1006, the earnings limit law, governs retirees returning to work in any LSERS eligible position except for those returning under full time bus operator shortage law. These retirees are allowed to earn wages up to 50% of the adjusted FAC used in the calculation of their retirement benefit. If over earned, they must repay LSERS. To ensure an accurate accounting of their earnings, you must enroll them into the retirement system although contributions are not reported. Report salaries earned using the Retiree Return to work earnings form located on our website. When no longer employed, terminate them online as any other termination.
1007, the full time bus operator shortage law governs retirees returning to work as full time bus operators to cover a shortage. The employer must submit a declaration to the BESE Board of intent to hire a retired bus operator due to a shortage. The employer must also send a letter to LSERS each year no later than sept. 1 stating you have declared the shortage and want to hire the retiree. The retiree’s name and signature must be on the letter. The retiree must then be enrolled into LSERS. Members’ salary contributions must be reported like other regular active members; the member contributions are Unsheltered. The retiree’s benefit will be suspended if they are rehired within the 1st year after retirement. LSERS will terminate all 1007 memberships at year end. The cycle must begin again at the beginning of each year. A retiree’s benefit amount does not change. When they are no longer employed in this capacity, they may file for a refund of contributions,w/o the 90 day waiting period; however, all salary contributions must be reported before the refund can be processed.

Full-Time Bus Operator Shortage (La. R.S. 11:1007)
• Retired as a bus operator and returns to a full time bus operator position • Certify shortage to BESE• Submit intent to LSERS by Sept. 1• Enrollment required each fiscal year between 7/1 to 9/1• Report salary contribution monthly (Unsheltered member contribution
type) • 1 year waiting period or benefit suspended for that period• Termination performed by LSERS on 6/30 yearly• Refund of contributions when no longer employed

Hover over “FORMS”, then select RRTW Enrollment. Any personnel authorized to enroll a new member will have the capability to enroll a retiree RTW. Effective 7/1/15, online enrollment was made MANDATORY!!

To enroll a RRTW, Enter the Social Security Number of the member you want to enroll and click SEARCH. The member’s information will auto populate.
The employer field will default to your agency.
Choose the appropriate enrollment type (Earnings Limit Law or Full-time Bus Operator Shortage Law)

Here is a glimpse of what you’ll see if you select the earnings limit law:
Using the drop down arrows, select the enrollment date, the position and the employment status as either Full Time or Part Time
Remember, the employer must present form 2F to employee. With the earnings limit law you do not have to Enroll the member each year.
Upon clicking the update button, you will receive a confirmation message; simply click ok and the member will be enrolled.
An enrollment letter including earnings limit information will be mailed to the retiree.

Here is a screen shot of the Full-Time Bus Operator shortage law enrollment; all fieldsrequire action. Select the appropriate answer for items numbered 1 – 3. Item number 4 –select the enrollment date and upload the required certification under item number 5.
As with any enrollment, you must present the form 2F to employee.
Keep in mind that to be enrolled under 1007, the retiree returning to work must have been a retired BUS OPERATOR. Also, LSERS will terminate the membership at the end of each fiscal year. For each year the retiree continues employment, the cycle must be repeated from certifying the shortage with the BESE board on through to online enrollment.
If the enrollment is attempted for a retiree who is not a retired bus operator, you will receive an error message.
Again, if the enrollment is accepted, you will receive a confirmation message. Simply click ok and the member will be enrolled.

Once a retiree is enrolled, monthly earnings are required.
Locate and open the retiree return to work earnings report under the forms drop down menu.

1. The employer ID & employer name will default to your agency.
2. Choose the month of the earnings to be reported-(The year will auto populate) and ALL retirees who are enrolled will auto populate as well.
3. Enter monthly earnings. Please know, you MUST enter monthly earnings even if the member does NOT have any earnings for that month, in this case, you simply enter zeros. If not, you will get an error message. Remember, contributions are not allowed under 1006, therefore, no place to enter.
4. Choose correct operation code. Remember, when you first report earnings, the operational code will be ADD. Then, if corrections need to be made, it will either be Replace or Delete.
5. Then click Submit
On this screen you can also see the retiree’s annual earnings limit amount.
*A point of information, all active 1006 members will receive a new year earnings limit notification letter at the beginning of each year.

10 Contributions not reported for RRTW under Earnings Limit Law
To review the 1006 RRTW Earnings Exceptions Report Click on REPORTS, then RRTW 1006 EARNINGS EXCEPTION REPORT on the drop down menu.
RRTW 1006 earnings should not be uploaded with regular salary. If this is done, you will receive an exception of “reported no enrollment.” Also note, that if there is an exception showing no earnings reported for RRTW and the earnings were reported with regular salary upload, they won't be reflected as reported 1006 earnings.

RRTW earnings reported using Salary Contribution Correction Form will not:• NOT be reflected as reported 1006 earnings• Will create an exception, “reported no enrollment”.
Select the month then click on view report.
The exceptions report will appear. The members with exceptions will be listed individually. And the “total” exceptions will be summed at the bottom.

If a member is enrolled as 1007, earnings would be reported the same way you report active member salary and contributions. Upload the monthly Salary Contribution Reporting Form thru LSERSWeb by clicking on FORMS and selecting. They SHOULD NOT BE A SEPARATE FILE.
Use the browse button to find your salary contribution file you want to upload. Click the submit button to upload file. Once completed, a confirmation window will appear. Click OK and a confirmation email will be sent.
Once a salary file is uploaded, it cannot be deleted. All changes must be done through an online Salary Contribution Correction.
