LANSING SCHOOL DISTRICTSTRATEGIC IMPLEMENTATION PLAN FOR

FUNGAL CONTROL PROGRAM

FUNGAL CONTROL TECHNICAL SPECIFICATIONS FORREMEDIATION AND CLEANUP

The following are technical specifications that must be adhered to by all outside contractors conductingfungal disturbance activities for Lansing School District.

Lansing School District will hereafter be referred to as the “Owner” or “Building Owner”. The outside contractorswho conduct fungal disturbances will hereafter be referred to as the “Contractor”. Nova Environmental, Inc. hiredby the Owner will hereafter be referred to as the “Owner’s Consultant” or “Owner’s Representative”.

INITIAL REQUIREMENTS

1 General Terms

1.1 Fungal Disturbance Definition:

For purposes of this technical specification, fungal is defined as any visible or suspected evidenceof fungal growth on building materials including, but not limited to, drywall, plaster, carpet,plywood, ceiling panels and structural members.

For purposes of this technical specification, disturbance is defined as any and all remediation,cleanup and decontamination activities associated with fungal wastes. All disturbances within oron Building Owner’s facilities or their property shall be conducted in strict accordance with the instructions identified within this technical specification.

1.2 By conducting work on the Owner’s premises, the Contractor acknowledges that he/she has investigated and satisfied himself/herself as to:

1.2.1 The conditions affecting the work, including, but not limited to, the physical conditionsof the site which may bear upon site access, handling and storage of tools and materials,access to water, electricity or other utilities that otherwise may affect performance of therequired activities;

1.2.2 The character and quantity of all surface and sub-surface material, obstacles to beencountered insofar as this information is reasonably ascertainable from an inspection ofthe site, including exploratory work done by the Building Owner or a designatedConsultant, as well as information presented in drawings and specifications included withthis specification. Any failure by the Contractor to acquaint himself with availableinformation will not relieve him/her of the responsibility of determining properly thedifficulty, safety concerns or cost of successfully performing the work. The BuildingOwner and/or the Owner's Consultant are not responsible for any conclusions orinterpretations made by the Contractor on the basis of the information made available bythe Building Owner and/or the Owner's Consultant.

1.2.3 The methods and procedures detailed within the technical specifications are merelyillustrative of the procedures to be utilized on the fungal disturbance projects for theOwner. Other procedures, which are the equivalent of those described, are encouraged atthe option of the Contractor but are always subject to the Owner and/or the Owner'sConsultant approval.

1.3 The Contractor shall furnish all labor, materials, services, insurance, transportation/disposal andequipment necessary to perform the fungal disturbance activities contemplated by thisspecification.

1.4 All work contemplated under this technical specification shall be performed in accordance with all applicable governmental regulations and best industry practices.

2 Log Book/Regulations

2.1 The Contractor shall have the following items in view at the job site at all times.

2.1.1 Applicable regulations, such as 29 CFR Part 1910.134, Respiratory Protection Standard;2.1.2 A complete set of these specifications;2.1.3 Copy of employee training certificates/proof of training;2.1.4 Copy of applicable medical surveillance documentation;2.1.5 Appropriate Material Safety Data Sheets (MSDSs) for all chemicals on-site, including but

not limited to, soaps, cleaning solutions and biocides;2.1.6 Copy of Permit-Required Confined Space Program.

3 Submittals to Owner’s Representative/Consultant

3.1 The following shall be made available for all employees who will participate in any fungaldisturbance project, to the Owner or Owner’s representative before the project begins.

3.1.1 Copy of employee training certificates/proof of training;3.1.2 Copy of dated fit test;3.1.3 Copy of applicable medical surveillance documentation;3.1.4 List of all cleaning solutions/chemical agents/biocides to be used on-site;3.1.5 MSDSs for all cleaning solutions/chemical agents to be used on-site;3.1.6 Copy of Permit-Required Confined Space Program.

4 Confined Space Issues

4.1 In many cases, fungal waste to be accessed by the Contractor may be in Confined Spaces. As a result of the potential or actual hazards associated with the fungal waste, these locations would beconsidered Permit-Required Confined Spaces pursuant to 29 CFR Part 1910.146 of the OSHARegulation. The contractor shall do the following:

4.1.1 Train all employees who will be conducting work in Lansing School District as an entrantand attendant in applicable Permit-Required Confined Spaces;

4.1.2 Train the on-site supervisor as a Confined Space Supervisor pursuant to the OSHA Confined Space Standard;

4.1.3 Evaluate all Lansing School District spaces to be entered by the Contractor’s employeesin order to determine if they are Confined Spaces/Permit-Required Confined Spaces;

4.1.4 Coordinate and issue permits when employees will be entering Permit-Required ConfinedSpaces;

4.1.5 Ensure complete compliance with all aspects of the OSHA Confined Space regulatorystandard.

5 Medical Evaluation

5.1 Any worker entering the fungal waste work area shall be of sound health to work on fungaldisturbance / cleanup projects and wear appropriate respiratory protection. The Contractor shallensure that the examination includes the following:

5.1.1 Pre-placement respiratory examinations shall include the determination of the forcedexpiratory volume and forced vital capacity. Examinations shall be provided pursuant to29 CFR Part 1910.134 of the OSHA Respirator Standard along with any additionalapplicable regulatory standards;

5.1.2 A medical history and physical examination shall be performed with attention to cancer,steroid therapy, immunodeficiency, pulmonary disease, diabetes mellitus and otherimmunocompromising states. This examination is to ensure that workers do not work inenvironments in which they have increased susceptibility to fungal associated diseases.

6 Training

6.1 Any worker entering the fungal waste work area shall be properly trained in order to ensure thatthey are knowledgeable and have expertise in fungal waste disturbance projects. The Contractorshall ensure that each employee is trained in the following:

6.1.1 The specific nature of operations which could result in exposure to fungal wasteconcerns;

6.1.2 The content of 29 CFR Part 1910.134 of the OSHA Respirator Standard along with anyadditional applicable regulatory standards;

6.1.3 The purpose, proper selection, fitting, use and limitations of respirators;6.1.4 The containment setup, decontamination setup, engineering controls and work practices

associated with a negative pressure enclosure;6.1.5 The proper work practices for the removal, control, cleanup and decontamination of

fungal wastes;6.1.6 The proper use of applicable equipment including negative air filtration systems and

HEPA filtered vacuums;6.1.7 The proper use of applicable chemicals, including but not limited to, cleaning solutions,

and biocides that may be utilized on fungal waste disturbance projects;6.1.8 Entrant and attendant pursuant to the OSHA Permit-Required Confined Space Standard.

FUNGAL DISTURBANCE/REMEDIATION REQUIREMENTS

7 Worker's Dress and Safety Equipment

7.1 Worker's clothing shall be provided by the Contractor. Rips and tears in the coveralls shall be repaired, or else the coveralls shall be replaced.

7.2 The Contractor shall provide protective clothing for the Owner's Consultant and inspectionpersonnel.

7.3 The Contractor shall provide hygiene facilities and materials for the Owner's Consultant andinspection personnel.

7.4 Worker's clothing shall consist of disposable full body coveralls (coveralls should be of micro-porous material - disposable paper), underwear, head covers, impermeable gloves, and boots. TheContractor shall supply whatever safety gear is necessary to protect those people authorized to enter the work site, including hard hats and eye protection. OSHA approved footwear ismandatory while at the project site (inside and outside of the enclosure). No street clothing shallbe worn under coveralls.

7.5 The Contractor shall have an appropriately rated fire extinguisher within the work area and nearthe clean room of each enclosure.

7.6 The Contractor shall adhere to all OSHA and other regulatory agency requirements regarding thesafety of the employees, including but not limited to:

7.6.1 Fire Safety7.6.2 Ladders7.6.3 Scaffolding7.6.4 Confined Space

7.7 Personal Protective Equipment

7.7.1 Workers shall wear full body disposable suits with hoods and booties. A Tyvek® orsimilar type of suit may be worn. Suits will be worn inside the work area and shall remain in use until the completion of the remediation project. Light-weight nylon clothesmay be worn under the suit but these clothes must be changed before leaving the workarea and should be laundered separately.

7.7.2 Additional respiratory protection by supplemental filters, such as organic vaporcartridges, may be needed when handling certain cleaning and disinfectant products.Consult the MSDS to obtain the proper filters as necessary.

7.8 Personal Hygiene Practices: The Contractor shall enforce and follow good personal hygienepractices during the remediation project. These practices shall include, but not be limited to, thefollowing:

7.8.1 No eating, drinking, smoking or applying of cosmetics in work area. The Contractor will provide a clean space, separated from the work area, for these activities.

7.8.2 All workers must shower upon leaving the work area. Shower facilities will be providedby the Contractor. Upon leaving the work area, each worker will remove and dispose ofthe work suit prior to entering attached shower facility.

7.8.3 Disposable clothing, such as Tyvek® suits, and other personal protective equipment(PPE) must be donned prior to entering work area. A clean room will be provided for workers to put on suits and other personal protective equipment and to store their streetclothes. Disposable suits shall be used once, and then properly discarded.

7.8.4 A lavatory facility must be provided and located in the general work area. The eating anddrinking area, clean room, and the lavatory facility must be maintained in a clean andorderly fashion at all times. The Contractor will provide portable lavatories when neededand disinfect them daily.

8 Respiratory Protection

8.1 Respirator protection for workers shall be provided by the Contractor as required by currentOSHA regulations.

8.2 Minimum respiratory protection consisting of powered air purifying respirators (P.A.P.R.) withloose full-face piece and HEPA filters will be provided and used by all fungal remediationworkers. Workers will always wear a respirator when in the work area. While wearing therespirator, workers will not pull the respirator away from his/her face to talk, smoke, eat, or drink.No workers will be permitted to wear a half-mask respirator.

8.3 The Contractor shall have/use (within 24 hours of notification by the Owner's Consultant) asupplied air respirator operational in demand mode or other positive pressure mode.

8.4 Combination cartridges (HEPA/organic vapor) are required during the removal of fungal wastesutilizing potentially hazardous solvents/biocides.

8.5 An adequate supply of cartridges and respirators must be on-site and available for workers(regardless of respirator type).

9 Limitations/Prohibitions on the Use of Formaldehyde Solutions

9.1 The Owner strictly prohibits the use of formaldehyde solutions within its facilities or on itsproperties for the purpose of fungal waste decontamination or sterilization.

10 Emergency Planning

10.1 Emergency planning shall be developed prior to fungal remediation initiation and agreed to by theContractor and the Owner. All plans must be detailed in writing and posted at the job site (in viewnear the decontamination chamber entrance).

10.2 Emergency planning shall include written procedures for the following emergencies:

10.2.1 The Contractor must explain his contingency plan for the possibility of the negative air filtration devices blowing a fuse, tripping a circuit breaker, or losing power.

10.2.2 The Contractor must explain his contingency plan for the possibility that a disposal bagmay break or leak.

10.2.3 The Contractor must explain his contingency plan for the possibility of an injury.10.2.4 For non-life-threatening situations - employees injured or otherwise incapacitated shall

decontaminate following normal procedures with assistance from fellow workers ifnecessary, before exiting the work place to obtain proper medical treatment.

10.2.5 For life-threatening injury or illness, worker decontamination shall take least priorityafter measures to stabilize the injured worker, remove him/her from the work place andsecure proper medical treatment.

10.2.6 The Contractor must detail emergency evacuation routes in case of fire, explosion, ortoxic atmosphere, etc.

10.3 The Contractor shall take all necessary precautions and actions to protect his/her employees,subcontractors, Owner's Representatives, Owner's Consultants, government inspectors, generalpublic, and the building and structure from exposure to fungal waste.

11 Preparation of Work Area for Fungal Remediation

11.1 The Owner shall attempt to furnish utility services for the Contractor's use, including electricaloutlets (25 ampere) and water taps in or adjacent to the work area in sufficient quantities and located such that the Contractor can use them for equipment and remediation/decontaminationpractices. However, should such utility access not be available, the Contractor is solely responsible for the provision of the same. In the event of power failure (regardless of fault), theContractor is responsible for continuing work using adequate generator power.

11.2 Danger signs will be posted at a distance sufficiently far enough from the fungal remediation workarea to permit an employee to read the sign and take necessary protective measures to avoidexposure. All possible entrances to the work area shall be posted. Additional signs will be placedat areas designated by the Owner's Consultant.

Signs shall state: WARNING

FUNGAL REMEDIATION IN PROGRESSDO NOT ENTER – AUTHORIZED PERSONNEL ONLY

11.3 The building personnel shall attempt to shut down and lock out all heating, cooling, and air conditioning system components that are in, supply, or pass through the work area. Shouldbuilding personnel be unavailable or unable to so do, it is the sole responsibility of the Contractorto do so. The Contractor will seal all intake and exhaust vents in the work area with tape and 6-mil polyethylene, as well as any seams in system components that pass through the work area. Allaffected heating, ventilation and air conditioning system filters will be removed and placed in 6-mil polyethylene bags for disposal as fungal waste.

11.4 The Contractor may be required to pre-clean all movable objects within the work area using aHEPA filtered vacuum and/or wet cleaning/biocide methods. Pre-cleaning will be conducted bythe Contractor as deemed necessary by the Owner or the Owner's Consultant. After cleaning,these objects shall be removed from the work area by the Contractor and carefully stored in anuncontaminated location as designated by the Owner's Consultant. Carpeting, drapes, clothing,furniture, and other fabric items contaminated with fungal waste may be required to be disposedof.

11.5 The Contractor may be required to pre-clean all fixed objects in the work area using HEPA filtered vacuums and/or wet-cleaning/biocide methods. Pre-cleaning will be conducted by the Contractoras deemed necessary by the Owner or the Owner's Consultant.

11.6 Where doors or other such building fixtures are removed by the Contractor prior to remediationactivities, the Contractor is responsible for replacing doors and/or fixtures upon completion ofremediation. Each door and/or fixture shall be sufficiently marked or otherwise identified by theContractor to insure replacement in the proper location.

11.7 The Contractor shall seal all windows, door-ways, elevator openings, corridor entrances, drains,ducts, grills, grates, diffusers, skylights and all other openings between the work area and the areas outside the work area with, at minimum, 4-mil polyethylene sheeting.

11.8 Walls will be covered with at least one layer of 4-mil polyethylene sheeting. Walls that are non-porous and will not be damaged by water, cleaning solutions or biocides do not necessarily needprotection. They can be decontaminated using HEPA vacuums and cleaning techniques. TheOwner or the Owner’s Consultant will advise the method deemed most appropriate and theContractor shall comply with the method chosen.

11.9 Non-waterproof tape may not be used for attaching polyethylene sheeting or for sealingpolyethylene leaks. High quality duct tape or its equivalent shall be used for this purpose.

11.10 The Owner or the Owner's Consultant must approve the decontamination chamber location,Contractor parking, dumpster location and entrances that the Contractor will use for the movementof supplies and personnel.

11.11 Equipment storage, bathroom usage designation, foreman's office and designated break areas (ifavailable) will be determined by the Owner or the Owner's Consultant. Only project areas and designated areas are to be used.

12 Decontamination

12.1 The Contractor will construct decontamination facilities in a pre-designated area which will housethe clean room, shower room, dirty room, and, when feasible, an equipment room. This facilitywill be, at minimum, a three-chambered with an entrance airlock with shower facilities in itscentral chamber. The dimensions of these chambers will be adequate for the number of menneeded for the project. At least two layers of 6-mil polyethylene will be placed on the floor of theentire decontamination chamber, to prevent leakage of water from the showers. The walls, floor,and ceiling covering of the airlock construction will be seamed to each other in a fashion makingthem air and water tight. One end of this construction will exit to the clean area outside thecontainment barrier walls. The other end of this construction will exit inside or at the containmentbarrier walls. Except for these doors, all three chambers will be partitioned from each other with air and water tight flaps made of 6-mil polyethylene. Four (4) flapped doors will be constructedwith two (2) layers of 6-mil polyethylene. One door will be at the entrance of the clean room, onedoor at the entrance to the shower, one door at the entrance to the dirty room, and the last door atthe entrance to the work area. Both layers will be attached to the side of the door which faces toward the work area. The first layer of polyethylene will be attached at the top, bottom, and sidesof the door opening. It will be slit down the middle. The second layer of polyethylene will beattached only at the top of the door on the dirty side of the door opening. It will be wider than theslit made in the first layer and will hang like a flap. When air is drawn from the clean side of the airlock into the work area it will cause the door flaps to lift. If air attempts to move from the workarea end of the airlock toward the clean end or outside of the enclosure, it will force the flaps shut,closing the slit in the first polyethylene layer and thus stopping the air flow. All four (4) dooropenings or flaps will be constructed to allow clean air into the enclosure, but stopping air fromexiting the enclosure. The central chamber will contain shower(s). Each shower stall will sit in a pan with at least six-inch sides. Suitable hoses will be used to supply hot and cold water to theshowers. A sump pump or other suitable and safe device will be used to filter and dispose of theshower waste water through a special HEPA filter. No water may leave the work area withoutundergoing HEPA filtration, stored in leak proof drums and disposed of properly. Black polyethylene sheeting may be used for privacy on the decontamination facility. All polyethyleneused for decontamination purposes shall be made of fire rated materials.

12.2 The Contractor may construct a two-chambered decontamination airlock to serve as a debris port.All fungal waste will be moved out through this port or through the decontamination unit. Thechamber will be constructed in the same manner as the main decontamination airlock, butexcluding the shower facility. As each bag is filled, it will be set into the first room for temporarystorage. Three workers will be needed to complete the waste decontamination process. A workerin the first room will wash and hand the bag to a worker in the second room where he/she will then double-bag the material. The second worker will then hand the double-bagged material to athird worker who loads the material on the transport vehicle (airlocks must exist between eachroom, as in the main decontamination facility). Drums shall be wet wiped and HEPA vacuumed inthe decontamination port. If a debris port is not possible, all precautions should be taken whenhauling waste through the main decontamination facility, where all bags will go through thedecontamination process. If a separate decontamination facility is constructed it shall be sealedwhile not in use.

12.3 All workers, without exception, will change street clothes in designated areas (clean room) prior to the start of each work day. Lockers or acceptable substitutes will be provided by the Contractor for street and work clothes. After workers are properly dressed in protective gear, they will walkthrough the shower and dirty room into the work area.

12.4 At the end of the work shift, and anytime the worker leaves the work area, he/she will decontaminate by removing all contaminated work clothes in the dirty room, but leaving his/herrespirator on. He/she will then proceed to the showers and properly wash. Respirators will beworn while showering and remain on until the respirator is clean of fungal waste. The cartridgeswill then be removed and disposed of as contaminated waste and the respirator stored in the clean

room. Workers will shower before breaks, lunch and at the end of each day's work. Hot water,towels, soap and hygienic conditions shall be provided by the Contractor.

12.5 Adequate toilet facilities may be located outside of the work area and decontamination for thispurpose will be employed. Where such facilities do not exist, the Contractor will provide portableservice.

12.6 No smoking, eating or drinking is to take place in the work area. Prior to eating, drinking or usingtoilet facilities, workers will fully decontaminate by showering. A new coverall will then be usedto re-enter the work area.

12.7 Procedures developed for evacuation of injured workers (see 10 – Emergency Planning) will beused. Aid for a seriously injured worker will not be delayed for reasons of decontamination.

12.8 Worker's footwear will remain inside the work area until the completion of the job.

12.9 All waste water must be passed through a HEPA or five micron filter and disposed of properly.

12.10 All Contractor's tools and supplies, including large items such as ladders and scaffolding must beproperly decontaminated when removing them from the project area.

13 Methods of Fungal Remediation

NOTE: The use of supplies, equipment, tools, etc., owned, rented or otherwise in the possession of the BuildingOwner is strictly prohibited.

13.1 The waste material will be packed in 6-mil polyethylene bags prior to starting the next section toprevent the material from drying. Double bagging will always be used. Bags shall not be over-filled and will be securely taped or sealed at the top to prevent accidental opening or leakageduring removal, storage and transport.

13.2 Large components removed intact will be wrapped in two layers of 6-mil polyethylene sheetingsecured with tape.

13.3 When removal of building materials (electrical, light, duct work, etc.) is necessary, the Contractorshall develop drawings indicating existing materials and their exact locations.

13.4 Personnel knowledgeable and experienced in electrical work must be used when installing or making connections to any electrical components within the facility, as well as when removingand/or replacing lights.

13.5 The Contractor shall use applicable tools in order to remove fungal wastes. These tools include, but are not limited to, shovels, scoops, scrapers and wire brushes.

13.6 Prior to the disturbance of any fungal waste/contaminated debris the Contractor shall wet downwith water/water surfactant mix the affected area/component in order to minimize any airborne dust potentially containing any vector borne organisms.

13.7 If it is not possible to wet the area down prior to disturbance, the Contractor shall use HEPAvacuums to remove affected dust/debris prior to gross removal using applicable tools.

13.8 The Contractor shall ensure complete cleanup and decontamination of all affected areas and building components, such as floors, walls, beams, support beams, cross members, horizontal andvertical surfaces and window components, such as sills.

13.9 The Owner reserves the right to require the Contractor to utilize a truck mounted or trailer mounted industrial vacuum system with HEPA filtration to conduct the fungal remediationproject, if deemed necessary by the Owner or Owner’s Consultant.

13.10 Any sharp edged components to be disposed of that will tear the polyethylene bags and sheetingmust be placed into fiberglass or fiberboard drums for disposal.

13.11 No bags shall be thrown or dropped at any time.

13.12 All containerized fungal waste that is stored on-site (if allowed) shall be properly labeled and placed in a locked or secured location until ready for final disposal. Labels shall be of sufficientsize and contrast to be readily visible and legible.

14 Operating Procedures for the Uses of Negative Pressure Systems for Fungal Waste Remediation

Introduction

This specification provides guidelines for the use of negative pressure systems in the remediation of fungal wastefrom buildings. A negative pressure system is one in which static pressure in an enclosed work area is lower thanthat of the environment outside the containment barriers.

The pressure gradient is maintained by moving air from the work area to the environment outside the area viapowered exhaust equipment at a rate that will support the desired air flow and pressure differential. Thus, the air moves into the work area through designated access spaces and any other barrier openings. Exhaust air is filtered by a high-efficiency particulate air (HEPA) filter to remove potentially hazardous particles.

The use of negative pressure for fungal waste remediation protects against large-scale release of particles to the surrounding area in case of a breach in the containment barrier. A negative pressure system also can reduce the concentration of airborne fungal waste in the work area by increasing the dilution ventilation rate (i.e. dilutingcontaminated air in the work area with uncontaminated air from outside) and exhausting contaminated air throughHEPA filters. The circulation of fresh air through the work area reportedly also improves worker comfort, whichmay aid the removal process by increasing job productivity.

All fungal remediation projects will be completed with the use of HEPA air filtration devices. Each unit must havethree filters, including a HEPA filter capable of removing minute fungal waste particles. Each unit has ducts thatmust be exhausted to the outside air. Inlet and outlet ports of the air filtration devices must be covered with tape and4-mil polyethylene sheeting when not in use. HEPA air filtration devices will be set up so that the air in theenclosure is drawn away from the worker. Removal and cleaning operations will always move towards the airfiltration devices. HEPA air filtration devices will be run until the completion of the project.

14.1 Materials and Equipment

14.1.1 The Portable, HEPA-Filtered, Powered Exhaust Unit

The exhaust unit establishes lower pressure inside than outside the enclosed work areaduring fungal waste remediation. Basically, a unit consists of a cabinet with an openingat each end, one for air intake and one for exhaust and a series of filter areas arrangedinside the cabinet between the openings. The fan draws contaminated air through theintake filters and discharges clean air through the exhaust. Portable exhaust units usedfor negative pressure systems in fungal waste remediation projects should meet thefollowing specifications.

14.1.2 Structural Specifications

The cabinet should be ruggedly constructed and made of durable materials to withstand

damage from rough handling and transportation. The width of the cabinet should be lessthan 30 inches to fit through standard-size doorways. The cabinet must be appropriatelysealed to prevent fungal waste containing dust from being emitted during use, transport,or maintenance. There should be easy access to all filters from the intake end, and thefilters must be easy to replace. The unit should be mounted on casters or wheels so it canbe easily moved. It also should be accessible for cleaning.

14.2 Mechanical Specifications

14.2.1 Fans

The fan for each unit should be sized to draw a desired air flow through the filters in theunit at a specified static pressure drop. The unit should have an air handling capacity of 1,000 to 2,000 ft3/min under "clean" filter conditions. The fan should be of thecentrifugal type.

For large-scale fungal remediation projects, where the use of a larger capacity, specifically designed exhaust system may be more practical than several smaller units,the fan should be appropriately sized according to the proper load capacity established forthe application, i.e.

Total ft3/min (load) = Volume of air in ft3 x air changes/hour 60 min/hour

Smaller-capacity units (e.g. 1,000 ft3/min) equipped with appropriately sized fans andfilters may be used to ventilate smaller work areas. The desired air flow could beachieved with several units.

14.2.2 Filters

The final filter must be the HEPA Rated.

Each unit should be equipped with a Magnehelic® gauge or manometer to measure thepressure drop across the filters and indicate when filters have become loaded and need tobe changed. The static pressure across the filters (resistance) increases as they becomeloaded with dust, affecting the ability of the unit to move air at its rated capacity.

14.3 Electrical - General

The electrical system should have a remote fuse disconnect. The fan motor should be totallyenclosed, fan-cooled, and the non-overloading type. The unit must use a standard 115-V, single-phase, 60-cycle service. All electrical components must be approved by the National ElectricalManufacturer's Association (NEMA) and Underwriter's Laboratories (UL).

14.3.1 Fans

The motor, fan, fan housing, and cabinet should be grounded. The unit should have anelectrical (or mechanical) lockout to prevent the fan from operating without a HEPAfilter.

14.3.2 Instrumentation

An automatic shutdown system that would stop the fan in the event of a major rupture inthe HEPA filter or blocked air discharge is recommended. Optional warning lights are recommended to indicate normal operation, too high a pressure drop across the filters (i.e.filter overloading), and too low a pressure drop (i.e. major rupture in HEPA filter orobstructed discharge). Other optional instruments include a time and automatic shut-offand an elapsed time meter to show the total accumulated hours of operation.

14.4 Setup and Use of a Negative Pressure System

14.4.1 Preparation of the Work Area

14.4.1.1 Determining the Ventilation Requirements for a Work Area

Experience with negative pressure systems on fungal remediation projectsindicates a recommended rate of one air change every 15 minutes. Thevolume (ft3) of the work area is determined by dividing this volume by therecommended air change rate (i.e. one air change every 15 minutes).

Total ft3/min =Volume of work area (ft3)/15 min

The number of units needed for the application is determined by dividingthe total ft3/min by the rated capacity of the exhaust unit.

Number of units needed = [Total ft3/min]/[Capacity of unit (ft3)]

14.4.2 Location of Exhaust Units

The exhaust unit(s) should be located so that makeup air enters the work area primarilythrough the decontamination facility and traverses the work area as much as possible.This may be accomplished by positioning the exhaust unit(s) at a maximum distance from the worker access opening or other makeup air sources.

Wherever practical, work area exhaust units can be located on the floor in or near unuseddoorways or windows. The end of the unit or its exhaust duct should be placed through an opening in the plastic barrier or wall covering. The plastic around the unit or ductshould then be sealed with tape.

Each unit must have temporary electrical power (115V AC). If necessary, three-wireextension cords can supply power to a unit. The cords must be in continuous lengths(without splice), in good condition, and should not be more than 100 feet long. Theymust not be fastened with staples, hung from nails, or suspended by wire. Extensioncords should be suspended off the floor and out of workers' way to protect the cords fromdamage from traffic, sharp objects and pinching.

Whenever possible, exhaust units should be vented to the outside of the building. Thismay involve the use of additional lengths of flexible or rigid duct connected to the airoutlet and routed to the nearest outside opening. Window panes may have to be removedtemporarily.

Additional makeup air may be necessary to avoid creating too high of a pressuredifferential, which could cause the plastic coverings and temporary barriers to "blow-in."Additional makeup air also may be needed to move air more effectively through the workarea. Supplemental makeup air inlets may be made by making openings in the plastic

sheeting that allow air from outside the building into the work area. Auxiliary makeupair inlets should be as far as possible from the exhaust unit(s) (e.g. on an opposite wall), off the floor (preferably near the ceiling), and away from barriers that separate the work area from occupied clean areas. They should be resealed whenever the negative pressuresystem is turned off after removal has started. Because the pressure differential (and ultimately the effectiveness of the system) is affected by the adequacy of makeup air, thenumber of auxiliary air inlets should be kept to a minimum to maintain negative pressure.

14.4.3 Use of the Negative Pressure System

14.4.3.1 Testing the System

The negative pressure system should be tested before any fungalcontaminated component is wetted, removed or remediated. After the workarea has been prepared, the decontamination facility set up, and the exhaustunit(s) installed, the unit(s) should be started (one at a time). Observe thebarriers and plastic sheeting. The plastic curtains of the decontaminationfacility should move slightly in toward the work area. The use ofventilation smoke tubes and a rubber bulb is another easy and inexpensiveway to visually check system performance and direction of air flow throughopenings in the barrier. Another test is to use a Magnehelic® gauge (orother instrument) to measure the static pressure differential across thebarrier. The measuring device must be sensitive enough to detect arelatively low pressure drop. A Magnehelic® gauge with a scale of 0 to 0.25or 0.50 inch of water and 0.005 or 0.001 inch graduations is generallyadequate. The pressure drop across the barrier is measured from the outside by punching a small hole in the plastic barrier and inserting one end of a piece of rubber or Tygon® tubing. The other end of the tubing is connectedto the "low pressure" tap of the instrument. The "high pressure" tap must beopen to the atmosphere. The pressure is read directly from the scale. After the test is completed, the hole in the barrier must be patched.

The HEPA filter should be replaced if prefilter and/or intermediate filterreplacement does not restore the pressure drop across the filters to itsoriginal clean resistance reading or if the HEPA filter becomes damaged.The exhaust unit is shut off to replace the HEPA filter, which requires removing the prefilter first, then opening the intake grill of filter access, andfinally removing the HEPA filter from the unit. Used HEPA filters shouldbe placed in a sealable plastic bag (appropriately labeled) and disposed of asfungal waste. A new HEPA filter (structurally identical to the originalfilter) should then be installed. The intake grill and intermediate filtershould be put back in place, the unit turned on, and the prefilter positioned on the intake grill. Whenever the HEPA filter is replaced, the prefilter andintermediate filter should also be replaced.

When several exhaust units are used to ventilate a work area, any air movement through an inactive unit during the HEPA filter replacement willbe into the work area. Thus, the risk of fungal contaminated dust releasedto the outside environment is controlled.

Any filters used in the system may be replaced more frequently than thepressure drop across the filters indicates is necessary. Prefilters, forexample, may be replaced two to four times a day or when accumulations of particulate matter become visible. Intermediate filters must be replacedonce every day or so, and the HEPA filter may be replaced at the beginningof each new project. (Used HEPA filters must be disposed of as fungal

containing waste.) Conditions in work area dictate the frequency of filter changes. In a work area where dust/debris/fungal waste release iseffectively controlled by thorough wetting and good work practices, fewer filter changes may be required than in work areas where the removalprocess is not well controlled. It should also be noted that the collectionefficiency of a filter generally improves as particulate accumulates on it.Thus, filters can be used effectively until resistance (as a result of excessiveparticulate loading) diminishes the exhaust capacity of the unit.

14.5.4.2 Dismantling the System

When a final inspection and assessment indicate that the area has beendecontaminated, all filters of the exhaust units should be removed and disposed of properly and the units shut off. The remaining barriers betweencontaminated and clean areas and all seals on openings into the work areaand fixtures may be removed and disposed of as contaminated waste. A final check should be made to be sure that no dust or debris remains onsurfaces as a result of dismantling operations.

15 Clean-Up Procedures for Abatement

15.1 General: The work site when disturbance is taking place shall be cleaned at the end of each day'sfungal remediation activities. Prior to beginning remediation, all furnishings, equipment, andcarpet shall be removed. A separate, secured area within the facility shall be designated forstorage of debris until it can be properly disposed of properly. The unit shall be secured to prevententry by any person after termination of work day. Disposable supplies, such as mop heads,sponges and rags shall be replaced regularly and disposed of properly. Durable equipment, suchas power and hand tools, generators and vehicles shall be cleaned monthly. All equipment shallbe cleaned by HEPA vacuuming and cleaning solution/biocide washing.

15.2 Clean-up Methods and Equipment: Areas in which remediation operations have been completed,shall be cleaned, starting at the ceilings and working down to the floors, by vacuum cleaning usinga HEPA vacuum, followed by a wet cleaning with cleaning solution/biocide wash. The Contractormay use a garden sprayer or similar type to wet all surfaces with cleaning/biocide solution. After spraying the surface, a wet/dry HEPA vacuum shall be used to vacuum the water from the surface.

15.3 HEPA Vacuum: The Contractor will obtain training in the use of the HEPA vacuum from themanufacturer prior to use. The Contractor shall obtain HEPA vacuum attachments, such asvarious size brushes, crevice tools, and angular tools to be used for varied application and servicethe HEPA vacuum routinely to assure proper operation. Caution shall be used any time the HEPAis opened for filter replacement or debris removal. Operators shall wear a full set of protectiveclothing and equipment, including respirators, when using the HEPA vacuuming equipment.

15.4 Wet Cleaning with Cleaner or Biocide Solution: The Contractor shall prepare and use an EPA registered cleaner/biocide or other appropriate solution, according to the manufacturers'recommended coverage. The waste water from cleanup shall be contained and disposed ofproperly.

15.5 Surfaces to be Cleaned: Surfaces to be cleaned include ceilings, walls, floors, windows (sash, jamb, and sill), doors, fixtures of any kind, beams, support beams and cross members. All surfaces must be cleaned except, those in rooms which were found free of fungal wastes, were notremediated, were properly sealed, or were never entered during the remediation of the subject area.

15.6 Encapsulation of Porous Materials: Subsequent to removal, cleaning and decontamination offungal wastes, the Contractor shall remove any loose material from the surface and coat all porous

materials such as old beams, wood floors and plaster browncoat substrate surfaces with an effective encapsulating agent.

15.7 Removal of Large Debris: Large debris from demolition (i.e. doors and windows) shall bewrapped in plastic sheets at least 6 mil thick, sealed with heavy duct tape, and stored in thedesignated area. This debris will be removed and disposed of properly.

15.8 Removal of Small Debris: Prior to picking-up or collecting small debris, the surface to be cleanedwill be sprayed with a fine mist of water. The debris will be picked up, collected, and placed into 6 mil thick double plastic bags. The bags shall not be overloaded, shall be securely tied, and shallbe stored in the designated area until disposal.

15.9 Removal of Plastic Sheeting: The plastic sheeting covering the floors, or other plastic sheeting,shall be sprayed, picked up, and HEPA vacuumed prior to removal. The plastic sheeting shall becarefully folded from the corners and ends toward the middle and placed into double 6 mil plasticbags and sealed. Bags shall be stored in the designated area and disposed according to Part V of the contract documents.

16 Acceptance Criteria for Area Re-Occupancy

16.1 The Contractor will clean all work site surfaces in a proper manner with appropriate equipment inaccordance with Item 15 of these specifications.

16.2 After completion of the cleaning operations, the following activities shall be performed:

16.2.1 A complete visual inspection to insure fungal waste-free conditions. The Contractor shalltour and inspect the entire work area, including but not limited to: ventilation openings,doorways, windows, and other openings; he/she shall look for fungal waste debris anddust from any source, residue on surfaces, or any other matter. If any fungal wastedebris, dust or residue is found, repeat the final cleaning until visual inspection issuccessfully completed. It shall be the right of the Owner's Consultant(s) to accompanythe Contractor during the inspection and determine if additional cleaning is necessary.

16.2.2 The Consultant shall perform a complete visual inspection to ensure fungal waste free conditions. Any accumulation of fungal associated dust, during the "white glove test",shall be cause for the Contractor to repeat all cleaning procedures.

16.3 After the work area is found to be in compliance, all entrances and exits are unsealed, and the polyethylene sheeting, tape and any other trash and debris shall be placed in double sealedpolyethylene bags (6-mil minimum) or barrels lined with one polyethylene bag (6-mil minimum),and properly labeled and disposed of.

17 Disposal of Fungal Wastes and Debris

17.1 The Contractor shall collect all wastes and debris associated with the fungal remediation project,including, but not limited to, fungal wastes, polyethylene and disposable equipment and supplies, properlybag these materials and dispose of in a construction landfill.

18 Submittals Prior To Contractor Release & Final Payment

18.1 Damages: The Contractor shall promptly repair any and all damages caused to facilities at no cost to the Owner.

18.2 The following must be submitted prior to final payment:

18.2.1 All documentation requested in Submittals to Owner's Representative, Section 3.1.

WORK/CONDUCT REQUIREMENTS

19 Supervision, Personnel and Misconduct

19.1 A Project Supervisor shall be appointed to provide supervision and oversight on all fungalremediation projects. The Project Supervisor shall be designated prior to the start of said project(s) and must remain the same throughout the duration of the project(s).

19.2 The Owner's Consultant IS NOT THE CONTRACTOR'S OUT-MAN. The Contractor mustprovide one out-man for each enclosure (unless the decontamination chambers are within "talking"distance of each other). The out-man must always remain within talking distance of the enclosurethey are assigned to.

19.3 Contractors employees are subject to immediate dismissal if any of the following, but not limitedto the following, occur:

19.3.1 Failure to follow proper remediation procedures, including but not limited to respiratoryprotection and the throwing of fungal waste disposal bags outside of the enclosure.

19.3.2 Physical threats and violence to the Owner's Consultant or any other person.

19.3.3 Property damage or theft.

19.3.4 Reckless driving on Owner's property.

19.3.5 Discourteous and ill-mannered statements made to the Owner, Owner's employees orOwner's Consultant.

19.3.6 Consumption of alcohol on Owner's premises.

20 Site Security/Site Cleanliness

20.1 The work area is restricted to only authorized, trained and protected personnel. These personnelmay include the Contractor's employees, employees of subcontractors, Owner's employees andRepresentatives, state and local inspectors, and any other designated individuals. The list ofemployees who will participate in the project as defined in 2.1.2 of these specifications will be theonly employees allowed to enter the work area. Additional employees assigned to this projectmust be cleared through the Owner or the Owner's Consultant. Documentation of all training,medical, and other pertinent requirements are required prior to the employees’ participation.

20.1.1 An employee shall not remain on the Owner's premises if he/she is prohibited fromparticipating in the project as a result of insufficient paperwork or if the Owner'sConsultant determines the employee, in any manner, is detrimental to the safe completionof the project.

20.1.2 The Contractor shall record the names and social security numbers of all people on asign-in sheet who enter the work site, and maintain this record for thirty years.

20.2 Entry into the work area by unauthorized individuals shall be strictly prohibited.

20.3 Access to the work area shall be through a single worker decontamination system. All othermeans of access (doors, windows, hallways, etc.) shall be blocked or locked so as to prevent entryto or exit from the work area. The only exceptions for this rule are the waste pass-out airlockwhich shall be sealed except during the removal of containerized fungal waste from the work area,and emergency exits in case of fire or accident. Emergency exits shall not be locked from theinside; instead, they shall be sealed with polyethylene sheeting and tape until needed.

20.4 The Contractor shall designate one worker to remain outside each enclosure throughout theduration of the project in order to regulate ingress and egress to the work areas as well as toprovide needed supplies and equipment. The worker outside the enclosure will be within hearingrange at all times.

20.5 All areas occupied or used in any way by the Contractor (all employees), outside the enclosure(s)but within the building shall be kept in an acceptable condition and thoroughly cleaned at the endof each day, to the satisfaction of the Owner's Consultant. If at any time, food containers or debrisis found not properly disposed of, eating on premises shall be terminated.

20.6 The Contractor is responsible for maintaining areas outside the building in a condition acceptableto the Owner or the Owner's Consultant. This includes, but is not limited to: sanitation, suppliesand equipment and employee driving and substance abuse.

21 Stop Work Orders

21.1 If at any time, the Owner or the Owner's Consultant decide that work practices are in violation ofthe contract specifications or endangering workers, he/she/they will immediately notify theContractor's on-site Representative of such and operations are to cease until corrective action istaken.

21.2 The Contractor shall cooperate fully with the Owner and Owner's Consultant.

CONDITIONS Information given in this Conditions section are peculiar to this project, necessary for the progress of the work, and shall be provided as described herein. Throughout this Conditions section, Lansing School District is referred to as the "Building Owner" or "Owner" and the successful bidder as the "Contractor". All other parties involved and contracted by the Owner are referred to as the "Owner's Representatives". Bidding, Bonding and Contract Information 1. The Bid Proposal Packet shall be filled in completely, giving all information called for herein. Should any

bidder refuse to hold its bid firm for the required period or refuse to enter into a contract in accordance with the terms of its proposal, the Owner reserves the right to disqualify its bid and may consider this a factor with respect to any future bids made by him/her, and may refuse to consider the same for that reason.

2. All pages and documents, and the information requested within the Bid Proposal Packet section, must be

furnished completely in strict compliance with the bidding submittal requirements. The manner of submission is essential to permit prompt evaluation of all bids on a fair and uniform basis. Accordingly, the Owner reserves the right to declare as non-responsive, and reject, any bid which is incomplete or where material information requested is not furnished, or where indirect or incomplete answers or information is provided.

3. Bidders are cautioned that any alternate bid(s), unless specifically requested, or any changes, insertions, or

omissions to the terms and conditions of these specifications, may be considered non-responsive and at the option of the Owner may result in rejections of the bid(s).

4. Any bid(s) received at the office designated herein, after the exact time specified for receipt, will not be

considered. 5. The Owner reserves the right to postpone the bid opening for its own convenience. 6. Bidders shall fill in the number and date of each addendum on the Bid Proposal Packet (Contractor's Agreement

and Certification). 7. Should a bidder find apparent discrepancies in, or omissions from, the bidding documents, or should it be in

doubt as to their true meaning, or should it have any questions regarding any work or materials intended by the bidding documents, then such bidder, either Contractor or Subcontractor, shall immediately notify the Owner of such questions. The Owner will issue an addendum to all Contractors recorded in its office as being bidders for the specific project. 10. Simultaneously with the execution and delivery of the contract agreement between the Owner and the Contractor designated by the Owner, the Contractor shall qualify for, sign and deliver to the Owner an executed Performance Bond and an executed Labor and Materials Payment Bond secured by a T-listed surety company licensed to do business in the State of Michigan and approved by the Owner. Each such bond shall be in the amount of 100% of the contract agreement. All bonds shall be attached to and made part of the agreement between the Owner and the Contractor. Attorneys-in-fact who signed the contract bonds must file with each bond a certified copy of their power of attorney to sign said bonds. The Contractor shall include the full cost of bonds in its bid.

11. Each Bid Proposal Packet shall be accompanied by a certified check, cashier's check, or Bid Bond by a T-listed

bonding company that is licensed to do business in the State of Michigan made payable to the Owner in an amount not less than 5% of the bid(s) as a proposal guarantee.

12. Bonds and certificates of insurance shall be approved by the Owner before the successful bidder may proceed

with the work. Failure or refusal to provide bonds or certificates of insurance in a form satisfactory to the Owner shall not provide the successful bidder to any extension of the time parameters as set forth in the attached time schedule and may, at the Owner's option, be cause for rejection or cancellation of the contract.

13. It shall be understood and agreed by all parties submitting proposals on any part of the work that the

requirements contained in all contract documents shall apply to all addenda issued before the time set for receiving bids, that the general character of work called for in the addenda shall be the same as originally required for similar work, unless otherwise mentioned, and that all incidental work necessitated shall be included, even though not particularly specified therein.

14. No proposal shall be considered as being binding upon the Owner until a written contract has been properly

executed and satisfactory bonds have been furnished. Failure to execute and return the contract and satisfactory bonds within the prescribed period of time shall be cause for annulment of the award. The bid security of the bidder will be realized upon or retained by the Owner.

15. The bidder to whom the contract is awarded shall, within fifteen (15) calendar days after notice of award and

receipt of contract documents from the Owner, sign and deliver the required copies to the Owner. Certificates of insurance and performance, labor and materials bonds shall also be submitted to the Owner at this time.

16. The Contractor shall defend, indemnify, save harmless and exempt the Owner, its officers, agents, servants, and

employees from and against any and all suits, actions, legal proceedings, claims, demands, damages, costs, expenses, and attorney fees incident to any work done in the performance of this contract; provided, however, the Contractor shall not be liable for any claims, demands, damages, cost, expenses, and attorneys fees arising out of an act or omission of the Owner, its officers, agents, servants, and employees.

17. THE CONTRACT WILL BE AWARDED TO THAT RESPONSIBLE BIDDER WHOSE BID(S),

CONFORMING TO THIS SOLICITATION WILL BE MOST ADVANTAGEOUS TO THE OWNER. SEE BOARD POLICY 3610.

Project Examination, Reference Documents 1. A mandatory pre-bid examination of the premises will be conducted at the time(s) and date(s) indicated in the

Bid Advertisement. All bidders are required to attend. Questions regarding the bidding or the project may be asked at the examination, but all valid interpretations or revisions to the bid proposal documents shall be made by issued addendum.

2. Before submitting proposals for the work, each bidder should have examined the premises, and satisfied itself as

to the conditions under which it will be obligated to operate in performing its part of the work, or that will in any manner affect the work under its contract.

3. All bidders shall tour the building(s), and familiarize themselves with the work contemplated in the contract.

Submission of a bid shall be deemed conclusive evidence that the bidder has familiarized itself with the work contemplated by the bid and shall constitute a waiver by each of all claims of error in bid, withdrawal of bid, or payment of extras, or combination thereof, under the executed contract, or any revision thereof. All figures and/or diagrams referencing sizes, or amounts, or materials are estimates. The bidder is solely responsible for its’ own measurements.

Workers Rights 1. The Contractor shall comply with the Michigan Civil Rights Act which states that Contractors shall not

discriminate in hiring or in its terms and conditions of employment on the basis of race, religion, creed, national origin, color, sex, marital status, age, height or weight, nor on bona fide job requirements. Neither shall a Contractor discriminate in the sales of products or the rendering of services pursuant to this contract on the basis of any of those categories.

Insurance Requirements 1. The Contractor shall protect, defend and indemnify the Owner and the Owner’s Representative, their officers,

agents, servants, volunteers, and employees from any and all liabilities, claims, liens, demands, and costs of whatsoever kind and nature which may result in injury or death to any persons, and for any that result in injury or death to any persons, and for loss or damage to any property, including property owned or in the care, custody, or control of the Owner in connection with or in any way incident to or arising out of the occupancy, use, service, operations, or performance of work in connection with this Agreement resulting in whole or in part from negligent acts or omissions of the Contractor, any Subcontractor, or any employee, agent, or representative of the Contractor or any Subcontractor.

CERTIFICATES OF INSURANCE A. Before commencement of any work, a Certificate of Insurance executed by bidder's insurance carrier showing

required insurance coverage shall be submitted. An endorsement or statement waiving the right of cancellation or reduction in coverage unless thirty (30) days prior written notice is given to Owner by registered or certified mail shall be included.

B. 1. Insurance Coverages

As a condition of performing work as a contractor, you must provide us with satisfactory evidence of your insurance coverages as follows:

a. Worker’s Compensation and Employer's Liability Insurance covering your statutory

obligations in the state(s) in which you work for us is to be performed. Coverage for your liability under the Longshoreman (USL&HW) or Maritime (Jones Act) statutes must be included in your coverage if any of your work for us is on or over navigable waterways or involves your use of any vessel.

b. Automobile Liability Insurance with a limit of $1,000,000 per accident covering your

owned, non-owned and hired automobiles.

2. Other Requirements

a. Evidence of your insurance coverages, required herein, is to be provided to us on ACORD

Certificate Form 25-S and must indicate:

1. A Best's rating for each of your insurance carriers at A-VII or better,

2. That the issuing insurance company will provide thirty (30) days written notice of cancellation to the certificate holder and the words "endeavor to" and "but failure to mail such notice shall impose no obligation or liability of any kind upon the company, it agents or representatives" do not apply or have been removed.

3. That "Nova Environmental, Inc." and "Lansing School District" are additional

insured on the General Liability policy certified,

4. Any deviations in coverage provided by the Standard 1986 ISO Simplified General Liability policy form, and any such deviations will not be acceptable unless specifically approved in writing by Nova Environmental, Inc. and Lansing School District, and

5. Any deductibles over $2,500 applicable to any coverage, provided that any such

deductible over $2,500 will not be acceptable unless specifically approved in writing by Nova Environmental, Inc., and Lansing School District.

b. The General Liability and/or Umbrella policies must be primary and not excess over or

contributory with any other valid, applicable, and collectible insurance in force for Nova Environmental, Inc., and Lansing School District.

c. General Liability and Auto Liability limits may be attained by individual polices or by a

combination of underlying policies with umbrella and/or excess liability policies.

d. The Contractor waives subrogation rights against Nova Environmental, Inc., and the Owner for property damage to property covered by valid and collectible property insurance, and will include this same requirement in contracts with its Subcontractor and Suppliers. If the policies of insurance referred to in this paragraph require an endorsement to provide for continued coverage where there is a waiver of subrogation, the owners of such policies will cause them to be so endorsed.

e. Contractor will provide Contractor's equipment floater coverage and agree it and its

insurance carriers will waive subrogation against Nova Environmental, Inc., and/or the Owner for claims paid by such insurance.

Contractor Responsibility

1. The Contractor shall exercise proper precaution at all times for the protection of persons and property and shall

be responsible for all the damages to persons or property either on or off the site, which occur as a result of its fault or negligence in connection with the prosecution of work. The safety provisions of applicable laws and OSHA standards shall be observed and the Contractor shall take or have cause to be taken such additional safety and health measures as the Owner or the Owner's Representative may determine to be reasonably necessary.

2. Neither the final certificate nor final payments, nor any provision in the contract documents shall relieve the

Contractor of responsibility for defects in workmanship or faulty work or materials. The Contractor shall correct any defects due to faulty work or materials and pay for the damage to other work resulting therefrom, which shall appear within a period of one year from the date of completion unless otherwise stated in this document. The Owner shall notify the Contractor of observed defects with reasonable promptness.

3. The Contractor shall furnish the Owner with a written guarantee to remedy any defects due to faulty materials

or workmanship which appear in the work within one year from the date of final acceptance by the Owner. 4. It is the intent of the Owner to award the contract to Contractors fully capable, both financially and with regards

to experience, to perform and complete the work in a satisfactory manner. 5. The Contractor shall have a representative available for all meetings, presentations and public relation

appearances deemed necessary by the Owner. The Contractor will be made available for such activities for one year following the signed contract.

Pre-Start Job Meeting 1. The awarded Contractor shall attend a pre-start job meeting. At this meeting the Contractor may be required to

furnish proof of employees’ wages.

Permits, Fees, Regulations and Taxes 1. The Contractor shall obtain and pay for all permits, assessments, fees, bonds, and other charges as necessary to

perform and complete the work of this contract, including connection charges and inspections fees. 2. The Contractor shall be responsible for obtaining all permits and licenses (building, electrical, heating, and

ventilation, and plumbing permits) necessary for the proper completion of said project(s). Permits and licenses are available from the appropriate agencies having jurisdiction. The Contractor shall give all notices, pay all fees and comply with all laws, ordinances, rules and regulations bearing on the work. If any of the work of the Contractor is done contrary to such laws, ordinances rules and regulations without such notice, he shall bear all costs arising therefrom. The Contractor shall include all costs and taxes in its bid, and make proper provisions for payment of all other State and Federal applicable taxes, fees or other costs.

3. The Contractor shall present at the pre-start job meeting evidence of all required permits. The Contractor is

advised that timely inspections by the applicable inspection departments are a requirement of this contract and are a condition of progress and final payments. All inspections will be final and a certificate of occupancy, where applicable, will be required before final payment will be made.

4. The Owner is NOT automatically exempt from State of Michigan Sales and Use Taxes. The Owner must pay

these taxes when materials are to be incorporated into realty. Hence, for materials that are permanently attached, built-in, incorporated or otherwise made part of the structure all applicable taxes shall be paid by the Contractor. The Owner is exempt from sales and use taxes if the materials are moveable and are not permanently made part of the structure, (i.e., public address consoles).

Patents and Royalties 1. The Contractor shall also comply with the following provision excerpted in part from AIA Document A201/CM

4.17.1.

The Contractor shall pay all royalties and license fees, shall defend all suits or claims for infringement of any patent rights and shall save the Owner and the Owner's Representative harmless from loss on account thereof, except that the Owner, or the Owner's Representative as the case may be, shall be responsible for all such loss when a particular design, process or the product of a particular manufacturer or manufacturers is selected by such person or such person's agent. If the Contractor has reason to believe that the design, process or product selected is an infringement of a patent, that party shall be responsible for such loss unless such information is promptly given to the Owner and/or the Owner's Representative.

Fax bids will not be accepted. Materials To Remove: Contractor is responsible for the removal/remediation of the following material:

1. Remove all ceiling panels from the pool area (approximately 5,000 Sq. Ft.) and associated grid and support wires flush with plaster ceiling above drop.

2. Remove and dispose of wood display cases. 3. Remove/scrape all visible delaminated paint from the walls. 4. Contractor shall temporarily support all light fixtures and HVAC systems. 5. Contractor shall remediate (brush areas of the plaster ceiling to dislodge the efflorescence, thus facilitating prep

work for painting of the ceiling. 6. Contractor shall use a fungicidal paint approved by the owner and apply paint to the plaster ceiling

(approximately 5,000 Sq. Ft.). Paint shall be consistent with Fosters or Kilz and color shall be white. Setup and engineering controls:

1. Contractor shall construct walls to the 2’ x 2’ ceiling grid – Approximately 15 foot walls. 2. Contractor shall construct floors of polyethylene sheeting and plywood protection for the pool. 3. Contractor shall achieve Negative Air consistent with Asbestos Abatement procedures. 4. Contractor shall seal pool drains. 5. Contractor shall construct a shower w/decontamination stages for this project.

PPE Requirements – A copy of potential hazards are attached

1. All workers shall wear disposable coveralls. 2. All workers shall don appropriate respirators for protection. 3. All workers shall utilize latex gloves for removal/remediation process.

Disposal

1. All debris shall be placed in sealed drums for disposal to an approved landfill. Additional Information

The Contractor is responsible for all measurements. Measurements for bidding purposes as well as material

procurement are the sole responsibility of the Contractor. The Contractor is responsible for remediation of all materials whether identified in the Scope-of-Work, the maps/pictures or not.

2. The Contractor is responsible for returning the work area to the Owner in a condition that satisfies the

Owner and the Owner’s representative. 3. The Owner shall provide necessary utilities whenever possible. The Contractor shall be responsible for

providing any necessary utilities (for Contractor and Owner's Representative) to complete the projects as scheduled, if not provided by the Owner.

4. Complete decontamination chambers with showers shall be constructed for the projects. The Owner and

the Owner's Consultant must approve the decontamination chamber location, bag out location, Air Filtration device (AFD) placement and dumpster location.

5. The Contractor may construct a bag out area to facilitate disposal of the materials. The bag out chamber (2

chambers) shall be constructed of wood frame and plywood and shall be sealed with polyethylene (walls/floors/ceilings). The bag out area shall have a wood door with lock.

6. The Contractor shall be responsible for the security and safety of the building. 7. The Contractor is responsible for any damage to surfaces, electrical and mechanical equipment. The

Contractor shall be responsible for repairing (painting) surfaces: walls, ceilings, floors, windows, doors etc… The Contractor is responsible for all damage resulting from removal operations. All wires shall be properly adhered with cable ties to appropriate hangers.

8. All areas shall be encapsulated with an Owner’s Consultant approved biocide agent following remediation

activities to minimize the potential for subsequent fungal growth. 9. The Workers shall wear PAPRs and appropriate disposable clothing for all remediation activities. 10. The Contractor shall supply a manometer and will be required to maintain a minimum negative pressure of

.02 inches of water equivalent. In addition, the Contractor must smoke test the enclosure daily at a minimum.

11. Six sided locked dumpsters only - no open top dumpsters. Dumpsters must be removed from the premises

within two (2) days of project completion. 12. The Contractor shall provide utility lighting for all work areas as necessary. 13. No salvaging, by the Contractor or their employees, of any item.

14. The Contractor shall construct wood frame and plywood barriers at all locations requested by the Owner or Owner’s Representative.

15. The Contractor will be required to construct an enclosure that satisfies all the requirements of Appendix F

of OSHA 1926.58 "Work Practices and Engineering Controls for Major Asbestos Removal, Renovation and Demolition Operations and all work activities shall be conducted in accordance with procedures outlined in the EPA Document “Mold Remediation in Schools and Commercial Buildings.”

All projects will be considered complete when the project site has passed required clearance testing, the Contractor has completed removal of all supplies and equipment and the Contractor has returned the building to the Owner in a condition that satisfies the Owner and Owner's Representative. Post Remediation Fungal Clearance Testing Post Remediation Fungal Clearance Samples will be collected, analyzed and results verbally expressed to the Owner and to the Contractor within twenty-four (24) hours, with the time period beginning at the completion of activities. It will be in the judgment of the Owner's Representative as to when the Post Remediation Fungal Clearance Samples will be collected. All Post Remediation Fungal Clearance samples will be analyzed by an AIHA accredited microbial laboratory. Fungal Clearance Samples shall not be collected on the same day as visual inspection and lockdown. The Contractor shall be allowed in the building between the hours of 7:00 a.m. and 6:00 p.m.

All bidders must attend the Pre-Bid Examination and all bidders must tour the building(s), and familiarize themselves with the work contemplated in the contract. The submission of a bid for this/these project(s) shall be deemed conclusive evidence that the bidder has thoroughly examined all documents constituting this specification, has familiarized himself with the work and requirements contemplated by this contract and shall constitute a waiver by each of all claims of error in bid, withdrawal of bid, or payment of extras, or combination thereof, under the executed Contract, or any revision thereof. All figures set forth in the above bid(s) referencing sizes, amounts, or materials are estimates only and are provided for the convenience of the bidder. The bidder is solely and completely responsible for his own measurements and for his own determination regarding the scope of the project(s). These specifications including, but not limited to, the Bid Advertisement, the Bid Proposal Packet, and the Fungal Control Technical Specifications for Remediation and Cleanup have attempted to detail and address all aspects of the project(s) being performed for the Owner. Nonetheless, the successful completion of the project(s) in a safe manner and in compliance with all applicable regulations remains as the foremost concern of the Owner. To ensure that this goal is met, it is expressly agreed by and between the parties to the contract, hereinafter to be signed between the Owner and the Contractor, that the Owner and/or it's Representative may require and enforce more stringent or different provisions, as they relate to this project, should they, in their discretion, determine that such changes will or may more fully protect the Owner, the Contractor, their subcontractors, agents, servants or others under their control or direction or the general public from any risks and/or situations associated with said project(s). This provision in no way constitutes a waiver by the Contractor of his/her responsibilities to conduct said project(s) in accordance with all applicable regulations and in accordance with his/her duties as set forth in all laws, statutory and common.
