The rule will not increase any fees, business costs, personnel costs, will not decrease profit opportunities, and will not require any specialized knowledge to comply. This change will not increase any direct or indirect regulatory costs. Hence, the Board determined that a Statement of Estimated Regulatory Costs (SERC) was not necessary and that the rule will not require ratification by the Legislature. PURPOSE AND EFFECT: The proposed amendments adjust

the minimum and maximum disciplinary guidelines to clarify

to licensees the ranges of discipline that can be expected if a

violation occurs.

SUMMARY: The proposed amendments reflect changes made

Florida’s Occupational Therapists and Occupational Therapy

issue of the Florida Administrative Register.

A Notice of Change was published in Vol. 47, No. 162, of the

August 20, 2021, issue of the Florida Administrative Register.

The changes are in response to written comments submitted by

the staff of the Joint Administrative Procedures Committee and

discussion and subsequent vote by the board at a public meeting

held September 20, 2021. The changes are as follows:

64B10-15.001 Continuing Education for Licensure

Renewal.

(1) No change.

(2) For each subsequent renewal period, to satisfy the

requirements of this rule, in each biennium a licensee shall have

a minimum of forty (40) contact hours of continuing education

credit. A contact hour shall consist of fifty (50) clock minutes.

In any biennium after the first renewal period:

(a) A licensee shall have a minimum of twenty (20) contact

hours of continuing education credits that include personal

attendance at a live presentation or, as specified in subsection

(3) of this section, completion of classroom attended college

course(s) taught with live lectures. For the renewal period

ending September 30, 2022, the requirement referenced in this

subsection regarding live and in-person attendance is waived

for each licensee. During the renewal period of October 1, 2020

through September 30, 2022, :

1. tThe licensee may complete the continuing education by

means not requiring live or personal attendance.

2. No later than 90 days prior to September 30, 2022, the

Board shall review and amend, modify, or sunset this

subsection if it determines this rule creates barriers to entry for

private business competition, is duplicative, outdated, obsolete,

overly burdensome, or imposes excessive costs.

GENERAL SUBJECT MATTER TO BE CONSIDERED: The

Monroe County Tentative Work Program Public Hearing will

be held in-person and virtually in order to present District Six's

Five-Year Tentative Work Program and allow the public to ask

questions or make comments about the program in general, as

well as specific projects included in the plan. The in-person

Public Hearing will be in compliance with all current Centers

for Disease Control and Prevention (CDC) guidelines, and

social distancing will be followed.

Both formats will consist of a formal presentation followed by

comment period and open discussion. The presentation will

begin at 6 p.m. followed by a live question and answer session.

Staff will be available to answer questions and provide

assistance. In-person audience members onsite can approach

the microphone and ask questions or make comments in

compliance with all current CDC guidelines. Online viewers

can submit questions and comments prior to the Hearing by e-

mailing [email protected] or submit comments via

the GoToWebinar chat box during the Hearing. Questions and

comments will be responded to in a timely manner. Persons

wishing to submit statements, in place of or in addition to oral

Regarding Declaratory Statements

NOTICE IS HEREBY GIVEN that the Florida Office of

Financial Regulation has issued an order disposing of the

petition for declaratory statement filed by Everi Payments, Inc.

on July 08, 2021. The following is a summary of the agency's

disposition of the petition: The Office issued a Final Order on

the Petition for Declaratory Statement. The Office determined

that if the Petitioner engages in the conduct described in the

Petition, it would be engaging in money transmission.

Petitioner, a licensed money transmitter, is contemplating the

implementation of an electronic “Wallet” application and/or

product that will offer an alternative to customers who are

currently obtaining funds in the form of cash from kiosks on the

casino floor. This application will allow casino patrons to fund

a digital wallet to use when making purchases or engaging in

other transactions at tribal licensed gaming establishments. In

the future, when Petitioner receives funds (monetary value)

from these casino patrons and then transmits the funds

(monetary value) to the customers through their wallets,

Petitioner will be acting as a money transmitter as set forth in

subsection 560.103(23), Florida Statutes. ******The original

petition was published July 12, 2021 in the Florida

Administrative Register Volume 47, Number 133.
