ENARDO, INC. TERMS & CONDITIONS OF SALE Domestic Customer Payment Terms: Standard terms are net 30 days from invoice date, with approved credit, ex Works, Tulsa, Oklahoma, USA.
Credit card payments by Visa or MasterCard. Cash on Delivery (COD), Prepayment via wire transfer prior to shipment, or Irrevocable Letter of Credit drawn on a United States of America (“USA”) bank is acceptable. If the Letter of Credit is used for payment, a $500 USD fee will be charged to cover banking fees.
International Customer Payment Terms: Credit card payments by Visa or MasterCard, Prepayment via wire transfer prior to shipment, or Irrevocable Letter of Credit drawn on a USA bank. If Letter of Credit is the chosen payment method, a $500 USD fee will be charged to cover banking fees.
Export of Goods: Buyer agrees that if the Products to be purchased from Seller are intended for export from the USA, such Products will not be utilized, inspected, shipped or trans-shipped by, or to, any country, entity, individual or end use prohibited by the laws or regulations of the United States. Specifically, the Products will not be sent to, or through, Burma / Myanmar, Cuba, Iraq, Iran, Libya, Sudan or Syria. Buyer agrees that the Products purchased from Seller will not be utilized, inspected, shipped or trans-shipped by or to any person or entity that is a Specially Designated National, a Denied Person, an Entity appearing on the Entity List, A Specifically Designated Narcotics Trafficker, or a Specially Designated Terrorist, as those terms are defined by the United States government or any of its agencies. Buyer also agrees that the Products to be purchased from Seller will not be utilized for any end use (such as applications in any way pertaining to chemical or biological weapons, missile delivery systems, or weapons of mass destruction) prohibited by the United States or any of its agencies.
Shipment: Each shipment shall be a separate sale and, upon Buyer's failure to give shipping instructions promptly, Seller may cancel the order or suspend delivery at its option. Receipt of Products or materials by Buyer shall constitute acceptance of delivery and waiver of all claims for loss or damages due to delay. A reasonable delay on Seller's part to make any shipment or part of shipment shall not be grounds for cancellation of the order. No cancellations will be permitted after shipment of Products. Buyer may not cancel, alter or suspend delivery on the order except with Seller's written consent, signed by its officer at Tulsa, Oklahoma. Seller shall not be liable for any claims for shortage unless presented in writing, accompanied by its packing slip, within 10 days after delivery of shipment.
Acceptance: Buyer agrees to inspect the Products within 10 days after delivery of shipment and to notify Seller in writing of any defect, nonconformance or other valid objection to Buyer's acceptance of the Products. Buyer agrees that 10 days is a reasonable period in which to inspect the Products. If Buyer does not give written notice to Seller within such 10-day period specifying any defect in or other objection to the Products, Purchaser will be deemed to have accepted the Products.
Return of Products: Products returned without Seller's written permission in the form of a Return Material Authorization (RMA) will not be accepted for credit. All returned Products must be new, in saleable condition, with transportation charges prepaid. No credit will be allowed for return of Products of special design, finish or size, or for any Products returned more than 60 days after shipment. A service charge of 50% of the price will be paid by Buyer to cover handling and inspection of any Products returned. Parts and subassemblies may not be returned.
Limited Warranty: Seller warrants, to the extent stated herein, all Products manufactured by it are free from original defects in workmanship or material for a period of twelve (12) months from shipment date. Engineering contractor sales shall be warranted for 12 months from the date of installation, not to exceed 18 months from date of shipment. During such 12-month warranty period, Seller at its option will repair or replace any defective Products returned to Seller's factory in Tulsa, Oklahoma, transportation charges prepaid. Seller will not be responsible for, and this limited warranty shall not apply to, any failure of or damage to any Products caused by (1) abuse, misuse, neglect, improper handling or installation, or lack of proper maintenance, (2) shipping damage, (3) repair, alteration or modification made outside of Seller's factory, or (4) acts of God, accident, collision, fire, theft, vandalism, riot, explosion, lightning, windstorm, hail, flood, water or other cause other than ordinary use.
DISCLAIMER. THE FOREGOING LIMITED WARRANTY AND LIMITATIONS ARE THE SOLE AND EXCLUSIVE WARRANTIES GIVEN BY SELLER AND ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED. THE REMEDIES OF BUYER UNDER THE FOREGOING WARRANTY ARE EXCLUSIVE, AND BUYER HEREBY WAIVES, ALL OTHER WARRANTIES, GUARANTIES, OBLIGATIONS, LIABILITIES, RIGHTS AND REMEDIES, EXPRESS OR IMPLIED, WHETHER ARISING BY LAW OR OTHERWISE. SELLER EXPRESSLY DISCLAIMS ANY AND ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF DESIGN AND ANY IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE OR MERCHANTABILITY. It is understood that Seller has no special knowledge of Buyer's operations or requirements, and Buyer agrees that the items of purchase are being purchased because of the independent determination made by Buyer of their suitability for intended use.
Limitation of Liability. SELLER WILL NOT BE LIABLE FOR ANY LOSSES, COSTS, FORFEITURES OR OTHER DAMAGES, WHETHER DIRECT OR INDIRECT, AND WHETHER OR NOT RESULTING FROM OR CONTRIBUTED TO BY THE DEFAULT OR NEGLIGENCE OF SELLER, ITS AGENTS, EMPLOYEES OR SUBCONTRACTORS, WHICH MIGHT BE CLAIMED AS A RESULT OF THE USE OR FAILURE OF THE ITEMS OF SALE. IN NO EVENT WILL SELLER BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF USE, LOST REVENUE, LOST PROFITS, OR LIABILITIES OF BUYER TO ITS CUSTOMERS OR THIRD PERSONS, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE PRODUCTS, WHETHER IN AN ACTION BASED UPON CONTRACT OR TORT, INCLUDING NEGLIGENCE. IN NO EVENT WILL SELLER'S TOTAL LIABILITY FOR ANY DAMAGES IN ANY ACTION BASED ON CONTRACT OR TORT ARISING OUT OF OR IN CONNECTION WITH THE PRODUCTS EXCEED THE TOTAL AMOUNT PAID BY BUYER FOR THE PRODUCTS.
Failure or Delay. Seller shall not be liable or responsible for delays or failures of shipment caused by Buyer or arising from any cause beyond Seller's control, including without limitation, labor controversies, embargoes, government regulations, trade restrictions, accidents, state of war, riots, fire, earthquakes, storms, failures of sources of supply or delay in receiving machinery or materials.
Fair Labor Standards Act. Seller represents that the Products were produced and/or sold in full compliance with all requirements of the Fair Labor Standards Act, as amended.
Governing Law. The construction of this agreement and the rights and duties of Seller, Buyer and all other persons shall be governed by the laws of the State of Oklahoma.
Entire Agreement. This form comprises the entire agreement affecting the purchase and no other agreement or understanding will be given effect unless specifically agreed to and signed by an officer of Enardo, Inc.

Series 7 Inline Flame Arrestor
Features and Benefits
Enardo Series 7 Inline Flame Arrestors are designedto stop the propagation of confined low pressuredeflagrations. The Series 7 is typically used for end-of-line and near end of line applications when the systemoperating pressure is near atmospheric levels andwhen there is minimal probability of a flame stabilizingon the Flame Arrestor element for an extended period.
The Series 7 prevents flame propagation by absorbingand dissipating heat using spiral wound crimpedribbon flame cells. These cells allow maximum flowwith maximum protection.
Designed with flanged connections, this arrestorallows removal of the flame cell element for easycleaning and replacement without removing thearrestor body from the pipe connection. Standardhousing construction is aluminum, carbon steel, andstainless steel. The element is available in aluminum orstainless steel. Special material and protectivecoatings are available on request.
