I Project Description

1.1 Engineer Description

ZhangBei Wind Farm, with the geographical center coordinate (EL 114°45' , NL41°02'), lies in the BaShang district in ZhangBei county , HeBei province. It is 35km awayfrom ZhangJiaKou city to the south and 4km from ZhangBei town to the north, and to thewest, the national road 207 is extended.

ZhangBei Wind Farm, in southeast edge of HuangTu plateau with higherelevation(1500ml600m), belongs to continental climate. In this region , the climate iscontrolled by Mongolia high pressure wind stream , and in winter , the wind is fromnorthwest direction mainly, meanwhile ,it is the major air pass that the cold air flows to thesouth. and more , because of the acceleration effect caused by the air stream flows throughYangHe river valley and gap , and topography effect by the abrupt drop of elevation insouthwards, the wind resource is abound in this region.

By the end of 1997 , 16 wind turbine-generator units had been erected (GermanyTW30011 + American AWT2752 + Darmark NTK3002 +Germany N43/6001) with thetotal installed capacity 5050kW , and will up to IOOMW in the future according to thescheme. As per this project, 83 wind turbine-generator units with individual capacity600kW will be erected, and the individual unit occupies land IOOm 2 for foundationpersistently, 2400m2 for construction temporarily.

1.2 Impact RangeTo this project, the land requisitioned permanently is 130175m2 (195.3Mu), that is,

8300m2 (17.45Mu) for wind turbine-gcnerator foundati*lŽl 875m (1l82.8 Mu) for roads,199200m2 (298.8 Mu) for construction temporarily. The land requisitioned is fannland andbarren in HuangHuaPing and XiShui administrative villages.

1.3 The Measure to Reduce Impact

13.1 The Measure to Reduce Land ImpactDuring the design process, the following items should be considered as fundamental

principles:

The roads for overhaul and construction ought to be planned one time; the constructionroad requisitioned temporarily can't be requisitioned again during the process of erection;the roads should be arranged bascd on the existing roads so that the farnland and barrenhave to be occupied minimally; the communication cables and I OkV routine should erectedon the side of the roads ; the wind turbine should bc erected on thc barren to avoidoccupying the farmland maximally.

1.3.2 The Measure to Reduce Impact on Economy

In order to reduce the impact on landowners' income and social economy, the followingmeasures should be adopted:

Enhancing the collection of the fundamental data, further analysis on local sociometric

situation , preparing the reasonable and reliant plans according to the actual facts.

Enhancing the interior and exterior inspection , establishing high efficiency and trouble-

free feedback routines , shortening message transacting period, ensuring the problems

encountered in construction can be solved in time.

During the construction process , prior rights to use local construction materials , underthe permission of technical requirements , the local transportation equipment and

manpower should be adopted priorly , by those means , the people who bear the impactresulting in this project may be benefited from the project construction.

1.4 Social InvestigationFrom 1998 May 5th to 8th, the relative units organized by ZhangJiaKou ChangCheng

Wind Power Co.,Ltd. came to HuangHuaPin and XiShui administrative Villages affectedby this project to launch the social investigation, they visited the peasants' families,discharged Social Investigation Sheet, so to request and consult the peasants for opinions

and requirements.

By the end of 1997, the total installed capacity was 5050kW, 16 units had been erected.the wind farm land was requisitioned from HuangHuaPing administrative village mainly,and the relationship between wind farm and farmer group, peasants is harmonious. when

the occasional manpower was needed, the local peasants were hired priorly, and thepeasants were willing to get the occasional job. to -iRrease income. Because the landrequisitioned is more in HuiCaiLiang natural village, the peasants had more opportunities

to get the occasional job, so the income was higher than that before. Nowadays , this village

has 16 automobiles , and the Mono TV sets are spread in alinost all families , but in other

natual villages , the automobiles are rare or none, the TV sets are not so popular . And in1997., a new school was built to improve the study conditions by Wind Farm with

invesment RMBIOO,OOOYuan, therefore, the local residents agree with this future joint

project.

Based on thc investigation:

the pcople investigated believe that the project will benefit the individual person

groups and country , they approve the project construction .

They concem about the compensating execution, and require that the compensation pay

in time.When manpower needed, they can be hired priorly.

The construction ought to be executed according to the plans strictly , The farmland can't

be occupied randomly.The erection of the wind turbine-generator units can improve the local scenery, and may

promote the local tourist trade.

2 Sociometric Description

Based on investigation, the land is requisitioned from HuangHuaPin and XiShui

administrative villages, and the HuangHuaPin administrative village manage HuiCaiLiang,

ErDaoBian, HuangHuaPing natual villages, XiShui administrative village manageHouJiaChun, XiJiaChun, JiaJiaChun , DianKou natural villages.

The local peasants lead a poor life, and engage in agriculture, The farnland in this

district is upland field. The peasants raise cows and sheep on the barren in small scale, and

the main farm crop are wheat, potato, flax etc. the peasants live on selling grains.According to the data from ZhangBei county Statistic Bureau, by the end of 1997, the

major economical indexes of ZhangBei county, YouLouGou town, HuangHuaPin village,

XiShui village are listed in Table 2-1 and 2-2.

3 Project ImpactIn this project, only land requisitioned, no building dismounted, and no impact on basic

facilities.

Land requisition can be dividcd into two parts: the permanent land requisition and the

temporary land requisition. For ZhangBei Wind farm, the permanent land requisition in this

project is 195.26 Mu, that is 12.45 Mu for wind turbine-generator units, 182.81Mu for

roads, the farmland requisitioned is 133.35 Mu (68.3%). The land requisitioned temporarily

is 298.8 Mu, the farmland requisitioned is 172.8 Mu(57.8%) . See Table 3-1 and 3-2.

The personal average farmland was 5.66Mu before land requisition in HuanHuaPin

village. When land requisitioned being deducted, it is 5.45Mu, the decrease is 0.2lMu. InXiShui village, the personal average farnland was 7.96 Mu, when land requisitioned being

deducted, it is 7.87 Mu, and the decrease is O.O9Mu. The families affected counted to be 19(68 person) totally, see Table 3-3 and 34, from the mentioned above, the land requisition

have less impact upon local peasants, and the impact can be eliminated through land

readjustment.

It is 2 or 3 years that the land will be requisitioned temporarily, adding the reclamationtime, it is 3 years at most. when construction finished, the land will be returned to peasants,

and during the construction process, the land must be used in accordance with designation

strictly, no random use can be allowed, therefore, the land requisition has little impact on

peasants life.

4 Compensating Policies for Land Requisition

4.1 Principle Policies

National:The People's Republic of China Land Manage Low

HeiBei Province:HeiBei Province Land Manage Regulation

4.2 Principle Items

The main regulations of The People's Republic of China Land Manage Low

Article6: The land in urban is belong to the ownership by the whole people, that is

state-owned. The land in villages and city suburbs, except for those that is regulated by law

to be belonging to the state, shall bc belong to collective; house site and plot of land forpersonal needs are belong to collective.

Articlc7: The state-owned land, in accordance with- law, may be assigned to the whole-

people ownership unit or collective unit to use. In accordance with law the state-owned

land and collective owned land may be. assigned to individual to use. The unit and

individual who use the land have the obligation to protect, administrate and make rational

use of it.

Articlc8: Collective-owned land which in accordance with law is owned by village

farmer collective, shall be managed and administrated by agricultural collective economic

organization or villager commission as village agricultural production cooperative etc.

Articlc9: Collective-owned land shall be registered and issued certificate by county

people's government to confirm its ownership right.

ArticlelO: In accordance with law, if the land ownership right and the right to use land

shall be changed, the procedures for registration of alteration of the land ownership must be

gone through and the certificate must be replaced.

Articlel2: Collective-owned land, the state-owned land used by the unit with

ownership of the whole people and collective-owned unit may be contracted by collective

or individual to manage for production of agriculture, forestry, animal husbandry and

fishery. Collective or individual who contracted land have obligation to protect and inaccordance with regulation of contracting contract to make rational use of land. The right to

contract and manage land shall be protected by law.

Article23: When the land is put in requisition by the state for construction, theconstruction unit must submit the design task approved by the charging department of theState Council or local people's government above county level according to the state capitalconstruction procedure and application to the land administration department above countylevel. After approved and reviewed by the people's government above county level, theland shall be appropriated by the land administrative department. When the land is put inrequisition by the state for the construction, the unit whose land is placed into requisitionshould obey the need of the state and should not obstruct.

Articlc24: The collective land acquired for the state's construction is owned by the

state. The land user only has the right to utilize it.Article27: The land user shall pay land compensation fee for the land acquired for the

state's construction. The compensation fee is three to six times of the average annual output

value of the land during the three years before land acquisition. For other kinds of landacquired, the provincial, autonomous region or municipal authority establishes thecompensation standard based on the compensation standard for cultivated land. Theprovincial, autonomous region and municipal authorities also stipulate the compcnsation

standard for the attachment and young crops on the land acquircd. With regard to the

suburban vegetable land, the land user shall subscribe its contribution to the developmentand construction fund for new vegetable land.

Articlc28: In addition to compensation fee, the land user shall also pay resettlement

allowance, which is calculated per the agricultural population to be resettled. The amount

of cultivated land acquired divided by the average amount of land occupied by each person

of the previous land user is the agricultural population to be resettled. The resettlement

allowance criteria for each agricultural person to be resettled is two to three times of the

average annual output value per Mu during the three years before land acquisition.

However, the resettlement allowance for each Mu of the acquired land can not be higher

than ten times of the average annual output value during the three years before land

acquisition. The provincial, autonomous region and municipal authorities set up the

resettlement allowance standard for other kinds of land in the light of the resettlementallowance standard of cultivated land.

Article29: If the farmers to be resettled can not retain their original living standard afterthey are paid the land compensation fee and resettlement allowance per Article27 and 28,the resettlement allowance can be increased with the approval of provincial, autonomousregion and municipal government. Nevertheless, the total of land compensation andresettlement allowance can not be higher than 20 times of the average annual output valueduring the three years before land acquisition.

Article 30: The compensation fee and resettlement allowance for land acquisition forthe state's construction shall be used to promote agricultural production, arrange theemployment of the excessive labor resulted from land acquisition and subsidizeunemployed people as living allowance. Any unit or individual can not use it for otherpurposes.

Articlc3l: The local land administration authorities above county level government willorganize the original land owner, the land user and other related units to arrange theexcessive labor resulted from land acquisition for state's construction. It can be done by theway of developing agricultural and side-products production, and establishing county,township and villages enterprises. The qualified people among the still unemployed can bearranged to work in the land user's unit or other collective units and state enterprises, inwhich case the allowance should be assigned to the unit which absorb labor.If all the land of the original land user is acquired, the agricultural residence can be changedinto non-agricultural residence with the approval of provincial, autonomous region andmunicipal govemnment. The local govemment above county level shall consult with the.concerned county (town) and village to apply the original collective properties,compensation fee and resettlemcnt allowance for agricultural ptoduction and livingsubsidies for the unemployed. Nobody can take articles-of public property.

Articlc33 The materials piling yard, transportation roads and other temporary facilitieswhich need to be built during construction period should be-arranged within the scope ofthe acquired land as far as possible. If any temporary land use is needed beyond theacquired land scope, the construction unit should submit application to the authority whichapprove land use for project construction for the approval of quantity and period oftemporary land use. It will enter into a temporary land use agreement with the agriculturalcollective economic organization if the application is approved, in which case thecompensation fee with be paid annually based on the average annual out put value in theprevious three years. No permanent buildings can be built on temporarily used land. Theconstruction unit should rehabilitate the land and return it in time when the period expires.

Article34 The wasteland, barren hills and state land used by other units can betransferred subject to approval in accordance with the approving procedures for land

acquisition for the state's construction. The wasteland and barren hills can be transferred

without any compensation. If the original land user suffer a loss due to land acquisition, the

construction unit should mak-e some compensation. Should the original land user needs tobe resettled, the construction unit should be responsible for resettlement.

The major clauses in the HeiBei Province Land Manage Regulation

Articlel8: The project approved by state need land requisition will requisition the landlegally, the land requisitioned owner should obey the requirement of construction , andunits and individual person have no right to obstruct.

Article24: The land requisitioned temporarily should be in 2 years, if the time is

required to extend, the requisitioning units should apply to relative organizations, and no

permanent buildings are allowed to be built.Article4l: When the land requisitioned by state for construction purpose, the

requisitioning unit must pay for resettlement cost and standard are:The land requisitioned are group owned farmland, orchard, fish pool, lotus-root pond

will be 4-6 times of its annual output.Calculating annual output: the average output in prior 3 years output.

The compensation for the crops , trees, house and other auxiliary facilities will be

determined by city govemment and be approved by province government.Article42: When land requisitioned by state, not only the land compensation should be

pay, but also pay resettle cost.The resettlement cost will be disbursed according to the agriculture population

resetilled.The resettlement cost should be 2-3 times of the land annual output before land

requisitioned.The resettlement cost should not exceed the 10 times of average output in prior 3 years,

under special situations, if the resettlement cost are required to be increased, the

compensation and resettlement cost can't exceed 20 times of than , and must be approved

by province government.

If the land requisitioned has no income, the resettlement can be ignored.

Articlc44: The land requisitioned temporarily should be compensated conform to the

land output based on the requisitioning time, when requisition finished, the land

reclamation should bc performed by land requisition units, or pay reclamation cost to land

owner by requisition unit.

5 Compensation Budget

5.1 Compensation StandardIn this project, only land requisitioned, no building dismounted and no people resettled.

During the preparation of this plan, ZhangJiaKou ChangCheng Wind Power Co.,Ltd.and design organization carried out the investigation upon compensation policies andstandards according toThe People's Republic of China Land Administrative Law andHeiBeiProvince Land Administrative Regulation,then negotiated with ZhangBai countyZhangBei Land Administrative Bureau and administrative village group , at last theyreached the compensation standard .

CompensationLand requisitioned permanentlyThrough several negotiation with ZhangBei Land Administrative Bureau and

HuangHuaPin, XiShui administrative villages, the conclusions are reached: the landrequisitioned output is 400yuan , and the farmland's compensation and resettling subsidizeis 15 times of the land output, it is 6000yuan , then the barren's compensation is 50% offarmland, 3000 yuan.

According to the negotiation, Land requisitioned for construction temporarily will beoccupied for 3 years , the compensation standard is 400 yuan per year and amount to 1200yuan for three years.

Land reclamation costAccording to the negotiation, the reclaiming compensation is 50 yuan per Mu.Crop compensationReference is 400 yuan per Mu.Farmland requisitioning taxAccording to HeiBei province stipulations, the farmland requisitioning tax is I yuan/m2 ,

6.1 Retrieval measuresFarmland reclamationWhile the project construction is finished, the farmland being rollcd in erection should

bc reclaimed in time, and the deep reclamation should be adopted to makc soil loosc. As faras the land whose fertilizer is disposal concerned, the crop rotation is requircd, thelegumiounosae should be planted in first year, at the same time, organic fertilizer should beapplied more to increase the soil's fertilizer, then in the second year, the wheat should bcplanted to resume the land.

Farmland AdjustmentAccording to the stipulation by ZhangBei county, the farmland in administrative village

should be adjusted if the village residents' number changed in 3 year period . for otherspecial cases , if land is requisitioned by state and changed the farmland's area , thefarmland should also be adjusted.

When construction units transacted the land requsitition famlities, and during the funddisbursing preiod ,the administrative villages affected will adjust farmland allocation,gather the farmland in village , reallocate the farmland based on residents numberreasonably.

In addition, the administrative villages' group should use compensation to developmentlabor and public welfare , for example , drilling wells , maintaining roads , erecting electricfacilities etc. then , the residents affected will improve income and life standard after landreallocation .

ZhangBei County Land Administrative Bureau, and the presents from HuangHuaPin,XiShui administrative villages , and villages group are originated by ZhangJiaKou

ChangCheng Wind Power Co.,Ltd. and ZhangBei County Government hold a promotionmeeting , they promoted the state policies, compensation standard and World Bank

policies .From 1998 May 5th to 8th , the relative units organized by ZhangJiaKou ChangCheng

Wind Power Co.,Ltd , came to HuangHuaPin and XiShui administrative Villages affected

by this project to launch the social investigation, they visited the peasants' families,

discharged Social Investigation Sheet , so to request and consult the peasants for opinions

and requirements.

8.3 Public Consultation and Participation in Execution of The Residents ResettlementAction Plan

Engaging in compensation disbursing managementAll compensation will be pay to group, except for crop compensation, any units or

person mustn't embezzle it, when compensation is disbursed to village group, the village

group should manage it presidently , and the disbursement must be discussed in public.Engaging the project participationThe project construction will affect the local residents, in order to guarantee the profit of

the peasants affected, the peasants are encouraged to participate the project construction,and own the prior rights when construction materials and manpower needed .

9 The Orvanizations and Channels for Appeal -

Although during the preparation and execution of tWe Residents Resettlement ActionPlan, the people affected are encourage to participate the project, some unpredictableproblems may be encountered in actual operation, in order to dissolve the problems in time

, except for appeal for govemment , appeal Organizations and Channels should be

established for the people affected , the specific process as following: First Step: During the project execution, if the peasants affected are not satisfied with

living environment, they can apply to village group and YouLouGou town resettlement

office directly, and will get the response inr 15 days.

Second Stcp: if the peasants are still dissatisfied, they can appeal to ZhangBei countyresettlement officc in 15 days whcn they receives the written reply . and they will receive

the response in 15 days.

Third Step : if the peasants are still dissatisfied, they can appeal to ZhangJiaKou

ChangCheng Wind Power Co.,Ltd. resettlement office in 15 day when they receive thewritten reply, as the same , they will get response in 15 days.

Forth Step: if they still dissatisfied, they can appeal to local court when they receive thewritten reply in 15 days.

The peasants can apply the compensation and reclamation if they are dissatisfied which

including compensating standard. The concrete appeal and program will be publicized in

consultation and negotiation.

10 Inspections and ReportsTo guarantee the project can be executed successfully and the profits of people affected

can be transacted appropriately, the whole process inspections should be made during theresettlement plan's execution with two ways: interior inspections and exterior inspections.

10.1 Interior lnspections and Reports

10.1.1 Purpose and MissionThe interior inspections are made by ZhangJiaKou ChangCheng Wind Power Co., Ltd.

Resettlement Office, and its major duties are: to auarantee the resettlement organizationskeep in good sharp ; to guarantee the legal rights of the people affected, to guarantee the

project construction is executed successfully, to guarantee the all resettlement departments

be in good operation according to the The Residents Resettlement Action Plan, therefore,

the overall inspections are required during the project execution .

and the relative contents are: land adjustment, residents resettlement . The inspections

should be continuous during the project execution, and the inspecting organizations should

transfer those tables to the owner when necessary.

10.1.4 ReportsP'eriodThe construction period is 2 years, since there are no buildings and facilities need to be

dismounted and no people need resettle, the inspection and evaluation reports should be

made two issues in first year and one in the following years by resettlement organizations,

when special situation occurs, the reports may be needed continuously.

Format ContentsAccording to the principles by the World Bank, the reports should be in two parts , in

first part , the resettlement's progress and compensation disbursing should be described in

details , meanwhile , the methods and measures to dissolve the problems and troubles

encountered should be adhered , this part is a text part in fact . in second part , the statistics

tables needed are listed to state the actual executing situation and schedule scheme about

land requisition , compensation disbursing etc. by comparison . see Table 10-2 and 10-3 .

10.2 Exterior Inspections and Evaluations and Reports

10.2.1 Purpose and MissionThe exterior inspections and evaluations is made for resettlement mainly, by this way,

the evaluating notion and advice should be obtained upon impact range and impactsituation , so to supply the pre-alarm system , at same time , to feedback the opinions of the

people affected. The exterior inspecting and evaluating organization, being the agent of theowner, is able to raise the consultation through inspection and evaluation.

transacted the land requisition famlities, and during the fimd disbursing period , theadministrative villages affected will adjust farmland allocation" and the explanationin Table 6-1 said " farmland allocation" will be carried out from Jan. 1999 to Mar.1999.
