REQUEST FOR PROPOSAL The Navajo Nation Child Care and Development Fund Program for Service Contract Install Iron Fence and Gates in Tuba City, AZ at Child Care Center Bid No. 15- 03- 1339LE SCOPE OF SERVICE: Install a wrought Iron coated black Fence and Gates around the Tuba City Child Care Center in Tuba City, Arizona; the iron fence panels will provide an enclosing of Child Care Center property with Playground equipment. Prices for all items bid must include both delivery and installation, all materials, equipment and taxes. Preliminary work: Before bid and installation or placing of fencing, conduct a field site visit to Tuba City, Arizona for exact size measurements and existing condition verification. Clearing Site: The contractor shall be responsible for clearing site required to access the child Care Center site. This may require, but not limited to, clearing brush, weeds, debris, and other material, vegetation and growth. The cost of clearing site shall be included in the unit cost of fence being constructed. The contractor shall fully guarantee its products for a period of one ( 1) year against all defects in materials, installation and workmanship. If any failures or defects occur, the contractor shall replace the item within fifteen ( 15) days of notification at no cost to the Navajo Nation Child Care & Development Fund Program CCDF). SCOPE OF SERVICE:

INSTRUCTION TO BIDDERS

A. ISSUING OFFICE: This Request for Proposal ( RFP) is issued for the Navajo Nation Child Care and

Development Fund Program, P. O. Box 2425, Window Rock, Arizona.

B. PURPOSE: This RFP provides prospective proposals with sufficient information to enable them to

prepare and submit for consideration.

C. SCOPE: This RFP contains the instructions governing the proposals to be submitted and the materials

to be included therein; mandatory requirements which must be met to be eligible for considerationand other requirements to be met.

D. SCHEDULE OF ACTIVITIES: DEADLINE:

E. INQUIRIES: Prospective proposals may make telephone or written inquiries concerning this RFP toobtain clarification of requirements. No inquiries will be accepted after the inquiry deadline as listed inSection D. Mail inquiries are to be addressed to Attn: Gary Litzin, Construction Inspector.

F. ADDENDUM OF SUPPLEMENT TO THIS REQUEST FOR PROPOSALS: In the event that it becomes

necessary to revise any part of the RFP, an addendum will be issued.

PROPOSALS SUBMISSION: Proposals must be received on or before April 1, 2015. Business proposals

who are mailing their proposals should allow sufficient time for mail delivery to insure receipt by thetime specified. If mailed, it is recommended that proposals be sent by certified mail to the addressindicated on the cover sheet of the RFP. NO LATE PROPOSALS WILL BE ACCEPTED.

THREE ( 3) COPIES OF THE PROPOSAL ARE REQUIRED: The original and three copies must be delivered

in a sealed envelope. The outside of the envelope should be clearly marked with the project name,include the name, address of the business submitting the proposal.

In accordance with the Navajo Nation Business Opportunity Act (NNBOA), business that have NavajoNation preference shall identify their Priority Number (Priority# 1 or Priority# 2) on the sealedpackages in the lower left hand corner.

G. REJECTION OF PROPOSALS: Child Care & Development Fund Program ( CCDF) reserves the right to reject

any or all proposals and to waive informalities and minor irregularities on proposals received.

H. PROPRIETARY INFORMATION: Any restrictions on the use of data contained within any proposals must beclearly stated in the proposal itself. Proprietary information submitted in response to this RFP will behandled in accordance with the applicable purchasing procedures. Each and every page of the proprietarymaterial must be labeled or identified with the word " PROPRIETARY".

I. RESPONSE MATERIAL OWNERSHIP: All material submitted regarding this RFP shall become property ofthe Navajo Nation and will not be returned to the business. Responses received will be retained by thePurchasing Services Department and may be reviewed by any person after final selection has been made,subject to paragraph K below. The Purchasing Services Department has the right to use any or all systemideas presented in reply to this RFB, subject to limitations in paragraph K below. Disqualification or non-selection of a proposal or bid does not eliminate this right.

J. INCURRING COSTS: The Navajo Nation Purchasing Services Department and Navajo Nation Child Care &

Development Fund Program is not liable for any cost incurred by the proposal prior to issuance of acontract.

K. ACCEPTANCE OF PROPOSAL CONTENT: The contents of the proposal of the successful proposal will

become contractual obligations if acquisition action ensues. Failure of the successful proposal to accept

these obligations may result in cancellation of the award and such proposal may be removed fromconsideration for future solicitation. The Navajo Nation Purchasing Services Department and NavajoNation Child Care & Development Fund Program reserves the right to pursue appropriate legal action in

the above set of circumstances.

L. ACCEPTANCE TIME: The Navajo Nation Division of Social Services— Child Care & Development Fund

Program, intends to make a vendor selection within thirty (30) days after the closing date for receipt ofproposals.

M. AWARD OF BID: Upon selection, a contract document will be prepared to the contractor and the proposal

submitted by the contractor will become part of the contract.

N. EVALUATION PROCEDURES AND CRITERIA:

1. A Review Committee will review and will judge the proposals received in accordance

with the general criteria used herein. The team may request oral presentation by theorganization proposing. Proposals should prepare to provide any additional

information the team feels is necessary for a fair evaluation of proposals.

2. Failure to provide any information requested in the RFP may result in disqualificationof the proposal. All proposals must be endorsed with the signature of a responsible

official having the authority to bind the proposal to the execution of a contract.

3. The sole objective of the review team will be to select the proposal that is most

responsive to the needs of the Navajo Nation Child Care and Development Fund

Program. The specifications in this RFP represent the minimum performance criteria

necessary for a response. On the basis of the evaluation criteria established in thisRFP, the Review Committee will select and recommend the proposal who best meets

this objective.

4. Evaluation Criteria: The following criteria will be used by the selected proposedreviewing Committee in the selection process for contract award. The technicalproposal factors will be rated on a scale of 1- 100 with weight relations as stated

below.

Navajo Business Preference:

Native American Preference 20 Points

Technical Proposal Factors: 10 Points

Staff and Qualifications: 10 Points

a. Staff Training, education,And experience

Experience: 20 Points

Service: 20 Points

Costs Control: 10 Points

Ancillary and Incidental Services: 10 Points

Cost/ Price Factors:

The importance of cost factors in the selection will depend upon the magnitude of the

cost differentials identified, the credibility of such differential, the keenness ofcompetition in the Technical Proposal, and the impact of other factors. The burden of

proof as to cost credibility rests with the offeror. Proposed costs will be evaluated notonly to determine if the estimate is reasonable, realistic and cost effective, but also todetermine the offerors understanding of the program and ability to organize andperform the contract. Cost/ price factors will not be numerically weighed and scored.

0. STANDARD CONTRACT: The Navajo Nation reserves the right to incorporate standard contract provisions

into any contract negotiations as a result of a proposal submitted in response to this RFP.

P. RETURN OF PROPOSALS: The Navajo Nation has no obligation to return any proposals received inresponse to this RFP.

0.. TERMS AND CONDITION: This purchase between the Navajo Nation and the bidder will follow the scope of

work outlines in the RFP. The successful bidder will be notified immediately after the selection. Once the

bidder is selected, a meeting shall be held between the successful bidder and CCDF Program to discuss thetimeline.

A. PROPOSAL REQUIREMENTS: All proposals must have as a minimum, the capabilities listed herein

and the bid proposal submitted must reflect in detail the inclusion of these services as well as the

degree of expertise in utilizing these capabilities.1. Licensed, performance bonded, and current General Liability.2. Prospective recipient shall sign a Navajo Nation Debarment and Suspension Waiver form, to be

provided by CCDF.

3. Must Submit Listing and provide all Licenses, Certification, Awards, Degree with Proposal4. Prospective recipient shall sign a Tax Form —W9.

B. Responsible for providing fence installation, supervision, materials, equipment, transportation, and

a general warranty for the material and service.

BILLING AND PAYMENT:

1. Billing and payment shall conform to all Navajo Nation procurement procedures. Vendor will

provide original invoices for each service by Child Care Center and forwarded to CCDFAdministration Accounting Office for payment to be processed.
