1. EXECUTIVE SUMMARY

Based on Article 87.2.13 of the Law No. 04/L-042 on Public Procurement, amended and supplemented with Law No. 04/L-237,

Law No. 05/L-068 and Law No. 05/L-092, Public Procurement Regulatory Commission (PPRC) for each calendar year shall prepare and submit to the Government and Assembly an annual report analysing public procurement activities in Kosovo for that calendar year, together with recommendations for improvement of the public

procurement system and / or improvement of the present law and the

secondary legislation issued by the PPRC under the authority conferred by this law, a report to be submitted not later than the end of March of the following calendar year. This report has been prepared in accordance with the requirements of the Public Procurement Law, presenting very detailed analysis on all public procurement activities developed in Kosovo, according to public

signed contracts during the period from 1 January to 31 December 2015. The preparation of this report fulfils the requirement of Article 87.2.12 of the Public Procurement Law, according to which PPRC must collect,

analyse and publish information about public procurement procedures and awarded public contracts.

This is the eleventh year that PPRC prepares such a report, trying to advance it every year and to complete it as much as possible, so that the Government and the Assembly of Kosovo have a comprehensive overview on all public procurement activities in Kosovo conducted during 2015. This report will also be welcomed for all international financial monetary institutions that operate in Kosovo, because they

will have at their disposal a report which includes public procurement activities in Kosovo according to sources of funding, the values of the procurement contracts, types of procurement activities and

procurement procedures.

2. LEGAL FRAMEWORK

2.1 The existing legal basis that regulate the Agency

Public Procurement Regulatory Commission (PPRC) is established under Part VI of the Law No. 04 / L-042 on Public Procurement, as

amended and supplemented with Law No. 04 / L-237, Law No. 05 / L-068 and Law No.05 / L-092.

According to Article 86 of this Law, the PPRC is an independent

regulatory agency and, under Article 87 of this Law is responsible for the development, operation and supervision of the public procurement system in Kosovo and shall carry out the functions assigned by this Law. In order to function properly, the PPRC has issued the Rules of Procedures and Operating Instructions for Public Procurement Regulatory Commission, which offers a series of practical operational

guidelines for the management and staff of the PPRC. Operational Guidelines provide a structured and understanding presentation of the PPRC in general, roles, responsibilities and competencies, as well as specific instructions for the implementation of the PPRC functions conferred by this Law. Guidelines are prepared in order to facilitate the

introduction of the Rules of Procedure and to guide the management and

staff of the PPRC during various review and administrative procedures which are part of the daily operations. Both internal acts of PPRC: Rules of Procedure and Operational Guidelines for Public Procurement Regulatory Commission are published on the website of the PPRC: http://krpp.rks-gov.net/

3. DESCRIPTION OF THE INSTITUTION (INSTITUTIONAL

ORGANIZATION)

3.1 Mission / Vision

The mission of the PPRC is the overall development, operation and

supervision of the public procurement system in Kosovo, and the development, operation and supervision of the electronic system of public procurement in Kosovo (E-Procurement). PPRC’s vision is the development, operation and continuous improvement of the public procurement and E-Procurement system in Kosovo.

3.2 Competences of the Public Procurement Regulatory

Commission, according to the law

1. Public Procurement Regulatory Commission is responsible for the overall development, operation and supervision of the public procurement system in Kosovo and shall exercise the functions assigned

to it by Articles 25, 81, 87 and 88 of this Law. 2. In addition to the matters specified above, the procurement expert shall have the responsibility and authority to:

2.1 conduct monitoring of procurement and contract management activities for the purpose of monitoring the application of this Law;

2.2 issue opinions to contracting authorities regarding their decisions,

actions or omissions during procurement and contract management activities;

2.3 receive reports from contracting authorities as referred to in Article 35, paragraph 1 and Article 61, paragraph 5 of this Law in order to carry out the activity foreseen in the subsequent sub-paragraph 2.13. PPRC in each case can decide to check the aforementioned

decisions and, if necessary, invite the concerned contracting authority to review its decision in accordance with the opinion issued. If the PPRC decides to check the above decisions, PPRC should do it within two (2) days after receipt of such report. PPRC opinions issued in accordance with this paragraph, have a non-

binding character for contracting authorities, but competent

authorities may take them into account when handling the complaints submitted in accordance with Part IX of this Law.

2.4 establish and publish detailed public procurement rules to ensure the proper implementation of the present law by contracting authorities, including rules governing the use and conduct of each of the procedures provided for in Articles 33-37 of this law;

provided, however, that such rules shall be consistent with the requirements and principles established by the present law and any applicable mandatory requirements of the EU relating to procurement;

2.5 prepare and disseminate procurement manuals, guidelines, standard form tender and contract documents, standard forms and

models pursuant to the present law for the benefit of contracting authorities and economic operators;

2.6 reinforce awareness among contracting authorities and economic operators of public procurement legislation as well as its objectives, procedures and methods;

2.7 provide technical assistance and advice to both contracting

authorities and economic operators on the application and interpretation of the provisions of the present law and any documents issued by the PPRC;

2.8 provide and publish written administrative interpretive rulings to both contracting authorities and economic operators on the application and interpretation of the provisions of the present law

and any documents issued by the PPRC; 2.9 establish and maintain an electronic Public Procurement Register

that shall serve as the repository for electronic copies of all notices, invitations, declarations, tender dossiers, reports, complaints and decisions filed or issued in connection with each and every procurement activity conducted or initiated by a contracting

authority;

2.10 establish manual and electronic systems for monitoring the

compliance of the contracting authorities with the present law, including the preparation of reporting forms to be completed by all contracting authorities subject to the present law;

2.11 collect, analyse and publish information about public procurement procedures and awarded public contracts;

2.12 For each calendar year shall prepare and submit to the

Government and Assembly an annual report that analyses the public procurement activities for the calendar year in question, along with recommendations for improvements to the public procurement system and/or improvement of the present Law. This report is submitted not later than the end of March of the following

calendar year.

2.13 establish and maintain an information website that provides the public with unrestricted access to (i) the present law and all secondary legislation issued under the authority of the present law, (ii) any interpretive rulings and documents referred to in this Article, and (iii) all information contained in the Public Procurement Register;

2.14 develop a web-site and a Kosovo-wide electronic information system to improve the publication of the notices required by the present law;

2.15 support the development of electronic procurement, e-auction

and communication within the field of public procurement; 2.16 develop and maintain a list of contracting authorities that

identifies all entities subject to the present law provided, however, that if the PPRC fails to include an entity in such a list, such failure shall not be determinative of the question as to whether or not such entity is a contracting authority for the purposes of the present law;

2.17 liaise and cooperate with other organisations at home and abroad on matters associated with public procurement; and

2.18 develop and implement detailed rules regarding Contracting Authorities’ disposal of assets

The PPRC shall also have the authority and responsibility to monitor and supervise the implementation of the provisions of the present law and the rules issued by the PPRC under the authority of the present law.

To this end, the procurement expert shall develop and operate an appropriate reporting methodology and mechanism supported by an electronic management information system that will enable it to (i) monitor the implementation of the present law; (ii) produce output and performance reports identifying strengths and weaknesses in the im-plementation of the present law and the procurement system; (iii) identify

those areas that are in need of improvement and development, (iv) produce the annual reports required by the present law in a manner that

provides a general but accurate assessment of the state of the national

procurement system and specific assessments of the degree of compliance/non-compliance by individual contracting authorities; and (v) make appropriate recommendations for changes to the primary and secondary procurement legislation. (Article 88 of this Law)

PPRC in its organizational structure has two departments which perform their functions under the competences provided under Articles 25, 81, 87 and 88 by this law, as follows: RULES AND MONITORING DEPARTMENT

RULES DIVISION:

establish and publish detailed public procurement rules to ensure

TRAINING AND INFORMATION TECHNOLOGY DEPARTMENT

DIVISION OF TRAINING AND EUROPEAN INTEGRATION:

PPRC is responsible to develop training modules and curriculum for procurement qualifications. PPRC is required to identify persons, experienced in public procurement, suitable to teach the

procurement courses designed by PPRC. PPRC, in cooperation with KIPA, shall arrange for the development and delivery, of procurement training courses having duration of at least fifteen (15) days for basic training and ten (10) days for advanced training. PPRC ensures that such courses are developed and

delivered by a trained person or training organizations having

substantial expertise in best international procurement practices and the procurement system of the EU. (paragraph 1 of Article 25 of this Law)

PPRC, in cooperation with KIPA, shall be responsible for organizing

examinations (Paragraph 2 of Article 25 of this Law).

PPRC, in cooperation with KIPA, shall issue a "basic procurement professional certificate" and "advanced procurement professional certificate". (Paragraph 4 of Article 25 of this Law).

DIVISION OF INFORMATION TECHNOLOGY:

4. SCOPE COVERED BY THE INSTITUTION

PPRC has thirty-three (33) working positions approved. From which thirty (30) are civil servants, while the current number of the PPRC employees is twenty-eight (28). From which twenty-five (25) are civil servants and three (3) are Public Officials (according to the LCS) two

members of the Board and the Chairman of the PPRC. Five (5) job positions are still not completed. The mandate of the PPRC’s board is for five (5) years, the Chairman and members of the board of PPRC were appointed by the decision dated

03.08.2015 by the Assembly of the Republic of Kosovo.

Functions of the President of the PPRC:

The President shall represent, manage and organize the operation

of the PPRC and have the overall responsibility for its day-to-day performance. The responsibility to carry out functions and activities of the PPRC, which are not designated or included in any

of the Departments lies with the President.

The President shall have the authority to designate any member of

the staff to organize and manage the work of the PPRC in a particular subject area, especially if certain functions or activities are not included in the functions and activities of the Departments of PPRC. The President has to inform the BoD members for any such designation. A copy of the document regarding the delegation

of the responsibility will be handed to the Personnel Officer, who is responsible for the maintenance and update of the relevant file. The President may change the delegated responsibilities as he/she finds them suitable.

The President shall convene meetings of the PPRC BoD when and

as he considers necessary or when requested by two other members of the PPRC BoD.

The President shall chair the PPRC BoD meetings. In exceptional

cases where it is necessary for the PPRC BoD to meet in the absence of the President, the President shall authorize one of the other members of the PPRC BoD to chair the meeting.

The President:

- Approves the List of job positions; - Approves job descriptions; - Assigns tasks to the PPRC employees; - Dismisses employees;

- Is responsible for the management of the PPRC financial resources;

- Designate one member of PPRC to represent, manage and organize the work of the PPRC in his absence, i.e. designates an acting President. This person may change from one occasion to

another;

- Issues instructions ensuring document handling within the PPRC;

- Concludes and signs agreements and contracts necessary to carry out the functions of the PPRC;

- Signs any document on behalf of the PPRC and all decisions made by the BoD. No official document should be issued by

PPRC which is not signed by the President; - Ensures that the Rules of Financial Procedures issued by the

Ministry of Finance (MF) are implemented by all employees of the PPRC, according to their function;

- Monitors and controls the expenditure of the PPRC; - Ensures that all employees who are responsible for the financial

administration are properly advised; - Ensures that there is a clear separation of duties between

financial administration and the necessary control. PPRC’s Staff training during 2015:

2. PPRC during these years of operation has had many difficulties in

achieving the objectives having in consideration that consistently we had removal of employees (experts) with extensive experience in

public procurement because of the low salaries in relation with the responsibilities which these officials have. Also during the recruitment procedures it was challenging to attract qualified candidates with experience in specific fields. With the beginning of the application of electronic procurement, the

need to increase the human capacity will increase in this important institution not only for PPRC but for all public procurement system in the Republic of Kosovo, with the purpose of a better functioning of the e-procurement platform.

With the entry into force of the amendment and supplementation

of the PPL, the PPRC is also responsible for organizing the training on public procurement taking into account that in the PPRC there is only one officer responsible for training, and getting this responsibility we are obliged to hold trainings for 700 procurement officers from all central and local institutions, PPRC has an urgent need for increasing human capacity in this department.

5. PUBLIC PROCUREMENT ACTIVITIES IN KOSOVO DURING 2015

Based on Article 87 paragraph 2.18 on Public Procurement Law No. 04 / L-042, Public Procurement Regulatory Commission should prepare

and maintain a comprehensive list of all contracting authorities in Kosovo, which are obliged to implement the Public Procurement Law. During 2015, Kosovo recorded 170 contracting authorities. Through annual reports on signed public contracts, which contracting authorities sent electronically during January 2016, the IT ans Statistics

Department of PPRC has prepared an annual summary report for all

public procurements conducted in Kosovo during 2015. Based on the reports sent by the contracting authorities, it shows that during 2015 throughout Kosovo 10895 public contracts were signed governed by Public Procurement Law in Kosovo, including all types of values of contracts. Further in this report we will present public procurement in Kosovo

though contracts signed during 2015. Taking into consideration reports prepared by the PPRC in previous years, according to the PPL requirements, the following report presents procurement activities, all signed contracts of the contracting authorities, by carrying out an

analyse of the signed contracts by funding sources, type of contracting authorities, type of contracts, the value of contracts, procurement

procedures, annex contracts, economic operators awarded with contracts, time limits for publication and contract award criteria. Therefore, the report reflects all the public procurement activities conducted during 2015 in Kosovo, by analysing and comparing them with previous years, where we can see the trend of the development of Public Procurement in Kosovo.

5.1. NUMBER OF CONTRACTS SIGNED DURING 2015

Based on Public Procurement Law of Kosovo, the Contracting authorities are obliged to present all signed contracts, including those with minimal value.

We will start the analysis of signed contracts with the separation of contracting authorities in the budgetary- governmental organizations, public companies and other -NGO. It is well known that this separation does not represent a real financial overview, since a considerable number of the public companies in Kosovo are still financed by KCB. Either way, we will try, based on this division, to reflect the number of contracts

signed in the table No.1 and in the graphic No.1 over the last four years by the contracting authorities in question.

Based on the classification of the contracting authorities, as

mentioned above in Table No. 2, and graphic No. 3, the following reflects the value of contracts signed during the past four years.

Graphic No.4 reflects the structure or the participation of the value of contracts signed during 2015. Budget– governmental organizations participate with 62.28%, public companies with 37.28%, while other authorities - NGOs with only 0.44% in total value of the contracts signed.

Table 3

Table No. 3 and graphic No.4 show the value of the signed contracts, taking into account the source of funding. From self source revenues, the value of contracts signed during 2015 is 147,482,211.85 €.

From the Kosovo Consolidated Budget the value of signed contracts reaches 251,046,795.73 €, while from donations the value of signed contracts reaches € 3,314,617.52.

Based on the type of procurement, that the contracts have as their

object, in table No. 4 and graphic No. 6, the value of signed contracts for supplies during 2015 reaches the amount of 189,591,969.47 €. The value of contracts signed for services is 57,189,990.33 €, and the value of contracts signed for design contest is 551,566.50 €. While the value of contracts signed for works reaches the amount of 154,510,098.80€, and if we add the value of Hani i Elezit- Pristina

highway to the amount planned for 2015, of 114,577,050.00€, the value of works contracts during 2015 reaches the amount of 269,087,148.80 €.

Supply contracts participate with 47.18%. Service contracts with

14.23%, contracts for design contest with 0.14%, while the contracts for work participate with 38.45%.

While in graphic No.8 the structure or participation of contracts signed is reflected according to the total value of contracts signed during 2015, where to the value of the works contracts is added the foreseen

value for year 2015 for Hani i Elezit- Pristina highway in amount of

114,577,050.00 € and the total value of contracts for work in 2015 reaches 269,087,148.80€ or 52.15% in the overall value of contracts signed. Supply contracts participate with 36.67%. Service contracts with 11.07%, contracts for design contests with 0.11%.

PROCUREMENT PROCEDURES DURING 2015

Table 6

Analysis of signed contracts, divided by type of procedures in table No. 6 and graphic No. 11, shows that the value of signed contracts under the open procedure during 2015 is 306,798,669.51 €. Under the

restricted procedure during 2015, is 7,438,530.35 €. The value of signed contracts according to the procedure of design

contests during 2015 is 551,566.50€, while the value of signed contracts

under the negotiated procedure after publication of a contract notice during 2015, are 40,169.82€. And according to the negotiated procedure without publication of a contract notice is 64,695,068.08€ and the value

of signed contracts according to price quotation procedure during 2015, is 20,108,584.47 €.

Meanwhile, according to the procedure for minimum value, the value of signed contracts during 2015 is 2,211,036.37€.

Analysis of structure or participation of implemented procedures

during 2015 in graphic No.12 shows us that the participation of the open procedure in the total value of signed contracts is 76.35%, which is the most commonly used procedure and known as the most transparent procedure.

Also the participation of negotiated procedure after the publication of a contract notice is 0.01%. And the participation of the negotiated procedure without publication of a contract notice during 2015 is 16.10%.

Participation of procedures under the price quotation is 5.00% and

the minimal value participation is 0.55%, restricted procedure with

1.85%, while the design contest participate only with 0.14% in the overall value of signed contracts during 2015.

From the analysis made the value of signed contracts during 2015, divided by contract award to domestic and international economic operators, graphic No.17 share in the total value of signed contracts is 75.76%. While for international and the part of the Prishtina-Hani i Elezit highway which is 114,577,050.00€, with a share of 24.24% in the general structure of signed contracts.

CRITERIA FOR AWARD OF CONTRACTS

As seen in table No. 11 the value of signed contracts by the contracting authority according to the award criteria to the lowest price is 400,918,706.40€, with a share of 99.77% in the total value of the

signed contracts during 2015. However, the value of signed contracts according to the award criteria to the economically most advantageous price reaches the amount of 924,918.70€, respectively with participation of 0.23% in the total number of signed contracts during 2015, always based on the CA reports.

5.11 AVERAGE NUMBER OF BIDDERS WHO HAVE SUBMITTED A

TENDER DURING 2015

Graphic No. 18 reflects the average number of bidders who have

submitted a tender or procurement in Kosovo during 2008 to 2015. The average during these years shows that 5.6 economic operator have tendered for one tender. So, we can conclude that competition in public procurement is very good.

5.15. ACTIVITIES OF PUBLIC PROCUREMENT REGULATORY

COMMISSION

Based on Article 42 of the PPL in Kosovo, No. 04 / L-042, each

contracting authority shall publish contract notices whenever they use the open procedures, restricted procedure or negotiated procedures after publication of a contract notice in PPRC’s official website: http://krpp.rks-gov.net Information Technology and Statistics Department started to publish

contract notices in the website from July 2007, continued in 2008, 2009,

2010, 2011, 2012, 2013, 2014 and 2015 which are presented in the graphic for the last three years.

Graphic19 By analysing the graphic No. 19 we notice that the publication of

contract notices in 2015 is 5364, contract award notices have increased to 6343. As it is seen the number of contract award notices has increased compared to the previous years, and this growth has led by the publication of contract award notices of law value contracts - price quotation. While 1835 cancellation notices were published during 2015.

Administrative Instruction No. 4/2015 for the implementation of Article 31 and 61 of this Law relating to employment and working conditions.

The abovementioned AI under Article 10.9 of the Law No. 04 / L-042 on Public Procurement have been published on PPRC’s website as drafts for 15 days, so

that the interested parties can make comments. The same have entered into force on 05.03.2015.

On 15/07/2015 the following have been issued and published on PPRC’s website, ie the link: "Help information", ten (10) Manuals with referent unit

prices, as follows: 1. Price list for hygienic material; 2. Price list for official material;

3. Price list for foodstuffs; 4. Price list for construction work and construction material; 5. Price list for medicines - essential list;

6. Price list for consumable material for health - essential list; 7. Price list for toner;

8. Price list for vehicle maintenance; 9. Price list for motor oils - Lubricants; and 10. Price list for fuel.

Manuals published with referent unit prices are manuals in which:

Procurement officers can rely during the evaluation of tenders; Other Contracting Authorities officials can rely while calculating the

estimated values; and

Economic operators may rely while preparing bids.

Published manuals are not MANDATORY manuals, which mean that the contracting authorities are not obliged to refer to these prices, but they serve as a helpful tool for the contracting authorities.

Two Standard forms were modified:

1. Standard Form B53 for the Annual Report of signed contracts, which entered into force on 16.11.2015; and

2. Standard Form B11 "Cancellation Notice of Contract Award", which

entered into force on date: 12.15.2015. (Modification of the standard form in question comes as a result of the approval of the amendment of Article 38 of the Operational Guidelines for Public Procurement by the Board of the PPRC).

During 2015, the Rules Department, based on written requests from many contracting authorities for the same issue, issued and published on PPRC’s

website, i.e. the link: "Frequently Asked Questions", a total of 36 legal interpretations.

Monitoring and supervision Department of the PPRC performs the duty of monitoring and supervising of procurement activities in Contracting authorities relying on Articles 81, 88.1 and 88.2 of the PPL No.04 / L-042. Monitoring and supervision department has the competence, authority

and responsibility to observe, supervise, and monitor the implementation

of the provisions of this law and the rules issued by the PPRC under the authority of the law. Monitoring and supervision Department during 2015 has a total of eight (8) employees, the Head of department and seven (7) officials, who have been engaged in monitoring procurement procedures either as planned

or monitoring as requested by contracting authorities, economic operators and interested parties. Monitoring and supervision Department for 2015 had planned to monitor forty two (42) contracting authorities. Monitoring and supervision Department has implemented 90% of the planned activities during the calendar year 2015 since it has monitored

thirty-eight (38) out of forty-two (42) Contracting authorities planned, with a total of 285 procurement activities.

If you draw a parallel between the report on violations for the two calendar years 2014 and 2015 then we will see that in all cases we have a decreased number of violations monitored in 2015. Here we are dealing with a real comparison because we are dealing with monitoring

approximately the same number of CA, respectively procurement activities.

In 2014 as planned, we have monitored thirty-six (36) contracting authorities as planned, with a total of 282 procurement activities and in 2015 we monitored thirty-eight (38) contracting authorities as planned, with a total of 285 procurement activities, so if we compare the number of procurement activities monitored in 2014 and the number of procurement activities monitored in 2015, then the percentage of

violations recorded in 2015 decreased, respectfully we see improvement of the performance of the procurement officials.

Goals of Monitoring and Supervision Department for 2016

Monitoring and Supervision Department for 2016 has planned to give priority to: - Monitoring and supervision of current procurement activities,

- Monitoring of procurement activities based on requests – the request of the contracting authorities, economic operators and other interested parties - Investigation of procurement activities and management activities of

public contracts - Monitoring of tender dossiers by following the notices, and other

cases which may occur during the work of the Department in this calendar year.

The purpose of the PPRC’s monitoring and supervision Department

Through monitoring of the contracting authorities to identify, prevent

and eliminate eventual failures relating to the respect of the public procurement law in force by contracting authorities, increase the work performance in order to ensure efficient, cost-effective, transparent and

fair use of public funds of the Kosovo consolidated Budget and all other funds and resources. Ensure the integrity and responsibility of public officials, civil servants

and other persons who are involved in a procurement activity, as well to promote the establishment of an institutional culture of unbiased, ethical and materially disinterested professionalism among all public officials, civil servants and other persons conducting or involved in a procurement activity.

6. SUPPORT FOR PUBLIC PROCUREMENT SYSTEM IN KOSOVO BY

INTERNATIONAL INSTITUTIONS

PPRC has consistently received support from various international

institutions. Many donors have provided funds in various forms to help

develop this system since its establishment in 1999, and onwards. These

supports were offered in the form of technical assistance, support

through various projects, by organizing training, exchange of experiences

based on study visits, providing the opportunity to participate in various

conferences and seminars etc.

Among the main donors who have supported the development of public

procurement system in Kosovo during 2014 are:

6.1 SUPPORTS FROM EUROPEAN COMMISSION

EC Project – Increasing Administrative Capacities in Public Procurement

area in Kosovo, is the fourth consecutive project funded by the European

Commission, through the Office in Pristina. This project began in

December 2013, and is expected to last until June 2015. During 2015

the project has continued to help the PPRC and public procurement

system in Kosovo in general in these aspects:

Preparation of the Draft National Strategy for Development of

Public Procurement and Action Plan;

Preparation of the National Training Strategy in the field of public

procurement;

Some proposals for amending the PPL, No. 04 / L-042;

- Upgrading the Internal Regulations of the PPRC and the CPA;

- Support on the creation of procurement policies, preparation of

guidelines for public procurement officers and provide assistance in the implementation of management and organizational improvement of the PPRC, the PRB and CPA.

- Implementation of a training program in public procurement, in

order to improve administrative capacity and coordination mechanism between key players.

- Assistance in the implementation of primary and secondary

legislation at the central and municipal level, training and

mentoring in the monitoring of contracts and regular advice on the use of framework contracts.

- Information campaign for stakeholders of public and private sector,

and the general public in order to raise awareness and

understanding of the benefits of accurate system of public procurement

- The project during 2015 has helped PPRC in the preparation of 4

Administrative Guidelines.

6.2 SUPPORTS FROM WORLD BANK

World Bank during 2015, helped PPRC, and public procurement

system in Kosovo in general with several projects:

a) Development of an electronic procurement system (2014 - 2015);

b) Implementation of centralized procurement procedures, based on

the Diagnostic Report - Quick Gains (2013 - 2015);

c) Project for performance measurement in the public procurement

system in Kosovo (2013 - 2015);

d) Project for the preparation of the Manuals with unit price for works,

goods and services (2013 - 2015);

6.3 ELECTRONIC PROCUREMENT IN KOSOVO

Kosovo during 2014 has begun to develop e-procurement platform. This project is funded by the World Bank under the Project Public Sector

Modernization. The contract for this project was signed on 8 December 2014 and the implementation of the project began on 15 December 2014. Full Development of electronic procurement platform is expected to last one year, until 14 December 2015. On behalf of the Government, the main beneficiaries of this project are the Public Procurement Regulatory

Commission, which will be the implementing agency of the project. For

the implementation of this project by the World Bank has contracted a consortium consisting of the Information Technology Company "Infodom" from Croatia and company "Komtel" from Kosovo. The contract value is 578,990.53€, including all taxes. This project will include:

- Development or adaptation, and implementation of e-procurement

System, from beginning to end, carrying the right of ownership to the Government of Kosovo;

- Supply, installation and configuration of key information

technology, in the data hardware centre equipment’s and services necessary for running the proposed procurement system;

- Package software of the project will function as a complete system,

unique electronic procurement to help Government, in conducting procurements;

- Setting the Data Centre will be done in the Ministry of Public

Administration, with the same replication, as the centre of the

second data within the Ministry of Finance;

- Providing training for staff involved in procurement, e-procurement

system, information technology and data of hardware and software centre;

- E-procurement system will be connected to external systems for

verifying information about business registration, identification number, proof of payment of VAT and taxes, daily information on currency exchange, as well as the -catalogue;

- E-procurement system will be prepared in three official languages

in Kosovo: Albanian, Serbian and English;

- Electronic tendering (by procurement planning process, to the

6.4. RECOMMENDATIONS ON IMPROVING THE SYSTEM OF

PUBLIC PROCUREMENT IN KOSOVO

According to Article 87.2.13, of the Law on Public Procurement 04 / L-

042, PPRC together with the annual report must submit to the

Government and the Assembly the recommendations for improving the

public procurement system and / or the present law.

In order to advance and improve the public procurement system in

Kosovo, PPRC proposes to the Government and to the Assembly and

other institutions dealing with public procurement, to take these steps:

- Full implementation of the Law on Public Procurement no. 04 / L-

042 as amended;

- Completing the legal basis for the implementation of electronic

procurement;

- Government in coordination with PPRC, to issue rules regarding

devices for the electronic submission and receipt of tenders and to

devices for the electronic receipt of requests to participate. These

rules must include an advanced electronic signature, in conformity

with international standards, according to Article 129.2 of the PPL

No. 04 / L-042;

- Implementation of the National Training Strategy in the field of

public procurement;

- Training in the field of public procurement, in addition to

procurement officials to be organized also for other various groups, such as management level staff, for technical experts who prepare technical specifications, for general and internal auditors, etc.

- To organize further training that are related to management of

contracts, not only for public officials, but for technical staff and others involved in the implementation of the contract;

- The validity of the certification for public procurement will be:

a) For basic level three years;

b) For advanced level - permanent term;

- To regulate by law the larger support for procurement officers, to

protect them from the pressures during the contract award;

- To continue monitoring the notices BEFORE publication of the

contract notice;

- In Article 61 to include a provision for abnormal low prices, and not

only in the total price but also for articles / positions.

- In Article 65 to include also cases in execution procedure;

- To reduce as much as possible the use of negotiated procedures,

and contracts with low and minimal values using public framework agreements and centralized procurement;

- Raising awareness on public procurement within contracting

authorities, economic operators, public procurement institutions, and the general public;

In the framework of the public procurement system in the Republic of Kosovo it is necessary to take measures to strengthen and improve in

particular:

1. Procurement Planning especially preparation in terms of quality

(they are delivered almost only formally), clear specification of each

activity as well as their specification with the procurement plan and

budget of the respective fiscal year and other years if the activities

have budget implications more than 1-year-old.

Contracting authorities must take the necessary actions when

preparing the budget and procurement planning to coordinate

activities with the aim of harmonizing the requirements and budget

possibilities as well as work plans with the annual budget. The

integration of these activities should be done in time and before

submitting the final procurement planning. The clear and complete

specification of each activity that is expected to be implemented

during the budget period must be followed by adequate budgetary

provisions of funds approved by the respective levels. Adequate and

timely specification of requirements by requesting units, especially

the specifics of the request but of the necessary budget too for the

realization is more than necessary.

2. It is necessary to strengthen internal processes in CA starting from

requesting and approval units’ up to the DP in order to harmonize

the activities especially in the phase of preparation of procurement

planning. PPRC during the monitoring phase has concluded that

the requesting units do not submit their applications on time or

submit them without specifying the proper level of the data as well

as provide contradiction for the necessary budget. In this way

lacking the coordination of activities in the sectors of CAs,

preparation of procurement planning in most cases is done only

formally. Such a practice should be changed as soon as possible.

3. Keeping records of procurement – It is extremely necessary that

this aspect be improved especially in the part of contract

management (Article 55.30 of the OG of PP). A more intensive

monitoring by the PPRC for the CA in regard of creating and

maintaining the register of procurement will be done. It is a legal

requirement to which most CAs do not do in the requested form.

PPRC will monitor with intensity this legal aspect in order to ensure

accountability and higher transparency in the procurement data.

Evidence of procurement activities must be complete and provide

sufficient data on a procurement activity is implemented.

4. Greater effectiveness in the time needed to complete

implementation of the contract from the initiation of activity until

the completion of the contract.

5. Improper use of framework contracts - especially in terms of

compliance with legal requirements elaborated in the Operational

Guidelines for Public Procurement (Article 50.2, 50.8, 50.10, etc.)

6. Professional preparation of Notices and Reports- in almost all

notices (for contract, for contract award, etc.) and reports

(including reports on signed contracts etc.) are not professional and

do not contain all the necessary data.

implementation of contracts, payments and other aspects of the

implementation is far below the legal rights and of good

performance. Kosovo Government and especially relevant audit

institutions will have to focus more on this area in order to

significantly improve the management of contracts and their

implementation. Also, PPRC will focus on monitoring the

management part of the contract. Especially in improving the

registry of data from the part of management contracts. PPRC will

monitor especially the section on compliance with the terms of the

contract with special emphasis on compliance with the fulfilment of

the dynamic and the application of penalties for non-performance

of the contract. PPRC will report to the Government of Kosovo in

order to be informed in time with the way of implementation of

contracts, weaknesses and shortcomings, the important data such

as: changes and variations in contracts, invoicing and payments,

contractor’s performances etc.

Budget expenditure rate in this economic category for 2015 is 219,162.47€, expressed in percentage 99.31.00% compared to the revised budget in this economic category or 37.71% compared with the budget spent of PPRC.

With the revised budget by the borrowing for the project of e-procurement in capital investments 165,900€, are transferred, while 104,098.47 € or 62.74% of the spent budget revised in this economic category.

With the implementation of the budget in presented level by 62.36% in the tables below for 2015 the project of borrowing (e-procurement) had a major impact in the value of 550,000€, the part of the borrowing in the total budget of PPRC was 60.22%. The balance of payments in the following tables also present the donation of BB Project, Monitoring Performance of Entities and Procurement Staff and Determination of Average Price per unit for work valued at 33.580€. Allocation of funds was made on the basis of cash flow plan prepared by CFO in collaboration with the Management of PPRC. Management of PPRC respectively CFO has been cautious and for any moment, we have not been in a position to lack of available funds or delay payment of the received invoices. This report will present in details the costs incurred by the PPRC budget for 2015, as well as their comparison with the same period of 2014.
