To find the true point of beginning, commence at the intersection of the Land Lot Line common to Land Lots 65 and 66 and the southerly right of way of Russell Road (80' Right of way), said point being THE TRUE POINT OF BEGINNING.

STANDARDS GOVERNING EXERCISE OF THE ZONING POWER

PURSUANT TO SECTION 1702 OF THE 1985 ZONING RESOLUTION, THE BOARD OF COMMISSIONERS FINDS THAT THE FOLLOWING STANDARDS ARE RELEVANT IN BALANCING THE INTEREST IN PROMOTING THE PUBLIC HEALTH, SAFETY, MORALITY, OR GENERAL WELFARE AGAINST THE RIGHT TO THE UNRESTRICTED USE OF PROPERTY AND SHALL GOVERN THE EXERCISE OF THE ZONING POWER.

Based upon the above reasons, the applicant feels that this is a reasonable request and that action contradictory to the zoning request will constitute a taking of property in violation of the Just Compensation Clause of the Fifth Amendment and the Due Process Clause of the Fourteenth Amendment to the Constitution of the United States, and Article 1, Section 1, Paragraph 1, and Article 1, Section 3, Paragraph 1 of the Constitution of Georgia, denying the owner viable use of its land.

REZONING APPLICANT'S LETTER OF INTENT

The Applicant and Owner, Dorin Neacsu, requests a rezoning for the 2.879 acre

property located on Russell Road next door to the old county fire station. The property is

currently zoned R-100 and the request is to rezone the property to R-TH to allow the

development of 18 townhouses. The proposed density is 6.25 units per acre which is

much less than the 8 units per acre allowed. The property is adjacent to an abandoned

fire station and across the street from commercial uses and the applicant believes that

the townhomes will provide a smooth transition from those intense uses to the less

intense residential uses to the west of the property. The homes will be a minimum of

1,650 square feet with 3 bedrooms and 2.5 bathrooms in the units. Each home will also

have a 2 car garage and driveways deep enough to allow the parking of 2 additional

cars. The plan also provides for 4 additional parking spaces for when guests or family

visit the community. The front fagade will consist of a mixture of brick and stone with

accents of concrete siding with the sides and the rear will be all brick with only accents

of concrete siding. The interior will consist of units with 9-foot ceilings, hardwood floors

and granite countertops with the expected price point to be in the $280,000 range and

up. The upkeep of the exterior of the homes as well as all the common space and yard

maintenance witr be provided by the mandatory HOA. There is a creek along the west

side of the property that will permanently provide a vegetated buffer from the proposed

townhomes and the abandoned fire station, to our knowledge, has been sold to a user

that plans on some type of commercial use.
