Welcome to 2013!

I first want to thank all those who at-tended and donated auction items to the 2012 Silent Auction in December. Through your generosity, $7,500 was raised for the benefit of our charitable partner; AEON Homes!

Now that we are approaching the 2013 legislative session, monthly Legisla-

tive Updates from Kathy Hahne with Faegre Baker Daniels will resume both in our monthly newsletters and at our monthly General Membership Meetings. With the makeup and control of the House and Senate changing as a result of the November elections, there will be much work to do and new acquaintances to make in order to best represent the needs of Greater Saint Paul BOMA members. We are fortunate to have Kathy work-ing on our behalf.

On a related front, I want to share with you that the Board re-cently initiated separate luncheon meetings with the full mem-berships of the Saint Paul City Council and the Ramsey County Board of Commissioners. Both proved to be very fruitful meet-ings based upon feedback from all. The goal of both meetings was to maintain and compliment lines of communication, to share with those bodies how BOMA at all levels can be of mu-tual benefit to them and our members, and we also leveraged the meetings to advocate various positions, hopes and needs.

Here is a quick update on the Board’s search for a new Presi-dent. A search committee comprised of five Greater Saint Paul BOMA members was established in mid-October 2012. That committee has been actively working to identify potential can-didates and vet those candidates. The committee is well along in its process. It is anticipated the interim period between lead-ers will be short. Day to day operations of the organization will continue on with the lion’s share of duties being picked up as needed by Executive Committee members.

2013 membership dues invoices should have reached every-one’s desk by now. We ask your assistance in paying dues promptly to ensure our funding base for the advocacy and edu-cation initiatives of the organization can be leveraged to their full potential.

Storm Water Retention, Design Maintenance and Regulations

Knowing how a structure functions, and your role in maintaining it effectively, you are involved in the repair and replacement of struc-tural items such as floors, ceilings, interior walls, and windows, and you need a basic understanding of building design, materials, codes, regulations, and structural systems and finishes. You also need to be familiar with maintenance procedures and equipment, grounds maintenance, and preventive maintenance, as well as construction documents. In this course, you will cover the characteristics, uses, and properties of common building materials, as well as building regulations, codes, and standards.

You will learn to compare building system components and to iden-tify appropriate inspection and maintenance techniques. You will de-velop the knowledge to establish procedures and standards for moni-toring building operations, preventive maintenance, and cleaning. You will also learn to read and use construction documents, studying from a course book that features a set of drawings and an architect’s pocket scale. Featuring helpful new illustrations and current resourc-es, such as governmental and industry websites, this course can help you design and maintain sound, safe buildings.

BOMA INTERNATIONAL ADVOCACyTell Congress to Pass Tax Extenders

Legislation Before 2013At the end of 2011, the 15-year timeline for depreciating leasehold improvements and a number of other business tax breaks commonly referred to as tax “extenders” expired and were not renewed for 2012 by Congress. Consequently, building owners have had to return to depreciating leasehold improvements on a 39-year schedule. In an attempt to increase the urgency of the matter, BOMA International, along with 1,500 other organizations, sent a letter to Congress ask-ing that the extenders package be passed before the end of the year. BOMA International is requesting your help in its efforts to educate Congress and urge immediate passage of the tax extenders package

current 2012-13 biennium will end with a balance of $1.3 billion, which, under current law, will automatically be allocated to pay back part of the K-12 school funding shift. A $1.1 Billion deficit is projected for the 2014-15 biennium.

Governor Dayton will submit his proposed budget in late January. Adopting a balanced budget will be the primary focus for legislators this session. Governor Dayton and DFL leadership are also keeping the door open for a potential bonding bill in 2013.

TAx REFORMGovernor Dayton has indicated he will submit a major tax reform proposal in January. The Governor and DFL leadership have signaled that they will look for ways to grow long-term, sustainable revenue streams and set reasonable spending levels to cure the ongoing problem of recurring budget deficits. Potential tax reform includes increased income tax rates on the wealthy, expanding the base of the sales tax, property tax reform, including reduction in C/I rates, the elimination or limitation of credits, deductions and exemptions in the individual and corporate income tax systems, and adjusting tax rates

TRANSPORTATIONGovernor Dayton recently appointed Charlie Zelle to replace Tom Sorel as the Commissioner of the Minnesota Department of Transportation. Commissioner Zelle most recently served as the head of the Jefferson Bus Lines and currently chairs the Minneapolis Regional Chamber of Commerce. Zelle served on the Transportation Funding Advisory Task Force (TFAC), which made a number of recommendations to the Governor for funding of transportation needs.

The recommendations made by TFAC in December include increasing motor vehicle registration fees, increasing the per-gallon motor fuel excise tax to generate $15.2 billion of revenue over a 20-year span, raising the existing sales tax in the five-county metropolitan area to generate $200 million annually for transit, expanding MnPASS, providing opportunities for local government revenue, and utilizing state bonding for improved transit and transportation options. The TFAC also recommended continued exploration of tolling options for new capacity, creating public-private partnership opportunities to enhance transportation projects, and monetizing assets to generate revenue.

CONCLuSION The new DFL leadership is struggling to lower expectations of the DFL base relating to desired outcomes of the 2013 Legislative Session. The new leadership and the DFL Governor are attempting to quietly “get on the same page” on the many issues being put forth by advocates. The new Speaker and Majority Leader are new to these roles. The course of the legislative session will depend on how well these legislators can lead their caucuses and how effectively they can align with the Governor.

tee for People with Disabilities would like to remind Saint Paul residents and businesses to keep sidewalks clear. Un-shoveled or poorly shoveled sidewalks and curb ramps make it danger-ous and next to impossible for people with mobility and/or vi-sion impairments to get around.

• Ken Smith, President and CEO Ever-Green Energy, was a speaker, a panelist and a one of the hosts to a delegation from Germany visiting business leaders and elected officials in both Saint Paul and southern Minnesota last week. A tour of our District Energy plant in Saint Paul was a part of the events.

• Also, Ken Smith recently presented the role of hot water dis-trict heating systems in improving energy profiles and unlock-ing fuel flexibility options for energy user and sharing how the City of Saint Paul has reached many of its efficiency and sustainability goals through the integration of district heating, district cooling, biomass fuels, combined heat and power, ther-mal storage, smart system monitoring and feedback cycles, and most recently the addition of solar thermal technology in a Department of Energy webinar.
