If you haven’t heard….the SCA is the place to be in 2014. We are off to a great start as we continue to invest in quality Education as the corner stone for the SCA and it’s members. Our most recent Luncheon featured the topic of “White Waiver” by Robin Singer who is one of the many educational supporters of the SCA this year. Robin’s topic was informative as always as he also updated the audience on a current case study that may be affecting the Claims Industry soon. His update engaged the audience in several questions that where of concern from the Adjusters point of view. The SCA was proud to bring this type of knowledge to the audience who attended and update them with this type of valued information.
If there is something that you would like to see for an Educational program we welcome any and all suggestions. The SCA wants to encourage input from its members who we serve. The White Waiver was a great suggestion from one of our Adjuster members and proved to be very beneficial. Reach out to Steve Moore at [email protected] with any input you may have…we appreciate it.
We continue to see our consistent members, some new members and some past members that are hearing good things about the SCA for 2014. The networking that takes place at these events is so positive and energetic as there are many that have not seen each other for a long time and are glad to re-connect through the SCA.

2014 CCNC Planning Under Way "Hitting A Home Run
- Covering All The Bases"August 19-20, 2014

Set your plans now to attend the 21st Annual Claims Conference of Northern California: “Hitting A Home Run - covering all the bases”. This Summer Classic will be held August 18-20, 2014, including a recently announced Opening Day afternoon session Monday, August 18th. The total of three day series will take place starting at 4pm Mon-day, then all day Tuesday and well into Wednesday this year, back at the Hyatt Regency Downtown Sacramento.
“Hitting A Home Run - covering all the bases” is an apropos theme, both in honor of the Baseball “Summer Classic”, and in making the most of a mid-week conference experience, offering a chance to get out of the Sacramento Summer heat for a time.
With Exhibitor Registration now full again for the tradeshow por-tion of the event, and sponsors lining up like so many batters, CCNC is pleased to announce that attendee registration is now open!
A three-tiered, Continuing Education-accredited (pending) program has been established for a series to be remembered. Class schedules and attendee registration are available on the web site at this time: www.ClaimsConference.org.

On behalf of the current board of directors, SCA President Bob Battezzato gave special recognition, honoring SCA past Board Member, Ruth Griffith, of Servpro of Auburn/Rocklin, at the April 10, 2014 luncheon meeting. Ruth served the organization gallantly for several years, in a variety of capacities, including 2012 Vice President. She was duly recognized for her commitment to the betterment of the SCA, and presented with a nice gift card.

The April 10, 2014 gathering of the Sacramento Claims Association featured the return of popular guest speaker, Robin Singer, of Morris Polich & Purdy. This time out, Mr. Singer devoted a good por-tion of his presentation to the use, for better or worse, of the “White Waiver” in claims resolution.
A “waiver”, he said, is defined as “giving up a known right”. “‘White’, in this instance, is based on a case of some-one named White.”
A “White Waiver”, Mr.Singer ex-plained, “is to negotiate with insured without having it show up in court.”
The advantage to attaining a White Waiver is that any negotiation details under a signed white waiver cannot be used in court.
“Public policy is to try to allow par-ties to settle disputed without going to court,” Mr. Singer explained.

The next luncheon meeting of the Sacramento Claims Associa-tion, Thursday, May 8, 2014, will feature Mr. Larry Muzamel, Executive Director of the California Tow Truck Association, who will speak to a variety of issues related to towing, and claims.
Learn about the potential conflicts on a “police” tow as compared to an “insurance” tow. Additionally, he will offer-up information on the storage and impound area.
“I’ve been working with the DMV on the lien sale process in CA,” he informs us. “Seems we are becoming the “title washing” state, so we’ve approached them about assisting in cleaning up this issue.”
To the extent there is interest, he may also share details of the technicalities of towing, specifically on correct ways to avoid additional damage to the vehicle, etc.
Billing is always an issue, too, so Mr. Muzamel may provide a comparison on the CHP billing guidelines, as well.

A “bad faith” case from 1985 gave birth to the name “White Waiver”. It was the case of “White vs Western Title”. In that case, it was determined that a “carrier has an ongoing duty of good faith”. While the CCP 998 fair offer statute affirms that, the purpose of white waiver seeks to circumvent, or “restore the old days”, whether that’s a good thing or bad thing.
Bottom line is that it’s a mixed bag, good news/bad news, as “negotiations are not admis-sible.” Also, the insured/claimant may also use this tool to shadow details of their case.
