CONDITIONS OF SALE.
FIRST.
The highest bidder to bo the buyer; the advance on each lot to be fixed by the
Auctioneer, who reserves to himself the right of refusing the bidding of any person, should
he see tit; and it any dispute arise between the bidders, the lot or lots so disputed about,
may, at the discretion of the Auctioneer, be put up again and re-sold, but the decision
of the Auctioneer shall, in all cases of dispute, be final and conclusive.
SECOND.
Tue full purchase-money for each lot shill be pud at the fall of the hammer, (if
required). Each and eveiv lot shall, at the fall of the hammer, be considered as delivered
to and accepted by the respective purchaser or purchasers thereof, and shall be aad
remain in every respect at his, her, or their absolute risk and expense, and shall be
removed from the place of sale by the purchasers at their expense, at, and within the time
to be mentioned by the Auctioneer, and taken, \\ ithout any allowance or compensation
for quantity, measurement, quality, weight, defect, error of description, or tor or on
any other account whatsoever, tlie Auctioneer not being responsible for the coirect
description, genuineness, authenticity, or completeness of any lot, and making no
warranty or guarantee whatever.
THIRD.
W, lot or lots shall be removed from the premises ou which the sale is held till
paid for, or without a delivery order, unless by permission of the Auctioneer; nor shall
any person he allowed to retract his or her bidding, hut give up his or her name and
residence, if required.
FOURTH.
If any purchaser shall fail to comply w th the above conditions, or any of them, the
Auctioneer shall be at liberty either to iccover in full the amount of the lot or lots
bought by such purchaser, without, refeiec.ee to any delivery or acceptance of the lot
or lots, other than the fiist delivery and stipulated acceptance at the fall of the hammer ;
or to resell any lot or lots bought by such purchaser, eithcr by public or piivate sale ;
and the full amount of the purchase-money at the present sale, or the deficiency (if any)
arising from such second sale, together with the expenses attending the same, shall
he made good by the defaulter at the present sale, and be recoverable as and for
liquidated damages.
FIFTH.
The contract of sale is to he deemed in all cases as made exclusively with the
Auctioneer, and payment is to be made to him or his cieik only.
SIXTH.
The Auctioneer reserves the right to withdraw any lot or lots from the sale, to
put up and sell together any two or more lots, or to divide any lot; and in any other
respect to alter the order of sale as he may think fit.
