• Switch off devices must be necessary

• Exemption applies to protect the engine NOTcomponents

• Exhaust after-treatment systems must operate for 160kKm in normal use

• Only permissible to guarantee safe operation

• The purpose of the law is undermined if switch down device is used routinely

• The approval authority has a legal responsibility to check the operation of the EGR

• Implementing regulation 692 (2008) states “in addition the manufacturer shall provide the approval authority with information on the operating strategy of the EGR system including its operation at low temperatures”
