the date in NOC application sent for grant of No Objection Certificate to
the wrong State Competent Authority i.e. Director/ Deputy Director Uttar
Pradesh Minority Welfare Deptt, Lucknow, Uttar Pradesh instead of
Additional Chief Secretary, Department of Higher Education, Government
of Uttar Pradesh, Bahu Khandi, Secretariat, Lucknow, Uttar Pradesh -
226001, which was received by an unknown person by hand on
15.09.2020 and affixed the seal of Minority Welfare Department, Uttar
Pradesh but there is no name and designation of the receiver of this
application. The said petition is still pending. The petitioner has waited
sufficiently for a period of 90 days, before filing this petition.
After perusal of the office report we found that office has not
reported properly in this case.
It transpires from the petition that this application has filed by Mohd.
Sarwar Manager of Unity Education & Welfare Society without any power
of attorney.
This Commission has issued public notice on dated 20.01.2020 that
in order to streamline the process of filing application for grant of Minority
Status Certificate, it has been decided that the same person should sign
the Declaration, Affidavit and Vakalatnama and who can be the following:
1. Individual – Owner
2. Society – Chairman / President / Secretary
3. Trust – Trustee / Authorized signatory as per resolution.

Petitioner has also not filed the envelope with postage charges for
sending notice to the respondents. Hence this application is not
maintainable at this stage.
Keeping in view the above mentioned facts, the cognizance cannot
be taken of this application; accordingly, the petition is deserve to be
rejected. Liberty is given to the petitioner to file the fresh petition, if he
desires to do so. Accordingly, the petition is disposed of.
Office is directed to notify this order to the petitioner.
