Over the past two months, Sarasota County held seven DeSoto Acres community meetings. The County mailed notices to each DeSoto Acres resident and emailed notifications to those on the County email list. The purpose of these County meetings was to obtain resident input on a variety of topics. From this input, County staff will distill resident input into a recommendation to the Sarasota County Commissioners for future plans on each of these topics. (See page 4 for links to each County meeting.) The February 2019 Newsletter provided detailed background as to how and why these meetings are taking place. In summary, DeSoto Acres is a unique community. At 850 acres, we are the largest, oldest platted neighborhood in Sarasota County (not including the City of Sarasota). As we near our 100 th anniversary, we are attempting to gain County recognition of this uniqueness, as we work together to preserve our character, the integrity of our neighborhood, and our zoning. This includes properties along Lockwood Ridge, west to Shade / Middle Ave, and North from University Parkway (with the OPI light office zoning specifically created in 1996 to minimize UP commercial development impact next to DeSoto Acres low-density residential zoning), south to 47 th St / 51 st St (adjacent to the industrial park). The North Lockwood Ridge Corridor Study was the link by which the County allocated resources to determine how best to assist DeSoto Acres to preserve our uniqueness. The seven meetings were designed to discuss this uniqueness, and to voice our community concerns. County staff, and representatives related to the meeting topics, listened to resident’s input on each topic to assess current status, gather data and input, and recommend how to move forward. DeSoto Acres: Strengths and Uniqueness We are fortunate to live in a beautiful community, and many of the things that make us unique, we take for granted. Not many cities can boast to have large residential, open greenspace parcels nestled Eive minutes from a thriving downtown, Sarasota Bay, and every big box store and restaurant any human could want! Below are some additional characteristics that make DeSoto Acres a “one-of-a-kind” in the state of Florida: We are the only one-house per two acres community in North County west of I-75. Our large lots provide aquifer replenishment and stormwater infrastructure control for areas to the south of our community. Our lots have old growth vegetation, including grand trees. Our neighborhood offers a rich habitat for wildlife, and includes protected wetlands. This is a relief area for Florida plants, animals, and humans. Our area is known for stabling horses. DeSoto Acres horses are part of our heritage and we remain a horse friendly community. Zoning code was “grandfathered in” to allow stabling horses on our properties, and chickens as well. Our community has a relationship with the John Ringling History. Many circus families lived in our area from the 1930’s, close to the winter home of the Ringling Circus in North Sarasota County. Our founder, William Van Dame, contributed to Sarasota County’s growth and connection to the north by donating his land to connect 301 from 17 th St. north into Manatee County. His vision for Van Dame Estates, was to offer large lots for suburban homes or small farms close to the City (based on a 1928 ad from the Sarasota Herald Tribune). In the 1950s/ 1960s, the area was re- platted by the County to include all parcels within our Community. The zoning designation was “E” for Estate 1 house per acre. MeetingOverviewThrough discussions in the meetings, several

challengeswereidentiEiedandpresentedtotheCounty.Belowisabriefoverviewofeachmeeting:

Land-use/Long-Range Planning and LockwoodRidgeCorridorCAPMeetings:Givenour large lots inanareawherelandisinhighdemandfordevelopment,apropertyownercanrequestazoningchangewiththeCounty. (SeeFebruary2019Newsletterforasummaryof the Land-use/Long-Range Planning process). Aproposed change inDeSotoAcres orwithin 3miles ormore can affect DeSoto Acres, aswe experiencedwiththerecentchangetoRollingGreenGolfCourse(seepage3 for more info) County Staff can also recommendchanges to the Sarasota County Commission. Forexample,aproposal isbeingexploredbytheCountytoallowanAccessoryDwellingUnitonanyresidentparcel.(Seepage10fordetails.)ThemeetingontheLockwoodRidge Corridor CAPwas to obtain residential input onwhat makes DeSoto Acres unique. Then staff maydetermineifanOverlayDistrict iswarrantedorif it’saneighborhood plan, which identiEies what should beconsidered as Sarasota County departments moveforward to evaluate planning for future capitalimprovements.Thesemayincludesidewalks,turnlanes,roaddesigns,etc. WhereasAnOverlayDistrictdeEinesphysical characteristics, uses, etc., within an area thatare different than the rest of the County. The Countystaff deEines uniqueness as zoning uses outside of thecurrent code. Examples were provided for areas thatqualifyas“unique”,suchasSiestaKeywiththeirresort,beach,residential lifestylemix,andPinecraftwiththeir1920’s structures on small lots with no set-backs andtheiruniquelifestyleuseofbicycleretail/rentalwithinaresidentialarea.

Environmental Protection Meeting: As Countybuildingandinfrastructurecodeshavechanged,DeSoto

Acres is now challengedi n h o w o u rn e i g h b o r h o o d i sperceived. While thecounty ’s grand treezoning has helped tosavelarger,olderspeciesof trees and diggingretention ponds forbuilding pads is nolonger allowed, nativeplantandwild life isde-

emphasizedasseeninthereductionofgreenwaysinthe2050plan. Attendingresidentsvoicedstrongopinionstoprotectouruniquehabitats,protectedwetlands,anddecliningvarietyofanimal,bird,and insects. Beyondsharing an appreciation for nature, the Countyrepresentatives knew little about the past or currentstatusofournaturalenvironment.

Transportation Meeting:All of Sarasota County andFlorida are experiencingma jo r t ranspor t a t i onissues. Increased vehiclesalong minor and majorarterials have pushedove r E l ow t ra f E i c i n toadjacent residential areas,throughoutFlorida.DeSotoAcresgridsystem,withtwominor arterials cutting ourcommunity into quadrantsis our challenge. Duringmorn ing and even ingcommute times, especiallya g g r a v a t e d d u r i n gsnowbirdseason,thecutthrough speeding trafEic is

quite evident. Attending residents were very vocalabout the increase in trafEic and safety and providedmanyideasofwhattheCountycoulddotomitigateandkeepourcommunityintact.

Safety/TrafGic Enforcement Meeting: Withincreased development around our borders andincreased trafEic cutting through our community,walkingonourstreets,ridingourhorsesorbicycles,ordriving our cars to visit a friend down the street is achallenge. The County is working with DeSoto AcresCommunity to install sidewalks along DeSoto Rd andTuttleAve.FutureCountyworkshopswillbescheduled.Forotherstreetswithproposedsidewalks,theCountyhas sent out a survey to residents along thosestreets todetermine if theywant sidewalksornot.Otheroptionssuchasround-abouts,markedpedestriancrossings,roaddesignstoslowtrafEicwereproposedtoCounty staff,however theDeputy representativeat themeeting kept reminding us that they can only enforcespeed. The other trafEic mitigating issues need to beaddressed at the transportation department. Othersafetyissuesthatwerementionedincludedthegrowingconcern over homeless encampments and illegalsubstancesales.

Stormwater/Drainage Meeting: We learned theCountyhasadrainagesurveyofDeSotoAcresfromthe1970’s.Buildingrequirementshavechanged,increasingEinishedEloorheight,requiringwaterdrainagefromourlotstogointotheCountydrainageswales,etc.Residentsquestions included coordination between stormwaterand the building department, and the representativerepliednocoordinationonanindividuallotbasis.Whenaskedaboutnewresidentialconstructionrequirementsofwaterdrainagecontroltootherproperties,thecountyrepresentativeindicatedthiswasnotaconsideration.

President’s Message MyFellowDeSotoAcresResidents,

Overthepasttwomonths,therehasbeenaseriesofmeetings with county representatives from variousdepartments. All residents were asked to identifycommonissuesandcomplaintsfromwithinourDeSotoAcres area, plus our unique characteristics. In thesemeetings, a common thread emerged, heavy intrusivetrafEic. And as time passes and Sarasota and ourimmediate area grows, ongoing trafEic and growthwillcontinuetoadverselyaffectourarea. Thetranquilityofthe north end of Sarasota county has been changedforever with the willful destruction of the rustically,beautiful Rolling Green golf course and the rampanthousing growth in southern Manatee County. I can’tbegin to compute the number of acres of naturaldrainage and animal habitat forever lost, and how theapparentmitigationfallsdirectlyintoDeSotoAcres’lap.DeSoto Acres was platted in 1921. Each home builtduring the 98 years that followed has left its family’smarkandElavor.Wehavegrownintoaveryuniqueareawith equally unique zoning. Our challenge is, how dowe preserve this rare county gem?We have chosen toliveintheAcresbecauseofourzoningnotinspiteofit.Whatchangescanwehelpthecountycreatetopreservefor another 100 years, the natural drainage, quietgreenspace,naturalanimalandbirdhabitat, safehorseand pedestrian walk space…our list goes on. We all,including the county,must keep an openmind and beready to discuss and work together to reach speedyconsensus. The goal is to make our streets safe andmaintain our area as an oasis amid the busy outsidearea.

ROLLING GREEN GOLF COURSE APPROVEDIn a 4 to 1 vote, the Sarasota Board ofCountyCommissionersapprovedtherezoneto

allow the construction of 487 single-family homes andvillasonthe139.28acres. Theonlyentrancesandexitsare on Tuttle Ave. The Rolling Green Golf VillageCondominium Association, directly to the north of thepropertyreachedasettlementwiththerezoneapplicantand attorney for buffer concessions, sealing the deal.VotingFortherezone,CommissionersMaio(District4),Ziegler (District 2), Detert (District 3), and Hines(District 5). Voting to Deny, Commissioner Moran(District1).

This rezone was opposed by the residents of theWindsofSt.Armands,RollingGreenGolfVillageSouth,NorthwoodsCommunity,andDeSotoAcresCommunityfor many reasons, the most cited being safety as theCountyrefusedtoaddressthe“failed”conditionofTuttleAve and lack of trafEic planning concurrentwiththe development’s estimated construction. The legalbasis cited for not applying trafEic concurrencystandards to the rezone, is the Community PlanningAct(2011)anditscompanions,F.S.163.3180andF.A.C.

Rule9J-5,havebanned“trafEic” fromanyconsiderationas it relates to anything to do with proposeddevelopment. This verbiage to “not apply trafEicconcurrency standards” is also incorporated in CountyPolicy1.3.12. Formany,thismakesnosense.Residentssentinletters,andbothattendedandspokeagainstthedensity of the project at the public hearings. It wasasked at the Planning Commission if there were anydollarsintheCountybudgettoaddressTuttle’s“failed”level of current usage and the inevitable increase inTuttle trafEic from thisdevelopment. Theanswerwas,“there are no dollars in the budget at this time”.Communities surrounding this now approved rezone,arewatchinghowtheCountywilladdresstheexpectedaggravationofcurrentissues.

ThenextCountyCommissionelection is in2020forDistrict1,District3,andDistrict5. Don’tforget,theSarasota County Charter amendment to restrict votingin each commission race to residents who live withinthe district passed 60% to 40% in the Nov. 8th, 2018general election. This voting rule is in place for the2020upcomingelections.

MEMORY LANE - ZIPPING THROUGH THE ACRES

I’ve lived on 59th street 35 years now. I can’timagineabetterplacetohaveraisedourtwosons.ThelargepropertyaffordedusthequietprivacyIneededasa medical professional, working nights and sleepingdays.The four+acresalsoprovideda largeplaygroundfortheboys,reminiscentofthefarmlandIgrewuponinIndiana. For yearswe had a zip line up between twotrees inour frontyard.Birthdaypartiesat theHarveysalwaysendedupoutside,withalonglineofkidswaitingtheir turn to squeal and zip across the 50 yards fromtree to tree! A few parents even gave it a try, myselfincluded.IalwaysfeltthattheziplinewasthebesttoyIever bought the kids. We talked about that this pastChristmas and #1 son said the best toy ever was themonster truck…and it ’s true, our bit of theneighborhoodwasrarelywithouttheconstantwhineofthe Mattel monster truck if our sons were awake andoutside.#1sonwasalwaysthedriver,#2soncontenttobe driven by older brother for years! #1 then seguedimmediately into driving the riding lawnmower whilepullingawagonfullofkids(bladeneverengaged)and

thenontoan80ccdirtbikethatwebuiltseveral jumpsinourbackyard.Ourboysandtheirfriendsdidnotplayquietly, and Iwouldnothavewanted it anyotherway.~ArticlebyDonHarvey

After a bit of a slow start, the Girst quarterEinishedstronginSarasotaCountyforsinglehomesales.AttheendoftheEirstquarter,inventorylevels,pendingsalesandclosedsalesarehigherthanlastyear,althoughthemediansalesprice is slightly lower. Withnearly6months of inventory the real estatemarket has shiftedfromaseller'smarkettoabalancedmarket.

Inrecentweeksandmonthssomeofmycustomershave had concerns about the market softening andwhether there will be "another bubble". Some saybecausethemarkethasbeensogoodforsolongitcan'tlast. Others have noticed there hasn't been muchappreciationoflate.First,letmesaymycrystalballhasbeen broken for some time and now only works inreverse. Havingsaidthat,Iwouldliketopointoutthatthe last "bubble" was caused by a number of factorswhich together created the perfect storm. Our currentreal estate environment is vastly different from daysgoneby. Forstarters,wearecurrentlyexperiencingthelowestunemploymentratesnationallyinmyadultlife.

Wagesare increasingduetocompetitionforskilledemployeesandsomeemployeesareevenbeingofferedsigningbonusesand/orbonusesforbringingothergoodemployees to work. Lenders no longer offer "liarsloans"tothemainstream.

You know the "stated income/stated asset" loanproduct thatwould allow a school teacher in SarasotaCounty to claim to earn $40,000 per MONTH(seriously!) and get a loan (or several loans) based onthatincome.

Loans today are fully documented and fullyunderwritten which has all but removed from themarket those whowould speculate while using "otherpeople'smoney".So,fornow,justrelaxandenjoylivinginparadise.

HOME GROWN - LETTUCE LOVE THE WEEDS

Goodmorning,afternoon,orevening(dependingonwhenyou’rereadingthis).Springishereandasourrainyseasonapproaches,onethingthat isonthemindof fellow gardeners or lawn maintainers alike is… themany Elourishing weeds to come. Oh yes, the dreadfulweeds that love togrow inplaceswedon’twant them.Theirseedsstick tooursocksandtheyoftentakeoverourgardenbeds. Iamheretodaytosuggestadifferentwaytolookattheseintruders,andthatis,asvolunteers.

“Weeds”, or ‘Volunteers’, as I like to call them, arereallyablessingasmuchtheyareacurse.Forinstance,myyardandmanyDeSotoAcresyardsarenotcoveredin traditional grass, but a collection of volunteerswhoarehappytogrowwhereotherplantswillnot.Theygiveour yards shades of green to cover and protect oursandy soil, so inhabitantsmay live there and keep ourecosystem happy. Volunteer plants also providebeautifulElowersifnotmowedorpulledtooearly.I

don’t know the name, but every Spring the yard getsEilledwithtall,littlepurpleElowersthatweusedtopickaschildren.

OnemorethingIwanttomentionaboutweedsthatyoumaybealittleskepticalaboutis…manyofthemareedible!That’s right; I said it. Iknowa fewof themanyplants that grow wild in our yard are totally edible.Thereisonethattastes likegroundpepperthatcanbesprinkledonsalads,andanothercalledBidensAlbathatyou’veall seen. It growsalmost shrublike if letbe, andhaslittledaisylookingElowersthathaveayellowcenterwithwhitepetals. Thisplant isnotonlyedible likespinach,but isknowntohelpreducethepainfromantbites, along with other medical properties. Did youknow that dandelions are consideredweeds up north,butisbottledandsoldinhealthfoodstoresforaidinginthehealingofmultipleailments?

Its root is even brewed and made into a delicioustea.Ifdandelionscanbeusedinsomanyways,Iamsurethat we have food and medicine growing wild in ourbackyards as well. I must mention that it is VERYimportanttonotconsumeanythingwithoutknowingforsurewhatit isandthatit is indeededible,asapprovedby a professional. If you are curious about a plant, I

suggesttakingpicturesandafewcuttingstotheSarasotaCounty extension ofEice,wheretherealexpertsare.I can admit that I too,sometimesEindweedstobevery annoying. It’s true,theydogetinoursocksandour gardens and just seemto pop up in places wherewe really don’t want them.

ButIhopethisbitofprosehasgivenyousomefoodforthought (and food for free) on the potential that theselittle guys do have- the life they give and joy theyprovide.Thankyouforreading,ArielFriedman

SARASOTA COUNTY EXPLORES ACCESSORY DWELLING UNIT (WITH KITCHEN) IN RESIDENTIAL ZONING

Your attention to the following topic is critical to determine if the evolving zoning change will or will not apply to DeSoto Acres zoning RE-1 (Residential Estate, one house per two acres). The County report, dated Feb 28, 2019 is available on the DeSoto Acres Association website DeSotoAcres.org under the Announcements tab.

The proposal is still under review and no ordinance has been drafted as the County is still obtaining data and input. The following are direct excerpts from the County staff report.

The Sarasota County Commission (Board) elevated housing affordability as a priority in 2017. Since that time, staff has presented data, engaged the community and compiled best practices into the Situational Report, delivered to the Board on May 22, 2017. In a report dated 2/28/2019, staff focused on smaller-sized units in a single-family setting, specifically an Accessory Dwelling Unit (ADU) ... The report contains a summary, data, and best practices relating to ADUs as a form of affordable housing.

Currently, Sarasota County ADU regulations consider a dwelling without a kitchen as not increasing the density on the property. If a kitchen is within the dwelling unit it would count as a separate unit on the parcel and pending the zoning and lot size this could restrict many properties from making these units available for rent or at all. An ADU (without kitchen) is permitted in Residential Estate (RE).

The County staff recommendation amending the Unified Development Code (UDC) is to encourage development and use of ADU’s. Currently, Base Districts of the UDC allows ADUs in a subdivision platted after (the word “to” was removed) October 2003… One unit per lot

or parcel with the property owner occupying either the principal dwelling or accessory dwelling unit. Maximum floor area is to be no more than 500 square feet. Each accessory dwelling contributes towards the density of the subdivision and cannot exceed the subdivision maximum. (Other limitations are cited in the report.)

The recommendations at this time: • Not counting ADUs with kitchens in residential

single-family districts as an additional unit, for the purposes of density.

• Maintaining the setbacks, maximum lot coverage, and additional parking space requirements.

• Requiring owner occupied status (verified through the homestead exemption status) for those property owners who want to rent out either the ADU or the primary structure.

If the UDC is amended to encourage ADUs, staff would provide community outreach, education, and assistance on the topic of ADUs. This would primarily include the explanation of the regulations and intent of the code language, as well as potentially offer architectural design guidelines.

Your Association recently learned of this “proposed” evolution in the zoning code and is learning more to know how the UDC is amended, if the final version of the ADU will impact DeSoto Acres or not, and provide input. The proposed zoning change could be a realistic attempt to address affordable housing for elderly, recent graduates, and low-income, without affecting our residential character. Taking a pessimistic view, this could also be an attempt to change density. We all need to be vigilant and informed. Please help keep all of DeSoto Acres informed. Thank you.

More questions included, how the County plans forwater Dlow into residential properties when streetimprovements are conducted. Currently, residents at 47th StwestofTuttleandresidentsnorthofDeSoto,alongTuttle to59th St west are experiencing Dlooding during normal rainevents. Stormwater / Drainage is a big consideration inDeSotoAcres850+acresandanimportantassetforSarasotaCountyStafftokeepinmind.

DeSoto Acres’ Community Meetings, including whether toinclude all of DeSoto Acres in the LockwoodRidge Corridorplanning or not, prior to sending forward to the CountyCommissioners. Our opportunity is to listen, review, andprovideoureditsorclariDicationstotheCounty.Itisalsoouropportunity to understand what the County Staff canrecommend for DeSoto Acres’ future or what is for DeSotoAcrestotakeforwardastheirowninitiative.
