    3. Debit Card Bonus Points Earned 3.1. The Cardholders will earn one (1) Debit Card Bonus Point

    for every RM2.00 (rounded down) amount of local and international Point-of-Sale (POS) retail purchase transaction utilizing the Debit Card. The Debit Card Bonus Points earned in respect of retail purchases transacted outside Malaysia will be calculated based on the RM equivalent of the transacted sum which will be converted at the prevailing exchange rate determined by the Bank at its absolute discretion.

    3.2. The Debit Card Bonus Points scheme is earned and accumulated on a per card basis. For the avoidance of doubt, Debit Card Bonus Points earned may not be combined between two different Debit Cards held by different Cardholders although they may have been tagged to the same Designated Account.

    3.3. The following transactions shall not earn Debit Card Bonus Points :-

    a. Cash withdrawal or cash deposits; b. Retail transactions in respect of purchases of

    petrol, diesel and any other purchases made at the petrol kiosks;

    c. Payment of the annual fees or service charges, delivery charges, cash payments, card replacement fee, dispute charges, fraud charges or any other fees, charges or penalties whether imposed by the Bank or otherwise;

    d. MEPS e-Debit transactions (PIN-based transactions). 3.4. The awarding of one (1) Debit Card Bonus Point for

    every RM2.00 may be subject to change from time to time as determined by the Bank upon adequate notice to the Cardholders.

    3.5. Debit Card Bonus Points earned and accumulated can be viewed online by the Cardholder at www.cimbclicks.com.my or can be ascertained from the Banks Call Centre by calling 1300 880 900 or 603-2295 6100.

    3.6. Debit Card Bonus Points earned do not have any cash or monetary value and are not convertible to cash. Accrued Debit Card Bonus Points are not convertible to cash unless expressly stated otherwise.

    3.7. Debit Card Bonus Points earned are not transferable to any third party.

    3.8. Debit Card Bonus Points earned in relation to a particular transaction may be withdrawn in the event of any Debit Card transaction disputes with the Merchant in respect of that transaction.

    4. Validity of Debit Card Bonus Points 4.1. Debit Card Bonus Points earned in a particular calendar

    quarter are valid for up to three (3) calendar years and shall expire on the first (1st) day of the following calendar quarter. For example, Debit Card Bonus Points earned between 1 January 2011 and 31 March 2011 will expire by 1 April 2014.

    4.2. Unless utilized earlier, Debit Card Bonus Points earned and accumulated must be redeemed prior to the expiry date. All unused or unredeemed Debit Card Bonus Points

    CIMB BANK - Debit Card Rewards Catalogue Terms and Conditions

    1. Definitions 1.1. Bank means CIMB Bank Berhad (13491-P). 1.2. Cardholder(s) means a customer of the Bank to whom

    the Debit Card has been issued. 1.3. Debit Card means the CIMB Bank Debit MasterCard

    and any replacement or renewal thereof which is issued by the Bank.

    1.4. Debit Card Bonus Points means the points awarded to the Cardholders for retail purchases or transactions charged to the Card in accordance with any provisions herein.

    1.5. Designated Account means the account designated by the Cardholder (which has been approved by the Bank) for the time being for the purpose of carrying out debit transactions through the use of the Debit Card.

    1.6. Gift(s) means the rewards provided under the Rewards Programme which includes goods, merchandise, vouchers, products, services, travel packages and/ or any other privileges contained in this Rewards Programme.

    1.7. Merchant is an individual, firm or company engaged in the business of selling and providing Gift(s) featured in this Rewards Programme

    1.8. Point of Sale (POS) means any transactions via the MasterCard network.

    1.9. Rewards Programme means the reward programme under the Debit Card Rewards Catalogue (Rewards Catalogue) designed by the Bank for Debit Card cardholders.

    2. Eligibility 2.1. All Cardholders under the Debit Card Bonus Points scheme

    are eligible to participate in this Rewards Programme. 2.2. By participating in this Rewards Programme, the Cardholders

    are deemed to have read, understood and agreed to be bound by these terms and conditions.

    2.3. In order to be eligible to earn or redeem Debit Card Bonus Points, the Cardholders Designated Account linked to the Debit Card must be valid and in good standing and not overdrawn if the Cardholder has an overdraft facility. Cardholder whose account(s) in the opinion of the Bank has been opened fraudulently shall not be eligible to participate in this Rewards Programme and the Bank reserves the absolute right to decline any redemption of Debit Card Bonus Points if the Cardholders Designated Account is cancelled or terminated by the Bank.

    2.4. Cardholders are to ensure that the signature on the gift redemption form is similar/matches the signature endorsed on their account opening application form.

    will be automatically forfeited after the applicable expiry date without notification to the Cardholders. Cardholders cannot carry forward any unused points earned and/or accumulated points once the Debit Card Bonus Points have expired. Any requests by Cardholders to utilise the unused points after the expiry date shall be not be entertained by the Bank and the Bank shall have no obligation to reinstate the expired or forfeited points.

    4.3 Notwithstanding the provisions of Clause 4.1 above, should the Debit Card be cancelled, the Debit Card Bonus Points earned and accumulated shall be forfeited and the Bank has no obligation to reinstate the points.

    4.4 The Bank reserves the right to alter the validity period of Debit Card Bonus Points and will give the Cardholders adequate notice of any such change. In such an event, the Cardholders will be given a grace period to utilize or redeem the Debit Card Bonus Points. The change will take effect from the date stated in such notice.

    5. Gift(s) Redemption 5.1. All redemption of the Debit Card Bonus Points must use

    the redemption form, attached to this Rewards Catalogue and which must be duly completed and signed by the Cardholders and sent to the Bank either via fax or mailing back to the Bank. Alternatively Cardholders may call to redeem through the Redemption Hotline as stated in the redemption form. The Cardholders agree that proof of sending is not proof of receipt. The Cardholders further acknowledge that it is their duty and obligation to ensure that any redemption submitted is duly received by the Bank for processing. The Bank shall not be responsible of any delay or failure of delivery of any Gift(s) arising from the non receipt of the redemption form.

    5.2. All redemption of Debit Card Bonus Points (including a request to transfer Debit Card Bonus Points to the designated Cardholders CIMB Bank/Direct Access credit card account) are subject to the Cardholders Debit Card being valid and the Designated Account being in good standing i.e. not closed, suspended or terminated by the Bank at the time the redemption request is made.

    5.3. Redemption of Debit Card Bonus Points is based on a per card basis. Any requests to combine Debit Card Bonus Points earned between (2) two or more Debit Cards of different Cardholders will not be entertained.

    5.4. Subject to clause 5.2, all redemptions are also subject to the accumulation of sufficient Debit Card Bonus Points and the Banks final acceptance. Redemption request with insufficient Debit Card Bonus Points shall be cancelled automatically by the Bank without further reference to the Cardholder.

    5.5. All Gifts featured in the catalogue are subject to the following:-

    a. Product/service availability; b. Cardholders available Debit Card Bonus Points; c. Cardholders Debit Card and Designated Account

    status;

    d. Final acceptance by the Bank; and e. Any restrictions that may apply as to where and when

    the Gift(s) can be redeemed. 5.6. Cardholders may utilise their accumulated Debit Card

    Bonus Points to qualify for any one or more of the following options: -

    a. Featured product/service redemption; or b. Transferring and converting of Debit Card Bonus

    Points to the designated Cardholders CIMB Bank/Direct Access credit card account.

    5.7. The Bank hereby expressly disclaims all and any liability to the Cardholder in respect of any redemption of goods, products or services under this Rewards Programme.

    5.8. Debit Card Bonus Points, which have been used to redeem any Gift(s), shall be deemed as extinguished. Request by Cardholders for any change to or cancellation of a redemption, which has accepted by the Bank, will not be entertained. Gift(s) redeemed cannot be returned or exchanged. Provided always that the Bank shall have the absolute right to refuse any request for the redemption of any type of Gift(s) which are no longer available. The Bank shall in its absolute discretion be entitled to substitute or remove any product and/or service from the Rewards Programme.

    5.9. The Bank hereby expressly excludes, does not make and disclaims any representation, warranty or endorsements, express or implied, written or oral in respect of any of the Gifts featured. In particular, the Bank does not warrant that any of the Gifts provided herein is of merchantable quality and/or fit for the particular purpose. The Bank shall not be held responsible in any way whatsoever for any damage or loss or accident from the use of any of the redeemed items.

    5.10. All items featured in this catalogue may differ from the actual goods or products in terms of color or design details. The Bank shall not be liable nor responsible in any way whatsoever to the Cardholders resulting from such discrepancies.

    5.11. In the event that the Cardholders choice of Gift(s) is/are unavailable, the Bank reserves the right upon giving adequate notice to substitute it with other item(s) of similar value. The Bank reserves the right, without giving any prior notice nor assigning any reason whatsoever to the Cardholders, to discontinue and/or replace all or any of the products and services provided herein.

    5.12. The Bank shall not be liable for or obliged to recognise or replace any defective, lost, damaged or stolen Gift(s) and Gift(s) accepted in good condition are strictly non-returnable and non-exchangeable. In the event of Gift(s) being defective or damaged upon delivery or for any queries relating to the warranty, Cardholders should contact the parties whose numbers are stated on the warranty card.

    5.13. Cardholders hereby give their consent to and authorize the Bank to use and/or disclose their particulars to a third party including the participating Merchants for the purposes of the Rewards Programme. The Bank warrants that the disclosure shall be limited to the Cardholders name, address and telephone number and shall be used only in relation to and for the purposes of the Rewards Programme.

    5.14. The Bank shall only be responsible for taking the redemption instructions from the Cardholders and forwarding the same to the Merchants of the respective items. The Bank disclaims any liability or duty in relation to the items redeemed. The item(s) is/are sent and supplied to the Cardholders by the Merchant who is solely responsible for all obligations and liabilities, relating to the supply and warranty of the terms and all ancillary charges.

    5.15. The Bank assume no responsibility for any physical injury, death, claims, losses, costs, expenses, damages or embarrassment suffered by Cardholders or any other party, of whatever nature resulting from the redemption of Gift(s) or the use of any Gift(s) offered herein.

    5.16. Any dispute concerning Gift(s) received under the Rewards Programme shall be settled between the Cardholders and the Merchant without recourse to the Bank.

    5.17. Should the utilisation of the Debit Card Bonus Points and/or the redemption of Gift result in a tax liability to the Cardholders, the Bank shall not be responsible for paying the same. Any taxes or charges imposed by the relevant authorities/ service establishments/ or Merchants pursuant thereto shall be borne by the Cardholders.

    5.18. The Cardholders agree that any redemption of the Gift(s) that consist of vouchers issued by the Merchant(s) cannot be encashed and are valid for use until the date specified and shall be subject to terms and conditions contained therein as may be determined by the Merchant(s). If they remain unused after the specified date, the vouchers will lapse and will not be replaced. The Bank is not responsible for expired, lost or stolen vouchers or Gift(s).

    5.19. The terms and conditions specified in the vouchers are beyond the Banks control and determined by the Merchants. Any disputes arising under the terms and conditions of the vouchers shall be settled directly by the Cardholders with the Merchants without recourse to the Bank. The Bank will not be responsible in replacing or cancelling any redemption as a result of such dispute.

    5.20. In the event that the voucher takes the form of a cash voucher(s), the Cardholder can use the Cardholders Debit Card to pay the difference to the Merchant should the purchase be in excess of the value stated on the cash voucher(s). There will be no refund of the unused portion of the value of the cash voucher(s).

    5.21. Issuance of dining vouchers does not constitute a reservation with the relevant Merchant. Cardholders are responsible for making the reservations and notifying the participating Merchant of the voucher(s) they are going to redeem. The Cardholders further agree that the respective Merchant may impose further terms and conditions on the dining vouchers which the Cardholders must abide with.

    5.22. Gift voucher(s) of a Merchant are only valid at participating outlets listed in the voucher(s) or the Rewards Programme.

    5.23. The Bank will not replace or assist the Cardholders by placing a hold or freeze status on any misplaced, lost or stolen Gift voucher(s) under any circumstances.

    5.24. Redeemed Gift vouchers are not exchangeable for any other Gift(s), are not refundable, not replaceable and not transferable for cash or credit under any circumstances.

    5.25. All payment for courier fee shall be made and charged to the Cardholders Designated Account.

    5.26. Cardholders acknowledge and agree that Gift(s) redeemed are on a No Trial Period basis.

    6. Points Transfer 6.1. Cardholders who are CIMB Bank/Direct Access credit card

    members will be entitled to transfer and convert their Debit Card Bonus Points for Bonus Points under the CIMB Bank/Direct Access credit card Bonus Points scheme.

    6.2. The transfer and conversion of Debit Card Bonus Points to Bonus Points will take approximately fourteen (14) business days from the date of the Banks receipt of Cardholders redemption form. The Bank shall not revise nor cancel any successful transfer and conversion of Debit Card Bonus Points to Bonus Points.

    6.3. Bonus Points earned as a result of a transfer and conversion of Debit Card Bonus Points can only be utilized under and pursuant to the terms and conditions of CIMB Bank Member Rewards Catalogue and CIMB Bank/Direct Access credit card.

    6.4. All Debit Card Bonus Points transfer request will be subject to the provisions specified in Clauses 5.1 to 5.5.

    6.5. The Bank reserves the right to change, from time to time, the Debit Card Bonus Points conversion rate specified in the redemption form by giving the Cardholders adequate prior notice.

    7. Delivery 7.1. Delivery of the Gift(s) shall be made to the Cardholders

    address, or the address furnished by the Cardholder in his/her redemption form.

    7.2. Delivery of Gift(s) will not be made to any P.O. Box addresses, Free Trade Zone addresses, addresses not serviced by courier providers, addresses outside Malaysia, as well as addresses at any of the Banks branches.

    7.3. The Gift(s) will be delivered to Cardholders within fourteen (14) working days after receipt of the Cardholders complete redemption form(s).

    7.4. Cardholders or any recipient of the Gift(s) is obliged to produce an identification document to the delivery personnel; failing which, the delivery personnel has the right to refuse delivery and will return the Gift(s) to the Bank as unclaimed.

    7.5. Delivery will only be made against a written acknowledgement of receipt of the item and of satisfaction with its physical condition by any occupant/recipient at the address of delivery; and where such address is an office address, by any member/recipient at the office. Such acknowledgement shall be deemed to be the acknowledgement by the Cardholder(s) and the Bank assumes no responsibility thereafter.

    7.6. All Gifts supplied will be covered by the manufacturer or Merchants normal terms of business. Except where the law provides otherwise, the Bank will not be responsible for the quality or suitability of the Gifts or for any delay in delivery.

    7.7. Cardholders shall be liable for delivery charges for each of the

    Gift item sent and such charges shall be debited into the Cardholders Designated Account accordingly. Courier fee is applicable for deliveries to East Malaysia and Langkawi Island.

    7.8. Delivery charges to Langkawi Island will be based on East Malaysias courier rate.

    7.9. For redirection of delivery addresses, a service charge of RM10.00 per item will be debited to the Cardholders Designated Account accordingly.

    8. Others 8.1. The Gifts offered under this Debit Card Rewards Catalogue

    is valid from 16 July 2012 - 31 December 2012. 8.2. Cardholders are not allowed to collect Gifts redeemed from

    any of the Banks branches. 8.3. All Gift(s) redeemed will be sent to Cardholders at their

    address as specified in Clause 7. 8.4. If the Gift(s) is returned undelivered to the Bank due to

    non-acknowledgement of receipt by the addressee, the Bank may (but is not obliged to) re-send or redeliver the above mentioned Gift(s) to the Cardholders provided that the cost incurred in resending the said Gift(s) shall be borne by the Cardholders.

    8.5. If the Bank attempts to re-send or redeliver the Gift(s) to the Cardholders and such Gift(s) is again returned undelivered to the Bank after the second attempt of delivery, the Bank shall not further attempt to send or deliver the said Gift(s).

    8.6. If the Cardholder fails to provide the Bank with a valid address to accept delivery within 30 working days from the date the Gift(s) is returned undelivered to the Bank, the Gift(s) and the Debit Card Bonus Points used to redeem the said Gift(s) shall be deemed forfeited and the Bank shall not be obliged to reinstate such Debit Card Bonus Points to the Cardholder.

    8.7. Any accessories/props/equipments featured together with the Gift(s) in any pictorial herein are for decorative purposes and shall not be available for redemption by Cardholders.

    8.8. Suspected or actual fraud and/or suspected or actual abuse relating to the accumulation of Debit Card Bonus Points in the Rewards Programme, or redemption of Gift(s) may result in forfeiture of accumulated Debit Card Bonus Points as well as cancellation of Cardholders participation in the Rewards Programme.

    8.9. By participating in the Rewards Programme, Cardholders are deemed to have read, understood and agreed to be bound by the Terms and Conditions stated herein and agree that any and all questions or issues regarding eligibility of a Cardholder for the Rewards Programme including the determination of Debit Card Bonus Points earned or accumulated and entitlement to redeem Gift(s) will be determined solely by the Bank and which decision shall be final, binding and conclusive.

    8.10. The Banks failure to enforce any of the terms and conditions herein does not constitute a waiver of the Banks rights under these terms and conditions.

    8.11. These terms and conditions shall be governed by and

    construed in accordance with the laws of Malaysia and the Cardholders acknowledge and agree to submit to the non-exclusive jurisdiction of the Courts of Malaysia.

    8.12. Unless the context otherwise requires, words and expressions respectively defined or construed in the Terms and Conditions For Debit Card shall have the same meaning when used or referred to in these terms and conditions and words referring to the male gender shall include the female gender and words referring to the singular number shall include the plural number and vice versa.

    8.13. In the event of any complaints related to the Rewards Programme, Cardholders may contact the Banks Customer Resolution Department bearing the following address, telephone and facsimile numbers (or bearing such other address, telephone and facsimile numbers which the Bank may change by notification to the Cardholders): Customer Resolution Department, Level 17, Menara Bumiputra-Commerce, 11 Jalan Raja Laut, 50350 Kuala Lumpur, Tel: 03-2619 2380/Fax: 03-2691 3248.

    9. Variation of Rules 9.1 The Bank reserves the right to suspend, cancel, terminate

    or withdraw this Rewards Programme in whole or part, by giving the Cardholders adequate prior notice. For the avoidance of doubt, suspension, cancellation, termination or withdrawal of this Rewards Programme shall not entitle any of the Cardholders to any claim or compensation against the Bank for any losses or damages suffered by Cardholders as a direct or indirect result of the act of suspension, cancellation or termination.

    9.2 The Bank reserves the rights upon giving adequate notice to vary (whether by addition, deletion, modification, amendment or otherwise howsoever) (the Amendment) any of the terms and conditions herein. Notification to Cardholders in respect of the Amendment shall be effected at the Banks absolute discretion through any one of the following means of communication, namely, by ordinary mail to the Cardholders last known address or by posting a notice regarding the Amendment at each of the Banks branches or by effecting an advertisement regarding the Amendment in one newspaper of the Banks choice, or via the Banks website and the Amendment shall be deemed as binding on the Cardholders as from the date of notification of the Amendment or from such other date as may be specified by the Bank in the notification.

    9.3 These terms and conditions are in addition to the Terms and Conditions For Debit Card applicable to the Cardholders. In the event of any inconsistency between these terms and conditions and the Terms and Conditions For Debit Card, these terms and conditions shall prevail in so far as they apply for the redemption of the Debit Card Bonus Points by Cardholders but not otherwise.

    CIMB BANK - Terma dan Syarat Katalog Ganjaran Kad Debit

    1. Takrif 1.1 Akaun yang Ditetapkan bermaksud akaun yang

    ditetapkan oleh Pemegang Kad (yang diluluskan oleh Bank) yang pada masa itu untuk tujuan menjalankan urus niaga debit melalui penggunaan Kad Debit.

    1.2 Bank bermaksud CIMB Bank Berhad (13491-P). 1.3 Hadiah bermaksud ganjaran yang disediakan di bawah

    Program Ganjaran yang termasuk barangan, dagangan, baucar, produk, perkhidmatan, pakej pelancongan dan/atau apa-apa keistimewaan lain yang terkandung dalam Program Ganjaran ini.

    1.4 Kad Debit bermaksud CIMB Bank Debit MasterCard dan apa-apa penggantian atau pembaharuannya yang dikeluarkan oleh Bank.

    1.5 Mata Bonus Kad Debit bermaksud mata yang diberikan kepada Pemegang Kad untuk pembelian atau urus niaga runcit yang dicajkan kepada Kad menurut apa-apa peruntukan dalam program ini.

    1.6 Pemegang Kad bermaksud pelanggan Bank yang kepadanya Kad Debit dikeluarkan.

    1.7 Point of Sale (POS) bermakna transaksi melalui rangkaian MasterCard.

    1.8 Program Ganjaran bermaksud program ganjaran di bawah Katalog Ganjaran Kad Debit (Katalog Ganjaran) yang disediakan oleh Bank untuk pemegang Kad Debit.

    1.9 Rakan Dagang ialah individu, firma atau syarikat yang terlibat dalam perniagaan menjual dan menyediakan Hadiah yang terdapat dalam Program Ganjaran ini.

    2. Kelayakan 2.1 Semua Pemegang Kad di bawah skim Mata Bonus Kad

    Debit layak menyertai Program Ganjaran ini. 2.2 Dengan menyertai Program Ganjaran ini, Pemegang Kad

    dianggap telah membaca, memahami dan bersetuju untuk terikat dengan terma dan syarat ini.

    2.3 Untuk layak memperoleh atau menebus Mata Bonus Kad Debit, Akaun yang Ditetapkan bagi Pemegang Kad yang dihubungkan ke Kad Debit mestilah sah dan dalam kedudukan yang baik dan tidak terlebih ambil jika Pemegang Kad mempunyai kemudahan overdraf. Pemegang Kad yang akaunnya pada pendapat Bank telah dibuka dengan cara menipu tidak layak menyertai Program Ganjaran ini dan Bank berhak secara mutlak untuk menolak apa-apa penebusan Mata Bonus Kad Debit jika Akaun yang Ditetapkan bagi Pemegang Kad dibatalkan atau ditamatkan oleh Bank.

    2.4 Pemegang Kad hendaklah memastikan bahawa tandatangan dalam borang penebusan hadiah adalah sama/sepadan dengan tandatangan yang diendors dalam borang permohonan ketika membuka akaun.

    3. Mata Bonus Kad Debit yang Diperoleh 3.1 Pemegang Kad akan memperoleh satu (1) Mata Bonus Kad

    Debit bagi setiap RM2.00 (dibundarkan lebih kecil) bagi jumlah pembelian Point-of-Sale (POS) runcit tempatan dan antarabangsa yang menggunakan Kad Debit. Mata Bonus Kad Debit yang diperoleh bagi pembelian runcit yang

    diurusniagakan di luar Malaysia akan dikira berdasarkan RM yang setara dengan jumlah yang diurusniagakan yang akan ditukarkan pada kadar pertukaran semasa yang ditentukan oleh Bank mengikut budi bicara mutlaknya.

    3.2 Skim Mata Bonus Kad Debit diperoleh dan dikumpul berdasarkan setiap kad. Untuk mengelakkan keraguan, Mata Bonus Kad Debit yang diperoleh tidak boleh digabungkan antara dua Kad Debit yang berlainan yang dimiliki oleh Pemegang Kad yang berlainan walaupun Kad Debit itu mungkin dihubungkan kepada Akaun yang Ditetapkan yang sama.

    3.3 Urus niaga berikut tidak memperoleh Mata Bonus Kad Debit:- 3.3.1 Pengeluaran tunai atau penyimpanan tunai; 3.3.2 Urus niaga runcit bagi pembelian petrol, diesel dan

    apa-apa pembelian lain yang dibuat di kiosk petrol; 3.3.3 Pembayaran fi tahunan atau caj perkhidmatan, caj

    penghantaran, pembayaran tunai, fi penggantian kad, caj pertikaian, caj penipuan atau apa-apa fi, caj atau penalti lain sama ada yang dikenakan oleh Bank atau dengan cara lain.

    3.3.4 Transaksi MEPS e-Debit (transaksi menggunakan PIN) 3.4 Pemberian satu (1) Mata Bonus Kad Debit bagi setiap

    RM2.00 mungkin tertakluk kepada perubahan dari semasa ke semasa seperti yang ditentukan oleh Bank dengan memberikan notis secukupnya kepada Pemegang Kad.

    3.5 Mata Bonus Kad Debit yang diperoleh dan dikumpul boleh dilihat secara dalam talian oleh Pemegang Kad di laman web www.cimbclicks.com.my atau boleh dipastikan melalui Pusat Panggilan Bank dengan menghubungi 1300 880 900 atau 03-22956100.

    3.6 Mata Bonus Kad Debit yang diperoleh tidak mempunyai nilai tunai atau nilai wang dan tidak boleh ditukarkan kepada tunai. Mata Bonus Kad Debit yang terkumpul tidak boleh ditukarkan keapda tunai melainkan dinyatakan sebaliknya dengan nyatanya.

    3.7 Mata Bonus Kad Debit yang diperoleh tidak boleh dipindahkan kepada mana-mana pihak ketiga.

    3.8 Mata Bonus Kad Debit yang diperoleh melalui urus niaga tertentu boleh dikeluarkan jika berlaku apa-apa pertikaian urus niaga Kad Debit dengan Rakan Dagang berkaitan dengan urus niaga tersebut.

    4. Tempoh Sah Mata Bonus Kad Debit 4.1 Mata Bonus Kad Debit yang diperoleh dalam suku tahun

    kalendar tertentu adalah sah sehingga tiga (3) tahun kalendar dan akan tamat tempoh pada hari pertama (1) pada suku tahun kalendar berikutnya. Contohnya, Mata Bonus Kad Debit yang diperoleh di antara 1 Januari 2011 hingga 31 Mac 2011 akan tamat tempoh pada 1 April 2014.

    4.2 Melainkan telah digunakan sebelum ini, Mata Bonus Kad Debit yang diperoleh dan dikumpul mestilah ditebus selewat-lewatnya dalam tempoh satu (1) bulan dari tarikh tamat tempoh. Semua Mata Bonus Kad Debit yang tidak digunakan atau tidak ditebus akan luput secara automatik selepas tarikh tamat tempoh tanpa pemberitahuan kepada Pemegang Kad. Pemegang Kad tidak boleh membawa ke hadapan apa-apa mata yang diperoleh dan/atau dikumpul

    tetapi tidak digunakan apabila Mata Bonus Kad Debit telah tamat tempoh. Apa-apa permohonan daripada Pemegang Kad untuk menggunakan mata yang tidak digunakan setelah tarikh tamat tempoh tidak akan dilayan oleh Bank dan Bank tidak diwajibkan untuk menggantikan mata yang telah tamat tempoh atau luput.

    4.3 Dengan tidak menyentuh peruntukan Fasal 4.1 di atas, jika Kad Debit dibatalkan, Mata Bonus Kad Debit yang dikumpul dan diperoleh hanya sah bagi tempoh enam (6) bulan dari tarikh akhir bulan pembatalan kad tersebut. Dalam tempoh ini, Mata Bonus Kad Debit mungkin masih boleh ditebus, setelah semua Mata Bonus Kad Debit yang diperoleh dan dikumpul oleh Pemegang Kad luput dan Bank tidak diwajibkan untuk menggantikan mata tersebut.

    4.4 Bank berhak mengubah tempoh sah Mata Bonus Kad Debit dan akan memberikan notis secukupnya kepada Pemegang Kad bagi apa-apa perubahan tersebut. Dalam kejadian itu, Pemegang Kad akan diberikan tempoh tangguh untuk menggunakan atau menebus Mata Bonus Kad Debit. Perubahan akan berkuat kuasa dari tarikh yang dinyatakan dalam notis tersebut.

    5. Penebusan Hadiah 5.1 Semua penebusan Mata Bonus Kad Debit mestilah

    menggunakan borang penebusan, yang dilampirkan pada Katalog Ganjaran ini dan mestilah dilengkapkan dan ditandatangani sewajarnya oleh Pemegang Kad dan dihantar kepada Bank sama ada melalui faks atau pos. Sebagai alternatif, Pemegang Kad boleh membuat penebusan melalui Talian Penebusan seperti yang dinyatakan dalam borang penebusan. Pemegang Kad bersetuju bahawa bukti penghantaran bukannya bukti penerimaan. Pemegang Kad selanjutnya mengakui bahawa sememangnya menjadi tanggungjawab dan obligasi mereka untuk memastikan bahawa apa-apa penebusan yang diserahkan telah diterima sewajarnya oleh Bank untuk diproses. Bank tidak bertanggungjawab terhadap apa-apa kelewatan atau kegagalan penghantaran apa-apa Hadiah yang disebabkan oleh borang penebusan tidak diterima.

    5.2 Semua penebusan Mata Bonus Kad Debit (termasuk permohonan untuk memindahkan Mata Bonus Kad Debit kepada akaun kad kredit CIMB Bank/Direct Access Pemegang Kad) tertakluk kepada Kad Debit Pemegang Kad yang sah dan Akaun yang Ditetapkan adalah dalam kedudukan yang baik, iaitu tidak ditutup, digantung atau ditamatkan oleh Bank pada masa permohonan penebusan dibuat.

    5.3 Penebusan Mata Bonus Kad Debit adalah berdasarkan setiap kad. Apa-apa permohonan untuk menggabungkan Mata Bonus Kad Debi yang diperoleh antara dua (2) atau lebih Kad Debit bagi Pemegang Kad yang berlainan tidak akan dilayan.

    5.4 Tertakluk kepada fasal 5.2, semua penebusan juga tertakluk kepada pengumpulan Mata Bonus Kad Debit yang mencukupi dan penerimaan terakhir Bank. Permohonan penebusan dengan Mata Bonus Kad Debit yang tidak mencukupi akan dibatalkan secara automatik oleh Bank tanpa merujuk lebih lanjut kepada Pemegang Kad.

    5.5 Semua Hadiah yang terdapat dalam katalog tertakluk kepada yang berikut:-

    a. Terdapatnya produk/perkhidmatan; b. Mata Bonus Kad Debit yang ada pada Pemegang Kad; c. status Kad Debit dan Akaun yang Ditetapkan

    Pemegang Kad; d. Penerimaan terakhir Bank; dan e. Apa-apa syarat yang mungkin terpakai berkaitan

    dengan di mana dan bila Hadiah boleh ditebus. 5.6 Pemegang Kad boleh menggunakan Mata Bonus Kad

    Debit yang dikumpul untuk melayakkan mereka dengan mana-mana satu opsyen atau lebih yang berikut:-

    5.6.1 Menebus produk/perkhidmatan yang dinyatakan; atau

    5.6.2 Memindahkan dan menukarkan Mata Bonus Kad Debit ke dalam akaun kad kredit CIMB Bank/Direct Access Pemegang Kad.

    5.7 Bank dengan ini menafikan secara nyatanya semua dan apa-apa liabiliti terhadap Pemegang Kad berhubung dengan apa-apa penebusan barangan, produk atau perkhidmatan di bawah Program Ganjaran ini.

    5.8 Mata Bonus Kad Debit, yang digunakan untuk menebus apa-apa Hadiah, akan dianggap sebagai telah luput. Permohonan daripada Pemegang Kad untuk apa-apa perubahan atau pembatalan penebusan, yang dipersetujui oleh Bank, tidak akan dilayan. Hadiah yang ditebus tidak boleh dikembalikan atau ditukar. Walau bagaimanapun Bank berhak secara mutlak untuk menolak apa-apa permohonan untuk menebus apa-apa jenis Hadiah yang tidak lagi ada. Bank berhak, mengikut budi bicara mutlaknya, menggantikan atau mengeluarkan apa-apa produk dan/atau perkhidmatan daripada Program Ganjaran.

    5.9 Bank dengan ini secara nyatanya mengetepikan, tidak membuat dan menafikan apa-apa pernyataan, waranti atau endorsemen, sama ada tersurat atau tersirat, bertulis atau lisan berhubung dengan apa-apa Hadiah yang disediakan. Secara khususnya, Bank tidak memberikan waranti bahawa apa-apa Hadiah yang terdapat dalam program ini adalah daripada kualiti yang boleh didagangkan dan/atau sesuai untuk tujuan tertentu. Bank tidak bertanggungjawab dalam apa jua cara sekali pun terhadap apa-apa kerosakan atau kehilangan atau kemalangan kerana menggunakan apa-apa barangan yang ditebus.

    5.10 Semua barangan yang terdapat dalam katalog ini mungkin berbeza daripada barangan atau produk sebenar dari segi warna atau butiran reka bentuknya. Bank tidak bertanggungan atau bertanggungjawab dalam apa jua cara sekali pun terhadap Pemegang Kad disebabkan oleh perbezaan ini.

    5.11 Jika Hadiah yang dipilih oleh Pemegang Kad tidak ada, maka Bank berhak setelah memberikan notis secukupnya menggantikannya dengan barangan lain dengan nilai yang sama. Bank berhak, tanpa memberikan apa-apa notis terlebih dahulu atau memberikan apa-apa sebab kepada Pemegang Kad, menghentikan dan/atau menggantikan semua atau apa-apa produk dan perkhidmatan yang terdapat dalam program ini.

    5.12 Bank tidak bertanggungan atau diwajibkan untuk mengenal pasti atau menggantikan apa-apa kerosakan, kehilangan, Hadiah yang rosak atau dicuri, dan Hadiah yang telah diterima dalam keadaan yang baik tidak boleh dikembalikan dan tidak boleh ditukar. Jika Hadiah didapati tidak sempurna atau rosak semasa penghantaran atau untuk apa-apa pertanyaan berkaitan dengan waranti, Pemegang Kad hendaklah menghubungi pihak yang nombornya dinyatakan dalam kad waranti.

    5.13 Pemegang Kad dengan ini memberikan kebenaran dan memberikan kuasa kepada Bank untuk menggunakan dan/atau mendedahkan butiran mereka kepada pihak ketiga termasuk Rakan Dagang sertaan untuk tujuan Program Ganjaran ini. Bank memberikan waranti bahawa pendedahan adalah terhad kepada nama, alamat dan nombor telefon Pemegang Kad dan digunakan hanya berkaitan dengan dan untuk tujuan Program Ganjaran.

    5.14 Bank hanya bertanggungjawab mematuhi arahan penebusan daripada Pemegang Kad dan menyampaikannya kepada Rakan Dagang bagi barangan berkenaan. Bank menafikan apa-apa liabiliti atau tanggungjawab berkaitan dengan barangan yang ditebus. Barangan dihantar dan dibekalkan kepada Pemegang Kad oleh Rakan Dagang yang bertanggungjawab semata-mata terhadap semua obligasi dan liabiliti, berkaitan dengan bekalan dan waranti tempoh dan semua caj sampingan.

    5.15 Bank tidak bertanggungjawab terhadap apa-apa kecederaan fizikal, kematian, tuntutan, kerugian, kos, perbelanjaan, kerosakan atau ras malu yang ditanggung oleh Pemegang Kad atau mana-mana pihak lain, walau apa pun jenisnya berpunca daripada penebusan Hadiah atau penggunaan apa-apa Hadiah yang terdapat dalam program ini.

    5.16 Apa-apa pertikaian berkaitan dengan Hadiah yang diterima di bawah Program Ganjaran hendaklah diselesaikan antara Pemegang Kad dengan Rakan Dagang tanpa melibatkan Bank.

    5.17 Jika penggunaan Mata Bonus Kad Debit dan/atau penebusan Hadiah menyebabkan liabiliti cukai kepada Pemegang Kad, maka Bank tidak bertanggungjawab untuk membayar cukai tersebut. Apa-apa cukai atau caj yang dikenakan oleh pihak berkuasa berkaitan/syarikat perkhidmatan atau Rakan Dagang hendaklah ditanggung oleh Pemegang Kad.

    5.18 Pemegang Kad bersetuju bahawa apa-apa penebusan Hadiah daripada baucar yang dikeluarkan oleh Rakan Dagang tidak boleh ditukarkan dengan tunai dan sah untuk digunakan sehingga tarikh yang ditetapkan dan tertakluk kepada terma dan syarat yang terkandung dalam baucar itu seperti yang mungkin ditentukan oleh Rakan Dagang. Jika baucar masih tidak digunakan selepas tarikh yang ditetapkan, maka baucar itu akan luput dan tidak boleh diganti. Bank tidak bertanggungjawab ke atas baucar atau Hadiah yang telah tamat tempoh, hilang atau dicuri.

    5.19 Terma dan syarat yang ditetapkan dalam baucar adalah di luar kawalan Bank dan ditentukan oleh Rakan Dagang. Apa-apa pertikaian yang timbul di bawah terma dan syarat baucar itu hendaklah diselesaikan terus oleh Pemegang Kad

    dengan Rakan Dagang tanpa melibatkan Bank. Bank tidak bertanggungjawab untuk menggantikan atau membatalkan apa-apa penebusan disebabkan oleh pertikaian tersebut.

    5.20 Jika baucar adalah dalam bentuk baucar tunai, Pemegang Kad boleh menggunakan Kad Debit Pemegang Kad untuk membayar perbezaan nilai tersebut kepada Rakan Dagang jika pembelian melebihi nilai yang dinyatakan dalam baucar tunai. Nilai baucar tunai yang tidak digunakan tidak akan dibayar balik.

    5.21 Pengeluaran baucar makan malan tidak termasuk tempahan dengan Rakan Dagang yang berkaitan. Pemegang Kad bertanggungjawab membuat tempahan dan memaklumkan Rakan Dagang sertaan tentang baucar yang akan ditebus. Pemegang Kad seterusnya bersetuju bahawa Rakan Dagang berkaitan boleh mengenakan terma dan syarat tambahan ke atas baucar makan malam yang mesti dipatuhi oleh Pemegang Kad.

    5.22 Baucar Hadiah daripada Rakan Dagang hanya sah di kedai sertaan yang disenaraikan dalam baucar atau Program Ganjaran.

    5.23 Bank tidak akan menggantikan atau membantu Pemegang Kad dengan meletakkan status tahan atau beku ke atas mana-mana baucar Hadiah yang tersalah letak, hilang atau dicuri di bawah apa-apa keadaan.

    5.24 Baucar Hadiah yang Ditebus tidak boleh ditukar untuk apa-apa Hadiah lain, tidak boleh dibayar balik, tidak boleh diganti dan tidak boleh dipindahkan untuk tunai atau kredit di bawah apa-apa keadaan.

    5.25 Semua pembayaran untuk kiriman cepat hendaklah dibuat dan dicajkan kepada Akaun yang Ditetapkan Pemegang Kad.

    5.26 Pemegang Kad mengakui dan bersetuju bahawa Hadiah yang ditebus adalah berdasarkan Tiada Tempoh Percubaan.

    6. Pemindahan Mata 6.1 Pemegang Kad yang merupakan ahli kad kredit CIMB

    Bank/Direct Access boleh memindahkan dan menukarkan Mata Bonus Kad Debit mereka untuk Mata Bonus di bawah skim Mata Bonus Kad Kredit Bank.

    6.2 Pemindahan dan penukaran Mata Bonus Kad Debit kepada Mata Bonus akan mengambil masa kira-kira empat belas (14) hari perniagaan dari tarikh Bank menerima borang penebusan Pemegang Kad. Bank tidak boleh mengubah atau membatalkan apa-apa pemindahan dan penukaran Mata Bonus Kad Debit kepada Mata Bonus yang telah dibuat.

    6.3 Mata Bonus yang diperoleh hasil daripada pemindahan dan penukaran Mata Bonus Kad Debit hanya boleh digunakan di bawah dan menurut terma dan syarat Katalog Ganjaran Ahli CIMB Bank dan kad kredit CIMB Bank/Direct Access.

    6.4 Semua permohonan untuk memindahkan Mata Bonus Kad Debit akan tertakluk kepada peruntukan yang dinyatakan dalam Fasal 5.1 hingga 5.5.

    6.5 Bank berhak menukar, dari semasa ke semasa, kadar pertukaran Mata Bonus Kad Debit yang dinyatakan dalam borang penebusan dengan memberikan notis secukupnya terlebih dahulu kepada Pemegang Kad.

    7. Penghantaran 7.1 Penghantaran Hadiah akan dibuat ke alamat Pemegang

    Kad, atau alamat yang diberikan oleh Pemegang Kad dalam borang penebusannya.

    7.2 Penghantaran Hadiah tidak akan dibuat ke mana-mana alamat Peti Surat, alamat Zon Perdagangan Bebas, alamat yang tidak ada dalam perkhidmatan penyedia kiriman cepat, alamat di luar Malaysia dan juga alamat di mana-mana cawangan Bank.

    7.3 Hadiah akan dihantar kepada Pemegang Kad dalam tempoh empat belas (14) hari bekerja selepas menerima borang penebusan yang lengkap daripada Pemegang Kad.

    7.4 Pemegang Kad atau mana-mana penerima Hadiah diwajibkan untuk mengemukakan dokumen pengenalan diri kepada kakitangan serahan, jika gagal berbuat demikian, kakitangan serahan berhak untuk tidak menyerahkan Hadiah dan akan mengembalikan Hadiah kepada Bank sebagai tidak dituntut.

    7.5 Penghantaran hanya akan dibuat berdasarkan pengesahan bertulis penerimaan barangan dan keadaan fizikal barangan adalah memuaskan oleh mana-mana penghuni/penerima di alamat penghantaran, dan jika alamat tersebut ialah alamat pejabat, oleh mana-mana kakitangan/penerima di pejabat tersebut. Pengesahan tersebut dianggap sebagai pengesahan oleh Pemegang Kad dan Bank tidak bertanggungjawab selepas itu.

    7.6 Semua Hadiah yang diberikan akan dilindungi mengikut syarat perniagaan yang biasa bagi pengeluar atau Rakan Dagang. Melainkan jika dikehendaki sebaliknya oleh undang-undang, Bank tidak akan bertanggungjawab terhadap kualiti atau kesesuaian Hadiah atau apa-apa kelewatan dalam penghantaran.

    7.7 Pemegang Kad bertanggungan terhadap caj penghantaran bagi setiap Hadiah yang dihantar dan caj tersebut akan didebitkan ke dalam Akaun yang Ditetapkan Pemegang Kad sewajarnya. Bayaran kiriman cepat terpakai bagi penghantaran ke Malaysia Timur dan Pulau Langkawi.

    7.8 Caj penghantaran ke Pulau Langkawi akan berdasarkan kadar kiriman cepat Malaysia Timur.

    7.9 Bagi penghantaran ke alamat baharu, caj perkhidmatan sebanyak RM10.00 bagi setiap barangan akan didebitkan ke dalam Akaun yang Ditetapkan Pemegang Kad sewajarnya.

    8. Lain-lain 8.1 Hadiah yang ditawarkan di bawah Katalog Ganjaran Kad

    Debit adalah sah dari 16 Julai 2012 - 31 Disember 2012. 8.2 Pemegang Kad tidak dibenarkan mengambil Hadiah yang

    ditebus dari mana-mana cawangan Bank. 8.3 Semua Hadiah yang ditebus akan dihantar kepada

    Pemegang Kad di alamat mereka seperti yang dinyatakan dalam Fasal 7.

    8.4 Jika Hadiah dikembalikan tidak dihantar kepada Bank disebabkan oleh tiada pengesahan penerimaan oleh penerimanya, maka Bank boleh (tetapi tidak diwajibkan) mengirim semula atau menghantar semula Hadiah yang disebut di atas kepada Pemegang Kad dengan syarat kos yang dikenakan untuk mengirim semula Hadiah itu ditanggung oleh Pemegang Kad.

    8.5 Jika Bank cuba mengirim atau menghantar semula

    Hadiah kepada Pemegang Kad dan Hadiah tersebut dikembalikan tidak dihantar sekali lagi kepada Bank selepas penghantaran kedua, maka Bank tidak akan lagi mengirim atau menghantar Hadiah berkenaan.

    8.6 Jika Pemegang Kad gagal memberi Bank alamat yang sah untuk menerima penghantaran dalam tempoh 30 hari bekerja dari tarikh Hadiah dikembalikan tidak dihantar kepada Bank, maka Hadiah dan Mata Bonus Kad Debit yang digunakan untuk menebus Hadiah tersebut akan dianggap luput dan Bank tidak diwajibkan untuk menggantikan Mata Bonus Kad Debit tersebut kepada Pemegang Kad.

    8.7 Semua aksesori/alatan/kelengkapan yang terdapat bersama dengan Hadiah dalam mana-mana gambar dalam katalog ini adalah untuk tujuan hiasan dan tidak diberikan untuk penebusan oleh Pemegang Kad.

    8.8 Jika disyaki atau terbukti berlaku penipuan dan/atau disyaki atau terbukti berlaku penyalahgunaan berkaitan dengan pengumpulan Mata Bonus Kad Debit dalam Program Ganjaran atau penebusan Hadiah, maka ini boleh menyebabkan Mata Bonus Kad Debit yang dikumpul luput dan juga penyertaan Pemegang Kad dalam Program Ganjaran dibatalkan.

    8.9 Dengan menyertai Program Ganjaran, Pemegang Kad dianggap telah membaca, memahami dan bersetuju untuk terikat dengan Terma dan Syarat yang dinyatakan dalam program ini dan bersetuju bahawa apa-apa dan semua persoalan dan isu berhubung dengan kelayakan Pemegang Kad bagi Program Ganjaran termasuk penentuan Mata Bonus Kad Debit yang diperoleh atau dikumpul dan kelayakan untuk menebus Hadiah akan ditentukan sepenuhnya oleh Bank dan keputusan tersebut adalah muktamat dan mengikat.

    8.10 Kegagalan Bank menguatkuasakan mana-mana terma dan syarat dalam program ini tidak akan membentuk penepian hak Bank di bawah terma dan syarat ini.

    8.11 Terma dan syarat ini akan dikawal oleh dan ditafsirkan menurut undang-undang di Malaysia dan Pemegang Kad mengesahkan dan bersetuju mematuhi bidang kuasa tak eksklusif Mahkamah Malaysia.

    8.12 Melainkan konteks menghendaki sebaliknya, perkataan dan ungkapan yang ditakrifkan atau ditafsirkan dalam Terma dan Syarat bagi Kad Debit hendaklah mempunyai maksud yang sama apabila digunakan atau dirujuk dalam terma dan syarat ini dan perkataan yang merujuk jantina lelaki hendaklah merangkumi jantina perempuan dan perkataan yang merujuk bilangan mufrad hendaklah merangkumi bilangan jamak dan sebaliknya.

    8.13 Jika terdapat apa-apa aduan berkaitan dengan Program Ganjaran ini, Pemegang Kad boleh menghubungi Jabatan Resolusi Pelanggan Bank di alamat, nombor telefon dan nombor faks berikut (atau di alamat, nombor telefon dan nombor faks lain yang boleh ditukar oleh Bank dengan memaklumkan Pemegang Kad): Jabatan Resolusi Pelanggan, Tingkat 17, Menara Bumiputra-Commerce, 11 Jalan Raja Laut, 50350 Kuala Lumpur Tel: 03-2619 2380/Faks: 03-2691 3248.

    9. Perubahan Peraturan 9.1 Bank berhak menggantung, membatalkan, menamatkan

    atau menarik balik Program Ganjaran ini keseluruhannya atau sebahagiannya, dengan memberikan notis secukupnya kepada Pemegang Kad. Untuk mengelakkan keraguan, penggantungan, pembatalan, penamatan atau penarikan balik Program Ganjaran ini tidak melayakkan mana-mana Pemegang Kad untuk membuat apa-apa tuntutan atau pampasan terhadap Bank bagi apa-apa kerugian atau kerosakan yang ditanggung oleh Pemegang Kad yang disebabkan secara langsung atau tidak langsung oleh tindakan penggantungan, pembatalan atau penamatan tersebut.

    9.2 Bank berhak, setelah memberikan notis secukupnya, mengubah (sama ada dengan menambah, menggugurkan, mengubah suai, meminda atau dengan apa cara sekali pun) (Pindaan) mana-mana terma dan syarat dalam program ini. Pemberitahuan kepada Pemegang Kad berhubung dengan Pindaan akan berkuat kuasa mengikut budi bicara multak Bank melalui mana-mana satu cara perhubungan berikut, iaitu melalui pos biasa ke alamat terakhir Pemegang Kad yang diketahui atau dengan menampal notis berhubung dengan Pindaan di setiap cawangan Bank atau dengan mengeluarkan iklan berhubung dengan Pindaan dalam satu akhbar pilihan Bank, atau melalui laman web Bank dan Pindaan dianggap sebagai mengikat Pemegang Kad mulai dari tarikh pemberitahuan Pindaan atau dari tarikh lain seumpamanya seperti yang boleh ditetapkan oleh Bank dalam pemberitahuan itu.

    9.3 Terma dan syarat ini adalah tambahan kepada Terma dan Syarat bagi Kad Debit yang terpakai kepada Pemegang Kad. Jika terdapat apa-apa ketidakselarasan antara terma dan syarat ini dengan Terma dan Syarat bagi Kad Debit, maka terma dan syarat ini akan digunakan selagi ia terpakai untuk penebusan Mata Bonus Kad Debit oleh Pemegang Kad bukan sebaliknya.

    CIMB ISLAMIC - Debit Card Rewards Catalogue Terms and Conditions

    1. Definitions 1.1. Bank means CIMB Islamic Bank Berhad (671380-H). 1.2. Cardholder(s) means a customer of the Bank to whom

    the Debit Card has been issued. 1.3. Debit Card means the CIMB Islamic Debit MasterCard

    and any replacement or renewal thereof which is issued by the Bank.

    1.4. Debit Card Bonus Points means the points awarded to the Cardholders for retail purchases or transactions charged to the Card in accordance with any provisions herein.

    1.5. Designated Account means the account designated by the Cardholder (which has been approved by the Bank) for the time being for the purpose of carrying out debit transactions through the use of the Debit Card.

    1.6. Gift(s) means the rewards provided under the Rewards Programme which includes goods, merchandise, vouchers, products, services, travel packages and/ or any other privileges contained in this Rewards Programme.

    1.7. Merchant is an individual, firm or company engaged in the business of selling and providing Gift(s) featured in this Rewards Programme.

    1.8. Point of Sale (POS) means any transactions via the MasterCard network.

    1.9. Rewards Programme means the reward programme under the Debit Card Rewards Catalogue designed by the Bank for Debit Card cardholders.

    2. Eligibility 2.1. All Cardholders under the Debit Card Bonus Points scheme

    are eligible to participate in this Rewards Programme. 2.2. By participating in this Rewards Programme, the

    Cardholders are deemed to have read, understood and agreed to be bound by these terms and conditions.

    2.3. In order to be eligible to earn or redeem Debit Card Bonus Points, the Cardholders Designated Account linked to the Debit Card must be valid and in good standing. Cardholder whose account(s) in the opinion of the Bank has been opened fraudulently shall not be eligible to participate in this Rewards Programme and the Bank reserves the absolute right to decline any redemption of Debit Card Bonus Points if the Cardholders Designated Account is cancelled or terminated by the Bank.

    2.4. Cardholders are to ensure that the signature on the gift redemption form is similar/matches the signature endorsed on their account opening application form.

    3. Debit Card Bonus Points Earned 3.1. The Cardholders will earn one (1) Debit Card Bonus Point

    for every RM2.00 (rounded down) amount of local and international Point-of-Sale (POS) retail purchase transaction utilizing the Debit Card. The Debit Card Bonus Points earned in respect of retail purchases transacted outside Malaysia will be calculated based on the RM equivalent of the transacted sum which will be converted at the prevailing exchange rate determined by the Bank at its absolute discretion.

    3.2. The Debit Card Bonus Points scheme is earned and accumulated on a per card basis. For the avoidance of doubt, Debit Card Bonus Points earned may not be combined between two different Debit Cards held by different Cardholders although they may have been tagged to the same Designated Account.

    3.3. The following transactions shall not earn Debit Card Bonus Points :-

    a. Cash withdrawal or cash deposits; b. Retail transactions in respect of purchases of petrol,

    diesel and any other purchases made at the petrol kiosks;

    c. Payment of the annual fees or service charges, delivery charges, cash payments, card replacement fee, dispute charges, fraud charges or any other fees, charges or penalties whether imposed by the Bank or otherwise.

    d. MEPS e-Debit transactions (PIN-based transactions). 3.4. The awarding of one (1) Debit Card Bonus Point for every

    RM2.00 may be subject to change from time to time as determined by the Bank upon adequate notice to the Cardholders.

    3.5. Debit Card Bonus Points earned and accumulated can be viewed online by the Cardholder at www.cimbclicks.com.my or can be ascertained from the Banks Call Centre by calling 1300 880 900 or 03-2295 6100.

    3.6. Debit Card Bonus Points earned do not have any cash or monetary value and are not convertible to cash. Accrued Debit Card Bonus Points are not convertible to cash unless expressly stated otherwise.

    3.7. Debit Card Bonus Points earned are not transferable to any third party.

    3.8. Debit Card Bonus Points earned in relation to a particular transaction may be withdrawn in the event of any Debit Card transaction disputes with the Merchant in respect of that transaction.

    4. Validity of Debit Card Bonus Points 4.1. Debit Card Bonus Points earned in a particular calendar

    quarter are valid for up to three (3) calendar years and shall expire on the first (1st) day of the following calendar quarter. For example, Debit Card Bonus Points earned between 1 January 2011 and 31 March 2011 will expire by 1 April 2014.

    4.2. Unless utilized earlier, Debit Card Bonus Points earned and accumulated must be redeemed prior to the expiry date. All unused or unredeemed Debit Card Bonus Points will be automatically forfeited after the applicable expiry date without notification to the Cardholders. Cardholders cannot carry forward any unused points earned and/or accumulated points once the Debit Card Bonus Points have expired. Any requests by Cardholders to utilise the unused points after the expiry date shall be not be entertained by the Bank and the Bank shall have no obligation to reinstate the expired or forfeited points.

    4.3. Notwithstanding the provisions of Clause 4.1 above, should the Debit Card be cancelled, the Debit Card Bonus Points earned and accumulated shall be forfeited and the Bank

    has no obligation to reinstate the points. 4.4. The Bank reserves the right to alter the validity period of

    Debit Card Bonus Points and will give the Cardholders adequate notice of any such change. In such an event, the Cardholders will be given a grace period to utilize or redeem the Debit Card Bonus Points. The change will take effect from the date stated in such notice.

    5. Gift(s) Redemption 5.1. All redemption of the Debit Card Bonus Points must use the

    redemption form, attached to this Rewards Catalogue and which must be duly completed and signed by the Cardholders and sent to the Bank either via fax or mailing back to the Bank. Alternatively Cardholders may call to redeem through the Redemption Hotline as stated in the redemption form. The Cardholders agree that proof of sending is not proof of receipt. The Cardholders further acknowledge that it is their duty and obligation to ensure that any redemption submitted is duly received by the Bank for processing. The Bank shall not be responsible of any delay or failure of delivery of any Gift(s) arising from the non receipt of the redemption form.

    5.2. All redemption of Debit Card Bonus Points (including a request to transfer Debit Card Bonus Points to the designated Cardholders CIMB Bank/Direct Access credit card account) are subject to the Cardholders Debit Card being valid and the Designated Account being in good standing i.e. not closed, suspended or terminated by the Bank at the time the redemption request is made.

    5.3. Redemption of Debit Card Bonus Points is based on a per card basis. Any requests to combine Debit Card Bonus Points earned between (2) two or more Debit Cards of different Cardholders will not be entertained.

    5.4. Subject to clause 5.2, all redemptions are also subject to the accumulation of sufficient Debit Card Bonus Points and the Banks final acceptance. Redemption request with insufficient Debit Card Bonus Points shall be cancelled automatically by the Bank without further reference to the Cardholder.

    5.5. All Gifts featured in the catalogue are subject to the following:-

    a. Product/service availability; b. Cardholders available Debit Card Bonus Points; c. Cardholders Debit Card and Designated Account

    status; d. Final acceptance by the Bank; and e. Any restrictions that may apply as to where and when

    the Gift(s) can be redeemed. 5.6. Cardholders may utilise their accumulated Debit Card

    Bonus Points to qualify for any one or more of the following options: -

    a. Featured product/service redemption; or b. Transferring and converting of Debit Card Bonus

    Points to the designated Cardholders CIMB Bank/Direct Access credit card account.

    5.7. The Bank hereby expressly disclaims all and any liability to the Cardholder in respect of any redemption of goods, products or services under this Rewards Programme.

    5.8. Debit Card Bonus Points, which have been used to redeem any Gift(s), shall be deemed as extinguished. Request by Cardholders for any change to or cancellation of a redemption, which has accepted by the Bank, will not be entertained. Gift(s) redeemed cannot be returned or exchanged. Provided always that the Bank shall have the absolute right to refuse any request for the redemption of any type of Gift(s) which are no longer available. The Bank shall in its absolute discretion be entitled to substitute or remove any product and/or service from the Rewards Programme.

    5.9. The Bank hereby expressly excludes, does not make and disclaims any representation, warranty or endorsements, express or implied, written or oral in respect of any of the Gifts featured. In particular, the Bank does not warrant that any of the Gifts provided herein is of merchantable quality and/or fit for the particular purpose. The Bank shall not be held responsible in any way whatsoever for any damage or loss or accident from the use of any of the redeemed items.

    5.10. All items featured in this catalogue may differ from the actual goods or products in terms of color or design details. The Bank shall not be liable nor responsible in any way whatsoever to the Cardholders resulting from such discrepancies.

    5.11. In the event that the Cardholders choice of Gift(s) is/are unavailable, the Bank reserves the right upon giving adequate notice to substitute it with other item(s) of similar value. The Bank reserves the right, without giving any prior notice nor assigning any reason whatsoever to the Cardholders, to discontinue and/or replace all or any of the products and services provided herein.

    5.12. The Bank shall not be liable for or obliged to recognise or replace any defective, lost, damaged or stolen Gift(s) and Gift(s) accepted in good condition are strictly non-returnable and non-exchangeable. In the event of Gift(s) being defective or damaged upon delivery or for any queries relating to the warranty, Cardholders should contact the parties whose numbers are stated on the warranty card.

    5.13. Cardholders hereby give their consent to and authorize the Bank to use and/or disclose their particulars to a third party including the participating Merchants for the purposes of the Rewards Programme. The Bank warrants that the disclosure shall be limited to the Cardholders name, address and telephone number and shall be used only in relation to and for the purposes of the Rewards Programme.

    5.14. The Bank shall only be responsible for taking the redemption instructions from the Cardholders and forwarding the same to the Merchants of the respective items. The Bank disclaims any liability or duty in relation to the items redeemed. The item(s) is/are sent and supplied to the Cardholders by the Merchant who is solely responsible for all obligations and liabilities, relating to the supply and warranty of the terms and all ancillary charges.

    5.15. The Bank assume no responsibility for any physical injury, death, claims, losses, costs, expenses, damages or embarrassment suffered by Cardholders or any other party,

    of whatever nature resulting from the redemption of Gift(s) or the use of any Gift(s) offered herein.

    5.16. Any dispute concerning Gift(s) received under the Rewards Programme shall be settled between the Cardholders and the Merchant without recourse to the Bank.

    5.17. Should the utilisation of the Debit Card Bonus Points and/or the redemption of Gift result in a tax liability to the Cardholders, the Bank shall not be responsible for paying the same. Any taxes or charges imposed by the relevant authorities/service establishments/ or Merchants pursuant thereto shall be borne by the Cardholders.

    5.18. The Cardholders agree that any redemption of the Gift(s) that consist of vouchers issued by the Merchant(s) cannot be encashed and are valid for use until the date specified and shall be subject to terms and conditions contained therein as may be determined by the Merchant(s). If they remain unused after the specified date, the vouchers will lapse and will not be replaced. The Bank is not responsible for expired, lost or stolen vouchers or Gift(s).

    5.19. The terms and conditions specified in the vouchers are beyond the Banks control and determined by the Merchants. Any disputes arising under the terms and conditions of the vouchers shall be settled directly by the Cardholders with the Merchants without recourse to the Bank. The Bank will not be responsible in replacing or cancelling any redemption as a result of such dispute.

    5.20. In the event that the voucher takes the form of a cash voucher(s), the Cardholder can use the Cardholders Debit Card to pay the difference to the Merchant should the purchase be in excess of the value stated on the cash voucher(s). There will be no refund of the unused portion of the value of the cash voucher(s).

    5.21. Issuance of dining vouchers does not constitute a reservation with the relevant Merchant. Cardholders are responsible for making the reservations and notifying the participating Merchant of the voucher(s) they are going to redeem. The Cardholders further agree that the respective Merchant may impose further terms and conditions on the dining vouchers which the Cardholders must abide with.

    5.22. Gift voucher(s) of a Merchant are only valid at participating outlets listed in the voucher(s) or the Rewards Programme.

    5.23. The Bank will not replace or assist the Cardholders by placing a hold or freeze status on any misplaced, lost or stolen Gift voucher(s) under any circumstances.

    5.24. Redeemed Gift vouchers are not exchangeable for any other Gift(s), are not refundable, not replaceable and not transferable for cash or credit under any circumstances.

    5.25. All payment for courier fee shall be made and charged to the Cardholders Designated Account.

    5.26. Cardholders acknowledge and agree that Gift(s) redeemed are on a No Trial Period basis.

    6. Points Transfer 6.1. Cardholders who are CIMB Bank/Direct Access credit card

    members will be entitled to transfer and convert their Debit Card Bonus Points for Bonus Points under CIMB Bank/Direct Access Bonus Points (the Bonus Points) scheme.

    6.2. The transfer and conversion of Debit Card Bonus Points to Bonus Points will take approximately fourteen (14) business days from the date of the Banks receipt of Cardholders redemption form. The Bank shall not revise nor cancel any successful transfer and conversion of Debit Card Bonus Points to Bonus Points.

    6.3. Bonus Points earned as a result of a transfer and conversion of Debit Card Bonus Points can only be utilized under and pursuant to the terms and conditions of CIMB Bank Member Rewards Catalogue and CIMB Bank/Direct Access credit card.

    6.4. All Debit Card Bonus Points transfer request will be subject to the provisions specified in Clauses 5.1 to 5.5.

    6.5. The Bank reserves the right to change, from time to time, the Debit Card Bonus Points conversion rate specified in the redemption form by giving the Cardholders adequate prior notice.

    7. Delivery 7.1. Delivery of the Gift(s) shall be made to the Cardholders

    address, or the address furnished by the Cardholder in his/her redemption form.

    7.2. Delivery of Gift(s) will not be made to any P.O. Box addresses, Free Trade Zone addresses, addresses not serviced by courier providers, addresses outside Malaysia, as well as addresses at any of the Banks branches.

    7.3. The Gift(s) will be delivered to Cardholders within fourteen (14) working days after receipt of the Cardholders complete redemption form(s).
