The Interagency Agreement (IA) between the California Department of Education (CDE)
and the Office of Administrative Hearings (OAH) requires OAH to report on a quarterly basis
certain information related to mediations and due process and expedited hearings, as well as
information required to be maintained according to state and federal law.1 The following report
addresses those IA reporting requirements.

CASES BY FILING PARTY
Overall, there were 994 total cases filed this quarter, which consisted of 859 student-filed
cases and 135 district-filed cases.3 Of the student-filed cases, 14 cases involved both expedited
and non-expedited issues (dual hearings), and four cases that were exclusively expedited
issues.4 Of the district-filed cases, there were two cases that involved expedited issues and no
cases that involved dual hearings.5 Of the 994 cases filed, one request by a student and one
request by a district were for a due process hearing only. A detailed list of all student-filed
cases this quarter broken down by district appears in Attachment B beginning on page 22.
Of the 994 cases opened by OAH this quarter, 992 had requests for mediation related to
due process hearing or mediation-only.6 Of the 992 requests for mediation, 78 were requests
for mediation-only.7 The remaining 914 requests for mediation were related to due process
hearing requests.8 Of the total requests for mediation, four student-filed and two district-filed
cases involved expedited issues only, and 14 student-filed cases and no district-filed cases
involved dual hearings.9

LEGAL REPRESENTATION
During the fourth quarter, 994 cases were filed, which consisted of 859 student-filed
requests and 135 district-filed requests. Of the 859 cases filed by students requesting due
process, 705 cases (82 percent) were filed by attorneys; of the 135 district-filed cases, 98 cases
(73 percent) were filed by attorneys.10
Of the 994 cases filed this quarter, 803 cases (81
percent) were filed by attorneys. This fiscal year, 82 percent of student cases and 76 percent of
district cases were filed with legal representation.

GRADE LEVEL
The majority of the 994 cases filed this quarter originated from students in the primary
grades (484 cases), followed by those in high school (230 cases), junior high school (167 cases)
and preschool (103 cases). The grade level of the student was not specified in 10 of the case
filings.11

ISSUES AND REMEDIES
Cases filed this quarter involved a variety of issues and requested remedies. The number
of issues raised varied per case, with some cases raising only one issue, and others raising
several issues. The most common issues raised in the 994 cases filed this quarter were
designated instruction and services (561 cases) and placement (536 cases). Other issues
included: assessment (485 cases), speech and language services (321 cases), occupational
therapy services (195 cases), one-to-one aide services (172 cases), goals and objectives (120
cases), extended school year services (76 cases), eligibility (69 cases), private services (63
cases), ABA (46 cases), mental health services (39 cases), procedural violations (37 cases), and
discipline (25 cases).12
Compensatory education was requested as a remedy in 421 cases and
reimbursement was requested as a remedy in 329 cases.13

The majority of cases filed this quarter involved students identified under the eligibility
category of Autistic-Like Behaviors (329 cases). Other identified areas of eligibility included:
Other Health Impaired (167 cases), Specific Learning Disability (163 cases), Speech or
Language Impairment (113 cases), Emotional Disturbance (53 cases), Intellectual Disability (32
cases), Orthopedic Impairment (18 cases), Deafness (13 cases), Hearing Impairment (11 cases),
Visual Impairment (five cases), and Deaf/Blind (one case). The student‟s area of eligibility was
not identified in 231 cases.15

CLOSED CASES
During this quarter, 940 cases were closed. Currently, 777 cases remain pending.17
Of
the 777 cases pending, 737 are related to due process hearing requests and 40 are related to
mediation-only requests. Of the 940 cases closed, 873 were related to due process hearing
requests and 67 were related to mediation-only requests. Of the 940 cases closed, 910 (97
percent) were resolved in some manner without need for a due process hearing.18
For the fiscal
year to date, 96 percent of cases have resolved without need for a due process hearing.
The majority of cases closed this quarter were settled during mediation (351 cases), followed by
those that were resolved outside the mediation or resolution session process (335 cases), and
those cases withdrawn by the filing party without explanation (156 cases). Additionally this
quarter, 26 cases resolved during the resolution session,19

settled at mediation, eight mediation-only cases were closed due to a party declining
participation,20
seven cases were dismissed after failing to amend following a notice of
insufficiency, five cases were dismissed by a motion to dismiss, one case was closed for other
reasons, and no cases closed at a settlement conference. Out of the 940 cases closed this
quarter, 30 were closed following a hearing and decision on the merits.

MEDIATIONS
This quarter, 524 mediations were held. The mediations were held in cases opened this
quarter and in cases that were pending from prior quarters. Of the 524 mediations held this
quarter, in 105 cases an additional mediation session was scheduled. Of the 524 mediations
held, 468 were related to due process hearing requests and 56 were related to mediation-only
requests. Of the 468 mediations related to due process hearing requests, four cases involved
only expedited issues and six cases were related to a dual hearing request.
For mediation requests related to due process hearings, 306 cases reached an agreement at
mediation,21
and 33 mediation-only cases reached an agreement,22
for a total of 339 cases
resulting in an agreement.23
Two of the cases involving only expedited issues reached an
agreement at mediation. Of the six dual cases, which involved both expedited and non-
expedited issues, which went to mediation, all six reached an agreement.24

Out of the 524 mediations held this quarter, mediation was successful in 339 cases (65
percent), with 165 mediations resulting in impasse. At of the end of this quarter, 461 cases
have mediations pending,25
and 737 cases have hearings pending.26
For the 2012-2013 fiscal year, OAH has conducted 1,859 mediations, with 1,204 resulting
in an agreement and 655 resulting in impasse. The overall mediation success rate for fiscal year
2012-2013 is 65 percent. For the 2012-2013 fiscal year, 96 percent of cases have resolved
without need for a due process hearing decision.

DUE PROCESS HEARINGS
During the fourth quarter, out of the 940 cases closed, 30 final decisions were issued. Of
the 30 decisions issued, 25 were issued within the 45-day timeline plus extensions, and no
decisions were issued late.27
There were three decisions issued in a case with expedited issues
and no changes of placement were ordered for this quarter.28
Overall, this quarter, 100 percent
of decisions were issued within the requisite timeline. For the 2012-2013 fiscal year, OAH has
issued 114 decisions and 99 percent have been issued within the requisite timelines.

Based upon the issues for hearing identified by the parties, during this quarter, districts
prevailed on all issues in 19 hearings (63 percent) and students prevailed on all issues in no
hearings. In 11 of the 30 decisions issued (37 percent), the issues in the decision were split
between student and district, with students prevailing on 18 issues and districts prevailing on 41
issues.29
For the current fiscal year, students have prevailed on all issues in eight hearings (7
percent), districts have prevailed on all issues in 66 hearings (58 percent), and 40 cases (35
percent) resulted in a split decision of the issues. Copies of all decisions have been provided to
CDE and have been posted on the OAH website.

Of the 30 decisions issued this quarter, 15 cases involved elementary school students, six
cases involved middle school students, and nine cases involved high school students.
On average, the due process hearings lasted four days, with students using 49 percent of the
hearing time to present their cases and districts using 49 percent of the hearing time for case
presentation.30
During case presentation, students called an average of five witnesses per case
and the districts called an average of five witnesses per case.31

RESOLUTION SESSIONS
The IDEA requires school districts to hold resolution sessions within 15 days of receipt of a
student‟s complaint. While there is no legal requirement to report this data to OAH, CDE
requests that OAH track this information. Accordingly, OAH sends letters to school districts
requesting them to report for each case if a resolution session was held, the outcome of each
session, and other information about each session. This quarter, based on the information OAH
received, 86 resolution sessions were reported as held and 325 were reported as not held. Of the
86 resolution sessions reported as held, two cases involved both expedited and non-expedited
issues, with no sessions regarding an expedited case.32
Attachment C, beginning on page 44,
reports all resolution session information reported to OAH this quarter and Attachment D
beginning on page 70, details the matters from this quarter for which OAH has not received any
resolution session data.
MOTIONS
Prehearing motions and Notices of Insufficiency (NOIs) comprise a substantial amount of
the work completed by administrative law judges. For this quarter, 356 prehearing motions and
42 NOIs were filed by the parties and ruled upon by OAH. Of the 356 prehearing motions that
were ruled on by OAH, 80 were filed by students, 65 were filed by districts or other local
education agencies and 211 motions were stipulated.33
Of the 42 NOIs filed, 21 of the
complaints were found sufficient, 18 were found insufficient, and three were found partially
sufficient. Seven cases were dismissed for insufficiency after failing to amend the complaint.34

There were 356 prehearing motions filed this quarter. Of the 80 motions filed by students,
41 were granted, 38 were denied, and one was granted in part. Of the 65 motions filed by
districts or other local education agencies, 32 were granted, 27 were denied, and six were granted
in part. Of the 211 stipulated motions, 201 were granted, nine were denied, and one was granted
in part.35
The prehearing motions involved a variety of issues, with the largest number involving
motions to continue (240 motions).

NON-ENGLISH-SPEAKING STUDENTS AND INTERPRETERS
During this quarter, 142 non-English-speaking students were identified through the due
process hearing request forms.36
Of the 142 non-English-speaking students, 131 students spoke
Spanish, two spoke American Sign Language, two spoke Armenian, two spoke Cantonese, two
spoke Korean, one spoke Indonesian, one spoke Pashto, and one spoke Vietnamese.

STUDENTS OF COLOR
CDE has requested that OAH collect data on the number of students of color accessing the
system. To facilitate this request, OAH‟s due process hearing request form asks the parties to
voluntarily provide this information. However, not all hearing requests are made using the OAH
form. This quarter, 13 students reported as being a student of color and 15 students reported as

TRANSCRIPT REQUESTS AND APPEALS
Data on the number of appeals to state and federal courts and appellate outcomes are
collected on an ongoing basis and include all cases about which OAH was notified of an appeal
since July 2005. This quarter, OAH received 37 requests for transcripts, and was notified of two
new appeals filed. Of the appeals reported in previous quarters, one OAH decision was upheld,
one decision was reversed, and one appeal was further appealed to a higher court.39
Based on correspondence with the parties and filings that have been provided to OAH, 221
cases have been appealed since July 2005.40
Of the 221 cases that have been appealed, 53 have
settled, 48 were upheld, 45 have been dismissed, nine were reversed, seven were withdrawn, and
four were remanded. There are 12 cases that are currently on appeal and 43 have gone on to
further appeal to a higher court.

identifying which cases are appealed and the appellate outcomes, parties are invited to notify

MEDIATION AND HEARING EVALUATIONS
OAH is required to send evaluations to all parties attending mediations and hearings. The
evaluations contain a rating scale of 1 to 5, with 1 being poor/very dissatisfied and 5 being
excellent/extremely satisfied. The evaluations ask the parties to evaluate the mediation, the
administrative law judge and OAH in general.
This quarter, 102 mediation evaluations were completed. Evaluations were completed by
parents (25 cases), legal counsel for parents (12 cases), school district representatives (56 cases),
legal counsel for districts (five cases), and non-attorney advocates for parents (four cases). In
each submitted evaluation, the evaluator indicated his or her role in the mediation.
