Please refer to your application dated 16.03.2020 filed online in the RTI portal of TRAI vide

registration no. TRAOI/R/E/20/00207 for providing information under the provisions of the Right to

Information Act, 2005 regarding postpaid/prepaid plan, MNP related matter. In this context, the following

is furnished:

1 to As per the existing tariff framework, the tariff for mobile services is under forbearance except

3 national roaming. Telecom service providers are free to decide the rates for calls and condition

such as validity period on the basis of input cost, competition and other commercial

considerations.

4 TRAI Direction dated 1st September,2008, inter-alia, mandates no access provider shall provide

&6 for any condition such as the requirement of obtaining new SIM or change of telephone number,

etc., by any telecom consumer who seek to migrate across plans or across postpaid and prepaid

tariff, Provided that, the direction contained in this sub-paragraph shall be applicable in relation

to migration from prepaid platform to postpaid platform subject to operational feasibility.

5 All Telecom Service Providers (TSPs) are governed by the License Agreement entered into with

Department of Telecommunications (DoT). Matters relating to KYC relate to subscriber's

verifications. Instructions regarding subscriber's verification are issued by DoT and

implemented by the Field Units of DoT. Therefore, a copy of your application has already been

transferred to DoT online on 21.04.2020 in terms of Section 6(3) (1) under the provisions of the

Right to Information Act, 2005 for providing the information on relevant issues.

7 The Telecommunication Tariff (43rd Amendment) Order 2006 dated 01.09.2008 issued by TRAI,

inter-alia, provides that tariff plan once offered by an Access Provider shall be available to a

subscriber for a minimum period of Six Months from the date of enrolment of the subscriber to

that tariff plan. No tariff item in a tariff plan shall be increased by the access provider during the

said six month period. This amendment is available on TRAI Website.www.trai.gov.in. Telecom

service provider can change; withdraw any plan in any service area as per commercial suitability.

8 to The eligibility criteria for making parting requests; and requests for parting of mobile number

11 are stipulated in the Telecommunications Mobile Number Portability Regulations, 2009, as

amended from time to time. These Regulations can be assessed in the TRAI website at the

TRAI has not laid down any benchmark for minimum internet speed to be provided by a 4G service provider. The speed of mobile internet is dependent on several factors such as closeness to the cell serving the customer, the number of users being served by the cell, the traffic handled by the cell, the user equipment/mobile handset used by the customer etc. As such, the mobile users may experience different speed at different locations and time of usage.

4 The Telecom Consumers Complaint Redressal Regulation, 2012 dated 05.01.2012, provide grievance redressal mechanism viz, Complaint Centre, Appellate Authority and Advisory committee. These regulations are already available in public domain and can be accessed at the TRAI website http://www.trai.gov.in under regulations.

5 Yes, however, the internet speed in wireless network cannot be guaranteed as it is dependent on a number of factors such as coverage, distance from the cell, traffic, customer equipment/handset etc.

It is for information that TRAI has mandated all Telecom Service Providers to establish a two tier

complaint/grievance redressal mechanism for handling consumer complaints. In terms of this

mechanism, a consumer can lodge service related complaints at the complaint centre of their

Telecom Service Providers (TSPs). In case complaint is not redressed satisfactorily by the service

provider at the complaint centre, an appeal can be registered with Appellate Authority of the

TSPs. Details of Appellate Authority of the service provider are uploaded and updated on TRAI

website as and when intimated by Service Providers. A subscriber may also obtain details of

appellate authority of his service provider on its website.

However, it is to bring to your kind notice that the installation of mobile tower does not fall under the purview of TRAI and no permission is required by the service provider from TRAI for installation of mobile towers. Accordingly, TRAI has not issued any guidelines, directions or orders in this regard. It is further informed that TRAI does not issue any certificate/NOC.

It is further informed that the guidelines for the issuance of clearance for installation of mobile towers were issued by the Department of Telecommunications (DoT) and for regulating the EMF emissions from a mobile tower, Department of Telecommunications has prescribed stricter precautionary norms for exposing limit for base station emissions, the details related to EMF and steps taken by DoT is available on DoT website https://dot.gov.in/journey-emf.

5 All Telecom Service Providers (TSPs) are governed by the License Agreement entered into with

Department of Telecommunications (DoT). Matters relating to KYC relate to subscriber's

verifications. Instructions regarding subscriber's verification are issued by DoT and

implemented by the Field Units of DoT. Therefore, a copy of your application has already been

transferred to DoT online on 21.04.2020 in terms of Section 6(3) (1) under the provisions of the

Right to Information Act, 2005 for providing the information on relevant issues.

7 The Telecommunication Tariff (43rd Amendment) Order 2006 dated 01.09.2008 issued by TRAI,

inter-alia, provides that tariff plan once offered by an Access Provider shall be available to a

subscriber for a minimum period of Six Months from the date of enrolment of the subscriber to

that tariff plan. No tariff item in a tariff plan shall be increased by the access provider during the

said six month period. This amendment is available on TRAI Website.www.trai.gov.in. Telecom

service provider can change; withdraw any plan in any service area as per commercial suitability.

ITRAI Act,1997 does not envisage handling of individual consumer complaints by TRAI.

TRAI has mandated all Telecom Service Providers to establish a two tier

complaint/grievance redressal mechanism for handling consumer complaints. In terms

of this mechanism, a consumer can lodge service related complaints at the complaint

centre of their Telecom Service Providers (TSPs). In case complaint is not redressed

satisfactorily by the service provider at the complaint centre, an appeal can be registered

with Appellate Authority of the TSPs. Details of Appellate Authority of the service

provider are uploaded and updated on TRAI website as and when intimated by Service

Providers. A subscriber may also obtain details of appellate authority of his service

provider on its website. If the consumer is still not satisfied with the resolution, he is free

to take legal. recourse.

and offer tariff as per prevalent market conditions, subject to the condition that these

protection of consumer interest and orderly growth of the sector.

Sir,

Please refer to your application dated 28.05.2020 sent through email for seeking

information under the provisions ofthe Rightto Information Act, 2005 about complaint against M/s. Airtel

Digital TV for not providing the services related matter.

2. In the above context, it is informed that the information sought by you is not available in

TRAI. TRAI Act, 1997 does not envisage handling of individual complaints by TRAI. However, the Service

Providers have to redress the complaint of their Subscriber/Customer, in accordance with the regulations,

directions and orders issued by TRAI, from time to time. TRAI has laid down the framework for redressal

of complaints by Service Providers through the "Telecom Consumers Complaint Redressal Regulation,

2012". As per the said regulations, the consumers may file a complaint with the "Complaint Centre" of the

Service Provider through the toll-free "Consumer Care Number". In case, the customer is not satisfied with

the redressal of his/her complaint he/she may file an appeal with the "Appellate Authority" of the

concerned Service Provider. For full details of the said regulations, may visit the public domain of TRAI at

website www.trai.gov.in under sub-menu "Regulations".

3. Further, it is observed that you have not sent the prescribed RTI fee along with your above

referred application. As per the provisions of the RTI Act, 2005 a citizen who desires to obtain any

information under this Act, should make an application to the Central Public Information Officer (CPIO) of

the concerned Public Authority along with the RTI fee of Rs. 10/- by way of cash against proper receipt to

be obtained in person from that office/by demand draft/bankers cheque/Indian postal order payable to

the concerned Public Authority, in terms of section 3 of RTI (Regulation of Fee and Cost) Rules, 2005.
