1 Traffic Conduct
1.1RulesofConduct
Article5Itisanoffenceforanyroadusertoactinsuchmannerastocauseahazard(orapotentialhazard)onthepublichighwayortoobstructotherroadusersinanyway.Article6Allparticipantsintrafficareforbiddentobehaveinsuchawaythatatrafficaccidentattributabletothemoccursinwhichanotherpersoniskilledorsustainsseriousphysicalinjuryorphysicalinjurysuchthattemporaryillnessoccursorthatpersonispreventedfromengaginginnormalactivity.Article71 Itisanoffenceforanypersoninvolvedinaroad
accidentofanykindtoleavethesceneoftheaccident.
2 Personsareonlypermittedtoleavethesceneofanaccidentassoonas:
a.theopportunityhasarisentoestablishtheidentityofthepersonorpersonsinvolved;
b.theopportunityhasarisentoestablishtheidentityofthemotorvehicleinvolved;
c.itisclearthatnopersonorpersonssustaininginjuriesintheaccidenthasorhavebeenleftatthesceneoftheaccidentinneedoftreatment.

Article81 Itisexpresslyforbiddentodriveorallowadriver
tooperateamotorvehicle,whenheisundertheinfluenceofasubstance,whetherusedaloneorincombinationwithanothersubstance,whichheknows,orshouldreasonablybeexpectedtoknow,maycompromisehisdrivingabilitytosuchanextentthatheisnotfittooperateamotorvehicle.
2 Itisexpresslyforbiddentooperateamotorvehicleorallowadrivertooperateamotorvehiclewhenonehasconsumedalcoholicbeveragestothepointthat:
a.uponanalysisthealcohollevelinhisbreathappearstobegreaterthan220microgramsperlitreofexhaledbreathand/or
b.uponanalysisthealcohollevelinhisbloodappearstobegreaterthan0.5milligramspermillilitreofblood.
3 Contrarytosubsection2above,thedriverofamotorvehiclewhichrequiresadriver’slicence,shouldthedateoffirstissueofsaidlicencenotyetbefiveyearsagoandshouldthisdateoffirstissuehavebeenonorafter20March2002,isforbiddentooperateorbepermittedtooperateamotorvehiclewhenhehasconsumedalcoholicbeveragestothepointthat:
a.uponanalysisthealcohollevelinhisbreathappearstobegreaterthan88microgramsperlitreofexhaledbreathand/or
b.uponanalysisthealcohollevelinhisbloodappearstobegreaterthan0.2milligramspermillilitreofblood.

4 Contrarytothatstatedinsection2,itisprohibitedforthedriverofamotorvehicleforwhichadrivinglicenceisrequired,ifthefirstlicenceissuedwasalicenceauthorisingtheholdertodriveamopedandthislicencewasissuedtoapersonwhowasnotyeteighteenatthetimeofissueandthedateofissuewaslessthansevenyearspreviouslyandoccurredonorafter20March2002,todrivesaidmotorvehicleoroperateitasthedriverafterhavingconsumedsuchanamountofalcoholthat:
a.hisorherbreathisshowninatesttocontainmorethan88microgramsofalcoholperlitreofexhaledair,or
b.hisorherbloodisshowninatesttocontainmorethan0.2milligramsofalcoholpermillilitre.
5 Itisforbiddentoallowapersontooperateamotorvehiclewhenoneknowsormayreasonablybeexpectedtoknowthatthispersonisinaphysicalstateasdescribedinsubsection1,2,3,or4above.
6 Inapplyingsubsection3above,driver’slicenceistakenalsotomeanadriver’slicenceissuedbyarelevantauthorityoutsideoftheNetherlands.

2 Traffic Regulations
2.1Roadpositioning

2.13Usinglightswhiledriving
Article321 Driversofamotorvehicle,amoped,amotor-
assistedbicyclewhichisnotamopedasindicatedinArticle1,partone,section(e),sub-section(d)oftheact,adisabledvehicleequippedwithacombustionengine,oradisabledvehicleequippedwithanelectricmotorandhavinganenclosedbody,willusedimmedlightsduringthedaywherevisibilityisseriouslyrestricted,andatnight.DriversofadisabledvehicleequippedwithanelectricmotorbutnotequippedwithenclosedbodieswillatsuchtimesusethelightsindicatedinArticle5.18.43,partone,oftheVehiclesRegulations.
