Notlfication and Legal Agreement If minded to grant, the application will require to be referred to the Scottish Ministers in accordance the Town and Country Planning (Safeguarded Aerodromes, Technical Sites and Military Explosives Storage Areas) (Scotland) Direction 2003 as Glasgow Airport and NATS have lodged formal objections. Glasgow Airport, Edinburgh Airport, NATS and the CAA shall also be notified at this time. Thereafter, the developer will be required to submit a restoration band and conclude a legal agreement to ensure the future removal of the turbines and the restoration of the site.

Recommendation: Refuse for the Following Reamns:=

1. The proposed development is contrary to policies DSP4, NBE 3B, EDI 3A of the North Lanarkshire Local Plan, supplementary planning guidance SPG 12 “Assessing Wind Turbine Developments” and Scottish Planning Pdicy in that the proposed development is considered to have a significant adverse visual impact on the landscape character of the site and with particular regard to the impact on settlements to the north of the site.

2. The proposed development is mt rery to policies DSP4, N8E 3B, EDI 3A of the North Lanarkshire Local Plan, supplementary planning guidance SPG I2 “Assessing Wind Turbine Developments” and Scottish Planning Pdicy in that the submitted ES has not sufficiently addressed the potential cumulative noise impact of the proposed development in relation to the Black Law phase l l extension and it therefore cannot be established what noise impact the proposed development will have on surrounding properties.

3. The proposed development is contrary to policies DSP4, NBE 38, EDI 3A of the North Lanarkshire Local Plan, supplementary planning guidance SPG 12 ”Assessing Wind Turbine Developments” and Scottish Planning Policy in that the supporting information provides insufficient information to assess the full impact of the proposals with regard to Golden Plover mortality.

4. The proposed development is contrary to policy EDI 3A of the North Lanarkshire Local Plan, supplementary planning guidance SPG 12 “Assessing Wind Turbine Developments” and Scottish Planning Policy in that Glasgow Airport and NATS have objected to the proposed development as the proposals conflict with safeguarding criteria as a significant number of visible turbines in this area already have planning approval, the introduction of further turbines would create unacceptable clutter on the radar screens. NATS object to the proposed development on the grounds that having examined the proposals in terms of operational and technical safeguarding a technical impact is anticipated which is deemed to be unacceptable.

The proposed development site measures 270ha and ties south of the A71 on the site of the former Damside opencast coal site and comprises naturally regenerated land previousiy disturbed by the opencast operations, commercial conifer plantation and areas of bare land with no vegetation. The site previously formed part of the Damside opencast operations and was never fully restored once extraction operations ceased. The nearest turbines sit approximately 1 Kin south of Springhill with Atlanton 2 Km to the west and Headlesscross I .4 Km to the east. The nearest property Knowton Farm is located approximately 870m away from the nearest proposed tutbine and the site sits in close proximity and directly north of the operational Black taw windfarm which comprises 54 operational turbines, only two of which are located within the North Lanarkshire area, the consented Black Law phase 1 extension comprising 23 turbines in total with 12 within the North Lanarkshire area and 11 within West Lothian Council and the proposed Black Law phase 2 extension comprising 11 turbines within North Lanarkshire and closest to the Damside proposals site. (The latter of these adjoining developments is also being considered at today’s meeting - see planning application ref. 1 ff0054UCNS).

Planning permission is sought for th6 construction of 8 turbines, access tracks including passing bays, a temporary construction compound, permanent meteorological mast, hardstanding area, substation compounds and control building. Each turbine would have a hub height of 80 metres, a rotor diameter of 93 metres and a maximum height to blade tip of 126.5 metres (417 feet). It is proposed that the development wiii be connected to the grid via a new substation building on site and an application for the grid connection to the local electricity distribution network will be made separately. The total generating capacity of the turbines will be up to a maximum of 20 Megawatts (MW).

The turbines would be designed with an operational life of 25 years and at the end of this period, the developer would decommission the wind farm at which time the above ground infrastructure would be removed and the site reinstated.

An Environmental Statement was submitted outlining the environmental effects of the pmposed development. The submitted Environmental Statement includes assessments on the foliowing topics: planning policy; project description, EIA methodology, landscape and visual assessment; ecology; omithoiogy; traffic and transportation; hydrology, geology and hydrogeology; archaeology and cultural heritage, noise, infrastructure, tetmmmunications, television, aviation and pubiic safety and shadow flicker.

The applicants provided further information in relation to landscape and visual impact, ecology (Golden Plover) and peatland in response to the concerns raised by Landscape, Greenspace, SNH, RSPB and SEPA,

5. Develoment Plan

5.1 The application site is zoned as NBE 38 Assessing Devefopment in the Rural Investment Area in the North Lanarkshire Local Plan.

5.2

6. Consultations

The Glasgow and Clyde Valley Strategic Development Plan (SDP) is also relevant.

6.1 The following consultees have no objection to the proposed development

Rathmeil Archaeology, MOD, Scottish Government, Historic Scotland and Transport Scotland, Coal Authority.

6 2 A summary of the comments from the remaining consultees are as follows:-

i) Transportation has no objection to the proposed development subject to provision and approval of a Traffic Management Plan and a condition assessment of the existing road (A71) prior to works commencing. In addition it is recommended that the applicant provides further information in relation to the suitability of the rail bridge on the 8717, particularly in relation to abnormal loads. Transportation also recommends that should Black Law Phase II extension be approved the construction phases of this proposal and Black Law should not coincide.

ii) Greenspace SeMces object to the proposed development and agree with the RSPB that the modelling predictions of 158 deaths of Golden Plover are unacceptable. Greenspace comment that best practice measures should be observed for all protected species and request that tiwy are consulted regarding the finalised habitat and Species management plans. Great Crested Newts were recorded on site and the ES advises that the realignment of the access road will ensure operations are outwith 25Om of any ponds. It is recommended that an Ecological Clerk of Works monitors the construction phase and Greenspace accepts the findings of the SNH requested Appropriate Assessment for the Taiga Bean Geese.

iii) Landscape Services object to the proposed development due to the cumulative adverse landscape and visual effects that the development will have upon significant receptors in the local area. They consider that the turbine locations proposed would present substantial adY6Be visual impacts in the short range to receptors travelling along the A71 and resldences to the north of the site.

Protective Services comment that the potentiat noise impact cannot be established due to the current unanswered inconsistencies between the predictive modelling for the Black Law extension consultation

Given that the Black Law predictions have a cumulative effect on the overall noise level predictions for the Damside proposals, Protective Services are unable to consider the potential cumulative impact of the proposed development in relation to noise. SNH bo not object to the proposed development but have advised that there will be significant adverse local landscape, visual and cumulative impacts and that these are unlikely to be avoided through any mitigation. SNH consider that this scheme will cause significant visual impacts and in particular wiH affect settlements and associated viewpoints around the notthem area of the site. In addition SNH consider that the proposal is likely to have a significant effect on Taiga bean goose as a qualifying interest of Shmannan Plateau SPA. As a consequence North Lanarkshire Council was required to cany out an Appropriate Assessment which concluded that the proposals would not adversely affect the integrity of the site and this has been accepted by SNH, SNH requested that further information relating to Great Crested Newts be submitted. RSPB object to the proposed development given that the collision risk modeling predicts that 158 golden plover will be killed by the proposed windfam. They comment that this single development could potentially lead to the removal of 0.3% - 0.8% of the Scottish passage population and the applicant has not provided sufficient information to conclude that the impact of the proposal on this species wit1 be of ‘minor significance’. SEPA recommend that a habitat restoration plan should be prepared describing ways that the ecological value of this site could be enhanced during the construction and operational phases of the development and in the longer term. Furthermore SEPA recommend a condition is attached to any planning permission granted that a robust surface water management plan should be included in the Construction Environmental Management Plans (CEMPs) and be informed of any updated designs as they become available. NATS object to the proposed development on the grounds that having examined the proposals in terms of operational and technical safeguarding a technical impact is anticipated which is deemed to be unacceptable. Glasgow Airport objects to the proposed development on #e grounds that having examined the proposal from an aerodrome safeguarding perspective it confticts with safeguarding criteria. Edinburgh Airport comments #at from their inifial assessment it is possible that the airport may object to the development with a possibility of mitigation. However they require more time to analyse the proposals before providing a definitive answer. Telecommunications operators have offered no objection to the proposed development except Afkins who irtdicaYe that a 300m buffer is required but note that a scanning telemetry is fmted 274m From the proposals,

adhere to the recommended 2Km stand-off distance in SPP for large scale turbine developments and the potential for some propeities to be viewing turbines on three sides.

Pamela Nash MP has submitted a representation outtining oncerns regarding cumulative impact of turbine developments in the area and overdevelopment of the site and surrounding area for turbines, the failure of the development to adhere to the recommended 2Km stand-off distance in SPP for large scale turbine developments and the proximity of the turbines to the A71.

In addition Allanton Tenants and Residents Association and Harthill and Eastfield Community Council have aiso submitted objections.

There has been a request for a site visit and hearing and the other reasons for objection outlined in the remaining representations received are outlined below:-

Potential for increased flood risk and displacement of the water table (redmyre). Transportation impacts and potential risks to pedestrians. Noise (including Amplitude Modulation) and potential adverse health risks. Potential for unacceptable cumulative noise effects on surrounding sensitive properties in relabion to the operational, consented and proposed Blacktaw Extension Phase II. Wildlife, Ecology and Ornithology. Impact on recreational value, amenity and access strategy of the area. Deforestation Proximity of Turbines to local schools. Impact OR cutturaf heritage interests, Failure of the proposals to adhere to SPP and recommended 2Km stand-off from settlements. Detrimental impact on surrounding property values and local businesses. Efficiency of wind energy as a renewable resource. Failure of the applicant to prove carbon emission reduction given the increased carbon emissions caused by manufacture, transport and installation etc of turbines. Failure of the proposals to meet the requirements of the Arhus Convention Article 3 of Directive 85/337/EEC and Environmental (Scotland) Regulations 2004 on the evidence for benefits of such proposed developments. Adverse impact on tourism in the area. The development is contrary to NLC Fuel Poverty statement. Detrimental impact on aviation safety.

7.2 7 Letters of support has been submitted and the reasons for support are summarised below:-

8. planninci Assessment

8.1 In accordance with Section 25 of the Town and Country Planning (Scotland) Act 1997, pIanning decisions must be made in accordance with the devetopment plan unless material considerations indicate otherwise.

8.2 The Glasgow and Clyde Valley Strategic Development Plan (SDP) adopted the approach of defining search areas for wind farm developments. The areas of search as defined provide a strategic spatial framework for more detailed local development planning. The proposed windfatm is in line with the Spatial Development Strategy and supports its spatial role and function. In line with the SOP the application still requires robe assessed under the terms of the North Lanarkshire Local Flan.

North Lanarkshire Local Plan

The applicatjon site is zoned as NBE 38 Assessing Development in the Rural Investment Area in the North Lanarkshire Local Plan. This policy seeks to protect the character of and to promote development in Rural Investment Areas through restricting development to acceptable types. Generation of power from renewable soums is considered an acceptable type of development. The policy then lists impact criteria for assessing acceptable development. The devetopment must comply with the undernoted criteria:

Have a positive economic benefit. 0 Minimise any adverse environmental impacts.

Do not pose undue infrastructure implications. Have a specific tocational need. Be of a suitable scale and form for the location. Appiications include a landscape assessment. Adherence to Scottish Planning Policy

Having assessed the proposals and the submitted Environmental Statement and in view of the consultation responses detailed above, it is considered that the proposed development:-

e WIth regard to economic benefit it is noted that the proposals are for the generation of renewable energy and that the principal economic benefit will be recouped by the applicant, landowner, renewable construction sector and would contribute towards the Scottish Government's wider renewable energy strategy.

In assessing the environmental impact with regard to the ES and consultation responses, it is noted that Greenspace agree with the RSPB that the modelling predictions of 158 deaths of Golden Plover are unacceptable and also wish to see additional Vantage Point surveys in line with RSPB recommendations. Both Greenspace and the RSPB therefore object to the proposed application due to the high mortality predicted of Golden Plover, but would reconsider this position if it can be shown that projected mortality can be mitigated for during construction of the windfarm and operational lifespan. It is recommended that best practice measures should be observed for all protected species and measures including species protection plans are recommended to minimise the potential for any impact on these species. In addition it is recommended that an Ecological Clerk of Works monitors the construction phase. Both SNH and Greenspace have accepted the findings of the 'Appropriate Assessment for the Taiga Bean Geese'. Given tite comments of both Greenspace and the RSPB it is considered that the level of ecological information provided by the applicant is insufficient to assess the environmental impact and further information is required in terms of ornithofogicaf interests on the site.

impact assessment h& by necessity had to take into account the potential cumulathte noise impact of a number of nearby existing, consented and proposed developments including the consented Phase I Black Law Extension, the proposed Phase If Black Law Extension and the consented Tormywheel Windfann. Protective Services note that at the time of writing the noise assessment report for the adjoining ‘Black law’ windfarm extension was not available to the applicants. Protective S e ~ ’ c e s comment that he difference between the predicted operational noise levets and the overall predicted cumulative noise levels at a range of windspeeds and locations is such that the Black taw predictions cannot be separated out from the overall predicted cumulative levels - one set of predictions affects the other. Due to the current unanswered inconsistencies between the predictive modelling for the 61ack Law Phase II Extension and the measured operational noise tevels at Brow Farm from the existing Black Law Windfan detailed within the SPR submitted noise report and the fact that the Black Law predictions have a cumulative effect on the overall noise level predictions for this application, Protective Services are unable to provide further comment on the submitted noise report. The lack of information relating to the proposed cumulative impact of the proposals with the proposed Black Law Phase II extension is such that the potential noise impact from the proposed development on the residential amenity of the surrounding residential properties cannot be established and as such the development could have a detrimental impact on the amenity of the surrounding area due to potential for noise disturbance.

In terms of flood risk and drainage SEPA have indicated no objections. The proposals include sufficient details to ensure satisfactory decommissioning and conditions are recommended to emure the satisfactory decommissioning and restoration of the site.

Transportation has no objection to the proposed development subject to conditions and that the service and access arrangements are via the A71 only and subject to all service and access arrangements and transportation routes being covered by an agreement under section 96 of the Roads (Scotland) Act 1984,

In terms of locational need it is noted that wind turbine proposals are generalty located in rural areas such as the application Bite as they are considered to be the most appropriate areas for such development.

In terms of scale, form and landscape impact it is noted that Landscape Sewices object to the proposed development due to the cumulative adverse landscape and visual effects that the development will have upon significant receptors in the local area. Landscape consider that the turbine locations proposed would present substantial adverse visual impacts in the short range to receptors travelling along the A71 and residences to the north of the site. The Damside development comes off the ridgeline and the forestry associated with it, and presents a much more visually significant development which cannot effectively be visually mitigated or integrated into the landscape. Landscape comment that the proposed development would be very difficuit to integrate with the existing, consented and proposed windfarm schemes given the landscape and visual context. In addition they note that the most sensitive receptors identified by the Environmental Statement are those of me local area particularly those in the settlements of Springhill, Shotts and the eastern end of Allanton. They consider that the reduction in the number of turbines for the Black Law phase 2 applications will increase the cumulative impact of the Damside application as many more of its turbines will register visually as outiiers and therefore will have a greater impact upon the visual receptors of &e development. Whilst SNH do not object to the development, they do consider that there will be significant adverse local landscape, visual and cumulative impacts and that these are unlikely to be avoided through any mitigation. tn addition they consider that this scheme will

cause significant visual impacts and in particular wlli affect settiements and associated viewpoints around the northern area of the site. Given the magnitude of the impacts and potential number of sensitive recepturs affected SNH have concerns about the Enviironmentat Statement's conclusions %hat the impacts are likety to be acceptable. The applicants have subsequently suggested the removal of b a n e 1 in order to mitigate the impacts of the proposals; however it is considered that the removal of this turbine would not address concerns regarding the impact of the proposed development.

0 The proposals are assessed against Scottish Planning Policy in paragraph 8.6 below.

As outlined above, the proposed development is not considered to be of a suitable scale and form for the location. The submitted landscape assessment is not considered to fully address 811 the concerns with regard to the impact of the turbines on the fandscape character of the site and in particular to the settlements and receptors to the north, Furthermore Insufficient information has been submitted to assess the full impact of the proposals on Golden Plover mortality or with respect to potential cumulative noise impact of the proposals in relation to Black Law phase l i extension, It is therefore considered that the proposed development is unacceptable and fails to accord with policy NBE 38.

8.4 Policy €423 (Assessing Economic Development and Infrastructure Proposals) is aiso relevant, This states under EDI 3A2 that 'the Council supports, in principle, all forms of renewable energy generation subject to wind fams meeting the criteria contained in the approved supplementary planning guidance relating to issues of scale, cumulative impact, community benefit and restoration. Having assessed the submitted Environmental Statement it is considered that the proposed development:.

Does raise issues with respect to scale and cumulative impact given the consultations responses and assessment outlined in paragraph 8.3 above.

0 In terms of community benefit the applicant has confirmed that B community fund to support local projects will be set up to operate throughout the operational life of the development.

Restoration would be secured by condiions, a Section 75 legal agreement and bond.

Shadow flicker is adequately addressed and will have a minimal impact on the nearest property to the proposed turbines. Should objections be received subsequent to the turbines being erected, there are measures which the developer can take to minimise the problem which will identify and address shadow flicker and this can be addressed by condition.

0 Whilst the MOD had no abjections, GIasgow Airport and HATS objected to &he proposal. Glasgow Airpart objects to ttte proposed development on the grounds that having examined the proposal from an aerodrome safeguarding perspective it conflicts with safeguarding criteria. BAA note that the development lies in an area of airspace used by both Edinburgh and Glasgow ATC, in particular for arriving commercial aircraft using Runway 23 at Glasgow. It is also close to Ctass D airspace where aircraft are permitted to fly without being required to communicate with Air Traffic Control (ATC) or to operate a transponder. Excessive clutter in this area could mask the primary radar returns from such traffic thus posing a threat to aircraft safety. As a significant number of visible turbines in this area already have planning approval, the introduction of further turbines would create unacceptable ctuttet on the radar screens, Edinburgh Airport commerRs that they require further time to conclude their assessment of the proposals. NATS object to the proposed deveiopment on the grounds that having examined the proposals in terns of operational and technical

safeguarding a technical impact is anticipated which is deemed to be unacceptable.

Access and Transportation issues are assessed in paragraph 8.3 above.

Does raise concerns relating to potential for noise impact given the consultations responses and assessment outlined in paragraph 8.3 above.

Forestry and woodiand issues are assessed in paragraph 8.3 above.

In terms of TVmadio Reception and Radio Waves: The digital switchover has taken place and it is envisaged that this will address most issues if not all. However in order to resolve any problems that may occur, the developer can be required to carry out an assessment of TV reception before and after the turbine are constructed and thereafter cartyout works designed to remedy any potential problems. Most telecomm operators with microwave links within the area were consulted with only one commsnt received from Atkins on behalf of Scottish Water and the proximity to a fixed link path in the area.

With regard to the grid connection it is anticipated that the development will be connected to the grid via a new connection achieved by means of an overhead line. The grid connection will be subject to a separate design and would form part of a Section 37 Application under the Electricity Act 1989.

As outiined above, the submitted ES and additional information has not provided sufficient information in terms of fandscape and visual impact and ecology to conclude that the proposed development will not have a detrimental impact on the surrounding area. Furthermore insufficient information has been submitted to assess the full impact of the proposals with respect to aviation and potential cumulative noise impact of the proposals in relation to Black Law phase I1 extension. The proposed development is therefore considered to be unacceptabfe and faifs to accord with policy EDI 3A.

The NLLP also requires proposed developments to be assessed against policies DSP 1 (Amount of Development), DSP 2 (Location of Development), DSP 3 (impact of Development) and DSP 4 (Quality of Development). Having assessed the proposals and the submitted Environmental Statement and in view of the consultation responses detailed above, it is considered that:-

* In terms of policy DSP 1, DSP 2 and DSP 3 it is considered that the amount, location and impact has been adequately considered by the ES.

With respect to policy DSP 4, it is considered that the proposed development is contrary to policy DSP4 as assessed in paragraphs paragraphs 8.3 and 8.4 above and 8.6 below. Having assessed the submitted ES and in light of the objections from Protective Services, bndscape and Greenspace the proposed development is considered to have a detrimental impact on ttw site and surrounding area. The applicant has failed to provide sufficient information in order to establish that there will be no detrimenta! impact on the amenity of surrounding residential properties from the proposed development in terms of noise and visual impact. Furthermore insufficient information is provided to conclude that the proposals will not have a detrimental impact on ecology and in particutar ornithology.

Other Material Considerations

8.6 Scottish Planning Policy outlines that planning authorities should support the development of wind farms in locations where the technology can operate efficiently and environmental and cumulative impacts can be satisfactorily addressed. Development plans should provide a dear indication of the potential for development

of wind farms of all scales, and should set out the criteria that wilt be considered in deciding applications for all wind farm developments including extensions. The criteria will vary depending on ttw scale of development and its reiationship to the characteristics of the surrounding area, &ut are likely to indude:

landscape and visual impact, assessed in section 8.3 above, effects on the natural heritage and historic environment, assessed in section 8.3 above, contribution of the development to renewable energy generation targets, effect on the local and national economy and tourism and recreation interests, bneffts and dis-benefits for communities assessed in section 8.3 and 8.4 above, aviation and telecommunications assessed in section 8.4 above, noise, assessed In section 8.3 above, and cumulative impact assessed in section 8.3 above.

In terms of Scottish Planning Policy and in tight of the comments received from Protective Services, Glasgow Airport, NATS, Landscape, RSPB and SNH outlined above it is considered that the proposed development fails to accord with the requirements of SPP.

Remsentations:

8.7 In terms of points of objection, i would comment as follows:-

1. The development is contrary to planning policy.

Response: Planning policy is assessed in paragraphs 8.3 to 8.8 above.

2. The proximity of the development to the local communities (Allanton, Springhill, Stane).

3. The proximity of Turbines to local schools.

4. The cumulative landscape and visual impact of the proposed development.

5. The failure of the proposals to adhere to SPP and recommended 2Km stand-off from settlements.

6. The accumulation of large scale development in the area.

Response: The concerns outlined in points 2 4 above are noted and assessed in section 8.3 and 8.4 above. In t e n s of proximity to local communities and schools it is accepted that the proposed development raises issues with respect to visual impact in particular to receptors €0 the north. Having consulted both Landscape and SNH they both raise concerns regarding the cumulative adverse landscape and visual effects that the development wili have upon significant receptors in the local area. Landscape considers that the turbine locations proposed would present substantial adverse visual impacts in the shod range to receptors travelling along the A71 and residences to the north of the site. Landscape comment that the proposed development would be very difficult to integrate with the existing, consented and proposed windfarm schemes given the landscape and visual context. In addition they note that the most sensitive receptors identified by the Environmental Statement are those of the local area particularly those in the settlements of Springhill, Shotts and the eastern end of Allanton. fhey consider that the reduction in the number of turbines for the Black Law phase 2 application will increase the cumulative impact of the Oamside application as many more of its turbines will register visually as outliers and therefore wit1 have a greater impact upon the visuat receptors of the development. SNH consider that there will be significant adverse local landscape,

visual and cumulative impacts and lbat these are unlikely to be avoided through any mitigation. In addition they consider that this scheme wilt cause significant visual Impacts and in particular will affect settlements and associated viewpoints around the northern area of the site. Given the magnitude of the impacts and potential number of sensitive receptors affected SNH have concerns about the Environmental Statement’s conclusions that %e impacts are likely to be acceptable.

7. The potential for increased fkmd risk and displacement of the water table (redmyre).

Response: Having consulted SEPA they have no objections to the proposed development on flooding or drainage issues. The information contained within the EA and the additional information provided by the applicant is considered sufficient to confirm that the proposed development will not increase flood risk or redmyre pollution to or from the site. It should be noted that a condition can be attached that the applicant provides certification from a chartered civil engineer with experience in drainage works, that the drainage system outlined in the supporting information is implemented in accordance with the approved details should the application be approved.

Response: The concerns outlined regarding the transportation impacts of the proposed development including potential risks to pedestrians and the detrimental impact on road safety are noted. Having consulted Transportation they have offered no objections to the proposed development subject to conditions. Furthermore the traffic impacts of the development are assessed in the ES and conclude that the proposed development will result in increased traffic flows but that the effects of construction traffic are considered of negligible significance with the implementation of a robust Traffic Management Plan.

The transportation impacts and potential risks to pedestrians.

9. The concerns relating to noise including Amplitude Modulation (AM noise which is characterized as the pyscho-acoustic noise created by the movement of the turbines blades through the air and the passage of air across the turbine blades sometimes referred to as ‘blade swish) and potential adverse health risks.

Response: The Report, “The Assessment and Ratina of Noise from Wind Farms‘ (Final Report, Sept 1996, DTI), (ETSU-R-97) describes a framework for the measurement of wind farm noise, which should be followed by applicants and consultees, and used by planning authorities to assess and rate noise from wind energy developments, until such time as an update is available. This gives indicative noise levels thought to offer a reasonable degree of protection to wind farm neighbours, without placing unreasonable burdens on wind farm developers, and suggests appropriate noise conditions. In 2011 a further report produced by Hayes McKenzie for DECC entitled ‘An Analvsis of Ho w Noise lmmcts are Considered iQ jhe Determination of Wind Farm Planning ARDlications” suggested that best practice guidance is required to confirm and, where necessary, clarify and add to the way ETSU-R-97 should be implemented in practice. (A previous report in 2006 by the same authors concluded that there Is no evidence of health effects arising from infrasound or low frequency noise generated by the wind turbines that were tested). ’The Salford University report into Aerodynamic Modulation of Wind Turbine Noise (last modified September 27, 2011) summarised the conclusions of the Haves MacKenrie re~or t and investigated further complaints caused by amplitude modulation of aerodynamic noise (AM). Report findings were constrained by the low incidence of AM and the low numbers of people adversely affected in the UK. Furfher research by AECOM entitled ‘NANR 277 - Wind Farm Noise: Statutory Nuisancg Comdaints Mefhoobloav’ is aimed at helping Local Authorities deal with wind farm noise complaints, using statutory nuisance powers.

10. The potential for unacceptable cumulative noise effects on surrounding semitiwe properties in retation to the operational, consented and proposed Blacklaw Extension Phase I f .

Response: The concerns regarding noise are addressed in sections 8.3 to 8.6 above. Having consulted Protective Services they comment that the ES submitted by the appticant has not satisfactorily addressed the potential cumulative noise impact of the proposed development in relation to Black Law Phase tl extension. The potential noise impact from the proposed development on the residential amenity of the surrounding residential properties cannot be established and as such it is considered that the development would have a detrimental impact on the amenity of the surrounding area due to potential for noise disturbance.

I t . The impact of the proposed development on Wildlife, Ecology and

Response: The concerns regarding witdtife, ecotogy and ornithology are addressed in section 8.3 above. Given the comments of both Greenspace and the RSPB it is considered that the level of ornithological information provided by the applicant is insufficient to assess the environmentaf impact of the development with regard to Golden Plover mortality.

Ornithology.

12. The impact of the proposed development on recreational vaiue, amenity and access strategy of the area.

Response: Having consulted Greenspace and in particular the Access officers they have offered no objection to the proposed development. They noted that the Right of Way SM052 cuts through the sire and it is recommended that access rights be maintained at all times throughout the development stage and beyond. In addition they recommend that the proposed tracks be of a suitable standard for multi use access.

13. The impact of deforestation.

Response: Having assessed the submitted ES and consulted Greenspace and SNH it is considered that the proposed felling is acceptable and can be accommodated without detriment to the amenity of the area.

14. The impact on cultural heritage interests.

ReSpon86: The concerns regarding the impact of the development on cultural heritage are noted. Having consulted both Historic Scotland and Rathmell Archaeology neither has raised any objection to the proposed development.

15. The detrimental impact on surrounding property values and local businesses.

Response: The detrimental impact of the proposed development on the value of the surrounding properlies or any perceived b s of property value is not material to the consideration of 8 planning application,

Response: In terms of the efficiency of wind turbines as a renewable resource it is considered that the submitted ES has adequately shown that renewable energy generation from wind is a viable and effective mett.lod of energy generation. Furthermore the concern relates to the wider National Policy on such matters,

17. The failure of the applicant to prove carbon emission reduction given the increased carbon emissions caused by manufacture, transport and installation etc of turbines.

Response: In terms of carbon emission reduction it is considered that the submitted ES has adequately shown that the proposed development will resuH in the reduction overall of carbon emissions and that renewable energy generation from wind is a viable and effective method of energy generation.

18. The failure of the proposals to meet the requirements of the Arhus Convention Article 3 of Directive 85/3371EEC and Environmental (Scotland) Regulations 2004 on the evidence for benefits of such proposed developments.

Response: tt is considered that the application does meet the requirements of the Arhus Convention Articfe 3 of Directive 85/337/EEC and Environmental (Scotland) Regulations 2004 in terms of the submitted ES and supporting information which accompanies the submission.

19. The potential adverse impact on tourism in the area.

Response: The potential negative impact on tourism and recreation is noted, however, chapter 12 of the ES confirms that no significant impacts on tourism or recreation will occur during either construction or operation of the proposed extension.

20. The development is contrary to NLC Fuel Poverty statement as the development will result in adverse economic impacts for electricity consumers and plunge more families into fuel poverty.

Response: The detrimental impact of the proposed development on fuel poverty is not material to the consideration of a planning application.

21,

Response: The impact of the proposed development on aviation safety is discussed in sections 8.4 and 8.6 above. Glasgow Airport and NATS have objected to the proposed development as the proposals conflict with safeguarding criteria as a significant number of visible turbines in this area afready have planning approval, the introduction of further turbines would create unacceptable clutter on the radar screens. NATS object to the proposed development on the grounds that having examined the proposals in terms of operational and technical safeguarding a technical impact is anticipated which is deemed to be unacceptable.

In terms of points of support, I would comment as follows:-

1. The proposals wilt be a positive addition to the area and will generate clean renewable ene rg y.

2. The developer has worked hard to minimise the impact of the proposed development.

Response: It is accepted that the proposed devetopment would positively contribute towards Scottish Government targets for the production of renewable energy. However having assessed the proposed development in sections 8.3 to 8.6 above it is considered that the development will have an unacceptable detrimental impact on the surrounding area due Landscape and visual impact, ecology, noise and aviation,

3. The development is on a suitable location and a considerable distance from local communities.

The proposals will have a detrimental impact on aviation safety.

Response: Having assessed the proposed development in sections 8.3 to 8.6 abOV6 it is considered that the development will have an unacceptable detrimental impact OR

the surrounding area due Landscape and visual impact, ecology, noise and aviation and is therefore not located in a suitable location.

Response: It is noted that the applicant has agreed tf-iat if approved the praject wit1 be accompanied by the implementation of additional community funding to benefit the surrounding communities. This is not, however, a vaiid planning consideration. Furthermore it is not considefed that the benefits of additional local investment outweigh the negative impacts of the proposed development in this instance.

The community benefit and tocal investment generated.

9. Conctueions

9.1 The proposed development is considered contrary to policies DSP4, NBE 38 and EDI 3A of the North Lanarkshire Local Plan, supplementary planning guidance SPG 12 "Assessing Wind Turbine Developments" on windfarm developments and Scottish Planning Poky. The submitted ES and additional supporting information has not sufficiently addressed the potential cumulative landscape and visual impact as the proposed development is considered to have a significant adverse visual impact on the landscape character of the site and with particular regard to the impact on settlements to the north of the site. Furthermore the ES has not sufficiently addressed the potential cumutative noise impact of the proposed development in relation to the Black taw phase I1 extension and it therefore cannot be established what noise impact the proposed development wit1 have on surrounding properties. Insufficient information is provided to assess the full impact of the proposals on Golden Plover mortality, In addition Glasgow Airport and NATS have objected to the proposed development as ttie proposals conflict with safeguarding criteria. The proposed development is therefore considered unacceptable and it is recommended that planning permission is refused for the reasons outlined above.

Finally, It is recommended that should the members be minded to approve, the application is continued until such time as the outstanding information has been provided and satisfactorily considered. In addition if approved the application requires to be referred to the Scottish Ministers given the outstanding aviation objections and the applicant will also be required to enter into a section 75 legal agreement and bond to cover site restoration.

1. Purpose of Report

1.1, The purpose of this report is to update committee on additional representations and information received in respect of the above planning application.

Background

The application was first presented to the Planning & Transportation committee on 22 November 2012 where it was continued to the meeting of 13 December. At that meeting it was agreed to continue the application again pending a site visit and hearing.

Amendments to Report

Additional Representations Since the report of 13 December was prepared, an additional 96 letters of representation in support of the application have been received. This includes one from Councillor Thomas Cochrane regarding the benefits of the proposed community benefit fund, the restoration of the turbine area and provision of recreational access. In addition it is stated that the application is in line with Scottish and UK Government policy on renewable energy, will reduce carbon emissions and will not have a detrimental visual impact on the surrounding settlements.

The other respondents’ comments are summarised below:-

0 The development will help in the fight against climate change 0 The wind farm will help Scotland reach its renewable energy targets. 0 The proposed site is a good location for a wind farm 0 Local groups and people will benefit from the proposed community benefit fund. 0 Wind farms are appealing to the eye.

The proposed development will re-use an ugly ex opencast mine area which will be restored as part of the proposals allowing recreational access to the site

0 The proposals will generate further employment in the renewables sector.

In response to these additional representations, the following comments are made:-

0 It is accepted that the proposed development would positively contribute towards the Scottish Government targets for the production of renewable energy and help fight against climate change. However having assessed the proposed development it is considered that the development will have an unacceptable detrimental impact for the reasons given in the attached report.

0 Having assessed the proposed development in sections it is considered that the development is not considered an appropriate location for the reasons given in the attached report.

0 It is noted that the applicant has agreed to provide funding to benefit the surrounding communities. This is not, however, a valid planning consideration.

0 The proposed restoration of the site and increased recreational access is not considered to outweigh the negative impacts of the proposed development in this instance.

0 The generation of additional employment in the renewables sector is not considered to outweigh the negative impacts of the proposed development in this instance.

Additional Information In the time since the 13 December 2012 committee meeting, the applicant has submitted additional information with a view to mitigating impacts to relating to ecology (in particular Golden Plover), landscape and visual impact, noise and aviation. This includes the removal of a turbine which would bring the development down to 7 turbines.

However, the applicants were previously advised prior to submission of additional information that the second continuation of the application by the committee for a site visit and hearing and subsequent delay in determination of the application was not seen as an opportunity for them to re-configure the scheme or submit substantive new information that would require detailed assessment and re-consultation. The applicants were advised that should they wish assessment of further detailed matters that they should withdraw the current planning application and re-submit a revised planning application.

3.5 The committee is advised that given the timing of the further information, no formal consultation has been undertaken on the additional information submitted by the applicants and that the consideration of the application remains on the basis of the scheme submitted for consideration by committee on the 13'h December (ie 8 turbines and not 7) . The applicant has contested this approach and argues that the Council is duty bound to consult upon the additional information but this is not accepted by the Planning Service.

3.6 The applicants have submitted updated details of their proposed community benefit contribution which will amount to f3,500 per MW of installed capacity per year, throughout the operational life of the development. As noted above, contributions of this nature are not material considerations and should not be taken into account when assessing the merits of the planning application.

4. Assessment

4.1 It is considered that the comments contained within the additional representations do not provide sufficient reason to outweigh concerns as outlined in the attached report. Furthermore, the applicant has been advised that the proper manner of submitting additional information (of a substantive nature) at this stage would be to withdraw the current planning application and then re-submit a revised planning application.

5. Recommendations

5.1. It is recommended that the Committee disposes of the application in accordance with the attached report.
