TRASCRIZIONE DI CERTIFICATO DI NASCITA DI MINORI

É sufficiente che uno o entrambi i genitori si presentino in Consolato senza appuntamento durante il normale orario di apertura al pubblico, consegnando la documentazione sotto elencata, che non verrà restituita.

Se alla data di presentazione il nominativo riportato nel certificato ha già compiuto 18 anni, l’interessato deve invece richiedere un appuntamento per “riconoscimento di cittadinanza”.

I genitori hanno facoltà di attribuire ai propri figli anche il cognome materno, in aggiunta ma non anteposto a quello paterno. Il provvedimento si applica solo per tutti i certificati di nascita emessi all’estero a partire dal 29 dicembre 2016.

L’opzione può essere esercitata anche quando il certificato di nascita del minore riporta solo il cognome paterno. A tale scopo, si raccomanda tuttavia di ottenere un certificato di nascita riportante la dicitura che riflette esattamente la volontà dei genitori.

DOCUMENTI DA CONSEGNARE AL CONSOLATO 1. Formulario, compilato preferibilmente in modo elettronico; 2. fotocopia dei passaporti dei genitori (solo le pagine con

firma e foto); 3. certificato di nascita esclusivamente in versione originale,

corredato di apostille; 4. traduzione integrale del certificato di nascita in lingua

italiana. Si suggerisce di contattare un traduttore NAATI.

NOTA BENE

Qualora per il nuovo nato venga contestualmente richiesto il passaporto, questo potrà essere rilasciato lo stesso giorno purché (1) la richiesta di trascrizione del certificato di nascita sia stata presentata con documentazione regolare e completa e (2) il nucleo familiare sia iscritto all’AIRE tramite questo Consolato.

L’attribuzione al nuovo nato del cognome paterno e/o materno (o parte di essi) come nome (o parte di esso) costituisce violazione dell’art. 34 del DPR 396/2000 e comporta per il Comune l’obbligo di segnalare il fatto alla Procura della Repubblica, che instaura un procedimento finalizzato alla rettifica del nome. Qualora sia stato rilasciato un passaporto, sarà necessario annullarlo e procedere all’emissione di un altro riportante i dati corretti, dietro rinnovato pagamento di tutti i diritti consolari.

Qualora il matrimonio dei genitori fosse avvenuto all’estero e non fosse ancora trascritto in Italia, è necessario provvedervi prima di richiedere la trascrizione della nascita del minore.

In Australia Occidentale, i certificati di nascita e di matrimonio sono rilasciati dal Registry of Birth, Deaths and Marriages; le sentenze di divorzio sono rilasciate dal Family Court.

L’apostille non deve essere tradotta, la traduzione non deve essere apostillata.

REGISTRATION OF A CHILD’S BIRTH CERTIFICATE

No appointment is needed. It’s enough for one or both parents to visit us during our opening hours and surrender the below listed documents, which cannot be returned.

If on the lodging date the person in the birth certificate is over 18 years of age, a registration request can no longer be lodged. In that case, the applicant will have to to request an appointment for “citizenship recognition”. Italian parents are entitled to name their children by having the child’s mother’s surname added to the father’s surname, not followed by the latter. This provision only applies to birth certificates issued abroad from 29th December 2016.

The option can be expressed even when the certificate bears the father’s surname only. However, parents are strongly advised to obtain a birth certificate containing the wording that exactly reflects their wish.

DOCUMENTS REQUIRED AT THE CONSULATE

1. Application form (best completed electronically), signed by one or both parents;

2. plain copy of parents’ passports (only pages with signature and photo);

3. original full birth certificate with apostille; 4. full Italian translation of a full birth certificate. A

NAATI translator is recommended.

PLEASE READ CAREFULLY

A passport for the child may be issued on the same day, subject to (1) a correct and complete application for birth certificate registration having been lodged and (2) the household being AIRE-registered through this Consulate.

Parents are warned against using their surnames (or part of them) as their child’s given name (or part of it). Such conduct is in breach of art. 34 of DPR 396/2000 and entails the receiving Council to report to Italy’s relevant Authorities, initiating a procedure aiming at rectifying the child’s given name(s). Whenever a passport was issued according to said birth certificate, that passport will have to be withdrawn and replaced with a new one bearing the correct details, and all fees to be paid again.

If the child's parents were married abroad and the marriage was not registered in Italy, registration of said marriage needs to be requested and full documentation provided before applying for registration of a child’s birth certificate.

In WA, Births, Deaths and Marriages certificates are issued by the Registry of Birth, Deaths and Marriages; Divorce Orders from the Family Court.

Apostilles are not to be translated, translations are not to be apostillized.
