I am employed as aColIection Associate for the Royal Bank of Canada and assuch have a personal knowledge of the matters herein deposed to except where o~erwise stated.2. [have confirmed by checking the records of the Royal Bank of Canada and bydiscussions with the solicitor for the Royal Bank of Canada George H. LeBlanc, and do verilybelieve as follows: .

a) Betty Rose Danielski became owner of the property located :at29 MarshallStreet, Fredericton, New Brunswick. (the "Property") pursuant to a Deeddated October 24th, 2000, registered in the York County Registry Officeon October 31". 2000, as Official Number 11490051, in B

c) Andre Murray filed a Claim for Lien against the Property by way of aClaim for Lien registered April 16

th, 2009, in the York County RegistryOffice as Official Number 27035311, a copy of which is annexed heretoand marked "C".

d) The Mortgage fell into default and a Notice of Mortgage Sale was issuedby the Royal Bank of Canada on or about June 31 1 1 ,2009, a copy of whichis annexed hereto and marked "0',e) A copy of the Notice of Mortgage Sale was sent to the Mortgagor, BettyRose Danielski by registered and regular mail, by letter dated June SIb,

2009. a copy of which is annexed hereto and marked "E".t) A copy of the Notice of Mortgage Sale was sent to Andre Murray byregistered mail, by letter dated June 51\ 2009, a copy of which is annexedhereto and marked "F".g) The Mortgage Sale took place on July 16th , 2009, at which time theproperty was sold to Hugh Cameron, Barrister & Solicitor in Trust.Attached hereto and marked "G", is a copy of the Certificate of Sale by

SueHen Ross, auctioneer. confirming same.h) Attached hereto and marked'r'H" is a copy of the Bidding Papers andTerms of Sale signed by solicitor George H. LeBlanc, as solicitor for theMortgagor, Royal Bank. of Canada, and also signed by Hugh Cameron intrust as purchaser of the property.

3. I am advised by George H. LeBlanc and do verily believe that the closing of thesubject property has been postponed pending vacant possession of the property, and particularlythe vacating of the property by Andre Murray and/or any other persons residing there.4. I am advised by George H. LeBlanc as solicitor for the Royal Bank of Canada anddo verily believe that the mortgage sale took place on July 16th, 2009 at 11:00 a.m. and that tothe best of his knowledge and belief all ofthe requirements of the Power of Sale contained in theProperty Act and the Mortgage were complied with.5. Attached hereto and marked "I" is a copy of the Affidavit of Service of Hugh K.Cameron dated July z o " , 2009, whereby he advises that he served A n d r e Murray with a Noticeto Vacate on July 161 il , 2009, by leaving a copy at the Property.

6. I am advised by George H. LeBlanc, solicitor for the Royal Bank of Canada anddo verily believe that Andre Murray has confirmed to him that he received the said Notice toVacate, although he claims to have received it a few days later.7. [ am advised by George H. LeBlanc and do verily believe that he has haddiscussions with Andre Murray whereby Mr. Murray requested more time to vacate the property,however, that Mr. Murray now denies same and has refused to vacate the property.8. Attached hereto and marked "1" is a copy of an e-mail from George H. LeBlanc toAndre Murrar wherein he confirms ~r. Murray's request for .anextension to vacate the propertyto August 15 ,2009, and that RBe IS agreeable to same-provided that Mr. Murray confirms thathe will vacate the Property on or before that date, and other comments.9. Attached hereto and marked "K" is a copy of a further e-mail sent by George H.LeBlanc to Andre Murray on July 27m, 2009, requesting confirmation of the agreement to vacate.10. Attached hereto and marked "L" is a copy of a further e-mail sent by George H.LeBlanc to Andre Murray on July 29th, 2009, confirming that RBe will require that the propertybe vacated by July 31~'.2009, pursuant to the Notice served on July 16th, 2009, as a result of thefailure to confirm the agreement to vacate.II. Attached hereto and marked "M" is a copy of an e-mail received by George H.LeBlanc from Andre Murray on August 4lb, 2009. in which he seems to deny his agreement tovacate the property, claims that he never requested an extension to vacate and claims that he hasa long term lease tor the subject property.12. Attached hereto and marked "N" is a copy of a reply from Mr. George H.LeBlanc to Mr. Murray dated August lIlli, 2009, in response to same.13. With respect to the request for an appraisal, Royal Bank of Canada was unable toget an appraiser to go to the property without a police escort, due to safety concerns. Attachedhereto and marked "0" is a copy of an e-mail from Andreen Tranchell, Royal Lef'age (Pr~ertyMangers for the Royal Bank of Canada). to myself and George H. Lefslanc, dated July 23 .2009. confirming same.

14. I am further advised by George H. LeBlanc and do verily believe that Mr. Murrayclaims to have a Lease to the subject property, however. has refused or neglected to provide acopy to George H. LeBlanc despite requests fo r same.
