Triangular Cooperation is a mechanism aimed at bridging cooperation between different countries in order to establi-sh strategic alliances on issues of common interest. To promote this mechanism, the German Government has created a specific fund to attend the demands of countries in which it cooperates, in accordance to the interests agreed upon by at least two countries. This is how the Cooperation Project between EITI Peru and EITI Guatema-la emerges, focused on exchanging experiences that relate to the implementation of the Extractive Industries Transparency Initiative -EITI-.

Extractive industries in Peru and Guatemala are of great importance. Globally, Peru is a multi-metallic country: it is the second largest copper reserve in the world, one of the main producers of gold (6th), silver (3rd), copper (3rd) and other metals, and it is 7th place in mining in the world. On the other hand, Guatemala is a country with mining poten-tial; because of its geographic location, it has mineral wealth in metallic minerals (gold, silver, zinc, copper, etc.) and non-metallic (mica, limestone, serpentine, jade, among others).

The EITI Initiative is a world standard in promoting a trans-parent management and responsibility of natural resour-ces. It seeks to strengthen government and business systems, contributing to public debate, and increasing trust. The initiative is supported by each country and supported by a coalition of State, businesses and the civil society working in collaboration. Currently, Peru and Guatemala are the only countries in Latin America that have been declared as “compliant countries” within the 51 that are part of the Initiative. In 2012, Peru was declared a compliant country, time since it has been able to generate experiences and good practices in the EITI Initiative implementation. Sharing its experience and good practi-ces with Guatemala allows both countries to strengthen their capacities and improve the initiative’s implementa-tion.

This project was implemented, amongst other purposes, because Peru and Guatemala need to stay in compliance with the EITI standard to maintain their status as compliant countries and to achieve governance of natural resources of the mining and oil sectors with the active participation of the three sectors. Being the initiative’s first compliant country in the region, Peru has had to face challenges that are common to other member countries in the initiative; therefore, it is fitting to draw upon its experience in benefit of other countries. For its part, Guatemala was interested in this project as it needed to strengthen the organizational and operational capacities of the EITI secretariat in order to meet the demands of the EITI standard. Likewise, the National Work Commission – CNT (for it’s Spanish initials) – as a multi-stakeholder space, needed to strengthen the dialogue between sectors, due to the social unrest gene-rated by the subject. The population demands real, accu-rate and comprehensible information about the processes related to the sector: to understand how much companies pay, how those funds are invested in the State (Central and Local Governments) and how the sector contributes to the country’s development, amongst other things.

Considering the above, EITI Guatemala and EITI Peru jointly implemented - with the technical support from GIZ - a work plan for developing processes and activities for improving the implementation of the initiative. The metho-dology was based in meetings (workshops and conferen-ces) between tech crews and the representatives of the three sectors (The State, Civil Society and Private Sector) of each country. Electronic means were also used to facilitate exchange and to take the greatest advantage of Peru’s experience, using this knowledge to improve EITI Guatemala’s operations.

In this document, a systematization of said experience is presented, with the objective of generating knowledge that can be used to improve the initiative’s implementation in both countries, maintain the exchange and communica-tion, and support other countries interested in EITI for their own implementation processes.

EITI PerúThanks to the leadership of its Ministry of Energy and Mining, Perú joined the EITI initiative in 2005, and the first instance of a so-called “Work Commission” was formed as a way to implement the initiative (by S.D. Nº 027-2006-EM). Peru submitted its candidacy to the International EITI Council in 2007. In February 2012, the EITI Council declared Peru a ‘compliant country’, making it the first in the American continent to reach such status. In 2011, through S.D. Nº 028-2011-EM, the Permanent Multi-stakeholder Commission for the Extractive Industries Transparency in Peru was formed. This Commission established roles in a definite way, putting an end to the role of the Work Commission.

EITI GuatemalaIn 2010, the Guatemalan Government, through the Vice-Presidency of the Republic, manifests its interest in joining the Extractive Industries Transparency Initiative (EITI), presenting its candidacy on February 10, 2011. The EITI International Board approved Guatemala’s nomina-tion at the 5th Global EITI Conference in Paris on March 1st, 2011. On May 10, 2012, the Governmental Agreement 96-2012 was published, with which the National Work Commission is created for the Implementation of the Extractive Industries Transparency Initiative (EITI). On March 214, the EITI International Board declared Guate-mala a “compliant country”.

In order to contextualize the experience generated by this project, it is necessary to begin by explaining what triangular cooperation is from the perspective of the Regional Fund for Triangular Cooperation in Latin America and the Caribbean of GIZ. “Triangular cooperations are cooperation projects which are planned, financed and executed in conjunction by an established DAC donor -an industrialized country who is member of the Development Assistance Committee (DAC) of the Organization for Economic Co-operation and Development (OECD)-, an emerging country that may act as a South donor or benefi-ciary country, and a third recipient country being the beneficiary. In practice, German cooperation for develop-ment also recognizes other multiple configurations as triangular cooperation. The partners’ complementary advantages contribute an aggregated value to triangular cooperation in bilateral projects. They bridge the gap between North-South and South-South cooperation and serve as an instrument for establishing strategic alliances that can jointly resolve global challenges. On an internatio-nal level, the interest in triangular cooperation has increa-sed significantly. This is also reflected in the 2030 Agenda for Sustainable Development. With the Regional Fund for Triangular Cooperation, the German Government contri-butes to making the most of the potential of this efficient instrument.1

With regards to the “Transparency in Extractive Industries: Peru - Guatemala - Germany” project, the idea to conduct this triangular cooperation exercise arises in July 2014, the Technical Secretaries for EITI-Guatemala (EITI-

GUA) and EITI-Peru (EITI-PER) get in touch, motivated by EITI-GUA’s interest in celebrating an exchange between both countries to share their experiences and best practi-ces in the implementation of the Initiative; them being the only two countries in Latin America that were qualified as compliant countries by the EITI standard. In October 2014, in a meeting between EITI-PER and the German Coopera-tion (implemented by GIZ) in Perú, EITI-PER expressed its interest in responding to EITI-GUA’s request to exchange experiences, knowledge and good practices with respects to a triangular project between Peru, Guatemala and Germany for strengthening the processes of imple-mentation of the initiative in Guatemala.

In March 2015, an exploration mission was conducted in Guatemala with the participation of all represented sectors of EITI Guatemala and Peru, to define, as precisely as possible, the subject areas in which cooperation and support were possible for strengthening the EITI imple-mentation in Guatemala. In this sense, the main EITI-GUA demand was acknowledged as the strengthening in its immediate processes in order to comply with the EITI standard and improve the organization of the ECI, ensu-ring its member’s participation in an equitable and coordi-nated manner.

In order to clearly establish the processes that were to be implemented, multi-stakeholder groups from both countries participated in workshops for planning and for monitoring advancement, which provided insight and feedback for planning. Eventually, the working framework was established based on the following results:

4.1 Important elements

A fundamental aspect of the project was to hold meetings for exchange regarding the implementation of the EITI initiative (besides the planning and monitoring encoun-ters). In said encounters, both countries coordinated and finalized contents. Because of the methodology of work

It is deemed necessary for the development of the new Governmental agreement (in the legal framework of EITI Guatemala) to incorporate in the modifications that the CNT will be of permanent nature. The decisions made by the CNT must guarantee equality in participation and conditions of the three sectors.Review of the CNT regulation proposal with the three sectors to reach a final product, as a result of consensus. It is neces-sary to improve design aspects of the proposal, observing a greater governance framework.

In order for the CNT to work, the requirements are: • Commitment (the people represented have to assist and arrive prepared to address the issues), • Generate conditions for dialogue, • Flexibility (in reaching consensus). In order for decisions to be sustainable, consensus must be reached in the three sectors, which is not always achieved, however it is impor- tant to know that the enforcement of one sector’s interests over another must be avoided.

The work plan for beneficial ownership must be implemented as soon as possible in order to comply with the new standard. Defining the concepts and regulatory frameworks must be followed by defining how the information will be implemented and published; this includes procedures, protocols and regulations for Guatemala EITI. For EITI Peru, instruction manuals are required to materialize the procedure and to identify politically exposed individuals.

This process requires serious commitment from the CNT and the Technical Secretariat, who will take about two years to obtain the information before it can be distributed. This indicates that the concept of beneficial ownership will be complicated and requires a long process of comprehension, agreements and dissemination that will have to be done in an agreed upon manner, with the participation of the three sectors. The work plan must be implemented as of June 2017 and in 2020 the true beneficial ownership data must be published in the conciliation report.

Awareness, information, guidance, etc., for implementing EITI on a regional level must be financed by the Ministry of Energy and Mining, therefore, it is necessary to include this industry in the budget.

The EITI Technical Secretariat must provide technical support and to be present throughout the process.

The decision regarding EITI implementation on a Sub-Natio-nal level must be taken by the CNT, who also must know that the information would be shared on a regional level regarding regional transfers and how those resources have been invested. Departmental and municipal governments must also be asked to participate.

The process should link investment coming from extractive industries with the local plans for sustainable development.Companies are interested in the population having informa-tion on what they are paying the State and how it returns those payments to each of the regions in the country.

Civil Society manifests interest in making contributions to the regional EITI process.

After hearing Peru’s experience in detail and Guatemala’s proposal, it is advised:

• To clearly define the working methodology • To consider having themed, multidisciplinary and multi-stakeholder tables.

Peru’s comment: The initiative’s awareness process is impor-tant at the regional level where Guatemala is planning on developing it. Results and their follow up are left pending.Regionalization in Guatemala starts from creating awareness of information regarding the extractive industry, but expres-ses expectations from local actors; the challenge is to see how CNT can address those concerns.

The process enables an approach between authorities and communities, strengthens social auditing and makes contributions to municipal governments visible. This could motivate municipal governments to participate in the implementation of this initiative.

• The conciliation report is a priority to maintain status as the compliant country’s.• To accelerate financing to be able to hire the consultant who will draft the report.• To define which State entity will manage the donation offered by the World Bank. • To create awareness of the ToRs (Terms of Reference) proposal for drafting the conciliation report with all sectors to collect contributions.

After learning about Peru’s validation process, EITI Guate-mala concludes that: • Formal communications with the EITI International Secreta-riart are required in order to obtain specific information and validation for Guatemala. To inquire specifically witch steps are to be taken and a work timeline.• To get acquainted with the evaluation form in relation to what aspects will be evaluated. For validation, CNT must fill out a form just like Peru does. • The clear and participative definition of the terms for the validation process are important, as well as documenting the entire process from the beginning (to back it up).

• The validation process is long; it requires clarity over what there is to inform in order to get to work. • A pre-validation process by Guatemala’s CNT is proposed. Conduct a self-evaluation on 2017, with Peru’s support.• To prepare, directly consult with the secretariat asking for a simple list of what information EITI Guatemala requires to prepare. Note: EITI international is very detailed when asking for the information.

• The information management guideline used for Peru’s conciliation report was shown, as well as Guatemala’s outline for it. It was concluded that Guatemala’s outline requires major details in order to shape the guidelines for the develo-pment of the conciliation report.• A committee must be formed to work on said guideline, and it should be discussed with the CNT to incorporate other actors in the commission, mainly from the government. The Technical Secretary is a key element in the institutionalization of this process and its results.

• The role of the Ministry of Energy and Mining in Peru is to promote the initiative; this contributes to governance and to decrease conflict. • About the comprehensive communication strategy, Peru reports to be implementing information processes on a national and sub-national level. There are actors of the civil society who have contributed. Guatemala requires proper financial management for a permanent process of information in the country. • One of the requisites of the guidelines for granting mining and oil licenses is to count with an environmental impact assessment, which should be solicited in the local language of the area of intervention, process that is not being adequately fulfilled. It is being demanded that this requisites’ compliance ought to be verified.• In relation to the conciliation reports, it was concluded that: The CNT shall guarantee that the information gathered is revised and validated so that when its handed to the Independent Administrator, it is relevance and quality can be guaranteed. The three parts of the CNT must organize by participative processes and the information; it must go beyond the numbers (This has been achieved in both countries). The role of the Techni-cal Secretary is vital in this task, as she must be the driving force and developer of the instruments, processes and practices to achieve quality and timely reports. The rates of completed reports provide quantitative criteria.• It is ideal to have the same quality and quantity of information of the industries and the government, that is, to have the information both from in the most disaggregated way as possible, in a national, regional and municipal level. It is necessary to demonstrate how the resources coming from the industry reach the communities; this can help to contribute the reduction of conflicts generated by the industry in the countries.• Civil society must assume the leadership role of constantly promoting commitment towards the quality of the reports, of participation and of contributions from government and private sectors.• In relation to the decision of initiating a regional experience of awareness of EITI Guatemala, the institutionali-zation of the experience is considered a fundamental factor of success, for local governments to monetarily support these processes. Some sector must handle payments from the industry to the State, through the Minis-try of Mining –as is the case in Peru- to be destined to strengthen regional exercises. • The role of civil society in regionalization must be broad, inclusive and extensive in convening. If good processes of regionalization are achieved, conflicts associated to the subject may decrease, as what would be attacked are the causes, not the effects.

4.2.2 Civil Society Sector:

• Promoting the initiative from the State, through related departments or instances that contribute to transparen-cy, knowing that EITI’s main objective is precisely transparency. Unlike Peru, Guatemala’s activity generates, which is why ways in which the activity could reduce conflict are sought out.• Establishing compromises from different bodies of the State. Starting from the extent to which EITI aims to reach. Clearly defineing the participants in the commission (to promote, inform, etc.) and in the report (those who contribute with information for the report).• The municipalities’ model of implementation needs improvement in order to generate options that can impro-ve people’s quality of life through resources that they receive from the industry. • It is necessary to clearly institutionalize the EITI’s operating body, make progress on the executive secretary in order to make the process sustainable.• It is necessary to establish permanent communication mechanisms with communities so that they are aware of the reports’ results.• To reactivate the industry that promotes community development, and for that it is necessary to incorporate academia, considering its potential to contribute to the process in the country.

4.2 Participants meet by sector:In both encounters, workshops were conducted for each sector of both countries with the aim of going through sectorial agendas. Of these, the following points were found as main and common points discussed:

• The EITI standard provides a platform for the initiative and the CNT decides the scope it wants to reach taking the standard as a base. The EITI standard has been dynamic through time, it changes frequently.• More than the number, it is how much representativeness the companies that participate in the sector have, and how they are organized to be represented. The materiality is what is important, and in general it is achieved with big companies.• Peru’s experience shows that there are companies that have joined and others whohave withdrawn, but there is a core number of companies that remain. • In the validation process, it is important to look at how relevant the number of companies is. The evaluators asked why the 200 companies that exist in Peru are not in this number, but this generates more costs and the participation of some companies is minimal.• There is similarity between the problems and concerns between Guatemala and Peru. For example, concerns regarding exposure and the vulnerability of the real beneficiaries. It is not clear yet how to define beneficial ownership, work must be done on this. Communications with Peru will be maintained to share the advances of each country.

4.2.3 Private Sector:

• The role of the State is to enable the EITI initiative. It must improve its communication and outreach role.• Consensus is achieved when all three parts yield and have something to gain, not when interests of one sector over the others are imposed. Consensus contributes to process sustainability. • The EITI standard is the basis for the implementation of the initiative, but each country decides how far they want to go with it.• The EITI implementation on a regional level is a CNT´s decision and requires political support from the Minis-try of Energy and Mining. Its implementation needs support from the Technical Secretary.• To take advantage of virtual mechanisms in order to maintain the remote exchange with Peru.• The political commitment from the Vice-President of the Republic towards supporting EITI and the CNT was confirmed. It is necessary to reflect on whether this opportunity is being maximized in EITI Guatemala.• The Ambassador to Peru in Guatemala clearly expressed his wish to support or oversee support to continue with these exchanges.• To be part of an international Initiative allows exchanges, which are very enriching. To understand how other countries have dealt with common problems and opportunities, truly contributes in improving performance.• The Conciliation and Validation processes must be faced with commitment and responsibility. They must be led by the government sector with the active participation of the other sectors.• Including the other sectors to contribute and enrich the EITI process (universities – as is the case in Peru – and study centres) is, in Guatemala, a pending matter that must be addresseded.• EITI Guatemala has a second semester 2017 and a first semester 2018 that are very committed with results for the country: Conciliation Report 2016, implementation of a roadmap for beneficial ownership, Validation Process 2018, Annual Work Report of 2016 and the elaboration of a 2017-2018 work plan. Institutionalizing the EITI GUA executive body, a new regulatory framework, that is visionary, actual, and projected as a State.

4.3 Observations and/or final conclusions of both meetings: Discussions in the meetings permitted conclusions to be drawn. The most important ones are mentioned below:

• The government agreement was drafted, the legal work was done in the corresponding entities but there was no consen-sus regarding financing the initiative, which is why it has not been published yet. Work is on going to follow up with the publication of the government agreement, considering Peru’s and other countries’ experiences. A specific plan of action was agreed upon to finally achieve its publication.

• An internal regulation proposal for the CNT was drafted but not discussed because the agreement has not been published. • The comprehensive communication strategy was drafted as a proposal by the SC organizations that make up the CNT. Said proposal was presented, discussed and approved by the CNT. A launch forum was held in three languages: Spani-sh and two local languages. The prioritized areas were 18 municipalities where there is not either mining or oil extrac-tion. There were radio spots on rural radio stations and municipal workshops were held to communicate the initiati-ve, having printed materials available in those workshops (brochures and booklets) to create awareness of the initiative and give information about the contributions made by the industry to central and local (municipalities) governments. Other workshops were held in municipalities were there’s mineral extraction to communicate other contributions in charge of the Ministry of Energy and Mining. The extractive companies financed a brochure and the logistics of the municipal workshops. An agreement has been reached for the department of Petén to keep spreading information about oil’s contributions. (Due to the work done in this area, the specific results will be detailed later)• A design for the EITI GUA website was selected. All the information was migrated from the existing format to formali-se the new format.

• Four events have occurred, two for planning and two for exchanging experiences between representatives of the sector before EITI Peru and Guatemala. Three meetings have happened in Guatemala, and one in Peru, besides using virtual media to share information.• There was mapping of the actors of the sector; some organizations were informed beforehand due to their profile related to the subject. New approaches towards organiza-tions that have shown interest in joining in EITI. • The plan to strengthen capacities of the SC was elaborated and implemented in a participative manner. It is necessary to evaluate new needs in training members of the SC and to define a permanent training system. Likewise, the SC has agreed on internal regulations, which have allowed it to establish its organization and its representation at the CNT.

• There were four (4) meetings, two for planning and two for sharing with representatives from the EITI sector in both countries. A meeting in Peru, two in Guatemala, and a virtual one to foster exchange between them. This exchange was between mining and oil companies.• A proposal has been drafted for the redesign of the EITI website as to facilitate a link between the EITI and the companies and organizations of the Civil Society. All informa-tion is being migrated to the new format and work is being done to link related pages.

6. The triangular cooperation experience is systematized.

7. EITI Guatemala has implemented a regional exercise of information sharing.

7.1 To begin a focused socialization and information sharing process of the initiative in Alta Verapaz, defining a work route with regional actors in Alta Verapaz. 7.2 To support the regional work plan implementation.

6.1. Systematize the project’s process

• Elaborated proposal disseminated by CONGAV (civil society organization in Alta Verapaz) and approved by the CNT.• Focused socialization and information sharing exercise about the initiative that EITI conducted in Alta Verapaz.• There are consumables and demands identified for the region’s follow up process. (More details on this process will come later)

• The triangular cooperation experience has been systema-tized in order to systematize the knowledge acquired for the parties involved and for others who are interested in a similar exercise

One of the most important duties for Guatemala to comply with the EITI standard is the management of information and that it is made public in order to make processes in the extractive industry more transparent. One of the means used for this is the EITI Guatemala website, althou-gh the use of other media accessible to the entire popula-tion is required. In that sense, taking EITI Peru’s experien-ce in the dissemination of information of the initiative, a comprehensive EITI communication strategy has been defined, which contemplates improving the website, design and broadcast radio advertising and print media which reach the population where the extractive activities will be carried out.

The Comprehensive Communication Strategy – ECI (for it is Spanish initials) – was developed through joint effort by organizations from the civil society and industries from the extractive sector, with support from the German Coopera-tion GIZ. The strategy was analyzed, debated and appro-ved in the National Work Commission - CNT - (Minutes 04 y 06 - 2016).

On November 29, 2016 the ECI for EITI Guatemala was launched, under the context of the International Forum: “Communication for Transparency”. This project includes the development of dissemination of information related to the extractive sector, which was determined as effective channel of communication for the EITI-Guatemala initiative and its objectives, those ones related to transparency as well as in favour of establishing mechanisms for dialogue between the parts involved in the sector for conflict resolution.

The selected municipalities for the socialization activities are the following:

decreasing conflict in subjects related to extractive indus-tries.• To develop community leaders with basic knowledge on social auditing, its practices and the benefits it generates in favour of governance.• To develop community leaders with basic knowledge on sustainable development and the importance of thinking about projects that guarantee this type of development. To teach them the importance of balancing environmental, economic and social sustainability.

5.2.2 Development of Mate-rials for an Integral Communi-cation Strategy (ECI)The strategy involved creating audio-visual material (radio ads and print material) in Spanish and local languages (Mam, Queqchi). The material was reviewed, analysed and approved by the CNT and financed through contribu-tion from the civil society, the private sector and the German Cooperation through the triangular cooperation project.

5.2.3 Integral Communication Strategy (ECI) Dissemination The dissemination of the EITI information was carried out through different stages of workshops aimed to groups selected by the aforementioned municipalities. Some of the participants were: community leaders, members of Non-Governmental Organizations -NGO’s-, Community Development Councils - COCODE - and members of Municipal Councils of the different municipalities selected. The subjects included:• The importance of the Extractive Industries

• EITI Guatemala• Contributions coming from the Extractive Industries to Central and Local Governments • Social Auditing to Local Governments; and • Sustainable Development: environmental, social and economic

During the workshops, brochures, and explanatory booklets were handed out, both in Spanish and the local Mayan language. A radio advertising campaign was also included, with a frequency of six daily airings of 30 seconds each (broadcasted by the national radio network FGER, through 11 radio stations and coverage in the prioritized municipalities).

5.2.4 Methodology of Dissemi-nation of the ECIThe dissemination work was carried out through approa-ching and coordinating with municipal authorities, who exercised leadership roles during the meetings. The workshops were participative, indigenous people, women and youth as participants. The workshops began with an assessment of the participants’ previous knowledge on the subject and concluded with a monitoring exercise of the new knowledge acquired.

5.2.5 The criteria for the guest selection was: 1. Presidents or vice president representatives of the COCODES.2. Municipal Planning Office Representatives.3. Representatives of NGO’s of the area.

• Invitations to groups of interest must be sent through the Municipalities in their role as local leader, however, this process requires EITI support.

• EITI is still perceived, by those who know little about it, as an ally to mining and oil or an ally of the State. This percep-tion makes the population averse to participate in activities programed by EITI.

• There is a lot of misinformation and lack of knowledge on the EITI subject in the Guatemalan departments.

• This process requires sufficient time for organizing and coordinating events.

• It is important to take into account each municipalities’ socio-political dynamics in regards to their agendas in order to schedule event dates with greater certainty, and improve assistance in this manner.

• Taking into account that the population has a low level of schooling, it is necessary to elaborate information mate-rials that are easy to comprehend. In addition, workshops must be carried out in the local language.

• EITI-Guatemala should the allocate resources for communication and information dissemination in specific and permanent budgets.

• It is recommended to maintain communication and information processes, like EITI Peru does, taking into account that this a requirement of the EITI Standard.

The exchange encounters between EITI Guatemala and EITI Peru provided in depth knowledge on the experience, best practices and lessons learned that Peru has had in exercises so called Subnational EITI. This experience motivated Guatemala to conduct a regional exercise based solely in spreading information on EITI and data from the national conciliation report regarding extraction and payments to the regions’ municipalities (there was no EITI decentralization exercise, as the one practiced in Peru).

Alta Verapaz was the selected region for this exercise because of the interest showed by the representatives of the civil society sector in the National Working Commis-sion and because there are important extraction projects in its territory, mainly oil.

Making the EITI Initiative known to key actors and sectors in Alta Verapaz, promoting EITI regulatory and operative frameworks for approaching the social and political gover-nance sectors and transparency as results of multi-stake-holder, participative exercises.

5.3 EITI Regional Exercise ofDissemination of Information

5.3.1 Objectives

• To share EITI’s goals and objectives as a multi-stakehol-der space for dialogue on transparency in the extractive industries with key actors in the Alta Verapaz region. • To share the EITI conciliation report results on a country level, emphasizing departmental and municipal data.

Specific Objectives

The subjects shared were the following: EITI concept and regulations, governance of the multi-stakeholder group (Guatemala CNT), social conflicts, accountability within the EITI framework, sharing data of the conciliation report in a disaggregated manner, tax and non-tax payments, local governments’ responsibilities in accountability, and legal framework of the extractive industry.

The methodology included selecting organizations and groups of the area to convene, taking into account the following: • Farmer and indigenous organizations • Civil Society Organizations (CSOs) and academic sector. • Governmental Organizations (GOs) and extractive companies • Municipalities of the department, organized by micro regions.

To go over the subjects, on-site workshops were carried out with the previously mentioned organizations. The workshops began with a diagnosis of the basic knowledge on the subject, and it ended by monitoring the new knowledge acquired. Participation of indigenous people stands out.

• It important to consider the necessary time for planning and implementation processes, taking into account that local actors have diverse compromises that they have to attend.• The population generally rejects the subject of extractive industries, but once dialogue on the subject can be established, attitudes can become more flexible.

• To program events with representatives from organiza-tions participating in that event, so that events are not scheduled over others, taking into account these are dynamic organizations with tight agendas.• Take into account the socio-cultural context of the popu-lation before implementing these processes.

Below it is discussed what was identified through interviews to EITI-Guatemala members. In addition, repre-sentatives from all EITI Guatemala sectors participated in a workshop in which a final monitoring exercise involved Debriefing (a Capacity Works tool), the report from that exercise received contributions from EITI Peru. The most important points are summarised below. 6.1 Best practices in the TCP• Participatory definition (taking into account communica-tions elements of EITI Peru), of a comprehensive commu-nication strategy through which information on extractive industries and EITI could be given to the places in the country with extraction sites.• Civil society assumes leadership in the elaboration and implementation process of the comprehensive communi-cation strategy. • Private companies made important contributions on implementing the communication strategy in Guatemala (covering costs of printing the information booklets and payment of logistics for the information awareness works-hops), in addition to the contributions to the contents of the dissemination material.• Meetings between sectors of both countries were carried out in order to exchange realities and experiences in the search for solutions to problems that arise from implemen-ting the initiative. • Peru values the participation of civil society organizations from the interior of the country in the CNT of Guatemala.

• Encounters by sectors (independently) from both coun-tries allowed discussions with greater confidence regar-ding concerns and experiences between each particular sector.

6.2 Success factors • Exchange as a mechanism for sharing knowledge gene-rates trust. • Willingness from all the EITI sectors’ from both countries’ to share and exchange experiences and knowledge. • Political support towards the process’ implementation on the part of EITI Peru and the Vice-President of Guatemala. • Virtual media was well used in facilitating the exchange of experiences between both countries. • Participatory development of annual planning and moni-toring exercises for the cooperation project between EITI Guatemala and EITI Peru, with participation form the multi-stakeholder groups from both countries.• Participation and sustained commitment from the civil society and companies to the TCP. Additionally, more frequent participation from governmental institutions was insisted upon.• Stability in the makeup of the Technical Secretary and the National Commission of EITI-Peru throughout the project; this allowed EITI-Peru to offer continuous support during the project.

7.1 Lessons Learned • In order to advocate and to have an impact on the decisions made by the CNT, civil society organizations need to improve their organization and develop capabili-ties to manage information and to-have knowledge on the processes related to the initiative.• Generating the necessary trust to work together requires face-to-face encounters between both countries.• During the project´s implementation, the participation and responsibility levels of EITI Guatemala and EITI Peru sectors could have been improved.• Greater involvement of the Guatemalan CNT members is required in the activity planning process in order to establi-sh responsibilities for its implementation.• It is important to put together technical teams in order to formulate expert opinions and specific proposals that improve the quality of EITI Guatemala processes. The CNT is already working on appointing these teams to issue proposals or opinions that facilitate their decision-making.• It is necessary to define a sustainability and self-finan-cing mechanism for the initiative and for the processes that EITI GUA implements, as it is already done in Peru.• The organization and documentation of the information that EITI produces can be improved, creating a platform for information management based on the EITI standard.

• The Guatemala CNT representatives that participate in national and international events must submit full reports.• In exchanges between countries, it is necessary to consider that experiences should be shared and adapted to the conditions and context of the receiving country. It is necessary to find an opportunity to know the experience of other countries, a regional network could be a space for exchange.• Mechanisms for communication (including virtual platfor-ms) and coordination can be improved in order to optimize learning and information exchange possibilities between EITI Guatemala and EITI.

7.2 Limitations/constraints in the execution of TCP: How to prevent them?• On occasion, lack of commitment from some members to get actively involved in the TCP activities was observed. This limitation was seen in the exchange events were the necessary participation from all sectors was not achieved. To improve commitment and participation, it is necessary to give EITI members more involvement in planning and distribution of responsibilities.

• Communication and coordination mechanisms were not always the most adequate and dynamic between EITI Guatemala, EITI Peru and the GIZ team. This made sche-duling events more difficult. Therefore, defining a clear communication mechanism from the beginning of the project is key.

• The processes were discussed and approved in the

Guatemala CNT but there was no constant information on

specific agendas and advances, which limited some

sectors’ participation in said processes. Therefore, appro-

val is important but informing about concrete plans and

agendas motivates participation from all sectors.

• Participation from members of the governmental sector

was limited in Guatemala, especially in the opportunities

for discussion of subjects of interest by sector.

7.3 Challenges presented during the TCP implementation. How to keep them in mind?

1. Implementing the EITI-Guatemala communication

strategy and the focalized dissemination of EITI informa-

tion required a clear conflict-sensitive approach because

social manifestations related to extractive projects have

increased in Guatemala. This requires constant reflection

with contributions from all sectors in order to identify possi-

ble unwanted effects with the interventions and incorpora-

ting the agreed upon actions within the project’s plans.

2. EITI Guatemala’s sustainability (budgetary) as a funda-

mental element for the processes not to be interrupted.

The EITI implementation requires a budget that should be

considered by the corresponding State entity, as it is

currently done in EITI Peru. Otherwise, the EITI processes

will not be carried out in a permanent manner. All the

resources necessary must be allocated in order to deve-

lop a permanent information dissemination process about

EITI on a national level.

3. It is important to achieve a political agreement to publi-

sh the governmental agreement with a legal basis for the

participation under equality of conditions of all EITI Guate-

mala sectors, as already accomplished in EITI Peru. Even

though in practice this dynamic works, the processes

need to be legalized in order to be institutionalized.

4. The political crisis in Guatemala caused many changes

in authorities, which affected the established sequence of

participation in the processes. The permanency of EITI

members facilitates continuity and fluidity in the proces-

ses. EITI Peru held the same people responsible of the

transfer of experiences throughout the whole process.

5. It is necessary to improve commitment and the level of responsibility from actors to achieve better results in exchange exercises such as this. To address this challen-ge and motivate a more active involvement, more informa-tion on the processes being implemented need to be brought to the EITI table of both countries. 6

• In the EITI Guatemala CNT, the three sectors have equa-lity in conditions to take decisions, despite not having updated the governmental agreement to this date.• The systematized EITI Peru experience is available in Spanish and English.• The EITI Guatemala comprehensive communication strategy was defined by the civil society, approved by the CNT and implemented by organizations from the civil society in three languages: Spanish and two local langua-ges of the selected areas (16 municipalities), where extraction activities occur. • The new capabilities of the civil society (exchanges with EITI Peru, new internal regulations, better organization, training) have allowed them to have an impact on the CNT decisions.• EITI Guatemala CNT has more agile processes for decision-making. • There is more in-depth mutual knowledge between sectors that make up the CNT, which has permitted the development of trust in collaborative work between the different sectors that comprise it. • Exchange mechanisms have been institutionalized between sectors that make up the national commission of EITI GUA and EITI Peru. • Clear rules exist which facilitate organization for repre-sentation and participation from the civil society of EITI Guatemala.• More people in Guatemala have information about EITI and about the contributions the government receives from the extractive industry. • Civil society organizations have joined, representing Guatemala in regional networks of the sector, which shows progress on subjects of transparency in extractive indus-tries.

• EITI is on route to become a mechanism for reducing social conflict in extractive projects.• It has´ been demonstrated that the multi-stakeholder table principle is a good mechanism for dialogue and transparen-cy, which can be replicated in other productive sectors.

8. EITI-Peru has strengthened its capacities to transfer experiences and knowledge on good governance for its extractive activities.

The implementation of the TCP has opened new fields of cooperation between both countries, however, it is neces-sary to keep in mind that a constant follow-up is required in order to make the most out of this opportunity of conti-nued cooperation.

• Technical secretaries of both countries must establish a communication mechanism around subjects and work agendas that are established according to the EITI standard. This will facilitate the implementation of said agendas.• Keeping the links of communication and coordination in each sector of both countries to continue with the exchan-ge of information and of experiences regarding their respective EITI responsibilities.• Defininge a common agenda for exchange between both countries based on the compromises they have made as countries compliant with the EITI standard (a post-project agenda must be defined in order to promote a permanent exchange).• Both countries can share their cooperation experience with others who already implement or are considering the implementating EITI, in order to motivate exchange between countries.• The EITI implementation can be an instrument to promo-te participative and multi-stakeholder dialogue in places of conflict.• Communication is an important factor to achieve trans-parency, and should be implemented in a permanent manner in EITI Guatemala, as it done in EITI Perú.

• The experiences that Guatemala and Peru have develo-ped in this exchange process relating to the EITI imple-mentation can be useful to other countries, as the same commitments and challenges for implementing the activity exist.• It needs to be highlighted, that creating a space for exchange requires political will and technical capacity from both countries to achieve the best results.• The project’s implementation has generated an expe-rience on good practices and lessons learned that, when put into practice in new cooperation processes, could improve the exchange results.• This systematization document collects the TCP expe-rience in an organized manner, from a perspective of knowledge management so that it can be useful in similar exchange processes.• The creation of a regional exchange network in the EITI implementation can be very valuable to generate a space using virtual and on -site means- for mutual learning between countries that have joined the initiative or are about to do so.• TCPs generate opportunities, which should be taken full advantage of.
