This project is not pending an appeal of the environmental determination.The environmental exemption determination for this project was made on April 3, 2006,

and the opportunity to appeal that determination ended April 24, 2006.

Fiscal Impact Statement: All costs associated with the processing of this project arepaid from a deposit account maintained by the applicant.

Code Enforcement Impact: If this project is denied, the City's Neighborhood CodeCompliance Division of the Development Services Department would take codeenforcement action because the existing permit for the 76 foot high monopole is expired.The code enforcement action would be funded by the City's general fund.

Housing Impact Statement: None associated with this project.

BACKGROUND

The Padre Gold project is located 7245 Linda Vista Road in the Linda Vista CommunityPlanning area. Currently existing on site is a 76-foot tall monopole that was approved previouslyby the Planning Commission on September 28, 1995. The permit expired September 28, 2005and Verizon submitted an application for a new CUP to maintain the existing monopole onMarch 4, 2006. The project has been scheduled for several Planning Commission hearings, butVerizon has requested continuances in order to redesign the facility.

On June 30, 2009, Verizon submitted a redesigned project consisting of a 76-foot tall monopinesupporting 15 panel antennas and a microwave dish along with a planter wall and new shrubs tosoften the visual impact of the equipment enclosure. The Linda Vista Planning group votedunanimously to deny the project. The project did not comply with LDe Section 141.0405(previous Communication Antenna regulations) due to the implausibility of a 76-foot high pinetree in a commercial setting devoid of any similar height trees. Verizon has redesigued theproject again, this time as an architectural tower. Verizon has provided two differentarchitectural designs as a result of ad hoc planning group subcommittee meetings. The heightremains the same: 76-foot, but the antennas are completely concealed within the new tower. Theequipment enclosure will remain, but concrete screening walls will be added along with a planterwall.

The project site is zoned Ce-I-3, which allows a maximum height of45-feet, thus therequirement for a PDP. The site is designated for commercial use in the Linda Vista communityplan. Surrounding uses include residential to the south, west and east and a school to the north.

DISCUSSION

Project Description:

This project was submitted under the previous Communication Antenna regulations (LDCSection 141.0405), and because it does not comply with the development regulations, it isconsidered to be a major telecommunication facility and it requires a PDP for the deviationsdiscussed below.

The existing tower is 76-feet where the maximum height limit is 45-feet. Section 141.0405 ofthe Land Development Code requires wireless communication facilities to be designed to beminimally visible through the use of architecture, landscape architecture and siting solutions.After several years and many discussions, Verizon has now designed a 76-foot tall architecturaltower that will house all of their antennas. The tower, because of its location at the intersection ofLinda Vista Road and Genesee Avenue will have the appearance of a community landmark.Verizon is requesting to maintain their existing 360 square foot equipment enclosure and torelocate the existing generator. All of these components are proposed to be located behind a 7­foot high concrete wall and a series ofplanter walls. Landscaping will be added to enhance thecompound area and along the street to enhance views of the property.

The height is a concern to staff as well as to the community, but it is a commercial propertylocated at a major intersection, which conld also be called a gateway within Linda Vista. Thelocation is conducive to an architectural tower that would have the appearance of a communitylandmark. Verizon has developed two designs based on input from a community planning groupad hoc subcommittee. The first design picks up on the surrounding architecture in the immediatearea and includes an asymmetrical roofline above decorative columns that transitions to a solidtwo-tone wall below. The second tower design is reminiscent of the architectural style ofUSD,which is also a community landmark. Additionally, Verizon is providing space for AT&T tolocate their antennas and equipment within the tower negating the need for a WCF at KearnyMesa Park, which the community group opposes. There is also room for the T-Mobile facility tobe relocated within the tower once the CUP for their flag pole on the same property expires.

The existing monopole and equipment enclosure encroaches into the rear yard setback. At thetime of the original approval, the deviations were included under the CUP. The proposedproject retains the enclosure in its current location, which is set back six-feet from the rearproperty line. The new tower would be set back approximately 8 ~-feet from the rear propertyline. The required setback is 14-feet. On the side yard setback along the eastern side of theproperty, the existing enclosure is set back 8-feet from the property line and the new generatorenclosure would be set back 10-feet from the property line. The required side yard setback is 19­feet. Since the time that the Verizon facility has been in this location, there have been nocomplaints from the adjacent property owners or tenants and since the project was originallyapproved, a new three-story condominium complex has been built to the east of the project site.The developers of the new condominium complex on the east constructed a 7-foot high concretefence along the property line and Verizon proposes to extend the wall down the side and rearproperty lines to help buffer the facility from the adjacent residential uses. This will help tomitigate potential adjacency issues between the land uses. Also, the addition of landscape infront of the enclosure and along the eastern boundary will provide a buffer as well.

General Plan Analysis:

The City's General Plan requires that wireless facilities be minimally visible by utilizingcamouflage and screening techniques to help blend the facility into the surrounding area. It alsorequires that wireless facilities be aesthetically pleasing and visually respectful and compatiblewith the community. The antennas associated with this facility will be completely concealedwithin the architectural tower. The existing equipment enclosure will remain as is, however,

planter walls and additional landscape material will be added to help screen and integrate theenclosure into the setting. The design of the tower is reminiscent of the architecture ofUSD, alandmark within Linda Vista, but the colors will be similar to that ofthe buildings in theimmediate vicinity. The tower will be the tallest structure in this part of Linda Vista, but itslocation at the main intersection in the community could be considered a gateway to thecommunity and therefore function as a community landmark. Based on the project's design, it iscompatible with the City's General Plan. The Linda Vista Community Plan does not discusswireless communication facilities.

Conclusion:

Staff supports the project as proposed. The replacement of a monopole with a project thatcomplies with the WCF regulations and the intent of the General Plan is always beneficial to thecommunity in which it is located as well as to the City. The new tower, although tall, will bedesigned in the architectural style ofbuildings on the USD campus, which Linda Vista is knownfor. Because the property is located at a major intersection that could be considered a gateway tothe community, opportunities existed to turn the monopole into a landmark. Verizon with thehelp of a group of interested planning group members was able to come to agreement on a designthat would promote the usn inspiration. With this design, Verizon will be able to maintain theheight of their facility and in exchange, the community will get an architectural landmark inplace of a significant visual impact. In addition to the landscape being added in and around thenew tower and walls, Verizon is also proposing to add landscape along the parkway to helpimprove views from the street.

Verizon is proposing to continue the 7-foot concrete wall currently on a portion of the easternproperty line down the remainder of that part ofthe property as well as along the rear propertyline to help buffer their equipment and tower base from the adjacent properties. They are alsoadding accent landscape material as well as landscape screening to help with views from adjacentstreets and properties. The tower will completely conceal Verizon and AT&T antennas as wellas AT&T equipment and the opportunity for T-Mobile to relocate within the tower is alsoavailable (T-Mobile's CUP expires in the next year or so). The resulting project will not onlyenhance the Padre Gold property, but will also improve aesthetics at this intersection, which actsas a gateway to the Linda Vista community.

This project complies with the Communication Antenna regulations, Council Policy 600-43 andthe General Plan. The encroachment into the setbacks and the increased height of the facility arebeing offset by the improvements Verizon is proposing along the eastern and rear property linesas well as along the street. Therefore, Staff recommends approval of this project.

WHEREAS, American Legion Post 731 Department of California, Permittee and Verizon Wireless,Owner, filed an application with the City of San Diego for a permit for a wireless communication facility(as described in and by reference to the approved Exhibits "A" and corresponding conditions of approvalfor the associated Permit No.'s 590322 and 318510, on portions of a .55 acre site;

WHEREAS, the project site is located at 7245 Linda Vista Road in the CC-1-3 zone ofthe Linda VistaCommunity Planning area;

WHEREAS, the project site is legally described as Lot 9, Block 35, Linda Vista Subdivision Unit No.8,in the City of San Diego, County of San Diego, State of California, according to map thereof No. 3253,filed in the Office of the Recorder of said San Diego County, June 23, 1955;

WHEREAS, on March 4,2010, the Planning Commission of the City of San Diego considered CUP No.590322 and PDP No. 318510 pursuant to the Land Development Code of the City ofSan Diego;

WHEREAS, on April 3, 2006 the City of San Diego, as Lead Agency, through the Development ServicesDepartment, made and issued an Environmental Determination that the project is exempt from theCalifornia Environmental Quality Act (CEQA) (Public Resources Code section 21000 et. seq.) underCEQA Guideline Section 15302; and there was no appeal of the Environmental Determination filedwithin the time period provided by San Diego Municipal Code Section 112.0520;

BE IT RESOLVED by the Planning Commission of the City of San Diego as follows:

That the Planning Commission adopts the following written Findings, dated March 4, 2010.

FINDINGS:

Conditional Use Permit - Section 126.0305

1. The proposed development will not adversely affect the applicable land useplan;

Section A.15 of the Urban Design section of the City of San Diego's General Plan addressesWireless Facilities. The intent is to minimize the visual impact of wireless facilities. The GeneralPlan states that wireless facilities should be concealed in existing structures when possible, orotherwise use camouflage and screening techniques to hide or blend the facilities into the surroundingarea. In this particular case, the existing monopole will be replaced with an architectural tower thatwill conceal all Verizon's and AT&T's antennas, as well as AT&T's equipment. The tower wilt bevery visible, however, because of its design and its location near a major intersection in the

community, the architectural tower will act as a community landmark. This meets the intent of theCity's General Plan and the WCF regulations.

The General Plan also states that facilities should be designed to be "aesthetically pleasing andrespectful to the neighborhood context." The architectural tower will be designed reminiscent of thearchitectural style ofthe buildings at USD, which happens to be a landmark in Linda Vista. Thetower will be highly visible to the surrounding community and as must be aesthetically pleasing. Theaddition ofplanter walls and landscape near the tower and also along the street will help to enhanceviews of the facility. All of the antennas and new equipment will be concealed within the tower. Asa result, the design of this WCF will respect the neighborhood context.

The Linda Vista Community Plan does not address WCF as a specific land use. Based on theproject's design, the facility will comply with the City of San Diego's General Plan as it relates toWireless Facilities, and this project would not adversely affect the land use plan.

2. The proposed development will not be detrimental to the public health,safety, and welfare;

The Telecommunication Act of 1996 preempts local governments from regulating the"placement, construction and modification of wireless communication facilities on the basis oftheenvironmental effects of Radio Frequency (RF) emissions to the extent that such facilities complywith the Federal Communication Commission's (FCC) standards for such emissions." The proposedproject would be consistent with the FCC's regulations for wireless facilities. To insure that the FCCstandards are being met, a condition has been added to the permit that requires Verizon Wireless tosubmit an RF study to demonstrate compliance with the applicable FCC regulations prior to buildingpermit issuance. Therefore, based on the above, the project would not result in any significant healthor safety risks to the surrounding area within matters of the City's jurisdiction.

3. The proposed development will comply to the maximum extent feasible withthe regulations of the Land Development Code; and

The original project was a 76-foot high monopole with a 360-square foot equipmentenclosure. The monopole is 31- feet over the maximum height of 45-feet and both the monopoleand equipment enclosure encroach into the side and rear yard setback. The original approvaloccurred under the previous Municipal Code where deviations were analyzed and approved underthe auspices of the CUP. Since the time of the original approval, the Land Development Codehas been adopted, the zone and development regulations have changed on this property and WCFregulations and policies have been adopted. This monopole is considered to be a secondgeneration tower where the design technology had not quite been developed at the time, but thenetwork was more diverse so the tower did not have to be as tall as the first generationmonopoles. As an anchor in Verizon's system, this WCF plays an important role in the overallnetwork and because it is over the height limit, the new design will serve as a landmark to theLinda Vista community. Extending the 7-foot concrete wall from the eastern property line andaround to the rear will help buffer the proximity of the tower and the equipment. The tower willserve as a collocation facility for AT&T and possibly T-Mobile.

The new tower and associated component will comply with the City of San DiegoCommunication Antenna Regulations (Land Development Code Section 141.0405). This section

ofthe code requires architectural integration and/or enhancements with the existing buildings orlandscape on the property. Therefore, the project complies to the maximum extent possible withthe applicable regulations of the Land Development Code, while continuing uninterruptedcoverage and service to the Linda Vista community. Based on these considerations, this projectcomplies with the applicable regulations of the Land Development Code.

4. The proposed use is appropriate at the proposed location.

This project will replace an existing wireless communication facility permitted in 1995under previous San Diego Municipal Code regulations. There were no regulations or adoptedguidelines specific to wireless communication facilities at that time. The project was processed asa Conditional Use Permit and was approved by the Planning Commission with a conditionallowing the facility to operate for a period of ten years.

New regulations and policies have been in effect for the last eight years which guide thelocation and aesthetics of these types of facilities. A wireless communication facility proposed ina commercial area is preferred and in this case, the facility has operated for the past 15 years withno complaints from the adjacent properties. Verizon is proposing to replace the monopole withan architectural tower that will serve as a community landmark. A 7-foot high concrete wall willbe extended down the eastern property line and wrap around to the rear and planter walls andadditional landscape will be added to enhance the property and views of the facility. The projectsite is located at a major intersection in Linda Vista on a commercial property and will be highlyvisible to the surrounding Linda Vista community, lending itself as a community landmark.

Planned Development Permit - Section 126.0604

A. Findings for all Planned Development Permits

The Linda Vista Community Plan does not address WCF as a specific land use. Based on theproject's design, the facility will comply with the City of San Diego's General Plan as it relates toWireless Facilities, and this project would not adversely affect the land use plan.

2. The proposed development will not be detrimental to the public health, safety, andwelfare;

The Telecommunication Act of 1996 preempts local governments from regulating the"placement, construction and modification ofwireless communication facilities on the basis of theenvironmental effects of Radio Frequency (RF) emissions to the extent that such facilities complywith the Federal Communication Commission's (FCC) standards for such emissions." The proposedproject would be consistent with the FCC's regulations for wireless facilities. To insure that the FCCstandards are being met, a condition has been added to the permit that requires Verizon Wireless tosubmit an RF study to demonstrate compliance with the applicable FCC regulations prior to buildingpermit issuance. Therefore, based on the above, the project would not result in any significant healthor safety risks to the surrounding area within matters of the City's jurisdiction.

3. The proposed development will comply with the regulations of the Land DevelopmentCode;

The original project was a 76-foot high monopole with a 360-square foot equipmentenclosure. The monopole is 3l-feet over the maximum height of 45-feet and both the monopoleand equipment enclosure encroach into the side and rear yard setback. The original approvaloccurred under the previous Municipal Code where deviations were analyzed and approved underthe auspices of the CUP. Since the time of the original approval, the Land Development Codehas been adopted, the zone and development regulations have changed on this property and WCFregulations and policies have been adopted. This monopole is considered to be a secondgeneration tower where the design technology had not quite been developed at the time, but thenetwork was more diverse so the tower did not have to be as tall as the first generationmonopoles. As an anchor in Verizon's system, this WCF plays an important role in the overallnetwork and because it is over the height limit, the new design will serve as a landmark to theLinda Vista community. Extending the 7-foot concrete wall from the eastern property line andaround to the rear will help buffer the proximity of the tower and the equipment. The tower willserve as a collocation facility for AT&T and possibly T-Mobile.

The new tower and associated component will comply with the City of San DiegoCommunication Antenna Regulations (Land Development Code Section 14L0405). This sectionof the code requires architectural integration and/or enhancements with the existing buildings orlandscape on the property. Therefore, the project complies to the maximum extent possible withthe applicable regulations of the Land Development Code, while continuing uninterruptedcoverage and service to the Linda Vista community. Based on these considerations, this projectcomplies with the applicable regulations of the Land Development Code.

4. The proposed development, when considered as a whole, will be beneficial to thecommunity; and

This project will be beneficial to the community by continuing to provide service to Linda Vistaand commuters passing through the community. The facility provides wireless communicationservices including e911 for users of cell phones and other devices. The facility will now providethese wireless services in a way that is integrated with the community. Therefore, this project willbe beneficial to the community.

5. Any proposed deviations pursuant to Section 126.0602(b)(1) are appropriate for thislocation and will result in a more desirable project than would be achieved if designed instrict conformance with the development regulations of the applicable zone.

This project replaces an existing 76-foot high monopole with a 76-foot high architecturaltower. The CC-I-3 zone has a height limit of 45-feet, but the new architectural tower willmaintain the 76-foot height. The location of the tower. which is set back from Genesee Avenueand Linda Vista Road, is conducive to an architectural tower that will lend itself as a communitylandmark. The tower designs were developed based on input from a community planning groupad hoc subcommittee. The design picks up on the surrounding architecture in the immediate areaand has slight hints of similarities to architecture used at USD. Additional landscaping, planterwalls and landscape will help to soften views of the tower and actual create a focal point for thecommunity. Additionally, Verizon is providing space for AT&T to locate their antennas andequipment within the tower negating the need for a WCF at Kearny Mesa Park, which thecommunity group had indicated at one time that they were opposed to. There is also room for theT-Mobile facility to be relocated within the tower once the CUP for their flag pole on the sameproperty expires.

The new tower will be set back from the rear property line approximately 9-feet, where theexisting monopole is located approximately I-foot away from the rear property line. The existingequipment enclosure is 6-feet away from the property line and the existing generator is right at therear property line. The required setback is 14-feet. A new 7-foot concrete wall is proposed alongthe rear property line, which will help to buffer the WCF from residential properties to the south.The generator is being relocated to the front of the equipment enclosure in a new split face blockenclosure with planter walls and landscape. On the eastern side of the property, the required sideyard setback is 19-feet. The existing equipment enclosure is located 10-feet away from theproperty line and the new generator enclosure will be aligned with the equipment enclosure. Theexisting 7-foot concrete fence that was installed by the developer of the new condominiumcomplex on the east will be extended by Verizon to provide a buffer between the land uses.

Therefore, the project with deviations results in a project that will continue wirelesscoverage in the community and provide a community landmark with improvements that willenhance this major intersection within the community.

The project shall include:

a. Demolition and removal of an existing 76-foot high monopole and replacement with a 76­foot high architectural tower housing Verizon antennas, AT&T antennas and AT&Tequipment. Space for T-Mobile antennas is available for future collocation within thetower. The tower will exceed the maximum height limit of45 feet by 31 feet;

b. Associated equipment for Verizon located in existing 360 square foot enclosure and a 158square foot enclosure for the existing generator. Both enclosures will encroach into therequired rear yard setback of 14-feet or the eastern side yard setback of 19-feet;

c. Landscaping and associated planter walls (planting, irrigation and landscape relatedimprovements);

Public and private accessory improvements determined by the Development ServicesDepartment to be consistent with the land use and development standards for this site inaccordance with the adopted community plan, the California Environmental Quality Act[CEQA1and the CEQA Guidelines, the City Engineer's requirements, zoning regulations,conditions of this Permit, and any other applicable regulations of the SDMC.

STANDARD REQUIREMENTS:

1. As this property contains a WCF with an expired permit, upon approval ofthis CUP/PDP,immediate steps must he taken to bring this site into compliance. A timeline has beenestablished to ensure that construction documents are submitted in a timely manner and theexisting facility is removed and new facility installed no later than 10 months from CUPfPDPapproval.

2. This Conditional Use Permit (CUP) and corresponding use ofthis site shall expire onMarch 4, 2020. Upon expiration ofthis Permit, the facilities and improvements describedherein shall be removed from this site and the property shall be restored to its original conditionpreceding approval of this Permit unless the applicant ofrecord files a new application for afacility which will be subject to compliance with all regulations in effect at the time.

3. No later than ninety (90) days prior to the expiration of this permit, the OwnerfPennitteemay submit a new application to the City Manager for consideration with review and a decisionby the appropriate decision maker at that time. Failure to submit prior to the deadline will because for compliance, which may include penalties and fines.

4. Under no circumstances, does approval of this permit authorize (insert applicant name) ortheir tenants to utilize this site for wireless communication purposes beyond the permitexpiration date. hnplicit use of this permit beyond the effective date of this permit is prohibited.

5. No permit for the construction, occupancy, or operation of any facility or improvementdescribed herein shall be granted, nor shall any activity authorized by this Permit be conductedon the premises until:

a. The OwnerlPennittee signs and returns the Permit to the Development ServicesDepartment; and

b. The Permit is recorded in the Office of the San Diego County Recorder.

6. While this Permit is in effect, the subject property shall be used only for the purposes andunder the terms and conditions set forth in this Permit unless otherwise authorized by theappropriate City decision maker.

7. This Permit is a covenant running with the subject property and all of the requirements andconditions of this Permit and related documents shall be binding upon the OwnerlPennittee andany successor(s) in interest.

8. The continued use of this Permit shall be subject to the regulations of this and any otherapplicable governmental agency.

9. Issuance of this Permit by the City of San Diego does not authorize the Owner/Permitteefor this Permit to violate any Federal, State or City laws, ordinances, regulations or policiesincluding, but not limited to, the Endangered Species Act of1973 [ESA] and any amendmentsthereto (16 U.S.C. § 1531 et seq.).

10. The Owner/Permittee shall secure all necessary building permits. The Owner/Permittee isinformed that to secure these permits, substantial building modifications and site improvementsmay be required to comply with applicable building, fire, mechanical, and plumbing codes, andState and Federal disability access laws.

11. Construction plans shall be in substantial conformity to Exhibit "A." Changes,modifications, or alterations to the construction plans are prohibited unless appropriateapplication(s) or amendment(s) to this Permit have been granted.

12. All of the conditions contained in this Permit have been considered and were determined­necessary to make the findings required for approval of this Permit. The Permit holder isrequired to comply with each and every condition in order to maintain the entitlements that aregranted by this Permit.

If any condition of this Permit, on a legal challenge by the Owner/Permittee of this Permit, isfound or held by a court of competent jurisdiction to be invalid, unenforceable, or unreasonable,this Permit shall be void. However, in such an event, the OwnerlPermittee shall have the right,by paying applicable processing fees, to bring a request for a new permit without the "invalid"conditions(s) back to the discretionary body which approved the Permit for a determination bythat body as to whether all of the findings necessary for the issuance of the proposed permit canstill be made in the absence ofthe "invalid" condition(s). Such hearing shall be a hearing denovo, and the discretionary body shall have the absolute right to approve, disapprove, or modifythe proposed permit and the condition(s) contained therein.

13. The OwnerlPennittee shall defend, indemnify, and hold harmless the City, its agents,officers, and employees from any and all claims, actions, proceedings, damages, judgments, orcosts, including attorney's fees, against the City or its agents, officers, or employees, relating tothe issuance of this permit including, but not limited to, any action to attack, set aside, void,challenge, or annul this development approval and any environmental document or decision.The City will promptly notify Owner/Permittee of any claim, action, or proceeding and, if theCity should fail to cooperate fully in the defense, the Owner/Permittee shall not thereafter beresponsible to defend, indemnify, and hold harmless the City or its agents, officers, andemployees. The City may elect to conduct its own defense, participate in its own defense, orobtain independent legal counsel in defense of any claim related to this indemnification. In the

event of such election, Owner/Permittee shall pay all of the costs related thereto, includingwithout limitation reasonable attorney's fees and costs. In the event of a disagreement betweenthe City and Owner/Permittee regarding litigation issues, the City shall have the authority tocontrol the litigation and make litigation related decisions, including, but not limited to,settlement or other disposition of the matter. However, the Owner/Permittee shall not be requiredto payor perform any settlement unless such settlement is approved by Owner/Permittee.

ENGINEERING REQUIREMENTS:

14. Prior to the issuance of any construction permit, the Owner/Permittee shall incorporate anyconstruction Best Management Practices necessary to comply with Chapter 14, Article 2,Division 1 (Grading Regulations) ofthe San Diego Municipal Code, into the construction plansor specifications.

15. Prior to the issuance of any construction permit, the Owner/Permittee shall submit a WaterPollution Control Plan (WPCP). The WPCP shall be prepared in accordance with the guidelinesin Appendix E of the City's Storm Water Standards.

LANDSCAPE REQUIREMENTS:

16. In the event that the Landscape Plan and the Site Plan conflict, the Site Plan shall berevised to be consistent with the Landscape Plan such that landscape areas are consistent with theExhibit 'A' Landscape Development Plan.

11. Prior to issuance of any construction permits for buildings complete landscape andirrigation construction documents consistent with the Land Development Manual: LandscapeStandards shall be submitted to the Development Services Department for approval. Theconstruction documents shall be in substantial conformance with Exhibit 'A,' LandscapeDevelopment Plan, on file in the Office of the Development Services Department. Constructionplans shall take into account a 40 square foot area around each tree which is unencumbered byhardscape and utilities as set forth under LDC 142.0403(b)5.

18. Prior to activation of wireless facility, it shall be the responsibility of the Owner/Permitteeto install all required landscape and obtain all required landscape inspections. A "No Fee" StreetTree Permit shall be obtained for the installation, establishment, and on-going maintenance of allstreet trees.

19. All required landscape shall be maintained in a disease, weed and litter free condition at alltimes. Severe pruning or "topping" of trees is not permitted. The trees shall be maintained in asafe manner to allow each tree to grow to its mature height and spread.

20. Any required planting that dies within 3 years of installation shall be replaced within 30calendar days of plant death with the same size and species ofplant material shown on theapproved plan. Required shrubs or trees that die 3 years or more after installation shall bereplaced with 15 gallon size or 60-inch box size material, respectively. Development Servicesmay authorize adjustment of the size and quantity of replacement material where material

replacement would occur in inaccessible areas or where the existing plant being replaced islarger than a 15 gallon shrub or 60-inch box tree.

PLANNINGIDESIGN REQUIREMENTS:

21. A topographical survey conforming to the provisions of the SDMC may be required if it isdetermined, during construction, that there may be a conflict between the building(s) underconstruction and a condition of this Permit or a regulation of the underlying zone. The cost ofany such survey shall be borne by the Owner/Permittee.

22. The applicant of record is responsible for notifying the city prior to the sale or takeover ofthis site to any other provider.

23. "Dog house" structures are not permitted. Cables shall be routed underground andinternally within the monoeucalyptus.

24. This wireless communication facility shall be removed or replaced if it is determined thatthe facility or components of the facility are obsolete.

25. Prior to the issuance of a construction permit, the telecommunication provider shall providecertification describing evidence that the cumulative field measurements of radio frequencypower densities for all antennas installed on the premises are below the federal standards.

26. All equipment, including transformers, emergency generators and air conditioners shall bedesigned and operated consistent with the City noise ordinance. Ventilation openings shall bebaffled and directed away from residential areas. Vibration resonance of operating equipment inthe equipment enclosures shall be eliminated.

27. Prior to obtaining a Construction Permit the following items must be illustrated on theconstruction drawings; coax cable tray, meters, telco, Ale units, generator receptacles, cableruns, bridges, dog houses and external ports. These appurtenances must be minimized visuallyso as to avoid the effect of changing the outward appearance of the project from what wasapproved on the exhibits.

28. All private outdoor lighting shall be shaded and adjusted to fall on the same premiseswhere such lights are located and in accordance with the applicable regulations in the SOMe.

29. The stamped, approved photo simulations (part of Exhibit "A") shall be printed in color onthe construction document plan set.

30. Within 90 days of CUP/PDP approval, construction documents shall be submitted to theDevelopment Services Department for the implementation of this permit, including the removalof the existing monopole and the installation of the architectural tower and associated landscapeimprovements.

31. Within ten months ofCUPIPDP approval, final planning and building inspection sign-offshall be obtained. Failure to comply with this timeline shall result in fines and penaltiesadministered by the Neighborhood Code Compliance section of the Development ServicesDepartment.

32. As part of the building permit approval, the Permittee may apply for a Temporary UsePermit to allow for a temporary antenna installation while construction is in progress for the newfacility. The temporary antenna installation shall not be permitted to remain in place longer than180 days from CUPIPDP approval. The temporary antenna instaIlation will be subject to reviewand approval by the Development Services Department, may require a bnilding permit, and shallcomply at all times with FCC regulations.

PLANNING COMMISSION

This Conditional Use Permit is granted by the Planning Commissionof the City of San Diego to American Legion Linda Vista Post 731,Owner, AIRTOUCH, Permittee, pursuant to Section 101.0510 of theMunicipal Code of the city of San Diego.

1. Subject to the terms and conditions set forth in thispermit, permission is granted to owner/Permittee to construct a390-square-foot unmanned cellular communication facility at 7245Linda Vista Road located at the intersection of Linda Vista Roadand Genesee Avenue, also described as Lot 9, Block 35, LindaVista Subdivision, Map No. 3253 in the City of San Diego, Countyof San Diego, State of California, in the CA Zone.

2. The facility shall consist of the following:

a. A 390-square-foot equipment building and a 75-foot-highmonopole (90 feet high inclUding 30 panels, 6 Whips andup to 4 digital dish antennas);

b. A six-foot-high chainlink fence surrounding the1,100-square-foot lease area;

c. Off-street parking to be located outside the fence inthe existing parking lot;

d. Additional street trees as identified onExhibit "A"; and

e. Accessory uses as may be determined incidental andapproved by the Planning Commission.

3. One parking space shall be provided in the existing parkinglot of the American Legion facility.

4. No permit for construction of any facility shall be grantednor shall any activity authorized by this permit be conducted onthe premises until:

a. The Permittee signs and returns the permit to theDevelopment Services Department, DEP Division;

b. The Conditional Use Permit is recorded by theDevelopment Services Department in the office of theCounty Recorder.

5. Before issuance of any building permits, complete gradingand building plans shall be submitted to the Development ServicesDirector for approval. Plans shall be in substantial conformanceto Exhibit "A," dated September 28, 1995, on file in the officeof the Development Services Department, DEP Division. No change,modifications or alterations shall be made unless substantialconformance review Dr amendment of this permit shall havebeen granted.

6. Prior to the issuance of any building permits, theapplicant shall:

a. Ensure that building address numbers are visible andlegible from the street (UFC 10.208).

b. Show the location of all fire hydrants on the plot plan(UFC 10.301).

7. Before issuance of any grading or building permits, acomplete landscape plan, including a temporary irrigation system,shall be submitted to the Development Services Director forapproval •. The plans shall be in substantial oonformance toExhibit "A," dated September 28, 1995, on file in the office ofthe Development Services Department. Approved planting shall beinstalled before issuance of any occupancy permit on anybuilding. Such planting shall not be modified or altered unlessthis permit has been amended and is to be maintained in adisease-, weed- and litter-free condition at all times.

8. The trees shall be permanently irrigated in accordance withthe city of San Diego Landscape Technical Manual.

9. Prior to the issuance of any building permits, the applicantshall assure by permit and bond the installation of a five-footwide sidewalk, with minimum four-foot width around obstructionsand 4:1 transitions, adjacent to this site on Linda Vista Roadand Genesee Avenue in a manner satisfactory to the City Engineer.

10. Prior to the issuance of any building permits, the applicantshall obtain an Encroachment Removal Agreement from the cityEngineer for the proposed landscaping to be located within thepUblic right-of-way.

11. This Conditional Use Permit must be used within 36 monthsafter the date of City approval or the permit shall be void.An Extension of Time may be granted as set forth insection 111.1122 of the Municipal Code. Any extension of timeshall be SUbject to all standards and criteria in effect at thetime the extension is applied for.

12. Construction and operation of the approved use shall complyat all times with the regulations of this or any othergovernmental agencies.

13. This Conditional Use Permit is granted for a period of ten(10) years from September 28, 1995, at which time it will becomenull and void unless a new application for a Conditional UsePermit is applied for an approved under the procedures in effectat that time. At such time as the Conditional Use Permit expiresor ceases to be utilized, all antennas and equipment will beremoved from the site by the last operator of the use.

14. The applicant/lessee shall have the option to SUblease aportion of the monopole for the purpose of co-location of acellular communications facility. Plan submittal and review ofthe co-location option shall be made available through theSubstantial Conformance Review Process, of the Development andEnvironmental Planning Division. The purpose and intent ingranting this option is to reduce the need for additionalmonopole facilities within the surrounding community.

15. This Conditional Use Permit may be revoked by the city ifthere is a material breach or default in any of the conditions ofthis permit.

16. This Conditional Use Permit is a covenant running with theSUbject property and shall be binding upon the Permittee and anysuccessor or successors, and the interests of any successor shallbe SUbject to each and every condition set out in this permit andall referenced documents.

17. All of the conditions contained in this Permit have beenconsidered and have been determined to be necessary in order tomake the findings required for this discretionary permit. It isthe intent of the city that the holder of this permit be required

to comply with each and every condition in order to be affordedspecial rights which the holder of the Permit is obtaining as aresult of this permit. It is the intent of the City that theowner of the property which is the sUbject of this permit eitherutilize the property for any use allowed under the zoning andother restrictions which apply to the property or, in thealternative, that the owner of the property be allowed thespecial and extraordinary rights conveyed by this permit,but only if the owner complies with all the conditions ofthis permit.

In the event that any condition of this permit, on a legalchallenge gy the Owner/Permittee of this permit, is found or heldby a court of competent jurisdiction to be invalid, unenforceableor unreasonable, this permit shall be void. However, in suchevent, the owner/Permittee shall have the right, by payingapplicable processing fees, to bring a request for a new permitwithout the "invalid" condition back to the discretionary bodywhich approved the permit for a determination by that body as toWhether all of the findings necessary for the issuance of thepermit can still be made in the absence of the "invalid"condition(s). such hearing shall be a hearing de novo and thediscretionary body shall have the absolute right to approve,disapprove or modify the proposed permit and the condition(s)contained therein.

18. The issuance of this permit by the city of San Diego doesnot authorize the applicant for said permit to violate anyFederal, state or City laws, ordinances, regulations or policiesinclUding, but not limited to, the Federal Endangered Species Actof 1973 and any amendments thereto (16 U.S.C. Section 1531et seq.).

The project site is designated for CA (Area Shoppingcenter) by the General Plan and the Linda Vistacommunity Plan. Nevertheless, particular uses Whichfulfill individual and community needs are permitted inresidential and other zones by conditional use permit.This project will not adversely impact the General Plannor the Linda Vista community Plan. street trees andneutral colors on exterior surfaces will effectivelyscreen the facility and allow the fence, equipmentbuilding to blend with surrounding vistas.

B. THE PROPOSED USE, BBCAUSE OF CONDITIONS THAT HAVE BEENAPPLIED TO IT, WILL NOT BE DETRIMENTAL TO THE HEALTH,SAFETY AND GENERAL WELFARE OF PERSONS RESIDING ORWORKING IN THE AREA AND WILL NOT ADVERSELY AFFECT OTHERPROPERTX IN THE VICINITY.

Radio frequency energy transmission from the proposedantenna system would not result in significant healthand safety risks to the surrounding area. Thetransmissions would have a maximum of 5.8 microwattsper square centimeter, well below the acceptedsafety standard of 580 microwatts per square

San Diego Municipal Code Chapter 14: General Regulations(12-2001)

§141.0405 Communication Antennas

(a) Section ]41.0405 regulates the following communication antennas. Amateur(HAM) radio facilities or temporary telecommunication facilities necessitatedby natural or man-made disasters are not regulated as communicationantennas. Section 141.0405 does not apply to single dish antennas smallerthan 24 inches in diameter or to remote panel antennas less than 24 inches inlength and in width, except when associated with another telecommunicationfacility.

(1) Minor telecommunication facilities: Antenna facilities used in wirelesstelephone services, paging systems, or similar services that complywith all development regulations of the underlying zone and overlay(s)and that meet the criteria in Section 141.0405(e)(l) or (2).

(2) Major telecommunication facilities: Antenna facilities that do notmeet the criteria for minor telecommunication facilities in Section141.0405(e)(I) or (2).

(3) Satellite antennas: Antennas capable of transmitting or receivingsignals to or from a transmitter or a transmitter relay located in aplanetary orbit. Satellite antermas include satellite earth stations,television-reception-only satellite antennas, and satellite microwaveantermas.

(b) General Rules for Telecommunication FacilitiesAll telecommunication facilities must comply with the followingrequirements:

(1) All approved telecommunication facilities must comply with theFederal standards for RF radiation in accordance with theTelecommunication Act of 1996 or any subsequent amendment to theAct pertaining to RF radiation. Documentation shall be submitted tothe City providing evidence that the cumulative field measurements ofradiofrequency power densities for all antennas installed on thepremises are below the Federal standards.

(2) Except in the event of an emergency, routine maintenance andinspection of telecommunication facilities located on residentiallyzoned premises, including all of the system components, shall occurduring normal business hours between 8:00 a.m. and 5:00 p.m.Monday through Friday.

(3) Antenna facilities or associated equipment proposed for installation inthe public right-of-way are subject to the following regulations:

(A) Antennas or associated equipment located in public right-ofwaywhich is adjacent to a residentially zoned premises may bepermitted with a Neighborhood Use Permit.

(B) Antennas and associated equipment located in the public right-of­way adjacent to non-residentially zoned premises are subjectto review and approval by the City Manager.

(C) All equipment associated with antenna facilities shall beundergrounded, except for small services connection boxes oras permitted in Section l41.0405(b)(4).

(D) A construction plan must be submitted to and is subject toreview and approval by the City Engineer in accordance withChapter 6, Article 2.

(4) Antennas and associated equipment located in the public right-of-waymay be placed above ground only if the equipment is integrated intothe architecture or surrounding environment through architecturalenhancement (enhancements that complement the scale, texture, color,and style), unique design solutions, enhanced landscape architecture,or complementary siting solutions to minimize visual or pedestrianimpacts. These facilities may be permitted with a Conditional UsePermit decided in accordance with Process Three.

(c) Temporary facilities that provide services to public events and are limited to aone-time maximum duration of 90 calendar days are subject to the temporaryuse permit procedures in Chapter 12, Article 3, Division 4.

(d) All telecommunication facilities that are reqnired to obtain encroachmentauthorization to locate on city-owned dedicated or designated parkland oropen space areas shall comply with the following:

(I) The City Manager shall determine that the proposed facility would notbe detrimental to the City's property interest; would not preclude otherappropriate uses; would not change or interfere with the use orpurpose of the parkland or open space; and would not violate any deedrestrictions related to City property, map requirements or other landuse regulations.

(2) The proposed facility shall be integrated with existing park facilities oropen space; shall not disturb the environmental integrity of theparkland or open space; and shall be disguised such that it does not

detract from the recreational or natural character of the parkland oropen space.

(3) The proposed facility shall be consistent with The City ofSan DiegoProgress Guide and General Plan.

(e) Minor Telecommunication Facilities

Minor telecommunication facilities are permitted as a limited use Ormay bepermitted with a Neighborhood Use Permit in the zones indicated with an "L"or an "N", respectively, in the Use Regulations Tables in Chapter 13, Article I(Base Zones) subject to the following regulations.

(l) An antenna facility will be considered a minor telecommunicationfacility ifthe facility, including equipment and structures, is concealedfrom public view or integrated into the architecture or surroundingenvironment through architectural enhancement (enhancements thatcomplement the scale, texture, color, and style), unique designsolutions, or accessory use structures.

(2) In an effort to encourage collocation and to recognize that sometelecommunication facilities are minimally visible, the following shallbe considered minor telecommunication facilities:

(A) Additions or modifications to telecommunication facilities thatdo not increase the area occupied by the antennas or theexisting antenna enclosure by more than 100 percent of theoriginally approved facility and do not increase the areaoccupied by an outdoor equipment unit more than 150 feetbeyond the originally approved facility, if the additions andmodifications are designed to minimize visibility.

(B) Panel-shaped antennas that are flush-mounted to an existingbuildingfacade on at least one edge, extend a maximum of 18inches from the buildingfacade at any edge, do not exceed theheight of the building, and are designed to blend with the colorand texture of the existing building.

(C) Whip antennas if the number of antennas that are visible fromthe public right-of-way does not exceed six, if the antennasmeasure 4 inches or less in diameter, and if they have amounting apparatus that is concealed from public view.

(3) Minor telecommunication facilities are not permitted in the followinglocations:

(A) On premises that are developed with residential uses inresidential zones;

(B) On vacant premises zoned for residential development;

(C) On premises that have been designated as historical resources;

(D) On premises that have been designated or mapped ascontaining sensitive resources;

(E) On premises within the MHPA; or

(F) On premises that are leased for billboard use.

(4) The installation of a minor telecommunication facility shall not resultin the elimination of required parkiug spaces.

(5) Minor telecommunication facilities that terminate operation shall beremoved by the operator within 90 calendar days of termination.

(f) Major Telecommunication Facilities

Major telecommunication facilities may be permitted with a Conditional UsePermit decided in accordance with Process Three, except that majortelecommunication facilities on dedicated or designated parkland and openspace may be permitted with a Conditional Use Permit decided in accordancewith Process Five, in the zones indicated with a "C" in the Use RegulationsTables in Chapter 13, Article I (Base Zones) subject to the followingregulations.

(I) Major telecommunication facilities are not permitted in the followinglocations:

(A) On premises containing designated historical resources;

(B) Within viewsheds of designated and recommended StateScenic Highways and City Scenic Routes; or

(C) Within Y, mile of another major telecommunication facility,unless the proposed facility will be concealed from public viewor integrated into the architecture or surrounding environmentthrough architectural enhancement (enhancements thatcomplement the scale, texture, color, and style), unique designsolutions, and accessory use structures.

(D) Within the Coastal Overlay Zone, on premises within the

MHPA and/or containing steep hillsides with sensitivebiological resources, or within pubic view corridors or viewsheds identified in applicable land use plans.

(2) Major telecommunication facilities shall be designed to be minimallyvisible through the use of architecture, landscape architecture, andsiting solutions.

(3) Major telecommunication facilities shall use the smallest and leastvisually intrusive antennas and components that meet the requirementsof the facility.

(g) Satellite Antennas

Satellite antennas are permitted as a limited use subject to Section141.0405(g)(2), and may be permitted with a Neighborhood Use Permitsubject to Section l41.0405(g)(3), or with a Conditional Use Permit decidedin accordance with Process Three subject to Section ]4] .0405(g)(4).

(1) Exemption. Satellite antennas that are 5 feet in diameter or smaller arepermitted in all zones and are exempt from this section.

(2) Limited Use Regulations. Satellite antennas that exceed 5 feet indiameter are permitted as a limited use in the zones indicated with an"L" in the Use Regulations Tables in Chapter 13, Article I (BaseZones) subject to the following regulations.

(A) Satellite antennas are not permitted within the MHPA.

(B) Satellite antennas are not permitted on premises that have beendesignated as historical resources.

(C) Satellite antennas shall not exceed 10 feet in diameter.

(D) Ground-mounted satellite antennas shall not exceed 15 feet instructure height.

(E) Ground-mounted satellite antennas shall not be located in thestreet yard, front yard, or street side yard of a premises.

(F) Satellite antennas shall not be light-reflective.

(G) Satellite antennas shall not have any sign copy on them norshall they be illuminated.

(H) Ground-, roof-, and pole-mounted satellite antennas shall be

screened by fencing, buildings, or parapets that appear to be anintegral part of the building, or by landscaping so that not morethan 25 percent of the antenna height is visible from the gradelevel of adjacent premises and adjacent public rights-of-way.

(3) Neighborhood Use Permit Regulations. Proposed satellite antennasthat do not comply with Section l41.0405(b)(2) may be permitted witha Neighborhood Use Permit subject to the following regulations.

(A) Satellite antennas are not permitted within the MHPA.

(B) Satellite antennas are not permitted on premises that have beendesignated as historical resources.

(C) Satellite antennas shall not exceed 10 feet in diameter.

(D) Satellite antennas shall not be light-reflective.

(E) Satellite antennas shall not have allY sign copy on them norshall they be illuminated.

(F) The visual impacts of the antenna to adjacent premises andadjacent public rights-of-way shall be minimized by thepositioning of the antenna on the site and the use of landscapeor other screening.

(4) Conditional Use Permit Regulations. Except for proposed satelliteantennas which are accessory uses in industrial zones, proposedsatellite antennas that exceed 10 feet in diameter may be permittedonly with a Conditional Use Permit decided in accordance withProcess Three subject to the following regulations.

(A) Satellite antennas are not permitted within the MHPA.

(B) Satellite antennas are not permitted on premises or itsappurtenances that have been designated as historicalresources.
