1. DEFINITIONS 1.1 Bidder: Bidder who submits the proposal.

1.2 BOQ: Bill of Quantities.

1.3 HEC: Higher Education Commission.

1.4 PIP: Project Implementation plan

1.5 RFP: Request for Proposals.

1.6 Second Party: Qualified Bidder.

1.7 Qualified Bidder: Bidder qualified for the award of contract against this tender.

1.8 Service Level Agreement: The level of service which HEC purchases from the

Qualified Bidder in respect of the service.

1.9 SLA: Service Level Agreement.

1.10 Warranty/Services of items/parts: All hardware, support, repair, replacement,

backups etc and services of all middleware including device and customer interfaces

and after sale support.

1.11 Trouble Ticket: A File that identified the fault, the technical detail of the fault and the

resolution.

1.12 Restoration Time: time measured between a trouble ticket being received, logged and

accepted by the Service Provider and restoration of the system(s)/service(s)/

functionality (ies).

1.13 Resolve: To restore the system(s)/services(s)/functionality (ies) on which a trouble

ticket is issued and complete all further activities necessary to close the trouble ticket.

1.14 Resolution Time: The time measured between a Trouble ticket being received, logged

and accepted by the Service Provider and the answer to / completion of the trouble

ticket.

1.15 Acceptance: Acceptance means Receipt by the Authorized person/ institution/

authority of the specified quantity or package of Wireless Broad Band Services at the

indicated site, place or institution.

1.16 Account Manager: Project or Task Manager; who has the prime responsibility of the

project/ task execution.

1.17 Authorized Service Center: Authorized Service Center means a Service Center

run by the Bidder

1.18 Bidder: Bidder means legally registered in Pakistan and be registered with FBR for Tax

purpose. The service provider should hold valid PTA license to offer required services.

1.19 BOC: Bill of Costs

1.20 BOQ: Bill of Quantities

1.21 Call Center: Call Center means the Center or the Place wherein the Bidder shall make

arrangements to receive complaints/ service calls from the customer/ students and

institutions.

1.22 Commissioning: Commissioning means the Wireless broad band service would have

to be functioning and specifications as per criteria and standards mentioned in the RFP

Document.

1.23 Contract: Contract means an agreement signed between the HEC and the Qualified

Bidder.

1.24 Day: Day means a working day (if not stated otherwise)

1.25 Delivery: Delivery means supply of the specified quantity or package of Wireless

broadband services at the indicated site, place or institution

1.26 Direct Service Center: Direct Service Center means a Service Center owned and

operated by the bidder itself

1.27 End user: End user means the person/ student to whom the Wireless Broad Band

Service is actually delivered for use and who will be entitled to demand after sales

services as per Contract.

1.28 First Party: Higher Education Commission

1.29 FY: Financial year

1.30 HEC: HEC means Higher Education Commission, Government of Pakistan

1.31 HEI: Higher Education Institution (HEI) means recognized institution by the Higher

Education Commission, Government of Pakistan.

1.32 MRC: Monthly Recurring Cost.

1.33 OTC: One-Time Cost

1.34 Procuring Agency: Procuring Agency means Project Directorate, Higher Education

Commission, and Government of Pakistan

1.35 Prospective bidder: Bidder who intend to participate in the tender process and fulfill

condition at 1.18.

1.36 Region: Geographical Business domain of principal to which Pakistan belongs.

1.37 RFP: Request for Proposal

1.38 Second Party: Qualified Bidder

1.39 Qualified Bidder: Bidder Qualified for the award of tender

1.40 Service Center: Service Center means the Center or Place, wherein the Bidder, inter-

alia undertakes and performs the service activities relating to the Wireless Broad Band

Service indicated in the Bid and shall include a Direct Service Center(s) or Authorized

Service Center(s).

1.41 Service Level Agreement: The level of service which HEC requires from Qualified

Bidder in respect of the services to be provided to students during the course of

warranty/ support period.

1.42 Qualified Bidder: Successful Bidder means the Bidder who become successful

through bidding process.

1.43 Total Bid Value/ Total Cost or Price: Total Cost means the aggregate cost of the

goods, prevailing taxes and services over one (01) year as required by the HEC.

1.44 Warranty/ Services of items/ parts: All hardware, support, repair, replacement,

backups etc. and services of all software including its installation, configuration,

updates, upgrades & online support. All patches upgrades, update.

price of the quoted Wireless Broad band Service, is submitted.

3.7. All pages of the blank RFP Document in full are signed by the

authority, stamped and submitted.

3.8. Earnest Money (EM) amount as specified in the RFP Document is

submitted in a separate sealed cover.

3.9. Filled up Technical Proposal is signed by the authority, stamped and

submitted.

3.10. The Eligibility Criteria/ Qualification Criteria are signed by the

authority and stamped.

Bidder’s undertaking on the Letter Head to the effect that they agree to

the Eligibility/ Qualification and Evaluation Criteria are signed, stamped

and submitted with the relevant documents.

3.11 A certificate of assurance and guarantee on the Letter Head from the

bidder that it will ensure supply of the wireless devices within the time

line specified in the Bid Documents, is submitted.

3.12 A list of Direct Service Center and Authorize distributor’s Service

Center is submitted.

3.13. All the undertaking/ letter heads and certificates wherever required

are signed, stamped and submitted.

3.14. Supporting Documents to meet the Eligibility/ Qualification Criteria.

3.15. All the supporting documents to meet the Qualification Criteria as

laid down in the Bid Documents and under Eligibility Criteria, are

signed by the authority and stamped.

3.16 Copy of Bidder’s Certificate of Incorporation/ registration is signed,

stamped and submitted.

3.17 Copy of Annual Reports including Balance Sheet, Income

Statement and Profit & Loss accounts for the previous three

audited years along with notes to auditors are submitted. It is

further mentioned that average will be taken on the basis of three

years, irrespective of the fact whether accounts are submitted for

the period of three years or a lesser period.

3.18 For wireless broad band services sales, copies of the invoices for

the sales made or proof of statutory documents like Income Tax,

Excise Duty Returns or Sales Tax Returns or any other legally valid

documents are submitted for the previous three years.

3.19 Bidder’s undertaking on letterhead that company has never been

Blacklisted, is submitted.

4. Whether Financial Proposal (Envelope B) contains the following;

2. Additional Notes

APPLICABILITY OF PUBLIC PROCUREMENT RULES, 2004 (REV.)

This Bid Process will be governed under Public Procurement Rules, 2004 (Rev.), as

amended from time to time and instructions of the Government of Pakistan received

during the completion of the project.

IMPORTANT NOTE:

Bidders must ensure that they submit all the required documents indicated in the RFP

Document without fail. Bids received without undertakings, valid documentary

evidence and supporting documents and the manner for the various requirements

mentioned in the RFP Document are likely to be rejected at the initial stage. The valid

documentary evidences for the critical components as detailed hereinafter should be

submitted by the Bidder for scrutiny. The Bidders are required to read the RFP

Document and applicable laws and submit any objection thereof in writing in the pre-

bid meeting; failing which no objection shall be entertained regarding the terms and

conditions of the RFP Document and the Bid Process at the later stage.

PURPOSE OF THIS DOCUMENT

The purpose of this document is to share/ present the macroscopic view of the project

objectives and requirements while giving its background. Vision & Objectives, Scope

of Work, Project Methodology as per HEC requirements, Bids Submission

requirements, Selection Procedure and Criteria, Terms & Conditions, Payments

Terms, and Warranty Support/ Services are also elaborated in this document to

provide necessary information about this tender for potential bidders. Bidders are

required to provide the required information by filling up the Bid Submission Forms

while strictly following the format given at Annexure –IV.

3. INTRODUCTION

It is an established fact that there is a direct correlation between knowledge capital

and economic development. Pakistan to become an emerging power needs to

enhance its intellectual capital and transform into a knowledge-based economy. The

strategic framework for meeting the contemporary and future challenges as defined

in “Vision 2025” of Government of Pakistan, acknowledge the importance of

globalization and dispersion of information and technology, which are likely to

dramatically change the scale and character of human enterprise. Universities and

institutes of higher learning are envisioned to build economies through providing

knowledge capital. HEC adopts the strategy targeted at the provision of an

environment conducive to quality education in all the higher education institutions

through faculty and infrastructure development. One of the major challenges being

faced by the higher education sector across the country, is access opportunities to

higher education and so to increase the enrolment in higher education from 5.8% to

10% by 2015 and 15% by 2020, as per National Education Policy 2009. HEC

encourages cost-effective and widespread dissemination of knowledge through the

use of educational technologies and distance education so that far-flung areas are

covered while simultaneously ensuring that quality standards are not compromised.

The demographic transition being experienced, poses another challenge to equip our

youth with the knowledge and skills necessary for development in the 21st century.

The fact that Pakistan is on a favorable portion of the demographic transition can

prove to be a demographic dividend, however if left alone, poses serious threats in

form on an illiterate and intolerant population.

A good progress has been made in higher education sector in Pakistan, and

significant transformations have taken place as to come out as one of the dynamic

sectors which is rapidly evolving and developing the capacity of HEIs to serve as

engines of growth in country’s socio-economic development. Despite of these

progress and positive change as well as potential which is widely acknowledged, the

higher education sector of Pakistan faces numerous challenges and issues, like poor

university – industry interactions, poor university – community relationship, low

enrolment, lack of capacity for continuous faculty and staff development, are amongst

the few. Strategic vision of HEC for higher education realizes that key to overcome

many of the current and future challenges, is to invest significantly in the Information

and Communication Technologies (ICTs), as witnessed in many emerging

economies around the world. Modern information and communication technologies

are key to enhancing efficiency, efficacy and impact of programs of development in

the higher education sector. Using distance education and open learning, affiliating

universities must leverage ICTs to play a major role in improving quality and widening

access to higher education in Pakistan.

Realizing these challenges and the opportunities and strengths this country

possesses, the Government of Pakistan as per the directives of the Prime Minister

launched National Program for Provision of Laptops for the bright and talented young

students studying at any of the public sector higher education institute or Government

Polytechnic Institutes across the country. The scheme is envisioned to promote

outreach of youth to information and communication technologies (ICTs) as to bridge

the digital divide not only within the higher education sector but across other sectors

as well, and to the communities throughout the country. Under this scheme, the first

phase has been successfully executed and 100,000 wireless broad band service

along with laptops were provided to talented students acquiring higher education at

any of the public sector higher education institutes (HEIs) and Government

Polytechnic Institutes. The Higher Education Commission has been given the

responsibility of program designing, implementation of scheme, and execution of the

project. HEC now intends to launch the next phase of the scheme under which

200,000 laptops are to be given to the students as per the criteria along with a

Wireless Broadband dongle device and 4G Services. The wireless broadband

service are procured in a transparent manner through competitive bid process under

Rule 36 (b) following the procedures stipulated in the Public Procurement Rules 2004

(rev.). HEC shall ensure that the procurement for the second phase of scheme as

well remains transparent and achieve even higher level of satisfaction of the

stakeholders and the Transparency International Pakistan. The Qualified Bidder

would be required to supply the required quantity of the Wireless Broad band dongle

and required Services at the designated Universities / institutions as per list at Annex-

III. The Qualified Bidder would also be required to provide detail of offices and

adequate number of service centers for warranty enforcement.

Accordingly, the HEC has invited Bids for provision of Wireless Broad Band Services

of approximately two hundred thousand (200,000) dongle devices as per the technical

specifications, service requirements and timeframe given in the RFP document. The

supply and distribution of WBBS shall be made by the Qualified Bidder against the

Purchase Order issued by HEC and within the specified delivery time as per delivery

schedule, after signing of the contract.

4. OBJECTIVE The Higher Education Commission, Pakistan (HEC) intends to provide wireless

broadband services under the Prime Ministers’ Laptop Scheme Phase – III to all

the recipients of laptops as supplementary service to the students of public sector

universities. The objective of HEC is to provide a reliable and economical access

to knowledge resources and help the students utilize the Wireless Broad Band

Service for enhancement of their knowledge base across the country.

This RFP is intended to acquire dongle devices to provide wireless broadband

service to the students of 105 public sector universities / Institutes along with their

sub campuses in almost 51 cities across Pakistan. The bidders have to ensure

that their service footprints are available at least in the cities enlisted at Annex-III

with a provision of service coverage area of at least 85% while the remaining of

the 15% coverage should be ensured within 3 months of the agreement for

required services. However the lead bidders having 85% coverage may come in

joint venture with other telecom operators to cover the northern areas.

5. SCOPE OF WORK HEC intends to procure 200,000 wireless broadband devices with at least three (03)

months free services of 4G to the students of all the public sector universities /

institutes.

Operational Requirements:

a) The Qualified Bidder shall supply 200,000 dongle devices and

distribute them amongst the entitled students as determined by

HEC’s defined criteria.

b) The Qualified Bidder will be required to provide 60,000 devices within 4

to 8 weeks upon issuance of Purchase Order whereas the remaining

delivery will be required to complete within (18) Eighteen weeks.

c) For the delivery of devices the Qualified Bidders will be required to

directly deliver the desired number of devices to designated

universities with proper handing over and taking over with the

university.

d) The Qualified Bidder shall ensure that the intimation of service take

place as soon as a student plugs in device and receives an SMS

detailing the activation process at the device application interface

from the service provider, and The Qualified Bidder will establish

kioask for BVM at designated universities during the distribution.

e) The Qualified Bidder will activate each individual device in the name

of specific student and ensure that each individual device is

attributed to a particular recipient of device (i.e. Student). The

particulars of the individual including Name, CNIC, Name of

University and other relevant record shall be collected by Qualified

Bidder and also shared with HEC.

f) The Qualified Bidder shall ensure that HEC’s digital library resources

are seamlessly accessible through these devices. To enable

students to access the digital library services attributed to respective

universities, the digital library traffic has to be routed through PERN.

The Qualified Bidder will extend dashboard displaying the activation

detail (i.e. users name, university, activation date/time etc.) and

utilization pattern of the service being availed.

g) The Qualified Bidder shall provide devices capable of connecting 4G

networks and fall back options to lower versions of technology as

well.

h) The Qualified Bidder shall provide facility of enterprise portal to HEC

to manage the Multiple Campaigns of HEC projects/ Services using

HEC short Code 9432 for two way communication messages (SMS)

and Bulk Broadcast one way as detailed in Technical Requirement

Sheet of the RFP. Through It’s own setup or Partner SMS

Aggregator. HEC may like to Continue the SMS Aggregator services

onward to this Contract

i) The Qualified Bidder shall provide country-wide roaming facility to all

student under this project.

j) Qualified Bidder will be required to extend the level 1 support to the

student through their CRM and Help.

k) Qualified Bidders has to provide one observer account to HEC to

observe the Level 1 support responses

l) Qualified Bidders has to make the customize help guide for the

students elaborating all the mechanism for L1 support , committed

response / resolution time against different compliant types to be

tackled in L1 support and the escalation mechanism to HEC.

m) Qualified Bidders will incorporate the escalation mechanism in the

Help Guide in case of delay in L1 support by Qualified Bidders.

Students will be required to log their complaints on

http://helpdesk.hec.gov.pk for escalation. The compliant will be

forwarded to Service provider and Service provider has to respond

L2 complaints on HEC portal.

n) The Qualified Bidder will ensure standard customer experience of

offered services as per PTA’s determination.

o) Service Provider should have 3G/ 4G services available to at least

85% students’ population within cities identified in the RFP. The

remaining students’ population within the identified cities should be

provided within next Three (03) months.

p) Service Provider will ensure 3G/ 4G coverage area within the cities

for at least specified kilometer radius from the respective university

as central point, as referred in revised Annex – III.

q) The bidders seems to have difficulty in services provisioning they

may engage the third party aggregator which usually have

agreement with all the telecom operators.

Commercial Requirements:

a) The Qualified Bidder shall provide first three months wireless broadband

4G services free of cost to the students, effective from date of activation

of dongle device.

b) The one-time cost (OTC) of the device should not exceed Rs.2000/-

(inclusive of all Taxes and duties) per device.

c) The monthly recurring cost (MRC) should not exceed Rs. 499/- (inclusive

of all Taxes) for 20GB volume per month.which will payable by students.

d) The bidders shall be providing extra volume to students as per their

usage on pro rata basis (i.e. MRC ÷ 20GB) after FOC period.

e) After FOC period every package / volume availed by students will be

charged to students direct by service provider. HEC will not have any

liability on it.

f) The bidder shall also offer education plan(s) with at least 20%

discounted rate on all available consumer/ commercial packages, as

long as students maintain their status.

Branding Requirement:

a) All devices as well as packing shall be co-branded as per the

specifications and instructions of HEC.

b) All devices should be accompanied by warranty card, instructions

manual, service center details and other important information.

6. BID SUBMISSION REQUIREMENTS

The objective of bid submission requirement is to provide bidders with the

information to submit their bid in response of this RFP.

Bidders must follow following requirements for their proposals/bids.

a. For this tender, PPRA 36(b) “Single Stage - Two Envelope” procedure

shall be followed. However, tender shall be awarded to on least cost

selection basis.

b. Bids shall comprise of single envelope containing envelopes, i.e.

Technical and Financial Proposal, and clearly marked as Technical and

Financial proposals.

c. Bidders shall submit two (02) copies of bid containing Technical and

Financial Proposals (including soft copies on CD/ DVD).

d. Bidder shall submit bids at the address given in Tender Notice and in

this RFP by hand.

e. Bidders shall submit a signed letter with Official stamp affixed on it as

per the format given in as Annex - IV cover letter to the Bid/Proposal.

Bids/Proposals submitted without this cover letter will not be accepted

and bids will be rejected straightaway.

f. Bidders are required to quote the solution complying with the Scope of

Work at section 6 of this RFP with minimum Specification set out in

Forms I and any additional item(s) that are deemed required to

complete the scope of work must be included.

g. Technical proposals shall contain Company profile, Authorization &

relationship with principal firms, location of branch offices, company

experience in related field, technical staff details (branch-vise), project

completed, major clients’ list as per the format given in Annex V “Firm’s

References”, equipment’s technical details (brochures, etc) mentioning

compliance and properly highlighted all the compliance specification as

requested in Form I “Technical Requirements” using florescent

highlighter of quoted hardware/equipment and material with their make,

model, part number.

h. Bidders are required to fill and sign the Technical Requirement Form I,

as provided in this RFP and must submit them along with Technical

Proposal.

i. The Qualified Bidder must provide Project Execution Plan as per

Universities /HEIs list attached at Annex-III.

j. Bidders are required to submit Technical Proposals according to the

solution requirements mentioned in this document while furnishing the

proposal in sequence and manner as set forth in Technical Evaluation

Criteria, and Financial proposal according to Bill of Cost (BoC).

k. A Earnest Money (EM) amount as specified in the RFP Document i.e.

2% of the total bid value payable by way of Bank Draft in PKR drawn

on

National Bank or a Scheduled Bank in Pakistan in favour of the “D.G.

Finance, Higher Education Commission” payable at Islamabad. The

Earnest Money in the form of Bank guarantee or Insurance guarantee

is not acceptable. The Earnest Money should be enclosed in a

separately sealed cover along with the Technical Proposal duly

marked as “Earnest Money”.

7. SELECTION PROCEDURE

a) Evaluation of the firms shall be based on information provided in Technical

b) Bidders are required to meet all the mandatory conditions as defined herein

for further consideration of bid for financial comparison

c) Bidder must provide POC (Proof of Concept) to access of Digital resources

through PERN as defined in the Scope of work of this RFP. Unsuccessful POC

may lead to technically disqualification from the tender.

d) Only technically responsive bidder will be considered for further processing

and comparison of financial bids.

e) The bid found lowest evaluated and technically fully compliance to the BoQ

and this RFP will be accepted for the award of contract subject to the approval

of Competent Authority.

f) After the approval of contract award, a contract agreement on the stamp paper

worth Rs. 1000/- shall be executed by the firm with Qualified Bidder within 15

days from the date of issuance of Letter of Intent.

g) For ordering purpose the price evaluation will be done against complete /

whole items including miscellaneous except optional items of bid, and not on

individual item basis. However, HEC shall only be paying initial One Time Cost

(OTC) as quoted by the Qualified Bidder.

h) If anything is not quoted as per BoC/BoQ it may lead to cancellation of whole

bid.

8. MINIMUM REQUIREMENTS FOR SERVICE LEVEL AGREEMENT

Following requirements for SLA apply to the scope of work defined in this RFP

for the project;

a) Qualified Bidder shall ensure that all devices supplied to HEC are new (non-

refurbished) and free from any sort of defects.

b) Qualified Bidder will be required to extend the level 1 support to the student

through their CRM and Help.

c) Qualified Bidders has to provide one observer account to HEC to observe the

d) Qualified Bidders has to make the customize help guide for the students

elaborating all the mechanism for L1 support , committed response / resolution

time against different compliant types to be tackled in L1 support and the

escalation mechanism to HEC.

e) Qualified Bidders will incorporate the escalation mechanism in the Help Guide

in case of delay in L1 support by Qualified Bidders. Students will be required

to log their complaints on http://helpdesk.hec.gov.pk for escalation . The

compliant will be forwarded to Service provider and Service provider has to

respond L2 complaints on HEC portal.

f) The Qualified Bidders will be required to maintain at least 3% of devices

distributed in respective in at least one service center in respective city listed

at annexure-III for replacement in case of fault.

g) Under 3% stock limit in each service center the replacement to the faulty

devices will be required through service centers same day while beyond 3%

stock limit in each service center the replacement may be provided next day.

h) Each breach to the SLA will be counted as one violation. Every additional

hours in delay services will accumulate one more violation. The financial

penalties on the SLA will be imposed as per following table.

9. TERMS OF PAYMENT

a) No payment shall be made in advance to the Contractor as mobilization

advance.

b) 100% Payment of devices will be released after delivery to universities /

institute. And placement of SMS System as per Contract. Invoice shall submit

not less than 10,000 devices.

c) Upon signing of contract Successful bidder will submit the performance Bank

Guarantee equal to (10%) ten percent of value for the 1 Year warranty/Service

period.10 % Bank Guarantees will be released after successful completion of

warranty service period.

d) The two percent (2%) bid earnest money equal of total bid value deposited by

the Qualified Bidder at the time of bid submission will be release after

submission of 10% bank Guarantee.

e) 10% deduction shall be made from each invoice as (Retained Money), for any

deductions as applicable under the contract, and will be released subject to

successful fulfillment of warranty and service. Qualified Bidder may extend

Performance Bank Guarantee or provide fresh Bank Guarantee equal to 10%

in lieu of Retention Money.

f) Upon acceptance of invoice payments shall be made within (30) thirty days

from the date of submission of each invoice.

g) All prices must be provided in PKR inclusive of all applicable taxes.

h) HEC may consider any other alternative arrangement for payments which falls

in the legal framework of Government of Pakistan (GoP) at the time of

Contract signing with Qualified Bidder. Taxes will be deducted as per

government of Pakistan rules at the time of payment. However in case the

Qualified Bidder is able to produce a copy of the exemption certificate in the

name of qualified bidder then no tax shall be deducted and no amount shall

be withheld.

10. LIQUIDATED DAMAGES

a) In case of delay in delivery of item / services as per contract as defined in the

scope of work in this RFP, the Executive Director, HEC reserves the right to

impose a penalty not exceeding 10% of the total amount of the contract at the

rate of 1% for each week of delay in handing over segment(s).

b) In case of delay of Services, the Executive Director, HEC reserves the right to

impose a penalty not exceeding 10% of the total amount of the contract value

for the first year at the rate of 1% of the contract amount for each week of

delay.

c) If the work is not executed according to the satisfaction of the Executive

Director, as per the scope of work, the ED reserves the right to reject it

altogether or impose a penalty not exceeding 50% of the contract amount for

the first year and work done from other party at the risk and cost of

bidder/contractor.

11. GENERAL TERMS AND CONDITIONS

Following general terms & conditions apply

a) Only valid 3G-4G PTA Licenses with mobility across the cities holder can

participate (documentary proof is mandatory) for this tender.

b) Only valid SMS Aggregator PTA Licenses with existing experience of two

government organizations short code hosting in-hand projects can participate

(documentary proof is mandatory) for this tender.

c) The bidder should be registered with sales Tax and Income Tax Department.

d) An affidavit to the effect that the firm has not been blacklisted by any

Government/semi Government organization and also provide Integrity Pact.

e) If a bidder has quoted multiple options, in this case bidder should submit the

earnest money equal to 2% of highest quoted option. Further the amount of

any optional requirement shall be added to total bid value.

f) Incomplete and conditional tenders will not be entertained.

g) The Commission reserves the right to accept/reject wholly or partially any

tender without assigning any reason at any stage of the tender process.

h) Validity period of the bids shall be 120 days.

i) The decisions of HEC will be binding on all concerned and will in no case be

challengeable at any forum or any court of law.

j) Bids are liable to be rejected if they are not conforming to the terms, conditions

and specifications stipulated in this RFP.

k) Bidders are required to submit a signed copy of Technical Compliance Sheet

and Certificates as in Form-I while affixing official stamp on it.

l) During the examination, evaluation and comparison of the bids, the HEC, at

its sole discretion, may ask the bidder for clarifications of its bid.

m) The request for clarification and the response shall be in writing/email and no

change in the price or substance of the bid shall be sought, offered or

permitted.

n) If there is a discrepancy between unit price and total price in the submitted bid

which is obtained by multiplying the unit price and quantity, the unit price shall

prevail and total price shall be corrected. If there is a discrepancy between the

words and figures, the amount in words shall prevail. If there is a mistake in

addition/ totaling, that shall be corrected. If the bidder does not accept the

corrected amount of bid, his bid shall be rejected and his tender security

forfeited.

o) For this tender all updates/changes shall be communicated through email and

also be posted on HEC website.

p) In case of any dispute between the two parties of any matter arising out of

after signing the contract agreement, the case shall be referred to Executive

Director, HEC whose decision shall be final and binding on both parties.

q) If the progress of the work is not to the satisfaction of ED(HEC), the ED(HEC)

has the right to cancel the order, get the work done by some other

Contractor/Firm subject to the first party has to pay any amount in excess of

the agreed amount, the difference will be recovered from the second party.

r) Bids submitted via email or fax will not be entertained

s) Bidders shall provide a certificate from their bank certifying their sound

financial position and credit limit from the bank or any appropriate

documentary proof (e.g.

Annual Audit Report), showing the financial strength of the bidders.

t) Bidders indemnify HEC against all third party claims of infringement of patent

trade mark, industrial design rights arising from use of the goods of any part

thereof in Pakistan.

u) Operation and maintenance of the equipment infrastructure will be the sole

responsibility of the Qualified Bidder.

v) Force Majeure refers to events such as wars, fires, typhoons, floods, earth

quakes, or other events that are regarded to be Force Majeure factor. The

confirmation of a Force Majeure event must be based on legally valid

supporting documents that are provided by an authoritative body that is jointly

recognized by both HEC and the Qualified Bidder. Employee strikes and

Construction Work carried out by any organization will not be considered as a

force majeure event.

w) The bidder should execute the entire Works on Turnkey basis as per network

and specification requirements in all respect according to the functional and

technical specifications.

x) Any equipment or material etc., omitted from BoQ and other lists, which may

be reasonably implied and obviously necessary for the completion and

efficient performance of the System in accordance with the specification, shall

be deemed to have been included in the Bid Price.

y) The bidder must provide and comply with the following:

1 Income Tax Certificate / GST Certificate.

2 Mandatory and Information Requirement Checklist.

3 Completely filled BoQ.

4 Certificate of Authorized Dealer, Partner, etc.

5 Location of Offices in major cities as per list provided at Annex-III.

6 Quoted Product Technical Compliance (as per FORMS I,).

7 Technical Requirement (clause by clause compliance of RFP).

8 Project Execution Plan (Time Line, Resources, dedicated Staff, Shared

Staff ext.). 9 List of relevant technical staff.

10 Mandatory and Information Requirement Checklist.

12. MEET OR EXCEED SPECIFICATIONS

The specifications provided in this RFP are the minimum requirements of HEC.

The Service Providers must meet or exceed these specifications to meet the

actual requirements of this Project and its successful practical implementation.

But in such a case additionally proposed or altered specifications should clearly

be highlighted to enable HEC to clearly identify modified specifications.

15. FINANCIAL EVALUATION

Financial bids shall be evaluated of only Technically Qualified bidders. While doing financial

evaluation, total bid value shall be considered provided the financial bid includes all the costs

involved in the project as per the requirements set forth in this document, and strictly

following the format given in BoQ.

16. AWARD OF TENDER For the purpose of award of tender, the Least-Cost-Selection (LCS) of the PPRA 36 (b) shall

prevail, and Lowest Evaluated Bid amongst the technically qualified bidders shall be

accepted for the award of tender.

The administrator should be able to command the SMS system to transmit emergency messages using masking/codes via a SMS command to the system without accessing the web interface

Auto Replies o SMS system should be able to automatically respond to SMS recipients/respondents with acknowledgement if required by HEC for any particular campaign.

Detailed Analytics /Graphs

The SMS web based system will generate periodic graphical and tabular downloadable reports campaign wise, time wise and mask wise. The system should be able to maintain at least six months historical data.

Keyword Based reporting

HEC proposed system must have filtering of data/reports based on specific responses from the mobile numbers responding to HEC via SMS. For example, how many people responded with “Yes”, how many with “No” etc.

HEC proposed system must have to run multiple compaigns in prallel thorugh the web / GUI interface with the user feed back recoding mechansiim with differnts SUB codes and generate live online feed back with graphs and drill down linked data

HEC proposed system aggregator must have running atleaste two Goverment services Short_code for feedback process

HEC proposed system aggregator must have agreement with all the Cellular Operators in pakistan to whitelist HEC ShortCode 9432 within 15 days of singing of the contract
