fair Board - Dawn Peil; NRPC – Randy Wahler; County Health Officer – Dr. Ver- non Miller. As no applications were received for the open positions, Clerk Webber was asked to continue advertising for the Predatory Animal Control Board, with applications due to the Clerk’s office by 5:00 p.m. on Friday, February 2, 2018, with appointment to be made at the February 6th Commission meeting. Maintenance Monthly Report Repairs to the south section of the Senior Center roof are 90% complete. The contractor is waiting for the weather to improve so he can finish the roof proj- ect. The Library HVAC system upgrade was complet- ed last week. New vacuum cleaners will be ordered for the courthouse from the maintenance budget. Road and Bridge Monthly Report Road and Bridge crews have been removing top- soil and stockpiling gravel at the Brown and County pits. The maps and surveys have been received for Hamilton Dome and Lower Cottonwood roads. The Planner is working with the BLM to get permanent Rights of Way permits in place for those areas. When the permits are complete, the official maps will be presented for signature by the Commissioners and placed in the Map Files at the Courthouse. Notice to Proceed has been received for Phase II of the HRRR Guardrail project on East River Road. When the plans are received from L-TAP, the project will be put out to bid. Signage has been ordered for a sec- tion of Missouri Flat Road warning of potentially icy conditions. Mr. Schlager notified the Commissioners that Delbert Daniels is retiring at the end of January. County Planner Monthly Report The Natural Resources Planning Committee will meet on January 16th. The Land Use Planning Board will meet on January 17th for a work session on the Policies section of the Land Use Plan. A letter will be sent to local septic system installers notifying them of the current regulations for installation of septic sys- tems in the County. One significant change involves the “Depth to Groundwater” section of the applica- tion. The Planner will now be requiring visual confir- mation/documentation of this measurement prior to approval of the permit and installation of the system. Youth Alternatives Monthly Report There are currently 14 participants in the diversion program (7 males, 7 females). The quarterly VOA- OJJDP 2017-2018 Nonparticipating State Award Subgrant CFDA #16.540 Reimbursement Request in the amount of $2,063.25 was approved. FBO Monthly Report There were 96 total operations at the airport in December. There were 535 gallons of AvGas sales and 150 gallons of jet fuel sales last month. A new polyurethane cutting edge will be ordered for the snowplow to replace the worn one. High Plains Power has set the transformer and meters for four of the T- hangars. Brad Basse at Jadeco is working with the Fire Marshall to get plans approved and electrical permits issued for the T-hangars. The AWOS Main- tenance Contract with DBT Transportation Services was approved in the amount of $12,505.76 for the time period of November 15, 2017 – September 30, 2019. Emergency Management Monthly Report Emergency Management Coordinator Bill Gordon reported he is finishing up his “After-Action Reports” regarding the eclipse and other events of the last year. His next project is to develop a River Aware- ness Level system for use by members of the public Owl Creek Water District Petition for Inclu- sion – Rice The Commissioners approved Resolution & Order 2018-02 of the Hot Springs County Board of County Commissioners including Todd and Barbara Rice into the Owl Creek Water District without election of additional board members. BLM RMP Sage Grouse Cooperating Agen- cy Status The Commissioners filed a request to participate as a cooperating agency with the BLM in the develop- ment of the further environmental analysis regarding Greater Sage Grouse for the BLM Wyoming RMP’s. Other Business 1. Senior Center Roof eMRG Award – The SLIB Grant MRG-17049 HS to replace the Senior Center roof in the amount of $196,500.00 was approved by the Commissioners. 2. Hangar Lease Transfers – Commissioners approved lease transfers for Block B-Lot 2 at HSG airport from Owl Creek Aviation/Nate Messenger to Ty Higgins, and Block B-Lot 4 at HSG airport from Janice A. McCasland to Daniel C. Wychgram. 3. Fairgrounds Multi-Purpose Building Roof – The Commissioners agreed to consider the voucher from S&B Excavation along with the other December vouchers. Commissioner Scheel will move forward with contacting vari- ous entities regarding project design, manage- ment and bidding. Correspondence: Conservation District 2017 Annual Summary; Museum Board Minutes – October & November, 2017; Kinder-Morgan Pipeline Safety Information; Chamber of Com- merce Newsletter – January, 2018 Executive Session The Commissioners entered Executive Session for Personnel reasons at 1:00 p.m. Those present for the Executive Session included Commissioners Scheel and Lumley, Clerk Webber, County Attorney Wil- liams, Administrative Assistant Herdt, Sheriff Lou Falgoust and Sergeants Jerimie Kraushaar and Beth Helm. The Commissioners left Executive Session at 1:40 p.m. No action was taken during or as the result of the Executive Session. QT POD Fuel System Annual Service Plan – The Commissioners approved the purchase of the Gold Level Service Plan for the POD Fuel system at HSG in the amount of $995.00.

WBI Letter of Agreement – Wyoming Behavioral Institute submitted a letter of agreement for the daily rate charged by WBI for county resident involuntary hospitalization under W.S. 25-10-110. The Commis-sioners approved the Letter of Agreement between Hot Springs County and the Wyoming Behavioral Institute acknowledging the 2018 daily hospitaliza-tion rate of $754.00 for the period of January 1 – De-cember 31, 2018.

Fairgrounds Multi-Purpose Building Roof Update – The Commissioners approved a letter to the Fair-board updating the board about ongoing action on the Multi-Purpose Building Roof.

Senior Center Roof Update – Commissioner Ryan expressed his appreciation of Commissioner Scheel’s efforts in Cheyenne earlier this month which resulted in the awarding of an Emergency Mineral Royalty grant for the Senior Center Roof project.

Hot Springs County Boards & Committee Appointments

The Commissioners appointed the following Coun-ty Board positions: Fair Board - Dawn Peil; NRPC – Randy Wahler; County Health Officer – Dr. Ver-non Miller. As no applications were received for the open positions, Clerk Webber was asked to continue advertising for the Predatory Animal Control Board, with applications due to the Clerk’s office by 5:00 p.m. on Friday, February 2, 2018, with appointment to be made at the February 6th Commission meeting.

Maintenance Monthly ReportRepairs to the south section of the Senior Center

roof are 90% complete. The contractor is waiting for the weather to improve so he can finish the roof proj-ect. The Library HVAC system upgrade was complet-ed last week. New vacuum cleaners will be ordered for the courthouse from the maintenance budget.

Road and Bridge Monthly ReportRoad and Bridge crews have been removing top-

soil and stockpiling gravel at the Brown and County pits. The maps and surveys have been received for Hamilton Dome and Lower Cottonwood roads. The Planner is working with the BLM to get permanent Rights of Way permits in place for those areas. When the permits are complete, the official maps will be presented for signature by the Commissioners and placed in the Map Files at the Courthouse. Notice to Proceed has been received for Phase II of the HRRR Guardrail project on East River Road. When the plans are received from L-TAP, the project will be put out to bid. Signage has been ordered for a sec-tion of Missouri Flat Road warning of potentially icy conditions. Mr. Schlager notified the Commissioners that Delbert Daniels is retiring at the end of January.

County Planner Monthly ReportThe Natural Resources Planning Committee will

meet on January 16th. The Land Use Planning Board will meet on January 17th for a work session on the Policies section of the Land Use Plan. A letter will be sent to local septic system installers notifying them of the current regulations for installation of septic sys-tems in the County. One significant change involves the “Depth to Groundwater” section of the applica-tion. The Planner will now be requiring visual confir-mation/documentation of this measurement prior to approval of the permit and installation of the system.

Youth Alternatives Monthly ReportThere are currently 14 participants in the diversion

program (7 males, 7 females). The quarterly VOA-OJJDP 2017-2018 Nonparticipating State Award Subgrant CFDA #16.540 Reimbursement Request in the amount of $2,063.25 was approved.

FBO Monthly ReportThere were 96 total operations at the airport in

December. There were 535 gallons of AvGas sales and 150 gallons of jet fuel sales last month. A new polyurethane cutting edge will be ordered for the snowplow to replace the worn one. High Plains Power has set the transformer and meters for four of the T-hangars. Brad Basse at Jadeco is working with the Fire Marshall to get plans approved and electrical permits issued for the T-hangars. The AWOS Main-tenance Contract with DBT Transportation Services was approved in the amount of $12,505.76 for the time period of November 15, 2017 – September 30, 2019.

PUBLIC NOTICE

Pursuant to the Wyoming Administrative Pro-cedure Act and the Wyoming Public Service Com-mission’s (Commission) Rules, the Commission hereby gives notice of the Application of Wyoming Gas Company, a division of Natural Gas Processing (Wyoming Gas or the Company) for approval to re-vise the Wobbe Index for its Grass and Lake Creek distribution areas, as more fully described below.

Wyoming Gas is a public utility as defined by Wyo. Stat. § 37-1-101(a)(vi)(D), subject to the Commission’s jurisdiction pursuant to Wyo. Stat. § 37-2-112.

On December 29, 2017, Wyoming Gas filed its Application for approval to revise the Wobbe Index for its Grass and Lake Creek distribution areas. The Company is requesting to revise the Wobbe Index for its Grass Creek distribution area from 1389 to 1324, and the Lake Creek distribution area from 1381 to 1312. Both revisions are based on a historic 12-month weighted average. The Applica-tion is filed in accordance with Commission Rule Chapter 3, Section 1(c)(v)(C).

This is not a complete description of the Appli-cation. Interested persons may inspect the Appli-cation at the Commission’s offices in Cheyenne, Wyoming, and at Wyoming Gas’ office located in Worland, Wyoming.

Anyone wishing to file a statement, interven-tion petition, protest or request for a public hear-ing in this matter must do so in writing filed with the Commission on or before February 5, 2018. Any intervention request filed with the Commis-sion shall set forth the grounds of the proposed intervention or request for hearing as well as the position and the interest of the petitioner in this proceeding. Please be sure to mention Docket No. 30009-63-GA-17 (Record No. 14917) in all corre-spondence with the Commission.

COUNCIL PROCEEDINGS

The Thermopolis Town Council met in regular session January 2, 2018 at 7 pm at Town Hall. Pres-ent were Mayor Mike Mortimore, Council mem-bers Tony Larson, John Dorman Sr., Bill Malloy and Dusty Lewis. Also present were Mayor/Codes Administrative Assistant Fred Crosby, Clerk/Trea-surer Tracey Van Heule, Police Chief Steven Shay, Town Engineer Anthony Barnett and Town Attor-ney Mike Messenger.

AGENDA: Following the pledge of allegiance, Malloy made a motion, seconded by Dorman and carried to approve the agenda with the deletion of 6B – a change order.

MINUTES: Larson made a motion, seconded by Dorman and carried to approve the Council meet-ing minutes from December 5 and 19, 2017.

BILLS: Malloy made a motion, seconded by Lewis and carried to approve the General, Enter-prise and Special Fund bills for December 2017. Larson and Mortimore abstained on the approval of the bills to their businesses.

ACCEPTANCE OF CLERK/TREASURER FI-NANCIAL DISCLOSURE: Larson made a motion, seconded by Dorman and carried to accept the fi-nancial disclosure presented by Clerk/Treasurer, Tracey Van Heule, pursuant to W.S. 6-5-118(a).

TOWN ENGINEER: ANTHONY BARNETT: Dorman made a motion seconded by Larson and

carried to approve pay estimate #3 (to Carr Coat-ings) on the airport tank painting project.

DEPARTMENT REPORTS: Police Chief Shay presented December reports for his departments. Public works reports were also available.

CODES ADMINISTRATION: FRED CROSBY: Nothing at this time.

Public notice is hereby given that the following listed water users have submitted proofs of appropriation and/or construction under the following per-mits as approved by the State Engineer. The below-listed proofs of appropriation or construction will be held open for public inspection from January 22 through January 26, 2018, during the hours of 9:00 a.m. until 5:00 p.m., at the following location(s): State Water Office, 715 E.
