NOTIFICATION

New Delhi, the n"April, 2017G.S.R. 353(E).-In exercise of the powers conferred by clause (iii) of sub-section (2) of section 56

and clause (d) of sub-section (2) of section 100 read with sub-section (3) of section 53 and section 57 of theMetro Railways (Operation and Maintenance) Act, 2002 (60 of 2002) and in supersession of

(i) The Delhi Metro Rail (Procedure to be followed by Claims Commissioner and Amount ofCompensation paid in case of Death and Injuries due to Accidents) Rules, 2007,

(ii) The Bangalore Metro Rail (Procedure for Claims) Rules, 2001 and

(iii) The Chennai Metro Rail (procedure of Claims) Rules, 2014, except as respects things done oromitted to be done before such supersession, Central Government hereby makes the following

rules, namely:-

1. Short title and commencement. - (1) These rules may be called the Metro Railways (Procedure of

Claims) Rules, 2017.(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions. - (1) In these rules, unless he context otherwise requires,

(a) "Act" means the Metro Railways (Operation and Maintenance) Act, 2002 (60 of

2002);(b) "Claims Commissioner" means the Claims Commissioner appointed under section

48 of the Act;(c) "applicant" means a person making an application to the Claims Commissioner

under section 58 of the Act;

(d) "Form" means a form appended to these rules;

(e) "legal practitioner" shall have the same meaning as assignedto it under clause (i) of section

2 of the Advocates Act, 1961 (25 of 1961);

(f) "legal representative" means a person who in law represents the estate of the

deceased;(g) "Schedule" means a Schedule appended to these rules;

(h) "section" means a section of the Act.(2) The words and expressions used in these rules and not defined but defined in the Act shallhave the meanings respectively assigned to them.

3. Procedure for filing applications.-(I) The application for payment of compensation in respect ofaccidents involving death, or bodily injury to person or damage to any property arising out of the working ofthe Metro Railway to the Claims Commissioner shall be presented in the Form given in the First Scheduleeither by the applicant in person or by his duly authorised legal representative:

Provided that an application may also be sent by registered post to the Claims Commissioner.

(2) The application referred to in sub-rule (I) shall be presented in duplicate.

(3) Every application shall be typed legibly in double space on one side of paper of good

quality.4. Scrutiny of application.- (l) The Claims Commissioner shall endorse on every application the date onwhich it is presented or received under rule 3 and sign the endorsement.

(2) If the application on scrutiny is found to be in order, it shall be registered and given a

serial number.(3) If the application on scrutiny is found to be defective and the defect noticed is formal in nature,the Claims Commissioner may allow the applicant, to rectify the same in his presence and if thedefect is not formal in nature, the Claims Commissioner may allow the applicant such time torectify the defect as he may deem fit. .

(4) If the applicant fails to rectify the defect within the time allowed under sub-rule (3), theClaims Commissioner may , by order and for reasons to be recorded in writing, decline to registerthe application and notify the applicant accordingly.

(5) An appeal against the order passed under sub-rule (4) may be preferred by the personsaggrieved within fifteen days from the date of such order and such appeal shall be dealt with anddisposed of by the Claims Commissioner.

5. Notice to Metro Railway Administration.-(I) The Claims Commissioner shall issue notice to MetroRailway Administration to show cause against the application on a date of hearing to be specified therein.

(2) The notice referred to in sub-rule (1) shall be accompanied by a copy of the application:

(3) If the representative of Metro Railway Administration does not appear on the date specified in thenotice referred to in sub-rule (1) or appears and admits the claim, the Claims Commissioner shall..forthwith proceed to disposeof the application.

(4) If the Metro Railway Administration contests the claim, it may file a reply along with copy ofsuch document on which it relies on or before the date of hearing and such reply and copies of thedocuments shall form part of the record.

6. Filing of an Affidavit. -( I) The Claims Commissioner may direct the applicant and the Metro RailAdministration to give evidence, if any, by affidavit.

(2) Notwithstanding anything contained in sub-rule (I), where the Claims Commissionerconsiders itnecessary for just decision of the case, hemay order cross-examination of any deponent.

7. Filing of reply and other documents by the respondents.-(I) The Metro Railway Administration may fileits reply to the application and copies of the documents on or before the date of hearing of the application.

(2) In reply filed under sub-rule (1), the Metro Railway Administration shall specifically admit,deny or explain the facts stated in the application and state additional facts necessary in its reply .

. 8. Summary disposal of application.-The Claims Commissioner may, after considering the application,summarily dismiss the application, if for reasons to be recorded in writing, he is of the opinion that there areno sufficient grounds for proceeding therewith. .

9. Ex-parte hearing and disposal of application-H) Where on the date fixed for hearing the application orany other date to which such hearing may be adjourned, the applicant appears and the representative of theMetro Railway Administration does not appear, the Claims Commissioner may; in his discretion, adjourn the. hearing or hear and decide the application ex-parte.

(2) Where an application has been heard ex-parte against the Metro Railway Administration, theMetro Railway Administration may apply to the Claims Commissioner for an order to set aside the exparte hearing, and if the Metro Railway Administration satisfies the Claims Commissioner that thenotice was not duly served or that its representative was prevented by any sufficient cause fromappearing, the Claims Commissioner may make an order setting aside the ex-parte hearing upon suchterms as he thinks fit and shall appoint the day for proceeding with the application.

10. Disposal of application in default.-fl) Where on the date fixed for hearing the application or any otherdate to which such hearing may be adjourned, the representative of the Metro RailwayAdministration appearsand the applicant does not appear, the Claims Commissioner may, at his discretion, adjourn the hearing orhear and decide the application in default.

(2) Where an application has been heard and disposed in default against the applicant, the lattermay apply to the Claims Commissioner to set aside the order in default and if the applicant satisfies

the ClaimsCommissioner that the notice was not duly served or he was prevented by any sufficientcause from appearing, the Claims Commissionermay make an order setting aside the order in default,upon such terms as he thinks fit and shall appoint the day for proceedingwith the application.

11. Summoningof witnesses and method of recording evidence.-(I) If an application is presented by anyparty to the proceedings for summoning of witnesses, the Claims Commissioner shall issue summons for theappearanceof suchwitnesses unless he considers that their appearance is not necessary for the just decision of~~. .

(2) The Claims Commissioner shall make a brief memorandumof substance of the evidenceofeverywitness as the exarilinationof the witness proceeds and suchmemorandumshall formpart ofthe record:Provided that if the Claims Commissioner does not make such memorandum, he shall record thereasons for his inability to do so and shall cause such memorandum to be made in writing and shallsign the same, and suchmemorandumshall form part of the record.

12. Decision of the Claims Commissioner.- The Claims Commissioner shall decide every application asexpeditiouslyas possible on perusal of documents,affidavits and other evidence, if any, and after hearing suchoral argumentas may be advanced.

'. 13. Order to be passed and signed.-(I) The ClaimsCommissioner, after hearing the applicant and theMetroRailwayAdministration,shall pass an order as he thinks fit, either at once or as soon as thereafter as may bepractiCable. .

(2) Every order of the Claims Commissionershall be in writing and shall be signedby him.(3) An order made by the ClaimsCommissionershall be executedas a decree of civil court and theprovisions of the Code of Civil Procedure, 1908, so far as may be, and shall apply as they apply inrespect of decree of a civil court.

14. Review of decision.-(l) Any person considering himself aggrieved by any order of the ClaimsCommissioner, on account of some mistake or error apparent on the face of the record, or for any othersufficient reason, may apply for review of a final order not being an interlocutory order, to the ClaimsCommissioner.

(2) Where it appears to the ClaimsCommissionerthat there is no sufficient ground for a review, heshall reject the application.(3) Where the ClaimsCommissioner is satisfiedwith the groundsmade in the applivsyionandconsidersit in the interest of justice, he shall allow the application for review:Provided that no such application for review shall be allowed without previous notice to the MetroRailway Administration or to enable it to appear and be heard in support of the order, a review ofwhich is applied for.

15. Orders or directions by the Claims Commissioner.-Nothing in these rules shall be deemed to limit orotherwiseaffect the power of the Claims Commissionerto pass such orders or give such directionsas may benecessaryor expedient to give effect to his orders or to prevent abuse of the process or to secure the ends of

justice.16. Associationof experts.-(1) The Claims Commissionermay, for the purpose of determining any claimfor compensation associate one or more experts possessing any knowledge of any matter relevant to the

inquiry.(2) The fees or allowances, if any, to be paid to the persons associatedwith the inquiry under sub­rule (1), shall be determined by the Claims Commissioner as he considers necessary, and the sameshallbe paid by the Metro RailwayAdministration.

17. Amountof compensation.-(1)The amount of compensationpayable in respect of death or injuriesshall be as specified in the Second Schedule.

(2) The amount of compensation payable for an injury not specified in Part II or Part III of theSecond Schedule but which, in the opinion of the Claims Commissioner, is such as to deprive aperson of all his capacity to do any kind of work, shall be four lakh rupees.

(3) The amount of compensation payable in respect of any injury (other than an injury specified inthe Second Schedule or referred to in sub-rule (2) resulting in pain and suffering), shall be such as theClaims Commissioner may, after taking into consideration medical evidence, besides othercircumstances of the case, determine to be reasonable:Provided that if more than one injury is caused by the same accident, compensation shall be payablein respect of each such injury:Provided further that the total compensation in respect of all such injuries shall not exceed eightythousand rupees.(4) Where compensation has been paid for any injury which is less than the amount which wouldhave been payable as compensation if the injured person had died , and the person subsequently diesof the injury, a further compensation equal to difference between the amount payable for death andamount already paid, shall become payable.(5) The compensation for loss, destruction or deterioration of goods being carried by the passengeras his personal baggage, shall be paid to such an extent as the Claims Commissioner may, aftertaking into consideration all circumstances of the case, determine to be reasonable.

18. Limit of compensation.- Notwithstanding anything contained in rule 17, the total compensation payableunder that rule shall in no case exceed five lakh rupees in respect of anyone person.

G.S.R. 354(E).-In exercise of the powers conferred by clause (i) of sub-section (2) of section 56 ofthe Metro Railways (Operation and Maintenance) Act, 2002 (60 of 2002), and in supersession of

(i) the Delhi Metro Rail (Procedure for Investigation of Misbehaviour or incapacity of ClaimsCommissioner) Rules, 2007,

(ii) the Bangalore Metro. Rail (Procedure for investigation of Misbehaviour or Incapacity ofClaims Commissioner) Rules, 2011 and

(iii) The Chennai Metro Rail (Procedure for Investigation of Misbehaviour or Incapacity ofClaims Commissioner) Rules, 2014, except as respects things done or omitted to be done before suchsupersession, the Central Government hereby makes the following rules, namely:-

1. Short title and commencement- (1) These rules may be called the Metro Railways (Procedure forInvestigation of Misbehaviour or Incapacity of the Claims Commissioner) Rules, 2017.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.- (1) In these rules, unless the context otherwise requires,-

(a) "Act" means the Metro Railways (Operation and Maintenance) Act,2002 (60 of2002);

(b) "section" means a section of the Act;

(c) "Judge" means the Judge of the Supreme Court appointed for conducting the inquiry undersub-rule (3) of rule 3.(2) Words and expressions used in these rules and not defmed, but defined in the Act, shallhave the meanings, respectively assigned to themin the Act.

3. Committee for investigation of complaints.-(I) The Central Government, on receipt of a complaintalleging any definite charges of misbehavior in respect of or incapacity to perform the functions of the officein respect of the Claims Commissioner, shall make a preliminary scrutiny of such complaint.

(2) If, on preliminary scrutiny, the Central Government, considers it necessary to investigate intothe allegation, it shall place the complaint together with supporting material, as may be available,before a Committee consisting of the following persons to investigate the charges of allegationsmade in the complaint, namely:-

(i) Secretary (Co-ordination and Public Grievances) Cabinet Secretariat -Chairman.

(ii) Secretary, Ministry of Urban Development -Member

(i i i) Secretary, Department of Legal Affairs, Ministry of Law and Justice -Member

(3) The Committee shall devise its own procedure and method of investigation which may includerecording of evidence of the complainant and collection of material relevant to the inquiry which maybe conducted by a Judge of the Supreme Court of India under these rules.

(4) The Committee shall submit is findings to the Central Government as early as possible withina period as may be specified by the Central Government in this behalf.

4. Judge to conduct inquiry-I l ) If the Central Government is of the opinion that there are reasonablegrounds for making an inquiry into the truth of any imputation of misbehaviour or incapacity of ClaimsCommissioner, it shall make reference to the Chief Justice of India requesting him to nominate a Judge of theSupreme Court to conduct the inquiry.

(2) The Central Government shall, by order, appoint the Judge of the Supreme Court nominated bythe Chief Justice of India (hereinafter referred to as Judge) for the purpose of conducting the inquiry.

(3) Notice of appointment of a Judge under sub-rule (2) shall be given to the ClaimsCommissioner.

(4) The Central Government shall forward to the Judge a coPy of-

(a) the articles of charges against the Claims Commissioner concerned and the statement of

imputation;(b) the statement of witnesses, if any; and

(c) material documents relevant to the inquiry.(5) The Judge shall complete the inquirywithin such time or further time as may be specified bythe CentralGovernment.(6) The Claims Commissioner concerned shall be given a reasonable opportunity of presenting awritten statement of defence within such time ~smay be specifiedin this behalf by the Judge.(7) Where it is.alleged that the ClaimsCommissioneris unable to discharge the duties of his office.efficiently due to any physical or mental incapacity and the allegation is denied, the judge mayarrange for the medical examination of the Claims Commissioner by such Medical Board as may beappointed for the purpose by the Central Government and the Claims Commissioner concerned shallsubmit himself to suchMedical Examinationwithin the time specified in this behalf by the Judge.(8) The Medical Board shall undertake such medical examination of the Claims Commissioner asmay be considered necessary and submit a report to the Judge stating therein whether the incapacity issuch as to render the Claims Commissionerunfit to continue in office.(9) If the Claims Commissioner refuses to undergo such medical examination as considerednecessary by the Medical Board, the Board shall submit a report to the Judge stating therein theexaminationwhich the Claims Commissionerhas refused to undergo and the Judgemay on receipt ofsuch report presume that the ClaimsCommissionersuffers from such physical or mental incapacity asis alleged in the complaint.(10) The Judge may, after consideringthe written statement of the Claims Commissioner and theMedical Report, if any, amend the charges referred to in clause (a)of sub-rule (4) and in such a casethe Claims Commissioner shall be given a reasonable opportunity of presenting a fresh writtenstatementof defence.(11) The Central Government shall appoint an officer of that Government or any Advocate topresent the case against the ClaimsCommissioner.(12) Where the Central Governmenthas appointed an Advocate to present its case before the Judge,the ClaimsCommissioner shall alsobe allowed to presenthis case by an Advocatechosen by him.

5. Inquiry report.- After the conclusion of the investigation, the Judge shall submit his report to theCentral Government stating therein his fmdings and the reasons thereof on each of the articles of chargeseparatelywith such observations on the whole case as he thinks fit.6. Provisionsof Civil Procedure Codenot binding.-The Judge, while conducting an inquiryunder rule 4,shall not be bound by the procedure laid down by the Civil Procedure Code, 1908 (5 of 1908) , but shall beguidedby the principles of natural justice and shall have power to regulate his own procedure including thefixingof places and times of his inquiry.7.. Suspension of Claims Commissioner.- Notwithstanding anything·contained in rule 4 and withoutprejudiceto any action being taken in accordancewith the said rule, the Central Government,keeping in viewthe gravity of charges, may suspend the Claims Commissioner against whom a complaint is underinvestigationor inquiry.8. Subsistence allowance.-The payment of subsistence allowance to Claims Commissioner undersuspension shall be regulated in accordance with the rules and orders for the time being applicable to anofficerof the Governmentof India drawingan equivalent pay.
