UNANIMOUSLY CARRIED VISITORS Floyd Milliken - asked if it would be possible for the Village to contact the businessmen to take better care of their sidewalks after the Village sidewalk plow has gone through. Mayor Herman - nothing in statute about maintenance of sidewalks. Sam Mogavero - sidewalks improperly attended to leads to lack of incentive to patronize business district vendors. Board to discuss with the Attorney, upon his arrival, who is liable for the sidewalk area in front of anyone of the businesses. POLICE CHIEF'S REPORT Joseph Kane - submitted monthly report. Request Board authorization to purchase bUllet-proof vests for all members of the Police Department, cost of which will be reimbursed 100% to the Village; approximate cost $200 each; MOTION Trustee Hornberger, seconded Trustee Carlson to approve the purchase as requested. UNANIMOUSLY CARRIED Request permission to order 1981 pOlice car; in order to have delivery after June 1, Village must submit purchase order by January 17, 1981 from Mid City Dodge, State Contract Vendor; approximate cost $7,700; MOTION Trustee Hornberger, seconded Trustee Carlson to authorize the Chief to submit the order with Mid City Dodge for the new police car to be delivered in June, 1981 and paid out of the new budget. UNANIMOUSLY CARRIED Regarding the syphoning of gas from the pump at Bison Canning, going on for over nine months, the Chief reported that two men have been arrested; Mayor Herman commended the Village Police Department for doing a good job. FIRE COMMISSIONER'S REPORT Sam Mogavero - read monthly fire and ambulanc reports - Mayor Herman stated he has a letter being prepared to submit to the Fire Company at the January 6, 1981 meeting relating to the Centennial of the Fire Department in 1982. FIRE INSPECTOR'S REPORT Floyd Milliken - (1) Inspected the Western Electronics Building (2) Complaint of odor of gasoline in the area of 66 York st., inspected and found no immediate danger; Mr. Dybowski, the General Foreman stated at this time that in his opinion the ground is saturated from a previous leak and every once in awhile the odor of gasoline does come to the surface.

WATER COMMISSIONER'S REPORT Richard Carlson - purchase of forty (40)inside Badger Meters and ten (10) meters with outside readers; MOTIONTrustee Carlson, seconded Trustee Faraci to authorize purchase as requestedat approximate cost of $1,484.00. UNANIMOUSLY CARRIEDAttorney Allan Paglia submitted communication and proposed contract forsupply of village water, rental of Library, and plowing of streets betweenthe Village of Angola and the Town of Evans; the Board will review thecontract and continue to negotiate with the Town of Evans; Mr. Pagliarequested that a copy be submitted to Town Attorney John Hamlin.Trustee Carlson to speak to the Town of Evans regarding unpaid vouchersfor lab tests of Town water.
GENERAL FOREMAN'S REPORT Rick Dybowski - submitted detailed report ofcost for storm sewer replacement work at the corner of Washington andCommercial to be submitted to Community Development for reimbursement;total cost $1,646.00.

VISITORS Gail Irish, Carl Lehning, Directors Forrest Avenue cemeteryAssoc. - asked the Board if there were any zoning restrictions or objectionsinvolved in the Associations plans to expand the cemetery; Mr. Irishindicated that the plan was to purchase land to extend the property westwardalong the southerly boundary; Attorney Allan Paglia stated that the move isa permitted one under the zoning regulations, but would require issuanceof a special use permit by the Village Board; this must be preceded by aPublic Hearing to determine if there are any serious objections; regardingroadway at the end of Henry and N. Main, previously known as "cemeteryRoad," as previously discussed this is not a Village Road or land; consideredold paper street; and was never maintained by the Village.Mr. Irish, further requested new water service for 27 and 29 Henry Drive;Trustee Carlson, Village in the process of looping lines one block from thatarea; next spring would be willing to check to see if feasible to includeHenry Drive.

WATER COMMISSIONER'S REPORT Rick Dybowski, General Foreman, reported hereceived a communication from John Stock Services stating he would beshutting down the job of looping water lines due to the weather and willresume in the Spring.Regarding proposed water contract with Town of Evans, Trustee Carlson wouldlike to set up a committee of four to include ,himself, Trustee Heinrich,and two members from the Town Board to meet, discuss proposed contract,resolve differences and then bring back information to respective Boards.Attorney Allan Paglia - heard rumors after last Town of Evans Board Meetingthat they want no part of contract; further, the Village should considerraising water rates now. Trustee Carlson would still like to talk to Town,and will continue to try and set up such a committee and meeting.
Consultant Gowdy & Hunt, Engineer Al Robinson - presented drawing andspecifications for emergency electrical work at the Water Treatment Plant.Trustee Carlson - if module system not incorporated into expansion, wouldthis electrical work be affected?Al Robinson - no, but he felt he would be remiss in his job if he did not ,~'llayout job to include both the module system and this electrical work.Board informed of Bond ResolUtion estoppel period which ends February 4,1981-Attorney Allan Paglia - no problem to publish advertisement for bids atthis time; bids will be opened February 9, 1981 at 2 P.M.Al Robinson - Gowdy & Hunt has discussed this emergency electrical renovationwith FmHA and the representative Mr. George Dimon indicated that the urgencyof the condition will justify publishing for bids prior to official FmHAapproval.The contract has been set up for 90 days, with one payment in full forcompleted work; this procedure results in a savings in that a performancebond would not be required, which is within Farmers Home Administrationrules and standards.Discussion between the General Foreman Rick Dybowski and Engineer AlRobinson regarding Village doing some of the inside concrete work andprocedure to be fOllowed.Al Robinson - recommended Village set up meeting with Niagara Mohawkrepresentatives to discuss automatic switch and rate evaluation; NiagaraMohawk personnel to attend such meeting with Mr. Robinson, Mr. Dybowski,would be an Engineer, Commercial Manager and Line Superintendent; wouldlike meeting set up and completed before 2/16/81 Board meeting.Additionally, would like to expose concrete for service tests; estimateof cost for emergency electrical work as discussed by Gowdy & Hunt andVillage Board at 2 previous meetings $35-40,000.MOTION Trustee Faraci, seconded Trustee Heinrich to authorize publicationof Notice to Bidders, such bids to be publicly opened and read February 9,1981, at 2 P.M. at the Village Office. Main in the village to Rt. 5, being2.08 lane miles outside village limits @S650.00 per lane mile, total $1352.00.Voting Aye:, Trustees Carlson, Heinrich, FaraciVoting No: None.

REVITALIZATION MEETING - Chairman of the village Planning Board, Donald L.Carbeck informed the Board of a meeting January 28 at 7 P.M. at theVillage Office on the Business District Redevelopment; representativesfrom Coudersport, Pa. will present a slide presentation and informativemeeting of progress attained in Coudersport; this letter was sent toover sixty business people and the Village Board, a,nd all interestedpersons.

Many times in my position, I must set about on a task that isunpleasant and unfortunately this is one of those cases. I couldthink of no one that would be more qualified in all respects tohold the position of Commissioner, and of no person that I wouldbe more pleased with to serve in that capacity. However, the lawsof the State of New York in this instance preclude this fromhappening. It is unfortunate, but it is a known fact tnat everyadversity contains a positive side. Hopefully the positive sideof this incident will be that the laws of the State of New Yorkwill have more bearing on the actions and activities of the FireDepartment in the future. At least I sincerely hope so.

Hopefully there will be a position within the Fire Service thatcan make good use of the expertise you possess in firematics andadministrative capabilities. Please never have the feeling thatanything that has transpired in this incident has a personalitymeasure attached to it. It is just one of those things that mustbe followed mainly due to the fact that a Fire Commissioner inthe Village form of government acts in the fiduciary capacity asTrustee of Village monies. Certainly you could see the potentialramifications if this law did not exist and that some day in thefuture perhaps three non-residents of the Village were entrustedwith the expenditure of budgeted tax money.

The exception was in the office of Fire COmmissioner and pursuantto New York State village Law, Article 3 - entitled "Officers andElections" Sub. Par. 3-300 entitled Eligibility for Election orAppointment to and Continuance in Office --
Thus, as unfortunate as it may be the position of Fire Commissionerto which Warren Jensen was duly elected cannot receive the approvalof the village Board of Trustees, and thus is referred back to theAngola Volunteer Fire Department for corrective measures at itsearliest convenience.
Additionally, the village Clerk-Treasurer has been instructed toorder a copy of the Village Law to be alloted to the Fire Departmentfor future reference so that unfortunate circumstances such as thiswill not arise again in the future.

POLICE CHIEF'S REPORT Mayor Herman questioned Chief Kane regarding thehours spent on Angola Justice Court matters by the Justice Clerk and heconcurred that 76 hours per month is a reasonable amount of time; the Courtis running very proficiently, the Judge contemplating appointing a PublicProsecutor, it is encouraging to the patrolmen when the Court is runningefficiently; Mayor Herman commented that the quarterly fines and bailrevenues from the State are increasing.
FIRE INSPECTOR'S REPORT Floyd Milliken - inspection by the Fire TruckCommittee delayed until March.
ASSESSOR'S_REPORT Henry Hornberger - Increased Assessment Notices havebeen sent out, expect many people at Grievance Night tomorrow, Tuesday,February 17,1981 from 6 to 10 P.M.
Chief of Police Joseph Kane requested that the County be notified by theVillage Board of the bad condition of Route 323 at the corner of Lincoln.

Attorney Allan Paglia informed the Board of conversation with Bond Counselregarding Bond Resolution adopted August II, '1980 and period of probableusefulness for repayment of financing. Bond Counsel informed AttorneyPaglia that they will prepare the necessary amended Bond Resolution papersand recommended that the Board borrow on a Bond Anticipation Note onapproved Bond Resolution including 10 year payback period. This procedureis acceptable at this time as the permanent financing through FmHA wouldbe in accordance with the Local Finance Law in effect at the time of thesale of serial bonds to the Village, such law effective March 17, 1981,being Chapter 16 of the State Laws of 1981, establishing 20 yearsperiod of probable usefulness.

At a regular meeting of the village Board of the Village of
Angola, County of Erie, New York, held in the said Village on the 6th
Trustee Hornberger offered the following resolution and
Trustee Heinrich moved its adoption.
WHEREAS, a proposed local law has been introduced to the
Village Board of the Village of Angola, and
WHEREAS, the said local law, would, if enacted, provide for
licensing and inspection of amusement parlors in the village of Angola, and
WHEREAS, the proposed local law has been drafted and has been
on the desks of all members ·of the Board of the Village of Angola, for more
than seven (7) calendar days before the execution of this resolution,
NOW, THEREFORE, BE IT RESOLVED, that the village Board of the
village of Angola direct the Village Clerk to cause notice of a public
hearing regarding the adoption of the proposed Local Law #1 for the year of
1981 of the Village of Angola pursuant to the applicable sections of the
village Law and Municipal Horne Rule Law, said public hearing shall be held on

There were twelve senior citizens attending the meeting and the Presidentof the Senior Citizens Group, Ray Nagel, Seneca'Road, Angola, N.Y., spokefor the group, the group would like Federal Revenue Sharing Funds appliedtowards the purchase of a van for the senior citizens, to provide nutritionand socialization, in addition, the van would be used to take meals toshutins, they feel that human needs take priority over property needs,applying federal revenue sharing funds for such purpose is a qual~fied
expenditure, sixty percent of Village residents over 60 years of age.Mayor Herman - cost of van should be shared at proportionate basis withTown, to reduce F.R.S. Funds for Public Safety would mean increasing Villagetaxes at a rate of $1.00 per $~500 asse~sed valuation, the general fund hasappropriated $2000 for adult recreation; 'to -be""turned over to the seniorcitizens center and can be applied to whatever use the group would deemappropriate, reiterated that the ,Village Board was an early supporter ofthe Friendship House Senior Citizens Center which will open May I, 1981in this area.There being no further comment at this time MOTION Trustee Hornberger,seconded Trustee Carlson to close the Federal Revenue Sharing Use PublicHearing and open the Second Public Hearing. ' ,Mr. Meka, Lake Street Masked,for explanation of proposed $3.92 increase.
Leonard Lerczak, Lerczak Drive - questioned conference attendance andtravel expenses, and hiring of outside consultant.
Mayor Herman - Explained increase due to escalation of expenditures foryearly garbage contract, all utilities, gasoline, tax rate increasemaintained at $3.92 by increasing the transfer to the general fund from thewater fund to $44,000 for the upcoming fiscal year, financing of fire truckthrough Farmer's Home at 5%, and amendment to the local finance law forrepayment over twenty year period of probable usefulness, regardingconferences and travel expenses, there are forty-two (42) concurrentmeetings and the officials attending each take in as many as four in oneday, Consultant hired to assist in the State mandate of instituting doubleentry accounting, Capital Projects Funds Accounting, with assistance ofClerk-Treasurer submitting financial reports to the different agencieson Capital Projects.
Trustee Carlson - Water Department self-sustaining and need expert in thefield of municipal accounting to advise on the proposed Water PlantExpansion Project, transfer to General Fund to be spent to offset taxes,reiterated that the Angola water rates are the lowest in New York Stateand the Board needs financial advice on all of these matters.

BUILDING INSPECTOR'S REPORT Gary Walter - issued two building permits -one for addition to single dwelling; one for swimming pOOl with instructionsto Owner that the filling swimming pool permit is to be brought in to thevillage Clerk's Office at least twenty-four hours in advance of filling suchpool; - 128 S. Main has been posted as an unsafe building; owner has untilMay 1 to have bUilding demolished; must apply for demolition permit; -119 S. Main Street; inspections completed and issued temporary rentalpremises permit good for six months; siding and roofing repairs bySeptember, 1981; in addition, rental 'units must be kept in compliance torenew rental occupancy permit; - denied building permit application to erecta garage at the front· of, 'home' 'at '64 Terrylyrin in violation of set-backrequirements; proper papers have been submitted and forwarded to the ZoningBoard of Appeals and the Planning Board for a variance to the Municipal Code.

COMMUNICATIONS (l) Resident 105 Lake Street regarding work in stormsewer and if Village problem, resident to be reimbursed for cost 'involved in correcting storm sewer problem; the Board determined that thisindeed was a Village problem and on MOTION of Trustee Hornberger, secondedTrustee Carlson the Village of Angola will reimburse Helen Garland, 105 Lakestreet, Angola, N.Y. $270.00 being cost involved with correcting problemdated December 1 and 2, 1980, and March 3, 1981. NEW BUSINESS (1) Resolution authorizing Notice of Public Hearing onproposed Local Law #1 for the year 1981 providing for "Amusement Law" inthe Village of Angola (attached on separate sheet in minutes). STREET COMMISSIONER'S REPORT Trustee Hornberger - read a thank youletter from Superintendent of Schools William Houston for loan of Villagesweeper to the Lake Shore Central School System.(2) D.P.W. cleaned ditch at Commercial and John R. Drive hoping to solvedrainage problem in that area.(3) Request from residents living in the following areas to help solvedrainage problems, (i.) Lerczak and Rosalind (ii) School Street at Mr.Arnold's and Mrs. DiMartino's; feeling of the Street's Commissioner that theproblem on School st. has been caused by repaving increasing the height ofthe street over the bordering properties;The General Foreman and Streets Commissioner to check these areas duringthe next rains, hoping ·to resolve the problems by diverting the water toditches and manhole.
GENERAL FOREMAN'S REPORT Rick Dybowski - compressor has been repairedand returned to the D.P.W. - general cleaning up and restoration work beingcompleted - problem of leak on private line from Duriron driveway toresidence about 600 to 800 feet from such driveway: Trustee Carlson talkedto owner regarding whose responsibility to repair; discussion of privatewater lines and repairs by Village,whereby the Board concluded that thissituation be handled the same as storm sewer problems - if it is a villageproblem, the Village will absorb the costs, if it is the problem of theowners private line they would be required to reimburse the Village forcost of repair; Board instructed Mr. Dybowski to contact the owner andexplain the procedure and repair line -

Recital
WHEREAS, the Board of Trustees of the Village of Angola, in
the County of Erie, New York, has heretofore duly authorized the
purchase of an aerial ladder/ptimper fire truck pursuant to a bond
resolution adopted on August 11, 1980 and the period of probable
usefulness of said specific object or purpose was stated as ten
(10) years;
WHEREAS, pursuant to Chapter 16 of the Laws of 1981 the
period of probable usefulness of said specific object or purpose
is twenty (20) years;
now, therefore, be it
RESOLVED BY THE BOARD OF TRUSTEES OF THE VILLAGE OF ANGOLA,
IN THE COUNTY OF ERIE, NEW YORK (by the favorable vote of not less
than two-thirds of all the members of said Board) AS FOLLOWS:
Section 1~ The Village of Angola (herein called "Villa,gel!),
in the County of Erie, New York, is hereby authorized to purchase
an aerial ladder/pumper fire truck, including equipment and appa
ratus used in connection therewith, for the use of the Fire Depart
ment of the Village. The estimated maximum cost of said specific
object or purpose, including preliminary costs and costs incidental
thereto and the financing thereof, is $169,850 and said amount is
t.{
hereby appropriated therefor, including the amount of $10,000
being the trade-in value of the fire truck now 'owned by the
Village, to provide the down payment required by law. The plan
of financing includes the use of said trade-in, the issuance of
serial bonds to finance the balance of said appropriation and the
levy of a tax upon all the taxable real property in the Village
to pay the Jinterest on said bonds and the principal thereof as
the same shall become due and payable.
Section 2. Serial bonds in the principal amount of
$159,850 of the Village are hereby authorized to be issued
pursuant to the provisions of the Local Finance Law, constituting
chapter 33-a of the Consolidated Laws of the State of New York
(herein called llLaw ll), to finance the balance of said appropriation.
Section 3. The following additional matters are here-
by determined and de1cared:
(a) The specific object or purpose for which the
bonds authorized by this resolution are to be issued is the pur-
chase of a motor vehicle used for fighting fires, including equip-
rnent and apparatus used in connection therewith, the estimated
cost of which is in excess of $50,000 and, in consequence, the
period of probable usefulness of said specific object or purpose,
pursuant to the limitations of Section 11.00 a. 27 of the Law,
as amended by Chapter 16 of ·the Laws of 1981 of the State of New York
is twenty (20) years, but the maturity of the bonds shall not
exceed twenty years as measured from the date of the first bond
anticipation note issued pursuant to the bond resolution referred
to in the recitals hereof.
(b) Current funds are required to be provided prior
to the issuance of the bonds authorized by this resolution or any
bond anticipation notes issued in anticipation of the sale thereof
pursuant to Section 107.00 of the Law, such current funds in the
amount of $10,000 are now available in the current budget of the
village under the heading "Trade-In Allowance". The Village
Treasurer is hereby authorized and directed to set aside said funds
and to apply the same solely to said specific object or purpose.
(c) The proposed maturity of the bonds authorized
pursuant to this resolution may exceed five (5) years.
Section 4. Each of the bonds authorized by this
resolution and any bond anticipation notes issued in anticipation
of said bonds, shall contain the recital of validity prescribed by
§52.00 of the Law and said bonds and any notes issued in antici
pation thereof, shall be general obligations of the Village,
payable as to both principal and interest by a general tax upon
all taxable real property within the Village without limitation
of rate or amount. The faith and credit of the Village are here
by irrevocably pledged to the punctual payment of the principal
of and interest on said bonds and any notes issued in antici
pation of said bonds and provision shall be made annually in
the budget of the Village by appropriation for (aJ the amorti
zation and redemption of the bonds and notes to mature in such
year and (b) the payment of interest to be due and payable in
such year.
Section 5. Subject to the provisions of this resolution
and of the Law~ and pursuant to the provisions of §30.00 relative
to the authorization of the issuance of bond anticipation notes,
or, the renewals of said Notes and of SSO.OO and SSS6.00 to
60.00 of the Law, the powers and duties of the Board of Trustees
relative to authorizing bond anticipation notes and prescribing
the terms, form and contents and as to the sale and issuance of
the bonds herein authorized and of any bond anticipation notes,
are hereby delegated to the" Village Treasurer, the chief fiscal
officer of the Village.
Section 6. The validity of the bonds authorized by
this resolution, and of any notes issued in anticipation of said
bonds, may be contested only if:
(a) such obligations are authorized for anobject or purpose for which the Villageis not authorized to expend money, or
(bl the provisions of the Law which should becomplied with at the date of the pUblicationof such resolution are not substantiallycomplied with
and an action, suit or proceeding contesting such validity, is
commenced within twenty days after the date of such pUblication,
or
(0) such obligations are authorized in violation ofthe provisipns of the constitution.
Section 7. This resolution, as amended, is sUbject
to a permissive referendum.
Section 2. The amendment to said bond resolution in
Section I of this resolution shall in no way affect the validity
of any liabilities incurred, obligations issued or action taken
pursuant to s.aid bond resolution and all such liabilies incurred,
obligations issued or action taken shall be deemed to have
been incurred, issued or taken pursuant to said bond reselution,
as so amended.
Section 3. The Village Clerk of the Village of Angola,
in the County of Erie, New York, shall within ten (lO) days
after the adoption of this resolution, cause to be published
at least once in the "EVANS JOURNAL,.II a newspap-er published in
Evans, New York, having a general circulation within said Village,
and hereby designated as the official newspaper of said Village,
and to be posted in at least six (6) of the most conspicuous
public plac~s, in the Village, a notice which shall set forth
the date of adoption of said foregoing bond resolution and con~
tain ,an abstract thereof concisely stating its purpose and effect.
Section 4~ The Notice referred to in Section 3 hereof,
shall be in substantially the following form:

PRESS RELEASE
The Angola Village Board met as a screeningcommittee following the regular board meeting Monday eveningto review six resume's from parties interested in filling thevacancy created by the resignation of Trustee Richard Faracion May 1, 1981.
According to Mayor Kenneth J. Hetman, "it was an administratorsdelight to have six such qualified applicants for the position,anyone of whom would have been a tremendous asset to the village."
However, after some 2~ hours of deliberation on the applicants,the board members became deadlocked on two of the remaining candidates.
Mayor Herman explained, "at this point it became obvious that Iwould have to invoke the powers set forth in Art. 3 Sec.3-312 of theN.Y.S. Vi11a~e Law, charging me with the responsibility of fillingthe vacancy. The mayor continued, "My final decision was based ingreat deal by the fact that the electors had previously elected abusinessman to the board, and it was this position that was open, Ifelt it was only fitting that a businessman be appointed to thevacancy to keep the balance on the Village Board that the electorshad chosen. Thus, I appointed Lewis R. Catalino of 14 Beverly Drivein the Village of Angola to fill the unexpired term of office."
Mr. Cata1ino is a life long resident of the village, GeneralManager of Evans Builders Supp1V' Inc., A graduate of Tri-StateCollege with a BS Degree in Bus~ness Administration and Accounting,Past President of the Evans-Brant Chamber of Commerce, and sits onthe advisory board of the Marine Midland bank.
Mr Cata1ino will take office June 1, with officia~ swearing inceremonies set for the Village Board meeting that evening.
"This move allows us to enter the new fiscal year of the villagewith a full board" the mayor concluded.

Summer Youth ProgramRESOLUTION: WHEREAS, the Erie County Consortium has approved Village of Angola applicationfor 1981 Summer Youth Employment Program, andWHEREAS, Community Development Office has verbally approved reimbursement to the Villageof Angola for cost of such supervision of the S.Y.E.P., andWHEREAS, at the April 27, 1981 meeting, Salvatore Mogavero informed the Board of hisinterest in the position, and of his past experience of working with youth,NOW, THEREFORE, BE IT RESOLVED that the Village of Angola appoint Salvatore Mogaveroas Supervisor for the approved S.Y.E.P. at the rate of $5.25 per hour for 36 hours perweek, effective June 24, 1981, being one week prior to the start of the seven weekprogram, to allow time to prepare necessary schedules and other pertinent requirements,for a grand total of eight weeks employment. NEW BUSINESS RESOLUTION - the following Resolution was moved for adoption byTrustee Hornberger, seconded Trustee Heinrich:WHEREAS, recent information circulating throughout the County of Erie advocating theproposal of fees to be charged for fire training, Emergency Medical Technician Coursesand State mandated recertification courses, andWHEREAS, it is the feeling of this organization that such fee schedules would bedetrimental to the total concept of volunteer fire and ambulance services through ourVillage, andWHEREAS, any type of fee instituted against volunteer personnel who provide fire andambulance service to the residents of our Village spending countless hours in trainingand in actual service, thus would have to be considered "non-appreciative" andWHEREAS, the final alternative of not charging these fees would rest on the shouldersof the already overburdened taxpayers in our Village to pay these chargesNOW, THEREFORE, BE IT RESOLVED that the Village of Angola go on record opposing feeschedules of any type to be levied against the volunteer fire and ambulance services inour Village, and that this ultra-necessary training continue to be paid for on theCounty and State level as in the past.BE IT FURTHER RESOLVED that this Resolution be forwarded to the County Executive andthe entire Erie County Legislature.Voting aye: Mayor Herman, Trustees Carlson, Heinrich, Hornberger, Catalino.Voting no: None CARRIED

MOTION Trustee Carlson, seconded Trustee Hornberger to approve the minutes of theOctober 5, 1981 meeting as submitted. UNANIMOUSLY CARRIED
VISITORS Leonard Lerczak regarding 25' strip of land on the east side of Bartus Lanereentered on the tax roll by Erie County after revaluation; Mr. Lerczak reiterated thatprevious Village administrators had verbally agreed to remove the 15' strip of land fromthe tax roll until such time as said land was transfered to a new owner; previousdiscussion by the property owner and Village Board resulted in a request that the minutesbe researched and the Village Attorney submit an opinion on this matter; Trustee Hornbergeras Assessor spent three days researching minutes from a period so stated by Mr. Lerczakand found nothing on record or any documents verifying the said agreement; the situationarose when owner of adjoining property had opportunity to sell ten acres and buyerrequesting before purchase that an approved road be deeded to the Village; at that timethe Lerczak family conceded twenty-five feet of the proposed fifty foot strip for aroad and was left with a 25 'X300 , strip of land which previous administrators verballyagreed to remove from tax roll until such time as the said strip was transferred to anew owner; Board members comments - (1) Recall situation when Bartus Lane wasdedicated and 25' additional was taken opposite Lerczak property to complete 50' road(2) Another similar situation exists in the Village (3) Franklin Street extensionsituation reiterated (4) any interest by current adjacent property owners to purchase;(5) Situation not just matter of principal, question whether Village can legally takeoff assessment roll, suggest again request Attorney to research matter; Village musthave documents to base decision to remove property from current tax rolls (6) CurrentBoard would abide by decision or cOTIffilitment previously made to the Lerczak family if theagreement has been documented (7) Board requested Leonard Lerczak to submit what mapshe has for review by Village Attorney.Mr. Lerczak would appreciate an answer to resolve this matter; after speaking to ErieCounty his contention was that the Village would have to initiate action to remove thisproperty from the tax roll by submitting a letter stating the situation; Niagara Mohawkset a pole on the site of the original proposed street; supposedly documented proof wassubmitted for Village records years ago.Mr. Lerczak regarding nice job on John R. and Commercial by D.P.W.; one piece notcompleted; asking Board's consideration of completion before winter; Trustee Hornbergerto speak to General Foreman and inspect area; Mr. Lerczak has no objection to guard railsbeing installed in area.

211FIRE COMMISSIONER'S REPORT Sam Mogavero - (1) Hydrant Test conducted by Fire Dept.;request Board's consideration for one Village employee to accompany the three Fire Dept.groups of volunteers to assist if there are any problems; Board agreed with FireCommissioner and will be taken into consideration for next springs hydrant test.(2) Regarding the use of recapped tires for Fire Truck 1"4 and Ambulance - Trustee:,.·····l.Hornberger, Trustee Carlson, Mayor Herman did speak at various times regarding recapson rear of #4, no conversation regarding recaps for ambulance; Fire Commissioner SalSack does not feel recaps would be sufficient due to the weight in the rear of Truck #4;further discussion between the Board and Fire Commissioners and recommendation that theFire Company get the prices and specifications of both new and recap tires for Truck #4only and suggestion that the Fire Company check with other surrounding companies fortheir opinion and experiences with recapped tires.
STREET COMMISSIONERS REPORT Trustee Hornberger - Newton Street driveway apronscompleted, some grading this fall, seeding in the spring.$38 per block for replacement of sidewalks, work to begin within the next week or two.Leaf pick-up to begin as soon as weather permits; leaf box and truck ready to go.Mayor Herman request damaged flasher be replaced at area where tile has collapsed onCenter Street. Parking lot behind Post Office and designation of specific area for"over-night parking only;" Streets Commissioner to speak to Joe Kane regarding sucha sign.Trustee Hornberger as Chairman of Assessors, agrees with computation of State Board ofEqualization and Assessment that Village assessments are too low, thus the 1982 tentativereduced equalization rate of 13.20.

MOTION Trustee Carlson, seconded Trustee Hornberger to approve the minutes of theNovember 16, 1981 meeting as submitted. UNANIMOUSLY CARRIED
VISITORS William Barrett regarding late filing of subdivision map with Erie County andtax assessmen~a subdi~ion, and legally not, being able to transfer any of the lotsuntil County acceptance on a timely basis of completed subdivision plot plan and map;Mayor Herman - read communication from Donald Carbeck, Temporary Chairman Planning Board,concerning Beverly Heights Subdivision, in which he states "it is the opinion of everyPlanning Board member that Mr. Barrett give us a new print which shows exactly what wasused for sewer lines, storm drains, manhole receivers, and water lines. with hydrants, etc.The actual print would then meet Mr. Dybowski's request for Village records as well." - ErieCounty did not approve map signed by the Village of Angola due to time-lapse beyond thelegal requirement.Trustee Hornberger - regarding assessment, Mr. Barrett only recourse would be to file agrievance for Assessors review on the third Tuesday in February next year. General ForemanRichard Dybowski - original plat not filed correctly with Erie County;: Village Engineersapproved water lines only.The Board recommended that Mr. Barrett contact Erie County regarding acceptance of subdivisionmap with revisions as completed. Mayor Herman indicated he would speak to Mr. Carbeck againon this matter.Robert Miller, regarding previously discussed matter of sanitary sewer connections for3 Terrylynn Drive properties and communications between Sewer District and Mr. Miller onsewer connection feasibility.Mayor Herman suggested that Mr. Miller attend the next Sewer Board Meeting to be held atthe Eden Town Hall, Thursday December 10, at 2 P.M., to hopefully resolve this matter onceand for all. Mr. Miller agreed to attend such meeting.The Mayor requested a memo as reminder to call Marco Faraci at the Sewer Authority Officerequesting that prints of the contract covering the Terrylynn Drive properties be broughtto the meeting next Thursday.Joan Will and John Barone, representing Angola Businessmen's Association, regarding proposedcelebrations for the upcoming Christmas Holiday; (i) weather permitting an Old FashionedCommunity street cleaning using Village truck and brooms, Sunday December 13th around10 o'clock in the morning, when the Christmas decorations will be installed (ii) Boardinvited to attend tree lighting ceremony, Friday, December 11th, 7 P.M. at the Bank lot(iii) on Friday, December 18th, planning to advertise for Carolers around the Christmas treeand Santa present to pass out candy canes; watch Penny Saver for details (iv), RobertMiller offered to set tree in the future if Niagara Mohawk personnel are prohibited fromso doing. (v) Village to install snow fencing around the tree in hopes of deterring anyfurther vandalism. .

FIRE COMMISSIONER'S REPORT Sam Mogavero - (1) Voucher submitted from vic Schrader Tirefor payment of new tires for Fire Truck #4 (2) Fire Chief request permission to purchase6 coats at $95.00 each and six pairs of boots at $55.00 each, these quotes being the lowestof three received; MOTION Trustee Heinrich, seconded Trustee Hornberger to approve therequest for purchases at a total cost not to exceed $900.00. UNANIMOUSLY CARRIED(3) Fire Department request reimbursement of cost for remodeling and request approval toreface the front wall with the same materials used for remodeling of the various offices,total cost $1,750.00; Trustee Carlson recommended that the Board approve 50% reimbursementnow and the balance to be reimbursed after June 1, 1982; upon MOTION of Trustee Carlsonand seconded Trustee Catalino the Board approved reimbursement in the amount of $875.00out of the current budget. UNANIMOUSLY CARRIED(4) Regarding remodeling of office restroom, cost of materials and labor for walls only$200.00; Board estimated additional $200.00 for vanity, sink and medicine cabinet;MOTION Trusteee Hornberger, seconded Trustee Heinrich to approve maximum expenditure of$400.00 to remodel office restroom. UNANIMOUSLY CARRIED
FIRE INSPECTOR'S REPORT Floyd Milliken - the one wall furnace is too small to heatthe Fire Hall, and suggested the Board consider another unit for the d~wnstairs hall;various piles of brush left during leaf pick-up have been removed by the D.P.W.; 87 So.Main Street violation notice sent to owner; attended 16 hour Arson Detection Course inCheektowaga; Fire Officers not attending training schools which would be most advantageousto them - attendance at such training schools is a legal expense to the Village and suchofficers could be reimbursed for expenses; Board reiterated that fire officers are coveredunder a blanket liability policy in regard to any litigation brought against a fire official.

WATER COMMISSIONERS REPORT Trustee Heinrich - submitted list of 15 water accounts thatare two quarters in arrears totalling $1,375.19; certified notices to be sent to eachproperty owner allowing ten days to pay in full in accordance with the local law or ~
service to be discontinued.Trustee Carlson - (1) Hydrant at Lake and Main Streets to be repaired by S. Stock Services.(2) Hunt Engineer representative Al Robinson telephone call regarding payment to Herbert F.Darling Contractor and request Board approval of payment for second estimate in the amountof $121,167.55, and work change orders #6, 7 and 8 totalling $11,627.00 and change order#9 credit of $9,022.90 (decrease in contract for lineal feet of intake installed) for totalof an additional $2,604.10; if the Board would approve the requested payment and changeorders the papers would be signed by Mayor Herman, sent back to Hunt Engineers and theywould then forward to FmHA for their approval; payment could not be released to thecontractor until such approval was received from the Farmer's Home Administration; discussionregarding work change orders and understanding that #8 being purchase of second buoy for$700.00 includes the lamp which cannot be purchased separately; a recalculation of theadjusted conntract as follows:
Adjusted contract - $588,072.10, less prior payment - $437,861.10, balance due$150,211.00, less this request $121,167.55, 5% retained $29,043.45.MOTION Trustee Carlson, seconded Trustee Heinrich to tentatively approve payment toHerbert F. Darling Contractor in the amount requested of $121,167.55 and approve workchange ord~s #6, 7, 8, 9, pending approval of Farmer's Home Administration. UNANIMOUSLYCARRIED - JZe.e- / - i/- - ?;;(~(3) Two vacumn pumps at Pump Station need to be repaired, one at a cost of $1,667.00 andthe second at a cost of $1,234.00; a new pump would cost approximately $1,788.00; opinionthat it 1S more feasible to repair two old pumps which could last four times longer thanone new one.
GENERAL FOREMAN'S REPORT Rick Dybowski - request permission to buy fifty sign blanksand thirty (post) blanks total cost $1,562.00; D.P.W. crew have been repairing signs forfour days; Trustee Carlson commented that taxpayers have noticed the work being done;Board did not take action at this time and the matter was tabled.

MOTION Trustee Hornberger, seconded Trustee Carlson to approve the minutes of theDecember 7, 1981 meeting as submitted. UNANIMOUSLY CARRIED
FIRE COMMISSIONER'S REPORT (1) Overhead doors of both the COlnmercial Street and So. MainStreet Fire Halls must be repaired immediately; Memorial Hall door separating from theframe, and the controls are off center; must be closed manually; inferior installationoriginally; Board agreed that these repairs be made immediately (2) Air conditionerupstairs is defective; qualified fireman checked and in his opinion the unit is beyondrepair; suggestion that the unit be donated to the Vocational School for their airconditioning classes; MOTION Trustee Heinrich, seconded Trustee Carlson to approvedonation of the inoperable unit to the school as suggested by the Fire Department.UNANIMOUSLY CARRIED (3) At the next Board meeting a list of items needing attentionat both Fire Halls and at costs over and above the fire department budget to besubmitted for Board consideration. (4) Commissioner to discuss Fire Departmentmonthly charges with Village Clerk and General Foreman (5) Window replaced at CourtHouse by local company, Loretto Glass Company and vouchered to the Town of Evans.(6) At one of the Angola Businessmen's Association meetings a suggestion regarding thepossibility of having Village law violators work out their court sentences by helpingSenior Citizens; Allan Paglia to check into the matter and clarify for Board.
STREETS COMMISSIONER AND CHAIRMAN ASSESSOR'S REPORT Trustee Hornberger to start workon assessment roll changes next week - all leaves picked up; leaf machine .need extensiverepair or purchase new one; General Foreman recommend that it be fixed - signs needed tobe replaced at a cost of $924 as reported at the last Board meeting; MOTION TrusteeHornberger, seconded Trustee Carlson to approve expenditure as requested. UNANIMOUSLYCARRIED - Sanding truck repaired again at a cost of $500; keep in mind for futurebudgets, purchase new one or extensive repairs to the one presently in operation General Foreman's car in very bad condition; would like to discuss at a workshop sessionwith Board the alternatives in providing a car for the General Foreman.
WATER COMMISSIONER'S REPORT Trustee Heinrich - of fifteen outside customers in arrears,eleven paid in full, four remain unpaid; two customers called with promise to pay at theend of the year; one customer did not pick up the notification from the Post Office; oneno word at all; Board agreed that no action to be taken until after the first of the yearat the January 4th meeting.
GENERAL FOREMAN'S REPORT Thanks to Erie County and Town of Evans Highway Departmentsfor helping Village by sanding Lake Street when the Village sander was down.
OLD BUSINESS As yet Attorney Allan Paglia has not heard from Audit and Control regardingdisposition of the arrears water bill, 627 Fulton, former owner William Barney.
SPECIAL FUNDS MOTION Trustee Heinrich, seconded Trustee Hornberger to approve thefollowing: Community Development voucher total $8,288.70; Revitalization $52.50,Storm Sewer Project $8,236.20. UNANIMOUSLY CARRIED
Mayor Herman asked that a moment of silence be observed in respect for the Polish people,many of whom are related to people in our community, who are currently under one of the mosttrying times in history, at one of the most inopportune times of the year.
