Boise Village is a great option forfirst-time home buyers looking tocapitalize on the federal govern-ment’s $8,000 tax credit that ex-pires April 30, 2010. But there’s asizable tax credit available to repeathome buyers, too.

The Worker, Homeownership, andBusiness Assistance Act of 2009 es-tablished a tax credit of up to$6,500 for qualified existing homeowners who purchase a new princi-pal residence on or before April 30,2010 (or have a binding sales con-tract by April 30, 2010, and close onthe new home by June 30, 2010).Boise Village’s single-family homesand duplexes meet this tax credit’scriteria. Whether you are looking todownsize to a smaller, lower-mainte-nance home or you simply desire anew home with modern amenitiesand finishes, now may be the perfecttime to make your move and get theunprecedented $6,500 tax credit.You are likely eligible to receive thetax credit if:

• You have owned and resided inyour current home for a consecutivefive out of the past eight years

• The home you purchase be-comes your primary residence; youdo not have to sell your currenthome. You can even turn it into anincome/rental property if you so de-sire

• Your adjusted household in-come does not exceed $125,000 (or

$225,000 if you are married filingjointly)

This tax credit should not be con-fused with a tax deduction. A taxcredit is a dollar-for-dollar reductionin what the taxpayer owes; if thetaxpayer owes nothing, the full cred-it is applied toward his or her re-fund.

Question: I tried to buy a house. I ap-plied for a bank loan, and the bankprocessed my loan as an FHA loaninstead of a conventional loan. The

house I was buying failed the FHA inspectionand I did not buy it.

Then I tried to buy another house, and twodays prior to the closing the bank asked meto do some repairs. The seller refused to ex-tend the contract, and on both houses I lostmoney. Can I sue to get my money back forthe inspections and appraisals?

Answer: The only thing that’s similarabout your two deals is you lost money. Let’sseparate the issues in your two failed pur-chases and look at each. The first issue isyour relationships with the sellers which aregoverned by the contracts you signed.

The next issue is your relationship with

your lender. Starting with your attemptedpurchases of two homes, you could look atthe first failed purchase and view it as a posi-tive ending. When you buy a home, you, thebuyer, have an obligation to become educat-ed about the home you are about to buy. Youshould have a pretty good understanding ofthe neighborhood in which the home is lo-cated. You should know a bit about thehome itself and you should have the homeinspected by an independent home inspec-tor of your choosing.

If you know the neighborhood, you shouldbe able to avoid problems such as buyingnear a new commercial development, sewertreatment plant or garbage processing facili-ty. If the neighborhood is fine, then youneed to make sure the home won’t give youreal problems from the start.

Most of us are not knowl-edgeable enough to look at a roofand determine whether it has oneyear left in its life or 10, but mostgood home inspectors do have thespecific expertise to help you identi-fy any physical failings of a home.Did you hire a professional home in-spector? If you were buying thehome with a conventional loan andnot a Federal Housing Administra-tion (FHA) loan, you would nothave had an FHA inspection.

If the home failed the FHA inspec-tion, the agency’s inspector musthave found some critical problemswith the home. Had you purchasedthe home with a conventional loan,you might have had to spend quitea bit of money fixing the problemsand you might have been worse off

than you are now.If the bank asked for repairs to the

second home, it would seem thatyour loan, again, was processed asan FHA loan. These days it is easierto get financing with an FHA loanthan a conventional loan, if you arenot putting at least 20 percent downtowards the purchase of that home.

In my experience, most FHA re-quired repairs are legitimate repairsthat should be made to homes. Insome cases FHA repairs can be mi-nor, but as a whole they are for theprotection of the buyer.

For the contract, as a buyer of ahome, you have the ability to negoti-ate the terms of the contract for thehome you are buying. Hopefully, theagent you’ve hired has helped youwith this. You can request that theseller make repairs required by FHAto bring the home up to FHA stan-dards and you can require the sellerto reimburse you the funds you paidfor any appraisal and inspection ofthe home should the deal fall

t h ro u g h .The seller may not agree to your

terms, but the marketplace permitsyou to request it and to decidewhether to proceed with the pur-chase of the home. You askedwhether you can sue someone to getthe money you spent on the inspec-tion and appraisals, but the realquestion is this: Do you even havethe right to get that money back?

If you drive an hour to the storeand realize that you forgot yourmoney at home and drive backhome and then back to the store,the store is not be responsible toyou for the time and gas that it took

you to go back and forth. Likewise,the seller and the bank are not re-sponsible to you for these expenses.You essentially took the risk that ifthe deal fell through, you wouldn’tget this money back.

Most buyers take the risk that thepayment they make to the lender forthe appraisal of the home and creditreport will be lost if the deal for thehome falls through. Frequently,lenders will only bill the borrowerfor the credit check (anywhere from$15 to $70) but will hold off on theappraisal cost until they know thatthe borrower is sure that he or shewants to proceed with the purchase.

I have a theory that the originof the phrase “How do you do?”is from the past time of garden-

ing. Before English historiansreach for their computer to launcha debate, indulge me a little byconsidering the tremendousamount of thought involved in se-lection of a good soil amendment.Good soil is critical to successfulgrowing, and gardeners often haveentrenched feelings about the besttype of material to plow underwhen preparing for planting.

Naturally, manures float to thetop of any discussion on amend-ments. At spring gatherings manygardeners question each otherclosely on which manure they use,comparing its age, crumble-ability,and animal source as if it were afine wine for plants. In situationssuch as this, “How do you do?” isreally an inquiry that can best beanswered by “With composted cowthis year, but I had great successwith sheep last year.” Yes, it’s truethat the obsessive gardener willkeep track of manure’s successand failures from year to year.

When planning to amend yoursoil, any herbivore’s doo will do, aslong as it is aged before applying itto the garden. All animals carryeColi in their waste that can besplashed up onto plants duringrain or irrigation, so it is impor-tant to use manure that has beenaged four months or longer. As forthe relative benefits or drawbacksof which herbivore doo is best,well, that would be decided bypersonal choice, ready access,and quantity desired.

In some cases cattle manurecould be high in salts, particu-larly if it came from animalsconfined to feedlots. Thoseneeding a large enough quanti-ty to buy by the truckload maybe able to ask for an analysis ofnutrients from the landscape

supply company, which would in-clude salts. This is somewhat hardto come by, as many places don’tspend time and money analyzingmanure and asking for a detailedanalysis may get you thrown off thep ro p e r t y.

Horse is always an option, butcan be high in weed seed. I’m noveterinarian, but I have been toldthat a horse will pass what it’s eat-en through it’s system and out theother end every 45 minutes, leav-ing no time for weed seeds to be,um, processed. If the horse is on agood pasture — one without manyweeds — or is fed with certifiedhay, the problem of weed seeds iseliminated and gardeners can hap-pily shovel it all over their garden.

Manure options expand if thequantity needed is small enough toinclude sheep, llama, or rabbit,even designer types such as “ZooD o o. ” Rabbits produce a great ma-nure that is high in nitrogen butwon’t harm or ‘burn’ plants. How-ever, their poo pellets should beseparated from wood beddingchips before tilling into the gardenin order to avoid having the nitro-gen from them and the soil tied upin decomposing the wood chips.

A little goes a long way when ma-nuring the garden. Applicationsshould be no thicker than one-quarter to one-half inch across thesurface of the area before tillingin. Now is the time to prepare thesoil with your choice of amend-ment, and proudly greet the neigh-bors with “How do you doo?”
