NORTHEAST OHIOREGIONAL SEWERDISTRICT

The Northeast Ohio Regional Sewer District entered into a consent decree withthe United States and Ohio Environmental Protection Agencies and the UnitedStates Department of Justice in 2011 to implement, within a 25 year time limit,a long term control plan to control combined sewer overflows (CSO) currentlyimpacting Lake Erie and its tributary streams. ORC was hired under an“Indefinite Delivery/Indefinite Quantity” (IDIQ) basis to provide right-of-wayservices. To date, ORC has provided project management, title research,appraisal, acquisition, closings and relocation services to more than 150impacted parcels. Assignments made to ORC through this contract include:

• East 140th Street Consolidation and Relief Sewer for Scioto & Page Basin;

• Cascades Project;

• Superior Pump Station;

• Stones Levee Pump Station;

• Dugway Storage Tunnel;

• Westerly Low Level Interceptor;

METROPOLITANSEWER DISTRICT OFGREATER CINCINNATI

• ORC was hired by the Metropolitan Sewer District of Greater Cincinnati toprovide acquisition services, relocation services and QA/QC for the entire LickRun Project. There were 91 acquisition parcels and 92 relocation parcels thathad been reviewed with recommendations provided. ORC providedacquisition and relocation services on the remaining active parcels.

• Also Associated with the Lick Run Project, the Sewer District hired ORC toprovide relocation services for one residence on behalf of the District. Theproject was necessitated by the potential of sewer water backing up into thestructure. The District performed the acquisition, and ORC provided relocationbenefits on a voluntary basis, which included replacement housing payments,increased interest, and incidental expenses for an owner occupant.

• Additionally, the City of Cincinnati contracted ORC to provide on-call taskrelated appraisal services for the City of Cincinnati’s Engineering andMetropolitan Sewer District Divisions. The West Fork Road Flood MitigationProject included the total acquisition of 22 single and multi-family dwellings.

• In additional to flood mitigation projects, our Southern Ohio appraisal staffhas been working with the Metropolitan Sewer District of Greater Cincinnatiassisting in the development and upgrade to the Hamilton County SanitarySewer System. Our appraisers have been involved in several MSD projects,including the Queen City /Cora Sewer Separation Project at Lick Run, Legendsof Carpenter Run, Houston Road, Dry Run Area Sewer Project along RoundBottom Road, as well as two pump station elimination projects at Huntingtonand Green Pine Acres Pump Station Elimination projects. In total, ORC’sappraisal staff has prepared appraisals to assist in the acquisition of over 100parcels for the Cincinnati MSD.

• The City of Cincinnati hired ORC to perform full acquisition appraisals for 9single family dwellings located along the south side of Rapid Run Road inDelhi Township, OH. The acquisitions are voluntary and a result of DelhiTownship being awarded a Federal Pre-Disaster Mitigation Grant from theOhio Emergency Management Agency.

ORC was award our first on-call contract in 2001 with the Metropolitan St.Louis Sewer District (MSD), and we have since been awarded multipleadditional on-call contracts. In this time, ORC has acquired over 400improved properties on more than 20 different projects, with approximately90% of those properties requiring relocation. In order to ensure a uniformapproach to each of the projects and maintain the possibility of qualifying forFederal Funds in the future, all of the projects were completed under theguidance of 49 CFR Part 24 – Uniform Relocation Assistance and RealProperty Acquisition for Federal and Federally Assisted Programs.

In the past, properties were acquired due to basement back-ups and overlandflooding. MSD determined the most effective means of handling this situationwas to purchase the properties and relocate any occupants. In manyinstances, retention basins were constructed to alleviate flooding insurrounding areas. ORC continues to work on similar projects plus acquiringproperties needed for additional pump stations and tunnels for MSD’s newsewer system.

ORC’s role on these projects has included attending public meetings, projectmanagement, title research, appraisals, appraisal reviews, acquisitions,coordination of closings, relocation assistance and regular project updateswith MSD.

ORC has received accolades from both the client and the public for theservices that have been provided over the past decade.

A separate on-call contract was awarded, in 2012 – when a consent decreebetween MSD, the State of Missouri, and the United States EnvironmentalProtection Agency (EPA) was established - to provide services to acquireeasements. The consent decree requires MSD to address the issues ofoverflows and other sewer systems concerns and outlines a strict timeline forMSD to resolve the issues. As corrective measures are designed, they oftenrequire the acquisition of permanent and temporary easements toaccommodate the improvements. ORC is supplementing the MSD right-of-waystaff to assist in acquiring these easements in a timely manner. Whencompleted, it is anticipated that ORC will acquire easements from more than300 individual property owners.

PUBLIC WATERSUPPLY DISTRICT NO. 2

ORC began its relationship with the Public Water Supply District No. 2 of St.Charles County, MO in 2007. Since that time ORC has worked on more than 30projects and acquired easements from more than 130 property owners for theDistrict.

PWSD No. 2 has grown from a small, rural water district at its inception to thelargest water district in the State of Missouri, serving a population of about 75,000people. Some growth is attributed to acquisitions of other utilities, but most comesfrom the addition of customers new to the current service area of over 400 squaremiles. This area includes the communities of Lake St. Louis, Defiance, New Melle,Augusta, Dardenne Prairie, Dutzow, and parts of O’Fallon, Weldon Spring,Innsbrook, and unincorporated St. Charles and Warren Counties. Due to thispopulation growth, PWSD has had a need for service expansion. It began theaddition of new water and sewer mains while focusing improvement on existing ones.

ORC has provided the District with real estate services for 30 water and sewerimprovement projects.

Typically ORC’s role for the District involvesresearching ownership, preparing valuations,negotiating for the purchase of the easementsand closing the transactions. When necessary,ORC also provides condemnation support bypreparing files and exhibits as well as expertwitness testimony.

In addition to acquiring easements, ORC hasassisted the District in other tasks. These include:

• Preparing right of way cost estimates

• Project route discussions with property owners

• Public hearing participation

• Route ownership research

TAMPA BAY WATER AUTHORITY –TAMPA BYPASS CANAL WATERPROJECT

The Tampa Bypass Canal (TBC) is a 14-mile waterway thatconnects the Lower Hillsborough Wilderness Preserve withMcKay Bay. The canal provides flood protection for thecities of Temple Terrace and Tampa by divertingfloodwaters from the Hillsborough River. The canal is alsoa water supply source for the city of Tampa. As asubconsultant to the design firm Camp Dresser McKee(CDM), ORC acquired permanent easements to facilitatethe construction of a water pipeline for the By-Pass Canal.The ORC Team also reviewed title certifications,maintained files, and participated in high-level meetingswith Tampa Bay Water and the engineers of CDM. The By-Pass project affected several neighboring Tampa Baycommunities.

NORTHERN KENTUCKY SANITATIONDISTRICT #1 (FORT WRIGHT, KY)

In 2014, ORC’s Appraisal Team prepared appraisals forsewer easements on 46 properties in connection with theVernon Lane Sewer Improvement Project in Fort Thomas,KY. The sanitary sewers in this historic neighborhood hadbeen in place for 100+ years and needed to be replaced.ORC worked closely with SD1 to determine thecompensation for these easements with consideration givento the prescriptive easements that have existed fordecades, but lack formal documentation. SD1 requestedthat the appraisals for nearly 20 of the properties beupdated to reflect plan changes that were made toaccommodate property owner requests and to minimizethe impact to various parcels.

ORC also provided acquisition services for sewereasement on 34 properties in connection with the VernonLane Sewer Improvement Project. These parcels were invarious stages of the acquisition process when ORC tookover the project from SD1 staff in order to complete theacquisition process in a timely manner.

Lastly, ORC provided acquisition services for a sewereasement for 1 parcel on Vulcan Drive in Kenton County,KY. This project, funded through a CommunityDevelopment Block Grant, connected two existing sanitarysewer systems in an industrial area.

CSO – OHIO CANAL TUNNELINTERCEPTOR (AKRON, OH)Through a $300,000 on-call contract with the City of Akron,ORC was hired to provide relocation services for fivebusinesses and nine residential properties that were locatedin downtown Akron, OH. The purpose of the project is toreduce combined sewer overflow (CSO) from discharginginto the Cuyahoga River, Little Cuyahoga River and theOhio Canal, thereby improving water quality. The Cityperformed acquisition services, and ORC providedrelocation benefits which included applicabledeterminations, replacement housing payments, andbusiness relocation benefits. Assignments made to ORCthrough this contract include:

• Task Order # 1 – 8 residential and3 commercial relocations

• Task Order # 3 – 1 residential relocation• Task Order # 4 – 2 commercial relocations• Task Order # 5 – 5 residential and

1 commercial relocation

CUYAHOGA COUNTY DEPARTMENTOF PUBLIC WORKS (CCDPW)ORC has secured 4 consecutive General Right-of-WayServices agreements with the Department of Public Works.Assignments made to ORC through this contract include:

CITY OF SPRINGFIELD(SPRINGFIELD, OH)ORC was hired by the City of Springfield to provideappraisal services for the following sponsored project.

• Erie Express Sewer Line Project – 31 appraisals

SUMMIT COUNTY DEPARTMENT OFENVIRONMENTAL SERVICES(AKRON, OH)ORC was contracted to perform ROW services for 5 parcelsfor the Clinton Sanitary Sewer Project Q-832. This projectwill install a vacuum-type sanitary sewer to replace thefailing septic systems.

EAST END SEWER IMPROVEMENTS(SANDUSKY, OH)The City of Sandusky hired ORC to perform full turnkey RWservices for the acquisition of 13 parcels for the East EndSewer Improvement project. ORC provided title research,appraisal, acquisition, closing and project management.
