WDFW Hatchery Maintenance

Various hatchery maintenance activities

1. This Hydraulic Project Approval (HPA) authorizes the maintenance activities at specific siteslisted in the attachment entitled 'DFW Planned Maintenance Activities.xls' which are necessary forthe continuing operation of Washington Department of Fish and Wildlife (WDFW) owned and/ormaintained finfish hatchery facilities. The following maintenance activities are authorized by thisHPA:a. Routine intake and outfall maintenance (sediment removal)b. Large Woody Material (LWM) repositioningc. Organic material and debris removald. Temporary fish trapping, rack installation, maintenance, re-installation during the trappingseason. Racks may be associated with a temporary or permanent trapping structuree. Instream adult holding and/or trapping pond maintenancef. Vegetation management.Any other hydraulic project activities, including emergencies, require a separate HPA. EmergencyHPAs can be obtained by calling the local Habitat Biologist (HB) during normal business hours, orthe after-hours hotline number of (360) 902-2537.

2. NOTIFICATION REQUIREMENT: Three days prior to the start of any operation, other thannormal screen cleaning and removal of minor organic debris such as leaves, twigs, etc., within theordinary high water line (OHWL) of waters of the state, the Regional Habitat Program Manager(RHPM) shall be notified (see attached list). Notification may be by mail, FAX, or e-mail and shallinclude the starting date, description of work, location, and the control number of this HPA.

3. TIMING LIMITATIONS: Routine maintenance authorized under this HPA may begin immediatelyand shall be completed by June 29, 2019, within the following limitations:a. Sediment removal (1a) work shall be conducted during the time periods specified in theattachment entitled 'ALLOWABLE FRESHWATER WORK TIMES April 2014.doc' in fish bearingwaters.b. Fish traps or racks shall be placed and maintained in the stream either during the time periodsspecified in the attachment entitled 'ALLOWABLE FRESHWATER WORK TIMES April 2014.doc'orno more than one week prior to the anticipated return or out-migration of the targeted stock andentirely removed no more than three days after completion of the trapping operation.

4. Work under this HPA shall be accomplished per plans and specifications approved by theWDFW entitled JARPA as received April 16, 2014, including the attachment entitled "DFW PlannedMaintenance Activities.xls", except as modified by this HPA. A copy of these plans shall beavailable on site during construction.

5. FISH KILL/ WATER QUALITY PROBLEM NOTIFICATION: If at any time, as a result of projectactivities, fish are observed in distress, a fish kill occurs, or water quality problems develop(including equipment leaks or spills), immediate notification shall be made to Washington MilitaryDepartment Emergency Management Division at 1-800-258-5990, and to the local WDFW HabitatBiologist (http://wdfw.wa.gov/conservation/habitat/ahb/).

FISH REMOVAL AND SCREENING (FOR SEDIMENT REMOVAL WORK IN THE WETTEDPERIMETER)6. When conducting sediment removal work (1a), the permittee shall capture and safely move foodfish, game fish, and other fish life from the job site. Invasive species captured shall not be placedback into state waters. The permittee shall have fish exclusion, fish capture, and transportationequipment ready and on the job site. Captured fish shall be immediately and safely transferred tofree-flowing water upstream or downstream of the project site.

7. Any device used for diverting water from a fish-bearing stream and any pump used to bypasswater from the work area within a watercourse shall be equipped with a fish guard to preventpassage of fish into the diversion device pursuant to RCW 77.57.010 and 77.57.070. The pumpintake shall be screened as follows:

a) Perforated Plate: 0.094 inch (maximum opening diameter).b) Profile Bar: 0.069 inch (maximum width opening).c) Woven Wire: 0.087 inch (maximum opening in the narrow direction).

The minimum open area for all types of fish guards is 27%. The screened intake shall consist of afacility with enough surface area to ensure that the velocity through the screen is less than 0.4 feetper second. Screen maintenance shall be adequate to prevent injury or entrapment to juvenile fishand the screen shall remain in place whenever water is withdrawn from the stream through thepump intake.

8. Screening is not required on equipment within areas where all fish have been removed andexcluded.

9. If a gravity pipe bypass is used, it shall be of sufficient size to pass all flows and debrisdownstream of the project site for the duration of the project.

BYPASS10. If heavy equipment is used to clean out an intake, outfall, or instream holding pond, a temporarybypass, cofferdam, or similar structure used to divert flow around or away from the work area shallbe in place prior to initiation of work in the wetted perimeter except when all of the

following three conditions are met:a. Fish removal and screening provisions are followed,b. Work is performed during the attached work windows (Attachment 1), andc. Water quality provisions are met.

11. A temporary bypass cofferdam, or similar structure is not required when any of the followinginstances exists, and the provisions of this HPA can still be met:a. When installing a coffer dam, bypass or similar structure would cause greater impacts to fish lifethan it would prevent;b. When the work area is in deep or swiftly flowing water;c. When turbidity is not a concern (i.e. the stream is dry, very slow flow);d. When fish can be excluded by nets or screens, ore. When fish are not present.

12. The bypass or berm shall be of sufficient size to pass all flows and debris for the duration of theproject.

13. Back water shall not enter the work area from the bypass downstream end. If needed: Asandbag revetment or similar device shall be installed at the downstream end of the bypass toprevent backwater from entering the work area.

14. Water removed from within the work area shall be routed to an area landward of the OHWL toallow removal of fine sediment and other contaminants prior to being discharged to the waters ofthe state.

15. The de-watering discharge point shall be designed and operated so as not to cause erosion orscour in the stream channel, banks or vegetation.

16. Prior to releasing the water flow to the project area, all work below the OHWL shall becompleted.

17. Upon completion of the project, all material used in the temporary bypass shall be removedfrom the site and the site returned to pre-project or improved conditions.

18. Reintroduction of water to the channel shall be done gradually and in stages so as to minimizethe mobilization of sediments and fines into downstream waters.

EQUIPMENT19. Equipment used for this project shall be free of external petroleum-based products whileworking around state waters.

20. Equipment shall be inspected prior to use and at least once during the course of work to ensurethat there are no fluid leaks. If a leak does occur, the equipment shall be immediately removed fromthe area and not used again until adequately repaired. Equipment shall not be left unattendedwithin the stream channel.

21. With the exception of bypass pumps, all machinery and equipment shall be serviced, fueled,and maintained on uplands more than 200 feet from waters of the state to prevent contamination ofsurface waters, when practicable. Fueling areas shall be provided with enough spill containmentmaterials to prevent a spill from reaching waters of the state.

22. Whenever feasible, heavy equipment shall be stationed on and operate from the top of thebank, the roadway, dry gravel bar area, or a work platform (e.g. excavator pads). The drivemechanism of the equipment shall not enter or operate within the wetted perimeter, except toproperly install, set, and remove temporary fish trapping structures. Accumulation of soils, debris,and noxious weeds shall be removed from the drive mechanisms (wheels, tires, tracks, etc.) andundercarriage of equipment prior to using it to conduct work below the ordinary high water line.

23. The permitee shall ensure that WDFW protocols (http://wdfw.wa.gov/ais/) for controlling thespread of aquatic invasive species are implemented during the course of the project. Every effortshall be implemented to control the spread of noxious and nuisance weeds, including but notlimited to: cleaning of equipment of loose vegetation material and seeds before transport.

ROUTINE INTAKE AND OUTFALL MAINTENANCE - SEDIMENT REMOVAL24. Sediment removal in areas that have no fish life may occur at any time on intakes or outfallsprovided no sediment is allowed to impact areas with fish life downstream.

25. Sediment removal operations for intake and outfall maintenance shall not extend more than 100feet from the intake or outfall. Every effort shall be made to keep this distance as minimal aspossible.

26. The amount of sediment removed shall be limited to that necessary to maintain the function ofthe WDFW facility, but shall not exceed the limit identified for each site in the applicationattachment entitled "DFW Planned Maintenance Activities.xls", and should ensure that furtherremoval will not be necessary during fish spawning, intra-gravel development, or out-migration.Sediment removal shall not create an unstable streambed upstream of the point where gravel isremoved; the transition from within the excavation area shall be gradually sloped (approximately5%) to meet the natural stream grade.

27. Some intake facilities have a "Tanner Gate" designed to reduce the accumulation of material inthe intake. At these facilities, the Tanner Gate shall be operated at all times in a manner that willminimize accumulation. This may require frequent (possibly hourly) inspections and adjustmentsduring fluctuating stream flows.

28. Existing stream crossing structures shall be used to cross the stream. The use of existingbridges and culverts is preferred to the use of fords.

29. All sediment removed shall be disposed of at an upland site that prevents it from reenteringstate waters.

LARGE AND SMALL WOODY MATERIAL AND DEBRIS REMOVAL AND RELOCATION30. Floating shear logs may be used to help protect the facility by deflecting debris, including ice.These floating shear logs shall be anchored in a manner to minimize the accumulation of debris atthe shear log.

31. Areas at each facility that tend to accumulate wood and debris shall be inspected frequently.Wood repositioning and debris removal shall be frequent enough to prevent the build-up of largejams. Non-embedded debris shall be removed and disposed of upland so it will not reenter thestream. Non-embedded small woody material may be removed and disposed of upland or returnedto the stream downstream of the work area. Non-embedded large woody material (LWM) shall bereturned to the stream downstream of the work area. LWM embedded in the streambed or banksshall not be disturbed.

32. LWM shall be suspended during its repositioning to minimize damage to the streambed orbanks. Yarding corridors (for LWM) or full suspension shall be used to avoid damage to riparianvegetation.

33. LWM shall not be cut to a length less than the channel width at the OHWL. Root wads shall notbe removed from the LWM trunk. The diameter of the root wad shall not be reduced. If wood mustbe cut beyond these limitations, a separate HPA is required to include mitigation.

34. Where LWM cannot be suspended above the streambed and banks, skid logs or similarmethods shall be used to avoid bank damage. Upon completion of the operation, skid logs shall beremoved in a manner that avoids damage to stream banks and vegetation, and the bank shall berestored to pre-project or improved condition.

35. LWM repositioning shall be accomplished in a manner that minimizes the sudden release ofbedload, logs, or other debris downstream.

TEMPORARY FISH TRAP AND RACK INSTALLATION AND REMOVAL36. If it is necessary to place gravel along the bottom of the rack, it may be obtained from a drygravel bar in the immediate vicinity. Removal of gravel shall be held to the absolute minimumnecessary to ensure the ability of the rack to function properly and shall be no greater than theamount indicated in the application attachment entitled "DFW Planned Maintenance Activities.xls"".

37. The gravel bar from which gravel is taken for placement along the bottom of the rack shall beabove the existing water level and free of pits or potholes when finished. The finished grade shallprovide a smooth slope of at least 2 percent downward toward the wetted perimeter of the stream.

38. The rack shall be maintained in a condition that will allow continuous stream-flow through thearea without creating a significant backwater curve. Adequate personnel and equipment shall beavailable at the site at all times to ensure proper maintenance and necessary action is taken if anemergency occurs.

39. The temporary rack shall be securely anchored to a structure on one bank to allow it to swing to

the bank if a washout occurs. If a washout occurs, the rack shall immediately be removed orreinstalled to prevent further damage to the bed or banks of the stream.

40. Trap and rack installation and removal shall be accomplished in a manner that will minimizedisturbance of the streambed. Each segment of the structure shall be lifted by hand or withequipment and transported to or from the stream with full suspension so that it does not drag on thebed or banks of the stream.

INSTREAM ADULT HOLDING AND TRAPPING POND MAINTENANCE41. The instream pond may be cleaned on an annual basis by sluicing material downstream,provided there is less than one-half cubic yard of material and downstream spawning areas can beprotected from sediment impacts. Sluicing shall occur only during higher turbid stream flows orwhen sediment traps constructed as follows are installed downstream:a. At least three sediment traps shall be placed downstream of the project. These traps shallconsist of laying filter fabric on the streambed and creating a dam on the downstream edge of thefilter fabric.b. The dam shall be just high enough to create a backwater curve over the length of filter fabric.c. The sediment traps shall be removed from the stream within two days of completing the sluicingoperation. All sediment trap materials and materials captured by them shall be completely removedand disposed of so they do not reenter state waters.

42. All material removed from the pond by a method other than sluicing shall be disposed of so thatit does not reenter state waters.

WATER QUALITY43. Every effort shall be taken during all phases of this project to ensure that sediment-laden wateris not allowed to enter the stream.

44. Wastewater from project activities and water removed from within the work area shall be routedto an area landward of the ordinary high water line to allow removal of fine sediment and othercontaminants prior to being discharged to the stream.

45. All waste material such as construction debris, silt, excess dirt or overburden resulting from thisproject shall be deposited above the limits of flood water in an approved upland disposal site.

46. If high flow conditions that may cause siltation are encountered during this project, work shallstop until the flow subsides.

VEGETATION MANAGEMENT47. Revegetation shall occur per the application attachment entitled "Vegetation Management Planfor WDFW Hatcheries", except as modified by this HPA.

48. Bank and bank vegetation removed or damaged as a result of facility maintenance or otherconstruction shall be limited to that necessary to construct the project. Within seven calendar daysof project completion, all disturbed areas shall be protected from erosion using vegetation or other

means. If vegetation is removed or damaged, re-establishment of native vegetation shall occur assoon as the weather permits, but no more than six months after the removal or damage. Vegetationshall be maintained as necessary for three years to ensure at least 80 percent survival.

49. ANNUAL REPORTING: A calendar year annual report of work shall be submitted in unlockedMicrosoft Excel (*.xls) format to [email protected] by February 28 of the following year,or in the final year of the HPA, prior to the expiration date using the template included with this HPAentitled "133480 WDFW Hatchery Maintenance Annual Report template.xlsx". An annual report isrequired even if no work was conducted. The annual report shall include:a. General: HPA Control Number, permittee, contact person, address, telephone number, date ofreport, time period represented.b. Summary: Total number of individual projects by hatchery facility and statewide.c. Problem(s) encountered: Provision violation, notification, corrective action, impacts to fish life andwater quality from problem, invasive species removed.d. Recommendations for improvement to provisions.e. List of individual projects completed at each facility including details noted in the template.

DEFINITIONS

Debris: Inorganic material including trash, tires and garbage etc. This definition does not includeLarge Woody Material (LWM), woody material smaller than LWM, woody material resulting frombeaver activity, or woody material placed in channels for an environmentally beneficial purpose.

Large Woody Material (LWM): Trees or tree parts larger than four inches in diameter and longerthan six feet in length, including rootwads. This material is located wholly or partially waterward ofthe Ordinary High Water Line (OHWL).

Ordinary High Water Line (OHWL): The mark on the shores of all waters that will be found byexamining the bed and banks and ascertaining where the presence and action of waters are socommon and usual and so long continued in ordinary years, as to mark upon the soil or vegetationa character distinct from that of the abutting upland provided that in any area where the ordinaryhigh water line cannot be found the ordinary high water line adjoining saltwater shall be the line ofmean higher high water and the ordinary high water line adjoining freshwater shall be the elevationof the mean annual flood.

Organic Material: Natural woody and plant material smaller than LWM. Examples include woodymaterial resulting from beaver activity, twigs, leaves, and dead fish.

Sediment(s): Settled particulate matter located in the predominant biologically active aquatic zone,or exposed to the water column. Sediment also includes settled particulate matter exposed byhuman activity (e.g., dredging) to the biologically active aquatic zone or to the water column.

Wetted Perimeter: The areas of a watercourse covered with flowing or non-flowing water.

This Hydraulic Project Approval pertains only to those requirements of the Washington State Hydraulic Code,specifically Chapter 77.55 RCW (formerly RCW 77.20). Additional authorization from other public agencies may benecessary for this project. The person(s) to whom this Hydraulic Project Approval is issued is responsible for applyingfor and obtaining any additional authorization from other public agencies (local, state and/or federal) that may benecessary for this project.

This Hydraulic Project Approval shall be available on the job site at all times and all its provisions followed by theperson(s) to whom this Hydraulic Project Approval is issued and operator(s) performing the work.

This Hydraulic Project Approval does not authorize trespass.

The person(s) to whom this Hydraulic Project Approval is issued and operator(s) performing the work may be heldliable for any loss or damage to fish life or fish habitat that results from failure to comply with the provisions of thisHydraulic Project Approval.

Failure to comply with the provisions of this Hydraulic Project Approval could result in a civil penalty of up to onehundred dollars per day and/or a gross misdemeanor charge, possibly punishable by fine and/or imprisonment.

All Hydraulic Project Approvals issued under RCW 77.55.021 are subject to additional restrictions, conditions, orrevocation if the Department of Fish and Wildlife determines that changed conditions require such action. Theperson(s) to whom this Hydraulic Project Approval is issued has the right to appeal those decisions. Procedures forfiling appeals are listed below.

MINOR MODIFICATIONS TO THIS HPA: You may request approval of minor modifications to the required work timingor to the plans and specifications approved in this HPA. A minor modification to the required work timing means up to aone-week deviation from the timing window in the HPA when there are no spawning or incubating fish present withinthe vicinity of the project. You may request subsequent minor modifications to the required work timing. A minormodification of the plans and specifications means any changes in the materials, characteristics or construction of yourproject that does not alter the project's impact to fish life or habitat and does not require a change in the provisions ofthe HPA to mitigate the impacts of the modification. Minor modifications do not require you to pay additional applicationfees or be issued a new HPA. To request a minor modification to your HPA, submit a written request that clearlyindicates you are requesting a minor modification to an existing HPA. Include the HPA number and a description of the

MAJOR MODIFICATIONS TO THIS HPA: You may request approval of major modifications to any aspect of your HPA.Any approved change other than a minor modification to your HPA will require issuance of a new HPA. If you paid anapplication fee for your original HPA you must include payment of $150 with your written request or request billing to anaccount previously established with the department. If you did not pay an application fee for the original HPA, no fee isrequired for a change to it. To request a major modification to your HPA, submit a written request that clearly indicatesyou are requesting a major modification to an existing HPA. Include the HPA number, check number or billing accountnumber, and a description of the requested change. Send your written request and payment, if applicable, by mail to:Washington Department of Fish and Wildlife, PO Box 43234, Olympia, Washington 98504-3234. APPEALS INFORMATION

If you wish to appeal the issuance, denial, conditioning, or modification of a Hydraulic Project Approval (HPA),Washington Department of Fish and Wildlife (WDFW) recommends that you first contact the department employee whoissued or denied the HPA to discuss your concerns. Such a discussion may resolve your concerns without the need forfurther appeal action. If you proceed with an appeal, you may request an informal or formal appeal. WDFW encouragesyou to take advantage of the informal appeal process before initiating a formal appeal. The informal appeal processincludes a review by department management of the HPA or denial and often resolves issues faster and with less legalcomplexity than the formal appeal process. If the informal appeal process does not resolve your concerns, you mayadvance your appeal to the formal process. You may contact the HPA Appeals Coordinator at (360) 902-2534 for moreinformation.

A. INFORMAL APPEALS: WAC 220-110-340 is the rule describing how to request an informal appeal of WDFWactions taken under Chapter 77.55 RCW. Please refer to that rule for complete informal appeal procedures. Thefollowing information summarizes that rule.

A person who is aggrieved by the issuance, denial, conditioning, or modification of an HPA may request an informalappeal of that action. You must send your request to WDFW by mail to the Washington Department of Fish and WildlifeHPA Appeals Coordinator, 600 Capitol Way North, Olympia, Washington 98501-1091; e-mail [email protected]; fax to (360) 902-2946; or hand-delivery to the Natural Resources Building, 1111Washington St SE, Habitat Program, Fifth floor. WDFW must receive your request within 30 days from the date youreceive notice of the decision. If you agree, and you applied for the HPA, resolution of the appeal may be facilitatedthrough an informal conference with the WDFW employee responsible for the decision and a supervisor. If a resolutionis not reached through the informal conference, or you are not the person who applied for the HPA, the HPA AppealsCoordinator or designee will conduct an informal hearing and recommend a decision to the Director or designee. If youare not satisfied with the results of the informal appeal, you may file a request for a formal appeal.
