TERMS AND CONDITIONS TO BE TAKEN INTO ACCOUNT BY SERVICE
PROVIDERS
This Request for Proposal (RFP) has been compiled by the NHBRC and it is made
available to the Bidders on the following basis.
Bidders submitting a Bid in response to this RFP are deemed to do so, on the
basis that they acknowledge and accept the terms and conditions set out below:
1. The NHBRC reserves the right to amend, modify, withdraw this RFP or any of the
procedures or requirements set out herein at any time without prior notice and
without liability to compensate or reimburse any person. If the NHBRC amends this
RFP, the amendment will be sent to each Bidder in writing or publicized as the
case maybe. No oral amendments by any person will be considered or
acknowledged.
2. The premises of the bidder should be open at all reasonable hours for inspection
by representatives of the NHBRC. This is done in order to confirm any information
provided by a Bidder in the RFP Bid.
3. This RFP is not intended to form the basis of a decision to enter into any
transaction involving the NHBRC, and does not constitute an offer or
recommendation to enter into such transaction, or an intention to enter into any
legal relationship with any person.
4. A Bid submitted in response to this RFP will constitute a binding offer which will
remain binding and irrevocable for a period of six months from the date of
submission to the NHBRC. The offer constituted by the Bid will be deemed not to
have been accepted and no agreement will be deemed to be reached with any
Bidder, unless and until a definitive Agreement and other related transaction
documents are concluded between the NHBRC and the Preferred Bidder.
5. Neither the NHBRC nor any of their respective directors, officers, employees,
agents, representatives or advisors will assume any obligation for any costs or
expenses incurred by any party in or associated with preparing or submitting a Bid
in response to the RFP. All costs associated with the preparation and submission
of the Bid is the responsibility of the Service Provider. The costs shall not be
chargeable to the NHBRC by successful or unsuccessful Bidder.

6. No entity may be involved, whether directly or indirectly, in more than one Bid in
response to this RFP. A failure to comply with this requirement may, within the
sole discretion of the NHBRC, result in disqualification of the relevant entity.
7. Any material change in the control and/or composition of any Bidder or any core
member of a Bidder after submission of a Bid, shall require the prior written
approval of the NHBRC, and any failure to seek such approval from the NHBRC
shall result in the NHBRC being entitled, in its sole discretion, to exclude the
relevant Bidder from any further participation in the bid process. The NHBRC shall
be the sole arbiter as to what constitutes a “material change in the control and/or
composition of any Bidder”, and as to what constitutes a “core member of a Bidder”
for purposes of such approval. Any request for such approval shall be made to the
NHBRC in writing and shall provide sufficient reasons and information to allow the
NHBRC to make an informed decision. The NHBRC reserves the right to accept
or reject any such request for approval at its sole discretion.
8. The NHBRC and its advisors may rely on a Bid as being accurate and
comprehensive in relation to the proposals provided therein by the Bidders.
9. All bids information submitted to NHBRC will become the property of the NBHRC
and will as such not be returned to the bidder. The NHBRC will make all
reasonable efforts to maintain proposals in confidence. Proprietary information
should be identified as such in each proposal.
10. RFP shall be considered irregular if they show any omissions, alteration of form,
additions, or conditions not called for, or irregularities of any kind. However, the
NHBRC reserves the right to waive any irregularities and to make award in the
best interest of the company.
11. The NHBRC reserves the right to appoint one or more service providers.
12. RFP’s shall be rejected, among other reasons, for any of the following:
RFP’s received after the closing date and time as specified.
Collusion among bidders and upon detecting that the B-BBEEE status level
of contribution has been claimed or obtained in a fraudulent manner.
Incomplete work that in the judgment of the company shall prevent or hinder
the prompt completion of additional work, if awarded.
All Bids must be formulated and submitted in accordance with the requirements of this
RFP.

PART A– NHBRC BACKGROUND
1. About NHBRC
1.1 The National Home Builders Registration Council (NHBRC) is a regulator body of
the home building industry. Our goal is to assist and protect housing consumers
who have been exposed to contractors who deliver housing units of substandard
design, workmanship and poor quality material. No matter the size or value of your
home building project the NHBRC is here to protect you, the housing consumer.
1.2 Established in 1998, in accordance with the provisions of The Housing Consumers
Protection Measures Act (Act No. 95 of 1998) the NHBRC’s mandate is to protect
the interests of housing consumers and to ensure compliance to regulated building
industry standards.
2. NHBRC Services
2.1 Home Builder Registration
2.1.1 Every home builder is required by law to be registered with the NBC. Registration
allows access to funding from financial institutions, access to NHBRC home
building materials, training programs and intervention by the NHBRC to maintain a
healthy working relationship between the builder and client.
2.1.2 Applications for registration are evaluated on:
1. Submission of completed registration forms
2. Payment of prescribed fees
3. Technical assessments
4. Financial assessments
5. Completion of NHBRC orientation and induction programs
2.2 Enrolment of new homes
2.2.1 The Housing Consumers Protection Measures Act 1998 requires all new homes to
be enrolled with the NHBRC 15 days prior to construction. The home enrolment
insures consumers against poor building practises and permits the NHBRC to
conduct building inspections at key stages of construction. Enrolment of homes is
subject to a fee which is scaled according to the value of the home.
2.2.2 Home Inspection NHBRC inspections are designed to mitigate building risks for the
consumer and to protect against poor workmanship during construction.

Depending on the enrolment values of the home, a newly enrolled home can be
subject to a minimum of four and a maximum of eight inspections. Where
necessary, the NHBRC will provide dispute resolution on site between the builder
and consumer. In the situation where the NHBRC inspector identifies a deviation
from NHBRC building guidelines, a non-compliance certificate will be issued to the
builder.
2.2.3 The builder will be obligated to rectify such non-compliance within a given
timeframe. If the builder is unable or unwilling to rectify it, the NHBRC has the
mandate to stop construction and undertake disciplinary action against the builder.
2.3 Complaints and conciliation
2.3.1 The complaint procedure aims to resolve disputes between housing consumers
and builders by ensuring that builders meet their obligations. The NHBRC deals
with three types of complaints:
a. Three month non-compliance period
Complaints relating to minor structural defect identified within three months of
occupation of the home.
b. One year roof leak period
Complaints relating to roof leaks identified within one year of occupation of the
home.
c. Five-year major structural defects period
Complaints relating to major structural defect identified within five years of
occupation of the home.
2.4 Suspension on Home Builders
2.4.1 The NHBRC may withdraw the registration of a builder where it has found that the
builder is guilty of failing to meet obligation in terms of the Act or where the building
company has been placed under voluntary liquidation. Following an investigation
and/or reasonable time to afford the builder an opportunity to affect corrective
measures, the NHBRC may suspend a builder's registration and/or the right to
enroll homes where it has found that:
1. The builder has failed to rectify reported building defects
2. The builder has failed to rectify non-compliance issued by the NHBRC
3. A situation requires immediate intervention and that such is in the best interest
of the consumer.

2.4.2 Suspended home builders are subject to the NHBRC Disciplinary Hearing Process
which can result in the disciplinary action or prosecution.
2.5 Industry Advisory Services
2.5.1 Working with the Department of Human Settlements the NHBRC is able to provide
advisory services on:

2.6 Builder training and development
2.6.1 The NHBRC provides free technical training to emerging builders. Contact a
NHBRC office nearest to you to find out more about our training programs and
schedule.
3. Business overview
The NHBRC is a medium sized organization with a staff complement of 420
employees. The NHBRC’s head office is located in Bryanston, Gauteng with 9
regional offices of varying size, and 12 satellite offices.

PART B –TERMS OF REFERENCE
The National Home Builders Registration Council (NHBRC) invites suppliers from SETA
accredited training providers to deliver unit standards- based training. The training will
carry credits towards a qualification in National Certificate: Building & Civil Construction.
The service provider must be conversant with the South African housing legislation, any
other relevant acts and the housing scenario in general. Service providers must comply
with the Preferential Procurement Policy Framework Act No 5 of 2000, the NHBRC
Procurement Policy, Tender Conditions, Technical Specification and Quality Assurance
provisions by the CETA and other relevant SETAs.
1. Purpose
1.1 In terms of the Housing Consumer Protection Measures Act (Act 95 of 1998) Clause 3(h) the
National Home Builders Registration Council has to assist home builders to achieve and
maintain satisfactory technical standards of the home building industry, through training and
inspection. The NHBRC has set aside funding for the skills programme training of emerging
contractors.
1.2 The Council’s Strategic Corporate plan also makes emphasis on the training of historically
disadvantaged home builders, in order to accelerate their career progression in the home
building industry.
1.3 This programme is aimed at developing and empowering a pool of emerging contractors to be
fully fledged contractors that will meet NHBRC’s technical requirements, as stipulated by the
home builders manual. Furthermore, this programme is intended at centralizing and managing
home builders training and development in liaison with the National and Provincial housing
departments
1.4 The National Home Builders Registration Council intends to appoint suitably qualified CETA -
Accredited Training Providers to deliver a national skills programme, which will lead to
credits towards a qualification in National Certificate: Building & Civil Construction.
2 Background
2.1 Regional training service report grouping
The NHBRC decided to subdivide the Province(s) to reflect spatial service delivery of
training services. This is also aimed at deriving maximum economic benefit of training
service throughout all regions of the province in line with the official provincial
demarcation.

2.6 . General risks
Please note that numbers of trainees cannot be guaranteed and spatial demographics of each region
and province will affect the numbers of trainees available and may result in declining or increasing

NB: If the number of learners registered by the supplier exceeds the benchmark/stated number
as per schedule of quantities by 20%, a special written approval shall be sought for the order
of additional learners.

4. Duration of Panel
4.5.1 The duration for the services will be for a period of three (3) years.
4.5.2 The services shall be terminated by the NHBRC due to poor performance without
prejudice to any of the parties.
5. Management And Staff
a) Management
The management of the service provider must have experience in the construction
industry of at least one (1) year.
b) Key Account Manager
It is a requirement that a Key Account Manager be the overall contact person for
the NHBRC and he or she will be responsible for the implementation and co-
ordination of the agreement.
c) Staff
Qualified and knowledgeable and experienced staff must be provided by the
service provider.

Curriculum Vitae must also be included with the written proposal for this resource.
The replacement of staff must be of a similar standard and level of experience, skill
and knowledge.
Be available to work during periods of heightened activity.
Indicate ability to source additional staff as required, and should include but
not be limited to the following:

6. Requirements of the service providers
6.1 Accreditation
6.1.1 In order to be eligible to be considered each service provider is required to have
following:
The official accreditation by CETA must be clearly stated as such or any other accredited SETA, that particular skills authority database and records shall be verified to ensure that they provide equivalent accreditation, and thereafter the database so verified, will be used for acceptance of the accreditation supplied.
All proof of accreditation documents will be verified with the relevant accrediting authority or body.
6.2 Special Conditions of Contract
a) Training must be aligned to NHBRC Home Building Manual.
b) Provision of the NHBRC Building Manual shall form part of the learning materials
for all Technical training modules.
c) Sound knowledge and understanding of all relevant Skills Development
legislation.
d) The Service Provider management must have at least one (1) year relevant
experience within the Construction sector.

e) The Service Provider must have Communication Skills and Tools, including but
not limited to email and telecommunication facilities, report writing and
interpersonal skills.
f) The Service Provider must have at least 1-year experience or equivalent within
the building and/or construction industry training environment
g) The Service Provider should preferably demonstrate multi-lingual proficiency.
h) The Service Provider must have capacity to deliver training within 14 calendar
days of training being scheduled by NHBRC
i) The Service Provider must be willing to deliver onsite training where required,
including remote rural areas
j) The Service Provider must be willing to deliver training at various sites, including
remote rural areas
k) The Service Provider must demonstrate capacity for purposes of expediting this
training, including but not limited to accredited assessors/facilitators, financial
capacity, material development, learner support, office infrastructure, provision of
nutritious meals to learners (at R50.00 per learner per day), schedule plans,
training venues and transport. (Fees structure below is inclusive of all travel,
meals, support and study as mentioned on the list of deliverables)
l) The Service Provider will submit a detailed Project Plan on training to be
conducted.
m) The Service Provider shall be expected to sign a Programme Commitment to
complete training.

6.3 Fee Structure
6.3.1 Qualifying service providers will be appointed on an ad-hoc basis as the need
arises for a specific period. The NHBRC will pay rates ranging from R250.00 to R350.00
per learner per day.

PART C –EVALUATION PROCESS
In accordance with the NHBRC Supply Chain Management Policy, the tender
evaluation process shall be carried out in two stages namely:
Stage 1 : Compliance check of Mandatory Documents
Stage 2 : Functional or technical evaluation

The bidder documents will be assessed at this stage of the process to establish
compliance with the standard conditions of the tender as described under
Terms and Conditions and under the heading ‘1.1 Mandatory Requirements’
below.
The bidder must indicate compliance with the mandatory requirements by
ticking under “Comply” or “Not Comply” and should the bidder not indicate or
does “Not Comply” the bidder will be disqualified from the evaluation process.
Document proof of specific mandatory requirements must be attached to the
relevant form failure which will result in the disqualification of the bid from the
