GENERAL

A.1 THE QUALITY SYSTEM

The Contractor shall plan, develop and maintain a documented Environmental Management System and Quality System in accordance with this Specification and with the Australian Standards specified below: AS/NZS ISO 14001: 1996 - Environmental Management System AS/NZS ISO 9001: 2000 - Quality System The Contractor must maintain current third party certification of its quality systems certified by an accredited certification body registered by the Joint Accreditation System of Australia and New Zealand (JAS-ANZ) - such systems must cover and be implemented on all work under the Contract. Contractors maintaining third party certification to the Civil Construction Management Code will be deemed as meeting this requirement. Council reserves the right to conduct surveillance audits of the Contractors activities against the requirements of the Contractor’s certified management systems.

A.2 HOLD POINTS

Definition: Those points beyond which the work may not proceed without review by the Superintendent.

Hold points are identified in the Specification by the letters HP in the left margin and by bold text print or arise from non-conformances. Text, which is bolded but not identified by the letters HP in the left margin, is not a hold point. These are specified obligations on the Contractor requiring the review or approval of the Superintendent. They are bolded for ease of identification. The review by the Superintendent of a hold point will not relieve the Contractor of responsibility for satisfactory execution or performance of the work. Twenty-four (24) hours notice is required prior to a hold point review. Failure to provide notice may result in a delay in the release of a hold point.

A.3 QUALITY SYSTEM DOCUMENTS

Further to Clause 8.4 of the General Conditions of Contract, the Contractor shall submit for consideration by the Superintendent at the signing of the Contract Agreement – a site-specific environmental plan and a controlled copy of the contract specific quality plan including specific quality procedures/descriptions relating to the work.

Works must not commence until the Superintendent notifies the Contractor that the quality plan is suitable. Mornington Peninsula Shire Council reserves the right to photocopy the above documentation for its own use in the administration of the Contract.

A.4 ADDITIONAL QUALITY SYSTEM REQUIREMENTS

The Contractor shall comply with the specified Australian Standard for Quality Systems. In addition the following requirements shall be satisfied:

(a) Identification

The Contractor shall identify all test results with the precise locations to which they relate.

(b) Traceability

Traceability is not required unless otherwise specified.

(c) Testing

The frequency of testing shall be adequate to demonstrate compliance with the Specification. In some instances the minimum frequency of testing is covered in the Specification.

(d) Records

The Contractor shall make all records pertaining to the Contract available to the Superintendent at all reasonable times. Where requested by the Superintendent, the Contractor shall provide the Superintendent with a copy of records.

Within four weeks of the Date of Practical Completion, and before issue of the Final Certificate, whichever is earlier, the Contractor shall make available a register of all records held. The Contractor shall provide the Superintendent with a copy of such records, or part thereof, as requested.

Within twelve weeks of the Date of Practical Completion, and before issue of the Final Certificate, whichever is earlier, the Contractor shall provide as-built drawings, in accordance with the following requirements:

(i) Design and Construct Contracts

As built drawings shall show the Works as constructed. The location of services of others within the limits of the work shall also be shown and detailed.

(ii) All Other Contracts

Departures from the drawings shall be clearly marked on a set of the Contract Drawings.

(e) Non-Conformance

All non-conformances, where the disposition of the non-conformance violates the contractual requirements, are to be promptly reported to the Superintendent for agreement via non-conformance reports. Such non-conformances automatically create hold points. Further, all non-conformance reports shall include:

(i) the cause of the non-conformance.

(ii) the proposed method of rectifying the non-conformance; and

(iii) the proposed changes made to the work procedures to prevent a

recurrence.

(f) Audits

Audits carried out by the Contractor to comply with the requirements of the relevant quality system standard shall be conducted by a qualified auditor in accordance with ISO 10011-1:1990 “Guidelines for Auditing Quality Systems - Part 1: Auditing”.

(g) Design

Design of temporary works, handling details not specified on the drawings, effects of construction loads on the permanent works or any other design requirements specified in the contract shall be verified in accordance with the Design System Element of AS.9001-1994.

A.5 OCCUPATIONAL HEALTH AND SAFETY

The Contractor shall incorporate into the Quality Plan a system element covering the management of occupational health and safety, in accordance with the Occupational Health and Safety Act 1985 and Occupational Health and Safety (Plant) Regulations 1995 Statutory Rule No. 81/1995. The system element shall include a Health and Safety Plan, a Risk Assessment of hazards associated with the works under contract and provide for the prompt notification to the Superintendent of any accident or injury occurring at the site. The completed Health and Safety Plan and Risk Assessment shall be in accordance with Managing Contractor Health & Safety Risks – Guidelines for Local Government (a copy of this manual may be obtained from the Mornington Peninsula Shire Council through the Superintendent). The Contractor must prepare and submit the Safety Plan and Risk Assessment prior to commencing the works under the contract. A Risk Assessment Form shall be used to record the risk assessment and risk control methods to be employed by the Contractor. The Contractor must demonstrate the use of proper and safe plant and equipment, and systems of work that are safe and in which there has been adequate instruction, training and supervision. Where the Contractor is required to co-operate with others (Clause A.12), co-ordination of the parties to ensure relevant safety issues are reviewed and implemented will be arranged by the Superintendent. When requested by the Superintendent, the Contractor shall be represented at meetings convened by Mornington Peninsula Shire Council for the purpose of reviewing occupational health and safety matters related to the site of the Works. The Contractor and the Contractor’s agents shall, so far as is practicable, provide and maintain for employees and agents of Mornington Peninsula Shire Council who, in the course of their work for Mornington Peninsula Shire Council, enter the site, an environment that is safe and without risks to health.

A.6 SURVEILLANCE AND AUDITS BY MORNINGTON PENINSULA

SHIRE COUNCIL

The Superintendent will arrange surveillance and audits to ensure that the Contractor is complying with the Quality System. The Contractor shall, upon being given reasonable notice by the Superintendent, make or arrange to be available all facilities, documentation, records and personnel, including those of any sub-contractors, that are reasonably required for the audit or surveillance to be undertaken.

Notwithstanding that Mornington Peninsula Shire Council may have previously undertaken audits of a sub-contractor’s quality system in connection with other work, the Contractor shall include the operations of all such sub-contractors in the Contract quality plan and shall fulfil all the quality obligations of the Contract. Mornington Peninsula Shire Council will carry out audit and surveillance of the work of all sub-contractors and suppliers as it sees fit, in the same way that it may carry out audit and surveillance work done and materials supplied by the Contractor. The Superintendent may for this purpose have recourse to audit and surveillance carried out for other Mornington Peninsula Shire Council contracts. Copies of any such audit and surveillance reports used by the Superintendent will be provided to the Contractor.

A.7 CONTRACT DOCUMENTS

The whole of the work is to be executed in strict accordance with this specification, the General Conditions of Contract (AS2124 - 1992), the accompanying plans and with any working drawings furnished as the work proceeds. The specification and drawings represent the requirements and intentions of the contract. Any other operations which may be reasonable inferred from these documents to form part of the true intent and meaning of this contract, although not specifically stated as such, will be deemed to have been included, and due allowance for their execution must be made. The whole of the works hereinafter described shall be included in one or more contracts, each of which is to include the supply of all materials, tools, plant, fencing, cartage, labour and all other things (excepting such as are specified as being supplied by the Mornington Peninsula Shire Council) whether temporary or permanent, which may be necessary to carry out the work to the true intent and meaning of the specification.

A.8 VISITING SITE

Contractors are advised and expected to visit the site of the proposed works before tendering and to ascertain themselves the actual extent of the work to be done, the nature thereof, and the difficulties connected therewith, as the Council will not entertain any claim whatsoever on account of failure to do so.

A.9 ORDER OF WORK

The works shall proceed in accordance with the works program furnished by the Contractor unless directed otherwise in writing by the Superintendent. The Contractor shall be allowed to occupy or take up only such portion of the streets or roads through which the works are to be carried out as the Superintendent may from time to time consider requisite and necessary. In the event of the Contractor failing to proceed with the work satisfactorily after any portion of the street has been opened up. The Superintendent shall have full power to complete the work in such manner, as the Superintendent may think fit at the sole risk and expense of the Contractor.

A.10 WORKING HOURS

Before commencing work under the Contract, the Contractor shall submit, for the Superintendent’s review, the working hours proposed for the execution of the work under the Contract. Further to the provisions of Clause 32 of the General Conditions of Contract: (a) no work shall be carried out on any Sunday, public holiday, between

Good Friday and Easter Monday inclusive, or during the Christmas to New Year periods;

(b) no work shall be carried out on the site outside the period between 7.00

am or sunrise, whichever is the later, and 6.00 pm or sunset, whichever is the earlier;

(c) Saturday - no work shall commence before 9.00 am. Refer Environment

Protection Authority Residential Noise Regulations 48a(5) ;

unless otherwise specified or approved by the Superintendent. A.11 EXTENSION OF TIME DUE TO INCLEMENT WEATHER

When wet weather delays the progress of the works resulting in a claim for extension of time, the Contractor shall inform the Superintendent as soon as the work is affected (by telephone). The Superintendent shall record when the delay was reported and an assessment of the delay claimed. This record will form the basis of the Superintendent awarding extension of time.

A.12 CO-OPERATION

The Council reserves the right to perform work or to award other contracts for work on or adjacent to this project. The Contractor shall co-operate with all other Contractors or other forces so as to avoid delay or hindrance to their work and ensure that all work is performed expeditiously.

A.13 SUBLETTING OF WORKS AND ASSIGNMENT OF MONEY

Special attention is drawn to General Conditions of Contract Clause 9. A.14 INDUSTRIAL AWARDS AND SITE ALLOWANCES The Contractor shall be required and agrees by submission of a tender to

undertake to:-

(a) Adhere to awards and formal agreements.

(b) Adhere to National Wage Case Principles.

(c) Prohibit “all-in” or “cash-in-hand” payments.

(d) Ensure good safety practice in accordance with relevant legislation, awards, and the procedures contained in building Industry Agreement.

(e) Refuse claims for payment for lost time due to industrial action unless

exceptional circumstances exist of genuine safety issues or fundamental breaches of contract of employment by employers.

(f) Any site allowances negotiated between the Contractor and any

Industrial Union will be the responsibility of the Contractor and shall not be reimbursed by Council.

A.15 MATERIAL STANDARDS

All materials shall be as specified herein and in accordance with Australian Standard Specifications.

A.16 ORIGIN OF MATERIALS

All materials and goods described in this specification shall be the best of their respective kinds. Depending upon the degree of the procurability and suitability, the approval of the Superintendent will normally be given for the use of all materials and goods manufactured in accordance with the following order of preference:

Victorian, Australian, New Zealand.

Unless otherwise indicated in the Specification, Tenders shall be based on the use of materials and goods manufactured in Victoria.

A.17 MATERIALS SUPPLIED BY COUNCIL

All materials to be supplied by Council will be delivered to the site of the works. The Contractor shall give one week’s notice for the supply of all materials.

On delivery the materials shall be signed for by the Contractor who shall thereafter accept full responsibility for the materials until the completion of the works.

Any materials damaged after delivery shall be replaced at the Contractor’s expense.

A.18 EXAMINATION AND TESTING OF MATERIALS AND WORKS

(a) General The Contractor shall be responsible for carrying out all examination and

testing of materials and work under the Contract in accordance with requirements of the Specification.

(b) Allowance for Testing in Construction Program The Contractor shall make allowance in the construction program for the

time necessary to arrange for and to carry out examination and testing materials and work.

(c) Tests Unless otherwise specified, all tests shall be undertaken in accordance

with the appropriate test methods and codes of practice of VIC ROADS. Where there is no relevant VIC ROADS test method then the current appropriate Australian Standard test method or other specified test method shall be used. Unless otherwise specified, all tests shall be conducted by experienced testing officers from a laboratory accredited by the National Association of Testing Authorities (NATA) for the test methods used under the Contract.

(d) Frequency of Testing The frequency of testing undertaken by the Contractor shall be evenly

distributed throughout the materials and work being tested. Notwithstanding the minimum specified frequency of testing, the

Superintendent may direct the Contractor to test any particular lot.

A.18 EXAMINATION AND TESTING OF MATERIALS AND WORKS

(cont’d) (e) Testing Small Areas

For earthworks and pavement construction any lot which has a surface area less than 500 m2 may be treated as a small area. When testing a small area as a lot and where test requirements are based on characteristic values of density ratio and/or moisture ratio, acceptance of the lot shall be based on the mean values of 3 individual tests. In this case the lot will be accepted as far as compaction is concerned if the mean value of the individual tests exceeds by 2.0% or more the appropriate compaction scale requirement for the characteristic value of density ratio for six tests per lot. The lot will be accepted as far as moisture is concerned if for material which has a swell equal to or greater than 2.5% the mean value of the individual tests exceeds by 2.0% or more the characteristic value of the moisture ratio for six tests per lot or for material with a swell less than 2.5% if the mean value of the individual tests exceeds by 5.0% or more the characteristic value of moisture ratio for six tests per lot.

(f) Test Results

Unless otherwise specified, the Contractor shall supply a weekly summary of test results to the Superintendent by the end of the following week. The summary shall include details of all tests undertaken, the result of each test and sufficient additional information to satisfy the Superintendent that the Contractor is conforming with the specified requirements of testing frequency.

A.19 MAINTENANCE

The Contractor shall maintain the works of this contract to the satisfaction of the Superintendent for a period of twelve (12) months after practical completion of the work, and the liability of Contractor during this period shall be to maintain the surface of the roadway footpaths and easements in good order, free from weeds, excess loam, loose crushed rock. Filling in ruts and depressions, reseed and nurture areas where the grass has not grown. Flush and clean all drainage lines and pits.

If at the end of the maintenance period, the necessary maintenance work has not been carried out to the satisfaction of the Superintendent, the Council shall have the right to, and will complete the necessary maintenance work at the expense of the Contractor.

A.20 SANITARY ACCOMMODATION

The Contractor shall provide suitable and approved sanitary accommodation for all persons employed on the works.

A.21 SET-OUT WORKS

The Bench Marks, or Permanent Survey Markers, for each part of this work shall be as shown on drawings. The Contractor shall check the differences in level between the Bench Marks and, prior to setting out the work, advise the Superintendent if there is any discrepancy in level.

Immediately prior to commencement of the Contract, the Contractor shall check that all survey marks required for setting out of the works are in position and where necessary, survey marks which are missing will be replaced by Council.

The Contractor shall when setting out the works and during construction, report to the Superintendent any apparent inconsistency or mistake or error between the set out and data supplied by the Superintendent, and shall not proceed with further construction works without the authority of the Superintendent. The Contractor thereafter will be responsible for maintaining all survey control.

It is the responsibility of the Contractor to properly offset and reinstate any engineering survey pegs that could be disturbed by construction works. Any such works that are requested to be carried out by Council Surveyors will be charged to the Contractor.

Permanent Survey Marks: Any permanent survey marks that could have been disturbed during construction are to be reported to the Superintendent.

A.22 PUBLIC UTILITIES AND SERVICES

The Contractor shall be responsible for any damage which has been caused to any water, sewerage or gas mains, electric light, power or telephone cables, by any works or operations under control of the Contractor.

The Contractor shall also be responsible for any damage caused to the works of this contract by any fault that may develop in any of the above mains or services.

The Contractor shall make arrangements with the Authorities concerned for any repairs, which may be necessary, and shall have no claim against the Council for any loss or delay occasioned by any such damage or defects.

Any mains, cables, drains or sewers, which require alteration, will be altered by the Council without cost to the Contractor and the Contractor shall afford every facility to the Authority carrying out such alterations.

A.22 PUBLIC UTILITIES AND SERVICES (cont'd)

All fire plugs, valve boxes, manhole covers, which require to be raised or lowered to the finished level of the new road will be similarly dealt with, but the Contractor shall, if so requested by the Superintendent in writing, make the necessary arrangements with the Authority concerned.

Where any Authority desires to lay a new main or cable in the road during the progress of the contract works, the Contractor shall facilitate the work as much as possible.

The Contractor shall have no claim against the Council for any delay, loss, or inconvenience, which may occur through the necessity of such alterations or laying of new mains or services.

The Contractor shall make the necessary provisions for cutting and sealing any service pipes where required, and seeing that all leaks and defects are stopped or repaired before construction proceeds.

The Contractor is warned of the danger and loss cause by interference with the conductors, insulators, or structures on the transmission lines belonging to United Energy. No blasting or clearing operations shall be carried out in the vicinity of such lines without adequate precautions being taken to prevent possible damage. United Energy has power to recover damages from the persons responsible for such loss or damage.

During the excavation, construction and maintenance of the work, the Contractor shall take every precaution that is necessary for the protection from injury of all existing water, sewer and gas mains, drains, and other pipes, electric and telephone conduits, cables or poles, and other existing works, services, fences or buildings wherever met with, or that are adjacent to the work, and shall maintain the same until end of the maintenance period.

All damage occasioned by the Contractor to these works and services shall be repaired or restored at once by and at cost to the Contractor and to the satisfaction of the relevant authority.

Before commencing any excavation work, the Contractor shall contact the Responsible Offices of the various Departments and locate all mains, services, etc.

Prior to disconnecting any service (water, gas or power) the Contractor shall give reasonable notice to the occupants of the properties involved.

In this clause, mains, cables, drains, sewers, etc., shall not include private services for water, gas or telephone and the alteration, removal or replacement of any or all of these services shall be the responsibility of the Contractor.

A.23 EXISTING WATER SERVICES

The Contractor shall, lower and/or raise as necessary all existing copper service pipes, so that the depth thereof will be not less than 150mm nor more that 600mm below the road bed. The Contractor shall replace all existing G.I. water services with copper tubing. A licensed plumber shall carry out this work.

Prior to disconnecting the water supply to each property, the Contractor shall notify the occupant.

During the progress of the works and to the end of the maintenance period, the Contractor shall be responsible for and shall repair, at the Contractor’s expense, all damage to service pipes caused directly or indirectly by the works of the contract. All joins in copper shall be kept clear from under the pavement and kerb and channel.

The Contractor shall make the necessary provisions for cutting and sealing any services where required, and for seeing that all leaks and defects are stopped or repaired before construction proceeds.

A.24 TRAFFIC MANAGEMENT

(a) Description

This Clause covers requirements where the Contractor is solely responsible for traffic management.

(b) General

Unless otherwise specified, the Contractor shall make provision for

traffic, including pedestrians, in accordance with the Clause and the relevant parts of the VicRoads Worksite Traffic Management (Roadworks Signing) Code of Practice, hereinafter referred to as the Code, or Australian Standard AS 1742.3 “Manual of Uniform Traffic Control Devices”. The Contractor shall make such provision for traffic notwithstanding anything contained in the General Conditions of Contract and without derogating in any way from the Contractor’s obligations pursuant to the General Conditions of Contract and in particular from the Contractor’s obligations pursuant to Clause 15 of the General Conditions Contract.

For the purpose of applying the Code a reference therein to VicRoads shall be taken as a reference to the Contractor subject to such modification as the context may require. A copy of the Code or AS 1742.3 shall be available for use by the Contractor’s personnel and produced when requested by the Superintendent.

A.24 TRAFFIC MANAGEMENT (cont'd)

The Contractor shall submit, before commencing any part of the work, details of the proposed provisions for traffic to be provided during the Contract for review by the Superintendent.

The number, type and location of signs and devices shall be not less than the standards set out in the Code as applicable and shall also meet the requirements of this section.

Should circumstances arise which are not adequately covered by the Code or this section, the Contractor shall submit alternative proposals to the Superintendent for review prior to works proceeding.

Work shall not commence or continue at any location until all appropriate signs and devices such as lamps, barricades, traffic control apparatus and the like are in place, side tracks have been constructed where required and line marking completed where required.

At all times when the Contractor’s employees are on site, the Contractor shall render immediate assistance without charge to any person whose lawful passage through a work area may be obstructed or made difficult by or as a result of the Contractor’s operations.

Unless otherwise approved, when work is not being performed on the site, traffic shall not be carried through that works zone or works area on side tracks, detours or part widths of the existing pavement.

(c) Signs and Devices

Unless otherwise specified, the Contractor shall supply all sign and devices required to complete the work covered by this section.

Signs and devices shall comply with the relevant requirements of the Code together with the following additional requirements:

(i) Pavement Markers

Pavement markers shall comply with the requirements of AS 1906, Retroreflective Materials and Devices for Road Traffic Control Purposes, Part 3 - Raised Pavement Markers (Retroreflective and Non Retroreflective). The adhesive used to fasten them to the pavement shall comply with the requirements of Section 853(VicRoads Standard Specifications).

Section 853 forms part of this Contract. If not included in this Specification a copy will be supplied to the Contractor on request.

(ii) Retroreflective Sheeting

Retroreflective sheeting used on any sign or device shall comply with the requirements of AS 1906, Retroreflective Materials and Devices for Road Traffic Control Purposes, Part 1 - Retroreflective Materials, for Class 1 material, except that the coefficient of luminous intensity shall be not less than 50% of the values given in Table 2.2 of AS 1906, Part 1, for each designated colour when tested in the cleaned condition.

(iii) Signs

Dirty, illegible, damaged or faded signs shall not be used if there is any doubt that the message or intent of the sign is unclear or confusing to road users. The Contractor shall clean, replace or renew all signs as required to ensure legibility.

(d) Storage of Plant

When not in use, the Contractor shall be responsible for the safe storage of plant and equipment clear of the travelled path. Wherever possible, plant and equipment shall be stored not less than 3 m from the edge of the traffic path in urban areas and not less than 5 m in rural areas. If it is not possible to provide such clearance, the plant and equipment shall be moved from the Works area to a suitable storage site or be protected by suitable signs, lights and devices.

(e) Care of Areas Used by Traffic

The Contractor shall be responsible for ensuring that the pavement and shoulders being used by traffic within the Works area are in a safe and trafficable condition.

Any material which has fallen on any travelled path as a result of the Contractor’s transportation or other operations and any material stored near the travelled path which could constitute a hazard to traffic shall be removed by the Contractor immediately.

(f) Access to Side Roads and Abutting Property

Construction operations shall be conducted in such a manner as to minimise inconvenience to abutting property owners. Unless otherwise specified, access to properties and side roads shall be maintained at all times wherever practicable other than when the works present a traffic hazard or the work would suffer damage as a result of the passage of traffic.

Where the Contractor proposes to restrict access to abutting properties as a result of the Contractor’s operations, the Contractor shall provide a minimum of 24 hours notice to the affected property owner/occupier.

Access shall not be denied to any abutting property outside the customary working hours.

(g) Operations Affecting Traffic

(i) General

Unless otherwise specified, the Contractor shall so conduct the operations as to minimise obstruction and inconvenience to the public, and shall not have under construction any greater length or amount of work than can be managed properly with due regard to the convenience of the public.

If the intermingling of construction plant with traffic is unavoidable the intermingling shall be minimised at all times.

Unless otherwise specified, the Contractor shall:

• Provide a minimum safe working width for the Contractor’s

construction plant plus an absolute minimum clearance to the edge of the traffic path of 1.2 m.

• Provide a minimum one way clear travel path width for traffic

of not less than 3.5 m for one-way operation and 7 m for two-way operation.

• Not work on any part of a carriageway during peak traffic

flows unless such work is so conducted that it does not cause any additional delays to traffic than if the work was not done.

• Locate the longitudinal joint (s) for pavement construction and/or cold planing works at either the traffic lane line(s) or at the centre of the traffic lane(s) or as specified in Clause M.17(c) for hot mix asphalt.

The shoulder (sealed or unsealed) may be used as part of the travelled path subject to the agreement of the Superintendent.

(ii) Earthworks and Pavement Construction

Unless otherwise approved by the Superintendent, earthworks and pavement construction shall proceed only in ares clear of travelled paths and footpaths.

Where construction is being carried out over part of the carriageway width, the following conditions shall apply:

• Steps or batters within 1.5m of the travelled path of the

carriageway shall be delineated as specified in the Code. Where the step or batter forms a drop in level of more than 200 mm at a slope steeper than 1 in 6, barricades shall be used in addition to delineation.

• Where the level difference is in the form of a step or batter of

less than 80 mm and is between the travelled paths, such step or batter shall be removed before the close of work each day and the full width of carriageway made available to traffic overnight. The removal of such step or batter shall be effected by shaping to a crossfall not steeper than 1 in 10.

• Unless otherwise specified, prior to the close of work each day

all steps between layer of unbound pavement material being placed shall be tapered to a slope not steeper than 1 in 10.

(iii) Footpaths and Pedestrian Walkways

The work zone shall be not less than 1.5 m wide, shall have a firm, even and free draining surface and shall be free from steps and obstructions.

(h) Detours and Side Tracks

(i) Side Tracks

Traffic shall not be diverted on to any side track until permission to use such side track as been given by the Superintendent.

(ii) Detours

Unless otherwise specified, traffic shall not be detoured on to roads outside the works zone.

Prior to the issue of the Final Certificate, unless otherwise specified, detours and side tracks used or constructed during the Contract shall be restored to the condition existing at the time of commencement of the work under the Contract. Where the Contractor is responsible for the restoration of detours and side tracks the Contractor shall produce from the landowners concerned clearances in writing stating that such detours and side tracks have been restored to their satisfaction.

A.25 PAVEMENT MARKINGS

Pavement markings required for works under this Specification shall conform to the current VicRoads Specification - Section 721.

This section covers the requirements for materials and application of pavement markings including:

(a) Fixing of both reflective and non-reflective raised pavement markers to

asphalt, concrete or sealed pavements using epoxy adhesive or hot melt bitumen adhesive.

(b) Supply and application of pavement marking paint and glass beads for

new installation and maintenance of longitudinal lines, intersection markings and other markings on the road surface.

(c) Supply and application of thermoplastic or cold-applied plastic material

and glass beads, and pliant polymer tape for new installations and maintenance of pavement markings.

A.26 PROVISION FOR STORM WATER

The Contractor shall provide for all watercourses, channels and drains intercepted during the progress of the works, and shall replace or, if so directed, permanently divert same, leaving them in as good a condition as they were originally found.

A.27 EROSION CONTROL

The Contractor shall take measures necessary to minimise erosion by surface protection of exposed areas, control of runoff water and trapping of sediments - refer to Section R (Environmental Protection) of this Specification.

A.28 EMERGENCY PLUMBING WORKS

The Contractor shall nominate a plumber who can be called the Superintendent to carry out emergency work on the Contractor’s behalf.

A.29 ROCK EXCAVATION

(a) Definition

Rock for the purpose of this work is defined as a dense hard material that in the opinion of the Superintendent is unable to be satisfactorily excavated without causing undue wear and tear to a machine in good working order, of “minimum capacity” specified herein.

(b) Minimum Capacity Machine

A minimum capacity machine for the purpose of this work shall be that as laid down in the Australian Earthmovers and Road Contractor Federation Current Hire Manual for plant groupings as follows:-

(i) Excavator, Class 5 - Drainage Works

(ii) Bulldozer, Class 6 - Road Works

(including all earthworks other than drainage)

(c) Excavation

Removal or rock as defined above and in the opinion of the Superintendent, will therefore necessitate excavation by a machine of greater capacity than a “Minimum Capacity Machine” or otherwise will require the use of explosives with or without the use of pneumatic or mechanical equipment worked in conjunction to remove it.

A.30 EXPLOSIVES

The transport, storage and use of explosives shall be subject to the Explosives Act, Mines Act and Regulations made under these Acts.

If it is intended to use explosives on the works, the Contractor shall comply with

the provisions of the Country Roads Board’s Dangerous Goods (Explosives) Regulations 1988 and with “Explosives in Roadworks - Users’ Guide” 1982 (NAASRA).

Unless otherwise consented to by the Superintendent, no explosives shall be manufactured or charges loaded before 7.00 a.m. or after 3.00 p.m. or on any day other than an ordinary working day and no charge shall be primed and no shot fired before 9.00 a.m. or after 3.30 p.m.

The Contractor shall give occupants of nearby buildings and structures, and owners of underground services adequate notice of intending blasting. Prior to blasting the Contractor shall arrange with the occupants and the owners of underground services for any necessary protection of persons, property or livestock.

Prior to use of explosives, the Contractor must submit a quality procedure that reflects the above requirements to the Superintendent for review.

A.31 LIMITATION OF GROUND VIBRATION DURING CONSTRUCTION

For work near existing buildings, structures and underground services, construction methods shall be adopted which will minimise ground vibrations. The construction methods shall be such as to limit measured peak ground particle velocities to the values specified below. These ground particle velocities will be measured below ground and immediately adjacent to the foundations of the building or immediately adjacent to the underground service.

Peak ground particle velocities shall not exceed the following values for the relevant type of building or underground service:

Brick or masonry sewers 3mm/second

Houses, flats and other domestic buildings, brick and masonry industrial and commercial buildings (including buildings clad in these materials) 5mm/second

Concrete and steel-framed industrial and commercial buildings, co-axial or optical fibre type cables 10mm/second

Other power and telephone cables, gas pipelines

and water mains 20mm/second

If measured peak ground particle velocities exceed the relevant maximum specified, the work shall be stopped immediately. The Contractor shall then amend the adopted construction methods in such a way to reduce the measured peak particle velocities to values less then specified.

The Contractor shall bear all costs associated with the implementation of construction methods, which are found necessary to contain measured ground vibrations below the specified limits. The Contractor shall bear all costs associated with any claims for damage resulting from the effects of ground vibration directly caused by the Contractor’s construction method if it can be established that measured peak ground particle velocities exceeded the specified relevant values. The cost of such damage shall be in addition to damage cause by other action attributed to the Contractor’s work.

A.32 UNDER ROAD BORING

For the installation of services, drainage and the like under constructed road pavements, a suitable method of under road boring must be used.

Detailed proposals for boring under constructed pavements or alternative underground methods proposed by the Contractor shall be submitted to the Superintendent for review before commencing work.

Thrust boring under constructed pavements shall not be used for services greater than 30mm in diameter and thrust boring shall not be used within 1000mm of the existing surface level.

Unless otherwise specified, boring by water jetting will not be permitted.

Unless otherwise specified, the annulus between the bore and the pipe or carrier-conduit shall be filled by pressure grouting.

Existing road pavements must not be open cut without the prior written approval of the Superintendent.

A.33 CARTAGE AND DAMAGE TO ROAD, ETC.

Any damage caused to any roads, footpaths, bridges, or other structures by carting materials for this contract shall be repaired at the Contractor’s expense to the satisfaction of the Superintendent.

The Contractor shall only cart along such roads or portions thereof as the Superintendent may from time to time direct, and shall submit clearances from any local authorities concerned before final payment is made.

Trucks - All trucks under this contract to be back tipping, fitted with adequate chains to provide for proper spreading of material.

A.34 CLEARANCES FROM LANDOWNERS AND OCCUPIERS

Before final payment is made, the Contractor shall produce written clearances from all landowners and occupiers whose properties have been entered by the Contractor or the Contractor’s employees or agents, for the purpose of carrying out work under the Contract, to certify that the landowner and occupier have no claim against Council for any loss or damage due to the Contractor’s operations and that the land and improvements have been left in a satisfactory condition.

A.35 FENCES

Except as hereinafter provided, the Contractor shall re-erect, raise or lower (as necessary) all fences - private or otherwise - abutting or adjacent to the roads, right-of-ways, and/or footways, being constructed in this contract, so that when so altered the bottom of plinth- or where there is no plinth, the corresponding part of the fence as to level - shall be 25 mm below the adjoining surface. The works shall be carried out in a workmanlike manner, the finished job being true to lines and levels.

In any case in which the owner of any property objects to any fence thereon being raised or lowered, the Contractor shall leave such fence as its present level unless directed in writing by the Superintendent to alter the same, then the Contractor shall carry out the work as part of the contract.

A.36 WORKS ON PRIVATE PROPERTY

Where the works under the contract encroach onto private property the Contractor shall not enter the property nor remove any fence enclosing such property until seven days notice has been given and entry has been authorised by the property owner. The Contractor shall erect any temporary fencing that may be necessary.

A.37 REINSTATEMENT

Any pavement, pitching, paving, kerbing or channelling which it may be necessary to remove, shall be carefully removed and replaced or renewed by the Contractor as they were when opened up, except where otherwise specified or directed.

A.38 CLEANING UP

The Contractor shall leave the whole of the site of the works and the locality clean and free from rubbish and debris of all kinds at the completion of work and shall, at the Contractor’s own expense, remove and dispose of all such rubbish, debris, surplus materials, etc.

All sand spread on kerbs, channel, paths and crossing shall be removed therefrom.

If necessary, concrete footpaths and channels shall be flushed and swept down.

All storm water drains shall be flushed clean.

On the expiration of the maintenance period, the Contractor shall hand over the works in a neat and clean condition.

A.39 INFORMATION SIGNS

The Contractor shall erect and maintain in at least one (1) location on each project, a sign or signs, supplied by Council, on which is printed the following information:

(a) The name ‘Mornington Peninsula Shire Council.

(b) The name of the project, e.g. ‘SPECIAL CHARGE SCHEME’ Estate

name etc.

(c) The name and after hours telephone numbers of the Contractor.

(d) The extent of works in project.

(e) The estimated cost of works.

(f) Duration of works.

The Superintendent, prior to erection shall approve the location and erection details of each sign.

A.40 PROGRESS INFORMATION FOR SCHEME PARTICIPANTS

Prior to the commencement of works and at a time, which corresponds to completion of half the value of the works, the Contractor shall correspond by letter to all scheme participants whose names and addresses the Principal will supply as part of the contract documentation. The Contractor shall present a copy of the letters to the Superintendent for review prior to their issue.

First Contact - Prior to start of works.

The letter must address the following:

• Work program including key activities and dates including where the works

are to start and finish.

• That seven days of advance warning will be given to residents prior to the Contractor entering any private property (A.37).

• That access will be maintained at all times except for a period of four days

when concrete kerbing is placed and curing in front of the property (F.19). • Contractor’s Representative’s name and contact number including after

hours numbers. • Contractor’s Representative’s name and contact number including after

hours numbers.

Second Contact - Half the value of the works or at a point where there has been a substantial departure from the construction time table or order of works.

The letter must address the following:

• Progress information setting out how the work is progressing, and should

there be any substantial departures from the time table or order of works, highlighting why and how this will effect the expected completion date.

• Advise that a written clearance will be sought from the owners of properties

where works are undertaken on private property e.g. construction of easement drains, prior to the finalisation of the contract.
