A lot of people told me similar stories of passports being leſt behind. Mind you, they all managed to get the passport in me so as not to miss their flight. I even had clients, Dennis and Cheryl Doolan, who sent me a photo of themselves at the airport holding their passports. Thanks guys. Nothing like rubbing some salt into the wound! Then it hit me. Maybe I had just found my legacy in life…that no one shall ever leave home without their passport when going overseas. This may just help my recovery process. Now back to the trip. There is a roller coaster ride at Universal Studios called “The Rockit” (you can view the ride on YouTube). Bayley wanted to go on it, but Kerriann was a lile apprehensive. My view was if he is tall enough and wants to go on it, then he should go on it. Bayley just made the height restricon by a hair, and was pumped. To ease Kerriann’s concerns, I said I would ride with Bayley. As the roller coaster slowly climbed up and up, the excitement on Bayley’s face started to disappear. We reached the summit, and then it started. The very first drop seemed vercal. I looked at Bayley and was greeted by a look of pure terror. The only way to describe it, think of the footage of Paul Vaun on the Vomitron at the Gold Coast (again you can Youtube if you haven’t seen the footage) and that is what Bayley looked like. I thought “what have I done?” I can’t tell you what happened on that ride because all I did was hold his hand and kept looking at him. I now know that was not a good move on my behalf. Bayley wasn’t in a good shape mentally aſter the ride. There was only one answer…get him on another ride and quick. The closest one was “The Mummy”. Off we went. Now, “The Mummy” is an indoor roller coaster and it was much faster than I thought it would be. Thankfully Bayley loved it and wanted to go again and did. The same could not be said about myself. I said to Kerriann she should go on it and I would just sit down on the ground and wait for them. Every minute, I progressive felt worse and worse. The rest of the family rode The Mummy twice more. When they finally decided to check on me, I made a brave decision. “Sorry, but I need to go back to the hotel, I don’t feel well”. I hadn’t felt this bad since my last fishing trip outside the heads. Kerriann’s reacon – she laughed, took a photo of me at my worst, and then shared it with friends. The rest of the family carried on and I went to back to the hotel, vomited, laid down for an hour and was then as good as gold. Later in our trip we went to Santa Monica Pier and the family took a ride on the ferris wheel. Bayley hated it and we discovered just like his mother, he doesn’t like heights. Kerriann didn’t feel the best. Muscle Beach was next to the pier so we walked down to watch people work out. There were some swings (yes the normal, average type of swings you see at your local park). Kerriann was sing on one, so I decided to give her a couple of pushes. Aſter a couple of minutes, Kerriann told me to stop. It would appear that she was feeling a lile queasy. What was I to do? I laughed, took a photo of her and now I am sharing in the only way I know how. Revenge is sweet.

Chasing a Debt Owed by a Company

In business today, many debts you might need to follow up are those owed to you by a company or companies.

In many instances, it can be time consuming and difficult to chase money from a company.

The first step is to get on the phone, contact the company debtor and attempt to organise payment of the debt by either a lump sum or by way of instalment payments.

If that doesn’t work or very little is paid and money is still owed, it may be appropriate for you to consider a document known as a “Creditors Statutory Demand for Payment of Debt” being prepared.

This is a two page document addressed to the company debtor setting out details of the amount owed and a request to the company debtor to make payment of the debt in full within 21 days of being provided with a copy of the demand.

If payment by the company debtor is not made within 21 days of receiving the Creditors Statutory Demand for Payment of Debt, it is open for you to consider the next step which involves an application to the Federal Court of Australia for the actual winding up of the company.

The requirements for making such an application involve the preparation of various documents which are submitted to the Federal Court (in Sydney) along with a filing fee.

Prior to making any application to the Federal Court for the winding up of a company, there are some factors to consider. These included the size of the debt (and the economics of pursuing the debt), the current business status of the company and the asset base of the company.

Wills and Marriage

Over 97% of the Wills that we review for clients are out of date, don’t contain all the options it should or have errors.

One of the most common reasons for a Will to become out of date is marriage. Not too many people know that ...

Marriage automatically cancels your prior Will UNLESS you have made the Will in contemplation of marriage.

So if a person has a Will, then subsequently gets married, their Will is revoked if it doesn’t have a clause that states

the Will was made in contemplation of marriage. This means that if they pass away, they have effectively died

without a Will and the laws of intestacy apply.

This can potentially make a huge difference. For example, if a deceased has no Will and leaves a spouse and

children, but the children are not the spouse's children, the spouse is entitled to:

the intestate's personal effects; and

a statutory legacy of $350,000.00 plus adjustment for CPI from December 2005, and interest if the statutory

legacy is not paid in full within one year of the date of death; and

one-half of the remainder (if any) of the estate.

Congratulations Gareth, his lovely wife Cath and son Lewis are over the moon with the safe arrival of their beautiful baby girl and

sister Lucy Grace.

Lucy entered the world on Anzac Day weighing in at a healthy 9lb 12oz, twelve days past her due date. Gareth was not sure which was more stressful, the birth or the car ride to hospital as Maitland was in the aftermath of the Super

Storm and roads were either cut or congested. Thankfully everything turned out fine.
