AIMS

To discuss the MLC,2006 requirements associated with:• medical care on board ship and ashore;• shipowners liability;• health and safety protection and accident prevention;• access to shore based welfare facilities; and• Social security.

MEDICAL CARE ON BOARD SHIP AND ASHORE(Regulation 4.1, Standard A4.1, Guideline B4.1)

Purpose:– To protect the health of seafarers and ensure their

prompt access to medical care on board ship and ashore.

Basic requirements

• Health protection and medical care• Standard medical report form• Hospital & medical care facilities on board• Medicine chest; medical equipment and guide• Qualified medical doctor (ships with 100+ persons &

ordinarily engaged in international voyages of 3+ days).

• Medical assistance (on shore) to other ships.

Basic requirements

• Seafarers permitted to go ashore for treatment

• Cost of medical care to be met by shipowner

DMLC – PART II

This section should cover:• The provision of on board medical care including

the medical chest and who is responsible for maintaining same.

• Who is responsible for providing on board medical care.

• Confirmation that the person(s) responsible for providing on board medical care is trained (including refresher training).

SHIPOWNERS’ LIABILITY(Regulation 4.2, Standard A4.2, Guideline B4.2)

Purpose: – To ensure that seafarers are protected from the

financial consequences of sickness, injury or death occurring in connection with their employment

SEAFARER COMPENSATION(Regulation 2.6, Standard A2.6, Guideline B2.6)

Purpose: – To ensure that seafarers are protected from the

financial consequences of sickness, injury or death occurring in connection with their employment

Basic requirements

• When does this liability arise?• Financial security for death or long-term disability• Period during which medical expenses must be

covered• Burial expenses• Payment of wages during sick leave• Exemption clauses• Safeguarding property

HEALTH AND SAFETY PROTECTION AND ACCIDENT PREVENTION

(Regulation 4.3, Standard A4.3, Guideline B4.3)

Purpose: To ensure that seafarers’ work environment on board ships promotes occupational safety and health.

Basic requirements• On-board policy & programme to promote OSH and

prevent accidents, injuries & diseases; prevention or reduction of exposure; continuous improvement; risk evaluation; training; preventative measures; inspection for unsafe conditions

• Regard for international instruments; safety culture on board; special attention for the under-18s; safety committee where ship has 5+ seafarers

• Investigation and reporting of occupational accidents, injuries, diseases and identified hazards; protection of seafarers’ personal data

• Warning seafarers of particular hazards

DMLC – PART IIThe following should be included: • If a ship has 5 or more seafarers then a safety committee is required. The

composition of the safety committee and the frequency of meetings together with the responsibilities of the master, safety officer and safety representatives.

• Details of the on board programmes for the prevention of occupational accidents, injuries and diseases and for continuous improvement in occupational health and safety.

• Details of the adoption, the effective implementation and promotion of occupational safety and health policies and programmes.

• The procedure for generating risk assessments (including those for young seafarers) and how frequently they are reviewed.

• The precautions taken to prevent occupational accidents, injuries and diseases.• The procedure for investigating, reporting and correcting unsafe conditions.• The procedure for investigating, reporting on board occupational accidents.• Details of the type of work that seafarers under the age of 18 are prohibited from

undertaking.

ACCESS TO SHORE-BASED WELFARE FACILITIES

(Regulation 4.4, Standard A4.4, Guideline B4.4)

Purpose: Purpose:

– To ensure that seafarers working on board a ship have access to shore-based facilities and services to secure their health and well-being

SOCIAL SECURITY(Regulation 4.5, Standard A4.5, Guideline B4.5)

Purpose: Purpose:

– To ensure that measures are taken with a view to providing seafarers with access to social security protection
