In accordance with the provisions of the New Jersey Open Public Meetings Act, Chapter 231,

Laws of 1975, adequate notice of this meeting was originally provided through the annual

public notice on January 7, 2020:

1. Emailing to newspapers designated by the Board – The Local Source and the Star

Ledger.

2. Posting on the District Website, the main bulletin board in the Administration Office

and at Abraham Clark High School.

3. Emailing to the Clerk of Roselle Borough.

C. ADDENDUM TO THE ADEQUATE NOTICE PUBLIC STATEMENT DUE TO THE

PUBLIC HEALTH EMERGENCY

In view of the COVID-19 public health emergency, the emergency orders and directives at the

federal, State and local levels, and consistent with the Open Public Meetings Act, N.J.S.A.

10:4-6 et seq., as amended by P.L.2020, c.11, (“OPMA”) the Roselle Board of Education is

conducting this regularly scheduled meeting, originally designated to take place at Abraham

C. Clark High School, remotely using video and/or telephone conferencing technology, Zoom

and/or Facebook. The public has been advised of this venue and format change and

instructions have been provided in order to access the meeting and to participate during the

public comment section(s) of the meeting.

P.L. 2020, c.11, which permits remote conduct of meetings was signed into law by Governor

Murphy on Friday, March 20, 2020, effective immediately. The Board recognizes the

importance of open transparency and public access and participation in its work. In view of

the current crisis and the brave new world in which we live, the Board asks all citizens to bear

with us as we work to meet the health, safety, welfare, and educational needs of our students,

staff and all members of the Roselle community.

Allegiance.

IV. SUPERINTENDENT’S RECOMMENDATIONS

A. RESOLUTIONS

1.1 BE IT RESOLVED that upon the recommendation of the Interim Superintendent of Schools, the

Roselle Board of Education hereby affirms the Roselle Public Schools Harassment, Intimidation

& Bullying (HIB) Investigation Reporting of 2019/2020 School Year Report Period 2 Incidents,

previously presented to the Board of Education and Public at the Regular Board Meeting held

March 30, 2020 [Attachment 1.1].

1.2 BE IT RESOLVED that upon the recommendation of the Interim Superintendent of Schools,

approve the updated RPS 2019/2020 School Year Calendar, to include the following changes

[Attachment 1.2]:

Monday, 12/2/19 – Early dismissal due to inclement weather

Tuesday, 3/10/20 – Closed due to Coronavirus concerns (Used emergency school closing day)

C. CURRICULUM & INSTRUCTION

Professional Development

Upon the recommendation of the Interim Superintendent of Schools, and the Board having

determined that attendance at these workshops is directly related to and within the scope of the

School Administrators’/ Teachers’ current responsibilities and the school District’s Professional

Development Plan, the Board having further found that attendance is critical to the needs of the

school district or furthers the efficient operation of the school district and is in compliance with

State and Federal travel payment guidelines, approve the following:

1.5 Approve the attendance of the following administrators to the 2020 FEA/NJPSA/NJASCD Fall

Conference, October 15 & 16, 2020, Atlantic City, NJ, at a registration cost of $292.00 per

person, plus mileage and meals, subject to the submission and verification of duly authorized

school year, at a cost of $774.00 towards payment for Teacher Advisor.

1.7 Approve the ACHS Student Council/Government (SGA) for the 2020-2021 school year at a cost

of $773.00 towards payment for Teacher Advisor.

1.8 Approve the ACHS Theater Arts Program for the 2020-2021 school year, at a cost of $542.00

towards payment for Teacher Advisor.

1.9 Approve the ACHS Saturday Detention/Academic Recovery Program for the 2020-2021school

year, effective September 1, 2020 through June 30, 2021, 8 AM to 12 Noon, for 29 Saturdays

(dates to be decided), at a cost of $6,694.36.

1.10 Approve ACHS Spring and Winter Concerts for the 2020-2021 school year, dates to be decided,

at a cost of $3,747.00 towards payment for Music Teachers Advisors.

1.11 Approve the Abraham Clark High School’s Second Chance Alternative School Program for the

2020-2021 school year, Monday through Friday, 4 PM to 8 PM, following the district school

calendar, at a total cost of $125,000.00, towards payment for teachers, administrators,

secretaries, and other relevant staff [ACHS Account 11-424-100-101-XX-000].

1.12 Approve the ACHS Credit Recovery/Edmentum Program for Abraham Clark students who may

need credit recovery, Tuesdays and Thursdays, 3:15 to 4:40 PM, effective September 25, 2020 to

June 13, 2021, at a cost of $5,009.40 towards teachers’ payment. [ACHS Purchased Services

Account].

1.13 Approve the ACHS STEM Program for the 2020-2021 school year, Tuesdays and Thursdays,

3:30 to 4:30 PM, at a cost of $5,306.30 towards payment for supplies, student trips, registration

fees for competitions, and teacher moderator [ACHS Account].

1.14 Approve the Abraham Clark High School’s CTE Program Distributive Education Club of

America (DECA), at a total cost of $7,725.80 towards supplies, student trips, supplies, and

registration fees for state and national competitions. [ACHS 11-000-270-512-AB-100].

1.15 Approve the ACHS students’ participation in the CTE Program with Fairleigh Dickinson

University and Rutgers University, at a cost of $6,210.00 towards payment for Program Director,

subject to the submission and verification of time sheets [ACHS Account 11-403-100-110-HW-

000].

1.16 Approve the application for the Carl Perkins Grant for 2020-2021 school year, at a cost of

$920.00 towards payment for Grant Writer/Planner.

1.17 Approve the continued collaboration between Rutgers School of Health Related Professions and

ACHS Health Occupation students of Abraham Clark High School for tuition free credits. Online

exam cost is $75.00 per student.

1.18 Approve the ACHS Treasurer of School Accounts for the 2020-2021 school year, at a cost of

$2,374.00.

1.19 Approve the ACHS Student Council Advisor for the 2020-2021 school year, at a cost of $773.00.

1.20 Approve the Middle School National Junior Honor Society, Grace Wilday Junior High School,

2020-2021 school year, at a cost of $774.00 towards payment for Advisor.

1.21 Approve the Grace Wilday Junior High School’s Yearbook Advisor for the 2020-2021 school

year at a cost of $773.00.

1.22 Approve the Grace Wilday Junior High School’s Peer Leader Program for the 2020-2021 school

Program for the 2020-2021 school year, effective September 8, 2020 through June 22, 2021,

Mondays through Fridays, 7:30 to 8:30 AM, at a cost of $49,195.80 [LVM Funds 11-421-100-

1.24 Approve the Leonard V. Moore Middle School’s Reflect & Restore After-school Program, as

part of the Social-Emotional Learning (SEL) restorative-practices initiative, two days meeting

per month, effective September 2020 through June 2021. (Dates to be decided) at a cost of

$3,443.60 towards payment for administrative support and oversight [LVM Funds 11-421-100-

1.25 Approve the Leonard V. Moore Middle School’s Yearbook Advisor for the 2020-2021 school

year, at a cost of $773.00.

1.26 Approve the Leonard V. Moore Middle School’s Student Council Advisor for the 2020-2021

school year, at a cost of $773.00.

1.27 Approve the Leonard V. Moore Middle School’s Holiday and Spring Concerts for the 2020-2021

school year at a cost of $3,747.00 towards payment for each of the two (2) concert directors.

1.28 Approve the Summer Tutorial iRead Program at Dr. Charles C. Polk Elementary School,

effective July 14, 2020 through August 21, 2020, Tuesday through Friday, 1 to 5 PM, at a total

cost of $6,969.00 [Funded by DCCP Account 11-140-100-XX-020].

1.29 Approve the Dr. Charles C. Polk School’s Instructional Team, to collaborate, plan instruction,

analyze data and grade level assessments that focus on areas of need as measured by walk-

throughs, student progress and lesson plans, at a cost of $11,616.00 towards teachers’ payment,

subject to the submission & verification of time sheets [DCCP Account 11-120-100-101-PO-001].

1.30 Approve the Dr. Charles C. Polk Elementary School’s Before the Bell Healthy Start Program,

effective September 1, 2020 through June 30, 2021, 7:30 to 8:00 AM, at a cost of $7,903.80

towards payment for Administrative support and oversight, pending submission and verification

of time sheets. [DCCP Account 11-421-100-101-PO-000].

1.31 Approve the Dr. Charles C. Polk Elementary School’s Before the Bell Tutorial Program,

Mondays through Fridays, 7:30 to 8:30 AM, effective September 1, 2020 through June 30, 2021,

at a total cost of $48,979.80 towards teachers’ payment and other relevant staff [DCCP Account

11-421-100-101-PO-000].

1.32 Approve the Dr. Charles C. Polk Elementary School’s Literacy and Math Science Nights, for the

2020-2021 school year, (3 times during the school year, dates to be decided), at an approximate

cost of $11,798.55 towards teachers’ payment and other relevant staff [DCCP Account 11-000-

221-104-PO-103].

1.33 Approve Washington Elementary School’s Before the Bell Program, Mondays through Fridays,

7:30 to 8:30 AM, effective September 1, 2020 through June 30, 2021, at a total cost of

$45,000.00 towards teachers’ payment and other relevant staff [WES Account 11-190-100-800-

WA-400].

which in total exceed the line item appropriation in violation of N.J.A.C. 6A:23-2.11(a).

Pursuant to N.J.A.C. 6:20 –2.11(c)4, the Roselle Board of Education certifies that as of

March 31, 2020 after review of the secretary’s monthly financial report no major account

or fund has been over-expended in violation31 of N.J.A.C. 6:20-2.11(b) and that sufficient

funds are available to meet the district’s financial obligations for the remainder of the

fiscal year.

3.5 RESOLUTION APPROVING ADDITIONAL FUNDING FOR RUDERMAN &

ROTH, LLC FOR LEGAL SERVICES FOR GENERAL COUNSEL TO THE

ROSELLE BOARD OF EDUCATION FOR THE 2019-2020 FISCAL YEAR:

WHEREAS, there exists a need for Legal Services-General Counsel for the Board of

Education, and; WHEREAS, a request for proposals for Legal Services-General Counsel was

issued pursuant to a fair and open process and proposals were received and opened on May

31, 2018;

NOW THEREFORE BE IT RESOLVED, that, the Roselle Board of Education hereby

appoints, Ruderman & Roth, LLC, 150 Morris Avenue, Suite 303, Springfield, New Jersey

07081 as the General Counsel for legal and related matters as assigned by this Board or its

designee. Ruderman & Roth, LLC, will be compensated in accordance with the terms of the

contract at a rate of $150 per hour, in an amount not to exceed an additional $7,380.

3.6 OPPOSING DELAY IN TRANSMISSION OF QUARTERLY PROPERTY TAX

REVENUE TO SCHOOL DISTRICTS

WHEREAS, Assembly Bill 3902, currently pending in the State Legislature, would

authorize the Department of Community Affairs to permit municipalities to delay the

quarterly transmission of property tax revenues to school districts during gubernatorial-

declared emergencies; and

WHEREAS, New Jersey's public schools are highly dependent on property tax revenue to

support education programs; and

WHEREAS, on average, local property taxes constitute close to 60% of public school

revenue, with the percentage even greater in a significant number of districts; and

WHEREAS, a delay in payments from municipalities would result in a financial crisis for

school districts, seriously disrupting the educational process—and bringing it to a halt; and

WHEREAS, although public school buildings are closed during the current health

emergency, the education of our students is taking place through remote learning and home

instruction; and

WHEREAS, continued timely transmission of school property taxes is critical for the

education process to continue without interruption; and

WHEREAS, even though municipalities are designated as the authorities to collect property

taxes, these taxes are levied for specific purposes—e.g., municipal, school, county, fire

district—and these obligations must continue to be met; and

WHEREAS, as currently written, A-3902, which is intended to ease a financial burden on

municipalities, would place a severe strain on school districts and the students and families

that they serve; and

WHEREAS, the Roselle Board of Education recognizes the impact of the current public

health emergency on the state and local governments, as well as local school districts, but

believes this legislation would worsen the situation for our communities.

NOW, THEREFORE, BE IT RESOLVED that the Roselle Board of Education urges

the State Senate and the Governor to oppose A-3902; and be it further

RESOLVED, that this resolution be delivered to Governor Phil Murphy, State Senate

President Stephen M. Sweeney, Assembly Speaker Craig Coughlin; and the Union’s

Legislative District’s representatives in the state Senate and General Assembly; and be

it further

RESOLVED, that copies of this resolution be sent to the New Jersey School Boards

Association.

3.7 RESOLUTION TO APPROVE SAFETY GRANT FOR 2020-2021

Whereas, the Educational Risk Insurance Consortium-North (ERIC North), a sub fund of the

NJSIG has established a Safety Grant Program and

Whereas, the program is intended to provide funds toward plant safety, building security,

safety equipment and communication devices; and

Whereas, the ERIC North Safety Grant Committee has developed a formula to equitably

allocate grant funds to qualifying ERIC North members, and

Whereas, it has been determined that the Roselle School District may qualify for a grant in

the amount of $22,095.00 for the period of July 1, 2020 through June 30, 2021.

3.8 RESOLUTION TO APPROVE UNION COUNTY EDUCATIONAL SERVICES

COMMISSION ADJUST TRANSPORATION CONTRACTS 10% DISCOUNT

DURING 19-20 SCHOOL YEAR DURING STATEWIDE PANDEMIC

Be it resolved that the Roselle Board of Education (the “District”) resolves to continue

contracted transportation payments, at a 10% discount, to the Union County Educational

Services Commission (“UCESC”) for the 19-20 school year during the statewide period of

emergency closure of all schools even in the absence of services rendered. The UCESC will

accordingly make payment to the transportation providers for the District. The District

understands that such payments do not guarantee that the transportation provider will be

able to resume transportation when schools re-open. While such payments are prohibited by

NJSA 18A:19-3 which only allows payment for services rendered, the District is making

such payments pursuant to section 18006 of the CARES Act.

Let it be known that this resolution is put forth in the spirit that continued payments will

make the resumption of transportation more likely than if payments were terminated and

that transportation of students is so essential to re-opening schools that this unusual measure

must be taken.

3.10 RESOLUTION TO APPROVE TRAVEL AND RELATED EXPENSES

REIMBURSEMENT 2020-2021 SCHOOL YEAR

WHEREAS, the Roselle Board of Education recognizes school staff and Board members will

incur travel expenses related to and within the scope of their current responsibilities and for

travel that promotes the delivery of instruction or furthers the efficient operation of the school

district; and

WHEREAS, N.J.A.C. 6A:23B-1.1 et seq. requires Board members to receive approval of these

expenses by a majority of the full voting membership of the Board and staff members to receive

prior approval of these expenses by the Interim Superintendent of Schools and a majority of

the full voting membership of the Board; and

WHEREAS, a Board of Education may establish, for regular district business travel only, an

annual school year threshold of less than $150 per staff member where prior Board approval

shall not be required unless this annual threshold for a staff member is exceeded in a given

school year (July 1 through June 30); and

WHEREAS, travel and related expenses not in compliance with N.J.A.C. 6A:23B-1.1 et seq.,

but deemed by the Board of Education to be necessary and unavoidable as noted on the

approved Board of Education Out of District Travel and Reimbursement Forms; now

THEREFORE, BE IT RESOLVED, the Board of Education approves all travel not in

compliance with N.J.A.C. 6A:23B-1.1 et seq. as being necessary and unavoidable as noted on

the approved Board of Education Out of District Travel and Reimbursement Forms; and

BE IT FURTHER RESOLVED, the Board of Education approves travel and related expense

reimbursements in accordance with N.J.A.C. 6A:23B-1.2(b), to a maximum expenditure of

$258,049 for all staff and board members.

3.11 AGREEMENT BETWEEN THE ROSELLE BOARD OF EDUCATION AND ST.

JOSEPH THE CARPENTER SCHOOL

WHEREAS, the enrollments of St. Joseph the Carpenter School are not adequate for the

economical preparation of lunches for school children, and while the Roselle Board of

Education can adequately provide such services, and

WHEREAS, the Parties desire to implement a school meal program following the current

USDA meal planning option whereby Roselle Board of Education shall provide lunch service

to St. Joseph the Carpenter School children subject to the approval of the New Jersey

Department of Agriculture and provided that such program shall not impair existing

allowances to either Party.

NOW, THEREFORE, in consideration of the mutual premises herein contained, the Parties

agree as follows:

EFFECTIVE PERIOD

This agreement shall be effective as of September 1, 2020 and remain in force until June 30,

2021, unless sooner terminated as herein provided. This Agreement may be terminated, by

notice in writing given by either Party to the other, at least sixty (60) days prior to the date of

termination. The term of the Agreement can be extended upon mutual agreement of the

parties to a maximum of four (4) additional years.

AUTHORITY

St. Joseph the Carpenter School wishes to transfer authority to operate the programs noted

below for its students to the Roselle Board of Education:

National School Lunch Program

A. All legal and financial authority for operating the programs noted above for the

students of St. Joseph the Carpenter School is hereby transferred to Roselle Board of

Education. Roselle Board of Education is accepting total legal and financial

responsibility for St. Joseph the Carpenter School's meal program, to include paying

over claims as a result of administrative reviews, distributing USDA commodities,

completing edit check worksheets, doing on-site reviews, and complying with all

federal and state Program regulations. St. Joseph the Carpenter School relinquishes

its authority to operate the Child Nutrition Programs to Roselle Board of Education.

B. The Parties to this Agreement agree to cooperate fully, to work in good faith, and to

mutually assist each other in the performance of this agreement. In connection

therewith, the Parties shall from time to time meet upon reasonable request of either

party at a mutually agreed time and location to confer in good faith and amicably, in

a business-like manner, work out disputes arising from the implementation of this

agreement. Roselle Board of Education shall prepare and provide sufficient food for

the number of lunches required each school day by St. Joseph the Carpenter School.

MENU/MEAL PATTERN

A. All meals supplied by Roselle Board of Education will conform to the United States

Department of Agriculture menu pattern requirements.

B. The final approved copy of the lunch menu to be prepared on behalf of St. Joseph the

Carpenter School shall be provided by Roselle Board of Education a minimum of one

(1) week in advance of each month.

C. Roselle Board of Education will be responsible for the printing and distribution of

menus.

COMPLIANCE WITH SCHOOL MEAL PATTERN REQUIREMENTS

All meals must comply with 2020 Dietary Guidelines and meet the Nutrient Standards as

established by the guidelines. In order to accomplish meeting the Nutrient Standards and

conduct nutrient analysis of meals served to students, the following information must be

available:

• Recipes for all menu items offered as part of the reimbursable meal;

• Nutrient fact labels for all food items as part of the reimbursable meal;

• Detailed production records;

• Menus listing all components of the reimbursable meals.

VENDING MACHINES

St. Joseph the Carpenter School may not operate vending machines during the hours that food

service purchases are available in the cafeteria (including prep-time and clean-up time).

CALENDAR

Roselle Board of Education will provide lunches on a daily basis, Monday through Friday, on

days when school is in session, according to the school calendar. No lunches will be provided

on dates when Roselle Board of Education is closed or on a one session day.

A. Prior arrangements must be made between the Parties for the provisions of meals on

days when Roselle Board of Education is not in session and St. Joseph the Carpenter

School is in session.

B. St. Joseph the Carpenter School shall notify the Roselle Board of Education of any

planned non-serving days at least two (2) weeks in advance.

CHARGES

Roselle Board of Education will operate the food service on a profit and loss basis and be

entitled to all revenues and profits derived from the operations. St. Joseph the Carpenter

School agrees to indemnify and hold Roselle Board of Education harmless with respect to

any and all claims, liability, loss and expenses including reasonable costs, collection expenses

and attorney's fees, arising out of the acts or omissions of Roselle Board of Education, its

agents or employees in the fulfillment of its obligations of this agreement. Additionally, the

servicing vendor will provide to Roselle Board of Education and St. Joseph the Carpenter

School certificates of insurance naming both local education agencies as additional insured

and maintained as required by statute, worker's compensation insurance coverage for all their

employees.

St. Joseph the Carpenter School shall furnish all utilities and facilities reasonable and

necessary for the efficient performance of this Agreement by Roselle Board of Education,

including, but not limited to heat, ventilation, hot and cold water, steam gas, lights and electric

current, garbage removal and recycling services, extermination services, office space and

equipment, and telephone service. St. Joseph the Carpenter School will provide all food

service equipment and maintain, repair and replace said equipment. St. Joseph the Carpenter

School will be responsible for all necessary cleaning of walls, windows, ventilation

equipment and electric light fixtures, and all necessary scrubbing, mopping and polishing of

floors in the dining room areas.

REIMBURSEMENT

Roselle Board of Education will be entitled to receive the State reimbursement and

will be responsible for the edit check worksheets and the reimbursement claims.

RECORDS

A. Roselle Board of Education shall be responsible for maintaining and keeping all

recipe and nutritional facts and labels as required for nutrient analysis. These will be

provided to St. Joseph the Carpenter School upon request.

B. Roselle Board of Education shall be responsible for keeping all other Child Nutrition

records as required by the New Jersey Department of Agriculture, Bureau of Child

Nutrition, and will furnish to St. Joseph the Carpenter School said records upon

written request.

DISPUTE RESOLUTION

In the event a dispute shall arise between the parties concerning this Agreement, the respective

Administrator of each Party shall be notified immediately. Thereafter, at a time which is

mutually convenient to both parties, the Administrators shall meet and attempt to resolve the

dispute. If the dispute cannot be resolved between the Administrators, the same shall be

reported to either Parties Lead School Administrator. If a dispute remains unresolved, any

further actions shall be pursuant in accordance with N.J.S.A. 18A:18A-14 and shall be

referred to the Union County Superintendent for resolution. The resolution determined by the

County Superintendent will be binding, subject to the appeal to the Commissioner of

Education and the State Board of Education.

APPROVALS

A. This agreement must be reviewed by the New Jersey Department of Agriculture's

Food Distribution Section prior to the acceptance of donated foods.

B. This agreement must be reviewed by the New Jersey Department of Agriculture,

Bureau of Child Nutrition prior to the receipt of reimbursement monies.

Note: This program is run by Roselle BOE for the St. Joseph School and the Roselle

BOE provides the lunch and Roselle BOE receives the reimbursement for the lunches

provided to St. Joseph School.

3.12 RESOLUTION TO APPROVE BID AWARD FOR UPS POWER UPGRADE

WHEREAS, there exists a need for UPS POWER UPGRADE; Universal Schools &

Administrative Co. (USAC E-Rate Program) E-rate is paying 80% of this cost and the school

district is responsible for 20%

contract to Ocean’s Computer Group to provide UPS power upgrade for the 2020- 2021 fiscal

year in an amount of $ $110,598.05. This award is based upon a matrix that was assessed by

the Director of Operational Technology.

3.13 RESOLUTION TO APPROVE PARTICIPATION IN HCESC COOPERATIVE

PRICING SYSTEM VENDORS

Upon the recommendation of the Interim Superintendent of Schools that the Board of

Education hereby authorizes the Business Administrator to procure goods and services

through the Hunterdon County Educational Services Commission.

WHEREAS, title 18A:18A-10 provides that the Roselle Board of Education without

advertising for bids obtained, or after having rejected all bids obtained pursuant to advertising

therefore, by resolution may purchase any goods or services pursuant to a contract or contracts

for such goods or services entered into on behalf of the State by the Division of Purchase and

Property, and

WHEREAS, the Roselle School District has the need, on a timely basis, to procure goods and

services utilizing state contracts, and

WHEREAS, the Roselle Board of Education desires to authorize its purchasing agent to make

any and all purchases necessary to meet the needs of the school district throughout the school

year.

NOW THEREFORE BE IT RESOLVED, the Roselle Board of Education does hereby

authorize the district purchasing agent to award the contract to the following:
