CONSTRUCTION OF A VEHICLE CROSSING ON A FOOTWAY OR VERGE

Section 1 IS PLANNING PERMISSION REQUIRED?

1.1 - Does your proposed Pavement Crossing give access onto a Classified Road? (e.g. A38, B4104 or C2707 road) If unsure call 0844 225 3002 and ask our Pavement Crossing Coordinator to check for you.

1.2 - Is the property a multi-dwelling (i.e. flats / maisonettes etc)?

1.3 - Is the property in a conservation area?

1.4 - Is the property a listed building?

1.5 - Will you need to do excavations, demolish, build or any other engineering work in order to create the parking area and access?

1.6 - Will you be changing over 5m square of your front garden to hard surfacing?

1.7 - Will you need to link to a surface water drainage system? NOTE: You will need to make arrangements to ensure water does not flow onto the public highway.

If you have answered YES to any of the above, contact your Local Planning Authority before proceeding further as you will probably require planning permission for your intended changes to your property.

Please do not submit an application to Ringway Infrastructure Services without confirming the planning requirements. If you submit an application and on assessment of the location the Pavement Crossing Coordinator finds that planning permission would be required, your application will be rejected and you will be notified to contact your Local Planning Authority.

Section 2 IS THE SITE SUITABLE? Yes No Office Use

2.1 - Is there a minimum length of 4.8m on the property? This is to ensure there is sufficient space to park a vehicle without it protruding over the footway or verge.

2.2 - Is there a minimum width of 3m?

2.3 - Is there a minimum of 15m from a junction? (Seek advice if unsure or within a cul-de-sac or minor estate road)

2.4 - Can vehicles and pedestrians be seen clearly in both directions?

2.5 - Is the area clear of trees within 1m of the crossing?

2.6 - Is the area clear of street furniture (road signs etc)?

2.7 - Is the area clear of street lights?

2.8 - Is the area clear of parking restrictions?

2.9 - Is the ground reasonably level? (Where the slope is greater than 1:12 it will not be approved)

If you have answered NO to any question in Section 2, please telephone 0844 225 3002 (Calls to this number are charged at 3p per minute plus callers suppliers network charge) to obtain further advice before proceeding further as your application may not be approved.

If you have answered YES to all the questions in Section 2, please proceed to Section 3 and tell us about the site and your plans.

a) If you are a tenant - contact your landlord / housing association as they will need to make the application.

b) If the property is, or was, owned by the Council, contact the Housing Department and obtain a letter from them to submit with your application confirming you have permission to proceed with the application.

Section 3 TELL US ABOUT THE SITE BEFORE CHANGES ARE MADE Office Use3.1 - What is the length of the front garden (from the front of the house to the back edge of the footway)?

3.2 - What is the width of the front garden / area of construction?

3.3 - What are the existing materials on your property (i.e. grass, shrubbery, paving etc)?3.4 - Is the driveway leading to a garage or are you planning to install gates? NOTE: Additional space will be required in order to open the garage doors / gates3.5 - What is the existing surface beyond your boundary (i.e. grass verge, pavement etc)?

You should also consider whether there will be sufficient space to get in and out of the vehicle comfortably and a clear path to your front door.

Frequently Asked Questions (FAQs) about Dropped Kerbs

I am unsure of my roads classification (is it a class A, B or C road) who can I ask?If you are unsure of your roads classification, please contact us on 0844 225 3002 (Calls to this number are charged at 3p per minute plus callers suppliers network charge) for advice.

I require vehicle access onto the A46 who do I contact?The A46 is classed as a trunk road and is the responsibility of the Highways Agency. If you require a vehicle access onto the A46 please contact the Highways Agency on 0845 750 4030.

I’m not the owner of the property, who do I contact?If you are not the owner of the property concerned, you should also approach your landlord for permission.

Who constructs the vehicular accesses?Vehicular accesses must only be constructed by the County Council’s approved contractor, Ringway Infrastructure Services.Please note that the applicant is solely responsible for all costs associated with construction of the access.

Do I need Planning Permission to pave my front garden?From 1st October 2008 new rules apply for householders wanting to pave over their front gardens.You will NOT need planning permission if a new driveway uses permeable (or porous) surfacing which allows water to drain through, such as gravel, permeable concrete block paving or porous asphalt, or if the rainwater is directed to a lawn or border to drain naturally.

What is the cost of constructing our standard access, as illustrated on the previous page?The cost of constructing our standard access can vary. However, as an indicative guide (and based upon a 1.8 metre footway crossing) you could expect to pay anything from £750.00 to £3000.00, VAT will be charged at the current rate at the time of making payment.

Please also note, that the higher sum of approximately £3000.00 assumes the relocation of utility apparatus, e.g. BT covers, lighting columns and drainage covers.

If planning permission is not required the following design criteria applies:

Width

The dropped kerbs should be a minimum of 2.7m driveway width at your boundary, together with the adjoining sloped (taper) kerbs (4.6m overall).

Alignment

Accesses should emerge onto the highway at right angles, as far as possible, to the road.

Gradient

Driveways should generally be no steeper than 1 in 12 (approx. 8%) and extend from the road to your boundary.

Turning Space

On busier roads or where driver’s vision is limited, the applicant should endeavor to provide on site turning space for vehicles.

Driver Visibility

When emerging from an access, the driver of a car is located about 2m (X) back from the nearside carriageway edge and their eye level is about 1m above the surface. From this point, the driver needs to be able to see as far as possible along the road in both directions. On through routes, the following distances should be achieved in either direction, measured along the nearside carriageway edge.

30mph - Y = 90m

40mph - Y = 120m

50mph - Y = 160m

60mph - Y = 215m

Where these distances cannot be achieved, the applicant should clear their site frontage of all obstructions over 1m in height (600mm in the case of vegetation) for as far as possible in either direction from the access and ask the advice of this Authority.
