A. RELIEF SOUGHT: Direction to PIO for online transfer of RTI request to CBI so that substantive response/information can be provided for issues spread all over India and various ministries from Year 2006-07 onwards B. GROUNDS FOR APPEAL: (i) Response of PIO suppresses his earlier letter dated 02/08/2017 (First attachment) to Chief Secretary/Govt of Assam. Copy of letter dated 02/08/2017 was received by appellant on 06/10/2017 which is the date, RTI appeals CVCOM/A/2017/60008 dated 29/07/2017, CVCOM/A/2017/60012 dated 10/08/2017 and CVCOM/A/2017/60017 dated 17/08/2017 and PLCOM/A/2017/60028 dated 02/09/2017 were disposed online. (ii) RTI appeals CVCOM/A/2017/60008 dated 29/07/2017 and CVCOM/A/2017/60012 dated 10/08/2017 were given delayed and unauthorised
response dated 29/09/2017 (4th attachment) and 03/10/2017 (5th attachment) by SO/CVC Sh Suresh Pal without grant of relief sought. The RTI appeals were meant for disposal by FAA/CVC Sh Praveen Sinha. (iii) Sh Suresh Pal is giving such unauthorised responses from March 2015 onwards leading to CVC Complaint 7929/2015 and 26663/2015 against CVC officials. (iv) Letter dated 02/08/2017 from CPIO (First attachment) synchronises with online forwarding of RTI request CBIMH/R/2017/50012 dated 28/06/2017 (v) So far, from August 2013 onwards, 37 RTI requests and 18 RTI appeals have been registered with DoPT. Earlier also in May/June 2013, Online RTI requests were registered with DoPT for seeking information from CVC and Railway. On 24/05/2013, FIR No. 393/13 dated 24/05/2013 was registered at Assam jalukbari Police Station against N F Railway Officials. The FIR was suppressed in October 2013 without knowledge of complainant. After not getting relief from PMO, CBI and CVC, NHRC was approached in August 2013 leading to FIR No. 644/14 dated 03/09/2014 (6th attachment) which is under investigation at Assam Jalukbari PS as informed by Guwahati Police vide letter dated 15/06/2017 (7th attachment) (vi) Sh Ajay Kanoujia Director/CVC initially claimed on 04/07/2017 (8th attachment) to the effect that CVC Computerised Complaint data is not working and hence asked for copy of CVC Complaints 20265/2016, 42907/2016 and 7827/2016. The same were sent to him on 10/07/2017. (vii) DoPT transferred RTI request to CVC vide registration number CVCOM/R/2017/80013 dated 01/09/2017 which was disposed by Sh Ajay Kanoujia on 28/09/2017 claiming that complaints have been filed. (iv) Letter dated 02/08/2017 from CPIO (First attachment) synchronises with online forwarding of RTI request CBIMH/R/2017/50012 dated 28/06/2017 (v) So far, from August 2013 onwards, 37 RTI requests and 18 RTI appeals have been registered with DoPT. Earlier also in May/June 2013, Online RTI requests were registered with DoPT for seeking information from CVC and Railway. On 24/05/2013, FIR No. 393/13 dated 24/05/2013 was registered at Assam jalukbari Police Station against N F Railway Officials. The FIR was suppressed in October 2013 without knowledge of complainant. After not getting relief from PMO, CBI and CVC, NHRC was approached in August 2013 leading to FIR No. 644/14 dated
03/09/2014 (6th attachment) which is under investigation at Assam Jalukbari PS as informed by Guwahati Police vide letter dated 15/06/2017 (7th attachment) (vi) Sh Ajay Kanoujia Director/CVC initially claimed on 04/07/2017 (8th attachment) to the effect that CVC Computerised Complaint data is not working and hence asked for copy of CVC Complaints 20265/2016, 42907/2016 and 7827/2016. The same were sent to him on 10/07/2017. FACTS 1) I am IRSEE/98 Exam/Gp A JAG officer under Ministry of Railways presently working as Deputy Chief Electrical Engineer, Dibrugarh Workshop, N F Railway, Dibrugarh since April 2015. 2) I am being subjected to all possible types of harassment by Railways - Badly delayed malicious vindictive and fraud disciplinary cases commenced on 11/07/2011, 12/06/2015 and 18/04/2017, repeated spoiling of APARs, denial/withdrawal of facilities, denial of promotion AND NON-PAYMENT OF SALARY SINCE JANUARY 2017. 3) Based on malafide/illegal NFR orders dated 21/05/2013, threat dated 21/05/2013 of the then CEE/Planning Sh S K Puri and based on verbal advise dated 23/05/2013 of CVO/NFR, under compulsion/coercion, I reported to MD/CH/MLG on 23/05/2013 for Medical Examination by NFR/Medical Board. 4) On 24/05/2013, my office chamber was locked and not opened despite speaking to CEE, CEE/Planning and CESE. I gave message to all concerned followed by registration of FIR No. 393/13 at local police station against GM/NFR, CEE, CEE/Planning and CESE. 5) On 28/05/2013 I met CPO/NFR Sh C Saikia (Now Chairman/RRB/Guwhati) regarding quashing of

GM(P)/NFR order dated 21/05/2013. He was non-committal and evasive about the issue. 6) At 1600 hrs on 28/05/2013, I met Medical Board for my medical examination. During the examination, I was informed that my correspondence to PMO alongwith about 31 other documents were basis of request by the then CESE/NFR Sh Arjun Kumar for asking my medical examination. 7)) On 03/06/2013, CEE/NFR issued a letter showing involvement of the then CRB Sh Vinay Mittal (Now Member/UPSC) and Adviser (RE) in my issues pertaining to my postings in CORE organisation. 8) On 04/06/2013, HoB/CBI/Guwahati Sh H C Nath (Now Guwahati Police Commissioner informed that they have taken action on my complaint and advised to be in touch with CVO/NFR. On 08/01/2013 (Page 151-164 of the attachment), email was sent to Honourable Prime Minister regarding denial of work to Praveen Poddar, DyCEE/Coord/MLG/NFR and connected matters. Thereafter harassment of complainant was enhanced by N F Railway. On 09/04/2013 (Page 132 of the attachment), email was sent to Sh Arjun Kumar the then CEE/Planning/NFR informing of note no. EL/212/1/ (B) dated 09/04/2013. Thereafter criminal conspiracy was hatched by way of initiation of note dated 12/04/2013 by Sh Arjun Kumar for subjecting complainant to illegal medical examination. On 18/04/2013, N F Railway issued orders for transfer of Sh Arjun Kumar WITH IMMEDIATE EFFECT.
