TERMS & CONDITIONS TO BE FOLLOWED, BEFORE PLACING SUPPLY ORDERS ( THE RPPT ACT 2012 AND RULES 2013 SHALL BE APPLICABLE ON THE ALL THE PROCUREMENT )
1. The rate contract is for original Foreign manufacturers based in india and/or sole distributors/authorized dealer of foreign manufacturers not based in india i m p o r t e d c h e m i c a l s , g l a s w a r e s , p l a s t i c w a r e s , l a b w a r e s ( i n c l u d in g s o l i d , l i q u i d , g a s a n d w a s t e / d i s p o s a l h a n d l in g s y s t e m s

categories material/items required for different constituent units of Rajasthan University of Veterinary and Animal Sciences, Bikaner located in Rajasthan state for one year w .e .f. th e d a te o f issue o f this o rd e r.
2 Item manufactured indigenously as well as imported for which proposals from Indian authorized dealers with rates in India rupees receivedare only approved
3. If more than one firm manufacturers/supplies for the item of similar specifications/goods ,are approved, the concerned purchasing authority/DDO/Unit Incharge, would ascertain the lowest price of subject matter of procurement (SMP) and place supply order to the lowest price SM P This type of certificate should be provided at the time of supply order itself by the concerned unit.
4. If Procurement entity procures the subject matter of procurement (SMP) from other then lowest bidder, as per section 27 (l)(b ) of RPPT,2012 where there are price and other award? criteria, the most advantageous firm be evaluated on the basis of the criteria and price and reason/justification be recorded in the comparative statement.
5. The rate contract holder quotes/reduces its price to render similar goods at a price lower than the rate contract price to anyone at any time during the currency of the rate contract, the rate contract price, shall be automatically reduced with effect from the date of reducing or quoting lower price, for all deliver of the subject matter of procurement under that rate contract and the rate contract shall be amended accordingly. The firms holding parallel rate contract shall also be given opportunity to reduce price giving them fifteen days time to intimate their acceptance to the revised price. Similarly, if a parallel rate contract holding firm reduces its price shall be conveyed to other parallel rate contract holding firms and the original rate contract holding firm for corresponding reduction in their prices. If any rate contract holding firm does not agree to the reduced price, further transaction with it, shall not be conducted.
6. Under imported/ indigenously small apparatus category only those items costing less than Rs. 10.00 lacs are approved for rate contract.7. The approved manufacturers/firms will submit copy of the above mentioned approved price lists (Annex. V) submitted along with the rate
contract proposal as well as a copy of Annex-VI, to concerning purchasing authority/DDO/Unit Incharge for comparison of price etc. at their level also, (the list of concerning DDOs/Unit Incharge is enclosed as Annex-2) for the purpose.
8 The order should be given to the manufacturer directly by the purchasing authority with a copy of order to authorized dealer as enlisted in Annexure-1. While placing the order any of the following certificate (categories wise) be essentially obtained from the concerned firm.a. Lab equipment and instruments- ISI/CE/ISO 9001 certificateb. Analytical instruments- ISI/CE/ISO 9001 certificatec. Microscope- ISO 9001 /CE/ISO 14001 certificated. C h em ica ls-ISO 9001 certificatee. Glassware- ISI/NABL/ISO 9001 certificatef. Plastic ware - IS O 9001 certificateg. Teaching audio -visual aids, security system, UPS, Invertors,Stablizers and batteries: - ISI/ CE/ISO 9001 Certificate.
9. Valid certificate/license from department of industries for the above category items , in detail enlisting the items being manufactured and evidence of being genuine manufacturer /original manufacturer should essentially obtained by the concerned purchasing authority/DDO/Unit Incharge from the manufacturers/firms before placing the order.
10 In case of imported items, approved in rate contract, the concerned purchasing authority/DDO/Unit Incharge will check the validity of certificate 'Sole authorized distributor in India', submitted by the manufacturers/firms before placing the order.
11 Copy of the latest VAT clearance certificate shall be obtained from the manufacturers/firms by the concerned purchasing authority/DDO/Unit Incharge before placing the order
12 Copy of all the orders by competent authority shall invariably be endorsed to Treasury officer .RAJUVAS,Bikaner failing which the order shall be considered invalid and concern Treasury will not authorize the bill.
13. University does not guarantee for any quantum of order and liability of any kind.14. This order will remain valid up to one year w.e.f. the date of issue of this order.15. Rates.: The manufacturers have to supply items as per price list submitted by him and no change in the price list in between would be
permitted.16 Discount.: Discount mentioned in the price list will be availed as per the rate mentioned in the above price list. In case the rates of
discount (i.e. mentioned as above) are revised and supplied are made at the rates lower than these approved rates mentioned in the price list to any purchaser in India by any aforesaid manufacturer or on their behalf during the contract period such benefit will have to be extended to the concerning purchasing authority of this university from the date of such revision.
17. Delivery:- All the rates are for destination (Free delivery at any place in Rajasthan and inclusive of packing, forwarding, freight and insurance charges) . Delivery Period:- The Indigenous items should be supplied within 30 days and imported items within 60 days from the date of supply order. Liquidated damages shall be recovered at the prescribed rates, if the firm fails to supply within the supply period, provided that the ordering authority on the request of the firm may extend the supply period before its expiry after being satisfied with the reason given by the firm for inordinate delay in supplies However, extension of supply period may be with or without liquidated damages. In case of extension in the delivery period with liquidated damages recovery shall be made on the basis of the basis of the following percentage of value of stores which the tenderer has failed to supply:-a. Delay upto one fourth period of the prescribed delivery period. -- 2.5%b. Delay exceeding one fourth but not exceeding half of the prescribed delivery period. - 5%c. Delay exceeding half but not exceeding three fourth of the prescribed delivery period. -- 7.5%d. Delay exceeding three fourth of the prescribed delivery period. -- 10%
18. Installation: Installation of instruments, which is necessary, shall be done by the firm free of cost. The purchasing authority will inform the firm about the installation after receipt of instruments/ equipment's.
19. Guarantee: Minimum Guarantee period of instruments/ equipment's is one year from the date of receipt & installation.20.Excise duty exemption on purchase of equipments instruments, etc. is to availed necessarily as applicable following applicable rules and
procedures for which order placing authority/ competent authority shall be responsible.21. Imported instruments/ equipments etc. be purchased on concessional custom duty as applicable in case of university(ies). If any irregular
payment of custom duty made by any purchaser he will be responsible.22 Sale Tax and Surcharge If any will be charged as applicable (as per Annex. VI submitted at the time of rate contract proposal), however
the same will not be paid extra if they are including in the rate of price list 23. Payment: payment may be made within 30 days from the receipt of material or bill whichever is later24 Purchase: Purchase order will be placed by any of the purchasing authority of this University's constituent units situated at various
places in Rajasthan25.Rate quoted in Indian Rupees are only approved.26.Unit head(s) will verify/ adjudge the stock position available before placing any order.27.Jurisdiction for legal matter shall be Bikaner.
28 The above terms and condition shall be followed by all concerned purchasing authorities/DDOs/Unit Incharge in letter and spirit. For any non-compliance of above terms and conditions, they will be held responsible at their own.
Note: This offer can be repudiated at any time in respect of above manufacturers and necessary action can be taken against the during firms by the University. Further rate contract is subject to the production of agreement on N JS of Rs.500/- which may be submitted to this office within 15 days from the date of issue of this order

A G R E E M E N T (See Rule 28)

shall, where the context so admits, be deemed to include his heirs successors, executor, and administrators
of the one of part and the Rajasthan University of Veterinary & Animal Sciences, Bikaner (hereinafter called
"the university which expression, shall, where the context so admits, be deemed to include his successors
in office and assigns) of the other part.
(1) Whereas the approved supplier has agreed with the

The delivery shall be effected and completed within the period noted below from the date of supply

NOTE:
(1) Fraction of a day in reckoning period of delay in supplies shall be
eliminated if it is less than half a day.
ii) The maximum amount of agreed liquidated damages shall be 10%
iii) If the supplier required an extension of lime in completion of contractual
supply on account of occurrence of any hindrances, he shall apply in writing to the
authority which had placed the supply order, for the same immediately on occurrence of
the hindrance but not after the stipulated date of completion of supply.
(2) Delivery period may be extended with of without liquidated damages if the delay in the supply of
goods is on account of hindrances beyond the control of the tendered.
6. All disputes arising out of this agreement and all questions relating to the interpretation of this
agreement shall be decided by the Vice-chancellor and the decision of the Vice-Chancellor shall be
final.
