*98 POLICE AND EMERGENCY SERVICES—FIRE AND RESCUE TRAINING PROCEDURES—Mr Latham asked the Minister for Education and Early Childhood Learning representing the Minister for Police and Emergency Services—

(1) What brief did Fire Rescue New South Wales give to Wollongong University's Centre for Human and Applied Physiology in developing new training and testing procedures for staff applicants?(a) What were the specifications in detail?

(2) How many men have applied to become NSW Firefighters for each of the past 10 years?(3) How many women have applied to become NSW Firefighters for each of the past 10 years?(4) How many men have failed the Fire Rescue New South Wales college entry test for each of the past

10 years?(a) What has been the average test score⁄ranking for each of these years?

Answer— I am advised:1. Fire and Rescue NSW (FRNSW) briefed the University of Wollongong (UOW) to complete a thorough evaluation of the physical demands of contemporary firefighting.a) The UOW conducted research services in: preliminary site visits; validation and approval of the list of essential tasks; characterising trade tasks; development of defensible screening tests; approval of screening tests to trial on firefighters; screening tests for contemporary firefighters; developing performance standards; and implementing physical employment standards screening.2-3. Prior to 2013, FRNSW did not use an e-recruitment system to manage and track candidates. The past five years are shown below:

4-5. There is no FRNSW college entry test. FRNSW's recruitment process involves gateways (online testing) to the required merit selection stage. Candidate progression is based on the applicant's performance. Candidates who did not progress beyond this stage are deemed not as competitive as other applicants.6-7. (1) Has the High Court ruled that the New South Wales Anti-Discrimination Board and the New South Wales Civil and Administrative Tribunal do not have jurisdiction over residents of other States and Territories?(a) If so, how has the Government responded to this ruling?

Answer— I am advised:The High Court found in Burns v Corbett [2018] HCA 15 that only the High Court, the Federal Courts and Courts of the State can exercise judicial power in relation to matters under sections 75 and 76 of the Constitution. These matters include disputes between residents of different States. The High Court did not make any ruling in relation to the Anti-Discrimination Board.The NSW Court of Appeal, in Attorney General for New South Wales v Gatsby [2018] NSWCA 254, confirmed that the NSW Civil and Administrative Tribunal is not a Court of a State for the purpose of Chapter Ill of the Constitution.The Civil and Administrative Tribunal Act 2013 enables the Local Court and District Court to hear matters where the NSW Civil and Administrative Tribunal does not have jurisdiction to do so.Information regarding the number of non-NSW residents who have been the subject of investigations and hearings by the Anti-Discrimination Board and New South Wales Civil and Administrative Tribunal is not available.

I am advised:Data are not available on the number of NCAT members who had to recuse themselves from proceedings due to conflicts of interest, or the 'number of NCAT members who have been deemed in breach of the conflict of interest provisions of the Member Code of Conduct.The Member Code of Conduct provides guidance to Members in the performance of their duties and how to conduct themselves consistently with the objectives of the Civil and Administrative Act 2013. The Code of Conduct refers to the value of fairness, which requires a Tribunal Member to make unbiased, impartial decisions and to give all parties the opportunity to put forward their positions.In April 2016, 'NCAT Policy 5 - Member Participation in External Engagements Relating to the Tribunal or its Work' was implemented. The policy sets out the obligations, limitations and procedures which are applicable when a Tribunal Member is requested to participate, or participates, in an external engagement relating to the Tribunal or the work of the Tribunal.The Member Code of Conduct and other NCAT policies are available atwww.ncat.nsw.gov.au.

(1) How many complaints has Mr Garry Burns lodged with the New South Wales Anti-Discrimination Board for each of the past five years?

(2) How many complaints has Mr Sam Ekermawi lodged with the New South Wales Anti-Discrimination Board for each of the past five years?

(3) What safeguards are in place to prevent serial and vexatious complainants lodging matters with the New South Wales Anti-Discrimination Board?

Answer— I am advised:If a complaint is made to the Anti-Discrimination Board, it may be referred to the NSW Civil and Administrative Tribunal. This may result in information becoming publicly available and disclosable, but this does not include the number of complaints lodged within the Anti-Discrimination Board.The secrecy provisions contained in section 124A of the Anti-Discrimination Act 1977 Act create an offence and prohibit staff and officers of the Anti-Discrimination Board from disclosing information about individual complainants or respondents that was obtained in the course of exercising the Anti-Discrimination Board's functions, except as permitted by the Act.Safeguards are located in section 92 of the Anti-Discrimination Act 1977. Section 92(1 )(a)(i) enables the President of the Anti-Discrimination Board to decline a complaint, or part of it, if the President is satisfied that it is frivolous, vexatious, misconceived or lacking in substance.

*104 HEALTH AND MEDICAL RESEARCH—DRINKING WATER QUALITY MONITORING—Ms Faehrmann asked the Minister for Mental Health, Regional Youth and Women representing the Minister for Health and Medical Research—

(1) How many breaches of the guideline values for microbial (including bacteria, protozoa, cyanobacteria and viruses), chemical and physical characteristics specified in the Australian Drinking Water Guidelines have been recorded in the New South Wales Drinking Water Database since 2010?(a) Where have these breaches occurred?(b) On what dates did these breaches occur?(c) For each breach, what substances were detected, and in what amounts?

(2) What information is provided to water authorities, councils and the community in the event of a breach of the Australian Drinking Water Guidelines?(a) Please provide a list of the information given to residents in communities where these breaches

(2) As part of Sydney Water's compliance monitoring program, if the Australian Drinking Water Guidelines (ADWG) for health-based parameters are exceeded, NSW Health are notified. NSW Health also receive the Quarterly Drinking Water Quality Monitoring reports from Sydney Water which detail any exceptions, and discussions are held at the quarterly Joint Operational Group (JOG) meetings with NSW Health. *105 EDUCATION AND EARLY CHILDHOOD LEARNING—EDUCATION—Revd Mr Nile asked the Minister for Education and Early Childhood Learning—

(1) Can the Minister confirm that on 17 May of this year, Greystanes Highschool organised a "Rainbow Mufti Day" during which students were encouraged to wear an item of rainbow clothing and encouraged to donate money to the cause?

(2) Is the Minister aware that a letter announcing the event which was co-signed by the Deputy Principle, the Student Representative Council Coordinator and the School Chaplain, which stated that students that did not donate money on the day "will be chased up until they pay up"?

(3) Can the Minister explain what is involved in the "sexuality" component of the new "Personal Development Health and Physical Education" programme, which was noted by David de Carvalho, CEO of the NSW Educating Standards AAuthority in the Terms 1 issue of this year's Parent & Citizen?

(4) Does the Minister stand by the Governments repeated declarations that Safe Schools programme, or elements of it, is not being foisted on children in New South Wales?

Answer— (1) I am advised Greystanes High School organised a 'Rainbow Mufti Day' on 17 May 2019 as a Student

Representative Council (SRC) initiative to raise money for Headspace, an organisation that provides mental health services for young Australians aged 12-25. Students were encouraged to wear an item of rainbow clothing and to donate money to Headspace.

(2) I am advised that an information note was distributed to parents of students at Greystanes High School. The note was similar with previous notes about themed mufti days and explained that students would be asked to donate one dollar if they were dressed in the 'rainbow' theme and two dollars if they were dressed in other mufti clothes. The note was signed by the Relieving Deputy Principal, the Student Representative Council (SRC) Coordinator and the Year 12 School Captain. It is acknowledged the wording of the note was not consistent with the NSW Department of Education's Controversial Issues in Schools policy, updated on 5 March 2019. I am informed the matter has been addressed with the Relieving Principal and that measures have been put in place to ensure future compliance with the policy.

(3) In the new K-10 PDHPE syllabus, sexuality and sexual health education isprovided in the broader context of healthy, safe and active lifestyle. It addresses a range of issues such as human anatomy, growth and development, gender roles and expectations, equality and power in relationships, planning and managing sexual health, strategies to support young people to keep safe, sex based harassment and homophobic bullying and the impact of discrimination. The new NSW PDHPE curriculum provides age and stage appropriate sexuality and sexual health education.The PDHPE curriculum provides students with opportunities to develop the knowledge, understanding and skills required to develop positive attitudes and behaviours in order to promote positive health outcomes for themselves and others.

(4) The Australian Government allocated funding to the Foundation for Young Australians for implementation of Safe Schools Coalition Australia from 2013 to 2017. The Australian Government ceased funding the program on 30 June 2017.The NSW Government and NSW Department of Education did not provide funding for use of Safe Schools Coalition resources in NSW schools and it is not part of the NSW curriculum
