RESOLUTION

Before this Board is a Petition filed by Petitioners, RODOLFO

V. DELA ROSA, ET AL., on 12 May 2005, seeking the payment of

dividends, the resumption of loan privileges, the payment of

insurance, retirement pension, death, survivorship and funeral

benefits, as well as damages for employees of the Philippine National

Railways (PNR).

Petitioners allege that despite the fact that their employer, the

PNR, regularly deducted from their respective monthly salaries their

GSIS premium contributions and notwithstanding Sections 8 1 and

41(w)2 of R.A. No. 8291, the then GSIS Caloocan District Office, the

Operating Unit Concerned (OUC) in this case, stopped the payment

of dividends and suspended the loan privileges of PNR Employees

starting sometime in 1991. They further claim that after their

retirement from the PNR, they applied for payment of their

insurance benefits but the OUC unjustifiably refused to pay the

same. The OUC allegedly refused to pay their retirement and

pension benefits as well. Moreover, when Petitioner Corsinio C.

Arcega died, the OUC allegedly refused to pay the death,

survivorship and funeral benefits to his beneficiaries.

1 SECfiON 8. Government Guarantee. -The government of the Republic of the Philippines hereby guarantees the fulfillment of the obligations of the GSIS to its members as and when they fall due.

2 SECfiON 41. Powers and Functions of the GSIS. - The GSIS shall exercise the following powers and functions:

(w) to ensure the collection or recovery of all indebtedness, liabilities and/or accountabilities, including unpaid premiums or contributions in favor of the GSIS arising from any cause or source whatsoever, due from all obligors, whether public or private. The Board shall demand payment or settlement of the obligations referred to herein within thirty (30) days from the date the obligation becomes due, and in the event of failure or refusal of the obligor or debtor to comply with the demand, to initiate or institute the necessary or proper actions or suits, criminal, civil or administrative or otherwise, before the courts, tribunals, commissions, boards, or bodies of proper jurisdiction within thirty (30) days reckoned from the expiry date of the period fixed in the demand within which to pay or settle the account;

Petitioners claim to have been deprived of the social protection

and the benefits guaranteed by the Philippine Government under

Section 8 of R.A. No. 8291. Despite repeated representations, verbal

and written demands, the OUC continued to refuse to grant to the

Petitioners the benefits they were claiming. Hence, the filing of the

Petition.

After summons was served, the OUC filed its Answer

contending that the mandate of the GSIS to provide the necessary

protection to its members is linked to the payment of the monthly

premium obligations of its members. This led to GSIS' adoption of

the "Premium Based Policy". As of 31 May 2005, the PNR had

incurred compulsory premium arrearages for the period December

1988 to April 2005, in the amount of ONE BILLION 1WO HUNDRED

NINE1Y-FOUR MILLION 1WEN1Y 1WO THOUSAND 1WO

reason of PNR' s compulsory premium arrearages and pursuant to

the "Premium Based Policy", the OUC had valid and legal bases not

to pay the retirement claims and other social insurance benefits of

the Petitioners.

A preliminary conference was held on 15 August 2005. The

parties, through their respective counsels, were then required to file

and serve upon the other party their pre-hearing briefs. Briefs for

the Petitioners and the OUC were filed on 22 August 2005 and 23

August 2005, respectively.

On 28 June 2006, the Hearing Officer received Atty. Rogelio B.

De Guzman's withdrawal as counsel for the Petitioners. No other

counsel entered his/her appearance for the Petitioners thereafter.

As there were no further motions, pleadings or

communications received from the Petitioners for the succeeding

years, the new Hearing Officer, in an Order4 dated 01 April 2009,

directed the Petitioners to express their interest to pursue the case

by filing their position paper within fifteen (15) days from receipt

thereof, otherwise he would dismiss the case for failure to prosecute.

Having received no position paper or any response whatsoever

from the Petitioners, individually or as a group, the Hearing Officer,

on 29 June 2009, issued an Order 5 considering the Petition

withdrawn for Petitioners' lack of interest to prosecute. Petitioners

did not file any other pleading after the issuance of the same.

Further, upon verification with the NCRl Department6, the

department presently handling the claims of PNR employees, it was

determined that all of the benefits due the Petitioners have already

been paid to them 7 •

In view of the settlement of all the claims of the Petitioners,

the petition has been rendered moot and academic. A case becomes

moot and academic when there is no more actual controversy

between the parties or no useful purpose can be served in passing

upon the merits. 8 A moot and academic case is one that ceases to

present a justiciable controversy by virtue of supervening events, so

that a declaration thereon would be of no practical use or value.

Generally, courts decline jurisdiction over such case or dismiss it

on ground of mootness. 9

In this case, considering that the claims of the Petitioners have

already been settled, the case ceases to present a justiciable

controversy and a declaration thereon would be of no practical value.

It becomes incumbent upon this Board, inherent in its power to

adjudicate, to dismiss the case motu propio for being moot and

academic.

Moreover, due to Petitioners' lack of interest to prosecute the

present petition and the absence of any pleading filed by Petitioners

after their pre-hearing brief, it is but proper under the circumstances

for the Board to dismiss the petition.

WHEREFORE, considering that all the claims of the

Petitioners have been paid to them, the case is DISMISSED for being

moot and academic.

Inasmuch as this Peti~on has been pending since 2005, .an

Order was issued on 1 April 2009 directing the petitioners to

express their intere_st to pursue this case by filing their position

paper· within 1.5 days from receipt thereat otherwise, the

undersigned Hearing Officer shall be constrained to dismiss the

Petition.

As of this date, the petitioners have not submitted their

position paper despite the fact that each one of them were

furnished a copy of said Order of 1 April 2009 at their respective

given address.

This being the case, the undersigned is constrained to

consider this Petition withdrawn for lack of interest to prosecute

the same.

WHEREAS, a Petition was filed on 12 May 2005 before the GSIS Board of Trustees by Rodolfo V. Dela Rosa, et al ., docketed as GSIS Case No. 006-05, seeking th e payment of dividends, the resumption of loan privileges, the payment of insurance, retirement, pension, death, survivorship, and funeral benefits, as well as damages for employees of the Philippine National Railways (PNR); ~

WHEREAS, pursuant to Section 30 of R.A. No. 8291, the GSIS has original and exclusive jurisdiction to settle any dispute arising from the application of the laws administered by the GSIS;

RESOLVED, to APPROVE and CONFIRM the Resolution in GSIS Case No. 006-05, entitled In the Matter of the Claim for Dividends, Resumption of Loan Privileges, Insurance, Retirement, Pension, Death, Survivorship and Funeral Benefits and Damages for PNR Employees, Rodolfo V. Dela Rosa, et al., Petitioners, the dispositive portion of which states:

"WHEREFORE, considering that all the claims of the Petitioners have been paid to them, the case is DISMISSED for being moot and academic.

"SO ORDERED."

A copy of the Resolution in GSIS Case No. 006-05 is attached and made an integral part of this Resolution.
