Need for SDI Terms of Use
The “Extraction by Suction” - Scenario
This scenario was presented by a regional content provider
- Data was published by open services- Commercial usage of the data was not allowed- Nevertheless:
- When services were down a telephone call reached the provider
- A commercial data provider asked for what reasons the services are down
- Because they have to update their databases. - The implemented loop that gathers the information tile by tile
has stopped
The “Extraction by Suction” – Scenario
- The regional content provider was flabbergasted and asked for the contract that allows the commercial use of the information.
- What kind of contract?
- They met in court again.

Experiences:• During the technical realization we have recognized the demand for the realization of
economic tasks within the SDI.• Arising question:
What are services of an SDI good for, if nobody knows if one is allowed to use them in a commercial manner?
• Answers:Creation of the SiG geo-eBusiness (open)

Risk: New Barrier
• We recognize that we need Terms of Use to enable the economic use of the SDI.
• We also recognize that each content provider has his own comprehension of contracting, licensing, terms of use, costs etc.
• The risk of about 40 Terms of Use arose
• Therefore a reasonable organizational structure has to be found to conquer the possible barrier

• Harmonization of Terms of Use within the SDI
Hope:• Harmonization and an enhanced market transparency by usage of a
neutral third party template
• How can hope be changed in reality?
Install an organizational structure with active and qualified persons!

Approach: Model• ToU consists of separate statements referring to
elementary combinations of– an operation (What kind of usage is undertaken?)– an intention (What is the purpose of the usage?)

• operations– exakt meaning depends on type of
SDI resource (data, services, applications)– documentation of template must comprise
adequate definitions in process
more on intentions• Intentions
– different types are highly correlated with specific segments of SDI users, but not synonymous!
– e.g. public authorities or educational institutions can act as a company as well
• knowledge of user segment is not sufficient for the awareness of the intention
– therefore neutral terms were chosen for the categorization of intentions

Outlook
• Realize a usable, reasonable and simultaneously harmonized SDI Terms of Use template / exemplars.
• Convert it in proof defined General Terms and Conditions for SDIs.
• Create a broad and stable base of awareness for the Terms of Use template.
• Integrate the Terms of Use template technically into the SDI.
• Activate business processes on the SDI.
Conclusion
• Beside the technical requirements of standardization exists the need for the standardization of economical rules for SDIs.
• Economical rules are the definite and legal formalized descriptions of the usage of services, data and applications of SDIs.
• Harmonization process has started in NRW. First results are encouraging but there is still a long way to go.
