4) Under Point No.10 in your RTI Application dated 04.11.2015, you have sought information on representation dated 02.11.2015 which is concerning his “departmental remedies” viz. his appeal against imposition of penalty on Shri Raju Kumar under Rule 16 of CCS (CCA) Rules, 1965. I am to refer to your Request for Information under RTI Act 2005, received vide letter dated 15/01/2016 and to say that during the scrutiny/verification of documents prior to the interview of the said examination held on 20.06.2015, it was found that the date of declaration of his B. Tech result, which is the essential qualification required for the examination under reference, was not properly mentioned in the graduation certificate or mark sheet of Shri Ajit Kumar. However, the date mentioned on such documents is 08.01.2014 which is after the stipulated date (01.01.2014) fixed by the Commission for reckoning the essential qualification. He was directed to submit to this office within 15.07.2015 a certificate issued from his University/College mentioning the date of publication of final result of B. Tech, failing which his candidature would be cancelled on the ground of No Essential Qualification. He also submitted written undertaking in this regard on the day of his document verification. He submitted a certificate issued by his college (C.V. Raman College of Engineering) in which it has been mentioned that Shri Ajit Kumar has completed his B. Tech course before 31st December, 2013, which does not imply that his final result was declared before 01.01.2014. The certificate issued by C.V. Raman College of Engineering does not specifically state that the result of B.Tech was published on 31.12.2013. Hence the candidature of Shri Ajit Kumar was cancelled for Combined Graduate Level Examination, 2014. The matter was informed to him vide this office memorandum no.3/10/2015-Exam.II dated 14.08.2015 (copy enclosed as pdf. file).In response to the said cancellation memorandum Shri Ajit Kumar submitted another certificate on 28.08.2015 (issued on 27.08.2015) wherein it was mentioned that the final result of B.Tech degree was declared on 13.12.2013. However, he submitted this certificate well after the stipulated date and completion of all stages of recruitment process and even after finalisation of data for preparing the final result of the examination which was published on 02.09.2015. Hence, the certificate submitted by Shri Ajit Kumar was not considered. .
