I, the undersigned, being duly sworn and under oath, state that the following facts known by me or told to me by the other

re liable persons form my belief that Travis Austin Smith the defendant committed the crime charged .

On Monda ;: May 26,2014 at approximately 2250 I was dispatched to the residence of 623 S . 9 th Street for a complaint of anintoxicated 'individual causing a disturbance. While approaching the residence, I observed two individuals, one male and one female inthe street at 9 th & Schaller Street having a physical altercation . I parked and exited my vehicle near them and could hear both subjectsyelling at one another loudly . As I approached the subjects on foot, theX turned and began walking south . The male was stumbling ashe walked . I stopped them on the sidewalk in the 600 block of south 9 t Street . The male identified himself as Travis Austin Smith ofSac City. He was advised numerous times that he was under arrest and refused to turn around to be handcuffed. He threatened tohead butt law enforcement officers and was placed on the ground to be handcuffed, where he continued to resist arrest . He wastransported to the Sac County Law Enforcement Center and charged with Interference with Official Acts .

Defendant has entered into a plea agreement as follows: He is entereing a guilty plea to the chargeof disorderly conduct and the court sentences him to serve 20 days in the Sac County jail on thatcharge plus $60.00 court costs. He shall serve an additional 48 hours of that sentence from 6:00 p.m.on June 8, 2014 until 6:00 p.m. on June 10, 2014 and shall also receive credit for time previouslyserved toward the 20 day sentence. The balance of said sentence is suspended for a period of oneyear during the defendant's good behavior. The accompanying charges of public intoxication andinterference with official acts are ordered dismissed defendant's cost. The total of $180.00 of courtcosts shall be paid by July 18, 2014 and if not paid a show cause hearing shall be held on July 21,
