F. No. 37-3ffiegal/AICTE/2012.-- In exercise of Cs powers conferred under sub-section (1) of Section 23 read with Section 10 of the All India Council for reelancal Education Act 1987 (52 of 19871 the All India Council for Technical Education (AICTE) makes the following Regulations.—

Short Title , Application and Commencement:

These Regulations may be called the All India Council for Technical Education (Grant of Approval for conducting Vocational Education Program,

Community College course[sl and Skill Knowledge Provider under National Vocational Education Qualification Framework) Regulations, 2012. They shall apply to Institutions already approved by the All India Council for '1-ethnical Education and/or seeking approval of the All India Council for Technical Education for conducting Vocational Education Program, Community College courses and to act as the Skill Knowledge Provider under National Vocational Education Qualification Framework, as notified by the Council from time to time.

1.3 They shall come into force with effect from the date of their publication in the Official Gazette. Definitions:

"Academic year" means Academic Year of the concerned affiliating University and tor Technical Board and /or Institution. "Act" means the All India Council for Technical Education Act, 1987 (No.52 of 1987). "AICTE web-portal" means web site hosted by the Council at URL www.ante-india.org. "Applicant" means an applicant that makes an application to the Council seeking approval under these Regulations. "Approved Institution" means the Institute approved by Council. "HOARD OF TECHNICAL EDUCATION" means the Technical Education Board established by the State Govt. and/or Union Territory concerned

college recognized by the Central Statutory Body and/or affiliated by the University or the State Board of 'technical Education, as the case may be and conducting Vocational Education under NVEQF scheme.

2.10 "Community College course" means specialization in a specific sector under NVEQF scheme.

2.1I 'Vocational Course" means specialization in a specific sector under NVEQF scheme.

2.12 "Company" means the company established under Section 25 of the Companies Act, 1956.

2.13 "Competent Authority for Admission" means a body responsible for admission to Institutions in the State/UT concerned.

2.14 "Council" means All India Council for Technical Education established under Section 3 of the Act

2.15 "Course" means one of the stream based sector specific specialization of learning in Vocational Education Program

2.16 "Division" shall mean; a batch of filly seats excluding supernumerary seats, if any'

2.17 -Banking" means the intemet banking. 2.18 'e-Receipt" means the payment receipt received on payment using Internet banking

on web- portal of A1CTE. 2.19 xecutwe Committee" means the Committee constituted by the Council under

Section 12 of th AICTE Act. 220 "Foreign National" means the citizen of the all countries other than India who are

not of Indian origin as defined under PIO. "Government rnded Institution- means Institution that meets 50% or more of as recurring expenditure out of the grant received from Government or Government organizations.

"Institutioffi means the institution duly approved by the Council to conduct Technical Education Program and /or the college recognized by the Central Statutory Body and/or affiliated by the University or the State Board of Technical Education, as the case may be. "LEVEL" means Vocational Education of approximately 1000 hours spread over a year, as referred in the architecture of NVEQF notified Ministry of Human Resource Development vide executive order No:1-4/2011-1/E, DATED: 03.09.2012

2.26 "NATIONAL VOCATIONAL EDUCATION QUALIFICATION FRAMEWORK" means framework of vocational education program as notified by Ministry of Human Resource Development vide executive order No:1-4 / 2011-VE, dated 03 09.2012

7.27 'Vocational Education" means imparting Vocational courses in a certain specialization at a certain level along with General Education under NVEQF scheme.

2.28 "Non-Resident Indian (ERI)" means an Indian citizen who is ordinarily residing outside India and holds an Indian Passport.

2.29 "Persons of Indian origin (PIO)" shall mean the Persons who are citizens of other countries (except Pakistan & Bangladesh) who at any time held an Indian Passport, or who or either of his/her parents or any of his/her grandparents was a citizen of India by virtue of the provisions of the Constitution of India of Sec.2 (b) of the Citizenship Act, (57 of 1955).

2.30 "Private-Self Financing Institution" means an Institution established by a Society/Trust/Company and either does not receive any grant/fund or receives less than 50% grant /fluid from Central and/or State Government and/or Union Territory Administration or any other Govt. Authority for meeting its recurring expenditure.

231 "Regional Committee" means a Regional Committee established under Section 14 of the Act.

2.32 'SKILL KNOWLEDGE PROVIDER" means the competency based knowledge provider which will impart skill based training of Vocational Content under NVEQF Scheme.

2.33 "Sociely" means a Society registered under Societies Registration Act, 1860. amt 2.34 "Trust'. means a Trust registered under Charitable Trusts Act, 1950 or any other

relevant Act.

3 , Promoters of the Skill Knowledge Provider 3.1 ; An Skill Knowledge Provider may be established and administered by the

following: a A Society reistered under the Societies Registration Act, 1860 b A Trust registered under the Charitable Trusts Act, 1950 or any other relevant Act.

A company ince orated under Section 25 of the Com.anies Act, 1956. A Partnership Firm duly registered with Registrar of firms under relevant law of the State or UT Administration concerned.

4.1 All Institutions and SKP's shall require prior approval of the Council for a Conduct of a Vocational Education Programs

b Conduct of a Community college Courses in Existing AICTE approved Polytechnics Conduct of a Community college Courses in college recognized by the Central Statutory Body and/or affiliated by the University or the State Board of Technical Education

d Conduct of training for required skills by an existing organization or its service / training centres as Skill Knowledge Provider (SKP

4.2 The Council shall publish, from time to time, Approval Process Handbook, detailing the procedure & conditions of approval and procedure to process the applications of Institutions and SKP.

4.3 The applications for approval for the purposes listed under clause 4.1 and (c) of these Regulations shall be made by:

c 4.5 The format of the applications and the documents to be attached to the application

and the fee to be remitted, the manner by which the applications are processed, the norms and standards, requirements and the procedures for grant of approval shall be prescribed in the Approval Process Handbook by the Council from time to time.

4.6 The applicant may be required to submit the application for purposes listed in 4.1 and pay prescribed fee online through AICTE's web-portal or any other mechanism notified by the Council from time to time.

4.7 On submission of online application AICTE's web-portal, the system may generate a tracking number, specific to the application, which may be used by the applicant for making further references and to track / check the status of the application, concerned, online

4.8 An affidavit, in the format as given on the web portal. on a Non Judicial Stamp paper of Rs 100/- duly sworn before a First Class Magistrate or Notary or an Oath Commissioner, inter alia, stating that the information given in the application is true and that if it is found at any stage that any or part of the information has been suppressed and / or misrepresented and / or the information given in the application is false, the Council will be free to take action including withdrawal of approval and / or any other legal action as it may deem fit.

4.9 a All Institutions already approved by council and applying for approval of the Council under these Regulations:- •

Shall make necessary corrections, online, based on the deficiency / Status report available through Institute login until such time that the applicant finally submits the application on the portal.

If there are no deficiencies then the system shall allot the intake applied for, as per clause 6 of Chapter I and Chapter II of the Approval Process Hand Rook

The consolidated list of all Institutes / Polytechnics with the approved intake shall he placed before the Executive Committee for approval or otherwise. The same shall be notified on the web portal. Further the Institute / Polytechnic may print the Letter of approval along with approved intake through the Institute / Polytechnic login.

No appeal shall be allowed on this procedure since an applicant is allowed corrections multiple times, in the application form along with generation of online deficiency / status report before submission of the application.

b All applicants other than 4.9 (a), may also make necessary corrections. online, based on the deficiency / Status report available through Institute login until such time that the applicant finally submits the application on the portal. 'he application submitted online on the web portal of the Council shall be evaluated by a Scrutiny Committee constituted by the Regional Officer by selecting members using automated selection process provided by the AICTE web-portal

4.10 R tional Officer or an Officer of the Council concerned shall assist the respective

Committee and place relevant records and documents before the respective Committees and make necessary arrangements for conduct of the meetings; however, he shall not be part of the Committees. 'I he Scrutiny Committee shall invite applicants of 4.9 (II) for presentation of their proposals along with originals of all scanned documents and a video CD of all facilities created by Institutions and/or SKP, as the case may be. Based on the recommendations of the Scrutiny Committee, the Regional Officer concerned shall communicate deficiencies, if any, to the applicants as stated in time schedule. She list of deficiencies shall be posted on the AICTE web-portal for information. Expert Committee shall visit the Institutions / SKP's in respect of applications as in clause 4.9 (b) of these Regulations which are recommended by the Scrutiny Committee for further processing for grant of approval.

4.14

The Regional Officer concerned shall request the applicants, whose proposals seeking approval for cases as indicated in clause 4.9(h) are recommended by the Regional Committee for grant of approval, to deposit the prescribed amount in the name of Member Secretary AICTF along with all affidavit, in the prescribed format given on the web portal, as per the procedure mentioned in the Approval Process Handbook.

4.15

Regional Officer concerned, while forwarding the recommendations of the Regional Committee to AICTE headquarters. for placing before the Executive Committee shall verify that the processes and parameters prescribed under these Regulations and Approval Process Handbook are followed by the Scrutiny Committee, Expert Visit Committee and the Regional Committee

The Bureau concerned at AICTE headquarters shall also verify that the processes and parameters prescribed under these Regulations and Approval Process Handbook are followed by the Scrutiny Committee, Expert Visit Committee and the Regional Committee.

4.16 'Do recommendations of the Regional Committee shall be placed before the Executive Committee of Atc"rE. Executive Committee after considering the recommendations of the Regional Committee and on confirmation of deposit of money, along with the affidavit. shall take a final decision in its meeting on grant of

royal or otherwise. The Council shall grant the desired approvals only after satisfying itself that the

licant meets all the norms and standards prescribed by it. Further based on the decision of the Executive Committee, Letter of Approval to tart the program within two years, or Letter of Rejection shall be issued by the

designated authority of the AICTE.

However. the Extension of approval shall be required to be obtained by Institutions d SKP each year.

The Council shall not grant any conditional approval to any Institution / SKP Institutions and SKP granted Letter of Approval for conduct of VP, Community College Courses and SKP under NVLQI' shall comply with appointment or teaching staff, coordinator, and Principal/Director as the case may be, as per policy

garding minimum qualifications, pay scales etc., norms prescribed by the Council and other su oiling staff & administrative staff as per the schedule prescribed in

the Approval Process Handbook.

Institutions other than minority Institutions shall appoint teaching staff / coordinator / Principal / Director and other supporting staff and administrative staff strictly in accordance with the methods and procedures of the concerned affiliating University / Technical Board particula ly in case of selection procedures and selection Committees.

The information about these appointments of staff in the prescribed format shall also be uploaded on the web-portal of AICTE as per the schedule prescribed in the Approval Process Handbook.

In no circumstances, unless the appointment of all teaching and other staff is in place, the Institution and/or SKP shall start the approved Courses.

4.21 The applications received under clause 4.1 of these Regulations will he processed as per the procedures, norms, standards and schedule prescribed in the Approval Process Handbook as notified by the Council from time to time.

4.22 The applicants shall not name the Institution / SKP in such a way that the abbreviated form of the name of the Institution / SKP becomes IIM or ITT or II Se or NIT or AICTE or UGC or MHRD or GOI. The applicant shall also not use the word(s) Government, India, Indian, National, All India, All India Council, Commission anywhere in the name of the Institution / SKP and other names as prohibited under the Emblems And Names (Prevention of Improper Use) Act, 1950. Provided that the restrictions mentioned above shall not be applicable, if the Institution / SKP is established by Government of India or its name is approved by the Government of India.

4.23 Under no circumstances, an Institution and SKP without prior approval of AICTE and affiliation from University / Board concerned, shall be allowed participation in the counseling and admission process and to admit students.

4.24 Affiliating Universities shall not enroll students admitted in such Institutions / SKP, , which do not have requisite prior ao *royal of the Council.

4.25 Central / State Government / ET Administration concerned shall not permit any Institution / SKP without requisite prior approval of the Council to admit students

426 The applicant promoters/ Institutions / SKP are expected to provide to the Council true and complete information and documents required for various purposes. If the information given and or the documents provided to the Council are found to be false, and/or incomplete, the applicant Institutions / SKP have failed to disclose factual information and / or suppressed/misrepresented the information, the Council shall take action including withdrawal of approval and/or any other action as deemed necessary against the applicant Institutions / SKP.

4.27 AICTE may also conduct from time to time inspections with or without notifying dates in such cases where specific complaints of falsification of documents, misrepresentation, violation of nom and standards, mat-practices and take appropriate actions, including withdrawal of approval and any other action deemed necessary against the applicant Institutions / SKP, as the case may be.

4.28 The Money Deposited by the Institution / SKP with AICTE may be permitted to be withdrawn otter a term of ten years. However, the term of the money deposited could be extended For a further period as may be decided on case to case basis

and/or forfeited in case of any violation of norms, conditions, and requirements and/or non-performance by the Institution / SKP and/or complaints against the Institutions / SKP's.

4.29 In the event of denial of approval for under clause 4.1 of these Regulations, any application received for approval for any of the purposes mentioned above at clause 4.1 of these Regulations from such Institutions /SKP shall not be considered till such proceedings are settled and the Institutions / SKP are cleared of the charges of violations.

members. All Education Institutions / SKP shall upload the information in respect of their Director / Principal, Coordinator and faculty members in the format available on the web portal of the Council and update the information from time to time.

8 Interpretation Any question arising out of the interpretation of these Regulations, shall be decided by the Council and the decision of the Council shall be binding and final.

9 Power to relax

IP

The Council may in exceptional cases, for removal of any hardship or such other reasons to be recorded in writing, relax any of the provisions of these Regulations in resiect of an class or eate o ' of Institutions and / or SKP. Withdrawal of approval If any Institution / SKP contravenes any of the provisions of these Regulations, the Council may, after making such inquiry, as it may consider appropriate and after giving the Institution / SKP concerned an opportunity of being heard, withdraw the a . woval granted under these Regulations.

II Penalty An Institution / SKP running any education/skill training under NVEQF in violation of these Regulations, shall be liable for initiation of legal civil action including withdrawal of approval, if any, and / or legal criminal action by the Council against the Institution and/or its Society/Trust/Section 25 Company and Individuals / any other associated as the case may be.

Provided further that if any Institution / SKY contravenes any of the provisions of these Regulations, the Council after making such inquiry as it may consider appropriate and after giving Institution / SKP concerned an opportunity to clarify the matter, may take any or all actions as specified below and as the case ma be.

12 Action in case of violation of Rey ulations 12.1 An Institution / SKP running any Vocational Educational Program in violation of

Regulations or/and Approval Process Handbook, shall be liable for initiation of appropriate Penal Civil action including withdrawal of approval, if any, and / or criminal action by the Council against defaulting Societies / Trusts / Companies / Associated Individuals and / or the Institution / SKP, as the ease may be.

Provided that, if any Institution / SKP contravenes any of the provisions of concerned regulations, the council after making such inquiry as it may consider appropriate and after giving these Institution / SKP concerned, an opportunity of being heard, under appropriate regulations, withdraw approval to the concerned Institution / SKP.

Provide further that incase of such a withdrawal, the operations of the said Institution / SKP shall not be started again before completion of two academic years from the date of such a withdrawal.

Provided further that, the students admitted to the Institute / SKP whose approval has been withdrawal, shall be redistributed to other Institutions / SKI" in the

Excess admissions over the sanctioned intake shall not be allowed under any circumstances. In case any excess admission is reported to / noted by the Council, appropriate penal action will be initiated against the Institution / SKP. the Institution / SKP shall be liable to following punitive action from any one or more of the following by the council.

I. Excess admission fee amounting five times the total fees collected per student shall be levied against each excess admission.

2. No admission status in one / more VE programs or skills for one academic year

3. Withdrawal olapproval for VE Program or skills. 4. Withdrawal of a oft-oval of the Institution / SKP.

12.6 Non fulfillment in additional Essential requirements for Institution / SKP a Institutions / SKP not maintaining prescribed requirements shall be liable to

following punitive action from any one or more of the following by the council.

12.8 Refund Cases

a

Institutions / SKF' not following guidelines issued by the Council regarding refund of fees on cancellations of admissions or delaying refunds shall be liable to following punitive action from any one or more of the following by the council.

I Fine for non compliance of refund of fees levied against each case shall be twice the total fees collected per student.

2 No admission status in one / more VE programs or skills for one academic year

3 Withdrawal of approval for YE Program or skills. 4 Withdrawal of approval of the Institution / SKP.

b Amount in respect of Fine for non compliance of refund of fees shall be remitted to i "Member Secretary. AICTE" as per instructions of the council.
