    Chairman Sanders recognized the new Weems Hospital CEO, Mr. Mike Cooper.Mr. Cooper had a short discussion with the Board.

    Department Supervisors ReportHoward Nabors Superintendent of Public Works (9:07 AM)Mr. Nabors had no action items.

    Mr. Nabors stated that Tommy Sadler is back at work.

    Commissioner Parrish commended Mr. Nabors on work done by the Road Department west ofApalachicola.

    Chairman Sanders and Commissioner Massey also complimented the Road Department onwork done in their districts.

    Nikki Millender- Parks & Recreation (9:09 AM)Mrs. Millender had no items.

    Mrs. Millender updated the Board on little league football and cheerleader sign-ups.The Board and Mrs. Millender discussed this matter further.

    Mr. Pierce updated the Board on the soccer field and basketball court projects at D. W. WilsonPark in Apalachicola.

    Dewitt Polous- Mosquito Control (9:11 AM)Mr. Polous asked the Board to consider an increase in salary for Virginia Messer, an employeeat the Road Department, as she provides administrative assistant duties for him at theMosquito Control Dept.

    Commissioner Jackel discussed a list of items regarding changes to the budget, which included a$1,000 increase for Virginia Messer, a $2,500 increase to Nikki Millender, and a $500 bonus forall County employees.The Board and Mr. Polous discussed Scott Tuckers pay and job description. They also discussedMr. Tucker supervising inmates and whether he should receive that pay adjustment.Commissioner Jackel stated that these increases will not affect the proposed millage rate.The Board discussed this matter further.Commissioner Parrish stated that he isnt opposed to the $500 increase for all Countyemployees but he is opposed to the individual pay adjustments.Commissioner Lockley stated that he also objects to the individual pay adjustments.Mrs. Millender discussed her proposed increase.The Board and Mrs. Johnson discussed this matter further.

    Motion by Jackel, seconded by Massey, to approve salary increase of $1,000 for VirginiaMesser, $2,500 for Nikki Millender, & $500 one-time allocation for all County employees;Motion carried 3-2, Lockley and Parrish opposed.

    Motion by Lockley, seconded by Massey, to approve a $1,500 pay adjustment for ClerksFinance Office employees , Clerks Administrative Assistant /Deputy Clerk to the Board andCounty Administrator; Motion carried 5-0.

    Commissioner Jackel, based on a conversation with the Tax Collector, discussed the possibilityof moving the Carrabelle Courthouse Annex from its current location to the old Carrabelle HighSchool location that currently houses City Hall and other offices.

    Chairman Sanders suggested if the Carrabelle Annex moves from the current location, movingthe Parks and Recreation Department into that building and erecting a new fence for securitypurposes at that location.Board discussed further.

    Motion by Jackel, seconded by Massey, directing staff to start the process of looking for spaceand provide figures for moving the Carrabelle Courthouse Annex to the old Carrabelle HighSchool (City of Carrabelle Municipal Complex) and also provide an estimate for a new fence atthe proposed Parks and Recreation Department location; Motion carried 5-0.

    Pam Brownell- Emergency Management (9:38 AM)Mrs. Brownell had no action items.

    Action Items:None

    Mr. Pierce discussed awarding of bid for the retrofit on the EOC building to Garrison Design andConstruction.

    Motion by Parrish, seconded by Massey, to approve awarding bid to Garrison Design andConstruction, for the retrofit on the EOC building; Motion carried 5-0.

    Information Items:1. Pam, Tress, and Jenni participated in the Franklin County Promise Coalition Exercise

    on 08/11/14 at Franklin County School.2. Pam Brownell met with Chad Gunter with One Source Solutions regarding Fuel

    Quality for our backup generator.3. Pam Brownell and Jennifer Daniels met with Jessie Hayes with Dept. of Health

    regarding Special Needs criteria and new brochure.

    Erik Lovestrand- Extension Agent (9:39 AM)Mr. Lovestrand was unable to attend the meeting due to another engagement.

    Anne Birchwell

    Library Director (9:40 AM)Ms. Birchwell presented her report to the Board. She discussed an upcoming meeting at thelibrary with Senator Marco Rubios staff and the many issues that will be discussed at thatmeeting.

    Ms. Birchwell discussed a new partnership program with local restaurants called A Bite for aBook .

    Ms. Birchwell asked for B oard action to authorize the Chairmans signature on a State AidLibrary grant application.Attorney Shuler reviewed and recommended the Chairman s signature on the library grantapplication.

    Motion by Jackel, seconded by Massey , to approve Chairmans signature on the State AidLibrary grant; Motion carried 5-0.

    Shannon Hartsfield Update of Federal Fisheries Disaster Shelling Program (9:45 AM)Mr. Pierce presented this item from his report.

    3- Provide the Board with background on the Federal Fishery Disaster shelling program. Mr.Shannon Hartsfield is on the agenda to provide on update on the application process for thoseseeking to participate in the shelling program. Mr. Hartsfield might have already provided thisinformation. The program could start in late September. The federal funds available, which areapproximately $2.8M for the re-shelling by boat is supposed to be used over a 3 year period,and the purchase of shell material will have to come out of the $2.8M. The re-shelling programwill include work on some of the winter bars but there will still be winter bars open forharvesting.

    The Board and Shannon Hartsfield discussed the re-shelling program further.

    Commissioner Parrish asked that Mr. Hartsfield send the information to the County so it can beadded to the Countys website. He also asked that it is advertised in the local newspaper.

    Commissioner Lockley and Mr. Hartsfield discussed what assistance is available to oystershuckers and those who process shrimp for the shrimp houses.

    Commissioner Jackel asked if the drug tests that are part of the application process can beconducted at Weems. Mr. Hartsfield said he would look into that.

    Recess (10:04 AM)Chairman Sanders called for a recess.

    Reconvene (10:18 AM)Chairman Sanders reconvened the meeting.

    Keith McCarron ARPC Discussion of DOT 5 Year Plan (10:18 AM)Mr. McCarron reviewed the DOT 5 year plan. He discussed prioritizing projects and the startdates of some of the Highway 98 projects. He also explained how the projects are ranked.

    Commissioner Jackel commented on the condition of Highway 98 between Eastpoint andCarrabelle and expressed concerns of the project not being a priority on the plan, especially forthe safety of the residents that use that road.Chairman Sanders expressed her concerns regarding the problems with Highway 98. She stated

    that the worse area is from the Countys School to Yents Bayou.Mr. McCarron stated that he will discuss this matter with the state engineer and ask for aresponse giving an idea of when this project might be started.Commissioner Lockley and other Board members expressed their concerns with the conditionof this road due to safety issues but also because it is an evacuation route for County residents.

    Commissioner Jackel asked why there were no projects for Franklin County in 2017 and 2018.Mr. McCarron wasnt sure but attempted to explain some of the causes.

    Mr. McCarron discussed the SCRAP and the SCOP programs and stated that the County wasnteligible for SCRAP because of the lack of a local gas tax, but didnt advise going after thatprogram because of low funding.Mr. McCarron discussed SCOP funding for the Cities of Apalachicola and Carrabelle.Chairman Sanders and Mr. Pierce discussed this further.Mr. McCarron discussed the trail programs throughout the County.

    Commissioner Lockley asked about the possibility of a four lane highway for Highway 65 or 67.Mr. McCarron responded.Chairman Sanders commented on this matter.

    Advisory Board of Adjustment Consent Agenda (10:43 AM)Mr. Pierce presented the items to the Board.

    1. Approved (ABOA) - a request for a variance to construct a seawall and rip rap revetmentwithin the Critical Habitat Zone on property described as 1527 East Gulf Beach Drive, Lot 6,Tract 50, East End, St. George Island, Franklin County, Florida, as submitted by GarlickEnvironmental Associates, Inc., agent for Bruce Grady, owner.

    2. Approved (ABOA) - the administrative decision to deny a building permit for construction of asingle family dwelling and to disconnect electric service to this lot. This property is described as

    696 East Bayshore Drive, Lot 13, Block 35, Unit 4, St. George Island, Franklin County, Florida. Appeal submitted by John Clark and Diane Wyatt, owners.

    Mr. Pierce asked that this item is tabled until a later date.

    3. Approved (ABOA) - a request for a Special Exception to construct a telecommunication towerand a height variance to construct the 260 self-supporting tower on property described as lyingin Section 23-08S-06W-0000-0010-0010, 1250 US Highway 98,Eastpoint, Franklin County,

    Florida. Request submitted by James Johnston with Shutts & Bowen, LLP, agent for the FranklinCounty School Board.

    This item was addressed earlier in the Meeting.

    4. Approved (ABOA) - a request for a variance to extend an existing rock revetment to the eastwithin the Critical Habitat Zone on property described as 2043 Turpentine Trail, Lot 17, Bay CoveVillage, St. George Island, Franklin County, Florida. Request submitted by Garlick Environmental

    Associates, Inc., agent for Danny & Patricia Hayes, owners. It was noted this was not anextension but a rock revetment to work with a breakwater.

    5. Approved (ABOA) - a request for a variance to construct a seawall and rip rap revetmentwithin the Critical Habitat Zone on property described as 1529 East Gulf Beach Drive, Lot 7,Tract 50, East End, St. George Island, Franklin County, Florida.     Marcia M. Johnson Clerk of Courts Report (10:44 AM)Mrs. Johnson had no report.

    Alan Pierce Director of Administrative Services Report (10:45 AM)Mr. Pierce presented his report to the Board.

    1- Inform the Board that the US Treasury released the Interim Final Rules related to theRESTORE Act on August 15. These rules still have to be published for 30 days and then there is a60 day period after that before they become final. While it is expected that these Interim FinalRules will not change substantially, I believe the publication allows still one more opportunity forsome changes to be made. The Interim Final Rules are 97 pages long and have been providedto the commissioners electronically. Ms. Sarah Bleakley, General Counsel to the GulfConsortium, is reviewing the rules and will be providing her analysis to the Consortium, of whichFranklin County is a member.

    The US Treasury had announced training related to the new rules and the procedure forapplying for funds, but that training was cancelled last month and has not yet been re-

    scheduled.

    Chairman Sanders commented on a recent Consortium meeting she attended in Pensacola.

    2- Inform the Board that the countys CDGB housing rehabilitation project did not get funded.Ms. Debbie Belcher was the grant writer. Another funding cycle will be open in 2015. Ms.Belcher will appear before the Board soon to discuss this application as well as what options theBoard might consider in 2015.

    Ms. Belcher distributed information, which was the same information as last year. Sheexplained that there was nothing wrong with the application but discussed why the Countydidnt receive point s on certain items. She didnt know the cycle for this year because theywere re-writing some rules and recommended re-applying for this project.

    Chairman Sanders asked about the number of points the County received on this project.

    Commissioner Jackel asked for an update on recent or current CDBG grants. Ms. Belcher statedthat there is nothing in the works right now and stated what grant applications were availablefor the County. She stated that there will be a need to appoint new members for the citizenadvisory board task force because of different requirements this year and discussed therequirements for members of the advisory board.

    Commissioner Parrish and Ms. Belcher discussed a project to provide water at the Southlanddevelopment area.

    Commissioner Lockley and Ms. Belcher discussed whether or not the Cities applying for grantswill compete with the County.

    Ms. Belcher discussed further re-applying for the Housing grant. She stated that it is relativelyeasy to get the match because of using SHIP funds.Commissioner Parrish expressed concerns of the income limit requirements for this project.Ms. Belcher explained how the limits are assessed.

    Commissioner Lockley and Ms. Belcher discussed using minority contractors in order to acquireadditional points and whether they have to be within the County.

    4- Board direction on proposed modification to Crystal Air lease at airport. The current leaserequires Crystal Air to pay $5000 per month, and in return Crystal Air has control of all the T-hangers, the main FBO hanger, and the corporate hanger. I have spoken with Mr. TedMosteller and the consensus of the Airport Advisory Committee is that they would like to get thecorporate hanger back. The corporate hanger is a 10,000 square foot hanger with 1500 square feet of office space. At this point, Crystal Air is not regularly utilizing the hanger, but onoccasion does receive some rent if a large plane stays in the hanger overnight. Crystal Air wouldalso like to see a reduction in their lease payments.

    As Airport Manager, my recommen dation is to reduce Crystal Airs monthly lease to$2500 a month effective June 1, and modify the lease to allow Franklin County to give Crystal Air10 days notice on vacating the corporate hanger in the event Franklin County has a use for it.Until the county gives Crystal Air notice, the corporate hanger will continue to be in their leaseand they will continue to pay the utilities for the building. But effective June 1, the county will

    receive the gross proceeds of rent from the corporate hanger plus the $2500 a month baselease.

    If the corporate hanger can be leased out, the use of that one building alone couldgenerate $3K to $5K monthly.

    Board direction.

    Commissioner Jackel and Mr. Pierce discussed the county sharing in the profits from the gassold at the Airport. She expressed concerns with the operation of the FBO.Commissioner Lockley stated that he didnt have any confidence in the FBO. He stated that Mr.Newman isnt here enough to run the FBO successfully.Commissioner Jackel expressed concerns with AVCON, the Airport engineering firm. She wasopposed to reducing the lease, especially without gas profit sharing.Chairman Sanders commented on this matter.The Board discussed Airport operations and the status of the current FBO.

    Motion by Lockley, seconded by Jackel, to not take the recommendation as presented by Mr.Pierce and consider starting the process to get a new engineer; Motion carried 5-0.

    Mr. Pierce stated that parking is becoming a problem at the Courthouse so he is going todesignate parking spaces with signage.Mrs. Johnson mentioned the resolution that has been adopted by the Board concerning

    employee parking. She also stated that a local business is using the Courthouse parking area,which is causing parking issues for Courthouse visitors.Commissioner Parrish stated there is a parking problem for the County Judge also.Attorney Shuler stated that he will get with Mr. Pierce to seek a resolution to this problem.

    Chairman Sanders and Mr. Pierce discussed the progress on the audit for the Senior Citizen s Center.

    Franklin County Extension Activities August 29 September 11, 2014

    UF/IFAS Extension Faculty have been involved in the following Extension activities during this period.

    General Extension Activities: Extension staff has assisted County residents by providing information and expertise in the areas of plant

    identification, control of nutsedge, and injured wildlife. Extension office staff participated in webinar with Horticulture team regarding upcoming Fall Gardening

    seminar series that will take place on September 9, 16, and 23 at the Extension office. Extension Director met with District Extension Director regarding 2014-15 Plan of Work and Report of

    Accomplishments. Extension Director participated in Fall County Extension Directors meeting wit h all CEDs from the NW

    District.

    Sea Grant Extension Extension Director involved in contacts and planning for dialogue session between local stakeholders in the

    oyster industry and the various agencies and entities working on oyster recovery related activities. Extension Director travelled to the Gulf and South Atlantic States Shellfish Sanitation Conference at the Duke

    University Marine Lab. Brief highlights of the conference will be shared at this meeting.

    4-H Youth and Volunteer Development:

    Horticulture: Extension Program Assistant worked with Wakulla Extension Director and provided session 1 of the 3-

    part Fall Gardening Seminar Series at the Franklin County Extension Office.

    Agriculture: Extension Director met with the NW District Natural Resources Program team to prepare exhibit for

    Sunbelt Agricultural Expo. That UF participates in each year in Moultrie, GA to highlight FloridaExtension activities. Exhibit will focus on coastal friendly living in the Florida Panhandle. This is thelargest exposition of this type in the SE U.S.

    Franklin County Tourist Development Council

    MEMOTO: Franklin County Board of County CommissionersDATE: September 12, 2014SUBJECT: Visitor Center Contracts

    Commissioners:

    Attached are copies of the contracts for operating the countys Visitor Center s. There are four contractsthis year. Three are with the same groups as last year, the two Chambers of Commerce and theApalachicola Maritime Museum. The fourth contract is with Allyn LLC to operate the Eastpoint VisitorCenter.

    The TDC Board has reviewed all of the agreements and recommend their approval. 2014-15 will be thefirst year that the Eastpoint Visitor Center will be operational. The County has invested a lot to preparethe building and we look forward to getting it operational shortly.

    In a motion by Beverly Hewitt, seconded by Frank Cook, the TDC Board unanimously approved theattached four contracts and recommended that the current administrator for the TDC take on themanagement and operation of the visitor center as well as current TDC Administrative duties. Webelieve that combining the two entities will insure the success of both.

    FRANKLIN COUNTY TOURIST DEVELOPMENT COUNCILVISITOR CENTER AND INFORMATION SERVICES CONTRACT

    Effective October 1, 2014, this Contract is entered into by the Franklin County TouristDevelopment Council (hereafter known as FCTDC) with the Carrabelle Area Chamber ofCommerce.

    As Manager, the Carrabelle Area Chamber of Commerce, agrees to staff and manage theFCTDC Visitor Center in Carrabelle, Florida and agrees to provide tourist information to allemail, mail, telephone, or walk-in inquiries that request information.

    In consideration of all duties specified in this Contract, the Franklin County Tourist DevelopmentCouncil will fund the Visitor Center $35,000 per year, payable in advance quarterly installments,upon the execution of this contract and completion of terms listed below.

    1. Contract Term: October 1, 2014 to September 30, 2015.2. Signage: The Visitor Center will display an appropriate standard image sign which

    will contain the words Visitor Center in letters not smaller than four (4) inche s inheight, the international information symbol, and the FCTDC logo not smaller thansix (6) inches by twelve (12) inches, and must be approved prior to installation by theFCTDC.

    3. Hours of operation: The Visitor Center agrees to staff and manage to operate aminimum of forty (40) flexible hours six days per week. The Visitor Center will post adisplay of operational hours, will adhere to the posted hours, and will staff the Centeras posted. The Visitor Center will assign its own specified hours of operation,

    depending on the areas most significant tourism traffic. The schedule must beapproved by the FCTDC. It is the intent to provide information to visitors in a timelymanner.

    4. Inquiries: The Visitor Center will respond by providing a FCTDC standardizedbrochure and to any other specific inquiry requests for delivery by emails, mail,telephone, and walk-ins. The FCTDC reserves the right to provide additionalstandardized information to the Visitor Center for distribution.

    5. Reporting: The Manager will provide a monthly report to the FCTDC with any tourismrequests resulting from all emails, mail, telephone, and walk-ins. Entries must belisted on the official FCTDC sign-in sheets. This information will be due at the FCTDC

    Administrative Office no later than the 10 th of each month.

    6. Display: The Visitor Center will provide a standardized display in cooperation with theFCTDC. The FCTDC reserves the right to create and provide additional displays tothe Visitor Center.

    7. Website: The Visitor Center will place the current FCTDC logo on the home page ofthe organizations official website as well as provide a link to the FCTDC website,www.saltyflorida.com.

    8. Insurance: The Visitor Center will provide the FCTDC with a certificate of Insurancewith minimum liability limits of $300,000 combined single limit, and must nameFranklin County as an additional insured.

    9. Disputes: Payments will be withheld, until any disputes are resolved, for failure tocomply with any contractual agreements. Visitor Center Managers will receive anotice to correct any problem associated with the provisions herein from the FCTDC.

    Effective October 1, 2014, this Contract is entered into by the Franklin County TouristDevelopment Council (hereafter known as FCTDC) with the Apalachicola Maritime Museum.

    As Manager, the Apalachicola Maritime Museum, agrees to staff and manage the FCTDCVisitor Center on St. George Island and agrees to provide tourist information to all email, mail,telephone, or walk-in inquiries that request information.

    In consideration of all duties specified in this Contract, the Franklin County Tourist DevelopmentCouncil will fund the Visitor Center $35,000 per year, payable in advance quarterly installments,upon the execution of this contract and completion of terms listed below.

    1. Contract Term: October 1, 2014 to September 30, 2015.2. Signage: The Visitor Center will display an appropriate standard image sign whichwill contain the words Visitor Center in letters not smaller than four (4) inches inheight, th e international information symbol, and the FCTDC logo not smaller thansix (6) inches by twelve (12) inches, and must be approved prior to installation by theFCTDC.

    3. Hours of operation: The Visitor Center agrees to staff and manage to operate aminimum of forty (40) flexible hours six days per week.     1- Provide Board with plaque sent form the DAV on behalf of the donation the countymade to purchase the new DAV van.

    2- Inform Board that Franklin Countys Legislative Delegation meeting wil l be onMonday, Sept. 29 at 7 PM. Our delegation is meeting in Gulf County at 5 PM and thenwill come here to the county commission meeting room.

    3- Provide Board with copy of contract for services for designing the Bluff Road BoxCulvert. I need to put the contract in the record which is why I am mentioning it.

    4- Inform the Board that the new manager of the Apalachicola National EstuarineResearch Reserve (ANERR) has been selected, and it is Ms. Jenna Harper. She has beenemployed at the Reserve in several capacities for the last 12 years. She took over from

    Lee Edmiston who has retired. Ms. Harper might still be in the audience.5- Inform the Board that Ms. Betty Webb is stepping down from her position as FranklinCounty representative on the Riparian County Stakeholders Coalition. I believe theCoalition only meets quarterly, but at some point the Board will need to name areplacement.

    6- Inform the Board that I have engaged Mr. Paul Cureton to provide a market appraisalfor the Superior Bank building in Carrabelle. After receiving the appraisal, the Boardwill need to decide whether it wants to make an offer for the building as a permanent siteof the Franklin County Courthouse Annex in Carrabelle.

    7- Board action to approve change order for Poloronis Construction to close out the EastApron Drainage Project at the airport.

    8- Inform the Board that the US Coast Guard is having a meeting on Oct. 8 to review anychanges to the Area Contingency Plan. Pam Brownell, EM Director, has a conflict andhas asked me to attend. Neither she nor I know of any changes being proposed to theArea Contingency Plan, but since is the plan that the Coast Guard will use in the event ofanother oil spill we believe the county should be represented at the meeting.

    9- Present Board with a draft ordinance prohibiting roofs on detached structures seawardof the Coastal Construction Control Line (CCCL) on the west end of Alligator Point. Theneed for this ordinance arose from a decision DEP made in allowing beach viewing

    platforms on Alligator Point seaward of previous structures. The neighbors areconcerned that if DEP were to allow a roof over this structure, or any future structuresthat DEP might permit seaward of the CCCL, that it will have a greater chance of

    becoming airborne during a storm and causing damage. This part of Alligator Point hasan extremely flat beach and is very vulnerable to storm events.

    Board action to have Mr. Shuler review the ordinance and set a public hearing.

    10- At the last meeting, the Board asked staff to contact various public officials to putthem on notice of the need for assistance if the winter oyster harvesting season continuesto be poor. On Thursday, September 11, 2014, Mr. Nick Wiley, Executive Director ofthe FWC, was quoted in the Tallahassee Democrat saying that it was possible that the

    Bay would be closed to oyster harvesting for up to 2 years if the Bay can not recover. Ihave spoken to other representative at FWC, and Governor Scotts chief policy advisorfor environme ntal issues. At this time there is no plan to close the Bay. Mr. Wileyscomments were that closing the Bay will have to be looked at if the current emergencyoyster harvesting rules, which is 5 bags and a 4 day week, are not effective in helping the

    bars recover. Mr. Jim Estes, FWC, would like the Board to know that FWC is aware ofthe poor conditions in the Bay and is actively working will all parties to try and reach aconsensus on what needs to be done.

    The SMARRT group and the Univ. of Florida have called for a public meeting onOct. 1, from 1 to 4 PM, and the Apalachicola Community Center for more discussion onthis issue.
