1 Traffic Conduct

1.1RulesofConduct

Article5Itisanoffenceforanyroadusertoactinsuchmannerastocauseahazard(orapotentialhazard)onthepublichighwayortoobstructotherroadusersinanyway.Article6Allparticipantsintrafficareforbiddentobehaveinsuchawaythatatrafficaccidentattributabletothemoccursinwhichanotherpersoniskilledorsustainsseriousphysicalinjuryorphysicalinjurysuchthattemporaryillnessoccursorthatpersonispreventedfromengaginginnormalactivity.Article71 Itisanoffenceforanypersoninvolvedinaroad

accidentofanykindtoleavethesceneoftheaccident.

2 Personsareonlypermittedtoleavethesceneofanaccidentassoonas:

a.theopportunityhasarisentoestablishtheidentityofthepersonorpersonsinvolved;

b.theopportunityhasarisentoestablishtheidentityofthemotorvehicleinvolved;

c.itisclearthatnopersonorpersonssustaininginjuriesintheaccidenthasorhavebeenleftatthesceneoftheaccidentinneedoftreatment.

Article81 Itisexpresslyforbiddentodriveorallowadriver

tooperateamotorvehicle,whenheisundertheinfluenceofasubstance,whetherusedaloneorincombinationwithanothersubstance,whichheknows,orshouldreasonablybeexpectedtoknow,maycompromisehisdrivingabilitytosuchanextentthatheisnotfittooperateamotorvehicle.

2 Itisexpresslyforbiddentooperateamotorvehicleorallowadrivertooperateamotorvehiclewhenonehasconsumedalcoholicbeveragestothepointthat:

a.uponanalysisthealcohollevelinhisbreathappearstobegreaterthan220microgramsperlitreofexhaledbreathand/or

b.uponanalysisthealcohollevelinhisbloodappearstobegreaterthan0.5milligramspermillilitreofblood.

3 Contrarytosubsection2above,thedriverofamotorvehiclewhichrequiresadriver’slicence,shouldthedateoffirstissueofsaidlicencenotyetbefiveyearsagoandshouldthisdateoffirstissuehavebeenonorafter20March2002,isforbiddentooperateorbepermittedtooperateamotorvehiclewhenhehasconsumedalcoholicbeveragestothepointthat:

a.uponanalysisthealcohollevelinhisbreathappearstobegreaterthan88microgramsperlitreofexhaledbreathand/or

b.uponanalysisthealcohollevelinhisbloodappearstobegreaterthan0.2milligramspermillilitreofblood.


4 Contrarytothatstatedinsection2,itisprohibitedforthedriverofamotorvehicleforwhichadrivinglicenceisrequired,ifthefirstlicenceissuedwasalicenceauthorisingtheholdertodriveamopedandthislicencewasissuedtoapersonwhowasnotyeteighteenatthetimeofissueandthedateofissuewaslessthansevenyearspreviouslyandoccurredonorafter20March2002,todrivesaidmotorvehicleoroperateitasthedriverafterhavingconsumedsuchanamountofalcoholthat:

a.hisorherbreathisshowninatesttocontainmorethan88microgramsofalcoholperlitreofexhaledair,or

b.hisorherbloodisshowninatesttocontainmorethan0.2milligramsofalcoholpermillilitre.

5 Itisforbiddentoallowapersontooperateamotorvehiclewhenoneknowsormayreasonablybeexpectedtoknowthatthispersonisinaphysicalstateasdescribedinsubsection1,2,3,or4above.

6 Inapplyingsubsection3above,driver’slicenceistakenalsotomeanadriver’slicenceissuedbyarelevantauthorityoutsideoftheNetherlands.

2 Traffic Regulations

2.1Roadpositioning

aspossible.2 Cyclistsarepermittedtoridetwoabreast.Thisdoes

notapplytoridersofmotor-assistedbicycles.Article41 Pedestriansaretousepavementsorfootpathsat

alltimes.2 Ifthereisabreakinthepavementorfootpath,

pedestriansaretousethecycleormopedtrack.3 Ifthereisalsoabreakinthecycle,motorcycleor

mopedtrack,pedestriansaretousetheroadsideortheedgeofthecarriageway.

Article51 Cyclistsarerequiredtousethemandatorycycle

trackorthecycle/motorcycletrack.2 Ifthereisabreakinthemandatorycycletrackor

tousethemaincarriageway.3 Theymayusethenon-mandatorycycletrack.

Ridersofmotor-assistedbicyclesequippedwithcombustionenginesmayusethenon-mandatorycycletrackonlyiftheengineisswitchedoff.

4 Ridersofbicycleshavingmorethantwowheelswithatotalwidth,includingtheload,inexcessof0.75metresandofbicyclespullingtrailerswithatotalwidth,includingtheload,inexcessof0.75metres,mayusethepubliccarriageway.

5 Ridersaged16yearsandoverofmotor-assistedbicyclesasindicatedinArticle1,partone,sectione,subsectiondoftheactwhoareinpossessionofadisabledperson’sparkingcard,orofacardestab-lishedbyministerialregulationtodesignatethetransportofdisabledpersons,mayusethepave-mentorfootpath.

6 Ridersaged16yearsandoverofmotor-assistedbicyclesasindicatedinArticle1,partone,sectione,subsectiondoftheactwhoareinpossessionofadisabledperson’sparkingcard,orofacardestab-lishedbyministerialregulationtodesignatethetransportofdisabledpersons,shallusethepave-mentorfootpath.

7 Thefirst,secondandfourthpartsofthisarticledonotapplytoridersindicatedinpartsixhereof.

Article61 Motorcyclistsarerequiredtousethecycle/motor

cycletrack.2 Theyarerequiredtousethemaincarriagewayif

thereisabreakinthecycle/motorcycletrack.3 Ridersofmopedshavingmorethantwowheels


andmopedspullingtrailerswithatotalwidth,includingtheload,inexcessof0.75metre,mayusethepubliccarriagewaythatatrafficaccidentoccurs.

Article7Handicappeddriversandtheirspecialvehiclesmustusethepavement,footpaths,cycletracks,cycle/motorcycletracksorthepubliccarriageway.Article81 Horseridersaretousebridleways.2 Ifthereisabreakinthebridlepath,horseriders

aretousetheroadsideofthepubliccarriageway.Article9Pedestriansmayusethepubliccarriagewayiftheyformacolumnoriftheyaretakingpartinamarchorafuneralprocession.Article101 OtherdriversthanthoseindicatedinArticles5to

8inclusivemustusethepubliccarriageway.Forparkingtheirvehicles,thesedriversandpedestriansmovingatrailerapparentlyintendedtobemovedbyamotorvehiclemayalsouseotherpartsoftheroadexceptforpavements,footpaths,cyclepaths,cycleandmotorcyclepathsorbridleways.

2 Roadusersotherthancyclistsandhandicappedpersonsdrivingspecialvehiclesmaynotusebicyclelaneswithcontinuouslanemarkings.

2.2Overtaking

Article111 Allovertakingmustbecarriedoutontheleft.


2 Driverswhohavepositionedthemselvesontheleftandhavesignalledtheirintentiontoturnleftaretobeovertakenontheright.

3 Cyclistsmustovertakeothercyclistsontheleft.Theymayovertakeotherslowermovingvehiclesontheright.

4 Driverswhoarepositionedontherightofanindicatorpanelmayovertakedriversontherightwhoarepositionedontheleftofsuchpanels.

5 Tramsmaybeovertakenontheright.Article12Itisnotpermittedtoovertakeavehicledirectlybeforeoronapedestriancrossing.

2.3Queues

Article131 Whentrafficisqueuing,andwherethecarriageway

isdividedintoseverallanesheadinginthesamedirection,itisnotnecessarytokeeptotherighthandlane.

2.7Turning

b.iftheywishtoturntotheleft,theymusttakeupanappropriatepositionclosetothemiddleoftheroadoriftheyareonadualcarriagewaytheymusttakeupapositionasfartotheleftaspossible.

2 Driversmustgiveadvancewarningoftheirintentiontoturn,eitherbyusingtheirindicatororbygivingarmsignals.

Article181 Driversandridersintendingtoturnmustgiveway

toalloncomingdriversandridersandtoalldriversandridersontheirleft,rightandcomingupclo-selybehindthem.

2 Driversandridersintendingtoturnleftmustgivewaytooncomingdriversandridersintendingtoturnrightatthesameroadjunction.

Article19Adrivermustatalltimesbeabletobringhisvehicletoastandstillwithinthedistancethathecanseetobeclear.Article20Thefollowingmaximumspeedsapplyinbuilt-upareas: a.formotorvehicles:50km/h; b.formopedsandvehiclesforthedisabled,

equippedwithanengine: 1 onabicyclepathand/orbicycle/mopedpath:

30km/h 2 ontheroad:45km/h c.fordisabledvehiclesequippedwithanengine,

andformotor-assistedbicyclesasindicatedinArticle1,partone,sectione,sub-sectiondoftheact,onthepavementorfootpath,6km/h.

Article21Elsewherethefollowingspeedlimitsapply: a.formotorvehiclesonmotorways130km/h,on

mainroads100km/handonallotherroads80km/h;

b.formopedsandvehiclesforthedisabled,equippedwithanengine:

1 onabicyclepathand/orbicycle/mopedpath:40km/h

2 ontheroad:45km/h c.fordisabledvehiclesequippedwithanengine,

andformotor-assistedbicyclesasindicatedinArticle1,partone,sectione,sub-sectiondofthe


act,onthepavementorfootpath,6km/h.Article221 Wherealowerspeedlimitdoesnotapplyasa

resultofotherarticlesoftheseregulations,thefollowingspecialspeedlimitsapplytothefollowingvehicles:

a.forcampersthataccordingtotheirvehicleregistrationcertificatefallunderthecategoryofcompanyvehicle,whosepermittedmaximumweightexceeds3500kg,lorriesandbusesotherthanT100buses,80km/h;

b.forT100buses,100km/h; c.foragriculturalorforestrytractorsandmotor

vehicleswithlimitedspeed,asindicatedinArticle1.1oftheRegulations,withorwithoutatrailer,25km/h;

d.formicrocars,45km/h; e.formotor-assistedbicycles,25km/h; f. forpassengercars,commercialvehicles,

motorcycles,three-wheeledmotorisedvehiclesandT100busespullingatrailerwithapermittedmaximumweightnotexceeding3500kg,90km/h;

g.forvehiclesotherthanthoseindicatedinsectionscandf,withatrailer,80km/h.

apedestriancrossing; d.inatunnel; e.withinthemarkingsofabusstop,orifthereare

nomarkings,withadistanceoftwelvemetresofthebusstop.Thisdoesnotapplyiftheintentionistoallowpassengerstoboardortoalight;

f. withinabuslaneonthepubliccarriagewayor g.onaroadmarkedwithacontinuousyellowline.

2.10Parking

Article241 Driversmaynotparktheirvehicles: a.On,oratadistanceoflessthanfivemetresfrom,

aroadjunction; b.infrontofentrances/exits; c.directlyonthecarriagewayofamajorroad

outsideabuilt-uparea; d.inadesignatedparkingarea: 1 if,accordingtotheinstructionsontheofficial

parkingnotice,theirvehiclesarenotincludedinthecategoryorgroupofvehiclesforwhich


theparkingareaisintended; 2 inanotherwayorforanotherpurposethanas

givenontheboardornoticeunderthis; 3 ondaysorattimeswhenparkingisshownon

theofficialparkingnoticetobeprohibited. e.onaroadmarkedwithacontinuousyellowline; f. withinanareaspecificallydesignatedforthe

loadingorunloadingofgoods; g.inparkingbaysreservedforpermit-holdersas

Article251 Parkinginaparkingpermit(disctype)zoneis

prohibited,exceptinparkingspacesdesignatedorindicatedassuchorspacesfeaturingablueline.

2 Inspaceswithablueline,amotorvehiclewithmorethantwowheelsmaybeparkedonlyifthevehicleisequippedwithaclearlyvisibleparkingpermitinaccordancewiththetermsoftheParkingPermitDecree.Ifthemotorvehiclehasawindscreenthentheparkingpermitmustbeplacedbehindthis.

3 Theparkingpermitindicatesthetimethatparking

Article261 Parkingispermittedinadisabledparkingspace

onlyfor: a.adisabledperson’svehicle,iftheactofparking

isdirectlyrelatedtothetransportofadisabledperson;

b.amotorvehiclewithmorethantwowheelsinwhichavaliddisabledperson’scardhasbeendisplayedvisiblyiftheparkingisdirectlyrelatedtothetransportofthedisabledpersontowhomthepermithasbeenissued,ortothetransportofseveralpersonsresidinginaninstitution,providedthatthecardhasbeenissuedtothemanagementofthatinstitution;

c.ifthedisabledparkingspaceisreservedforaspecificvehicle,thatvehicle.

2 Ifasignbelowtheparkingsignindicatesamaximumparkingtime,Article25,parttwo,appliesaccordingly,bearinginmindthattheparkingspaceneednothaveablueline.


2.11Parkingbicyclesandmopeds

Article27Bicyclesandmopedsmaybeparkedonthepavement,onfootpaths,atthesideoftheroadorwhereveranofficialsignindicatesthatitispermitted.

2.12Signalsandidentificationmarks

Article28Driversmayonlysoundtheirhornsorsignalwiththeirheadlampstogivewarningofemergencysituations.Article291 Driversofmotorvehiclesusedbypoliceandfire

brigades,motorvehiclesinusewithemergencymedicalassistanceservices,andmotorvehiclesofotherassistanceservicesdesignatedbytheMinisterusebluerevolving,flashingorblinkinglightsandatwo-tonehorntoindicatethattheyareperformingurgentduties.

2 Thedriversindicatedinthefirstpartmayuseflashingheadlightsduringthedayinadditiontothelightsindicatedinthatpart.

3 Rulesmaybeestablishedbymeansofministerialregulationsregardingtheuseofbluerevolving,flashingorblinkinglights,two-tonehornsandflashingheadlights.


Article301 Driversofvehiclesusedforworktobeindicated

willuseyelloworgreenrevolving,flashingorblinkinglightsundercircumstancestobeindicated.DriversindicatedinArticle29,partone,willuseyelloworgreenrevolving,flashingorblinkinglightsinsteadofbluerevolving,flashingorblinkinglights.Thedriverofthefirstoronlyvehicletoreachthesitetoperformtheassigneddutiesmayusebluerevolving,flashingorblinkinglightsinstead.

2 Ministerialregulationsareissuedtosettherulesrelatingtotheuseofyelloworgreenrotating,blinkingorflashinglightsandtheroadworksandcircumstanceswhensuchsignalsareused.

Article30a1 DriversofmotorvehiclesindicatedinArticle29,

partone,mayuseadditionalindicatorsundercircumstancestobeindicated.

2 Rulesmaybeestablishedbyministerialregulationsregardingtheindicatorsmentionedinthefirstpartandthecircumstancesinwhichtheyareused.

Article30bArticles29to30ainclusivedonotapplytoBelgianandGermanmotorvehiclesinusewithpoliceandfirebrigades,inusewithservicesforfirst-lineemergencyassistanceandmotorvehiclesofBelgianandGermanassistanceservices,designedinorunderarticle29,partone,providedsuchvehicleseachusesignalsinaccordancewiththelegalregulationsapplicabletothemintheirowncountries.


Article30cMotorvehiclesthatformpartofafuneralprocessionmustdisplayanidentificationmark.Rulesgoverningtheidentificationmarkandthemannerinwhichthismustbedisplayedwillbedrawnupbyministerialregulation.Article31SignalsmaynotbegivenandtheidentificationmarksasindicatedinArticle30cmaynotbedisplayedinothercasesorinotherwaysthanasdeterminedinthearticlesinthissection.

2.13Usinglightswhiledriving

Article321 Driversofamotorvehicle,amoped,amotor-

assistedbicyclewhichisnotamopedasindicatedinArticle1,partone,section(e),sub-section(d)oftheact,adisabledvehicleequippedwithacombustionengine,oradisabledvehicleequippedwithanelectricmotorandhavinganenclosedbody,willusedimmedlightsduringthedaywherevisibilityisseriouslyrestricted,andatnight.DriversofadisabledvehicleequippedwithanelectricmotorbutnotequippedwithenclosedbodieswillatsuchtimesusethelightsindicatedinArticle5.18.43,partone,oftheVehiclesRegulations.

2 Drivingwithundippedheadlightsinsteadofdippedheadlightsispermittedexceptinthefollowingcircumstances:


a.duringthedaytime; b.inthepresenceofotheroncomingroadusers,

and c.whenfollowingclosebehindanothervehicle.3 Rearlightsandrearregistrationplatelightsmust

alwayscomeonwithundippedanddippedheadlights,sidelightsandfoglamps.

Article33Towedtrailersmustbeilluminatedindulldaytimeconditionsandatnighttheymustshowrearlights,rearregistrationplatelightsandsidelights.Article341 Wherevisibilityisseriouslyrestrictedasaresult

offog,snoworrain,driversofmotorvehiclesandvehiclesadaptedfordisableddriversmustusetheirfrontfoglamps.Inthatcase,driversdonotneedtohavetheirdippedheadlightson.

2 Wherevisibilityisreducedtolessthan50metresasaresultoffogorheavysnowfall,driversmustusetheirrearfoglamps.

Article351 Cyclistswilluselightsinaccordancewithparts2

through4whenridingatnightorduringthedayifvisibilityisseriouslyrestricted.

2 Abicyclewithtwowheelsandacyclewiththreewheelshavingasinglefrontwheelmustbeequippedwithawhiteoryellowlightcarriedatthefront,unlesstherideriswearingawhiteoryellowlightonhisorherchest.

2.27Seatbeltsandchildsafetysystems

Article591 Driversofpassengercars,commercialvehicles,

three-wheeledmotorvehicleswithenclosedbodiesormicrocarsandtheirpassengerswillusetheseatbeltsavailabletothem.Passengersunder18yearsofageandlessthan1.35mtallshalluseasuitablechildrestraintsystembearingasealofapprovalasindicatedinArticle22,part5,oftheact.Iftheseatsintendedforpassengersareequippedwithseatbelts,nomorepassengersmaybecarriedintheseseatsthanthereareseatbelts.

2 Passengercars,commercialvehicles,three-wheeledmotorvehicleswithenclosedbodiesormicrocarsnotequippedwithaseatbeltorchildrestraintsystemasindicatedinthefirstpartmaynotbe


usedtotransportpassengersunder3yearsofage,andpassengersaged3to18years,whoarelessthan1.35mtall,willbetransportedinseatsotherthanthefrontseats.

3 Passengersyoungerthan18yearsmaynotbetransportedinarear-facingchildrestraintsysteminafrontpassengerseatfittedwithanairbag,unlessthisairbaghasbeendisengagedorisdisengagedautomaticallyinaneffectivemanner.

4 Thefirstpartdoesnotapplytopassengerswhomakeuseofawheelchair.Thesepassengersshallbetransportedinawheelchairthatissecuredinthevehicleinsuchawaythatthestabilityofthewheelchairandthesafetyoftheoccupantisensured.Thesepassengersshallmakeuseof:a.thesafetybeltintegratedintothevehiclethatisprovidedforthem;b.thesafetybeltthatisintegratedinthefloor-mountedvehiclerestraintsystem,orc.aconstructionasapprovedbyOurMinister.

5 Thefirstpart,secondsentenceandthesecondpartdonotapplyfortransportintaxis.Intaxiswherethereisnochildrestraintsystem,passengersunder18yearsofageandlessthan1.35mtallmustbetransportedinseatsotherthanthefrontseats.

6 Thefirstpart,whereapplicabletodrivers,andthefourthpartdonotapplyduringpaidtransportationofpassengersunderthe2000PassengerTransportActanddemand-drivenpublictransportintaxis,otherthanincasesinwhichanagreementismadeasindicatedinArticle84,part3,ofsaidact,orotherthanduringtaxitransportationinataxi


configuredforwheelchairtransportinaccordancewiththerequirementsstatedintheVehiclesRegulation.

7 Thecarseatbelt,thesafetybeltorthechildrestraintsystemmustbeusedinsuchawaythattheprotectivefunctionoftheseisnotaffectedorcouldbeaffectedinanegativemanner.Personsaged18oroverandpersonsundertheageof18whoundertheparticularcircumstancesdonotneedtouseachildrestraintsystemmayuseaprovisionthatisdesignedtoleadthediagonalpartoftheseatbeltovertheshoulder.OurMinistermaymakeadditionalrequirementsforsuchaprovision.

8 Driversofvehiclesasstatedinpart1areforbiddentotransportpassengersyoungerthan12yearsofageandpassengerswhomakeuseofawheelchairinwaysotherthanasstatedinthisarticle.

9 Part1doesnotapplytopassengerswhomakeuseofafacilityforlyingdown.Thesepassengersmustmakeuseoftheappropriaterestraintprovisioninthevehicleifpresentthatisintegratedinthevehicleorformspartofthefloor-mountedsystembywhichthefacilityforlyingdownismountedtothevehicle.

4 Busdriversareforbiddentotransportpassengersyoungerthan12yearsofageinamannerotherwisethanthatsetforthinthisArticle.

Article601 Theriderandthepillionridersofmopeds,

microcarswithoutanenclosedcompartment,motorcyclesandthree-wheeledmotorvehicleswithoutanenclosedcompartmentmustwearaproperlyfittinghelmetwithaclearandreliablemeansoffasteningaroundtheheadandbearingthesealofasafetystandardasstipulatedintheRegulationsauthorisingtheuseofhelmets.

2 Thefirstsectionabovedoesnotapplyinthecaseof: a.theriderandpillionriderofamotor-assisted

bicycle; b.theriderandrearpassengerofamotor-assisted

trailerbicycle; c.theriderandpillionriderofatypeofmoped,

designatedassuchbytheDienstWegverkeer(RoadTransportOffice)whichisnotamicrocar,oramotorcyclewithaseatprotectedbyasafety


cellandthatisfittedwithaseatbeltprovidedthatthisseatbeltisbeingused.Thedesignationmaydistinguishbetweentheriderandthepassengersasfarasthevalidityofthefirstpartapplies.Rulesaresetbyministerialrulingrelatingtotherequirementsamopedormotorcyclemustmeetinordertobesodesignated.Ineachcasetheserulesrelatetotherequirementsthatthesafetycellandseatbeltsmustmeet;

d.thedriverorpassengersofamicrocapwithoutanenclosedcompartmentorathree-wheeledmotorvehiclewithoutanenclosedcompartment,whoseseatinthismicrocarormotorvehicleisequippedwithamechanismforasafetybeltincompliancewithguideline97/24/EC,asapplicableonthedatewhenthevehiclecameintouse,andwithasafetybeltthatcomplieswiththatstipulatedinArticle5.6.47,thirdandfourthpart,oftheVehicleRegulationsorwiththatstipulatedinArticle5.5.47,fourthandfifthpart,oftheVehicleRegulations,providedthatthissafetybeltisbeingused.

3 Ridersareforbiddentotakeaspassengerschildrenundertwelveyearsinanyotherwaythanthatprescribedinthisarticle.

2.30Useofmobiletelecommunicationsequipment

Article61aApersondrivingamotorvehicle,moped,motor-

5 Special Regulations for Disabled Drivers

5.1Exemptionsfordisableddrivers

Article851 Driversofmotorvehicleswithmorethantwowheels

displayingavalidandclearlylegibledisableddriver’sparkingbadgeareexemptedfromtherestrictionsgoverningparkinginaparkingdiskzone(Article25).Similarly,disableddriverswishingtoparkforuptothreehoursareexemptedfromthebanonparkingonasingleunbrokenyellowlineandwhereparkingisforbiddenbythesignE1,andalsofromtheparkingrestrictionsonrecreationareas(Article46).Inthislattercase,theymustclearlydisplayintheirvehiclesaparkingdiskshowingthetimeatwhichtheycommencedparking.

Article21 Therulesforpedestriansarealsotobeapplied

todriversofinvalidcarriageswherethesetravelonthefootpathorpavementoruseapedestriancrossingtocrossfromonefootpathorpavementtotheother.

2 Inaddition,therulesforpedestriansarealsotobeappliedtopersonswhoarepushingabicycle,amopedoramotor-assistedbicycleandalsotopersonswhoarepropellingthemselvesalongbyothermeansthanavehicle(e.g.rollerskates,iceskatesetc.).

3 Therulesforwagonsandcartsarealsotobeappliedtopeoplewalkinginprocessions,marchesandgroupswheytheyareonthepublichighway.
